Mayor Cassandra called the meeting to order at 7:40 P.M.
The Invocation was given by Rev. Clem Hammerschmitt, St.
Mark's Catholic Church, followed by the Pledge of Allegiance
to the Flag led by Councilman Robert Ferrell.
AGENDA APPROVAL
Mr. Cheney stated he would like to delete Item VII-D, which
is a development plan, at the request of Kieran Kilday. He
requested the deletion under Legal of Item A-l, since this
has to be advertised four consecutive weeks and Mr. Vance
suggested leaving this on the agenda and announcing the
postponement since it has been advertised.
Mr. Cheney continued that he would like to add two items to
the Consent Agenda relative to construction trailers. One
request is for a construction trailer at 609 North
Railroad Avenue, which has been approved by the Building
Department. He advised a representative from MacDonald's
here this evening stated they submitted a request for a
trailer for temporary restroom facilities to use during
remodeling and they have already started work. He suggests
approval being given contingent on the Building Department
giving approval.
The City Manager then requested the addition of one bill
under Approval of Bills to Bruno Auto Center in the amount
of $2,370.03 for repairs to a garbage packer. Under Bids,
he requested the addition of the bid for beach decals for
the coming year. Under Development Plans, he requested con-
sideration of employing a traffic engineer for the planned
community development project located on the north side of
Woolbright Road just west of 1-95.
Vice Mayor zimmerman moved to adopt the agenda with the
corrections made, seconded by Councilwoman Zibelli. Motion
carried 5-0.

ANNOUNCEMENTS
Mayor Cassandra recognized the presence in the audience of
former Mayor and Councilman James Warnke, former Mayor Marty
Trauger and his wife, former Councilwoman Lyn Huckle, and
the son of former Mayor and Councilman Joe deLong, George
deLong and his wife.
Mayor Cassandra announced that City Hall will be closed on
Monday, May 26, 1986, in observance of Memorial Day. He
added that Memorial Services will be held at the Cemetery on
Monday, May 26, 1986, at 11:00 A.M. with the participation
of American Legion Post 164, American Legion Post 288,
V.F.W. Post 10150, V.F.W. Post 5335, and J.W.V. Post 440.
He welcomed everyone to attend to honor those Americans who
devoted part of their lives in the service of their country
and those who made the supreme sacrifice by giving their
lives.
Mayor Cassandra read a Proclamation proclaiming the month of
May as Recycling Month.
The Mayor announced a special City Council meeting will be
held on Tuesday, May 27, 1986, with the capital improvements
architects.
The City Manager announced the City Council will be holding
a special joint meeting next Thursday with the Community
Redevelopment Agency at 7:30 P. M. Mayor Cassandra
suggested that the public attend as it might be interesting
to see the downtown plans and how the redevelopment is
moving ahead. Mr. Cheney referred to Bud's Chicken building
on Boynton Beach Boulevard and stated this shows development
can take place in accordance with design guidelines.
CITY MANAGER'S REPORT
Aluminum Recycling Supporting WXEL's New Facilities
Mr. Cheney referred to Reynolds Aluminum making a donation
to WXEL from their collections during May and announced
there will be a slight adjustment in the hours the recycling
center will be open. For the first week, after May 22, it
will be open in the mornings from 9:30 A.M. to 12:30 P.M.
Effective June 3, it will be open in addition to the mor-
nings from 1:00 to 5:00 P.M. on Tuesdays through Saturdays.

County Charter Advisory Committee Hearings
Mr. Cheney announced a County Charter Advisory Committee
Hearing for this area will be held tomorrow night at Delray
Beach City Hall.
Planning & zoning Board Workshops
The City Manager referred to the Planning & Zoning Board
holding the first of three workshops for the comprehensive
plan evaluation and appraisal report today at 4:00 P.M. He
stated it was a good session with beginning the revision of
the plan and development of a new comprehensive plan and
suggested that people come to listen.
Mayor Cassandra announced the City Manager's report would be
accepted as presented.
PUBLIC AUDIENCE
Hands Across Palm Beach County Program
Mr. Jim Peterman, 1515 S. Flagler Drive, West Palm Beach,
stated he was the Chairman of the Program of Hands Across
Palm Beach County. He realizes there have been some con-
cerns about liability, but explained how this was different
with not attempting to have a human chain of people from one
end of the county to the other. The purpose is to capture
the spirit to show concern of American for American. He
explained how they are intending to observe all traffic laws
and take safety precautions. They have gone before the
County Commission and other municipalities and resolutions
have been granted and he is before this Council asking for
affirmation and approval for this effort for the citizens.
Councilman Hester clarified that he was just asking for a
resolution and Mr. Peterman agreed that he was requesting a
resolution or proclamation. He added that there was no need
for extra police officers and this is just for people to
turn out and join the spirit of holding hands and caring.
Mr. Cheney clarified that the human chain was not being
planned because of traffic and safety problems. He
understands it is going to be people gathering here and
there on sidewalks and hopefully contributing a few dollars
to support the food program. He doesn't think extra police
will be needed and doesn't think we will have a liability
problem if we don't formally sanction it.

