I. Call to Order
Chair Costantino called the meeting to order at 6:30 p.m.
II. Swearing in of Witnesses and Introduction
Attorney Tolces set forth an explanation of the hearing procedure and administered the
oath to all who would be testifying.
Mike Melillo, Senior Code Officer, requested Case #09-2124 be tabled for 30 days
until November 18, 2009.
Motion
Mr. Karageorge moved that Case #09-2124 be tabled until the Code Compliance Board
meeting to be held on November 18, 2009. Mr. Foot seconded the motion that
unanimously passed.
Officer Melillo reported the following:
The following cases were removed: #09-2547, #09-2623, #09-2786, #09-2846 and
#09-2653.
The following cases came into compliance: #09-2653 and #09-2911.
Motion

Chair Costantino requested Case #08-1695 be heard first as children were present.
There was no objection by the Board.

Case #08-1695 Estate of Annewoods Love 126 SW 8 Ave.
Scott Blasie, Code Compliance Administrator, reported the case had originally been
cited on June 13, 2008 for an unsafe, unmaintained swimming pool. The case had
been presented to the Code Compliance Board on September 17, 2008 and Rose Love
had appeared. The Board had established a compliance date of September 27, 2008,
or a fine of $500 per day. Compliance had been documented on September 28, 2009,
for 365 days of non-compliance. Staff's records reflected a tax deed sale and a transfer
of ownership on September 2, 2009. Mr. Blasie provided photographs for the Board's
review.

Scott Yost, 126 SW 8 Avenue, noted he had purchased the new property on
September 2, 2009.
Mr. Blasie advised that prior to the transfer on September 2, 2009, the property had
been transferred on January 28, 2009 with the City's lien attached. Thus, it appeared
two transfers had occurred; the first, between private parties and the second, between
the Tax Collector's Office and Mr. Yost.
Mr. Yost advised he had accumulated receipts in the amount of $3,600 for costs
expended to bring the property into compliance. It was Mr. Blasie's belief that the
entire yard had been sodded. In addition, Mr. Yost had satisfied all delinquent water
bills and taxes. It was noted Mr. Yost had remained at the premises on a part-time
basis while the property was brought into compliance. It was Mr. Yost's intent to
further renovate the property and move into the premises following the next school
year.
Mr. Foot suggested a nominal fine in the range of $5,000 plus administrative costs.
Motion
Based on testimony and evidence presented in Case #08-1695, and having been
advised that the Respondent has complied with all lien reduction procedures set forth in
Section 2-84 through 2-89 of the City of Boynton Beach Code of Ordinances, Mr. Foot
moved that this Board reduce the fines instituted in Case #08-1695, by virtue of this
Board's Order of September 17, 2008, to an amount of $5,634.12, including
administrative costs. Mr. Karageorge seconded the motion that unanimously passed.

Mr. Blasie briefed the applicants on the lien reduction procedure. The City's ordinances
required the Board's decision on the lien reductions be reviewed by the City
Commission. As such, completed minutes of the meeting would be forwarded to each
City Commissioner for review. The Commissioners and the applicant had seven days to
review the Board's Order and request an additional review at a City Commission
meeting. If no such request was made within seven days, the Board's decision would
be final.
Chair Costantino requested Case #09-2040 be heard next as an attorney was present.
There was no objection by the Board.
Case #09-2040 Thomas A. Agius 3350 Ocean Pkwy.
Courtney Cain, Code Officer, presented the case and reviewed the details of the
violation. The Notice of Violation date was June 26, 2009. The case had been
presented to the Board on August 19, 2009, and no one had appeared. The Board had
established a compliance date of August 29, 2009, or a fine of $500 per day.
Compliance had been documented on September 30, 2009, as the yard had been
mowed by a vendor. It was noted the Respondent had been a repeat offender which
was reflected on the agenda at the time the case had originally been brought before
the Board.
Natasha Prather, of the firm of Shapiro and Fishman, 2424 N. Federal Highway, Suite
360, Boca Raton, appeared on behalf of HSBC Bank. The property had been in
foreclosure. She believed the property came into compliance as the City had taken
measures to have the lawn mowed. The property was currently vacant and would be
taken care of by the lender. Mr. Blasie advised the City had recently adopted Ordinance
#09-040 which required mortgage holders of vacant properties to register the
properties and perform the required routine maintenance. Mr. Blasie agreed to mail a
copy of the ordinance to Ms. Prather.
It was questioned whether the property had been given to the bank through
foreclosure. Ms. Prather indicated the foreclosure action had been dismissed, and the
Bank had taken possession of the property as a result of a charge-off.
It was noted the fine was in the amount of $15,500 plus administrative costs of
$634.12. Attorney Tolces noted the fine had stopped running as the property came
into compliance. The issue before the Board was whether to certify a fine or dismiss
the case.

