Mayor Cassandra called the meeting to order at 7:30 P. M.
The Invocation was given by Rev. Nathaniel Robinson, Pastor
of the Church of God, followed by the Pledge of Allegiance
to the Flag, led by Councilman Robert Ferrell.
AGENDA APPROVAL
Vice Mayor Zimmerman wanted to remove item D-7 from the
Consent Agenda for clarification and discussion.
Councilwoman Zibelli added under X-New Business, item
B-Community Development Housing in the North End and wanted
to pull out item D-3 from the Consent Agenda for discussion.
City Manager Cheney said the applicant or his attorney has
requested that item D-1 on the Consent Agenda be removed and
placed under VII-Development Plans. Attorney Vance added
under VIII-Legal, D-Other, 4-Brief Discussion of New
Amendments to the Police and Fire Pension Acts.
Councilman Hester moved, seconded by Vice Mayor Zimmerman,
to accept the agenda with the correction. The motion
'carried 5-0.

CITY MANAGER'S REPORT
Mr. Cheney said he would wait for Mr. Jim Frederick to make
comments on "I am an American" Day.
Test borings for soil samples have been made as an initial
step in the physical activity relative to the building
expansion that will be taking place. Mr. Cheney advised
there will be inconveniences for a considerable length of
time.
Mr. Cheney said he received a letter this week from Mr.
Perry Cessna, Utilities Director, announcing that he will be
retiring on September 30, 1986. He said we are prepared,
however, for a smooth transition in this important and
highly technical department; Mr. John Guidry has worked with
Mr. Cessna for almost a year.
Mayor Cassandra requested a report on water consumption at
the next Council meeting; Mr. Cheney said they will resume
this report on a quarterly basis.
PUBLIC AUDIENCE
Tradewinds Development
Mr. Clyde Worrell, 2668 S.W. 23rd Cranbrook Drive, said he
is a member of the First Baptist Church of Boynton Beach.
Tradewinds Development Corporation submitted a letter of
settlement to the City for consideration, and due to
Councilman Hester being absent and Mayor Cassandra not
having enough time to review the settlement proposal before
voting at the last Council meeting, Mr. Worrell thought it
would be in everyone's best interest to reschedule this
matter, have it placed on the agenda, discussed and voted
upon by a full Council.
Mayor Cassandra said the Council received Tradewinds' letter
at 7:00 p.m. the night of the last Council meeting.
Attorney Vance said the offer of settlement died on the
affirmative motion when the vote was 2-2; he said he has no
idea whether Tradewinds would still be interested in the
settlement, which would have required that ordinances be
passed on first reading at that last meeting. Mr. Worrell
said he understands the offer is Still open if the Council
is ready to vote on it. Vice Mayor zimmerman said the
Council had promised the residents of Lake Boynton Estates,
Leisureville and all of Boynton Beach that, before they con-
sider anything concerning the Tradewinds project, they will
be notified; that has not been done. Mr. Worrell thought it
could be scheduled, and that could take place.
Councilman Ferrell asked if it could be scheduled for hear-
ing at the September 3 and September 16 meetings if

Tradewinds sends another letter stating the settlement offer
is still in effect. Mr. Worrell said he spoke with Mr. Mike
Morton today and was advised the settlement offer is still
available.
Mr. Cheney said Tradewinds' attorney should contact the City
Attorney with the offer of settlement, which would be sub-
mitted to the Council. Attorney Vance said, any time there
is litigation pending and the other attorneys want to make
an offer of settlement, he must present it to the Council.
Mr. Worrell said Mr. Kieran Kilday, who was present in the
audience, advised that he is a designated agent for
Tradewinds. Mayor Cassandra said we are in litigation, and
negotiation should be between the attorneys.
Attorney Vance said the offer cannot be the same, as the
previous offer required certain actions during the month of
August. Mayor Cassandra said Attorney Perry may contact
Attorney Vance regarding a settlement offer, and it will be
placed on the Council agenda for presentation and
discussion; he suggested that the material be given to the
Council a week in advance of the meeting so they will have
time to review it in advance. There was discussion of
advertising in the newspaper, but there was agreement that
sufficient notification could be made by notifying newspaper
reporters and letting them include the information as a news
item in the papers.
Attorney Vance said amendment to the Evaluation and
Appraisal Report, which has already been mailed to
Tallahassee, would be required. Sending an amendment would
delay the time schedule on the Report being returned to us;
12 other applicants are involved, so a decision would have
to be made. Mayor Cassandra summarized for Mr. Worrell that
Attorney Perry should contact Attorney Vance if Tradewinds
wishes to make an offer of settlement, and it will be placed
on the next Council meeting agenda.
"I am an American" Day_
Mr. Jim Frederick, American Legion Post 164, said last
Saturday they observed the celebration of the dedication of
Boynton Beach to be the home of "I am an American" Day.
This celebration, which was a tremendous success, was spon-
sored by their Post, the City and the Chamber of Commerce.
Mr. Frederick offered his thanks for the City's par-
ticipation and support. He said the City Manager appointed
John Wildner to coordinate their activities. They antici-
pate even more success for next year. Mayor Cassandra pre-
sented a proclamation to Mr. Frederick proclaiming the City

