Minutes 09-16-86MINUTES OF THE REGULAR CITY COUNCIL MEETING HELD AT CITY HALL, BOYNTON BEACH, FLORIDA, TUESDAY, SEPTEMBER 16, 1986 AT 7:30 P. M. PRESENT Nick Cassandra, Mayor Carl Zimmerman, Vice Mayor Robert Ferrell, Councilman Ezell Hester, Councilman Dee zibelli, Councilwoman Peter L. Cheney, City Manager Betty S. Boroni, City Clerk James W. Vance, City Attorney Mayor Cassandra called the meeting to order at 7:32 P. M. The Invocation was given by Rev. Sylvester Banks, Jr., Bible Church of God, followed by the Pledge of Allegiance to the Flag led by Councilwoman zibelli. AGENDA APPROVAL City Manager Cheney reminded the Council that he put a number of corrections to the agenda in their folders and he read the "Agenda Addendum". He called attention to "C. Resolutions" on the "CONSENT AGENDA". Because a Resolution was adopted last evening, the two Resolutions on the Consent Agenda were changed to 86-QQQ and 86-RRR. Under "IX. OLD BUSINESS," Councilwoman Zibelli added "Reconsideration of Review by the Community Redevelopment Agency (CRA) and the Planning and Zoning (P&Z) Board". Mayor Cassandra pulled out item 3 (Phase II of Mahogany Bay project) for discussion. Councilman Hester moved, seconded by Councilwoman zibelli, to accept the agenda as corrected. Motion carried 5-0. ANNOUNCEMENTS Proclamations Mayor Cassandra read the following Proclamations: a) Constitution Week - September 17 - 23, 1986 Mayor .Cassandra presented the Proclamation to Dorothy Thomas, of the Jonathan Dickinson Chapter of the Daughters of the American Revolution. - 1 - MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA SEPTEMBER 16, 1986 b) Fire Prevention Week - October 5-11, 1986 c) LuDus Awareness Month - October, 1986 Someone from the American Lupus Society of Southeast Florida wished to speak, and Mayor Cassandra said she would be allowed to speak during Public Audience. d) Iron Overload Diseases Awareness Day - September 21, 1986 CITY MANAGER'S REPORT City Awarded Certificate of Achievement for Excellence in Financial Reportinq For the sixth year in a row, City Manager Cheney said the City has once again received the Certificate of Achievement for Excellence in Financial Reporting. The financial report the City submits every year goes through an exhaustive review by professionals in local government. A limited number of cities receive the award, and City Manager Cheney pointed out that the City has received the certificate every year that Grady Swann has been the Finance Director. Mr. Swann was recognized by the Council and received applause. Golf Course Permits The City has been selling golf course permits since the middle of August for next year. 800 permits were set aside. Through today, City Manager Cheney said the City sold 640. 730 are left to be purchased throughout the rest of this month~ If all 800 permits are not sold, it does not bother the City because, from a point of view of financing the golf course, they make more money if they have non-permit holders paying green fees than if they have permit holders. City Manager Cheney suspected all 800 permits would be sold by the end of the month. Woolbright Road Extension Beyond the Western Part of the City City Manager Cheney reminded the Council that this was ~pproved at one time by the Board of County Commissioners in he five year plan and was brought to the County a week ago 'elative to signing a contract with the Design ~ngineer for he project. Representatives of Quail Ridge wanted to discuss the matter on the County agenda. The County notified £ity Manager Cheney, and he was there too. ~uail Ridge was asking that nothing more be done until the oad statistics for the next ten year road plan are presented - 2 - MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA SEPTEMBER 16, 1986 by the Metropolitan Planning Organization, so they can review the statistics and see if they will support the extension of Woolbright Road. City Manager Cheney reminded the Commissioners that they had supported the project once; the City was a strong supporter of the project, and he thought it was best to get on with signing the contract. City Manager Cheney suggested to the County Commission that they were supposed to have Congress Avenue, south of Boynton Beach Boulevard, designed and constructed by now; that kept getting delayed, and they are still doing the design. He also reminded them that the City already knows it has traffic problems that can be resolved if Woolbright Road is extended through Quail Ridge. The Commission did vote to execute the agreement. The Engineer will not spend the money for another ninety days while they see if the figures come in and Quail Ridge has a chance to study them. City Manager Cheney also pointed out that representatives from Greentree and some of the other "trees" out there spoke in favor of Woolbright Road going through Quail Ridge. The opposition to Woolbright Road through Quail Ridge appeared to be primarily Quail Ridge, which was not surprising, but City Manager Cheney reminded everyone that the plans for Woolbright Road were on the maps before Quail Ridge was even thought about. Joint CRA/City Council Meeting Thursday, September 25, 1986 Special City Council Meeting Wednesday, September 17, 1986 at 4:30 P. M. City Manager Cheney reminded the Council of these meetings. Mayor Cassandra said the three Attorneys that will be at the meeting tomorrow night (September 17th) are Kirk E. Friedland, Donald P. Kohl, and Charles F. Schoech. Two Attorneys definitely will be here. One will be here at 4:30 P. M., and one will be here at 5:15 P. M. Attorney Schoech will let Mayor Cassandra know tomorrow whether he will be here. He wanted time to think about it, and if he goes to the meeting, he will be there at 6:00 P. M. City Attorney Vance has opened up his telephone to all three Attorneys, if they wish to call. The City Manager's Report was accepted as presented. PUBLIC AUDIENCE Mayor Cassandra announced that anyone wishing to speak on an item that was not on the agenda could do so now. If there was an item on the agenda that they wished to speak on, they would be called when that item came up. American Lupus Society of Southeast Florida Amy Robinson, representing the Lupus Society, 157 N. W. 3rd Street, Boca Raton, Florida 33432, informed everyone that she and one in 500 Americans have Lupus. It is a disease that affects the body's defense system. The difficulty in dealing with it is its unpredictable nature, and she explained. 