AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA AMENDING
CHAPTER 9. ARTICLE IV, SECTION 9-51 OF THE CITY
OF BOYNTON BEACH CODE OF ORDINANCES, BY
CREATING A NEW SUBSECTION (e) TO PROVIDE THAT
REASONABLE AND PROPER FEES ARE ESTABLISHED
FOR FIRE RESCUE SERVICES IN THE ABSENCE OF A
MUTUAL 'AID OR INTERLOCAL AGREEMENT;
PROVIDING FOR CONFLICTS, SEVERABILITY,
CODIFICATION AND AN EFFECTIVE DATE.
WHEREAS, the City of Boynton Beach Fire Rescue Department is the division of
nunicipal government that enforces the fire codes in the interests of public safety; and
WHEREAS, fire protection and prevention are essential to the well-being, prosperity
and safety of the community and its residents; and
WHEREAS, the City's fire rescue department has reviewed the existing provisions
~f Chapter 9 and has determined that it is in the best interests of the citizens and residents of
the community to recommend that Section 9-51 be amended to provide that reasonable and
proper fees are established for Fire Rescue Services in the absence of a Mutual Aid or Interlocal Agreement;
and
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. Section 9-51 is hereby amended by creating a new subsection (e) to
read as follows:
e. In the event that Bowtton Beach Fire Rescue Department resources are requested
by another municipality which has an agreement with a third-party agency for mutual aid
services, and in the absence of an Interl°cal Agreement or Mutual Aid Agreement with the,
City of Bovnton Beach, a fee in the amount of $2,000 per occurrence for up to one (1) hour
service, and $500.00 per hour for each additional hour, shall be charged to the municipali _ty
requesting and receiving such services. Payment must be made to the City, in full, within
thirty_ (30) days of invoice.
Section 3. Each and every other provision of Chapter 9 of the City of Boynton
Beach Code of Ordinances not herein specifically amended shall remain in full force and
as previously enacted.
Section 4. All ordinances or parts of ordinances in conflict herewith be and the
same are hereby repealed.
Section 5. Should any section or provision of this ordinance or portion hereof,
paragraph, sentence or word be declared by a court of competent jurisdiction to be
invalid, such decision shall not affect the remainder of this ordinance.
Section 6, Authority is hereby granted to codify said ordinance.
Section 7. This ordinance shall become effective immediately upon passage.
