PUBLIC AUDIENC E: INDIVIDUAL SPEAKERS WILL BE LIMZ'rED TO 3-MINUTE PRESENTATIONS Herb Suss suggested that the City Commission add a provision to its policy on Advisory Board absenteeism so that a member, who has four or more absences due to extenuating circumstances, is not removed from a board on which they have served for many years. Mr. Suss donated a check to the Library for books. He complimented Wally Majors for doing a good job as Recreation Director and Tony Pereira for being an involved ciUzen. Meeting Minutes Regular City Commission Boynton Beach, Florida .luly 17, 2001 Barbara Harrison, Colonial Club, stated how pleased she was with the Senior Center. Sheila Ivory, 608 SW 1't Street, requested that stop signs be placed at the intersection of SW 1~t Street & SW 6TM Avenue. She also asked for more police presence in that area. Mayor Broening said someone from staff would speak to her before the end of this Commission meeting, Margaret Newton, 701 NW 4th Street, complimented Sgt. Eric Jensen of the Police Department for presenting her concerns regarding the 1-95 construction zone to the D.O.T. She thanked Sgt. Jensen for going beyond the call of duty. Brian Edwards, 629 NE 9t~ Avenue, stated that he supported getting a new fire station. He suggested that if there is a surplus of money, it be used for our Police Department. Andrew O'Brien, a commercial and industrial property owner in the City, complimented the Commission on their efforts to make Boynton Beach a business friendly city and suggested that all City departTnents should do the same. INFORMATtONAL 1'rEMS BY MEMBERS OF THE cTrY COMMZSSION Commissioner Ferguson had occasion to meet with Tom Lynch, Chairman of the Palm Beach County School Board, and asked about buses going to the new high school. Mr. Lynch suggested that the City Manager send a letter to the School Superintendent requesting buses to the school. City Manager Bressner will send the letter. Commissioner Ferguson requested that minutes of advisory boards be condensed. For example, he suggested that the Code Compliance Board minutes only list who received extensions and what people were fined. Commissioner Fisher announced that the Advisory Board on Children & Youth had another successful bowling tournament last weekend. Announcements: Oceanfront Concert Series on July 20, 2001, 6-9 PM, at Oceanfront Park - Straight Shooter (Country Band) Wally Majors, Recreation Director, and Linda Coyne, Volunteer &, Silent Auction Coordinator for the Concert on the Green, will present a donation of $500 in Publix gift certificates to The Lord's Place Boynton Beach Family Shelter. Shelter Director Laura Shumaker will be present to accept the donation. Mr. Majors and Ms. Coyne presented the donation to Ms. Shumaker from The Lord's Place. Meeting Minutes Regular City Commission Boynton Beach, Florida 3uly 17, 2001 Recognition of Boynton Beach Police Department's 10 year old & under PAL basketball team for placing 1~ in region, 2nd in state and 3rd nationally in the 2001 National PAL Basketball Tournament Police Chief Marshall Gage stated how proud he is of the Police Athletic League in Boynton Beach. Officer Bill Tome explained that this was the first time that a Boynton Beach PAL team had competed in a national tournament. He recognized the coaches and players. The Mayor presented City pins to the players. Sam Kendricks, PAL Football Commissioner, explained that the PAL program has been in existence for approximately seven years and that the program helps our youth, both scholastically and socially. He thanked the City Commission and Recreation Director Wally Majors for their assistance. Mr. Kendricks thanked Sgt. Paul Sheridan and Police Chief Gage and presented plaques. 4. Wal*Mart's School Supply Drive Commissioner Fisher announced the Wal'Mart School Supply Drive and stated that Wal'Mart will match the first $2,000 in donations from the public. Wayne Segal, Director of Public Affairs, stated that the City's afterscho01 bus will be parked at Wal'Mart on July 28 and 29 and our goal is to fill this bus with school supplies. B. Inform Commission of the Recreation Department's Needs Assessment Goals 6 Meeting Minutes Regular City Commission Boynton Beach, Florida 3uly 17~ 2001, Wally Majors, Recreation Director, stated that he presented the Recreation Department's Needs Assessment to the Commission to ascertain whether they support the department's goals. The Commission indicated their support and, therefore, Mr. Majors will proceed with the project. B. Project Team Reports (From 55 Strategic ]:nitiatives): 1. 5.1 Holiday Program/Holiday Tree Lighting Report Mr. Majors said that the Recreation Department created a team to address one of the City's initiatives, which is to develop a community identity. The team decided on various methods to achieve this goal, such as matching food and entertainment to the venue, identifying other potential sites for concerts around the City such as the Woman's Club and Mangrove Walk at the Marina, and increasing promotional efforts. Mr. Majors played 2 television commercials dealing with special events for the audience to view. Mr. Majors presented a Downtown Holiday Lighting Proposal (a copy of the proposal is attached to the original set of minutes on file in the City Clerk's office). He stated that the biggest cost would be the lights at approximately $42,000. Local businesses have been contacted and could sponsor a particular event or one element of the lighting proposal. The City could form a partnership with local businesses and organizations. Mr. Majors also stated that the City would qualify for a 15% discount on materials if they are ordered by August :[5~. The Commission and City Manager Bressner complimented staff on their proposal. City Manager Bressner stated that funds were not in the proposed budget; however, there is $79,000 in Economic Development