AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA PROVIDING FOR THE HOLDING OF A SPH2IAL BOND RL~LTION IN CONJ~ION WITH THE REGULAR ~JNICIPAL EI2LTION IN THE CITY OF HOYNTON BEACH ON MARCH 12, 1985, AND DfF_LARING THD~ THIS ORDINANCE SHALL TAKE EFFECT IMMEDIATELY UP(/~ ITS ADOPTION. W~EREAS, on January /~ , 1985, the City Council of the City of Boynton Beach duly passed and adopted an ordinance authorizing the issuance, subject to an election called to be held on March 12, 1985, in conjunction with the regular municipal election to be held on such date, of bonds of the City of Boynton Beach; and WHEREAS, it is necessary for the City Council to prescribe immediately the method and manner of holding said election and provide for notice thereof. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOIrNTON BEACH, FLORIDA: Section 1. Notice of said election shall be published in the Palm Beach Post, a newspaper published and of general circulation in the City of Boynton Beach, at least twice, once in the fifth w~ek and once in the third week prior to the w~e~k in which the election is to be held, the date of first publication in said newspaper to be at least thirty (30) days before said election, which notice shall be substantially in the following form: NCTICE OF SPECIAL BOND Rr.FLTION to be' held on Tuesday, March 12, 1985 CITY OF BOYNTON B~_CH, FLORIDA As provided by an Ordinance duly passed and adopted by the City Council of the City of Boynton Beach on January /.~ , 1985, a special bond election will be held on Tuesday, March 12, 1985 for the purpose of suhaitting to the qn]_alified electors of the City of Boynton Beach, Florida, the following six questions: Sb~ll bonds of the City of Boynton Beach, Florida, in an aggregate principal amount not exceeding $2,650,000 be issued for the purpose of providing funds, together with any other available funds, for paying the cost of acquiring and constructing public safety facilities in the City of Boynton Beach con- sisting of the construction of additions to the existing Police and Fire Stations, the construction of a new satellite Fire Station, the construction of parking facilities to serve such public safety faci- lities, together with any equipment and furnishings necessary or desirable in connection therewith, such bonds to mature at such time or times not exceeding thirty years from their date or dates as may be determined by the City Council, and to bear interest at a rate or rates not exceeding the maximum rate then permitted by law, and to be payable from unlim- ited ad vmlorem taxes? Shall bonds of the City of Boynton Beach, Florida, in an aggregate principal amount not exceeding $1,000,000 be issued for the purpose of providing funds, together with any other available funds, for paying the cost of constructing an addition to the existing public library building in the City of Boynton Beach, together with any equi~m~ent and fur- nishings necessary or desirable in connection therewith, such bonds to mature at such time or times not exceeding thirty years from their date or dates as may be determined by the City Council, and to bear interest at a rate or rates not exceeding the maximum rate then permitted by law, and to be payable from unlimited ad valorem taxes? Shall bonds of the City of Boynton Beach, Florida, in an aggregate principal amount not exceeding $2,150,000 be issued for the purpose of providing funds, together with any other available funds, for paying the cost of developing park and recreational facilities in the City of Boynton Beach, consisting of improvements at Congress Avenue Ommuauity Park, Wilson Recreational Center and the Northwest Seventeenth Avenue Cc~uunity Center, together with any equipment and furnishings necessary or desirable in connection therewith, such bonds to mature at such time or times not exceeding thirty years from their date or dates as may be determined by the City Council, and to bear interest at a rate or rates not exceeding the maximum rate then permitted by law, and to be payable from unlimited ad valorem taxes? Shall bonds of the City of Boynton Beach, Florida, in an aggregate principal amount not exceeding $1,100,000 be issued for the purpose of providing funds, together with any other available funds, for paying the cost of renovating the City Hall in the City of Boynton Beach and constructing parking faci- lities to serve the City Hall, together with any equipment and furnishings necessary or desirable in connection therewith, such bonds to mature at such time or times not exceeding thirty years from their date or dates as may be determined by the-City Council, and to bear interest at a rate or rates not exceeding the maximum rate then permitted by law, and to be payable from unlimited ad valorem taxes? Shall bonds of the City of Boynton Beach, Florida, in an aggregate principal amount not exceeding $1,600,000 be issued for the purpose of providing funds, together with any Other available funds, for paying the cost of constructing a public works building and a parks maintenance facility, together with any equipment and furnishings necessary or desirable in connection therewith, such bonds to mture at such time or times not exceeding thirty years frem their date or dates as may be determined by the City Council, and to bear interest at a rate or rates not exceeding the maximum rate then permitted by law, and to be payable from unlimited ad valorem taxes. The polls at said election will be open frcm 7 o'clock A.M. until 7 o'clock P.M. of the same day. Said election will be held at the same polling places in the several precincts of the City as the polling places for the regular mnnicipal election held on the same day and the election officers who will conduct said special bond election will be the same as those selected and appointed for said regular municipal election. In accordance with the Constitution and election laws of the State of Florida and the Charter of the City of Boynton Beach, all qualified electors of the City of Boynton Beach, Florida shall be entitled to vote in the special bond election to which this notice pertains. The City of Boynton Beach shall be authorized to issue the bonds covered by the questions hereinabove set forth to the extent such issuance as to any of said questions shall have been approved by vote of a majority of the qualified electors of the City of Boynton Beach voting thereon. By order of the City Council of the City of Boynton Beach, Florida. city Clerk Section 2. Said special bond election shall be held at the same polling places in the several precincts, respectively, in the City as the polling places for the regular municipal election held on the same day, and the election officers who shall conduct said special bond election shall be the same as those selected and appointed for said regular municipal election. Section 3. Betty Boroni, City Clerk of the City of Boynton Beach, Florida, is hereby designated and appointed as the official representative of the City Council in all transactions with the Supervisor of Elections of Palm Beach County in relation to matters per- taining to the use of the registration books and the holding of said special bond election. Section 4. The ballots used at said election for voting on the questions suk~itted shall be that portion of the cardboard or paper or othermaterialwithinthe ballot frames of the votingmachines which shall contain a statement of thequestions submitted. For Bonds ~ainst Bonds Shall bonds of the City of Boynton Beach, Florida, in an aggregate principal amount not exceeding $1,600,000 be issued for the purpose of providing funds, together with any other available funds, for paying the cost of constructing a public works building and a parks maintenance facility, together with any equipment and furnishings necessary or desirable in connection therewith, such bonds to mature at such time or times not exceeding thirty years frcm their date or dates as may be determined by the City Council, and to bear interest at a rate or rates not exceeding the maximum rate then permitted by law, and to be payable fr~m unlimited ad valorem taxes. Section 5. Electors desiring to vote for the issuance of said bonds shall use the stylus provided and punch the words "FOR BONDS" within the ballot frames containing the statsment of the questions relating to said bonds, and those desiring to vote against the issuance of said bonds shall use the stylus provided and punch the words BONDS" within the ballot frames containing the statement of the questions relating to said bonds. Section 6. Ballots containing the questions set forth in Section 4 above shall be prepared for the use of absent electors entitled to cast such ballots in said election. Section 7. This Ordinance shall be read in full at two separate meetings not less than ten (10) days apart and shall at least seven (7) days prior to its passage on second reading be noticed once in a newspaper of general circulation in the City of Boynton Beach, which notice shall state the date, time and place of the meeting at which this Ordinance will be passed on second reading, the title of this Ordinance, the place where this Ordinance may be inspected by the public and shall also advise that interested parties may appear at said meetings and be heard with respect to this Ordinance.