5,000 people die each year with Lupus. Ms. Robinson told everyone that the sunshine in Florida can cause flare ups of the disease. It affects women in child bearing age and, primarily, black women. Before and after child bearing years, it affects men and women equally. She brought literature, and Mayor Cassandra suggested she leave it on the back table. Problem with Home Improvements Elizabeth Jenkins, 711 N. W. 1st Street, told of problems she was having with Lamar Industries, Inc., 2900 North Dixie Highway, Fort Lauderdale, and Dan Hood, Electrician, P. O. Box 1179, Boynton Beach, Florida 33425. Mr. Hood's telephone number is 737-0177, but when Ms. Jenkins tried to reach him because the electrical work in her home had not been finished, his phone was disconnected. After doing part of the work, Ms. Jenkins said the contractor and electrician ran out on her, and she elaborated. Ms. Jenkins said she paid for part of the work, and the contrac- tor and electrician are "mad" and asking for the rest of their money. She told them, "No satisfaction, no money." Ms. Jenkins talked to a man in the Building Department, and she expounded. She told the man that there was a permit, but it did not seem to help her. Ms. Jenkins went into detail. Ms. Jenkins also called City Manager Cheney's office but he was on City business, and his Assistant was out of town. She took the matter to the Concerned Citizens for the Better- ment of Boynton Beach. The matter was discussed, and they told her to bring it to the City Council. Ms. Jenkins explained. Council- man Hester seconded the motion, and the motion carried 5-0. V. BIDS A. Approve purchase of communications equipment - Motorola and others City Manager Cheney called attention to a number of people who were present to answer questions or make presentations and said the item the Council was involved with tonight was accepting a bid and awarding an agreement or purchase contract to Motorola for the purchase of radio equipment for the City's new communications center, which was identified for the Council in previous correspondence, etc. City Manager Cheney said they were also here to talk about part of "VII, DEVELOPMENT PLANS, A," which pertained to the tower the City proposes to erect that was on the agenda for the height exception and because a proposal for financing and handling the tower was to be discussed. City Manager Cheney stated that the City hoped to purchase $1,200,000 worth of equipment from Motorola, get the Council's feeling about a possible joint public/private partnership on the power construction, and get the Council's approval of a height variance for the tower. City Manager Cheney informed the Council that throughout the country, one of the coming modes of communication is cellu- lar telephones. FCC has granted two companies the rights to have cellular telephones in Palm Beach County, One is McCaw Communications Companies, and they have a subsidiary in West Palm Beach. McCaw Communications is in the process of making a proposal to the City that they will fund the tower on a site to be provided by the City. McCaw Communications and the City will jointly use the tower, which will save the City some- where between $125,000 to $150,000 up front cash. There have been initial discussions on a proposed contract between - 10- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA SEPTEMBER 16, 19'86 them; Craig Grabeel, Assistant to the City Manager; James Vance, City Attorney; and City Manager Cheney, to a point where City Manager Cheney thought they could work out an agreement. At this time, City Manager Cheney said they had to face the policy issues and whether they wanted to have a joint public/private tower on City land. McCaw will build the tower. All the City does is put its equipment on it, such as antennas, etc. They should discuss that, as well as the Motorola award. Mayor Cassandra asked if there were any letters relative to Mr. Grabeel's memo of September 16, 1986 or with regard to the materials the City was buying. He was concerned about the priority of emergency calls. To get into the Chief of Police's area, Mayor Cassandra read that you had a priority but did not read that you could break in, and he asked if it was true that they had to wait until a line was vacated or open. Bob Scott, Senior Account Executive, Motorola, Inc., answered that the emergency call feature on the portable radio will allow immediate access into the dispatch center, so the dispatch center will know which particular unit is having the problem. Within 1/2 a second, the system will allow the user of that radio to gain immediate voice contact into the dispatch center. If there is a line, you would get through. The system has five priorities. The emergency level is the highest priority. If all channels are busy, the emergency call would go into the highest cue. As soon as the first radio transmission words are dekeyed, they would have access. If something does not dekey, Mayor Cassandra commented that they would not come in. He thought-that feature should be considered, and he wondered if that was the way the City wanted to go. Instead of one line for the Police, City Manager Cheney pointed out that there would be the availability of four. There was discussion. Mr. Scott confirmed Mayor Cassandra's statement that an Officer could press the button and still not get a voice channel until someone would dekey, but he added that the dispatcher would be aware of the fact that there is an emergency and could break into any line. The other question Mayor Cassandra had was that all of the statistics he looked at referr.ed to 320 feet for the tower. He wondered whether any data was taken to show they could use a smaller height. Mr. Grabeel replied that the basis of the tower design was the public safety portable radio, which was part of the system. He referred the Council Members to their binders and area coverage map, which was Job No. J2013-11. The most' severe case of the City's system would be a Policeman inside of a building with a radio on his belt and a public safety microphone on his lapel. That is the minimum acceptable area that can be covered, and it must be covered with that type of radio. There was discussion. Mr. Grabeel advised that one of the worst enemies of this frequency range is the Australian Pine's needles, which are exactly the length of part of the sound wave that the radio generates. It soaks up the signal like a sponge. There was comparison between that system and the current system. City Manager Cheney said the current system cannot and does not have the power height and enough repeaters to get the north end of the City. After discussion, Mayor Cassandra asked why they would need a 320 foot tower, if the report he was reading said there was no propagation problem. Dave Pascoe, Senior Consultant, Booz, Allen & Hamilton, Inc., Bethesda, Maryland, said