funds that could be used. Commissioner Ferguson requested that this lighting proposal be covered as part of the budget discussions atthe end of this month. There was a consensus that the City Commission favored the proposal and that it would promote the City. The Commission will discuss the matter further at their budget meetings. VT1'. Dick Hudson, Senior Planner in the Planning & Zoning Division, explained the process and schedule for comprehensive plan amendments. Mike Rumpf, Planning & Zoning Director, stated that redevelopment and a vibrant downtown does not happen by itself but only after careful study and proper planning. The Comprehensive Plan Amendment will implement the Federal Highway Corridor Plan approved by the City Commission on May 15, 2001. Hr. Rumpf showed the areas affected by referring to an overhead map. He explained that the residential areas would be preserved as long as the property owners and the market support their existence. He stated that a comprehensive plan is a future guide and that every city needs a core area with the least restrictions on density, height, etc. 3ay Laing, 937 Greenbriar Drive, representing all residents of Boynton Isles and Lee Manor Isles who were in the audience, stated that the notices and maps received by residents regarding the proposed land use changes were not clear and residents did not feel that staff answered their concerns properly. He feels that the City should go west to expand the tax base. Mr. Laing said that luxury apartment buildings are being built from Golf Road to Gateway Boulevard; however, only 10% are on the water and multi-family buildings tend to depreciate. Changing the land use designation removes the first obstacle to rezoning. Mr. Laing stated that signed Petitions were presented (however, no petitions were received by the City Clerk's office). The residents of Boynton Isles and Lee Manor Tsles are opposed to changing the Low Density Residential to Mixed Use. Mr. Laing stated that homes in these areas range from $300,000 to $1,000,000 and the tax base has increased to $5-$7,000 per year. Their goal is to protect the current standards of their neighborhoods. ProperLy owners feel that inclusion in the Federal Highway Corridor Plan would allow additional uses that would be substandard. Hr. Laing stated that one home in this area has just as much tax base as four duplexes and requires less services. Boynton Isles and Lee Manor Isles should be removed from the Comprehensive Plan Amendments. He urged the Commission not to change the land use for these neighborhoods. Wanda Weise, owner of 306 SE 10m Avenue, did not believe the map that she received in the mail was clear. She feels this land use amendment would lower her property's valuation. She stated that they were trying to sell their property and questioned why a business could not be located there. Mr. Rumpf said that the building was constructed as a single-family residence and is zoned residential. He understands that the former owner, Ms. Weise's father-in-law, had a business at this location but there has never been an occupational license there. Andrew O'Brien, 408, 410, 412 NE 3~ Street & 212 SE 6th Avenue, owns commercial and industrial properties adjacent to the property in question. He applauded the Commission on moving Boynton Beach forward. Mr. O'Brien stated, however, that there needs to be a 8 Meeting Minutes Regular City Commission Boynton Beach, Florida 3ulv 17, 2001 forum between the Planning Division staff and the citizens so that the citizens' questions could be answered. He understands that this comprehensive plan amendment will only change the land use classification but that will allow zoning to be changed later. He feels the process is scary because of so many unknowns. Brian Edwards, 629 NE gth Avenue, said he had the utmost respect for the City staff and the CRA and is pleased with where the City is headed. He stated that there is a distinct difference between land use changes and zoning; however, some workshops should be held to view the overlay zoning which would eliminate some residents' fears. Mary Law, 62S S. Federal Highway, stated that the zoning should be consistent in the entire corridor area. She said that property owners should be told of the specifics of the Mixed Use category, including the setbacks, size, height and property uses. Property owners need to know if they will be able to sell their businesses as they exist today. Peoples' voices should be heard by the City Commission. Beryl Kruger, speaking for Nicholas DiLorenzo of 902 N. Federal Highway, stated that Mr. DiLorenzo operates an automotive business. When this land use plan is amended, C-4 businesses in this area will become non-conforming businesses and the owners will have a problem with insurance. Mr. Kruger said there is not enough residential property to support the commercial uses along Federal Hwy. He stated that commercial property is more expensive in the eastern sections of cities and, in order to encourage development, cities must allow very high densities. Mr. Kruger said that it would be nice to let Boynton Beach continue as a small fishing village. There being no one else present wishing to speak on this matter, Mayor Broening closed the public hearing. Commissioner Fisher said he understands there is a difference between the comprehensive plan and zoning. However, he is concerned that changing the comprehensive plan makes rezoning easier and he does not know what a future City Commission will do.. His main concem is zone 4, east of Federal Highway, which is a residential pocket. Commissioner Fisher wants to keep it residential. Commissioner Ferguson stated that, through no fault of their own, the citizens still do not understand these changes. He said he cannot approve the comprehensive plan amendment if it includes the Low Density Residential area. Commissioner