Motion
Based on testimony and evidence presented in Case #09-2040, Mr. Yerzy moved that
this Board find that the Respondent, Thomas A. Agius, was in violation of the City of
Boynton Beach Code sections as cited, subsequent to the date of compliance specified
in this Board's Order of August 19, 2009, and in consideration of the gravity of the
violations, the actions taken by the Respondent to remedy the violations, and previous
violations of the Respondent, that this Board impose and certify a fine in the amount of
$2,184.12 including administrative costs. Ms. Carroll seconded the motion that
unanimously passed.
Case #09-2836 John Floyd Enterprises Inc.

Repair roof and water damage.
Vestiguerne Pierre, Senior Code Officer, presented the case and reviewed the details
of the violations. Service had been effectuated by posting a notice at the property.
John Floyd, 194 Lasco Harvey Rd., Americus, Georgia, pled not guilty.
Officer Pierre had received a complaint on the property from the tenant regarding a
leaking roof which caused water damage to the interior. Office Pierre provided
photographs for the Board's review.
Mr. Floyd advised John Floyd Enterprises Inc. no longer owned the property which had
been sold in 2005 or 2006, and he had received proceeds of the sale. He did not know
the identity of the new owner.
Officer Pierre believed several liens against the property had existed since 1990. It
appeared Mr. Floyd still owned the property as he had been observed entering and
exiting the premises. Mr. Floyd contended he had not been to the property.
The question was raised whether the Board could determine whether or not the
property had been sold. Mr. Floyd advised he did not have the recorded deed with him
but could obtain a copy. Mr. Tolces explained if Mr. Floyd had sold the property and
the purchaser had not recorded the deed, it would be necessary for Mr. Floyd to contact
the purchaser. The Board relied upon the information maintained in the Offices of the
Property Appraiser and Tax Collector. Attorney Tolces noted it was not necessary to
record a deed in Florida in order to consummate a sale. As such, the property could be
sold to two separate parties if the first party had not recorded the deed. In this

instance, a printout from the Property Appraiser's Office reflected the property located

at 2201 SE 3 Street was owned by John Floyd Enterprises, Inc. pursuant to a warranty
deed dated January 2002. Additionally, a printout from the Tax Collector's Office
reflected John Floyd Enterprises, Inc. as the owner of the property, with Wells Fargo
holding a mortgage. As Mr. Floyd believed a title search had been conducted at the
closing, Attorney Tolces suggested Mr. Floyd contact the attorney who handled the
closing, as he or she may not have recorded the deed.
The Board agreed to proceed with the case. It was stressed the tenant and her
children had been residing in a structure containing mold and as such, a $250 per-day
fine was suggested.
Motion
Based on the testimony and evidence presented in Case #09-2836, Mr. Yerzy moved
that this Board find that John Floyd Enterprises Inc. is in violation of the City of Boynton
Beach Code sections cited and moved to Order that the Respondent correct the
violations on or before November 20, 2009. The Board has considered the gravity of
the violations, the actions taken by the Respondent and any previous violations by the
Respondent and hereby orders that if the Respondent does not comply with this Order,
a fine in the amount of $250 per day for each day the violations continue past
November 20, 2009 plus administrative costs shall be imposed. The Respondent is
further ordered to contact the City of Boynton Beach Code Compliance Division in order
to arrange for re-inspection of the property to verify compliance with this Order. Mr.
Foot seconded the motion that unanimously passed.
Chair Costantino objected to the $250 fine. The Board had previously imposed fines of
$500 for vacant, empty pools. In this instance, a family with children had been residing
in a filthy, damp structure containing mold. She requested the maximum amount be
imposed in the hopes the violations would be remedied as soon as possible.
Mr. Yerzy agreed to amend his motion.
Amended Motion
Based on the testimony and evidence presented in Case #09-2836, Mr. Yerzy moved
that this Board find that John Floyd Enterprises Inc. is in violation of the City of Boynton
Beach Code sections cited and moved to Order that the Respondent correct the
violations on or before November 20, 2009. The Board has considered the gravity of
the violations, the actions taken by the Respondent and any previous violations by the
Respondent and hereby orders that if the Respondent does not comply with this Order,
a fine in the amount of $1,000 per day for each day the violations continue past

