Mayor Cassandra called the meeting to order at 7:30 P. M.
The invocation was given by Reverend John G. Block, St. Mark
Catholic Church. The Pledge of Allegiance to the Flag was
led by Mayor Cassandra.
AGENDA APPROVAL
City Manager requested that under "Consent Agenda", Item B.2.
be deleted. He also requested that under List of Payments for
Month of August 1987, at the request of the School Board
staff, that the bill for S. G. Philips, be deleted.
Mayor Cassandra noted that he would like to remove under
"Consent Agenda", A. 2. Minutes of Budget Public Hearing of
September 8, 1987 due to an error in the minutes. He also
asked under "Discussion" that D.i., D.3., and D.4 be deleted.
City Attorney Rea requested that under "Legal" that D.3. be
deleted and brought to the next City Commission meeting.
Vice Mayor Marchese moved, seconded by Commissioner Hester,
to accept the agenda as corrected. Motion carried 4-0.
Mayor Cassandra noted the large number of people attending
the meeting. For anyone attending for the first time, he
explained the procedure for those wishing to speak
~egarding an item not on the agenda. He explained that
anyone wishing to speak on an item that is on the agenda
must fill out one of the Public Comment forms. There is no
Public Hearing on a First Reading.
ANNOUNCEMENTS
Mayor Cassandra read in its entirety the Proclamation -
United States Constitution Day - September 17, 1987 which
was requested by the American Legion, Cline-Pautsch-Knott

Post 164 Auxiliary. After the reading he gave an executed
copy of the Proclamation to a representative of the
Auxiliary.
CITY MANAGER'S REPORT
List of Pending Projects and Activities
City Manager Cheney noted that recently he had sent a list
of pending projects and activities to Mayor Cassandra. He
noted that he will keep this up to date and would appreciate
any input from Mayor Cassandra.
Review Plans for Day Care Expansion and Remodeling
City Manager Cheney noted that Mrs. Coston was present at
the meeting. He stated that the Day Care people are aware
of the plan which had been in the planning stages for a long
time. He made reference to the proposal for remodeling and
adding on to the Day Care Center. City Manager Cheney noted
that advice had been received from many people and their
proposal had been reviewed by the Community Advisory Council
involved with day care, reviewed by the County staff which
administers the Head Start Program, and members of Boynton
Child Care, Inco He noted that the City has a Cost
Estimate. City Manager Cheney stated that at this point,
the Commission needs to give the architect some guidance as
to whether or not he should go ahead and prepare the design
and specifications so that the project can go to bid. He
noted that, if the Commission votes to go to bid, the next
time they will review the plan will be when the bids come
in, unless directed otherwise.
Vice Mayor Marchese asked what was meant by "a room of
isolation." City Manager Cheney stated that health regula-
tions require that a child who is sick must be isolated from
the other children. Mayor Cassandra noted that the City had
decided that if they were going forward with this project
that it would be done right the first time as indicated by
the dollar amount at the bottom of the estimate. He ela-
borated that he felt that the City has a commitment to the
children and to day care and that the Commission should move
ahead on this project.
Commissioner Hester moved that the Commission instruct the
architect to move ahead with the plans for the Day Care
Expansion and Remodeling. Motion was seconded by
Commissioner Mann.
Commissioner Mann asked if the $662,000 was totally the
City's responsibility. City Manager Cheney stated that it

was, except that he is trying to get the County to pay for
the kitchen equipment. He noted that it is likely they will
do so, partially due to the fact that they have done it for
other day care centers and also because this center prepares
meals for two other centers. He also noted that the County
pays the salary for the kitchen staff. Motion carried 4-0.
Recreational Vehicle Parkinq
Mayor Cassandra next asked staff to check into the issue of
parking of boats on residential property (RV's, campers,
etc.) as far as where to park them. He stated that he did
not like to see them parked out front. He noted that they
are allowed to park on concrete as the code is now written.
Mayor Cassandra noted that people are now parking their RV's
on the driveway and their cars on the grass. He would like
the staff to consider removing C.4. from the Code Book. He
requested that staff look at this and come back to the
Commission with recommendations.
Complete Plan Submission
Mayor Cassandra also stated that he would like to enforce
that all developers when submitting plans to the Technical
Review Board (TRB) that they be complete so that TRB does
not have to do their work for them.
City Manager Cheney requested that the last request be left
as a desire as the City is working on this administratively.
Mayor Cassandra stated that he had no problem with that.
PUBLIC AUDIENCE
Mounting of Commission Plaque
Ben Uleck, 1507 S.W. 17th Avenue, noted that the people
would like to see their plaque mounted behind the
Commission, he asked why it was not there. City Manager
Cheney stated that many things are still in the old City
Hall which have not yet been moved. He noted that there is
a limit to how fast everything can be moved. Mr. Uleck
asked for a date when the plaque would be moved. City
Manager Cheney stated that it would be done as soon as
possible but that he could not give Mr. Uleck a definite
date.
Memorial Park Wall
Mr. Uleck stated that since the City has $2.5 million for
parks that some of it be used for a memorial. One