McCray stated that he, too, was confused over this issue at the CRA meeting. He said he is also concerned regarding the zoning and cannot approve the comprehensive plan amendment as it stands now. Mayor Broening stated that he believes the area in question will remain residential and that the market will determine what the future zoning will be. Consideration of Revision to the Guidelines for Distribution of Community :Investment Funds Commissioner Fisher requested the Commission's approval of a change to the guidelines to allow for a donation to a City-run scholarship that the Advisory Board on Children & Youth sponsors. Steve Waldman, Vice Chairman of the Advisory Board on Children & Youth, explained the history of the Bob Borovy Scholarship. ]:t was instituted two years ago to honor Bob Borovy who made major contributions to our City. ]:t is given to a graduating high school senior and is based on the contributions made by the student to a school, religious, community, or social organization. The student must be recommended by three adults. The purpose of the schOlarship is to honor the concept of volunteering and to encourage volunteedsm. The student is given a $:~,000 savings bond. There was a concern raised by Commissioner McCray that the Commission might be accused of showing partiality. Commission Fisher stated that scholarship money could only be given to a City-run program. After discussion by the Commission, it was the consensus that the guidelines for distribution of Community ]:nvestment Funds be changed to allow the dispensing of these funds to a scholarship program that is City administered and operated and that the scholarship be open only to students who reside within the City limits of Boynton Beach. This matter will come before the Commission in the form of a resolution in the future. I realize that this is not a 'zoning' issue, at this point in time, but it does open the door to the possibility of zoning changes in the future that could affect the residents of Lee Manor Isles and Boynton Isles. The residents of these neighborhoods voiced their concerns repeatedly at the CRA meeting on July lOth. It is evident that these citizens, residents, taxpayers are concerned about the future of their homes, in many cases the largest investment they own. The map of the Land Use Amendment Area delineates a ten blocklow-density residential area from Riviera Drive to Kepner Drive. I cannot see any productive reason to include these areas in the proposed amendment if in fact they are to remain 'untouched' in the future. As elected officials, called to represent the 'voice' of the people I urge ~the Commission to exclude the low-density residential properties from this amendment. Needless to say, the residents of Boynton Isles and Lee Manor Isles voiced sincere concern over the proposed land use changes that were recently adopted by the CRA. In our defense, please understand that notices received by residents were a surprise, unclear about the exact nature of proposed land use changes, and in some cases incomplete (as maps with no explanations were received by more than one of our numbers). Many residents contacted the City regarding clarification and were directed to the City's planning staff. The residents did not feel that the staff answered questions adequately. Some were laughed at and told they didn't know what they were talking about. Others were told that we could be more vulnerable by not being included in the mixed land use change. But upon specific questioning, it sounded as if we would be more vulnerable to undesirable changes by being included. Planners also informed residents that on smaller parcels, such as Boynton Isles and Lee Manor Isles, the City could amend their land use and zoning with nothing other than a Commission approval. Is it any wonder that fears were raised? Since the CRA meeting of July 10, residents have reviewed the City's 20/20 Vision plan and the Federal Highway Corridor Community Redevelopment Plan. Let me emphasize that we are looking forward to new neighborhood friendly uses as stated in those plans. There are many good ideas within the proposal. However, as we have also researched other sources it has become clear that the direction Boynton Beach should be looking in order to expand the tax base is west...to those citizens who use our beaches and drive on city roads. Unfortunately, the city has been unable to offer services superior enough to those of the county to entice West Boynton to join the city. As an alternative, it is obvious that the city has chosen a "quick win" path towards growth. From Golf Road in the south to Gateway in the north, precious Intracoastal land is being monopolized by new "luxury" apartment buildings. Only ten percent of those units, maximum, have a water view. The rest are just rental units. That's ali. A luxury apartment complex" is only ten years away from being a mid-range apartment building, and only five more than that from being an eyesore. Single family homes (and some condominiums) appreciate. They appeal to stable, year round residents. Multi-family buildings depreciate. They appeal to unstable, transient residents. The concern of the 75 or so homeowners in Boynton Isles and Lee Manor Isles is that regardless of how one describes changes to the land use map as having minimal impact, our single-family home neighborhoods are being taken one step closer towards this "quick fix" of apartment buildings. It was insightful last week to watch the city planner tell us "it makes no difference,'' when discussing the land use change only for him to be corrected by a member of staff. That forthright man clearly stated that changing the land use designation removes the first barrier towards rezoning. It is no wonder people are suspicious, when subordinates are compelled to repudiate "political" positions taken by staff members beholden