Councilwoman zibelli referred to the newspaper noting a $10
fee and asked if that has been changed and Mr. Peterman
replied affirmatively and explained they have tried to
follow the guidelines of the national, but are different
with no human chain and asking for a donation of 10¢ to $10.
He added that 90% of the money will stay in Palm Beach
County.
Mr. Peterman announced this will be held on Sunday, May 25,
at 3:00 P.M. People should be in line on the east side of
U.S. 1 at 2:30 P.M. with radios. The Council indicated
their support of this and the Mayor wished them good luck.
Request to Eliminate Additional Parking Required at Boynton
Leisureville Clubhouse
Mr. Wilbur J. Lynch, 1912 S.W. 16th Avenue, President of the
Boynton Leisureville Association, requested help from the
Council in reference to a building problem. He told about
obtaining a building permit to construct a small bathroom in
the existing clubhouse and complying with all the code
requirements with the exception of adding 70 additional
parking spaces. He explained how this could only be
accomplished by taking at least one half of their present
golf course facilities and how 90% live within walking
distance with the present parking spaces being adequate. He
continued with expressing appreciation for the city services
extended to them, but explained how they provide services to
the community with having their own security, mowing grass
on city rights-of-way, paving their own streets, and
supplying many volunteers. He stressed that they are trying
to enhance their lifestyles and are not going to increase
the usage of the clubhouse with additional rooms.
Councilwoman Zibelli referred to the Council not'being able
to grant a variance for something like this and stated it
would have to go before the Building Board of Adjustment &
Appeals. Vice Mayor Zimmerman referred to it being con-
sidered a parking lot variance and Mr. Annunziato clarified
that it is under the zoning code. Mr. Cheney clarified that
it can be varied by the Board of Adjustment if it is a
hardship. The added parking spaces are not related to the
small amount of square footage being added, but the code
states if the square footage is added, the parking lot must
be brought up to current standards. Mayor Cassandra
referred to the outer walls being there and Mr. Cheney
informed him that usable building space is being added.

Councilman Ferrell asked how much usable building space is
being added and Mr. Lynch replied less that 1,000 square
feet.
Mr. Lynch asked if they must apply to the Board of
Adjustment for a hardship variance and Mayor Cassandra
replied affirmatively and explained the procedure.
Paul Sheridan Lawsuit
Mr. Bob Fauser, P. O. Box 1042, Boynton Beach, referred to
the newspaper reporting the lawsuit of Patricia Adams
against Paul Sheridan had been settled and asked if it was
proper to discuss this. Mr. Vance informed him the paper-
work is in control of the insurance carrier and he doesn't
know if it has been completed. He suggests not discussing
it at this time.
League of Women Voters' Study
Ms. Lois Rush, 28 Colonial Club, told about the League of
Women Voters studying the organization and responsibilities
of various city departments and boards. She expressed
appreciation for the assistance given by all the staff and
Councilmembers. She told about the staff being most
cooperative. She stated they hope to compile the infor-
mation they gathered, so the club members will be able to
use it as reference material and~provide background infor-
mation, so they can take positions on matters before the
Council. She extended thanks for the splendid cooperation.
Neighborhood CleanuR
Mrs. Ernie Segers, 711 N.W. 2nd Street, expressed thanks for
the light being installed at the dead end of her street.
She referred to cleaning up this street and told about
cleaning up the alley behind her house, but had been unsuc-
cessful getting someone to pick up the trash. Mayor
CaSsandra replied that the City Manager will make an effort
to get this cleaned up.
Mrs. Segers then told about cars trying to go through sand
at the end of the street to the church. Mr. Cheney asked if
this is a street which should be paved and Mrs. Segers
replied affirmatively and that it should go through to the
New Mount zion Missionary Baptist Church and be paved to the
next street. Mr. Cheney agreed to have this looked at.