suggestion he mentioned was to put a concrete/brick wall
along Woolbright Road. He noted that he had been to the
Cemetery Board twice in the past to request some of the
funds for this purpose but they have not responded. Mayor
Cassandra asked what $2.5 million Mr. Uleck was referring
to. City Manager Cheney noted that he was referring to the
referendum and Mr. Uleck agreed that he was but that it came
in through the back door. Mr. Uleck next read an article
regarding the United States Constitution as it relates to
public servants noting that he did not feel that it relates
to all of the Commission.
Housing for Unwed Mothers
Paul and Carol Razza, 1184 Summerwood Circle, West Palm
Beach, spoke next regarding a plan which they feel will
benefit Boynton Beach. Mr. Razza stated that he and his
wife have been working with teenage, unwed mothers for the
past four years. He related that he has been having these
unwed mothers stay with a family until they gave birth. He
has recently leased an abandoned house located on the same
property as The Lord's Place. The purpose of this place
will be to provide housing for unwed mothers and their
babies. He noted that he met with City officials several
months ago regarding renovations. At that time he realized
that he did not have the funds to accomplish the renovations
so he now plans to keep the structure as it is presently but
doing those things which will make it safe for the young
mothers and babies. He stated that he will request con-
ditional usage or anything else necessary to comply with the
City's requirements. He thanked the City for being so help-
ful in providing information for them. Mr. Razza noted that
they had spent approximately $6,000 to bring in plumbing and
to upgrade the facility. He noted that at this time he just
wanted to let the people know what they had in mind. Mr.
Razza stated that at no time would they have more than four
teenage mothers with their babies at the facility. There
will be a supervising family living there with their own
small child, so the mothers will have someone to supervise
them as they go to school to continue their education. He
hopes that this will give them an opportunity to learn to be
self sufficient.
Mrs. Razza noted that this is an educational program and is
eared toward independent living. She stated that the girls
eceive psychological and emotional counseling, have the
best medical care, and are trained so that they can some day
be out on their own with their high school degree and solid
career counseling. She noted that the purpose of the
program is to assist the girls to learn to be out on their
own.

Mr. Razza stated that he was not sure of the procedures
necessary and if they need conditional usage. He stated
that the house will not be occupied by any unwed mothers
until they have the approval of the City. He noted that
they are hoping to have a dedication within two weeks so
that at least the house can be occupied to prevent damage to
the structure.
Commissioner Mann asked if this use is a conditional use and
City Manager Cheney stated that it was an allowed con-
ditional use in that zone. Commissioner Hester asked if
this was a private endeavor. Mr. Razza stated that it is
and they are working on charity and donations. They have
run a dance to bring in money and are seeking private dona-
tions. Mr. Razza noted that the longer the building has to
remain unoccupied, the bigger the chance of it being
damaged. City Manager Cheney clarified that Mr. and Mrs.
Razza are coming to the Commission at this time so that they
can go ahead and move a supervising family into the house.
They did not want to move ahead with this public announ-
cement and appear to be working behind the backs of the
Commission. He noted that the City has been working with
the group and they fully intend to comply with all the rules
and regulations. Mayor Cassandra asked what they would do
if they run into expenses and they cannot accomplish their
plan. Mr. Razza noted that if that happens, the house will
revert back to The Lord's Place. Mayor Cassandra stated
that he was concerned that if the rules are bypassed, the
City is opened up for lawsuits. He agreed that a super-
vising family could live in the facility and have one unwed
mother and baby in the facility. He noted that it takes
approximately two months to go through the procedure of
equestlng conditional usage.
Commissioner Hester stated that he feels that this is a good
project, and if it is within the code that the Commission
should help them out. Commissioner Mann noted that he would
not want to discourage them. Mayor Cassandra stated that it
was the consensus of opinion of the Commission to give the
group a conditional approval following City procedures. Mr.
Razza thanked the Commission and stated that he would follow
the rules.
Conditions in North Boynton Beach
Mrs. Lottie Pierce, 103 N.E. llth Avenue, next expressed the
fact that she is disturbed about conditions in Boynton
Beach. She noted that she has lived in the area since the
30's and the northern end of Boynton is in the worst con-
dition it has ever been. She stated her concern for the