November 20, 2009 plus administrative costs shall be imposed. The Respondent is
further ordered to contact the City of Boynton Beach Code Compliance Division in order
to arrange for re-inspection of the property to verify compliance with this Order. Ms.
Ms. Carroll seconded the motion. (Mr. Foot noted he had withdrawn his second to the
original motion).
On roll call vote, the motion passed 4-3 (Messrs. Foot, LaTour and LaRock dissenting).
Case #09-2396 Bayfront of Boynton Beach 450 Bayfront Dr.
John Herring, Code Officer, presented the case and reviewed the details of the
violations. Officer Herring noted the Respondent had been faced with monetary issues.
However, most of the violations had been cured. As such, he requested the case be
tabled to November. It was anticipated the Respondent would be scheduling a fire
inspection within two weeks.
Motion
Mr. Karageorge moved that Case #09-2396 be tabled until the Code Compliance Board
meeting to be held on November 18, 2009. Mr. LaTour seconded the motion that
unanimously passed.
Case #09-1937 Eileen Laughton 1356 Piazza Pitti
Skip Lewis, Senior Code Officer, presented the case and advised a Business Tax
Receipt was required. The Notice of Violation was dated June 22, 2009. The case had
been presented to the Board on August 19, 2009, and Eileen Laughton had appeared.
The Board had established a compliance date of August 29, 2009, or a fine of $250 per
day. The violation still existed, with 52 days of non-compliance. While Ms. Laughton
had applied for her Business Tax Receipt, she was not in compliance as the premises
had not been inspected.
Eileen Laughton, 1356 Piazza Pitti, advised the tenants still resided at the premises.
In order for the premises to pass inspection, it was necessary for the air-conditioner to
be in proper working order. Ms. Laughton contended the tenants had been destroying
the air-conditioner by maliciously removing the Freon. She had the system repaired
and Freon added on numerous occasions at an approximate cost of $1,000.
Representatives from a reputable company had checked the system and found no Freon
leaks. Ms. Laughton believed it was the intent of the tenants to remain at the premises
rent-free as their lease had expired and they had not paid rent since August. The
tenants took measures to have a restraining order issued against Ms. Laughton. As

such, she could not repair the air-conditioner until the tenants had vacated the
premises.
Upon his initial inspection, Officer Lewis had discovered the air-conditioner had not
operated properly. The tenants contended Ms. Laughton was unwilling to repair the
leak in the system.
Chair Costantino suggested a lien be certified against the property. After the tenants
had vacated the premises and the property passed final inspection, Ms. Laughton could
appear before the Board for either a lien reduction or modification.
Motion
Based on the testimony and evidence presented in Case #09-1937, Mr. LaTour moved
that this Board find that the Respondent has not complied with this Board's Order dated
August 19, 2009, and having considered the gravity of the violations, the actions taken
by the Respondents, that this Board impose and certify a fine in the amount of $250
per day plus administrative costs which shall continue to accrue until the Respondent
comes into compliance or until a judgment is entered based upon this certification of
fine. Mr. LaRock seconded the motion that unanimously passed.

