Code Officer Lewis presented the case which arose as a result of a citizen complaint.
The initial inspection was January 31, 2008. Ten days was given to comply and was
given via written notice. Service was obtained by posting the property. The
Respondent was present and Officer Pierre translated.

Zilima Delhomme, 815 NW 6th Avenue was present and pled no contest. She
requested a year be given to allow her to correct the violations. She was having
financial problems.
Officer Lewis had photographs he distributed to the board and explained the history of
the property. The occupant allowed entry and Officer Lewis observed orange fencing
that was caving in, probably since the hurricane. The screening was torn out and the
doors were down. Officer Lewis believed there were some children living there and
noted an attempt was made to clean the pool. A child barrier would not pass as far as
a permitted barrier. They could repair the screen and door, to bring it back to the
original condition, or they could apply for a permit for a wooden fence. Some of the
trash and debris was cleaned, which was mainly in the back. There was nothing to
obstruct a small child from entering the area.
Motion
Based on the testimony and evidence presented in Case #08-346, Mr. Yerzy moved
that this Board find that Maudira & Zilima Delhomme are in violation of the City of
Boynton Beach Code Sections cited and moved to Order that the Respondents correct
the violations on or before March 29, 2008. The Board has considered the gravity of the
violations, the actions taken by the Respondents and any previous violations by the
Respondents and hereby orders that if the Respondents do not comply with this Order,
a fine in the amount of $100 per day for each day the violation continues past March 29,
2008 plus administrative costs shall be imposed. The Respondents are further ordered
to contact the City of Boynton Beach Code Compliance Division in order to arrange for
re-inspection of the property to verify compliance with this Order. Mr. Karageorge
seconded the motion that unanimously passed.
Officer Pierre translated for Ms. Delhomme the actions of the board. She explained
her husband left her, and she cannot do it in 10 days because she has to pay someone
to do the work, and the house was going into foreclosure. The City tried to assist her by
making some repairs to the house. In order for her to bring the property in compliance
she would need more time. She also requested clarification whether the ten days was
being given for the enclosure or clean the pool. Chair Costantino responded it was for
everything, but a safety hazard should be repaired first, such as the pool. She advised
she could secure the pool but cannot correct the entire violation within ten days. She
lived in the house since 1999.
Mr. Foot suggested leaving the order as is and to allow her to extend her best effort. He
explained the Respondent could come back for an abatement. The woman understood
and agreed.

Code Officer Guillaume reviewed the violations. A written notice was given and Notice
was posted on the property and at City Hall
Juvenal Suarez, 197 SE 2th Court, pled guilty and advised he cleaned the trash today
and removed the garbage. He explained he was told this morning that someone would
come back to check the lot at 5:15 p.m. but no one did. He had a truck and trailer and
was in the construction industry. He was told he could not keep the vehicles there, so
he purchased the lot, and was advised he could not keep them there either.
Officer Guillaume had photographs which he distributed to the board. There was one
pile of trash left outside and Mr. Suarez announced he made arrangements for a special
trash pickup.
Mr. Blasie explained in a residentially zoned area, licensed vehicles, boats or
construction equipment is considered exterior storage and it is not allowed. It was
explained the truck could remain at the home, but not the trailer.

Code Officer Pierre presented the case and explained the Respondent decided not to
sod, but the xeriscaping needed to be addressed. He advised the Respondent was in
the process of doing so and would need more time.
Sally Dalton, 650 Las Palmas Parkway, pled no contest. She advised she would need
more than a month because she prepares taxes and they were in season. She
requested six weeks to cure the violations.
Officer Pierre had photographs he distributed to the board.
Motion
Based on the testimony and evidence presented in Case #07-2872, Mr. Karageorge
moved that this Board find that Sally Dalton is in violation of the City of Boynton Beach
Code Sections cited and moved to Order that the Respondent correct the violation on or
before May 3, 2008. The Board has considered the gravity of the violation, the actions
taken by the Respondent and any previous violations by the Respondent and hereby
orders that if the Respondent does not comply with this Order, a fine in the amount of
$50 per day for each day the violation continues past May 3, 2008 plus administrative
costs shall be imposed. The Respondent is further ordered to contact the City of
Boynton Beach Code Compliance Division in order to arrange for re-inspection of the
property to verify compliance with this Order. Mr. Yerzy seconded the motion that