of Boynton Beach is the home of "I am an American" Day, sup-
porting the designation of the third Sunday in October as
"I am an American" Day and urging State and Federal legisla-
tures to likewise recognize this observance.
Final Settlement of Sheridan Case
Mr. Bob Fauser, 125 S.E. 6th Avenue, said he wanted to
discuss this lawsuit last May, but Attorney Vance thought it
best not to comment on it until the settlement papers were
signed. On July 28, 1986, final settlement was approved by
Judge Daniel Hurley. Mr. Fauser said Glen Adams was a
Boynton Beach police informant, who was shot to death by a
Lake Worth police officer in Lake Worth on May 12, 1984. At
the time of the shooting, Mr. Adams was working with
Detective Paul Sheridan of the Boynton Beach Police
Department. Patricia Adams, Glen Adams' wife, sued the City
of Boynton Beach and Detective Sheridan, charging them with
negligence in the death of her husband, including the charge
that Paul Sheridan was intoxicated at the time of the
shooting. The Lake Worth police report on this incident
stated that Paul Sheridan was extremely intoxicated when
they tried to interview him the night of the shooting. The
Boynton Beach police report stated that he was not intoxica-
ted--he had just been drinking and had done nothing wrong to
contribute to the death of Glen Adams.
The insurance company for the City of Boynton Beach and Mr.
Sheridan looked at the facts in the case and decided to
settle with Mrs. Adams and Renee' Adams, a daughter by a
previous marriage, giving them a total of $225,000. Mr.
Fauser said the lawsuit may be over, but questions remain.
He told about an anonymous letter, supposedly written by
certain members of the Boynton Beach Police Department and
sent to the City Manager and city Council in June, 1984, one
month after the shooting incident. He said at the time even
Bob Ferrell thought there was some basis to some of what the
letter said. In the letter certain Police staff members
complained that they had told then Chief Hamilton as far
back as early 1983 that Paul Sheridan had a drinking problem
and should be removed from the Vice Unit before there was a
problem. Mr. Sheridan was not removed, and there was a
problem. Mr. Fauser asked why Mr. Sheridan's drinking
problem was not officially acknowledged until after the
drunk-driving incident of February 9, 1985--nine months
after the shooting incident.
Chief Hillery stated in a sworn affidavit of February 21,
1986, that the facts show there was no improper conduct on
the part of Paul Sheridan that contributed to the death of
Glen Adams. If this was true, Mr. Fauser asked why the City

did not go to court and defend itself by presenting these
facts to a jury and why did the insurance company pay Mrs.
Adams and Renee' Adams $225,000 total if the facts show that
Paul Sheridan did nothing wrong. With the settlement, Mr.
Fauser said Paul Sheridan will never have to go to court and
answer any questions about his behavior the night Glen Adams
was shot.
Attorney Vance said the lawsuit was defended by the City's
insurance carrier, who has sole discretion in this type of
litigation; it is their money at risk. It was their deci-
sion to settle, as insurance companies frequently do. Mr.
Fauser said insurance companies look at the facts in each
case and decide whether to go to court or to settle--based
on the facts. As a Court ~Clerk, Mr. Fauser said he has sat
through cases where a law enforcement officer shot someone,
the relatives sued, the agency defended itself in court and
won. He expressed his dissatisfaction with the unanswered
questions in this case.
Solicitation Permits
Ms. Rosemary Stevens, Executive Director of the Leukemia
Society Palm Beach Area Chapter, told of the importance of
her organization's work and said the purpose of her visit
was to request a waiver of the section of the City's Code as
it deals with charitable solicitation. She gave an example
of an individual who was cured of cancer by recognizing
early enough a danger symptom listed on a brochure distri-
buted by a solicitor. Ms. Stevens said the health care
charitable organizations provide educational material as
well as raise money through donations. The requirement of a
$10 solicitation fee plus $.25 per volunteer is not the
major problem; the real encumberance is the amount of time
required to process the application, single out the Boynton
Beach volunteers, provide a list to the City, wait for the
badges, separate and mail those separately at first-class
postage rates--they will no longer meet the requirement for
bulk mail--and the extra paperwork involved.
Ms. Stevens said the health agencies have been conducting
these drives for a long time in the same way; she did not
think there were any problems when Boynton Beach did not
have these requirements. She mentioned the stringent regu-
lations and monitoring of the health agencies' activities.
Jeannine ~Winkles of the American Heart Association was 9re-
sent but declined to speak.
Attorney Vance said no one questions that the Leukemia
Society is a worthwhile cause, but the ordinance cannot be

aimed at specific groups. The federal courts have ruled
that an ordinance to regulate solicitation must be applied
across the board; to exempt one person or group invalidates
the entire ordinance. Ms. Stevens asked if all organiza-
tions could show a sample of the kind of identification they
provide, and the requirements could be waived for all who
meet the City's criteria. Attorney Vance said that would
not give control over the types of organizations that have
concerned the City Council.
Vice Mayor Zimmerman said the judges are not permitting us
to be a judge of who is worthy of making solicitations; it
seems they want that privilege.
There was discussion of different procedures that might
expedite the solicitation permit process. Mr. Cheney said
the purpose of the ordinance was not to make a judgment of
who could or could not solicit, but rather for residents to
be able to easily identify a solicitor who came to the door
and enable them to find out at City Hall where each soli-
citing organization's funds were spent. He said there may
be a way to change the procedure and still accomplish those
purposes. Mayor Cassandra said any ideas could be addressed
to Attorney Vance, and if he feels the City will not be hurt
legally, the Council will be glad to keep an open mind. Ms.
Stevens noted that their drive is conducted by 5,000 volun-
teers and some of the health organizations may have as many
as 50,000 volunteers; the record keeping, time involved,
administration and cost is extensive.
Time Limit for Developers
Mr. Ben Uleck, 1507 S.W. 17 Avenue, wanted to know if the
City could set a time limit for a developer to complete a
project. He told of a four-story building on Woolbright
Road just east of Congress Avenue which has been under
construction for 18 months; it should have been completed in
eight months. Mr. Uleck proposed that the City allow double
the normal time required. Attorney Vance said time limita-
tions can be placed on certain types of zoning and site plan
approval, but to require completion in a given time would
be a problem. If there was pure abandonment, demolition
might be possible.
Mr. Uleck said debris has been dumped in the canal by
Leisureville, and nearby residents are concerned. Attorney
Vance said that is probably an action of trespassing, but
that would be a private action.

