A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
URGING THE 1997 FLORIDA LEGISLATURE TO
OPPOSE HOUSE BILL 313, AS AMENDED, AND
SENATE BILL 214; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, local governments have been granted Home Rule
powers pursuant to Chapter 166, Florida Statutes and Article VIII,
section 2(b) of the Florida Constitution; and
WHEREAS, pursuant to the Municipal Home Rule Powers Act
and the Florida Constitution, municipalities shall have the
governmental, corporate and proprietary powers to enable them to
conduct municipal government, perform municipal functions, and
render municipal services, and may exercise any power for municipal
purposes, except when expressly prohibited by law; and
WHEREAS, HB 313, as amended, and SB 214 extensively
intrude into the broad Home Rule authority granted to each local
government authority; and
WHEREAS, these bills impose a tax burden on local
governments by requiring local governments to pay ad valorem taxes
and other fees, and places conditions on the manner in which a local
government may obtain or become certified to provide
telecommunications services; and
WHEREAS, HB 313, as amended, and SB 214 require a local
government to create a separate corporation in order to hold a
certificate to provide or resell to the public for hire any
telecommunications services; and
WHEREAS, House Bill 313, as amended, and Senate Bill 214
in the 1997 Legislature will have an adverse effect on local
governments' ability to effectively provide for their 'citizens by
substantially interfering with each local governments Home Rule
powers.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA,
THAT:
Section 1. This Commission strongly urges the Florida
Legislature to oppose HB 313, as amended, and Senate Bill 214.
Section 2. A copy of this Resolution shall be provided to all
members of the Palm Beach County delegation in the Florida
Legislatur~ as well as to any other individuals or organizations
the City Clerk may designate.
Section 3. That this Resolution shall become effective
immediately upon passage.