Code Officer Webb reviewed the case. The Respondent was issued a written notice
giving ten days to comply. Service was obtained via certified mail sent on February 12,
2008 and was accepted and signed for on February 14, 2008. The Respondent was
present.
Viergeuline Joseph, 344 SW 6th Avenue, pled no contest. She explained the property
was in the process of foreclosure. She did not have enough money to make the repairs
nor did she have the funds to stop the foreclosure.
The board discussed their options and noted foreclosures would be forthcoming and
was a sign of the times. This case was a hardship case; to assess a fine, dollar wise
was moot, because the funds were not there. Mr. Foot felt it would not be moot, but

only in the sense that work was done without the permit and if she did not have the
money, no work would be done. The work that was done was to enclose the carport.
Chair Costantino explained the fine would roll over to the purchasers of the house and
the violation would run with the land.
Attorney Alexander explained if the property was in foreclosure, there may be a Lis
Pendens, against the property. The violation would run with the land, but any fine that
would accrue would be foreclosed out if a Lis Pendens had already been filed on the
property. Officer Webb noted she had the Lis Pendens paperwork. The board noted the
issue would be passed on to the next property owner.
Motion
Based on the testimony and evidence presented in Case #08-338, Mr. Foot moved that
this Board find that Viergeulina Joseph & Marie Peteon are in violation of the City of
Boynton Beach Code Sections cited and moved to Order that the Respondents correct
the violations on or before April 18, 2008. The Board has considered the gravity of the
violations, the actions taken by the Respondents and any previous violations by the
Respondents and hereby orders that if the Respondents do not comply with this Order,
a fine in the amount of $50 per day for each day the violation continues past April 18,
2008 plus administrative costs shall be imposed. The Respondents are further ordered
to contact the City of Boynton Beach Code Compliance Division in order to arrange for
re-inspection of the property to verify compliance with this Order. Mr. Yerzy seconded
the motion that unanimously passed.

Code Officer Cain presented the case, which pertained to trimming or moving hedges.
The Hearing Date was January 16, 2008, and no one appeared. The Code Compliance
date and fine set by the board was to comply by January 26, 2008 or incur a $100 per
day fine. The violation still exists having 52 days of non-compliance.
Mr. Alencar, 633 Ocean Inlet Drive, advised the house belonged to his brother and
that he was authorized to speak on his behalf. He explained he was unaware of what
was occurring. The tenant cut a tree on the corner of the driveway and advised all was

corrected. He received a second letter and then they cut some bushes. The Officer
explained there was another shrub that needed to be cut. He retained someone to do
the work which would be done the next day.
Officer Cain noted this was a neighborhood complaint. He had photographs he
distributed to the board.
The board decided to table the case for 30 days and if not corrected, they would certify
the lien.
Motion
Mr. Foot moved that Case #07-3184 be tabled until the Code Compliance Board
meeting to be held on April 16, 2008. Mr. Karageorge seconded the motion that
unanimously passed.
Case #07-3304
Clorina Barthelemy
210 NE 20th Ave.
Officer Cain presented the case which pertained to interior renovations and alterations
including structural, electric and plumbing improvements that were made without the
proper permits. The Hearing Date was January 16, 2008 and the date and fine set by
the board was to comply by January 26, 2008 or incur a $100 per day fine. The
Respondent appeared at the hearing and was present also present for this hearing.
There were 52 days of non-compliance.
Officer Vestiguerne translated for Clorina Barthelemy and she advised she did all she
was asked to do. She hired an architect. The first one had a stroke but they returned
her drawings and the second contractor did the work. She submitted it and the Building
Inspector inspected the electrical at 9:00 this morning and passed it. The second
kitchen was gone.
Officer Cain had not inspected the property; but advised he visited the Building
Department and ascertained the Building Department had no record of any permits to
remove any plumbing or electrical from a kitchen. Ms. Barthelemy said she paid $180
for the permit. She received it but she left it at home.
Motion
Mr. Moyer moved that Case #07-3304 be tabled until the Code Compliance Board
meeting to be held on April 16, 2008. Mr. Yerzy seconded the motion that unanimously
passed.

