A RESOLUTION OF THE CiTY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA, REQUESTING
MODIFICATION OF BOUNDARY OF FOREIGN TRADE
ZONE #135 TO INCLUDE THE QUANTUM
CORPORATE PARK (A 600 ACRE MULTI-USE
BUSINESS PARK); AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the City of Boynton Beach, Florida is located in Palm Beach County;
and
WHEREAS, the Port of Palm Beach District (hereinafter referred to as the Port)
was established in 1915 as a political subdivision of the State of Florida having certain
powers as further defined in the Port of Palm beach Charter, Chapter 7081, Laws of
Florida as further supplemented and amended by special acts of the Laws of Florida; and
WHEREAS, the Port is authorized to promote commerce and industry throughout
the Port District, Palm Beach County and the Southeast U.S.; and
WHEREAS, the Port is the Grantee of Foreign Trade Zone (FTZ) #135, a special
commercial designation established by the U.S. Department of Treasury and controlled
and operated by the U.S. Customs Office; and
WHEREAS, commercial entities that import, can utilize the advantages prescribed
under FTZ regulations as established by the Foreign Trade Zone Act of 1934 (amended);
and
WHEREAS, FTZ #135 was set up to facilitate and incubate businesses that import
and manufacture; and
WHEREAS, the Port is in the process of extending the boundary lines of FTZ #135
to include the five Enterprise Zones in Palm Beach County, the Port of Palm Beach Cold
Storage, Inc., and several commercial sites in Martin County; and
WHEREAS, the Port is working with all governmental agencies in Palm Beach
County promoting the creation of new jobs, relocations, better tax base and quality of life
for the citizens of the Port District and County;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. That the major boundary modification needed to extend FTZ #135
designation to the Quantum Corporate Park will facilitate future relocations to the largest
underutilized Corporate Park in the County; and
Section 2, That granting FTZ status can only facilitate businesses that import;
and that all firms requesting admission into FTZ #135 must be audited by the Port prior to
activation status and that not all importers qualify due to limited quantities of volumes they
import; and
Section 3. That businesses qualifying for FTZ activation must post a Customs
Bond to be determined by dollar volume of imports and duties paid; and
Section 4, That the Port is agreeable to assist the City in the boundary
modifications of FTZ #135 as requesting in this Resolution at no charge to the City of
Boynton Beach, Florida; and
Section 5. That all individual businesses requesting future activation of FTZ
#135 for their individual sites located in the Quantum Corporate Park Will pay a set fee
schedule as per Port FTZ Tariff to the Port of Palm beach District; and that these
businesses will comply with all Port, Customs, U.S. treasury, Foreign Trade Zone Board
(consisting of the Secretary of the Army, Commerce and Treasury), all other federal
agencies and regulations governing the establishment, operations and jurisdiction of
Section 6. The City Commission of the City of Boynton Beach, Florida desires
to improve the qualify of life for its residents, and requests that the Port grant non-activated
FTZ #135 status to the Quantum Corporate Park.