Case #09-2675 Jacques & Laurette Momperousse 203 SW 9 Ave.
Pete Roy, Chief Code and Rehabilitation Officer, presented the case and reviewed the
details of the violations. The case was originally cited on August 12, 2009, requiring
the removal of unregistered vehicles and vehicle parts, outside storage and dead palm
trees. The case had been presented to the Board on September 16, 2009, and no one
had appeared. The Board had established a compliance date of September 26, 2009,
or a fine of $100 per day. Staff documented compliance on October 13, 2009. Officer
Roy recommended no fine or administrative costs be imposed. A new owner had taken
over the property after the case had commenced. The owner contacted staff and took
immediate steps to cure the violations.
Laurette Momperousse and her daughter noted they were present. The daughter
acknowledged her parents were no longer the owners of the property.
Motion
Based on testimony and evidence presented in Case #09-2675, Mr. Foot moved that
this Board find that the Respondents, Jacques and Laurette Momperousse, were in
violation of the City of Boynton Beach Code sections as cited subsequent to the date of
compliance specified in the Board's Order of September 16, 2009, and in consideration

of the gravity of the violation and the actions taken by the Respondents to remedy the
violations and the previous violations of the Respondents, that this Board impose and
certify “No Fine.” Mr. Karageorge seconded the motion that unanimously passed.
Case #08-1173 David & Fernande Pierre-Louis 22 Heather Dove Dr.
Mr. Blasie presented the case and reviewed the details of the violations. The
Respondents were originally cited on April 14, 2008 for violations to the City's Land
Development Regulations. In order to comply, the Respondents were required to repair
a broken window and install four-inch numbers on the house. The case had been
presented to the Board on June 18, 2008, and no one had appeared. The Board had
established a compliance date of June 28, 2008, or a fine of $100 per day. Staff had
documented compliance on August 25, 2009, for 422 days of non-compliance plus
$730.15 cents in administrative costs. The City's lien had been recorded on September
16, 2008. A deed dated January 28, 2009 conveyed ownership of the property to
MARFL LLC, a Delaware corporation. On September 30, 2009 MARFL LLC conveyed
ownership of the property to Mathew Phillips. The new owners were required to pay a
delinquent water bill and 2008 taxes of $3,571.78, clean up overgrowth and secure the
back door. Mr. Blasie provided photographs for the Board's review.
Mitch Bocook, 2805 Veronia Drive #201, Palm Beach Gardens, represented United
Servicing, the company that serviced the loans for MARFL LLC and Mr. and Mrs. Phillips.
Mr. Bocook provided a photocopy of a document evidencing his authority to speak on
behalf of the owners. A foreclosure of the property occurred in April. Mr. and Mrs.
Phillips had suffered the loss of approximately $110,000 in the foreclosure process in
addition to the costs of remedying the violations of the previous owners. Once Mr. and
Mrs. Phillips were made aware of the liens, they acted swiftly to remedy the violations.
As such, they were hoping the Board would consider their financial loss and speedy
actions in arriving at the lien reduction amount.
Motion
Based on testimony and evidence presented in Case #08-1173, and having been
advised that the Respondents have complied with all lien reduction procedures set forth
in Section 2-84 through 2-89 of the City of Boynton Beach Code of Ordinances, Mr. Foot
moved that this Board reduce the fines instituted in Case #08-1173, by virtue of this
Board's Order of June 18, 2008, to an amount of $2,730.15, including administrative
costs. Mr. LaRock seconded the motion that unanimously passed.

Case #08-2085 Jennifer & Patrick Fike 7026 Chesapeake Cir.
Mr. Blasie presented the case and reviewed the details of the violations. The
Respondents were originally cited on July 18, 2008 and were required to mow, weed
and trim the property in order to come into compliance. The case had been presented
to the Board on August 20, 2008, and no one had appeared. The Board had
established a compliance date of August 30, 2009, or a fine of $50 per day. Staff had
documented compliance on September 16, 2009, with 381 days of non-compliance.
Water bills and taxes were past-due.
Melanie Huegel, with Marina Properties, advised she was the listing agent for GMAC
Mortgage. The property had been taken through foreclosure on June 15, 2009 and the
individuals were evicted. The property had been assigned to her office on September
11, 2009. She indicated the City had not been named as a defendant in the foreclosure
proceeding.
The question arose as to whether the lien would survive the foreclosure. Attorney
Tolces explained the lien would survive in this case as the City had not been named as
a defendant. Ms. Huegel remarked the lien had not been recorded at the time the lis
pendens was filed. Not having viewed the court's file, Attorney Tolces could not
provide an opinion. Generally, however, if a lis pendens were filed, all entities filing
subsequent liens would be put on notice that a lis pendens had been filed. In order to
be certain, however, the file would have to be reopened.
Ms. Huegel indicated she had in her possession the lien filed by the City which went on
record December 1, 2008. The Certificate of Title and Sale of the property had
occurred five months thereafter. It was her belief the lis pendens would have been
filed a year in advance for the judgment to be entered against the property.
Attorney Tolces felt in view of the testimony provided, it appeared the City's lien had
been recorded after the filing of the lis pendens, which could affect the City's ability to
enforce its lien against the acquirer of the property. If it were the Board's wish,
Attorney Tolces could review the matter with City staff to determine whether the lien
was still in force. Chair Costantino recommended the Board take the necessary action
at this time.
Motion