Approval requested to locate a temporary construction
trailer at 609 North Railroad Avenue and at MacDonald's
Restaurant on South Federal Highway. Councilwoman Zibelli
questioned what the trailer was for at 609 North Railroad
Avenue and Mr. Cheney informed her it was requested by Steel
Structures for the construction of additions and alterations
to Boynton Restaurant Supply.
Councilman Ferrell made a motion to approve the Consent
Agenda, seconded by Councilman Hester. Mayor Cassandra
clarified the motion covers the Consent Agenda with the
additions as added by the City Manager and Items A-l; B-1
and 2; C-l, 2, 3, 4, 5, 6 and 7; D-l, 2, 3, 4 and 5; E; F,
including the vehicle repair; and G with the stipulation
that all paperwork is proper. Motion carried 5-0.
BIDS
Bid Waiver - Congress Avenue Tree Planting
Mr. Cheney clarified that technically this is not a waiver of
bids in that the money being spent is private contributions
from property owners adjacent to Congress Avenue. He read
the list of developers contributing and explained the loca-
tion.
Mayor Cassandra asked if a sprinkler system would be
included and Mr. Cheney informed him that we are hoping to
do it without a sprinkler system, but sleeves were put under

the pavement if it is necessary to install one-for main-
tenance. Vice Mayor zimmerman asked if there is a sprinkler
system south of there and Mr. Cheney replied negatively.
Councilman Ferrell made a motion to waive the bid process
for this planting, seconded by Councilman Hester. Motion
carried 5-0.
Approval of Beach Decal Bid
Mr. Cheney stated the bids were received for 16,000 beach
decals and the same bidder we had last year gave the low bid
and it is within budget. The Tabulation Committee recom-
mends awarding the bid to Semes Enterprises in the amount of
$1,120. Councilman Ferrell made a motion to accept the bid,
seconded by Councilman Hester. Motion carried 5-0.
PUBLIC HEARING
Consider request for the abandonment of a 40' local
street south of Boynton Beach Boulevard between Seacrest
Boulevard and S.E. 1st Street (Sawyer's Addition). This
request was submitted by Peter L. Cheney, city Manager
for the City of Boynton Beach.
Mr. Annunziato referred to this request being related to the
city's redevelopment efforts and explained this street is
located between the Recreation Department and the Library
and is primarily a parking lot now. In order to effect the
Library reconstruction, it will have to be taken out of ser-
vice as a public right-of-way. There are utilities located
in this right-of-way and the architects must work with the
utility companies to make sure their needs are addressed.
The Planning & Zoning Board unanimously recommended approval
of this request subject to staff comments.
Mayor Cassandra ascertained nobody wished to speak in
reference to this application and then closed the public
hearing.
Councilman Hester moved to approve this request for abandon-
ment of a 40' local street, seconded by Councilman Ferrell.
Motion carried 5-0.

Consider request for the abandonment of a 40' local
street within the public works complex, between N.E. 1st
Street and the east line of lot 140 of Arden Park. This
request was submitted by Peter L. Cheney, City Manager
for the City of Boynton Beach.
Mr. Annunziato informed the Council this is a portion of
N.E. 8th Avenue which lies totally within the public works
complex. The utility companies reviewed this and there are no
encumbrances in the right-of-way. The Technical Review
Board recommended approval and the Planning & zoning Board
submitted a positive unanimous recommendation to grant.
Mayor Cassandra asked if anyone wished to speak in favor or
against and received no response. He then closed the public
hearing.
Mr. Cheney clarified that this entire area is within the
fenced area of the public works complex.
Councilman Hester moved approval of this request, seconded
by Councilman Ferrell. Motion carried 5-0.
DEVELOPMENT PLANS
The Landings - Fire Sprinkler Problem request by
Attorney Alan Ciklin
Mr. Alan Ciklin, attorney representing the developer of The
Landings, stated this matter resulted from city code 9-18,
which requires a sprinkler system to be installed in any
wood frame building over two stories or 20 feet in height.
That code provision was adopted in 1973, but wasn't readily
used by the city in the past. The developer had incurred
substantial expense with drawings approved before this was
discovered. He has met with Mr. Cheney and Mr. Vance and
they determined the best way to conclude this matter was to
appear before the City Council.
Mr. Ciklin read according to Section 9-18, all wood frame
buildings and structures which are two stories or less in
height are not required to have sprinklers. He feels there are
many reasons why this code provision should not apply. He
explained how practical reasons had changed since 1973 with
the water distribution system being improved, fire hydrant
system not what it was, and additional fire staff.
Additionally, building codes have been continually updated.
Also, from a legal standpoint, Section 9-18 adopted in 1973
happens to be in conflict with the code provision in effect.
The Standard Building Code has the requirement with more
than three stories. Also, the N.F.P.A. codes also require
over three stories. Both modern and up-to-date codes are in
conflict with the 1973 provision. In addition, in 1974, the