Tradewinds Development/Police Auction
Mr. Lowell Bennett, 400 S.W. Golfview Terrace, said he had
planned to propose to the Council the same thing Mr. Worrell
did. He said he wanted to commend City Manager Cheney for
his performance as an auctioneer at the last Police auction;
the event was enlightening, entertaining, Mr. Cheney did a
super job, and a lot of kids went home happy. In response to
Mayor Cassandra's question, Mr. Cheney said the City made $900.

D. Development Plans
Consider request submitted by Thomas E. Brandt,
agent and co-owner with George A. Von Essen, for site
plan approval to construct a 52,024 square foot com-
puter disc drive repair facility on 6.10 acres
approximately 200 feet east of the Thor Drive dead-
end, adjacent to the Seaboard Railroad right-of-way.
This site will be known as Seagate Service Center.
The Planning and Zoning Board unanimously recommended appro-
val of this request, subject to staff comments. Council~
woman Zibelli asked if hazardous waste had been discussed,
and Mr. Carmen Annunziato, Director of Planning, said this
was discussed at an Environmental Review COmmittee meeting,
at which time it was determined there was no grounds for the
Environmental Review Permit application to be processed.
There was extensive discussion at the Technical Review Board
meeting concerning on-site storm water retention and the
effect of having truck wells; that was accounted by the
developer's plans to have the truck wells moved over.
Mr. Cheney advised Councilwoman Zibelli the City's ordinan-
ces contain a list of potential environmental problems. If
there are any questions, an applicant is called in to meet
with the Environmental Review Committee and the entire pro-
cess is discussed. If the conclusion is that there isa
potential environmental problem, they go through the appli-
cation review process. If the conclusion is there is not,
an applicant goes through the normal process. The applicant
was present, but there were no further questions.

Consider request submitted by Kieran J. Kilday,
agent for Turks & Caicos Corporation, B.V., c/o
Joseph Franks, for approval of an amended site plan
to allow for retail gasoline sales at the con-
venience store (Farm Store) and a change in parking
lot layout and design. This site, Meadows Square
Shopping Center, is located on Congress Avenue at
Hypoluxo Road, the southwest corner.
The Planning and Zoning Board unanimously recommended appro-
val of this request, subject to staff comments. Vice Mayor
zimmerman said he would like to see the new site plan and
hear an explanation of how it differs from the one the
Council turned down previously, which included a filling
station.
Mr. Kieran Kilday, 1551 Forum Place, West Palm Beach, said
they went back to the Planning and Zoning Board, which had
recommended denial earlier, with adjustments to the plan.
In addition to providing a more easily read plan, Mr. Kilday
said they increased the width of an exit onto Meadows Road.
He pointed out signage reform on the plan. With the
changes, the plan was presented again to the Technical
Review Board and the P&Z Board; all parties were satisfied.
Mr. Kilday explained Publix' delivery schedules and pointed
out the routes the large trucks will take for ingress,
egress and making turns.
In response to Vice Mayor zimmerman's question, Mr. Kilday
said there are four pumps, each being a dual pump; eight
cars could be pumping at once. He said this plan differs
significantly from the plan originally submitted to the TRB.
He commented that the sign with the cow has been deleted.
This property will match the existing center in terms of
texture and roofing. The owner of the center and a Farm
Store representative were present; Mr. Kilday said they will
require it to match. Mayor Cassandra asked if that state-
ment is binding. Mr. Kilday said the Community Appearance
Board granted approval on August 18, which bound them to the
colors and tiles.
Councilman Ferrell moved, seconded by Councilwoman zibelli,
to approve items D-3 and D-7 from the Consent Agenda. The
motion carried 5-0.

PUBLIC HEARING
Consider request submitted by Michael Puder, Southeast
Development Enterprises, Inc., for abandonment of a por-
tion of a l0T utility easement (4' reduction) in Plats
No. 5 and 6 at Boynton Lakes in order to allow for the
addition of patio/screened enclosures. (Waterview at
Boynton Lakes) Planning & Zoning Board postponed their
Public Hearing until September 9, 1986.
Mr. Annunziato said the applicant failed to secure all of
the necessary signatures on his application and, therefore,
requested a postponement of his abandonment request Until
September 9. In accordance with Mr. Annunziato's recommen-
dation, Councilman Ferrell moved that the City Council post-
pone this public hearing until September 16, 1986, at 8:00
p.m. or shortly thereafter, the Council meeting following
the P&Z Board meeting. Vice Mayor Zimmerman seconded the
motion, and it carried 5-0.
Mayor Cassandra announced a short break, and the meeting
resumed at 8:40 p.m.
DEVELOPMENT PLANS