advised that the Respondents have complied with all lien reduction procedures set forth

Officer Cain presented the case and reviewed the details of the violations. The initial
inspection was completed on August 31, 2009. Service was effectuated by posting a
notice at the property and City Hall. The Respondent was given 10 days to comply.
Safety issues existed. Staff recommended 30 days for compliance. Officer Cain
provided "before and after" photographs for the Board's review.
Michael Lake, 7740 W. Lake Drive, pled no contest. He had purchased the property
in 2006 through a foreclosure and had been working with the tenant (the previous
owner of the property) to remove the items stored in violation of the City's Code. Mr.
Lake was not aware he was required to purchase a Business Tax Receipt but made
immediate application upon learning of the requirement. Significant progress had been
made in clearing items that had accumulated over 10 years. Mr. Lake would request an
inspection as soon possible.
Officer Cain felt a 30-day timeframe for compliance was reasonable as most of the
items had been cleared and the front of the house was immaculate. It was also noted
a six-foot fence surrounded the property.
Motion
Based on the testimony and evidence presented in Case #09-2829, Mr. Karageorge
moved that this Board find that Michael White is in violation of the City of Boynton
Beach Code sections cited and moved to Order that the Respondent correct the

violations on or before November 20, 2009. The Board has considered the gravity of
the violations, the actions taken by the Respondent and any previous violations by the
Respondent and hereby orders that if the Respondent does not comply with this Order,
a fine in the amount of $250 per day for each day the violations continue past
November 20, 2009 plus administrative costs shall be imposed. The Respondent is
further ordered to contact the City of Boynton Beach Code Compliance Division in order
to arrange for re-inspection of the property to verify compliance with this Order. Mr.
LaRock seconded the motion.
Mr. Foot suggested a $500 fine be imposed as safety issues existed. Chair Costantino
and Mr. Karageorge believed $250 was appropriate based upon the progress and
improvements made to date. Additionally, the Respondent was not a repeat offender.
If Mr. Lake were to come into compliance within the 30-day period, the fine would not
be imposed.
The motion passed unanimously.
Case #09-2955 Boynton Beach Property Holding
D & M Photo Studio
Location: 410 E. Boynton Beach Blvd. #C
Violation: CO CH9 SEC. 9-22(C)
Fire inspection annual fees.
Officer Roy presented the case and reviewed the details of the violation. The initial
inspection was completed on September 11, 2009. Service was effectuated by certified
mail. The property had been inspected on three occasions, at $150 per inspection, with
the initial inspection having failed. The owner was also responsible for the same
violation. To date, the fees have not been paid. The City recommended 10 days for
compliance.
Medache Depilius, 410 E. Boynton Beach Blvd., of D & M Photo Studio, pled not
guilty. He had received an invoice in the amount of $150 and upon attempting to pay
the bill, was advised he owed a total of $500. The building consisted of Units "A," "B"
and "C." He had previously resided in Unit "A" and relocated to Unit "C" in June 2008.
Chair Costantino noted four violations existed in the sum of $350, together with an
additional $150 for the October 16, 2009 inspection, for a total of $500.
Attorney Tolces noted the owner could be cited for inspections to the building.
However, it should be ensured Mr. Depilius was cited only for the inspections to his
unit.

