Minutes 02-18-09 MINUTES OF THE CODE COMPLIANCE BOARD MEETING HELD ON WEDNESDAY, February 18, 2009, AT 7:00 P.M. Call to Order Chair Costantino called the meeting to order at 6:50 p.m. II. Elections Chair Costantino opened the floor for nominations. Mr. Foot nominated Michele Costantino for Chair. Vice Chair Yerzy seconded the nomination. Motion Mr. Foot moved the nominations be closed. Vice Chair Yerzy seconded the motion that unanimously passed. Vote The nomination of Ms. Costantino as Chair was unanimously passed. Motion Mr. Karageorge moved Richard Yerzy remain as Vice Chair. Mr. Foot seconded the nomination. The nominations were closed. Vote The nomination of Richard Yerzy as Vice Chair was unanimously passed. 1 Meeting Minutes Code Compliance Board Boynton Beach, Florida February 18, 2009 III. Approval of Minutes of January 21, 2009 Motion Mr. Karageorge moved to approve the minutes with the corrections noted. Mr. LaTour seconded the motion that unanimously passed. IV. Approval of Agenda Skip Lewis, Senior Code Compliance Officer, announced there were deletions to the agenda as follows: Case #03-2123 was recommended to be tabled to February 17, 2010. Motion Mr. Foot moved that Case #03-2123 be tabled until the Code Compliance Board meeting to be held on February 17, 2010. Vice Chair Yerzy seconded the motion that unanimously passed. Case #'s 08-3810,08-2731, 09-187 were removed. Case #'s 08-3929, 09-87, 09-88, 09-92, 09-119, 09-123, 09-181, 08-3832 complied. Case #03-692 was tabled to April 15, 2009. Motion Mr. Foot moved that Case #03-692 be tabled until the Code Compliance Board meeting to be held on April 15, 2009. Mr. Karageorge seconded the motion that unanimously passed. Motion Mr. Foot moved approval of the agenda as amended. Mr. LaTour seconded the motion that unanimously passed. V. Swearing in of Witnesses and Introduction Attorney Tolces explained the hearing procedures and administered the oath to all who would be testifying. V. New Business Officer Lewis called the roll and determined who was present. 2 Meeting Minutes Code Compliance Board Boynton Beach, Florida February 18, 2009 Case #09-139 Earnestine Hatcher & Dora L. Jones 415 NW 9th Avenue CO CH 15 SEC. 15-120(0) Inc Remove all outside storage Location: Violation(s): Mike Melillo, Senior Code Compliance Officer presented the case. Perry Hatcher, 415 NW 9th Avenue and Dora Jones, explained they received a letter to remove appliances, which were a dryer and a hot water tank. It was noted Mr. Hatcher was Mrs. Jones' son. Attorney Tolces recommended the Board accept a plea of not guilty and the City present its case. Officer Melillo had a photo showing outside storage in the back of the truck and in the backyard. Mr. Hatcher advised the letter they received indicated the appliances needed to be removed which they did. He explained they received another notification about outside storage and he needed clarification. Officer Melillo reviewed the original letter which indicated outside storage. It was explained the lawn mower and the items in the truck needed to be removed. The truck is not used every day and since the items are not being transported every day, it constituted outside storage. Motion Based on the testimony and evidence presented in Case #09-139, Mr. Karageorge moved that this Board find that Earnestine Hatcher & Dora L. Jones are in violation of the City of Boynton Beach Code section cited and moved to Order that the Respondents correct the violation on or before February 28, 2009. The Board has considered the gravity of the violation, the actions taken by the Respondents and any previous violations by the Respondents and hereby orders that if the Respondents do not comply with this Order, a fine in the amount of $50 per day for each day the violation continues past February 28, 2009 plus administrative costs shall be imposed. The Respondents are further ordered to contact the City of Boynton Beach Code Compliance ~ivision in order to arrange for re-inspection of the property to verify compliance with this Order. Mr. Foot seconded the motion that unanimously passed. Case #08-3701 Location: Violation(s): Yale and Holly Roth 3100 S. Seacrest Boulevard CO CH 15 SEC. 15-120(0) Inc CO CH14 SEC. 14-3 Repair driveway and fence. Sod bare spot in yard. Commercial vehicle parked in residential area. 3 Meeting