Discussion on comments for Palm Beach County ~Planning
and zoning actions west of Boynton Beach (Postponed from
July 15 and Auqust 5 meetings)
Mayor Cassandra said the City staff made recommendations on
approximately seven items, and Councilman Ferrell was con-
cerned that the Council did not have enough information to
agree to those recommendations. Councilman Ferrell said his
feelings are still the same; we should express what we see
as far as problems, impact or incompatibility but not for-
ward ~ policy statement from the Council when a full presen-
tation has not been given. He thought the Council could
comment as to what impact they foresee and would like the
Commission to consider, but not to formally oppose a project
which the Council has not considered in depth. He clarified
that concerns on each petition were forwarded to the
Commission.
Mayor Cassandra asked if the Council did not wish to make a
recommendation on the property surrounding its borders.
Councilwoman Zibelli expressed concern for the people living
in the communities that might be squeezed out by commercial
development. The County Commission will consider these
petitions Monday, August 25. Councilman Ferrell said, as
discussed at the previous meeting, the Council did not plan
to give a positive recommendation for any of the petitions,
and they would put themselves in the stance of making only
negative recommendations without having the information
fully presented to them. Mr. Cheney said our comments were

forwarded early enough that they should have been included
in the packets of material the Commissioners receive.
Petition #15
Dr. Richard Carrington, 4775-B Quailwood Cresent, Boynton
Beach, said about four years ago the citizens west of
Boynton Beach in the reserve area became concerned with ram-
pant commercial spot zoning and the quality of construction~
and they formed the COBRA organization. At that time the
City had no comprehensive plan to control growth in the
western area. Although people were suspect of COBRA when it
was formed, Dr. Carrington said they have gone to the
Commission to promote orderly and balanced growth. He
pointed out that he serves on the County's Land Use Advisory
Board and is an officer of COBRA. The COBRA directors hope
there will be no commercial development west of Knuth Road
north of the canal by Greentree Plaza.
The area Dr. Carrington was concerned about is on the west
side of Knuth Road, extending from Old Boynton Road to the
jog in Oakwood Lakes. The petition to the Commission is to
make the entire area commercial; COBRA and the neighborhood
residents are opposed. The owner has threatened that, if he
is not granted the zoning he seeks, he will apply for
annexation to the City and get commercial zoning from the
City. Dr. Carrington said he hopes the Council will see
their position--that this is an intrusion into a residential
development. He told about an East/West Committee which has
been formed, consisting of two people from the City, four
from the Chamber of Commerce and three from COBRA; they meet
once a month at Quail Ridge to discuss common problems and
objectives.
Councilman Ferrell mentioned that an all-night gas station
was proposed about a year ago, and annexation was requested.
The Council did not approve it.
Petition 916
Mr. John P. Hess, 7075 High Ridge Road, said he was repre-
isenting the owners of property on High Ridge Road and mem-
ibers of the Greater South High Ridge Property Owners
Association to bring to the Council's attention this peti-
~tion, which will be before the County Commission August 25
.!around 5:00 p.m. The proposal is to build a 26½ acre
iiindustrial area in the middle of a residential area; there
lis an agreement to purchase the land if the zoning is
~approved. The applicant could then come to the City and
have the Cedar Ridge zoning re-evaluated, possibly forcing

MS..Judy Cindrick, 1887 Finn Hill Drive, Lantana, was pre-
sent to speak on the same petition. She pointed out on a
map where the developer wants to build an industrial park
and showed photographs of homes in the area. She feels this
is checkerboarding and cannot see any purpose of the
industrial park for the residents of the area; they might
benefit from commercial development. Residential property
abutting the site will lose value and possibly will not
develop to its full potential. Ms. Cindrick said the Ridge
Terrace Nursing Home, the High Ridge Country Club, two
schools, a dude ranch pre-school and Lake Worth Christian
School are in the area. The Land Use Advisory Board voted
6-5 in favor of the industrial park; no residents were pre-
sent at that meeting, at which the area was portrayed as
homes of very poor quality. The developer's justification
statement in their application filed with the County said
they envisioned the whole area becoming a high tech commer-
cial/industrial/office park.
There was discussion regarding the Council sending a repre-
sentative to the August 25 meeting. Councilman Ferrell
would hate to see the City put in a position of making the
County's decisions for them, when the Council has not taken
the time to thoroughly review every petition. He said they
tried to get the County to do an im. pact zone agreement, but
they did not go along with it. Vice Mayor Zimmerman thought
the County is asking for the City's opinion; Councilman
Ferrell agreed and said that worries him to an extent,
because we are giving negative recommendations only. He
said he felt uncomfortable having someone make a policy sta-
tement for him on something about which he is not completely
informed.
Ms. Cindrick said the developer has indicated he will build
a high quality high tech industrial park, but she felt even
that would be incompatible in a residential area and serves
no purpose for the residents.
Vice Mayor zimmerman said he studied the Planning
Department's comments regarding these petitions and is
thoroughly in agreement with them. He made a motion,
seconded by Councilwoman Zibelli, to direct the appropriate
staff member to voice the recommendations to the County as
presented by the Planning Department staff. Councilman
Ferrell wanted to clarify that his comments were not that
the industrial park should or should not be at a certain
site, but that he feels the County has previously not soli-
cited our input and now they are asking for input on
something the Council does not~ know about. If the County is
serious about it, he thought we should go back to the impact
zone agreement and do something effective rather than asking
for our support piecemeal.