to development-oriented or-controlled boards. Since the CRA went forward with the mixed-use designation for our neighborhoods, residents of Boynton Isles and Lee Manor Isles are here once again to express our concerns and opposition of being included in the Federal Highway Corridor Land Use Change. We still oppose changing the existing land use designation for both of our neighborhoods from Low Density Residential to Mixed Use. We noted, for example, that comparative neighborhoods listed within the Federal Highway Corridor Community Redevelopment Plan, (please note, we use the word "comparative" here because the board compared these areas to ours,) are very descriptive of their stability and redevelopment. However no such description accompanies Boynton Isles on page 55. Much more emphasis is placed on our good neighbors in Sterling Village and on the nature of the commercial properties on our western edge. We have to wonder why our neighborhood isn't described as one that is stable, with homes escalating in value. The positive description of the northern single family neighborhood implies, "preservation." The lack of description for the southern neighborhood implies, "elimination." Boynton Isles and Lee Manor Isles are both quiet, waterfront, single-family communities. Originally developed in the 1950s, more than 60 homes comprise these developments. The communities are located on the East Side of Federal Highway between Woolbright Road and Ocean Avenue. The average lot size is 90' X 100'. Each home lies waterfront by way of the Intracoastal Waterway or finger canal fi'om the same. The neighborhood has revitalized on its own within the last few years. Newer, larger homes have been built .and older homes have been renovated. The current market of the homes ranges from $300,000 to $1,000,000. Listing and resales range from $550,000 to $830,000 in just the last year. The tax bas has increased from a previous average of $1800 to a range of $5000 to $7000 per year. The new majority of residents consist of professionals with children. The residents are proud, of their homes and are happy to be citizens of these unique neighborhoods and the City of Boynton Beach. Boynton Isles and Lee Manor Isles only goal is to protect and preserve the current standards of their neighborhoods and we feel that this can be best accomplished by remaining as we are currently designated- Low Density Residential. Residents feel the reclassification to mixed use could cause detrimental effects to the current revitalization of homes and their values. Residents feel that the inclusion of our neighborhoods into the Federal Highway Corridor Land Use Plan, changing the land use to mixed use will allow additional uses, which will be substandard. These uses are not currently allowed under the existing LDR land use and R1AA zoning. Removing Boynton and Lee Manor Isles would accomplish two things. First it would relieve the residents concerns and put them at ease with the City's redevelopment intentions, and secondly, it allows the City to accOmplish the same goal throughout the Federal Highway Corridor without opposition from these communities. It was stated by the planning staff at the CRA meeting, "that removing Boynton and Lee Manor Isles would require the staff to rezone properties on Federal Highway already re-zoned to accommodate commercial uses." Let us clarify, that the residents are not asking that the commercial properties be included in this request. They are requesting that the City only eliminate what is currently designated as LDR and zoning as R1AA, more specifically shown on pages 51 and 52 of the City's Federal Highway Corridor Community Redevelopment Plan adopted May 15, 200I. Incidentally, the residents note that the existing Commercial development previously re-zoned, was allowed to provide parking and main access to their consumers by way of the residential street of Isle Drive within the existing community. The new medical office building's main entrance is off of the residential sweet of Greenbriar Drive. There exist no buffers, walls or safety measures to protect the neighborhood. The City has already created detrimental circumstances on both of these roads even though we currently have the more restrictive land use classification. What else would we endure should land use become more lenient? Council members, please consider that a $425,000 home adds the same amount to the tax base as four $125,000 duplexes (when you account for the homestead exemption) which would fit on the same site, but contributes four times less demand on city services -water, sewer, police, roads and traffic, etc. Furthermore, a single-family homeowner is much more likely to maintain and beautify the property, and more likely to be a contributing citizen in the community, thus leading to the well-known '~halo" affect attributed exclusively to single-family home ownership. One example of this commitment is the group of us before the commission tonight. Them are ways to make a do~mtown eom an inviting place to visit, and to live that do not limit the long-term attractiveness of a city. There am approaches to "new urbanism" that do not threaten existing neighborhoods, while still creating environments that facilitate pedestrian traffic as opposed to automobiles. Changing Boynton Isles and Lee Manor Isles to Mixed Use on the land usage plan does absolutely nothing to contribute to these admirable goals. Conversely, by not listening to the concerns and cares of the home owners in these single-family residential neighborhoods, you risk alienating and antagonizing a prosperous, involved, and concerned group of citizens who would like nothing better that to help advance the cause and success ofBoynton Beack On behalf of the Boynton Isles and Lee Manor Isles residents, I respectively state our opposition to the Land Use Amendment of our neighborhoods.