senior citizens living on N.E. 10th, llth and 12th, because
of the loud noise from 6:30 P.M. to 1 A.M. on Saturday
night. She stated that the senior citizens are not getting
any honor or respect and that drugs have taken over. Mrs.
Pierce noted that even when the police pick up someone that
the next day they are back on the street doing the same
thing. She suggested that they be put in jail and made to
work. She stated that the police are doing their job but
they are not getting any help. She asked where the police
are between 12:00 and 3:00 A.M. when the streetwalkers are
standing around. She voiced her concern about 10th Avenue
and the railroad area. She stated that it is a disgrace and
she hates to even go into that area with all the garbage
lying around. She suggested that pressure be put on the
people to be decent and to teach them how. She stated that
code enforcement people should ensure that garbage is not
left lying around. She next referred to the Julia Parker
house on 13th which is half burned down. She asked what the
City was waiting for and why it is not torn down. Mayor
Cassandra asked if Mr. Howell knew the house she was
referring to and he stated that he was not aware of the
situation. Mayor Cassandra asked Mr. Howell to check into
the situation. Mayor Cassandra noted that the dumpster near
the tavern is a problem which he does not know how to take
care of. He noted that the garbage is picked up and in one
hour is right back like it was. Mrs. Pierce was referring
to the vacant lot across the street and along the railroad
tracks. City Manager Cheney stated that he did not know how
to take care of this problem. Mrs. Pierce stated that the
people need to be taught. She stated that the police need to
be more strict with the people. Mayor Cassandra referred to
the newspaper article about police harrassment in her area.
She stated that that should be ignored. Mayor Cassandra
stated that the City would look at that property. Mrs.
Pierce said that 1115 N.E. 1st is a real problem after mid-
night. She requested that Boynton be cleaned up and Mayor
Cassandra stated that the City will do its best to do so.
There was much applause from the audience.

Minutes of September 8, 1987, page 7, 4th paragraph should
read as follows:
"Mayor Cassandra stated that he does not wish to see a
millage increase from last year. A $782,394 decrease in
expenditures will be needed to prevent an increase in
millage. Mayor Cassandra stated that he does not wish to
throw more money from the excess funds into the revenue
because next year those funds are not there. He next
addressed his recommendations for the surplus funds. He
noted that there is ~$1,139,000 in excess. He would like to
take $1,000,000 of that and put it in the Disaster
Fund/Emergency Fund. Be suggested taking $100,000 of that
and put it as a Legal Contingency Fund. This would be used
only if the City is sued. It would not be used the other
way around. Mayor Cassandra stated that this would be left
in the hand of City Attorney Rea and, if needed, he would get
legal service for the City. Commissioner Hester asked if
the $100,000 would come out of the $1,000,000
Disaster/Emergency Fund. Mayor Cassandra stated that it
would not. The other $239,000, he felt, should not be put
in the revenue pot but have another category for that
emergency or request for money which we had no prior
knowledge of. Mayor Cassandra gave an example, a problem
could come up with employees and require more money in that
area. That should be a separate category. City Manager
Cheney stated that should Me called "Undesignated Funds."
Mayor Cassandra agreed."
Vice Mayor Marchese made a motion that the Minutes of
September 8, 1987 be accepted with the corrections as noted.
Commissioner Hester seconded the motion which carried 4-0.

Commissioner Hester moved, seconded by Commissioner Mann,
that the Consent Agenda, Items A.i., B.i., C.1, D.2, E. with
exception of S. G. Philips, F., G. H. and I. be approved.
Mayor Cassandra questioned Item H. under Consent Agenda
noting that there was usually no spot stating how many seats
the restaurant has. He questioned what defines a
restaurant. City Manager Cheney stated that this one should
be withheld until it was further clarified. Mayor Cassandra
stated that a motion to remove and table item H. from the
Consent Agenda pending further information. Commissioner
Hester made a motion that Item H be removed and tabled from
the Consent Agenda, seconded by Vice Mayor Marchese. Motion
carried 4-0.

Commissioner Hester made a motion, seconded by Commissioner
Mann, to accepted Consent Agenda, Items A.i., B.I., C.i.,
D.2., E. with the exception of S.G. Philips, F., G. and I.
Motion carried 4-0.
Mayor Cassandra referred to Item D.1. and asked if the
representative would comply with the new Sign Code which is
presently being written. The representative stated that he
could not agree to comply with the sign code as he did not
know what was contained in it. He asked that the sign por-
tion of his request be removed and tabled so that the
Commission could move on the rest of his request. Vice
Mayor Marchese moved to accept the request submitted by
Shalloway, Inc. excluding the project signage requirement.
Motion seconded by Commissioner Mann and carried 4-0.
Mayor Cassandra stated that he had a question for Mr. Don
Jaeger regarding D.3. which is a matter of concern. He
noted that any requests for site plan modifications for PUD
be initiated by the developer or the association and would
be applicable for every unit in the project. Mayor
Cassandra stated that that was not what they were doing -
they were approving a single home. Carmen Annunziato stated
that the problem arises where there is a governing organiza-
tion in a small (or even a large) residential area where
they have some of their own design criteria in their asso-
ciation documents. He noted that in this instance they have
a letter from the association president advising that they
~re in favor of the request presented. Mayor Cassandra
~sked if it is normal procedure when dealing with the master
)lan that the master plan modification requirement be
:hanged for one home. He asked if the master plan is to be
~hanged in this instance. Mr. Annunziato noted that this
;as for one home and not a blanket approval for all units in
~hat project. Mayor Cassandra asked how he could not
Lpprove another home in that project. Mr. Annunziato
ldmitted that that could be a problem. City Manager Cheney
lsked whether this is a single family or town home develop-
~ent. Mr. Annunziato noted that Cambridge is duplex. Mayor
~assandra related that his concern is that this woUld set up
)recedence. He stated that the City should be protected by
!ollowing the rules. He requested that this be tabled until
~omething can be worked out. Vice Mayor Marchese made a
~otion that this item be tabled, seconded by Commissioner
Mann. Motion carried 4-0.
Mayor Cassandra next addressed the site plan modification
~equest, item D.4. for the Publix Distribution Facility. He
asked about heights. Mr. John Moyle, representative of
Publix Supermarkets, Inc., introduced others with him at the
~eeting. He noted that they are requesting five. minor
6hanges: the steel water storage tank is to be added at the
~.W. corner to provide additional fire protection. The tank
is to be painted a neutral color and will be enclosed in a