The motion on the floor was voted upon and carried 5-0. Mr.
Annunziato wanted clarification as to whether the motion
included only petitions 915 and 916, which were discussed
tonight by the public, or the entire packet. Vice Mayor
Zimmerman said his motion was for the entire packet, and
Councilwoman zibelli said her second was intended for the
entire packet. Mr. Zimmerman asked if this would overburden
the Planning Department. Mr. Cheney said he did not know
all of the dates, but they will do the best they can if the
Council wants them to.
Attorney Vance said a motion to reconsider could be made by
anyone on the prevailing side, which every Council Member
was. Councilman Hester moved, seconded by Councilman
Ferrell, to rescind the previous motion; the motion carried
5-0.
Vice Mayor Zimmerman moved, seconded by Councilwoman
zibelli, to direct the appropriate staff member to voice
the recommendations to the County as presented by the
Planning Department staff for the entire package of peti-

Consider request submitted by Greg Proctor, agent for
Ryan Homes, for approval of a Preliminary Plat for
Meadows 300 PUD Tract K - Lakeshore, located on the west
side of Congress Avenue, south of Hypoluxo Road. This
request for approval of the construction plans and pre-
liminary plat provides for the construction of
infrastructure improvements to serve 61 single-family
units in connection with a previously approved planned
unit development.
Mr. Annunziato said this item was not on the Consent Agenda
because the vote to approve was not unanimous. Part of the
Planning and Zoning Board's recommendations included the
request that the City staff, particularly the Utility
Department, explain the need for requesting that the appli-
cant extend the water main to the edge of Lake Worth
Drainage District Canal 19 and escrow one-half of the cost
of an aerial crossing. The Board also questioned the loca-
tion of the water main and the size of the easement. The
recommendation at this point is that the request be
approved, subject to staff comments, provided the Council is
satisfied with the explanation made by the Utility
Department.
Mr. Greg Proctor, of Carnahan Engineering, 6191 West
Atlantic Boulevard, Margate, said he was present on behalf
of Ryan Homes. In response to Mayor Cassandra's questions,

Mr. Proctor said he is familiar with the staff comments and
agrees with all of them, including compliance with those
outlined in the City Manager's memo of August 19, 1986.
Councilman Hester moved, seconded by Councilman Ferrell, to
approve the request submitted by Greg Proctor, agent for
Ryan Homes, for Tract K - Lakeshore, located on the west
side of Congress Avenue, south of Hypoluxo Road. The motion
carried 5-0.
C. Consider Master Plan Amendment - Boynton Lakes Plat 2
Mr. Annunziato said this request is that the City find no
substantial change in the previously approved Master Plan.
The applicant desires to roof over screened porches approxi-
mately 12' X 26' in size. The Technical Review Board recom-
mends that the Council make a finding of substantial change,
based on justification outlined in correspondence from the
Building Department and Fire Department. Drawings were pro-
vided representing the potential impact in one area of Plat
2. These screened porches are approximately 300 square feet
and amount to approximately 25 percent of the house size.
In one area, the potential exists to have these roofed over
structures within 10 feet of each other. Because the lot
coverage ratios would change so dramatically, the consensus
of the TRB is that it will constitute substantial change to
the previously approved PUD.
Mr. Jack Wolfe, 3 Fenwick Place, said about 25 of these
roofed screened porches are already built, and they are
trying to prevent any larger screened porches than are
already there. Over 65 percent of the area has patios that
were built by the builder; he asks that roofs be allowed
over them so people can use their porches. When it rains,
the porch furniture gets wet and cannot be used. This area
is single family, and across the street are villas, which
have screened porches with roofs on them. Regarding the
question of 10 feet between structures, Mr. Wolfe said he
has measured every home in every area of the development
with a tape measure, and there is not one home that cannot
handle a 12' screened porch without at least a 19.1' separa-
tion between them. The only ones with less space are those
on the canal or backing up to Congress Avenue.
Mr. Cheney clarified that the recommendation before the P&Z
Board is not that the porches should be denied or approved,
but the issue is whether or not this is a substantial modi-
fication to the Master Plan. The TRB thinks it is a
substantial modification and, therefore, the City needs a
new PUD application. If the City Council does not agree it
is a substantial modification, the application goes to the

P&Z Board, which will review it further and decide whether
to approve or disapprove this modification to the PUD. The
question is whether the applicant will be required to go
through a resubmitted Master Plan for the PUD, or do we let
the P&Z Board see if they can resolve this as an amendment
to that PUD. Mayor Cassandra commented that, if it is
determined to be a substantial change, resubmitting would
involve dollars and cents.
There was clarification that about 65 percent of the homes
in the area have screened patios, and 25 homes have roofed
porches measuring 12' X 26' and many others have smaller
ones. It was unclear if these were built without benefit of
permit. Mr. Annunziato said there is a substantial dif-
ference in the way the zoning code views roofed over struc-
tures as opposed to screened structures. Screened
structures can go closer to the rear property line; roofed
over structures must abide by setback lines as though they
were the house. Vice Mayor Zimmerman said this is a develo-
per's trick; they build a slab and put screen around it to
avoid the setbacks. Then they put a roof on it and create a
nonconforming building.
Councilman Ferrell moved, seconded by Vice Mayor zimmerman,
to find this to be a substantial change to the Master Plan,
and require the applicant to go before the Planning and
Zoning Board and submit a new application for a PUD. The
motion carried 5-0.

