AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA
AMENDING LAND DEVELOPMENT REGULATIONS,
CHAPTER 2, SECTION 4.J.1., TO ALLOW THE
MAXIMUM HEIGHT OF A FENCE, HEDGE, OR
WALL WITHIN THE FRONT YARD SETBACK TO
BE INCREASED TO SIX (6) FEET IN MULTI-FAMILY
ZONES; PROVIDING FOR CONFLICTS,
SEVERABILITY, CODIFICATION AND AN
EFFECTIVE DATE.
WHEREAS, numerous applications for variances have been submitted
due to increased security awareness; and
WHEREAS, staff has recommended an amendment to the City's zoning
regulations that will allow for an increase in security while not jeopardizing
streetfront regularity and aesthetics; and
WHEREAS, upon recommendation of staff, the City Commission of the
City of Boynton Beach has deemed it to be in the best interests of the citizens
and residents of the City of Boynton Beach to amend Chapter 2, Zoning, Section
J.1 of the City's Land Development Regulations to allow the maximum height
a fence, hedge or wall within the front yard setback to be increased to six (6)
;et in multi-family zones;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. Chapter 2, Zoning, Section 4.J.1. is hereby amended by
the words and figures in underlined type, and by deleting the words and
lures in struck-through type, as follows:
J. OTHER STRUCTURES. To further clarify the definition of structure as
)plied to all districts...
1. Fences, hedges and wails shall not exceed six (6) feet in height,
~bove finished grade, in residential zones, except that from the building line to
the front line the ~naximum height shall be four (4) feet. In Multi-family zo_nes,
the maximum height within the front yard setback shall be six (6) feet (chain link
fences shall be used only in combination with hedqe that shall be maintained at
he_eight of fence_¢~.
Section 2. Each and every other provision of Chapter 2 Zoning of the
Land Development Regulations not herein specifically amended, shall remain in
full force and effect as originally adopted.
Section 3. All laws and ordinances applying to the City of Boynton
mh in conflict with any provisions of this ordinance are hereby repealed.
Section 4. Should any section or provision of this Ordinance or any
)ortion thereof be declared by a court of competent jurisdiction to be invalid,
;uch decision shall not affect the remainder of this Ordinance.
Section 5. Authority is hereby given to codify this Ordinance.
Section 6. This Ordinance shall become effective immediately.