State Legislatur'e enacted a state-wide building code and the
city adopted the Standard Building Code which has the provi-
sion requiring sprinklers for buildings of more than three
stories.
Mr. Ciklin continued that the problem they are faced with is
a real life one and doesn't relate to fire safety require-
ments. Their problem is to retrofit the buildings which
have been issued permits and are under construction. It
will cost the developer $300,000 to $500,000 and will take
two to three months to stop and go backwards to retrofit the
buildings. In addition, materials were used for fire pre-
vention. This time and money were not committed in the
funds of the bond issue.
Mr. Ciklin concluded that they think from a legal, practical
and fairness standpoint, this old section of Code 9-18
should be done away with. He would be pleased to answer any
questions.
Mayor Cassandra questioned when this was brought to the
developer's attention and how much construction had been
done. Mr. Cheney stated this was first discussed with the
developer of Metro around March 10 to 14, when doing the
framing inspection of the buildings. There was no difficult
retrofit problem at that time. At the same time, it was
also discussed with the developer of The Landings.
Discussions did take place fairly early before there would
have been major financial problems. Mr. Ciklin agreed he
was aware of that, but unfortunately they have building per-
mits for the entire project and a lot are under construc-
tion.
Mr. Ciklin clarified that the real issue is what the
appropriate code is today and they think the modern code
should prevail.
Mayor Cassandra referred to wooden structures recently
coming in our area and stated he still thinks they should
have sprinkler systems.
Mr. Vance advised that he received a letter from Mr. Ciklin
yesterday referring to the fact that a special act was
adopted in 1974, which may have in fact wiped out all the
ordinances both the county and various municipalities
enacted prior to that date which conflicted with the special
act establishing the Standard Building Code approach to Palm

Beach County. Our code provision was adopted in 1973 prior
to adoption of the special act. Councilman Hester clarified
that we adopted the Standard Building Code, but still
retained the section of our code requiring a sprinkler
system.
Mayor Cassandra asked if we decided to update and modify our
sprinkler code, could we stop any new permits until this is
done and Mr. Vance replied negatively.
Vice Mayor Zimmerman referred to a variance from the code
being referred to the Building Board of Adjustment & Appeals
and Mr. Cheney pointed out this is not in the building code,
but is a requirement by ordinance.
Mr. Cheney clarified that the City Attorney is saying this
condition is not on the books. This was wiped off the books
by the Legislature.
Councilman Ferrell referred to a lot of improvements being
made since 1973 and different things being required from
developers. Councilwoman Zibelli stated she would still
like to see a sprinkler system eventually and Councilman
Ferrell replied that he might tend to go along with that,
but must consider the staff's recommendations and they say
it is not needed. Vice Mayor zimmerman referred to the
importance of safety and Councilman Ferrell agreed and
pointed out this has been done by charging people to add
more loops in the water system and we have additional fire-
men. Further discussion ensued regarding safety and impro-
vements made.
Mr. Vance clarified there are two approaches and explained
how legislative action in effect repeals certain specific
statutes. The other approach would be to adopt an ordinance
repealing that section and the Council could consider
whether to adopt additional legislation in that area which
would be subsequent to the special act.
Mr. Ciklin clarified that sprinkler systems are required in
buildings of three stories or more. In two story buildings,
generally it is easier to escape, he randomly polled
several local municipalities and could not find any who had
changed the provisions from the Standard Building Code.
Councilman Ferrell stated we have adopted the Standard
Building Code and the staff must have considered it to meet