Consider request submitted by Jeff Iravani, agent for
the Wilshire Corporation, for approval of a Preliminary
Plat for Meadows 300 PUD Tract G - Club Meadows Phase
III, located on 'the west side of Congress Avenue, south
of Hypoluxo Road. This request provides for the
construction of infrastructure improvements to serve 170
multi-family units in connection with a previously
~pproved planned unit development.
Mr. Annunziato said this item had been placed on the Consent
Agenda because the P&Z Board had unanimously recommended
approval of the application, subject to staff comments and
subject to the applicant receiving capital facilities fees
for utility improvements, which were above and beyond impro-
vements required for him to construct his specific
subdivision plat. The applicant has requested that this be
removed from the Consent Agenda to discuss the item.
Accompanying the Agenda was an analysis of the cost of over-
sizing, prepared by Mr. Perry Cessna, Director of Utilities,
which suggests there should be a captial facilities credit
to the developer of $10,458.80. The staff recommends that
this request be approved, subject to staff comments,

including the memo from Mr. Cessna explaining the capital
facility fee adjustment.
Mr. Jeff Iravani, Consulting Engineer for the project, said
there are no problems with the staff comments except the
part about extending utilities to the project to the
north--Lakes of Hypoluxo. Mr. Iravani said this project is
a Planned Unit Development; under PUD his client entered a
development contract with the City of Boynton Beach. All
comments and requirements by the City were met by his
client, and he spent $3.1 million for roads, drainage, water
and sewer, $1.2 million of which was for water and sewer.
In addition, his client contributed $370,000 to off-site
water and sewer extension on Congress Avenue from Old
Boynton Road to Hypoluxo Road. The intent with this outside
improvement was that the properties adjacent to this pro-
perty, of which Lakes of Hypoluxo is one, would have oppor-
tunity to connect to this water and sewer.
Mr. Iravani said his client has met all of his obligations,
but on Tract G, the City has required him to give an ease-
ment and construct a sanitary line in the middle of his pro-
ject to Lakes of Hypoluxo, which currently is for sale and
probably will be developed some time in the future. He
feels this is unfair, and his client has advised he will not
give an easement so someone else can have water and sewer.
He has spent a fortune to bring water and sewer to his pro-
perty and has met his obligation as a good neighbor to pro-
vide water and sewer to properties adjacent to him; that was
part of the $370,000 package. Mr. Iravani said he is
willing to negotiate if the developer of Lakes of Hypoluxo
in the future would like to purchase an easement at a
mutually agreeable point--not where the City is asking for
it now. He requested that the part of the staff comments
regarding water and sewer utilities being extended to Lakes
of Hypoluxo be removed, or that the Council reject this
approval, in which case he would like to ask his client's
attorney to speak.
In response to Vice Mayor Zimmerman's question, Mr. Iravani
said construction cost would be $10,000 to $15,000, but the
question is not the construction cost, it is the City
forcing his client to put an easement through the middle of
his property, going through his natural vegetation preserve.
Mr. Iravani said this does not have to be done; as easement
could be given on the east property line and still have gra-
vity sewer rather than building a lift station.
Mr. Paul Wolfe, Attorney with Ferguson, Jones and Foster,
505 South Flagler Drive, West Palm Beach, said there is an
existing easement for the neighbor to use to tie into the

sewer and water. On Plat 2 of Meadows PUD, a 20 foot uti-
lity easement has been provided along Hypoluxo Road; he can
tie into it at the shopping center site. Mr. Wolfe said
there is no reason to go across the middle of Tract G to get
utilities to his property; he pointed out the easement on
the plat and where the proposed easement would be. He said
cutting across Tract G might save Lakes of Hypoluxo a few
dollars, but his client had to pay 33 percent of the cost
of bringing water and sewer lines along Congress Avenue from
Old Boynton Road to his property. Mr. Wolfe said what his
client is being asked to do amounts to taking his land
without just compensation.
Vice Mayor Zimmerman said maintenance costs over the years
are something the City has to consider; replacing and main-
taining a round-about line could be costly. Mr. Wolfe asked
what would happen if owners of the next piece of property
want to tie in; they would have to go down Hypoluxo Road,
for there would be no more capacity in that small line.
Mr. Wolfe suggested that the staff people who made this
recommendation have acted arbitrarily, capriciously and
without thought for the reasonableness of 'their position.
He said, if the Council thinks it is in the City's best
interest to have the easement, the City has the right to try
to condemn an easement in that location. Mr. Wolfe said he
believes the plat as presented meets all of the criteria of
the City's ordinance for plats and the criteria of the
Florida Statutes for plats and should be approved without
the condition that his client be required to build a sewer
line for the benefit of someone else.
The City Manager asked Mr. Cessna, Director of Utilities, to
explain the reason for this condition for approval. Mr.
Cheney said this applicant was a leader in the Congress
Avenue sewer line extension and paid one third of the cost,
because they have one third of the units to be served. Mr.
Cessna said this requirement is not arbitrary and capri-
cious; rather than adding 600 to 900 feet of gravity sewer,
we will only need 300 feet. He said he has not seen
anything on Hypoluxo Road that Lakes of Hypoluxo can get
into by gravity sewer; the alternative is a pump station, of
which the City has 130 now and does not need any more, as
they all require maintenance. That cost ultimately goes to
the individual customer.
Mr. Cessna said, with a manhole between two pieces of pro-
perty, it is difficult to access with the vactor, which
weighs 40,000 pounds. He explained other difficulties in
cleaning lines. In reviewing the plans, Mr. Cessna does not
think the City can serve Lakes of Hypoluxo with gravity

