A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA, APPROVING
THE NEGOTIATED SETTLEMENTS FOR
PROPERTY ACQUISITIONS FOR THE POINCIANA
ELEMENTARY SCHOOL - SITE EXPANSION; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, on June 15, 1993, the City of Boynton Beach and
the Palm Beach County School Board entered into an Interlocal
Agreement for the Poinciana Elementary School Site; and
WHEREAS, said Agreement provided that the total cost of
property acquisition, including appraisals, surveys,
environmental studies, title research and demolition cost of
existing structures will be split equally, not to exceed
$500,000 each and requires the City of Boynton Beach to condemn
the property necessary to expand the referenced school if the
School Board is unable to acquire the subject property
voluntarily;
WHEREAS, staff has conducted negotiations with the property
owners, as set forth in the Summary Chart attached hereto as
Exhibit "A".
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CI~"f OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. The City Commission of the City of Boynton
Beach, Florida hereby approves the negotiated settlements for
properties as outlined in Exhibit "A" attached hereto and made
a part hereof.
Section 2. This Resolution shall" become effective
immediately upon passage.

requested the City top ay the full amount of outstanding taxes (which exceeds the fair market
value of the property). The City Attorney has entered into an agreement #ith the tax
certificate holder subject to court approval. HoweYer, further negotiations are required to
resolve the issue with the Tax Co[lector and his counsel.