our standards. Mr. Vance added that we were also required
to do that by a state act.
Councilman Ferrell referred again to the safety factor and
cost and Mayor Cassandra remarked that even with the UL
rating of a wall, they do burn and melt.
!Vice Mayor Zimmerman referred again to this not being part
of the building code in reference to applying for a variance
and Mr. Cheney agreed, but explained they were together
under the point of view of the State Legislature's action.
Mayor Cassandra asked if the time delay getting a clarifica-
tion would create a problem and Mr. Ciklin replied they have
been waiting to come back before the City Council and have
incurred a time delay of four weeks.
Mr. Vance suggested if the Council decides we have a legal
problem with Section 9-18 as it' now exists, the city should
mechanically clean that section up by adopting an addendum
to the existing code or by repealing it. Councilman Ferrell
referred to it already being automatically repealed and Mr.
Vance clarified that he doesn't believe it is enforceable,
but that doesn't get it out of the code.
Councilman Ferrell made a motion to repeal this section to
cover what we didn't do in 1974. Mr. Vance clarified that
this motion would direct his office to prepare an ordinance
for repealing Section 9-18 and Councilman Ferrell agreed.
Mr. Vance further clarified that if repealed, we would still
have the three story requirement with the Standard Building
Code. It would clean up the code book with an ordinance
repealing it. Councilman Hester seconded the motion. Under
discussion, Mr. Cheney pointed out the Standard Building
Code requires sprinkler systems in more than three stories.
The Council still may want to pass a motion or may want to
follow up on another motion to amend the Standard Building
Code. Councilman Ferrell clarified that his motion now is
to make it comply with the Standard Building Code.
Vice Mayor Zimmerman asked if these projects being con-
sidered are over two stories and Mr. Cheney informed him The
Landings has two stories with a peak and Mahogany Bay is
three stories. Vice Mayor Zimmerman asked if they are under
the Standard Building Code and Mr. cheney clarified they do
not require sprinkler systems by the Standard Building Code,
as they must be over three stories.

Mayor Cassandra clarified that the motion on the floor is to
direct the City Attorney to repeal Section 9-18. After this
motion is acted upon, if the Council wants to make an adden-
dum, they can bring it back down to 20 feet. These two
developments will slide through.
Motion carried 3-2 with Mayor Cassandra and Vice Mayor
Zimmerman dissenting.
Councilwoman Zibelli made a motion to amend our existing
addendum that we shall have sprinkler systems on wood frame
structures over two stories. Councilman Ferrell seconded.
Under discussion, Mr. Vance asked if this would apply to
everything or multi-family and Vice Mayor zimmerman replied
to multi-family. Councilwoman zibelli stated for safety
sake, it should be required for regular homes. Councilman
Ferrell referred to the extra costs required to build a home
and stated the staff gave a report this is not needed.
Councilwoman Zibelli stressed the importance of safety of
life.
Mr. Cheney requested that Type VI construction be substi-
tuted for wood frame, which is an all wood building. Mayor
Cassandra referred to some buildings having the first floor
of concrete and then going to wood and Mr. Cheney informed
him that Mahogany Bay is all wood, Type VI. Councilwoman
zibelli agreed to change it to Type VI.
Mayor Cassandra clarified that the motion is to direct the
City Attorney to make an addendum to our sprinkler code to
state all Type VI buildings of greater than two stories will
have a sprinkler system.
Councilman Hester stated he is interested in safety, but we
are under the Standard Building Code which says three
stories. He does not see why we should vary that much.
Construction materials are being improved each year.
Councilman Ferrell added that for the sake of one story, he
finds it hard to question. The staff feels the Standard
Building Code is adequate. He doesn't think we are taking
any safety away. Vice Mayor Zimmerman added that he is
satisfied with what we have now, the old code.
Mayor Cassandra clarified that the motion is to direct the
City Attorney to make an addendum to the fire and sprinkler
code to include Type VI construction of more than two
stories. Motion carried 3-2 with Councilman Hester and
Councilman Ferrell dissenting.

vened the meeting at 9:15 P.M.
Consider request for height exception for church steeple
- Boynton Beach Congregational United Church of Christ,
115 North Federal Highway - Total height 55 feet.
Mr. Annunziato informed the Council this request came from
the Technical Review Board which determined there were no
site related issues with this request. This request is con-
sistent with Section 4-F and the church spires exception.
Mr. Craig Livingston, Architect for Boynton Beach
Congregational United Church of Christ, stated they feel
this would be a good contribution to the~downtown district
and dress up the building. They hope this steeple will be
allowed on the building.
Mayor Cassandra explained the procedure for a height excep-
tion. Vice Mayor Zimmerman referred to approval by the
Downtown Review Board and Mr. Cheney informed him that Mr.
Livingston has attended the Downtown Review Board meeting
and they supported this and the Community Redevelopment
Agency also expressed support.
Mayor Cassandra questioned why it had to be so tall and Mr.
Livingston replied that in looking at spire designs, it is a
descending dimension and as it goes higher, it gets smaller.
Mayor Cassandra asked if it would be lighted and Mr.
Livingston replied negatively.
Councilman Hester moved to approve this request for height
exception for this church steeple for the Boynton Beach
Congregational United Church of Christ at 115 North Federal
Highway. Vice Mayor Zimmerman seconded. Under discussion,
Councilman Ferrell commented that we may get a lot of these
and must give equal consideration to others which come up.