ten foot high wall. The pumphouse has been enlarged to
accommodate the water pump. The water tank is all above
ground. Mr. Moyle stated that the next change is that the
guard house has been moved closer to the entrance to provide
security for the employees' parking lot. Next is the truck
checkin booth which has been added to prevent trucks from
stacking up on the street. The meter house will be located
behind a landscaped area and will have a fieldstone finish.
This is being added to meet a FP&L requirement. The rail
dock has been eliminated and the rail cars will now enter
the building and unload inside the building. Mayor
Cassandra informed Mr. Moyle that the sign code is being
revised and wanted this group to be aware of that. Mr.
Moyle stated that he was aware of that and had already spo-
ken with Mr. Annunziato about that.

BIDS
Consider purchase of two used trailers for use at the
Building Department and Police Department during
construction.
City Manager Cheney stated that there were no problems and
that they were recommending purchasing the trailers and
selling them later on when they are no longer needed as it
will be cheaper that way. Mayor Cassandra asked if the City
will have space for the trailers. City Manager Cheney
stated that the delivery date is tied in with the construc-
tion start. Mr. Bill DeBeck confirmed that this is the
case. Mr. Cheney stated that the one for the Police
Department will go at the South end of the police station
and the one for the Building Department will go in the old
existing parking lot on Seacrest.
Commissioner Kester moved to approve the request to purchase
two used trailers for use at the Building Department and
Police Department during construction, seconded by Vice
Mayor Marchese. Motion carried 4-0.
PUBLIC HEARING
Consider request submitted by Cormac C. Conagan,
Esquire, for Boynton-JCP AsSociates, Ltd., and the Lake
Worth Drainage District, to annex a 6.92 acre tract of
land and an abutting 85 foot wide canal right-of-way
(2.787 acres). This property is located on Javert
Street at Boynton (C-16) Canal, southeast corner.

Consider request submitted by James Leary for the
Seacrest Villas Condominium Association for the
abandonment of a 25 foot wide right-of-way located
between Oak Street and Lake Street. (New Palm Way -
Abandonment)
City Manager Cheney stated that he was ready to make
some comments on this one. Mayor Cassandra verified
that residents from Seacrest Villas were present. City
Manager Cheney stated that the residents wished to
abandon the right-of-way between Lake and Oak. Mr.
Cheney stated that due to their concern he met with
Police Chief Hillery, Deputy Chief DeLoach, Chief Rhoden,
Bob Eichorst and Carmen Annunziato to discuss the impact
of closing the street. Mr. Cheney stated that they
continue to recommend against it as they had done
before. He stated that by abandoning the street between
Oak and Lake, a subdivision regulation will be violated
by creating two dead end streets with no cul-de-sac at
the end. He is concerned that the ability to provide
services to property owners on these two streets who are
not a part of this request. It would be impossible to
approach the properties on Lake and Oak from two
directions in regard to police and fire departments.
He noted that there is a very busy restaurant and a
shopping center in the area and both create a traffic
problem from time to time. There should be the
alternative of servicing this area from two directions.
Public Works people would have a difficult situation
by having to back up to the lake causing a safety and
liability problem. City Manager Cheney stated that to
create two dead end streets in this area is not
desirable. He recommends against abandoning this
area and offers assistance from the Police Department
in regard to Crime Watch. He reviewed police reports
noting that in 1985 there were 8 calls for service - 2
for larceny, 3 for disturbances and 3 miscellaneous. In
1986 there were 4 calls - 1 for auto breaking and enter-
ing, 1 vandalism and 2 miscellaneous. In 1987 to date
there have been 8 calls - 1 auto, 2 general larceny, 1
breaking and entering a residence and 4 miscellaneous.
He noted that the records do not show a high police
request for service, therefore, he does not think this
supports closing the street. He is also concerned about
potential reduction in service for the condominium. At
the present time police can go down Lake Drive through
the right-of-way and back down Oak and cover the whole
area easily.
Mr. Jim Leary from Seacrest Villas stated that in the
last calendar year 11 crimes have been committed - two
were stolen cars. He stated that the residents have no
other way of protecting themselves other than depending
on the City. He noted that according to his figures