Case #07-3423
Marcellus Jean Francois
238 SW 5th Avenue
Officer Webb reviewed the case which pertained to removing trash and debris and
oversized vehicles. The Notice of Violation was December 6, 2007. The Hearing Date
was January 16, 2008 and the Respondent appeared. The compliance date and fine
set by the board was January 31, 2008 or incur a fine of $5K per day. The violation still
exists and there were 27 days on non-compliance.
Marcellus Jean Francois, 238 SW 5th Avenue, explained he believed he cleaned up
the violation and he met with Officer Webb, who gave a verbal that everything was fine.
He explained he did not know what he meant by that. He requested everything needed
to satisfy the violation be communicated in writing.
Officer Webb had three sets of photos from December 6, 2007, January 15, 2008 and
February 21, 2008 which he distributed to the board. There were 27 days of non-
compliance.
Chair Costantino asked whether he understood his fine had accrued to over $235K. Mr.
Francois responded he was not aware of that and advised the City could have the
property and he'll move on. The truck, trash and debris were gone, and there was just a
pile of coconuts. The issue was there were Code violations which were not addressed
in a timely fashion.
Scott Blasie, Code Compliance Administrator, requested the matter be tabled. He and
Officer Webb would like to consult with Mr. Francois and bring the matter back. Mr.
Blasie was uncomfortable having a $5K a day fine run while the only thing that was left
was a pile of coconuts. Mr. Francois came to the office several times indicating he was
in compliance, but when it was inspected there was still some trash and debris.
Motion
Mr. Karageorge moved Case #07-3423 be tabled to April 16, 2008 to allow Officer
Webb and Mr. Blasie to meet with Mr. Francois and develop a recommendation. Mr.
Yerzy seconded and the motion unanimously passed.
Case #06-2690
Rigaud & Yolaine Saintfort

Mr. Blasie explained the board was reconsidering this lien reduction. When the lien
was heard, one or more members expressed doubts, after the meeting, regarding the
severity of the Board's Order. Mr. Saintfort's violation was a driveway that needed
repair and he installed a concrete driveway at considerable expense. There was
discussion the fine was too severe and that was why it was recommended it be brought
back. The Respondent spent about $4K on the driveway, going over and above the
requirement, to correct the violation.

Rigaud Saintfort, 1515 SW 2nd Street, was present and advised he spent $4,800 plus
the building permit.
Chair Costantino explained she requested this case be reconsidered and she was
uneasy about the fine. She expressed to Mr. Saintfort she felt a disservice was done to
him by her not voting her conscience and she apologized. She explained she should
have been more focused.
She passed the gavel to Mr. Yerzy.
Motion
Based on testimony and evidence presented in Case #06-2690, and having been
advised that the Respondent has complied with all lien reduction procedures set forth in
Section 2-84 through 2-89 of the City of Boynton Beach Code of Ordinances, Chair
Costantino moved that this Board reduce the fines instituted in Case #06-2690, by virtue
of this Board's Order of December 20, 2006, to an amount of zero, including
administrative costs. Mr. Moyer seconded the motion.
Mr. Foot wanted to know why there would be no penalty when there was a three month
period between the violation and compliance.
Chair Costantino explained before Mr. Saintfort's case was heard, the respondent in the
case before his had spent a long time making required repairs and the board walked
away from it. This was a similar case. Mr. Saintfort did what was asked of him; he did
an excellent job, but the board determined he should be penalized and imposed the
fine. She did not think it was right. The prior case that was heard had no administrative
costs incurred. Additionally, the board had voted on the matter several times and if she
did not vote in favor of the fine, they would have been there for another 45 minutes.

Messrs. Karageorge, Moyer, Yerzy, and Chair Costantino voted aye
Officer Webb explained the violation notice was to repair the driveway and he went
beyond that.
A roll call vote was requested. The recording Secretary called the roll.
The motion passed by vote of 4-1 with Messrs. Moyer, Karageorge, Yerzy, and Chair
Costantino voting aye and Mr. Foot dissenting.

