AN ORDINANCE OF THE C~ COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORID~ BY AMENDING
THE 1999 STANDARD BUILDING CODE AND THE
BOYNTON BEACH AMENDMENTS THERETO, SECTION
105.12 "IMPACT OF CONSTRU~ON'; ADOPTED BY
ORDINANCE 099-16; PROVIDING FOR CONFLI~,
SEVERABILITY, CODIFICATION AND AN EFFECTIVE
DATE.
WHEREAS, .the City Commission adopted Ordinance No. O99-16 on
lune 15, 1999, which became effective on August 1, 1999; and
WHEREAS, staff has received a number of complaints from
residential properb/ owners regarding the effect of runoff from new
development adjacent: infill construcUon; and
WHERe, there are current~ no provisions in the Code: to resolvde
the impact on inful~ construction of higher FENLA required ~ot elevations on
adjacent property; and
WHEREAS, the City Commission has determined that it is in the
best iinterest of the City, its residents, prope~ owners, and visitors to
revise Se~[on 105.12 of the amendments to the 1999 Standard Building
Code to require all owners, developers and contractors of an infill parcel to
a professionally prepared drainage plan as a condition of securing
building permit;
NOW, THEREFORE, BE ~ ORDAINED BY THE C~ COMMISSION
OF THE C~ OF BOYNTON BEACH, FLORIDA, THAT:
Se~ion 1: Section 105.12 Impact of Construction. is hereby
amended by adding the words and figures in underlined ~pe and by
deleting the words and figures in ~ck-through type, as follows:
All con~ction activity regulated by this code shall be performed in
a manner so as not to adverse~ impact th econdition of adjacent
property, unless such activity is permitted to affect: said property pursuant
to a consent granted by the ,,~.~L~ ·

Se~ion 2: That all other provisons of Ordinance O99-16, of the
of Boynton Beach shall remain in full force and effect as adopted,
unless specifically amended herein.
Section 3. That ordinances or parts of ordinances in conflict
herewith be and the same are hereby repealed, provided that in the event
a conflict with respect to administration of the building codes, existing
laws or rules of the City shall control.
Se~on 6: Should any section or provision of this Ordinance or
po~on thereof be declared by a court of competent jurisdiction to be
invalid, such decision shatJ not affect the remainder of this Ordinance.
Se~ion 7: Authority is hereby granted to codify said Ordinance.