that one out of six families in the area had been hit by
some type crime in the past year. He stated that they
would accept any help or technique which would close the
north end of their property. He noted that they had cut
down trees, put in extra lighting but could not put up a
fence. He noted that there were 12 houses on Oak Street
and it adjoins the Boynton Boat Club (the park) and that
is where most of the problem is coming from. He
requests some barrier between Seacrest and that area.
Mayor Cassandra asked if Mr. Leary had spoken with
Detective Hawkins regarding Crime Watch. Mr. Leary
stated that they had met with him and were delighted
with that and the people are supposed to send him a
followup letter. Mayor Cassandra suggested that Mr.
Leary and the other residents further pursue Crime Watch
and recommended that they come back to the Commission in
one, two or three months if the Commission does not
approve his request at this time. Commissioner Hester
stated that closing the street violates the subdivision
code and the Commission should not go against a code.
City Manager Cheney requested of Mr. Leary that the
residents call the Police Department at the 911 number
if there is a problem, or even if they think there may
be a problem. Commissioner Mann assured Mr. Leary that
the Commission is concerned and requested that he please
come back soon and let the Commission know how things
are progressing.
Commissioner Hester moved that the request to abandon
the right-of-way between Oak and Lake be denied.
Commissioner Mann seconded and the motion carried 4-0.
Consider request submitted by Carmen Annunziato to
rezone from R-2 Single and Two Family residential to C-1
Office and Professional Commercial for the purpose of
implementing the Evaluation and Appraisal Report. This
property is located on the N.W. corner of Golf Road and
Seacrest Boulevard.
Mayor Cassandra noted that there are some residents from
Ridge Pointe present. Mayor Cassandra wanted to be sure
the residents did not have any misconceptions about height
of structures to be built on this corner. Carmen
Annunziato noted that final action Was not taken on
this item iin order to be sure residents of Ridge Pointe
realized the problem regarding potential height for
structures which could be built on the corners of these
intersections. City Attorney Rea was instructed at the
last meeting to check into the legality of limiting
construction to one story buildings on this corner if
zoned C-1. Attorney Rea did some research and stated
that the courts are not in agreement on the matter of
which controls - the ComprehenSeive Plan or Re-zoning.
Mayor Cassandra relayed, to the Ridge Pointe residents

that this Commission and ones to follow would honor a
one story building but the code calls for two story. He
wanted the reSidents to be aware that some time down the
road a two story building could possibly be constructed.
Mayor Cassandra stated his concern for driveways in this
area. He is concerned about how to get in and out of
the piece of property. Mr. Annunziato stated that it is
possible that all three properties plus the street could
be combined into one development block. He noted that
development is limited by the required setbacks. He
stated that it is buildable but not for a large faci-
lity.
Mayor Cassandra passed the gavel to Vice Mayor Marchese
and made a motion that the request to rezone from R-2 to
C-1 be approved, seconded by Commissioner Hester.
Mr. Mann noted that everyone had approved the request
but he wondered why they had. Mr. Annunziato noted that
several years the property north of Golf Road and east
of Seacrest were rezoned to commercial making three of
the four corners office and commercial. He stated that
this left this property plus the day care center out
of the zoning pattern. Following that, Ridge Pointe
Woods Villas developed eliminating the opportunity for
including these properties into a larger development.
The lots were further isolated. The R-2 zoning which
remains limits the ability to build at that location.
The other three corners are zoned office and commercial
and the action needs to be completed by granting C-1 for
this other corner. Mayor Cassandra suggested that a
copy of the A&E Report be provided Commissioner Mann
which will give him the information he needs. Motion
carried 4-0.
Consider request submitted by Jon C. Yergler, agent for
Post Landing (Boynton), Ltd., for the abandonment of a
12 foot wide drainage easement within the vicinity of a
proposed private recreation area. This propeorty is
located at North Congress Avenue at L.W.D.D. L-21 canal,
southwest corner. (Post Landing)
Carmen Annunziato noted that this area had been platted
prior to the finalizing of the site plan. There was a
conflict between one of the structures and the drainage
easement. The easement serves no purpose and it
conflicts with the location of buildings. The easement
is internal to the site. The TRB recommended approval
subject to comment made from the City Engineer.
As no one wished to speak for or against the issue, THE
PUBIC HEARING WAS CLOSED. Commissioner Hester made a
motion that the request submitted by Jon C. Yergler,
agent for Post Landing (Boynton), LTd., for the abandon-
ment of a 12 foot wide drainage easement be approved.