Minutes Code Compliance Board Boynton Beach, Florida February 18, 2009 Vestiguerne Pierre, Senior Code Compliance Officer, presented the case. Yale Roth, 2298 NW 35th Street, Boca Raton, pled no contest. He explained finances were an issue and he was struggling. His wife passed away, he lost his job and has to pay for babysitters for his children, as he was actively seeking employment. The property was a rental property and the tenant was told to remove the commercial vehicle. He was unable to invest any resources in the property, but was current on his mortgage and taxes. Officer Pierre provided photographs to the Respondent and the Board members. Items that could be repaired without funding, or with very little money, were pointed out to Mr. Roth. Motion Based on the testimony and evidence presented in Case #08-3701, Mr. Karageorge moved that this Board find that Yale and Holly Roth are in violation of the City of Boynton Beach Code sections cited and moved to Order that the Respondents correct the violations on or before June 18, 2009. The Board has considered the gravity of the violations, the actions taken by the Respondents and any previous violations by the Respondents and hereby orders that if the Respondents do not comply with this Order, a fine in the amount of $100 per day for each day the violations continue past June 18, 2009 plus administrative costs shall be imposed. The Respondents are further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re-inspection of the property to verify compliance with this Order. Vote Mr. Foot seconded the motion for discussion and suggested the fine be reduced to $50 per day. Mr. Karageorge amended his motion to reflect a fine in the amount of $50 per day. Mr. Foot seconded the motion that unanimously passed. Case #08-2839 Location: Violation(s): Peter Jacobsen 511 W. Ocean Avenue CO CH 13 SEC. 13-16 Obtain Business Tax Receipt. Pete Roy, Chief Code and Rehabilitation Officer, presented the case as contained in the staff report. The Respondent submitted an application for the Business Tax Receipt but could not obtain one. The Building Department required permits for the demolition of a wall in his garage or architectural drawings to put the wall up. Peter Jacobsen, 511 W. Ocean Avenue, pled no contest. The home was purchased with an existing interior wall in front of the garage door, which was a non-load-bearing 4 Meeting Minutes Code Compliance Board Boynton Beach, Florida February 18, 2009 wall. There was also a cut-out in the living room wall to accommodate an old projection television that required the electric to be brought up to Code. Officer Roy explained permits were needed for those, and when they are obtained, the property would be inspected for the Business Tax Receipt. Mr. Jacobsen explained he received conflicting information and was told a General Contractor had to apply for the Demolition Permit, not the property owner and an architect had to draw the plans. He advised the Board he did not have the funds to do so. The wall was already removed. He did not understand why he had to hire a contractor and architect to draw plans to remove a wall that was already removed. He did not know if a permit was issued to install the wall. Mr. Jacobsen initially lived in the home for a few years, and then wanted to rent it. Officer Roy noted there was a separate case for the demolition component. Motion Based on the testimony and evidence presented in Case #08-2839, Mr. LaTour moved that this Board find that Peter Jacobsen is in violation of the City of Boynton Beach Code section cited and moved to Order that the Respondent correct the violation on or before April 19, 2009. The Board has considered the gravity of the violation, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $50 per day for each day the violation continues past April 19, 2009 plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re-inspection of the property to verify compliance with this Order. Vice Chair Yerzy seconded the motion that unanimously passed. Case #08-1604 Location: Violation(s): Jermaine & Regina N. Horne 2090 N E 1 st Lane CH15-ART. IX-15-120(D).INC. LDR CH20 ART 1 SEC 8 E-16 Repair or install driveway. Post four-inch numbers on home. Courtney Cain, Code Officer, presented the case and advised the violation still existed. Jermaine & Regina Horne, 2090 NE 1 st Lane, were present. Mr. Horne explained he was working on correcting the violation. He had previously advised he did not have the resources for the driveway and his circumstances had not changed. He dug up the driveway and was in the process of filing for a permit. The next step would be for the cement. He advised whatever was financially feasible to correct, would be corrected. 