AN OP~INANCE OF THE CITY COUNCIL OF THE CITY
OF BOYNTON BEACH, FLORIDA, AMENDING APPENDIX
A - ZONING OF THE CODE OF ORDINANCES, CITY
OF BOYNTON BEACH, BY AMENDING SECTION 7.
PLANNED INDUSTRIAL DEVELOPMENT DISTRICT.,
E. USES PERMITTED, TO PROVIDE THAT ALL
PERMITTED USES COMPLY WITH THE PERFORMANCE
STANDARDS OF SECTION 4-N OF THE ZONING CODE;
BY PROVIDING THAT CERTAIN USES SHALL REQUIRE
THE ISSUANCE OF AN ENVIRONMENTAL REVIEW PEP~IT;
PROVIDING THAT EACH AND EVERY OTHER PROVISION
OF SECTION 7. PLANNED INDUSTRIAL DEVELOPMENT
DISTRICT. SHALL REMAIN IN FULL FORCE AND EFFECT
AS PREVIOUSLY ENACTED; PROVIDING AUTHORITY TO
CODIFY; PROVIDING A CONFLICTS CLAUSE, A SEVEPABILITY
CLAUSE, AND AN EFFECTIVE DATE; AND FOR OTHER
PURPOSES.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
~HE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1: APPENDIX A - ZONING, Section 7. Planned
£ndustrial Development District. E. Uses permitted, of the Code
of Ordinances, City of Boynton Beach, Florida; is hereby amended
to read as follows:
E. USES PERMITTED.
In the PID, a building and its customary
ancillary structures and land uses may be
erected, altered and occupied for any office,
professional, business (wholesale or retail)
or industrial use provided that such use or
uses is(are) approved by the Planning and
Zoning Board. In approving uses in the PID,
the Planning and Zoning Board shall make
findings that the use or uses proDosed will
not be in conflict with the performance
standards listed in Section 4-N of these
zoning regulations, and that the use or uses
proposed is(are) consistent with the intent
and purpose of this section.
In addition, uses permitted are subject to
limitations as follows:
1. Outdoor storage of materials may be
permitted based on a finding by the Planning
and Zoning Board that such storage does not
exceed fifteen (15) per cent of the total
square footage of the building site and that
such storage is screened and fenced to preclude
exposure to the public; and
2. Ail uses proposed which are listed in
Section 8-A-3 shall require the issuance of
an en review permit as set forth
in of these zoning regulations.
Section 2: Each and every other provision of APPENDIX A -
IZONING. Section 7. Planned Industrial Development District. shall
remain in full force and effect as previously enacted.
Section 3: Specific authority is hereby given to codify
~his Ordinance.
Section 4: Ail ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Section 5: Should any section or provision of this
Ordinance or any portion thereof be declared by a court of competen
jurisdiction to be invalid, such decision shall not affect the
remainder of this Ordinance.
Section 6: This Ordinance shall become effective
immediately upon passage.