Planning and Zoning Board
Consider request submitted by Dennis Childs for C.D.S.
Associates, to construct a 150 room motel with a 148
seat restaurant/lounge, including a shared parking allo-
cation. This motel would be located on the west side of
South Federal Highway between S.E. 18th Avenue and S.E.
20th Avenue. (Best Western Motel)
Commissioner Mann moved that the request submitted by
C.D.S. Associates be removed from the table, seconded by
Commissioner Hester. Motion carried 4-0.
Mr. Annunziato noted that this is a two-part request.
The first part requests site plan approval to construct
a 150 room motel at the site of the existing Best
Western which is south of Sun Bank on South Federal
Highway between S.W. 18th and S.W. 20th. The second
part is request for approval of a shared parking alloca-
tion in connection with the construction of a 148 seat
restaurant/lounge to be constructed on the same site.
He noted that access to the site will be from two dri-
veways off Federal Highway. Site runs from U.S.1 west-
ward to the extension of S.W. 3rd Street. TRB reveiwed
this request and it went to P&Z Board with the recommen-
dation to approve subject to staff comments including
Shared parking allocation. He noted that P&Z reviewed
this request and the applicant agreed to comply with
staff comments so P&Z voted unanimously to recommend to
the Commission that this be approved subject to staff
comments. Community Appearance Board also reviewed the
request and unanimously approved it. Mayor Cassandra
noted that the pool has been moved from its previous
site. Mr. Annunziato stated that it will now be located
center south. Next the color renditions were examined.
Mr. Childs, representative of C.D.S. Associates noted
~hat there is a 20 foot landscape buffer between the
road and the parking area. Mayor Cassandra voiced con-
cern about the cuts to the highway in that area. He
noted that two cuts are allowed for this project. Mr.
~nnunziato noted that there are presently three cuts in
t~his area so this project is eliminating one cut and one
cut is being expanded with a full turn lane to make it
s!afer. One curb cut is being eliminated according to
Mr. Annunziato. He noted that the median cut is to the
south with an adequate turn lane. Mayor Cassandra
e~pressed his concern about people coming from the
south, going north, wanting to visit the site. Mr.
Cihilds noted that the exit on the northern end of the
piroperty has a sign stating right turn only. Mayor
Cassandra stated that he feared that ~people would still
want to come out the northern exit a~d make a "U" turn.

City Manager Cheney stated that a "No U Turn" sign could
be installed and Mayor Cassandra noted that this should
be done. Mayor Cassandra asked if all the existing
structure would be raised to the ground. Mr. Childs
stated that that was the case except for the tennis
courts which they are preserving. Mr. Childs stated
that the building will be four stories high. He also
noted that they have landscaping which will block most
of the parked cars in front from the highway within a
couple of years.
Vice Mayor Marchese moved that the development plans for
the Best Western Motel including all staff comments and
the shared parking be accepted. Motion was seconded by
Commissioner Hester and motion carried 4-0.
Consider request submitted by Carmen Annunziato to
rezone from C-3 Community Commercial to C-4 General
Commercial for the purpose of implementing the
Comprehensive Plan Evalaution and Appraisal Report.
This property is located on Old Dixie Highway, east
side, between Miller Road and Gulfstream Mall. (Old
Dixie Highway Frontage) (C-4 rezoning denied on
September 2, 1987 and request made to place on September
15, 1987 City Commission Agenda).
Mr. Annunziato stated that this property is located on
Old Dixie Highway, east side, between Miller Road and
Gulfstream Mall. Mayor Cassandra noted that some of the
lots go from Old Dixie through to U.S. 1. He stated
that it is conceivable that C-4 might creep to U.S.1.
Mr. Annunziato pointed out the zoning line on the
overhead. He also noted that some of the lots in this
area are County. He stated that under C-4, warehouses
are not permitted but Mayor Cassandra pointed out that
in County projects they could come in. Mr. Annunziato
agreed that this could happen. Mayor Cassandra stated
that he does not like C-4 zoning. Mr. Annunziato stated
that there were several elements which went into their
recommendation. He noted that there was an existing
situation of some auto repairs on Dixie as a result of
County zoning. He noted that they have had several
requests for rezoning in that area. The use in C-3
usually requires high volume Of traffic to make them
work according to Mr. Annunziato. He stated that this
volume does not exist on Dixie Highway. He noted that
there is a requirement to do an economic analysis. He
felt that an evaluation of commercial land uses on North
Federal Highway as well as those on South Federal
Highway to see if the pattern of zoning is appropriate.

