WHEREAS, the City of Boynton Beach operates and maintains Boat Club Park;
WHEREAS, the City presently has no user fee schedule for boat launching and
trailer parking at Boat Club Park;
WHEREAS, due to the increasing cost of maintenance of ramps at the Boat Club
Park, staff has recommended that the Commission adopt an ordinance establishing an
annual and daily boat launching and trailer parking user fees for the Boat Club Park;
WHEREAS, the City Commission of the City of Boynton Beach, Florida upon
recommendation of staff, has determined that it is in the best interests of the citizens
and residents of the City to amend the Code to create and establish a boat launching
and trailer parking user fee for the Boat Club Park.
NOW, THEREFORE, BE I'T ORDAI'NED BY THE C1.TY COMM1.SS1.ON OF
THE C1'TY OF BOYNTON BEACH, FLOR1.DA, THAT:
Section :1. That Chapter 16," Parks and Recreation'; Article I! "City Parks and
Beaches" is hereby amended to create Section 16-61 "Boat Launching and Trailer
Parking User Fee at the Boat Club Park'; Florida is hereby amended by adding the
words and figures in underlined type, as follows:

16-61. Boat launching and trailer parking user fees at Boat Club Park;
Section l. The purpose of this section is to establish an annual and daily boat
launching and trailer parking user fees for the City's Boat Club Park.
Section 2. The City shall charge a $50.00 annual decal fee and $:[0.00 daily
fee for non-decal holders.
Section 3. The City shall not differentiate between residents and non-residents
of the County or the State while processing decal applications
Section 4. Annual decal will be issued to an applicant on an annual basis

Section S. Daily user fee will require the user to obtain a daily decal which
expires 24 hours alter issuance.
,Section 6. Unpermitted boats, vessels and trailers are subject to a $25.00 fine.
Section 7. Enforcement: The City Police Department is hereby given the power
and duty to enforce this article and shall have the power to make lawful arrest:;
for the violation of the provisions hereof. Anyone found to have violated any
provision of this section shall be punished as provided for in this chapter or a.,;
otherwise by law.
Section 8. Should any section or provision of this ordinance or portion hereof,
any paragraph, sentence or word be declared by a court of competent
jurisdiction to be invalid, such decision shall not affect the remainder of this
ordinance.

Section 9. Authority is hereby granted to codify said ordinance.
Section lO. This ordinance shall become effective immediately upon
passage.