sewer along Hypoluxo Road. He said, if this applicant can
show him where they can get in by gravity, he can maintain
the sewer lines that have to be put in. He said he is not
opposed to working something out; he does not want extra
sewer lines and does not want a line out in the middle of
nowhere that he cannot get to with a piece of equipment
worth $100,000, where an axle might be pulled out because it
became stuck in the sand.
Mr. Iravani suggested, if the developer to the north of them
is willing to purchase, an easement could be given on the
east property line; he showed pavement on a drawing where
the equipment could be brought to the manhole for cleaning
and another point where they could get into the gravity
sewer for cleaning. He said there are possibilities to pro-
vide gravity sewers without the sanitary line running
through his client's project. He said they will give an
easement, but want to negotiate with the other developer
to purchase it.
Attorney Vance recommended that the Council postpone this
item until the September 3 meeting and permit Mr. Wolfe to
meet with Mr. Cessna to work out something both sides will
be happy with.
Mr. Annunziato noted there are three parcels of land in this
unincorporated County pocket; the ability to have the
shorter length of gravity sewer would allow the City to
serve all three parcels by gravity sewer system--not just
Lakes of Hypoluxo. He also said it is not uncommon for
utility easements to be granted, which serve other property
owners. Hundreds of thousands of dollars have been spent on
utility easements which benefitted the Meadows, for which
they did not pay. He said extensions of utility easements
to serve other properties is common practice. Mr.
Annunziato added there was a 25 percent match against the 75
percent public funding of the master utility system; the
public already has a substantial investment in the gravity
sewer system. He said he does not think it is in the
interest of the City to provide for the construction of
another lift station with perpetual maintenance where it is
not necessary.
Mayor Cassandra suggested the Council take the City
Attorney's recommendation and attempt to settle the problem
through the Director of Utilities, the City Engineer and the
City Attorney. Mr. Iravani suggested that the comments his
client objects to be deleted right now, and they will get to
the utilities; he will come back for final plat approval.
Attorney Vance thought it would be better to work out all of
the details rather than have any area of dispute; the addi-
tional time would be helpful to both parties.

In response to Mayor Cassandra's question, Mr. Cheney said
this represents a change in wording, particularly in rela-
tion to leased vehicles, and wording and a change in fee
relative to re-issuing permits; there is no change in the $5
permit. When a permit is mutilated and none of it is
returned, the charge for re-issuing will be $5; when a piece
of the mutilated decal is returned, the charge for re-
issuing will be $3. This ordinance clarifies that, when a
person changes cars, he must purchase a different permit,
rather than passing the permit from car to car and among
different persons and families. It also clarifies that a
decal can be issued to an individual's own car, and he can
purchase a temporary permit for a leased vehicle also.

Approve Utility Service Agreement for Mr. & Mrs. Donald
Pearce - Mentone Road
Mr. Cheney said this request came in with an agreement for
annexation; however, the property is not adjacent and can
never be annexed. It is in the old Bristol Springs area.
He recommended that the Council authorize the extension of
service but not require an agreement for annexation.
Attorney Vance said he agrees, practically speaking, but we
have that policy. Mr. Cheney said this is not within our
reserve annexation area.
Vice Mayor Zimmerman moved, seconded by Councilman Ferrell,
that the City accept the agreement. The motion carried 5-0.
3. City of Boynton Beach v. Melear, et al. Western Well
Fields - Stipulated Final Judgment concerninq Parcel 17
Attorney Vance said our appraisal was $3,000, and the
sellers will take $3,000. Councilman Ferrell moved,
seconded by Vice Mayor Zimmerman, to approve the settlement
of the Final Judgment concerning Parcel 17 on the western
well fields. The motion carried 5-0.
Discussion of New Amendments to the Police and Fire
Pension Acts
Attorney Vance said the last session of the State
Legislature amended the Police and Fire Pension Acts to pro-
vide substantial additional benefits. At the same time,
another entity of the State was ruling that this particular
item is negotiable in labor contracts. He said there is a
substantial amount of confusion. The cities of St.
Petersburg, Orlando, Daytona Beach and Tallahassee are
meeting August 20 in Tallahassee to discuss sueing the State
to overcome the amendments and/or at least get a declaratory
judgment that enables one to meet them in a sensible manner.
Attorney Vance said these amendments are not very legible or
easily understood. At this point he recommends that the
City join in this litigation if it becomes a reality. The
proposal is that those cities which participate will pay on
a population basis. He suspects a lot of other ciites will
join in, and Boynton Beach's pro rata share will be rather
small. Attorney Vance said he plans to contact several city

attorneys in the immediate area and advise them of what is
going on. He thinks it is quite possible the legislation
might be overturned.
In response to Councilman Ferrell's question, Mr. Cheney
said the amendment includes the make-up of the pension
boards at the moment. If some cities participate in the
litigation, get a declaratory judgment, and the matter goes
to a circuit or appeals court, he said he is concerned as to
where our city would go; it would not affect us, yet we
would be in the middle. Mr. Cheney said he saw no reason
that we should revamp our pension board; it works and is a
good program. He had no problem with the State setting
standards of sufficiency, limits on unfunded liabilities and
audit reports, but thought they are becoming involved in
some other issues only because the Police and Fire unions
are strong in Tallahassee.
Councilman Ferrell said, having been on the other side in
the past, when issues such as this arose, representation
from the cities was minimal and 150 to 200 policemen and
firemen were present. He said Boynton Beach and other
cities should become involved and address them when these
issues come up. Opinions expressed by elected officials
from different cities have significant influence with the
legislature.
Vice Mayor Zimmerman asked if the City has money available
to participate, and Mr. Cheney answered affirmatively--in
our legal account. He said we do not know how much would be
required at this point; it may be necessary to act quickly,
before the next Council meeting. At the next Council
meeting, a report could be made; he thought Attorney Vance
should have the authority to sign up to participate.
Attorney Vance said he suspects the matter will snowball, and
Boynton Beach's commitment will probably be minimal if the
cost is based on population.
Vice Mayor Zimmerman made a motion that City Attorney Vance
evaluate further involvement and that the City join the
suit if he feels it is necessary. Councilman Hester
~econded the motion. Councilman Ferrell wanted to clarify
hat the Council is not opposing any of the minimum stan-
ards of safety requirements, but rather some of the other
technicalities. The motion carried 5-0.

