R97-110RESOLUTION R97-//,~ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, URGING THE FLORIDA LEGISLATURE TO ENACT LEGISLATION TO REPEAL THE PREEMPTION LANGUAGE IN THE FLORIDA CLEAN INDOOR AIR ACT AND RETURN TO LOCAL GOVERNMENT THE RIGHT TO ENACT AND ENFORCE TOBACCO- RELATED ORDINANCES; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, cigarette smoking kills more Americans each year than alcohol, cocaine, heroine, murder, car accidents and AIDS combined; and WHEREAS, second hand smoke inhaled by nonsmokers can cause serious health problems, especially among children; and WHEREAS, the Florida Clean Air Act (F.S.386) sets maximum standards for public smoking based on state determination; and WHEREAS, the current laws of the State of Florida, including the Florida Clean Indoor Air Act,. preempt local regulation of tobacco use; and WHEREAS, the City Commission of the City of Boynton Beach believes that rights should be vested in local communities to enact and enforce tobacco- related ordinances if they choose to do so; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1. The City Commission of the City of Boynton Beach, Florida hereby strongly urges the Florida Legislature to enact legislation to repeal the preemption language in the Florida Clean Indoor Air Act and return rights to local government to enact and enforce tobacco-related ordinances, if they choose to do so, with the Florida Clean Indoor Air Act as the minimum standard for the State of Florida. Section 2. The City Clerk is hereby directed to forward a copy of this Resolution to each Florida State Senator and House Representative for Palm Beach County, the Palm Beach County Legislative Delegation, the Board of County Commissioners of Palm Beach County, each municipality in Palm Beach County, and Governor Lawton Chiles. Section 6.. This Resolution shall become effective immediately upon passage. PASSED AND ADOPTED this. ,/,d' day of July, 1997.