Mayor Cassandra stated that this is an excellent idea.
Mr. Annunziato noted that this request was previously
denied. }{e stated that they should continue to analyze
this through the comprehensive planning process and
offer recommendations. Mayor Cassandra stated that he
felt an economic analysis would be a good idea at this
time.
Vice Mayor Marchese made a motion that an economic ana-
lysis be done. Motion was seconded by Commissioner
}{ester and carried 4-0.
Consider request submitted by Jack Wolfe, President of
Boynton Lakes Plat No. 2 Homeowners Association, for a
Master Plan Modification.
Mr. Annunziato stated that this request was to allow
roofed-over screen enclosures at Boynton Lakes, Plat 2.
This follows a request for utilities easement abandon-
ment which was recently approved. The Commission is
asked to determine if this request constitutes a
substantial request and if new zoning is required or if
the request is not a substantial one. Mayor Cassandra
asked if there were any codes enforcement problems in
this area. Mr. }{owell stated, that to his knowledge,
there are no liens on any properties in this area.
Commissioner Mann made a motion to recommend no substan-
tial change in this case. Motion was seconded by Vice
Mayor M~rchese and carried 4-0.
Consider request submitted by Kevin Mc Ginley, agent for
D.R. Associates, for approval of an amended site plan to
allow for the constructin of project signage. This
development is located on West Boynton Beach Boulevard
at the L.W.D.D. E-4 Canal, northwest corner. (Cross
Creek Centre)
Mr. Annunziato requested that this item be put on the
table. Commissioner }{ester moved to table the request
submitted by Kevin McGinley, agent for D. R. Associates,
for approval of an amended site plan to allow for the
construction of project signage (Cross Creek Centre).

City Attorney Rea summarized events regarding this proposed
ordinance. He noted that at the September 1st meeting that
this was brought up originally on second reading and
public hearing was held and closed and the Commission voted
~o continue on this date pending some legal interpretations.
He noted that the attorney for Shooters of Boynton Beach
made several legal arguments regarding the Comprehensive
Plan and other processes that took place. She provided her
requests in writing to Attorney Rea and he found one major
area that the City has not overcome. He noted that she
indicated that when the issue was originally brought to the
City Commission her client was not notified of proposed land
use amendments and was not at the hearing. At the July 2nd

hearing a Mr. Morton Goldstein spoke on behalf of Roland
Maranda indicating that he would love to have the whole

Shooters, Boynton Beach, Inc. has no corporate officer or
registered agent by the name of Roland Maranda. His rela-
tionship with the corporation is not known to the City. The
City must show that it has given sufficient legal notice and
that the people whose property which was affected had been
given sufficent notice. Attorney Rea does not feel that
~hat determination can be made in this case. He suggested
that since the public hearing is closed that the vo~e be
tabled for a period of time. In the interim he requests

hat the Commission direct staff to prepare the text amend-

fact that Roland Maranda is not a corporate officer and has
no legal connection to corporate entity which owns the pro-
perty. He noted that anyone could come off the street and
claim to represent someone, but the question is whether or
not they have the actual legal authority to represent that
person. Mr. Rae noted that if the Commission made a deci-
sion based upon Mr. Maranda's recommendation, he noted that
the Commission must prove that Mr. Maranda was authorized.
Commissioner Mann made a motion to postpone the voting on
Ordinance 87-26, seconded by Commissioner Hester and carried

City Attorney Rea read Proposed Resolution No. 87-JJJ by

"A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
BOYNTON BEACH, FLORIDA, ADOPTING STANDARDS FOR THE
DESIGN AND CONSTRUCTION OF IMPROVEMENTS REQUIRED FOR
PARKING LOTS; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER
PURPOSES"
Mr. Owen Anderson, 2181 S.W. 15th Avenue, Executive Vice
President, Chamber of Commerce, referred to the specifica-
tions for 90 degree angular parking with a 27 foot wide
isle. He noted that in a parking inventory study, City of
Boynton Beach, by Bridge and Associates, Inc., page 23, item
4, that only a 24 foot isle is required. He stated that the
City is requiring a 27 foot isle and noted that he felt this
was excessive and asked that it be reduced.
Mr. Annunziato stated that the sizes of the parking spaces
had been reduced from 65 feet to 63 feet (from 10 feet x
20 feet to 9 feet x 18 feet. This smaller size parking
space necessitates enlarging the isle to allOw cars to move
freely in and out of a space according to Mr. Annunziato.
Mayor Cassandra asked if Mr. Annunziato had referred to the
study by Bridge and Associates, Inc. and he stated that he
had read the study. Mayor Cassandra then asked Mr.
Annunziato to spend some time with the Chamber members
explaining how he came up with the specifications.
Vice Mayor Marchese moved for the adoption of Resolution No.
87-JJJ, seconded by Commissioner Mann. Motion carried 4-0.
D. Other
Consider acquisition of 10 acre tract of land adjacent
to Shooter's Restaurant .............. TABLED 9-1-87
Commissioner Rester moved that this item be taken off the
table, seconded by Vice Mayor Marchese. Motion carried 4-0.
Attorney Gene Moore stated that he directed a letter to the
Commission on June 26th asking that they consider the
possible acquisition of a 10 acre site immediately west of
the inlet (south of Shooters and between Watersedge). He
stated that it is a unique piece of property which could be

