AN ORDINANCE OF THE CITY COMMISSION OF THE
CI'TY OF BOYNTON BEACH, FLORIDA, AMENDING
CHAPTER 16~, ARTICLE 11 CITY PARKS AND
BEACHES, BY AMENDING SECTION 16-82~ POLICY
NO. I AND NO. 3; INCREASING ANNUAL BEACH
PARKING PERMITS AND RELATED FEES AND
CLARIFYING ISSUANCE POLICY; PROVIDING FOR
CONFLICTS, SEVERABILITY, CODIFICATION AND AN
EFFECTIVE DATE,
WHEREAS, the City of Boynton Beach operates and maintains Oceanfront Park,
which was recently selected by the Palm Beach Post as the "Best Beach Overall" in Palm
Beach County; and
WHEREAS, fees have not been 'increased since 1990, although costs for
maintenance have increased steadily; and
WHEREAS, the City Commission of the City of Boynton Beach, Florida upon
recommendation of staff, has determined that it is in the best interests of the citizens
and residents of the City to amend the Code to reflect increased annual permit fees;
NOW, THEREFORE, BE I'T ORDAINED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. That Section 16-82 of the code of Ordinances of the City of
Boynton Beach, Florida is hereby amended by adding the words and figures in
underlined type and by deleting the words and figures in struck-through type, as
follows:
16-82. Rules, regulations controlling parking of vehicles at municipal beach
property located within the Town of Ocean Ridge.

The city manager is hereby directed to implement subject procedures at the
earliest possible date. (Said regulations are set out below.)
POLICY NO. 1. PARKING PERMITS
Parking permits will be issued on an annual basis (October 1 through
September 30) with issuance beginning September i each year to residents (see

twenty dollars ($20.00) for the first decal ....
Permanent beach parking permit decals shall be issued at a charge of tcn
d~,,~* ~ ~ twenty dollars ($20.00) only to residents owning, leasing,
renting, occupying or residing in real estate in the city for at least six (6) months

not owned, shall be established by lease agreements, rent receipts of written
lessor verification.
Lost or mutilated parking permits. In the event that the vehicle to which
the permanent decal was issued has been sold...such decal will be rePlaced for a

return an identifiable portion of the mutilated parking decal to the CiwI In the
event the holder cannot provide an idenUfiable portion or part of such parking
decal, the charge for a replacement decal will be the sum ~,. ~,,
twenty dollars ($20.00). Lost decals will not be replaced until a~er a thirty-day
waiting period from the date the decal is reported lost.

Qualified nonresident: Qualified nonresidents may obtain beach decals
which permit parking on specified dates and times. The cost for such permit and
the dates they are valid shall be

as set forth herein:
The permit fee for Qualified nonresidents shall be sixty dollars
($60.00) each, and shall be valid seven (7) days a week, from May 1 to
November 15.
Section 2. Each and every other provision of Chapter 16, Section 16-82 not
specifically amended shall remain in full force and effect as previously enacted.
Section 3. All ordinances or parts of ordinances in conflict herewith be and the
~me are hereby repealed.
Section 4. Should any section or provision of this ordinance or portion hereof,
paragraph, sentence or word be declared by a court of competent jurisdiction to be
invalid, such decision shall not affect the remainder of this ordinance.

Section 5. Authority is hereby granted to codify said ordinance.
Section 6. This ordinance shall become effective immediately upon passage.