Consider request submitted by Kieran J. Kilday, agent
for The Building Company, for approval of an amended
site plan to allow for the addition of a 40,000 square
foot supermarket to the rear of the existing shopping
center, a revised shared parking allocation, and a
change in parking lot layout and design. This site is
located on Federal Highway at Woolbright Road, the
southwest corner.
Mr. Annunziato explained the location. He added that the
second aspect is for approval of a shared parking allocation
based upon our proposed ordinance. This request went to the

Planning & zoning Board with a positive recommendation from
the Technical Review Board. The Planning & zoning Board
recommends approval subject to staff comments. Also recom-
mended was the addition of right turn lanes at two main dri-
veways onto Woolbright Road.
Mr. Annunziato continued that one other item of concern is
the median which is supposed to be constructed from the
southwest corner. That landscaped area must be there to
direct traffic northward. Upon closer review, the applicant
found there is a garage door which serves a store there.
The applicant is going to request a change in the con-
figuration of the median and move it westward, which will
affect some of the landscaping, but it should work all right
as long as the median is there to direct traffic northward.
The recommendation is both requests be approved.
Mayor Cassandra expressed concern about the driveway in
front of the theater with traffic going through to Publix
and people coming out of the theater. Mr. Annunziato
informed him there is a stop sign and speed bump and people
should be directed to the walkway.
Ms. Glenda Haley, Kilday & Associates, advised they did work
with that congested area where the median strip is and have
aligned it better. Mr. Vance asked if she concurs with the
two driveways onto Woolbright Road and Ms. Haley replied
affirmatively.
Councilwoman Zibelli made a motion to approve this request
submitted by Kieran Kilday for approval of an amended site
plan to allow for the addition of a 40,000 square foot
supermarket at Sunshine Square, a revised shared parking
allocation, and a change in parking lot layout and design,
subject to staff comments and the comments from the Planning
& Zoning Board. Councilman Ferrell seconded and the motion
carried 5-0.

DEVELOPMENT PLANS (Continued)
Consider Employing Traffic Engineer
Mr. Cheney told about there being concern about needing
traffic engineering consultant work particularly in connec-
tion with the hearing coming up on the PCD which has an
impact on Woolbright Road and traffic in general and adja-
cent to that area. He has discussed this with Mr.
Annunziato and Mr. Vance. They think it would be a help to
hire a traffic engineer for under $1,500 to review the stu-
dies which have been presented by this applicant in this
particular case and assist the Planning Department in making
a recommendation. The whole issue of traffic on Woolbright
Road is a problem both existing and in the future. He enu-
merated reasons for trying a traffic engineer on this pro-~
ject to see whether it is useful.
Mr. Cheney advised that Mr. Annunziato has talked to several
Traffic Engineers and the recommendation is to hire Mr. Walt
Keller, who has worked with Broward County and done a lot of
work for Palm Beach County. He could be tried on this par-
ticular project as the finished report is needed in one
week. The charge would be $600 and Mr. Keller will come to
the Planning & Zoning Board and City Council when the issue
is presented. Mr. Vance stated that he concurs with the
City Manager's recommendation. Mr. Annunziato gave some
additional information about Mr. Keller's background.
Mayor Cassandra asked if the recommendation was to try Mr.
Keller out and then retain him and Mr. Annunziato clarified
this is just a one shot deal. Mr. Cheney added that we must
decid~ whether to do this work through a consultant or
through several consultants or have a Traffic Engineer on
staff. Vice Mayor zimmerman clarified that this project
would not exceed $1,500 and Mr. Cheney agreed with the basic
study and attending five to six meetings.
Councilman Ferrell made a motion to approve this request,
~seconded by Vice Mayor Zimmerman. Mayor Cassandra clarified
!that the motion is to hire this consultant for a single pro-
ject at a cost not to exceed $1,500. Motion carried 5-0.

