O00-54ORDINANCE ~ -.~'~ ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA AMENDING CHAPTER 26 OF THE CODE OF ORDINANCES OF THE CITY OF BOYNTON BEACH, ENTITLED "WATER, SEWER AND CITY UTILITIES", AMENDING SECTION 26-8.1 TO PROVIDE FOR COMMENCEMENT DATE FOR UTILITY SERVICES BILLING CYCLE, AND TO PROVIDE A DEFINITION OF BASE FACILITY CHARGE; AMENDING SECTION 26-9, SCHEDULE II (B) TO PROVIDE BILLING FORMULA FOR MULTI-FAMILY BUILDINGS IN WHICH SEVERAL DWELLING UNITS ARE SERVICED BY ONE METER; BY AMENDING SECTION 26-406 TO PROVIDE BILLING FORMULA FOR THE "FEE-IN-LIEU-OF" CAPITAL CONTRIBUTION FOR PROPERTIES REDEVELOPING WITHIN THE DOWNTOWN STORM WATER IMPROVEMENT WATERSHED; PROVIDING FOR CONFLICTS, SEVERABILITY, CODIFICATION, AND AN EFFECTIVE DATE. WHEREAS, it has come to the attention of the City Commission of the City of Beach that an amendment to "Chapter 26, Water, Sewer and City Utilities" is necessary to clarify certain provisions of that Chapter; and WHEREAS, upon recommendation of staff, the City Commission has that it is in the best interest of general welfare to the citizens and residents of the City to provide the clarifications; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1. The foregoing "WHEREAS" clauses are true and correct and hereby ratified and confirmed by the City Commission. Section 2. That Chapter 26, Section 26-8.1 is hereby amended by creating a new subsection (e) and (f), as follows: Sec.26-8.1 Water and sewer deposits; accounts, credits, termination and re- connection. (e) Billinq for utility service for parcels that will receive both water and sewer service shall commence on the Ist day that either a sewer connection is made, or the water meter is set in place. Billing for parcels receivino sewer service shall commence on the day that the sewer service line is connected to the City's utility system. For initial billing periods of less than 30 days, the base facility charge will be pro-rated bv multiolvina the standard base facility charqe by the number of days the service was provided, and then dividing by 30. (f) Base facility charge. The base facility charge is defined as the monthly base fee charged, per unit that shall be levied upon the initiation of service. The base facility charge is used to defray those non-consumption related operational expenses such as salaries, debt service, meter reading, billing and maintenance activities associated with the City's utility department, that are incurred regardless of water usage. Section 3. That Chapter 26, Section 26-9, Schedule TI. Wastewater Rates (b) is hereby amended by adding the words and figures in underlined type and by deleting the words and figures in struck-through type, as follows: (b) Residential and commercial rates outside city: The maximum sewer commodity charge for residential customers (in city or outside city) will be... Commercial accounts will be billed sewer charges based upon total water usage. For multi-family buildings (in city or outside city) in which several dwelling units are serviced by a single meter, the base facility charge per meter shall be calculated by multiplying the number of dwellinq units times the standard base charges for water, sewer and stormwater. The billinq for consumption shall similarly be calculated by dividing the total monthly consumption for each meter by the number of dwelling units, in order to determine the billing rate and amount per dwelling which is then multiplied by the number of units on each meter. Billing for utility services for multi-family parcels shall commence on the first day that either a sewer connection is made or a water meter is set in place. Section 4. That Section 26-406 is hereby amended by creating a new subsection (3), as follows: Sec. 26-406. Capital contributions. 2 (3) ~.The "fee-in-lieu-of" capital contribution for properties redevelopinq within the Downtown Stormwater Improvement Watershed, and utilizinc~ the installed stormwater treatment and/or conveyance facilities within that waterShed, shall be levied as follows: Capital cost per impervious square foot for Water Quality, Capital cost per impervious square foot for Water Quantity Total Capital cost per impervious square foot for Water Quality and Quantity $2.10 $o.',8 Section 8. Section 9. passage. $2.28 This fee shall be paid prior to the issuance of a buiidinq permit for new construction and/or redevelopment in the Downtown Watershed. Section 5. That each and every other provision of Chapter 26 not hereinbefore specifically amended shall remain in full force and effect as previously enacted. Section 6. All laws and ordinances applying to the City of Boynton Beach in conflict with any provisions of this ordinance are hereby repealed. Section 7. Should any section or provision, of this Ordinance or any ~ortion thereof be declared by a court of competent jurisdiction to be invalid, such Jecision shall not affect the remainder of this Ordinance. Authority is hereby given to codify this ordinance. This Ordinance shall become effective immediately upon FIRST READING this 4/ day of ~~-'~, 2000.