they performed the propagation analysis and also performed some tests on the current system. He explained that the state- ment about equipment problems Mayor Cassandra had referred to meant the interconnection between the multiple sites and the main site. Mr. Pascoe elaborated and said they are avoiding all of that. He assured Mayor Cassandra there is no problem with radio propagation. Mr. Pascoe said the reason for choosing the 325 foot tower was, as Mr. Grabeel mentioned, for the Police portable on ~he belt with a microphone attached to him, inside of a building. They found that the limiting point is 320 feet. Mr. Pascoe said they could see a certain gain at each suc- cessive interval. In order to achieve the coverage for that portable radio, they will have to go to 325 feet for the receiving antenna. After other comments, Mayor Cassandra pointed out that West Palm Beach's Civil Defense has a 145 foot height, and they are covering all the way up to Jupiter. The City's system has gone to Lantana and Gulfstream, and that was the limit- ing point as far as their coverage. Mr. Grabeel advised that they will have much greater coverage. - 12- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA SEPTEMBER 16, 1986 Mayor Cassandra asked how high the private company had to go on the antenna. Mr. Grabeel believed they requested from 100 to 200 feet. City Manager Cheney pointed out that the report the Council had from the Consultants clearly made the statement that the tower is needed, and they had to assume Consultants of their caliber had done that kind of analysis. Mayor Cassandra stated that if it had been shown in the report that all of these tests had been done and how the Consultants got the end result, there would not have been all of these questions. Mayor Cassandra questioned whether there would be guide wires or a collapsible antenna. Mr. Grabeel answered that one of the advantages of a partnership is that they can go to a self-supporting antenna. With a guide tower, they could not guide it to the desired 80% but would have to guide it at 60%. Mayor Cassandra asked how the tower would collapse if it gets hit with 180 miles per hour winds. Mr. Bud Blaksley, General Manager, Ellis Tower Company, Inc., Fort Lauderdale, replied that they do not design them to collapse. That was why they put the 180 m.p.h, figure on there. There was more discussion. Mayor Cassandra informed Mr. Blaksley that they are going nto a residential area. Mr. Blaksley asked if there are omes within 320 feet of it. Mayor Cassandra believed there were. Mr. Blaksley said there was no real history of failure because they are so rare. They have analyzed the failures over the 30 years they have been in business and aw the 1500 foot tower in Orlando fall within the confines f an area the size of the Council Chambers. Mayor Cassandra wanted to know how it falls. Mr. Blaksley said the question ~as how it would fall. It would be virtually impossible for it to just blow straight over. It goes into a collapsing ~rrangement. Usually, it piles up around the base of the uower. layor Cassandra asked if it had a Doint it collapsed on. r. Blaksley advised that a bad th~ng to do is to build a eak point in the tower, and he explained. They tried to un an engineering analysis on failures, but there is no way hey can do it because each one will fail from a different cause. Mr. Blaksley said their biggest concern with failures are human, not the weather. It is usually that a truck will run into it, etc. They secure the sites and have had no problems. Mr. Grabeel advised that Ellis Tower Company installed the towers on the Autec range. - 13 - MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA SEPTEMBER 16, 1986 Mayor Cassandra asked how they would guarantee the support of the dish attachment to the tower so it would not come flying loose. Mr. Blaksley answered that the dish mounts they provide have the same integrity of the tower. City Manager Cheney advised that the City will be putting a dish on there, and if the Council goes with the proposal, Cellular will be putting dishes on there too. He did not know the size of the dish because the analysis of the frequencies had not been done. If the City goes with McCaw Communications Companies, McCaw has agreed to have the analyses done. Ralph Marchese, 1901 Roma Way, questioned whether a Police Officer in trouble could have his needs attended to if he got through to a Dispatcher. City Manager Cheney informed him that he does not propose things that the Police Chief, Fire Chief, and department heads are not satisfied with. He wanted to make it clear that they had been involved with this in every department for the last six months. Police Chief Hillery affirmed that the Police Department has been involved since the initial planning stages and has been working closely with the Consultant and Motorola. They have been to several displays, have seen films, and are versed on the operation. Chief Hillery said the Police are completely at ease with the area Mr. Marchese was concerned with. Chief Hillery told of the problems with the present system and said this system alerts the Dispatcher immediately. At the first instance, when someone unkeys the mike, he goes to the head of the class. Chief Hillery was not talking about a great deal of time. He was'talking about micro-seconds. The Police feel much more comfortable with this system than with the present system. There was more discussion, and more comments were made about the information that was received. Mayor Cassandra repeated %hat if they had that data, he would like to have it. G~uncilman Hester was sure the Consultants were not going to give reports on something that had not been thoroughly investigated. Councilman Ferrell pointed out that some of ~he Council were satisfied, and he did not want people to ~hink all of the Council had some questions. There were more ~omments. As far as the propagation, Mayor Cassandra wanted that information to substantiate that what was said was true. The original concept they wanted to buy was $1,000,000 and some odd dollars. The new proposal came out to around 2,000,000 and some odd dollars. Mr. Grabeel thought everyone agreed the City would have what they need and will have plenty of room to grow. One thing City Manager Cheney said the City does not have is a computerized dispatch. There are still a lot of questions as to whether that has developed to the stage of what it should be, but that can be added. He explained what the system would do. City Manager Cheney informed the Council that the City is buying the tape recorder from Dictaphone instead of buying it from Motorola and are saving substantial