O85-12oRDINANCE NO. 85- ! ~" AN ORDINANCE OF THE CITY ODUNCIL OF THE CITY OF BOYN~ON BEACH, FLORIDA PROVIDING FOR THE HOLDING OF A SPECIAL BOND ~JNICIPAL ELECTION IN THE CITY OF BOYNTON BEACH ON MARCH 12, 1985, AND DECLARING TH~W THIS ORDINANCE SHALL TAKE EFFECT IMMEDIATELY UPON ITS ADOPTION. WHEREAS, on Feb~u~ary 5 , 1985, the City Council of the City of Boynton Beach duly passed and adopted an Ordinance authorizing the issuance, subject to an election called to be held on March 12, 1985, in conjunction with the the regular z~lnicipal election to be held on such date, of bonds of the City of Boynton Beach; and WHEREAS, it is necessary for the City Council to prescribe immediately the method and manner of holding said election and provide for notice thereof. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEA/UH, FLORIDA: Section 1. Notice of said election shall be published in the Palm Beach Post, a newspaper published and of general circulation in the City of Boynton Beach, at least twice, once in the fifth week and once- in the third ~ prior to the week in which the election is to be held, the date of first publication in said newspaper to be at least thirty (30) days before said election, which notice shall be substantially in the following form: NOTICE OF SPECIAL BOND ELECTION to be held on Tuesday, ~arch 12, 1985 CITY OF BOYSH12~ BEACH, FLORIDA ~ provided by an Ordinance duly passed and adopted by the City Council of the City of Boynton Beach on February. 5 , 1985, a special bond election will be held on Tuesday, March 12, 1985 for the purpose of suhnitting to the qualified electors of the City of Boynton Beach, Florida, the following question: Shall bonds of the City of Boynton Beach, Florida, in an aggregate principal amount not exceeding $3,500,000 be issued for the purpose of providing funds, together with any other available funds, for paying the cost of acquiring and constructing a Civic Center in the City of Boynton Beach, together with necessary parking facilities and any equipment, fur- nishings and landscaping necessary or desirable in connection therewith, such bonds to mature at such time or times not exceeding thirty years from their date or dates as may be determined by the City Council, and to bear interest at a rate or rates not exceeding the maximum rate then permitted by law, and to be payable from unlimited ad valor~ taxes? The polls at said election will be open frcm 7 o'clock A.M. until 7 o'clock P.M. of the same day. Said election will be held at the same polling places in the several precincts of the City as the polling places for the regular municipal election held on the same day and the election officers who will conduct said special bond election will be the same as those selected and appointed for said regular municipal election. In accordance with the Constitution and election laws of the State of Florida and the Charter of the City of Boynton Beach, all qualified electors of the City of Boynton Beach, Florida shall be entitled to vote in the special bond election to which this notice per- tains. The City of Boynton Beach shall be authorized to issue the bonds covered by the question hereinabove set forth to the extent such issuance as to said question shall have been approved by vote of a majority of the qualified electors of the City of Boynton Beach voting thereon. Said special bond election shall be held at the same polling places in the several precincts, respectively, in the City as the polling places for the regular municipal election held on the same day, and the election officers who shall conduct said special bond election shall be the same as those selected and appointed for said regular m~nicipal election. Section 3. Betty Boroni, City Clerk of the City of Boynton Beach, Florida, is hereby designated and appointed as the official representative of the City Council in all transactions with the Supervisor of Elections of Palm Beach County in relation to matters per- taining to the use of the registration books and the holding of said special bond election. Section 4. The ballots used at said election for voting on the questions sukmitted shall be that portion of the cardboard or paper or other material within the ballot frames of the voting machines which shall contain a statement of the question submitted. Said ballots as they appear within the ballot frames of the voting machines shall be substantially in the following form: OFFICIAL SPECIAL BOND RT.VCTION MARCH 12, 1985 CITY OF BOYNTON R~JkCH, FLORIDA For Bonds Against Bonds Shall bonds of the City of Boynton Beach, Florida, in an aggregate principal amount not exceeding $3,500,000 be issued for the purpose of providing funds, together with any other available funds, for paying the cost of acquiring and constructing a Civic Center in the City of Boynton Beach, together with necessary parking facilities and any equip- ment, furnishings and landscaping necessary or desirable in connection therewith, such bonds to mature at such time or times not exceeding thirty years from their date or dates as my be determined by the City Council, and to bear interest at a rate or rates not exceeding the maximum rate then permitted by law, and to be payable from unlimited ad valoram taxes? Section 5. Electors desiring to vote for the issuance of said bonds shall use the stylus provided and punch the words "FOR BONDS" within the ballot frames containing the statement of the question relating to said bonds, and those desiring to vote against the issuance of said bonds shall use the stylus provided and punch the words "AC~%INST BONDS" within the ballot frames containing the statement of the question relating to said bonds. Section 6. Ballots containing the question set forth in Section 4 above shall be prepared for the use of absent electors entitled to cast such ballots in said election. Section 7. This. Ordinance shall be read in full at two separate meetings not less than ten (10) days apart and shall at least seven (7) days prior to its passage on second reading be noticed once in a newspaper of general circulation in the city of Boynton Beach, which notice shall state the date, time and place of the meeting at which this Ordinance will be passed on second reading, the title of this Ordinance, the place where this Ordinance may be inspected by the public and shall also advise that interested parties may appear at said meetings and be heard with respect to this Ordinance. Section 8. This Ordinance shall take effect immediately upon its adoption.