Diane Springer, Code Compliance Coordinator, noted the initial $50 charge covered
the annual fire inspection fee. A charge of $150 was imposed on each occasion the Fire
Department returned to the premises for an inspection. In this instance, several
inspections had failed. All of the invoices totaling $500 were for Unit "C" and were
under the name of the Respondent.
Officer Roy explained it would be necessary to issue Board Orders for both Boynton
Beach Property Holdings and D & M Photo Studio.
Motion
Based on the testimony and evidence presented in Case #09-2955, Mr. Foot moved
that this board find that Boynton Beach Property Holdings is in violation of City of
Boynton Beach Code Section as cited, and move to order that the Respondent correct
the violation on or before October 31, 2009. The Board has considered the gravity of
the violation, the actions taken by the Respondent, and any previous violation by
Respondent, and hereby orders that if the Respondent does not comply with this Order,
a fine in the amount of $50 per day for each day the violation continues past October
31, 2009 plus administrative costs shall be imposed, The Respondent is further ordered
to contact the City of Boynton Beach Code Compliance Division in order to arrange for
re-inspection and verification of payment of the fees to comply with this Order. Mr.
LaTour seconded the motion that passed unanimously.
Motion
Based on the testimony and evidence presented in Case #09-2955, Mr. LaTour moved
that this board find that D & M Photo is in violation of City of Boynton Beach Code
Section as cited, and move to order that the Respondent correct the violation on or
before October 31, 2009. The Board has considered the gravity of the violation, the
actions taken by the Respondent, and any previous violation by Respondent, and
hereby orders that if the Respondent does not comply with this Order, a fine in the
amount of $50 per day for each day the violation continues past October 31, 2009 plus
administrative costs shall be imposed, The Respondent is further ordered to contact
the City of Boynton Beach Code Compliance Division in order to arrange for re-
inspection and verification of payment of the fees to comply with this Order. Mr.
LaRock seconded the motion that passed unanimously.
Case #09-2404 Ahmad A. Ali
Location: 124 Buttonwood Circle

Officer Lewis presented the case and reviewed the details of the violations. Almost all
of the screening was missing from the door on the front porch. The Respondent was
given 15 days to comply. Service was effectuated by certified mail. Staff
recommended 30 days for compliance. Officer Lewis provided photographs for the
Board's review.
Ahmad A. Ali, 124 Buttonwood Circle, noted he was the brother of the property owner
and currently resided at the residence. The owner was out of the country and was
aware Mr. Ali was present on his behalf. Mr. Ali was currently working with the
insurance company to determine the damages to the roof and whether mold existed.
He believed he could comply in two months. Officer Lewis had no objection to the
compliance period.
Motion
Based on the testimony and evidence presented in Case #09-2404, Mr. Yerzy moved
that this Board find that Ahmad A. Ali is in violation of the City of Boynton Beach Code
sections cited and moved to order that the Respondent correct the violations on or
before December 20, 2009. The Board has considered the gravity of the violations, the
actions taken by the Respondent and any previous violations by the Respondent and
hereby orders that if the Respondent does not comply with this Order, a fine in the
amount of $100 per day for each day the violations continue past December 20, 2009
plus administrative costs shall be imposed. The Respondent is further ordered to
contact the City of Boynton Beach Code Compliance Division in order to arrange for re-

Mr. Yerzy noted his objection to the proceeding. He believed there should be a faster,
easier way to conduct business so as not to waste the Board's time. Attorney Tolces
believed the hearing was proceeding as quickly as possible within the parameters of the
law, and he commended the Board members for their patience in dealing with the
issues.

Based on testimony and evidence presented in Case #09-1926, Mr. Yerzy moved that
this Board find that the Respondents, Albeiro & Leticia Marin, were in violation of the
City of Boynton Beach Code sections as cited subsequent to the date of compliance
specified in the Board's Order of August 19, 2009 and in consideration of the gravity of

Mr. Yervy moved that Case #09-812 pertaining to the remaining violations be tabled
until the Code Compliance Board meeting to be held December 16, 2009. Ms. Carroll

Officer Melillo noted proper service had not been effectuated upon the Respondents,
Integrity Investments Group LLC and Inwood International and in the interim, the
Respondents had complied. As such, he requested the Board's Order be rescinded.