OLD BUSINESS
Consider proposal to employ lobbying services as a joint
agreement with other Palm Beach County cities (Tabled)
Councilman Ferrell requested this to be left on the table.
Mayor Cassandra referred to the possibility of a city not
agreeing on an issue for lobbying and Councilman Ferrell
explained the money would be paid in the form of dues in
advance and votes would be taken upon issues.
Florida League of Cities - Requested by Councilman
Robert Ferrell
Councilman Ferrell referred to forwarding a memo in regard
to the action taken at the last City Council meeting and
made a motion that the City Council rescind the action which
was taken at that Council meeting in regard to the reimbur-
sement of his expenses for a trip to Tallahassee.
Mayor Cassandra stated he called the City Attorney to be
sure no parliamentary procedures were negated and asked him
to clarify the paragraph on Page 258. Mr. Vance clarified
that there appears to be no limitation on a motion to
rescind. Any member may make the motion. He then read the
paragraph from Roberts Rules of Order in reference to a
motion to rescind.
Mayor Cassandra referred to a conflict of interest because
of this being a monetary decision and the person involved
can lose or gain. Councilman Ferrell advised the expenses
were paid by the city before he went. Mr. Vance clarified
that actually the statute relating to a conflict of interest
specifically does not apply to a voting member when relating
to salary or expenses. Councilman Ferrell asked if that
meant he could not vote and Mr. Vance disagreed with
advising that he can vote.
Mayor Cassandra clarified that a motion was made by
Councilman Ferrell to rescind the action of the Council of
May 6. Councilman Hester seconded. Under discussion, Mayor
Cassandra requested everyone to speak just once. Councilman
Ferrell replied that having it done while he was not here
and being brought up by the Mayor, he chooses to do it
without discussion; but if the Mayor chooses to comment, he
would prefer to comment after him. Mayor Cassandra referred
to the maker of the motion speaking first, but agreed as
long as the decorum is kept in the proper sense, he sees no
problem.

Councilman Hester stated when he voted on this, he was not
aware it had been voted on in 1984 that persons on these two
committees would have their expenses paid for by the city.
From his understanding and reading of the minutes, those two
positions going to the Florida League of Cities on those two
committees did not have to have approval, as it was given in
1984. The reason he voted against it was because he did not
know this. With finding out it was voted on by the previous
Council that expenses were to be paid because of being on
the type of committee which is on call and not having time
to approve prior to going to a meeting. He was not apprised
about this at the May 6 meeting. He is sure somebody knew
about it that the expenses were to be paid.
Vice Mayor zimmerman suggested as a future policy, it would
be good to have those things clarified as Councils change,
just as we always adopt a certain procedure when a new
Council takes office. When committees carry over like these
for a number of years, he thinks the approval of those
expenses ought to be up to the Council sitting at that time.
There is a question in his mind whether this Council has
actually approved that and he doesn't believe it has.
Mayor Cassandra clarified that obviously everyone received a
memo from Councilman Ferrell making some statements and
innuendoes and several implications about his character.
The memo doesn't deserve any answer on his character nor
would he imply anything nasty about Councilman Ferrell's
character. The question of policy should be addressed.
What is policy - was it changed to a carte-blanche approval
to go to any meeting you want? If there was a policy direc-
tion, was it only for a special condition? For this special
condition, was there any commitment? In the memo, reference
was made to November 20, 1984 and at that time, it was not
necessary to ask approval of expenses for appointees to
Florida League of Cities committees. He then read a ver-
batim excerpt from the minutes of November 20, 1984. He
pointed out that the summary supplied from that meeting is
not what the verbatim excerpt says. He clarified that then,
there was no policy carte-blanche and Councilmen Wright and
Ferrell were appointed to a committee. It is his opinion
that no policy was made to go to any meeting without
Council approval; no carte-blanche approval. Was there a
special condition to policy - yes, if a meeting was between
Council meetings and unable to get Council approval, then
Council approval was not needed. Remember - Councilman
Ferrell was on the Personal and Ethics Committee. Was there a

stipulation to special conditions? He thought his question
of would he be here was a stipulation. Was there any com-
mitment on his part to the Florida League of Cities - he
stated in the minutes there wasn't any.
Mayor Cassandra continued with referring to how important an
issue is and stated if every Council member predecided what
was an important issue to see and whether to be here, there
would be chaos. Every question that comes in front of this
city Council that requires a vote is important. Some
require no discussion, some require little discussion and
some require heavy discussion. It is important to hear the
opinion of all Council members. It is impossible to see
into the future and say this or any particular issue is a
simple routine; that this issue is not important. On that
particular night, as reported by the newspaper, Delray had a
simple unimportant routine issue before the Council and the
issue failed for lack of a second because Delray did not
have a full Council; two of their Council members were in
Tallahassee. Because of this, this simple issue would have
cost Delray only $2,000; but because of an incomplete
Council, it cost Delray $6,000. This issue was decided by
someone as what was important and what was not important.
It is his responsibility as Chairman and Mayor of this City
to make sure what happened in Delray never happens in
Boynton Beach. It is his responsibility to make sure that
no issue is delayed and results in a loss because of insuf-
ficient Council members. On the May 6 agenda, there were
two issues, in his opinion as Chairman of this Council,
which were important - reverse osmosis consultant as it will
be their recommendation that will determine how we will
spend approximately $10,000,000 and to him, it was important
to make sure that we have the best consultant. As noted on
tonight's agenda, the sprinkler system was supposed to have
been on May 6 and that' issue was also important with
involving the safety of buildings and people, plus will
control the type of construction that will be allowed in
Boynton Beach. Because of the possibility of a tie vote and
the importance of the City of Boynton Beach, he wrote a
letter and requested Councilman Ferrell that he change his
priorities and be at the Council meeting. It seems to him
that protocol and courtesy would have deserved an answer one
way or another. This lack of an answer could only lead him
to the conclusion that the Florida League of Cities meeting
was more important than the City Council meeting and its
issues.