money. A part of the original cost of $2,000,000 to Motorola included the tower. Even if they bought the self supporting tower, the City found it could buy it directly from Ellis Tower Company cheaper than they could from Motorola. Motorola has some money in there as furniture and desks. City Manager Cheney said the City is saving money on those things by buying direct. The City is in good shape and will come back in annual budget and add. City Manager Cheney thought they had satisfied everyone that the City has a good solid based system now, and it will work well. He went into more detail. Dave Rutter, General Manager, McCaw Communications Companies, Personal Communications Division, 5808 Lake Washington Boulevard, Kirkland, Washington, said his company is committed to the cellular telephone industry. They are basically car phones and portable phones. It is their goal to make that product a household item, and it is their dream that the cellular phone will follow the path of the small computer. In the past year, prices have gone from unobtain- able down to where people can afford them. Mr. Rutter expects the price to go further down as the industry takes off and progresses. Mr. Rutter agreed with City Manager Cheney that they are a quasi-public utility. They are a private company with licenses in 27 major metropolitan statistical areas through- out the United States and own them through local partner- ships. The one here is West Palm Beach Cellular Telephone Company, Riviera Beach, and it would be a subsidiary of McCaw. Mr. Rutter said his company is owned by Affiliated Publica- tions and the McCaw family. City Manager Cheney answered that the City has a draft agreement that Mr. Rutter, Mr. Grabeel, Attorney Vance, and he have been going over. Tonight, the Council would be approving the concept. Financially, City Manager Cheney said the City would provide the same site they have been talking about through a lease. Mr. Rutter's company will build the tower, which will prob- ably be in the range of $125,000 to $150,000. His company and the City will be on the tower, and they agree that they will not interfere with each other relative to communica- tions and interference. They agree that Ellis will build the tower and will be the technical person relative to the tower's strength. They agree that each of them, maybe through Ellis, will put up their "stuff". Mr. Rutter's company will have a building on the site that they will pay for, a generator, and their own electricity. The City will have a building, a generator, and its own electricity, which it will pay for. City Manager Cheney continued by saying Mr. Rutter's company will maintain the tower. If they should drop out of busi- ness, the tower will become the City's. If they sell the business, the deal goes with them, with the City's same protection. 1 £ity Manager Cheney advised that language is in the agree- n.ent that says in spite of their joint decision making on %'ho else is allowed to use the tower, nothing will interfere ~ith the governmental function of the City, which is the afety and emergency. If the City is going to rent space rom the tower to some other user at the City's height, City ~anager Cheney said that is a business arrangement, not a governmental arrangement, and they will have a joint agree- ~ent on that. r. Rutter said his company is committed to the FCC by license aw to cover the three County area that is the standard etropolitan area of West Palm Beach. Boynton Beach is part f that. They are providing a service to Boynton Beach, ave many subscribers, and at some point, they will be efore the Council, trying to approve the communnication's tability. City Manager Cheney elaborated. Mr. Rutter showed the Council a cellular phone. City Manager Cheney recalled that at the last meeting, a citizen asked if a tower above the height limit of 45 feet would serve the City. City Manager Cheney told him i-t would be there to serve the City. After explaining, he pointed out that with this development taking place, they will be putting another user and not just the City on that tower. It is a quasi-public utility. It is not just any business firm, but it is licensed by the FCC. Mr. Grabeel advised that the original bid for a sky tower was $50,000. For a free standing tower, it was $125,000, but there will be some structural improvements, and it will probably be more. City Manager Cheney added that the City will still have to spend money for its building and trans- former. Mayor Cassandra asked if they were going to knock the buildings down at the sewer plant. City Manager Cheney replied that this location would not affect those buildings, but some day the City will knock down some of them. He told about the area. City Manager Cheney asked the Council if, in their judgment, it would be reasonable for the City to continue to try and work out the agreement, as Mr. Rutter wanted to get on with the construction of the tower in November or December. Mr. Rutter interjected that it is his intention to move as quickly as possible. Vice Mayor Zimmerman asked City Attorney Vance if he saw any legal involvement or entanglements on an agreement with an ownership combination. City Attorney Vance answered,"No", and added that it will not be an ownership combination. That was one of the earlier suggestions, but it was his position that the City must own the tower. Under the pro- posed draft agreement, the City will, in fact, own the tower and will merely lease space to them. In the event they break the lease, they will lose their space on the tower for any reason whatsoever. In any event, the City will own the tower. It is a long term, 50 year lease. Approval of Utility Lines on Seacrest Boulevard City Manager Cheney thought his memo of September 16 was self-explanatory and recommended that they approve both bids. He said the County has to relocate, at the cost of the project, the pipes that come through that field on the northeast side of Seacrest from the old sewer plant. City Manager Cheney recommended (1) that the Council approve ~he utility agreement where the City contracted the County o do the work of the Contractor, and (2) that they support he idea that they urge the County Commission to pay for the relocation of the pipes. Vice Mayor Zimmerman asked if the County had been approached on this. City Manager Cheney had written to Herb Kahlert, County Engineer, and suggested this should be in with the County money. He talked to Mr. Kahlert personally, and indicated in his letter that he would be glad to go to the - 18 - MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA SEPTEMBER 16, 1986 County Commission and discuss it with