5 Meeting Minutes Code Compliance Board Boynton Beach, Florida February 18, 2009 Officer Cain had photos he distributed to the Board. Motion Ms. Carroll moved that Case #08-1604 be tabled until the Code Compliance Board meeting to be held on April 15, 2009. Mr. Foot seconded the motion. The Respondents acknowledged they were aware the fine was running. Vote The motion passed unanimously. Case #08-2685 Linda Shelton & Nancy Morrow 1614 N. Seacrest Blvd. Officer Cain presented the case, which pertained to violations of the Building/Housing Code. There was a lengthy list of violations that remained outstanding. Linda Shelton, 1614 N. Seacrest Boulevard advised she was still working on correcting the violations. Some windows were repaired, a panel box in the hallway was semi- repaired and needed to be secured. The panel box at the rear of the property was repaired, but there were still issues with exposed wiring in the dining room. Other items that needed to be addressed were the trash and debris outside, the soffit and screens needed repair, the toilet was not functioning properly and there was exposed plumbing in the tub area. Ms. Shelton advised when she receives her check on the 30th, she would repair the soffits and the electric would be addressed. She cleaned the yard all day on Monday but there was more to do and she would continue working to address the violations. Motion Mr. Foot moved that Case #08-2685 be tabled until the Code Compliance Board meeting to be held on March 18, 2009. Ms. Carroll seconded the motion that unanimously passed. Case #08-1319 John Van De Warker 135 SW 1st Avenue Willie Webb, Senior Code Officer, presented the case. John Van De Warker, 312 SW 11 th Avenue, explained he received estimates from contractors, and applied for a permit, but had to stop because the contractor wanted all the payment up front. The estimate was $30,000. The property has a lis pendens, but he was current on the taxes, insurance and property maintenance. The property was uninhabited and was not a hazard. He was willing to move forward but his finances prevented him from doing so. Mr. Van De Warker wanted to keep the property and was determined to do what he could. The property was a duplex property. He requested he be given a time extension and he would report back to the Board with his progress. Motion Vice Chair Yerzy moved that Case #08-1319 be tabled until the Code Compliance Board meeting to be held on May 20, 2009. Mr. Karageorge seconded the motion. Mr. Van De Warker acknowledged he understood the fine was running. Vote The motion unanimously passed. Case #08-3213 Boynton Plaza Knowledge Points 153 N. Congress Avenue A Scott Blasie, Code Compliance Administrator, requested the case be tabled. The Respondent indicated a check was sent for the fire inspection fee. Motion Mr. Karageorge moved that Case #08-3213 be tabled until the Code Compliance Board meeting to be held on March 18, 2009. Mr. LaTour seconded the motion that unanimously passed. Case #08-2451 William Hancock 1401 NW 7th Street Officer Lewis presented the case which pertained to permit violations and explained there was no application made as of this date. Bill Hancock, 1401 NW 7th Street, and Debra Fitz, his girlfriend explained they had papers for the windows, but did not know what they meant. Mr. Blasie reviewed them and advised they hired an engineer and obtained stamped and sealed plans. Hiring a contractor to submit the paperwork and apply for the building permit remained. Officer Lewis explained they Respondent was red tagged because they required hurricane shutters. The windows were not impact resistant. Motion Mr. LaTour moved that Case #08-2451 be tabled until the Code Compliance Board meeting to be held on April 15, 2009. Mr. Foot seconded the motion. 