A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA,
AUTHORIZING AND DIRECTING THE MAYOR AND
CITY CLERK TO EXECUTE A LEASE AGREEMENT
BETWEEN THE CITY OF BOYNTON BEACH AND
GEOGRAPHICAL INFORMATION SYSTEM (GIS);
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Planning and Utility Departments have taken the lead in attempting
to modernize the City's computerized mapping and have worked for several months to
obtain the best system available as they prepare to go to the new UNIX operating system;
and
WHEREAS, upon recommendation of staff, the City Commission of the City of
Boynton Beach has determined that it is in the best interests of the citizens and residents
of the City to enter into a Lease Agreement with Geographical Information System (GIS)
to provide the necessary hardware and software.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA THAT:
Section 1. The Mayor and City Clerk are hereby authorized and directed to
execute a Lease Agreement between the City of Boynton Beach and Geographical
Information System (GIS), which agreement is attached hereto as Exhibit "A".
Section 2. This Resolution shall take effect immediately upon passage.

SUBJECT: Lease purchase agreement for Geographical Information System
(GIS) with Credential Leasing Corp. of Florida, Inc.
Please place the above - referenced item on the March 19, 1996 City
Commission agenda under Consent - Resolutions.
DESCRIPTION: Please find attached the three year (36 month) lease
purchase agreement for GIS hardware and software and the listing of
equipment the City is obtaining through prices piggy - backing from state
contract for the amount of $46,652.76. The Planning and Zoning
Department's monthly expenditure will be $1,295.91. Upon signing of the
agreement there will be an advance rental deposit of $2,591.82 applied
to first and last payments. There is also a dollar buy out at the end
of the three year term (see attached Purchase Option Agreement).
As you may know, the Planning and Zoning Department and Utilities
Departments have taken the lead in attempting to modernize the City's
computerized mapping and have worked for several months to obtain the
best system available as we prepare to go to the newer UNIX operating
system. During the last approved budget process it was decided we would
finance, over three years the purchase of this equipment. Credential
Leasing Corp. of Florida, Inc. was selected from a field of three (3)
eligible applicants from the bid process. The applicants are through
the "Piggy- Back" of State of Florida, Department of Management Services
Sun Microsystems contract #250- 040 -96 -1 which is currently being used by
City's Utilities Department for their program. The supplier of the
equipment is Engineering Software Service.
RECOMMENDATION: The Planning and Zoning Department has $16,700
allocated to GIS in this year's budget, but will only pay out $9,371.00
this year (assuming the agreement is approved) due to execution midway
through the budget year. Every budget year through the three (3) year
term of the agreement additional funding will be needed to maintain
title to the GIS equipment. However, in the event future funding is not
approved, the agreement contains the necessary termination clause which
would allow the company to take back the equipment. This contract is
already being used satisfactorily within the City. Staff has completed
negotiating the terms of this agreement and therefore recommends that
said agreement be executed by the City.

Agreement number _D4591 , does hereby grant to the
undersigned Lessee, the option to purchase the equipment being leased, as
a whole and not in part, and on an as is where is basis, at the end of the
original or any renewal term of said Lease, provided that the Lessee is not
then in default under said lease or any other agreement with Lessor. This
option may be exercised by Lessee by giving written notice to Lessor
which shall be accompanied by the purchase option price which shall be