Review of 1986/87 Golf Course Budget and .set fees for
1986/87
Mr. Cheney said the 1985/86 budget had been presented as a
balanced budget, and the estimate of expenditures through
the end of September shows there will be at least $4,000 of
revenue over expenditures. For 1986/87, a balanced budget
is proposed. Mr. Cheney said a change is not proposed in
the annual permit fee, but a change is proposed in the green
fees, increasing them by $1 per category, with the exception
of the 9-hole championship course. The cart fees are pro-
posed to remain the same. These fees will maintain and
operate the golf course in the coming year, setting aside
adequate reserves for replacement of equipment in two or
three years; the equipment replacement schedule is shown in
the budget. Appropriate transfers will be made to the
City's General Fund for such items as vehicles and sanitary
services. The fund is self-supporting and pays for all of
its services.
Mr. Cheney said Joe Sciortino, Golf Course Manager, is now
President of the State Municipal Golf Course Managers'
Association, and he won a statewide tournament recently. He
has suggested, and it is proposed in this budget, that $.50
per round be charged to everyone who plays the course,
including permit holders, to cover capital improvements.
This is not for maintenance, operation, equipment replace-
ment or upkeep of what we have, but for improvements and
additions to the course. A list has been compiled, which
includes some rebuilding, which is beyond maintenance and
repair, an added bay in the maintenance building, possibly a
screened porch around the clubhouse, added landscaping for
the course, which increases safety as well as aesthetics.
As the $.50 charges accumulate, Mr. Cheney said they would
come before the Council and make proposals as to how the
reserve for improvements and additions would be spent.
The fee structure change is minor, and there is no change in
permit cost. Mr. Cheney said the letters are ready to be
mailed out August 20 to all existing permit holders~ they
will have until September 10 to respond with their renewals.
From September 11 through 25, people who want to hold an
annual permit may sign up for any openings that occur
because some of the present permit holders do not renew.
Boynton Beach residents will have first choice in that sign-
up structure, because fewer than 70 percent of the permit
holders are from the City. By September 25 or 26, we hope
to have a total of 800 to 810 permit holders and will move
into operation on October 1.
Vice Mayor Zimmerman asked what is the reaction of the Golf
Course Advisory Committee to the increase in green fees and

capital improvements charge. Mr. Cheney said they have not
discussed it, as the Council's set of objectives and direc-
tions to the Golf Course Advisory Committee stated that all
personnel and financial matters are handled by the Mayor and
City Council. As a matter of practice, he said he does not
discuss budgets with any advisory committee until they come
to the Mayor and City Council. Copies of this budget were
mailed to the Committee after they were furnished to the
Council.
Mayor Cassandra referred to page 3 of the budget and asked
if there was no more revenue from ball retrieval. Mr.
Sciortino explained the contract with a ball retrieval ser-
vice under which they provide range balls. The cost is com-
parative, but rather than our putting out the money at the
beginning of the year as an expense, they provide us with
new range balls at the beginning of each year and take back
the old range balls. On page 14, Mayor Cassandra noted
$33,000 to be spent through August this year for General
Liabilities, but only $30,000 is anticipated for next year
and the City Manager recommends only $5,830. Mr. Bill
Sullivan, Purchasing Agent, explained that we joined an
insurance company through the Municipal League; the private
company we had cancelled our coverage. Mayor Cassandra
asked if we have a $5,000 deductible on this policy, as we
have on the other City policies. Mr. Cheney confirmed that
we do and noted that the $2,000 in item 49 on the budget is
to pay whatever liability claims we have under $5,000.

approve the Golf Course fee structure and budget as pre-
sented. The motion carried 5-0.
B. Community Housing - North End
Councilwoman Zibelli expressed concern about the boarded up
houses in the north end owned by Palm Beach County Housing
Authority. She has spoken with Mr. Allen Schnier of
Community Development and was advised they had been sold.
She would like to have the Council send a letter and ask Mr.
Schnier what the status is and when we can expect something
to be done. They are trying to remodel blocks, and the
boarded up houses are unsightly. The situation is a concern
to many people in Village Royale on the Green. Councilwoman
zibelli said she would like to have a letter sent from the
Mayor. Vice Mayor Zimmerman thought it would help to be
specific about which houses we are concerned. Councilman
Ferrell heard the new ones had been sold back to the builder
at a considerable discount. The Council agreed that the
letter would be sent as requested.

Charter says they are a liaison between the people and the
Council. Their duties are not that much, and very intelli-
gent, viable people are there who want to do something.
They would like to make the public aware that they are there
for people to come to with their grievances; this would help
to shorten the public audience section of the Council
meetings. The CRB can help find a solution to many citizen
complaints. The Council usually refers problems to the City
Manager or department heads anyway.
Vice Mayor Zimmerman read an article about this subject in
the paper. Councilwoman zibelli asked if the Council could
refer residents to that Board, as they do to the Planning
and Zoning and Technical Review Boards. Mayor Cassandra
mentioned printing a message on the utility bills regarding
the CRB. The Council was asked to try to bring ideas for
discussion at the next meeting.

Redevelopment Agency for September 11, 1986--the second
Thursday in September--if there is no Sewer Board meeting
held. He asked if the Council is ready to have another
meeting with the CRA. Mayor Cassandra asked if there is
anything new to discuss. Mr. Cheney thought the marina,
the general concept, the landscaping proposal, the model
block and parking should be discussed. He said we do not
want what has been happening in Boca to happen here. Mayor
Cassandra said September 11 sounds good as of this date.
ADJOURNMENT
Vice Mayor Zimmerman made a motion to adjourn, and the
meeting was adjourned at 10:40 p.m.