Mr. Blasie explained to Mr. Saintfort that the board's decision was subject to a seven
day review by the City Commission once the minutes awere available. He suggested
he contact Code Compliance in about two or three weeks.

Code Officer Cain reviewed the case and advised the trailer was removed. The initial
inspection date was January 3, 2008, and a written Notice of Violation was issued and
signed for on February 14, 2008. Thirty days was given and the Respondent was
present.
Iglad Norelus, 1519 NE 1st Court, explained he did not understand the matter but he
was not guilty. Officer Cain had photographs he distributed to the board. Mr. Norelus
wanted to know why the Code Officer violated the law to come onto his property and go
into his carport when he has insurance on the vehicle and a valid tag.
Officer Cain advised he did not enter the carport. He has the right to go up to his door
and anything he sees along the way during an ongoing case could be subject to a
violation and be photographed. Mr. Norelus explained his wife saw him and that it
constituted "trespassing." Mr. Norelus disputed the comments and alleged Florida
Statute was violated.
Officer Cain distributed the photos to the board. The exterior issues, such as stucco on
the house/painting were satisfactorily addressed, but not the outside storage.
Mr. Norelus indicated the concrete was purchased for him to use on his property. He
bought it last week on a Sunday and it was not storage. The refrigerator worked, the
covered book cabinet was for his kids, but he did not want to put it in the trash until the
truck came in the morning. It was explained operational refrigerators were only allowed
if the carport was enclosed. In an open carport those items constituted outside storage.
Mr. Yerzy thought it was messy and there were wires hanging. Mr. Foot noted he was a
repeat offender for the same type of violation or section of the Code.
Mr. Norelus advised he could move the refrigerator to storage. Chair Costantino
advised this was a hazard to children who could crawl inside. Mr. Norelus explained he

had a fence, but requested 30 days. He was going out of town on Friday returning April
1, 2008.

Officer Cain reviewed the case which pertained to violations of the Community
Appearance Code. The Notice was sent on January 3, 2008 and the Notice of Hearing

Based on the testimony and evidence presented in Case #08-018, Mr. Yerzy moved
that this Board find that Mario Castillo is in violation of the City of Boynton Beach Code

Mr. Foot inquired whether the City should intervene and board up the structure
because the house was unsecured.
Mr. Blasie explained there were hundreds of empty/abandoned houses in the City. This
location had police action on it and the owner was identified and it was not, as of yet, a
foreclosure. He explained from staff's perspective, they would like to continue to pursue
the homeowner, who lives out of the area, and hold off on the order to abate. He
explained there is a very limited pool of funds to secure homes with and literally
hundreds, if not thousands, of homes that are abandoned. The City cannot board up all
the homes. He explained when a Lis Pendens is filed, the office notifies the owner and
the attorney handling the matter and typically attorneys for the plaintiffs understand an
unsecured abandoned home is further devalued and can attract unlawful or
inappropriate activities. A Lis Pendens is usually a precursor to foreclosure and due to
the foreclosure process, staff was seeing a longer wait because there are so many and
there was a back log. Staff was trying to hold off on abatements and only abate the real
nuisance cases because there are no funds. Mr. Blasie advised this was an ongoing,
City-wide issue. He reported Homeowner's Association's are not the most forthright in
holding up their end of the rules and the City has had to mow a property in Citrus Glen.
They observed a gated community with a property manager simply refusing to do their
part. An abandoned house is an opportunity regardless where it is, in residential or
commercial areas. Staff has a number of criteria used to prioritize; that aspect was only
one of the criteria.

Boynton Beach Code Sections cited and moved to Order that the Respondent correct
the violations on or before March 29, 2008. The Board has considered the gravity of the

Respondents and hereby orders that if the Respondents do not comply with this Order,
a fine in the amount of $50 per day for each day the violation continues past March 29,
2008 plus administrative costs shall be imposed. The Respondents are further ordered

Mr. Blasie advised Case #'s 08-212 and 08-216, presented by Officer Herring, were
only read as Boynton JCP Limited, when the case was on the tenants, Bath and Body