utilized for City use, possibly as a Civic Center. He noted
that it could possibly be put on a referendum for financing.
Mr. Moore stated that $2.5 million is the asking price (5.75
per square foot) and in his estimation, the owner would be
willing to enter into a contractual agreement with the City
after price negotiations and subject to a referendum for
approval. He noted that he felt the City should use fore-
sight as to future land needs. This could be used as a City
Marina, etc. and if acquired, could be held in inventory and
used for passive uses until needed.
Mayor Cassandra noted that this is the only piece of land
available which goes to the water. He pointed out that the
only piece of land the City has that goes to the water is
the boat ramp. He suggested that the City might also want
to consider Watersedge development, Banana Boat, and the Two
Georges for acquisition. Mayor Cassandra asked if any
further discussion was desired on the feasibility of this
acquisition. Mayor Cassandra noted that it might be best to
put this on a referendum and let the people decide.
Bob Fauser, 125 S.E. 6th Avenue, asked Mr. Moore which three
lots he was referring to. Mr. Moore clarified that it was
the whole thing. Mr. Fauser continued to note that he had
attended other CRA meetings in the past where it was
suggested that the City spend $10-15 million in the downtown
area. He noted that this would be an expensive item also
but that the taxpayers would have to consider. There are
many things the citizens would like to do, but they just
don't have the money. Mayor Cassandra noted that if the
Commission decided to look into this further, that it was
likely to be put before the taxpayers.
Vice Mayor Marchese stated that he would like to see staff
further investigate the possibility of acquiring this piece
of property. Mr. Moore stated that he would contact City
Manager Cheney. He noted that the first step would be to
get an appraisal. Mr. Cheney stated that he would like to
talk to Mr. Moore about this, but he would like to check
into a cost for the appraisal before the next City
Commission meeting.
Mike Greenhouse, 618 N.E. 20th Lane, Watersedge. He noted
that the above would require changing zoning, and even though
it is a nice piece of property, he recommends that the City
stay with present plans. The residents of Watersedge would
like to go forward with the Comprehensive Plan. Mayor
Cassandra assured Mr. Greenhouse that all the Commission has
agreed to do is to investigate the situation.

Approve Water Service Agreement for Allen and Margarita
Lopez.
City Manager Cheney noted that this request involves an
individual lot north of Miner Road area which is in the
City's service area. People in this area continue to have
health and water problems. He noted that the City has an
obligation to provide service for these people, lot by lot.
Mayor Cassandra noted that these people are still on septic
tanks and this bothers him. It was noted that there are no
sewer loops in that area. City Manager Cheney noted that at
~ome point sewer lines are going to have to be put in. This
is County but in the City's service area. There are water
lines but no sewer lines in the :area. Commissioner Kester
moved that the Commission approve the Water Service
Agreement for Allen and Margarit!a Lopez, seconded by Vice
Mayor Marchese. Motion carried 4-0.
3. Discuss definition of Term of Office and Resignations.
This item was TABLED.
Consider reports concerning expansion of Community
Redevelopment Area.
City Manager Cheney referred to the report by the Planning
epartment, and a report by the Police Department. He noted
hat the next step, if the Commission agrees, is to instruct
the City Attorney to prepare the appropriate resolution,
advertise it for 10 days as necessary, or appropriate County
fficials for 15 days, and then come back to the Commission
ith that resolution. Commissioner Kester moved to proceed
to the next step in considering expansion of the Community
Redevelopment area. commissioner Mann seconded the motion

City Manager Cheney noted that this item ties in with the
closing of the old landfill and attempts to spend some
dollars out of the golf course budget and not out of general
City funds. This proposes to assist the landfill closure
engineer in his final preparation for the closure of the
landfill in such a way that will not require going back and
redoing in the future in case the city wishes to develop the
40 acres of landfill area at some future date into an addi-
tional nine holes for the golf course. In the beginning the
course was designed for 27 acres with a general design for
an additional 9 acres on the piece of land across the canal.
Mr. Cheney asked if the Commission wished to take the next
step at this time and save some money or if they desired to
close the landfill as the landfill engineer designed it with
no thought to the golf course. He noted that to pay a
little now may save a little later. Commissioner Mann asked
if this was to approve only the $8,000 for master planning.
Commissioner Hester asked where the money was coming from.
City Manager Cheney stated that it was from the golf course
budget.
Vice Mayor Marchese moved that the Commission adopt the
agreement with vonHagge & Devlin for the master planning of
additional nine holes for Boynton Beach Municipal Golf
Course for approximately $8,000. Motion seconded by
Commissioner Hester and carried 4-0.

Commissioner Hester moved that the resignation of Henry
Stanley, Civil Service Board, be accepted. Motion was
seconded by Vice Mayor Marchese. Mayor Cassandra requested
that the City Clerk send a letter of appreciation to Mr.
Stanley. Motion carried 4-0.
Attorney Rea next gave guidance regarding replacement for
Mr. Stanley. Mr. Stanley was appointed by the Commission,
therefore the first alternate moves up as a permanent member
of the Civil Service Board without any further action on the
part of the Commission. Mr. Rea stated that Stephen Frazier
would now become a permanent member of the Board and Arnold
Fasano would become first alternate. Commissioner Zibelli
will then appoint the second alternate.
Commissioner Mann made a motion that the action to appoint a
second alternate be tabled Motion was seconded by Vice
Mayor Marchese and carried 4-0.