7 Meeting Minutes Code Compliance Board Boynton Beach, Florida February 18, 2009 Case #08-3411 Boynton Plaza 141 N. Congress Avenue Officer Lewis explained the City recommended tabling the case to March 18, 2009. He reported the Respondents were present and were in agreement with the recommendation. Motion Mr. Foot moved that Case #08-3411 be tabled until the Code Compliance Board meeting to be held on March 18, 2009. Mr. Karageorge seconded the motion that unanimously passed. Case #08-3614 1865 Woolbright Road, LLC 1865 Woolbright Road Officer Lewis explained the City recommended tabling the case to March 18, 2009. He reported the Respondents were present and had no objections to the recommendation. Motion Mr. LaTour moved that Case #08-3614 be tabled until the Code Compliance Board meeting to be held on March 18, 2009. Ms. Carroll seconded the motion that unanimously passed. Case #08-16 Korrine and Peter Tapia 913 NW 8th Street Mr. Blasie presented the case and advised compliance was documented on December 8, 2008. He had two photographs taken April 10, 2008 and February 18, 2009, which he distributed to the Board members. A delinquent water bill was also paid. Debra Grogis, 2595 Prosperity Oaks Court, Palm Beach Gardens, was the agent for the seller. The property was a bank foreclosure and she advised there was a contract on the property. The buyers were requesting a lien reduction incurred by the previous owner. The deed to the property was obtained on August 4, 2008 and she believed the lien was removed. When the title company performed the search, she became aware of the lien. Mr. Blasie had a copy of the notice of lis pendens and he advised the City was not listed as a defendant in the foreclosure action. The lien was recorded on May 7, 2008. Attorney Tolces advised the lien may have been recorded after the foreclosure action commenced and prior to the issuance of the deed. It was noted the Board Order was recorded May 7, 2008. 8 Meeting Minutes Code Compliance Board Boynton Beach, Florida February 18, 2009 Motion Based on testimony and evidence presented in Case #08-16, and having been advised that the Respondents have complied with all lien reduction procedures set forth in Section 2-84 through 2-89 of the City of Boynton Beach Code of Ordinances, Mr. Foot moved that this Board reduce the fines instituted in Case #08-16, by virtue of this Board's Order of March 19, 2008, to an amount of $1874.00, including administrative costs. Mr. Karageorge seconded the motion that unanimously passed. Motion Mr. LaTour moved to take a short recess. The Chair agreed to a five minute recess. The meeting recessed at 8:11 p.m. The meeting reconvened at 8:16 p.m. Case #09-107 Location: Violation(s): Miguel Bartolo Juan 3265 E. Atlantic Drive CO CH15 SEC. 15-120(0) INC Remove furniture & appliances from the front porch. Officer Cain reviewed the case as contained in the staff report. The recommendation was to comply within 10 days. Motion Based on the testimony and evidence presented in Case #09-107, Ms. Carroll moved that this Board find that Miguel Bartolo Juan is in violation of the City of Boynton Beach Code section cited and moved to Order that the Respondent correct the violation on or before February 28, 2009. The Board has considered the gravity of the violation, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $75 per day for each day the violation continues past February 28, 2009 plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance ~ivision in order to arrange for re-inspection of the property to verify compliance with this Order. There was a refrigerator on the front porch that would be removed the next day. Case #09-121 Location: Violation(s): Donald Ross 2891 NE 4th Street CO CH15 SEC 15-120(0) INC 9 Meeting Minutes Code Compliance Board Boynton Beach, Florida February 18, 2009 Mow yard. Repair or remove fence. Officer Cain reviewed the case as contained in the staff report. The recommendation was to comply within 10 days. Motion Based on the testimony and evidence presented in Case #09-121, Vice Chair Yerzy moved that this Board find that Donald Ross is in violation of the City of Boynton Beach Code section cited and moved to Order that the Respondent correct the violation on or before February 28, 2009. The Board has considered the gravity of the violation, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $150 per day for each day the violation continues past February 28, 2009 plus administrative costs shall be imposed.
