AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF BOYNTON BEACH, FLORIDA, PROPOSING THAT A
REFERENDUM ELECTION BE HELD TO A~MEND THE CHARTER
OF THE CITY, AS ADOPTED BY THE FLORIDA LEGISLATURE
AND BEING KNOI~ AS CHAPTER 61-1889, SPECIAL LAWS
OF FLORIDA, AS AMENDED, TO PROVIDED THAT IF APPROVED
BY THE ELECTORS, THEABOVE REFERENCEDCHARTER SHALL
BE AMENDED TO AMEND SECTION 50. TE~,~S OF ELECTED
OFFICES. OF SAID CHARTER TO DELETE THE PROHIBITION
AGAINST COUNCIL MEMBERS SERVING MORE THAN TWO (2)
CONSECUTIVE TERMS; PROVIDING A BALLOT TITLE; PRO-
VID%NG THE OFFICIAL SUBSTANCE OF THE AMENDMENT TO
BE PLACED ON THE BALLOT; DIRECTING THE CITY CLERK
TO SUBMIT A CERTIFIED COPY OF THE ORDINANCE TO THE
SUPERVISOR OFiELECTIONS; PROVIDING AN EFFECTIVE
DATE, PROVIDING A CONFLICTS CLAUSE, AND A
SEVE[tABILITY CLAUSE; AND FOR OTttER PURPOSES.
NOW, THEREFORE, BE AND IT IS HEREBY ORDAINED BY THE
CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA:
Section 1. Should Ordinance No. 84-~ be approved
by the voters in March of 1984, then the City Council proposes
an amendment to Chapter 61-1889, more commonly known as the
Charter of the City of Boynton Beach, Florida, by amending
Article IV. Administration, Section 50. Terms of elective
offices, to read as follows:
Section 50. Terms, elective offices.
Ail elective offices shall be for the term of
two (2) years and-no-pe~sen-shat½-be-etig~§te

This amendment deletin8 the prohibition as to
~'~ving more than two (2) consecutive terms
~all take effect ten (10) days after approval
~y the electors. Any Council Member in office
at that time shall have no limitation on the
~umber of consecutive terms that may be served.
Section 2. That the official ballot title of said
Referendum as required by Section 101.161, Florida Statutes, shall
read as follows:

Section 3. That the official substance of the amendment
to be placed on the ballot in said Referendum as required by
Section 101.161, Florida Statutes, shall read as follows:
Are you in favor of an amendment to the City Charter
as follows:
Deleting the current Charter provision which prohibits
Council Members from serving more than two (2) conse-
cutive terms in office.

Section 4. That the City Clerk is hereby instructed
to immediately submit a certified copy of this Ordinance to the
;upervisor of Elections for Palm Beach County in order that said
[eferendum may be placed on the ballot for March of 1984, and
~hat said City Clerk is further required to take all action
Lecessary to see that"said Referendum is placed on the ballot
Lt the time of the municipal election.
Section 5. This Ordinance shall become effective ten (10)
Lays after said Ordinance has been passed by a majority of the
ualified electors of the City voting in the Referendum election.
'Section 6. That all ordinances or parts of ordinances
in conflict herewith are hereby repealed.
~Sect'ion 7. That should any section or provision of this
Ordinance or a portion thereof be declared by a court of compe-
tent jurisdiction to be invalid, such decision shall not affect
the remainder of this Ordinance.