them, to assist them in understanding the City's reason for this. Councilwoman Zibelli moved to approve the utility lines with the addition of urging the County to pay for the relocation of certain sewer pipes. Councilman Ferrell seconded the motion, and the motion carried 5-0. C. Emergency Repair to High Service Pump Motor ~7 John A. Guidry, Assistant Director of Utilities, assured Mayor Cassandra that this was an emergency. The motor burned out due to age, etc. If the City had a peak demand at this point and time, they could not meet it. The cost is $4,200. Mr. Guidry informed Councilwoman zibelli the motor was nine years old and pumped perpetually. Vice Mayor Zimmerman moved to authorize the repair'to high service pump motor #7 for $4,200. This development will be known as Post Landing and will be located on the west side of Congress Avenue, north of NW 22nd Avenue Consider request submitted by Patrick Mullen, agent for Metro Development Corporation, for site plan approval to construct 196 multi-family units plus recreation and landscaping at Phase II of the Mahogany Bay project (Congress Lakes PUD) to be known as Post Landing. BOYNTON BEACH, FLORIDA SEPTEMBER 16, 1986 Patrick Mullen, Gee & Jenson Engineers, Architects, Planners, Inc., 2090 Palm Beach Lakes Boulevard, West Palm Beach, Florida 33402, said Glen Nicotra, Vice President of Post Florida, the contract purchaser and developer of Post Land- ing, was present. Mr. Mullen noted that the agenda stated he and Mr. Nichols were Agents for Metro. He informed the Council that Post Florida is purchasing the property from Metro and is going to develop it. It has nothing to do with Mahogany Bay. Mr. Nicotra presented photographs and brochures to the Council and informed Vice Mayor Zimmerman that this will be their first project underway. They have two other pieces of property under consideration. There was discussion. Mayor Cassandra asked if this was Type VI, wood construction, and if they knew about the sprinkler requirement. Mr. Nikotra did and said it was not uncommon for their develop- ments in Atlanta, Georgia. The buildings will be brown and beige. With regard to the sprinkler system, Vice Mayor Zimmerman asked whether they were aware of the Fire Marshall's ruling on projects of this type that have rentals of six months or under. Mr. Mullen answered affirmatively and said they had met with the Fire Marshall. Mr. Mullen confirmed Mayor Cassandra's statement that they have a 40 foot setback from Congress Avenue, and it will be landscaped. Councilman Ferrell moved to approve items D, 1 and D, 3 of the "CONSENT AGENDA". Councilwoman Zibelli seconded the motion, and the motion carried 5-0. PUBLIC HEARING Consider request submitted by Len Kirschke, agent for Leonard Briscoe, to annex a .66 acre tract of land which is located on the west side of Federal Highway, approxi- mately 1,125 feet north of Gulfstream Boulevard (Boynton Center Plaza) Mr. Annunziato said this request was a combined request for ainnexation, amendment to the future Land Use Element of the Comprehensive Plan, and rezoning. It is the first request they were able to entertain under the Glitch Bill, which revised the growth management legislation, and does not - 20 - MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA SEPTEMBER 16, 1986 require a review by the State of the Land Use Element Amend- ment for small parcels of land. The Planning and Zoning Board recommended approval of the request, subject to staff comments. There was discussion about the City line. Mr. Annunziato said this was the pattern of annexation which occurred over the last 20 years, and he explained. Mayor Cassandra asked if anyone wished to speak in favor or against the request. There was no response. THE PUBLIC HEARING WAS CLOSED. Councilman Hester moved to approve the request, subject to staff comments. Councilman Ferrell seconded the motion, and the motion carried 5-0. Be Consider request submitted by Gary Smith, agent for Heyman Properties, for Conditional Use approval for McDonald's restaurant to expand the existing drive-thru facility on Federal Highway at SE 18th Avenue, on the east side Mr. Annunziato told the Council that McDonald's, as it now exists, is a legal, non-conforming use owing to the fact that the Conditional Use was never received as the City Ordinances changed through the years. If approved, the request would grant them conditional use approval for the existing window. The P&Z Board unanimously recommended that the request be approved, subject to staff comments. Mayor Cassandra asked if the two windows were beside each other or adjacent to each other. Mr. Annunziato showed the windows would be located on the north side of the building. City Manager Cheney interjected that the second car could not get by until the first car goes out, and he explained. There was discussion. Mr. Annunziato informed Mayor Cassandra that the parking requirements have not changed. McDonald's have enough to meet the City's Code requirements plus. There were comments. Mayor Cassandra said anyone wishing to speak in favor or against the request could do so now. There was no response. THE PUBLIC HEARING WAS CLOSED. Motion carried 5-0. - 21- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA SEPTEMBER 16, 1986 Consider request submitted by Michael Puder, agent for Southeast Development Enterprises, Inc., Lennar Homes, Inc., Florida Properties of Boynton, Inc., and HMF Investment, Inc., for abandonment of a portion of a 10' utility easement (4' reduction) in Plats No. 5 and 6 at Boynton Lakes in order to allow for the addition of patios/screened enclosures at Waterview at Boynton Lakes. This development is located on the east side of Congress Avenue, south of Hypoluxo Road Mr. Annunziato informed the Council that the applicant has again requested that this item be POSTPONED. In this instance, it will be until October 21, 1986 at 8:00 P. M. for the City Council's Public Hearing. Councilman Ferrell moved to POSTPONE the request until the October 21st meeting of the Council. Councilman Hester seconded the motion, and the motion carried 5-0. VII. DEVELOPMENT PLANS Consider request submitted by Pedro M. Diaz, property owner, to annex a 1.18 acre tract of land located on the north side of West Boynton Beach Boulevard, approximately 300 feet east of Knuth Dairy Road (adjacent to the Singer tract). The property is contiguous to the corporate limits along its entire southern and western property boundaries (approximately 478 feet or 50% of the entire property boundary). To be referred to Planning and Zoning Board Mr. Annunziato said it was recommended that this item be forwarded to the P&Z Board for public hearing. It is a request for annexation. The property is just north of Banyan Creek, adjacent to the recently annexed Greentree Plaza II on the west. Vice Mayor Zimmerman asked if the request was also for retail. Mr. Annunziato answered affirmatively. He informed Mayor Cassandra that people were concerned about gasoline sales in this area, That was the Singer property, and this is just west of it. Mr. Annunziato elaborated and said the request is for C-3 zoning. The issues of zoning can be debated through the public hearing process. City Manager Cheney advised the Council that the recommendation of the P&Z Board will come back to them. - 22- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA SEPTEMBER 16, 1986 Vice Mayor Zimmerman moved to send the request to the Planning and Zoning Board, seconded by Councilwoman Zibelli. Motion carried 5-0. - Consider request submitted by David Flinchum, agent for the Babcock Corporation for a Master Plan Modification - Meadows 300 Mr. Annunziato pointed out that this request was unusual because it was a request to reduce the number of units in a single family tract by seven in order to provide on site recreation. Because it is in the Planned Unit Development (PUD), it involved the substantial deviation question raised by PUD regulations. It was recommended that the Council find it not to be a substantial deviation and forward it to the P&Z Board for final action. Mr. Annunziato said this is the last undeveloped tract along the south side of Meadows Boulevard. The streets are in, but no houses have been built. Councilman Ferrell moved to find no substantial change and to forward the request to the Planning and Zoning Board. Councilwoman Zibelli seconded the motion, and the motion Carried 5-0. VIII. Ordinances - 1st Reading Proposed Ordinance No. 86-35 Re: Amending Solicitation Procedures City Manager Cheney advised they should let Ms. Stevens comment first because she received a copy of the Ordinance. In the Ordinance, he tried to eliminate the need for the identification card, if the organization can provide an adequate substitute. Rosemary Stevens, 2921 Giuliano Avenue, Lake Worth, repre- senting the Leukemia Society, said the elimination of the City badges and allowing the organizations to use their own takes them halfway. The other half is the list itself, which is as time consuming as the badges. Ms. Stevens said - 23- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA SEPTEMBER 16, 1986 they provide the list. With 5,000 volunteers, in a year's campaign, they may have in 45 cities as many as 4, 5, or 6 phone calls in connection with who is a valid volunteer. It is their list, and they have a copy of it. Ms. Stevens suggested that the City let them keep the list and that someone from the City call them. A 2 or 3 minute phone call would resolve that one question a year, as opposed to them spending time preparing a list that nobody is going to be using. City Manager Cheney said Ms. Stevens was referring to a part of the Ordinance he did not amend. Ms. Stevens emphasized that the instance is so infrequent. In the 12-1/2 years she has been there, in the 45 cities, they may have had not more than 6 phone calls. City Manager Cheney pointed out that the City has lots of different kinds of organizations. They know responsible organizations like this keep lists and keep them organized, but he was not as equally confident a lot of other organiza- tions keep it that well organized. City Manager Cheney explained. Ms. Stevens asked if it would be acceptable to have the requirement that organizations keep a duplicate list on hand for quick reference if someone asks questions. .As City Manager Cheney indicated, City Attorney Vance replied that it was not Ms. Stevens' organization the City was concerned about. If they eliminate the list, they might as well repeal the Ordinance. City Manager Cheney said what Ms. Stevens does not want to do is separate out from her list the people that live in Boynton Beach or the people she gave kits to. Ms. Stevens advised that it was the matter of time required to put together the list. She informed City Manager Cheney it is not exactly a list but various names filed alphabetically among 5,000 cards. Mr. Hunt stated that he takes an average of at least 15 to 20 calls a year, and perhaps more, about all organizations, inquiring about people collecting. Sometimes they will be referred from the Police Department. Other times, they will come direct to the City Manager's office. Mr. Hunt added that they get quite a few calls asking them to confirm that the collectors at their doors are who they say they are. - 24- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA SEPTEMBER 16, 1986 City Manager Cheney advised that this was first reading, and there will be a public hearing in two weeks. Ms. Stevens guessed if there was an opportunity to have anything added, it would have needed to be done before this meeting. Mayor Cassandra asked if something could be changed in the second reading. City Attorney Vance answered, "As long as it is not of a substantial nature." If one eliminated the filing of the list, it would be of a substantial nature, and he thought they would have to go back and start all over again. Ms. Stevens suggested they work with it as it is now. At a later time, maybe they can think of a way that will be acceptable to the City in connection with a list. Council- woman Zibelli commented that she would hate to see it watered down to where it would be ineffectual. City Attorney Vance read proposed Ordinance No. 86-35 on first reading, by title only: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA AMENDING ARTICLE III, CHAPTER 17, SECTIONS 42 & 44 - CHARITABLE SOLICITATIONS" Mayor Cassandra noticed he broke the rule tonight because there is no public hearing on first reading. City Manager Cheney responded that there had not been a meeting of the Recreation and Parks Board since they talked about it. Their regular meeting is Monday, September 22nd. Mayor Cassandra requested the Council to leave this matter on the table so he could tell the Recreation and Parks Board his concerns. City Manager Cheney said the City was in a pretty good bond market now, but he guessed it would not matter, and he will not be here at the next Council meeting. It was acceptable to leave the matter on the table. e Proposed Resolution~No. 86-SSS Re: ~dopting Pay Plan for Fiscal Year 1986/87 City Manager Cheney explained that the Council had one Resolution and the pay plan with all of the attachments to it. What he had put before the Council was the issue of voting to ratify the terms of each Union contract, if they so desired. Following up the Executive Session last vening! City Manager Cheney met with both Unions today and onfirmed the items he had discussed with the Council last  ight. The only question they had, other than wages, was he issue of Police standing by until Court time. City Manager Cheney discussed with them his concerns about the Fair Labor Standards Act. The City will confer with its Attorneys, and the Union will talk with other Attorneys to see if they can work that out. City Manager Cheney said it is not a large number of hours but is more of an incon- enience when it happens. If it was legal, depending on the hole contract, he recommended that they do it. City Manager Cheney guessed the two issues were whether to rant them a 4% or 4½% increase in their wages. He offered hem 4%. They said that was not acceptable and were still at the 6% or 7% level. City Manager Cheney indicated that e would suggest that the Council consider 4½%. If they ould get 4½%, the City would give them less on the uniform increase in plain clothes cleaning of over $100 a year. City Manager Cheney had suggested that he hoped he would be able to get the Council to ratify the agreement tonight, and they could ratify it if they wanted to in the future. If 'the Council ratifies it at 4½% and they accept it before October 1, City Manager Cheney said, "So be it." If they do not, they may be back down to 4% again and see where they will go in October, November, December, or whenever they get - 26- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA SEPTEMBER 16, 1986 together. City Manager Cheney indicated he would call them tomorrow and see what their decision is. City Manager Cheney discussed the same thing with the Fire Union. They indicated they had met and specifically dis- cussed it with their membership, but they would not agree to 4%. Everything else the City had with the Fire Union was agreed on. City Manager Cheney suggested to them that he would raise the issue that the Council go to 4½%. They urged that he raise the issue of going to 6½%, and City Manager Cheney told them very bluntly he could not support that. The City appreciates their services, is in good shape, but there is no way they can do anything about that. City Manager Cheney suggested that the Council confirm either 4% or 4½%, tell them that is it, and hope they will find that is the reasonable and comfortable thing to do this year. City Manager Cheney said the Council discussed the issue of keeping the millage down, and he reminded them there has been a lot of growth, but they are getting their share because they are well paid in comparison to what is around the area. If the Council will go with the 4½%, City Manager Cheney thought they might settle it. If they do not, they will start back and talk again at 4%. This year, City Manager Cheney said the City is in a position here it is ratifying first. In the past, the Unions rati- ied first. The City was first because of the way the meet- ings and Council meetings worked out. he subject of the Resolution is the pay plan in general. ity Manager Cheney said the City is recommending differently in the pay plan. Councilman Ferrell had reminded them of a position, which was the product of how the City handled the Unions last year, where they added improvements for Police Qfficers and Fire Fighters. In doing that, the City has ~otten the Police Officers and Fire Fighters close to the Management post, especially~in the Police. City Manager Cheney said the City's pay plan currently has 5% between grades, except for Grades 28 and 30. Grade 29 was skipped, where they had 6% between what would have been two gra~es. That has always been a problem. It is a cross ~etween management and non-management. In the Resolution ~efore the Council, it was proposed to take Grades 30 and above and add an additional'2% to get them further above the non-management people. They probably will propose another 2% next year, and then they will create 10% between grades 28 and 30 and recreate Grade 29. - 27- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA SEPTEMBER .16, 1986 City Manager Cheney explained that they got rid of Grade 29 many years ago. At that time, they gave an added increase to people below Grade 30 and brought those two grades together, but they did not give above Grade 30. That has been a part of the problem of the pay plan ever since. This will resolve that problem over two years. City Manager Cheney recommended that 2% be added for all management that are not part of the Union. It happens that the Fire Fighters management is part of the Union and, therefore, this would not apply to them because it is being negotiated. They are the only management not included in the proposal. City Manager Cheney said the Council was faced with the issue of the 2% and the issue of 4% or 4½%. City Manager Cheney explained the Resolution to Mayor Cassandra and said every position was a position the Council reviewed and approved in the adoption of the budget. He thought the Council had to decide which figure they wanted to approve for the Unions. Mayor Cassandra thought 4½% might be appropriate at this time, and he expounded. Vice Mayor Zimmerman remarked that there would be nothing more to negotiate then. Mayor Cassandra and Vice Mayor Zimmerman agreed that would be it. City Manager Cheney stated he would like to know that would be it, but they could not do anything until October anyway because there would not be any more meetings, and he would be away for awhile. Councilman Hester said if the Fire and Police do not agree, they will have to start over. Mayor Cassandra added that then they will start at 4%. Motion Councilman Hester moved to ratify the Union contracts of the Firemen and Policemen for 4½% along with the other items greed to in the negotiations Councilwoman zibelli seconded he motion. Other Consider agreement between City of Boynton Beach and American Land Company~Sandpiper Cove City Manager Cheney called attention to his memo of September 16, 1986, explained it to the Council, and said the developer would pay all .of the design costs and construction costs. The City will administer it. It is consistent with the City's Ordinance. If the developer does not use up the credits in five years, he will lose them. ~ouncilman Ferrell moved to approve the agreement, seconded by Councilwoman Zibelli. Motion carried 5-0. Rainbow City Grocery lease cancellation with Southland Corporation  ity Manager Cheney believed the memorandum prepared by Mr. unt, dated September 9, was self-explanatory. Some time go, the City urged Rainbow Grocery to get out of its lease. ~ainbow insisted on renewing it. When they wanted to get out ~f it, the City insisted on them buying their way out. They qid not want to do that, so the City collects $600 a month ~or nothing. The City would like to get them out of there because the building is a mess inside. City Manager Cheney said they discussed the agreement with City Attorney Vance on the assumption that if the City went into eminent domain and bought out a leasehold interest, they would know how to arrive at it. The proposal of settlement was suggested by City Attorney Vance, and Rainbow Grocery finally bought it. Councilman ~Ferrell moved to accept the cancellation of the Rainbow City Grocery lease, based upon receipt of $14,000. Councilman Hester seconded the motion, and the motion carried 5-0. IX. OLD BUSINESS R~consideration of Review by the Technical Review Board and P~anning and Zoning Board - Requested by Councilwoman Zibelli Tradewinds C~uncilwoman Zibelli said when this was brought up the last time, she did not quite Understand it. Vice Mayor Zimmerman seconded the motion. Councilman Ferrell was still opposed to it because irregard- less of what side of the issue they were on, it was the Council's responsibility to make a policy decision on the settlement of a lawsuit and give some direction to the Boards as to whether they want to settle or not, not to have the Boards take on the Council's part. Councilman Ferrell did not know if City Attorney Vance would want to give an opinion, but said he would question the legality of this. It would take away some authority the Council is supposed to have. It was obvious, and he was sure it was going to pass tonight, but Councilman Ferrell said he was going to pursue it on his own to see if it was legal that the Council do that. Councilman Ferrell did not have a problem with the TRB and ~&Z Board looking at it but had a problem with them trying o make a decision of whether to settle a lawsuit or not efore the Council does. That was his only question when it ame up on the Tradewinds project. The motions for settle- ~ent were to have it at first reading, and Tradewinds could eview it in between, which would have accomplished exactly the same thing, but they would have known how the Council lelt. Councilman Ferrell wanted those comments on the record because he wanted to look at it. Councilwoman Zibelli asked if Councilman Ferrell thought they should wait on this and give it to the Attorney they ~ill subsequently hire. Councilman Ferrell had no problem, }f they wanted to vote on it, but said he would pursue it himself. He just had a question that they were doing the wrong thing in haste, just to take care of Tradewinds, and he did not think it was that important. Even if they were to accept it and pass it on first reading, should another sDttlement come in, it could still go for review and reading i~ the two week period in between and accomplish the same t~ing, but it would have the Council in the role of decision mDkers and policy makers like they are supposed to be. That w~s the only thing he questioned. I t was Councilwoman Zibelli's understanding that when there re changes in plans, they should go back to the P&Z Board. - 30- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA SEPTEMBER 16, 1986 Councilman Ferrell responded that it would anyway, but the Boards would know how the Council felt. Maybe the Council would get another settlement offer and turn it down. Councilman Ferrell asked, "Why go through the trouble of having it go through the Boards if the Council is going to turn it down anyway?" In his opinion, they would be reversing the procedure. Mayor Cassandra suggested that they wait until tomorrow night, as they would be asking the three lawyers that will be interviewed to settle the litigation. Councilwoman zibel!i thought it would be a good idea. Regardless of the opinion Councilman Ferrell may have gotten from another attorney, these will be the attorneys that may be repre- senting the City, so they should value their opinion. Contrary to a vote of 3, which was what they would have tonight, Mayor Cassandra suggested that. Mrs. Ramseyer asked if they needed a motion to table. City Manager Cheney pointed out that they did not take any action on it. Vice Mayor Zimmerman thought this, in substance, was the same as they had before. He asked if City Attorney Vance saw anything different now. City Attorney Vance said he ruled the last time that if the Council desired to have input from the P&Z Board and the TRB in connection with that proposed settlement, they were entitled to receive it. Those Boards would not make a decision. They are advisory only. Mayor Cassandra recommended that the maker of the motion and the person who seconded it raise the motion at tomorrow night's meeting and see what the new Attorney or Attorneys decide on. The new Attorney or Attorneys may not want it to go back to the Boards. ouncilwoman Zibelli withdrew her motion until tomorrow ight. Mayor Cassandra said it could be added onto the agenda, based upon raising the question to the three persons interviewed and see what they say about it.  ity Attorney Vance doubted that any one who has not read the ity Code would want to rule on anything without doing some esearch. Mayor Cassandra reiterated that it should be on omorrow night's agenda. Based on City Attorney Vance's opinion, they should say the TRB and P&Z Board are only advisory Boards, and it will not be wrong for the Council to have some input. - 31 - MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA SEPTEMBER 16, 1986 If they pass the motion, City Manager Cheney asked them to think about how often they want a proposal to come before the Council. Right now, they do not have anything, and maybe they do not need to raise the question until it comes one time. If they pass the motion and it does come to the TRB and then the P&Z Board, then City Manager Cheney said they could say they have to look at it. At that time, the ity might raise the question, when that is over, as to when he Council will want to take it up again, if it comes back in three weeks or three months later. There may be some changes in the Court status in that time. City Manager Cheney said his concern would not be yet but after awhile. Councilman Ferrell asked if it was not possible that, by handling this differently than other cases of a similar nature, have.been handled, they. could create a problem in the lawsuit. City Attorney Vance answered that it was con- ceivable that it could. However, the TRB and P&Z Board are ecommending Boards. The Judge is a Judge, and City ttorney Vance could not tell how the Judge would feel. Councilwoman zibelli withdrew her motion, and Vice Mayor Zimmerman withdrew his second. NEW BUSINESS None.