The Mayor continued that on May 6, Councilman Ferrell did
not attend a Personal and Ethics Committee meeting according
to his minutes, but went to a Growth Management Committee
meeting, which was not even approved. If there was a carte-
blanche approval for that committee in 1984, then there pro-
bably would be no question, but that is not what he went to.
He has the dates of all the Florida League of Cities
meetings and when the Personal & Ethics Committee met, which
is Councilman Ferrell's committee. That committee did not
meet May 6 according to the Florida League of Cities
records.
Mayor Cassandra stated it is still his responsibility to
this City and to this Council that this is still an
unauthorized expense and unauthorized trip. The 1984
meeting did not say carte-blanche approval had been given,
but specifically stated certain items. As far as he is con-
cerned, this question to rescind still should be denied.
Councilman Ferrell stated that on May 6 all standing commit-
tees of the Florida League of Cities met in Tallahassee and
a notice was distributed in City Hall. There was no Growth
Management Committee meeting that he knew of. The Growth
Management Committee met Wednesday night, which he attended
as soon as he ~ot back from Tallahassee, which was a public
hearing at Delray Beach Atlantic High School.
Councilman Ferrell stated expenses were approved under an
old policy long before he was on this Council. Carte-
blanche approval was not given; approval was given to attend
committee meetings because the commitment required from the
League of Cities is if you are going to be on a committee
that you will be able to attend the meetings. He thinks the
key thing is, until the time he got miffed because he did
not answer the memo, he has been doing it for two years. He
has routinely been attending the meetings when they
come up, the League meetings, conferences. The conferences
were brought up for approval, but the committee meetings
were not. Councilman Wright and other people have attended
those meetings routinely because of the nature of the
meetings.
In reference to predeciding what is important, Councilman
Ferrell thinks that should also apply to the Mayor. He
doesn't think the Mayor should predecide what is important
to any one Council member. Some of the issues which have
come up at Tallahassee, which he has spent hundreds of hours

attending, have to do with our own issues such as the pen-
sion plans for fire and police and taking them literally out
of control of the City Council, and other issues which are
of equal importance if not more important than what was
being discussed that particular evening. To preclude a per-
son from going out of town - where do we stop - vacation
next and not being able to go on vacation because someone
thinks there will be a tie vote. He thinks that is an
unreasonable approach. He didn't go there to play games,
but has gone to represent this City and issues that are
extremely important. He agreed that Delray had two members
in Tallahassee, but the motion failed because their attorney
ruled the Mayor could not pass the gavel to make a motion,
like the Mayor did here with making a motion to not pay the
expenses for his trip. It did not cost Boynton Beach
anything because he went to Tallahassee. There were pro-
bably in the vicinty of 100 elected officials in
Tallahassee, which indicates with Tuesday being a popular
meeting night that the other cities with representatives had
their interests at heart and attended.
Councilman Ferrell referred to the possibility of a tie vote
and stated that possibility exists all the time. He doesn't
think that is a good argument. City Hall knew he wasn't
going to be here; there was no question or problem with com-
munication.
Councilman Ferrell stated that we should address it from
this point forward. It has been discussed and done this way
and minutes can be interpreted as wanted. It would be dif-
ferent if he had snuck out and sent a bill to the City,
which was definitely not the case. He doesn't think it
merits a whole lot of discussion and would like to have the
question called.
Mayor Cassandra requested to make a statement and Councilman
Ferrell reserved another one then. Mayor Cassandra stated
the question here is simple - did you have authorization or
did you not have authorization; there was no standard appro-
val to the committee by the 1984 Council and prior to that.
He referred to Councilman Wright also having to get approval
and there was also the request by a former Councilman that
we should know ahead of time so the Council can submit their
comments. If he wishes to call the question, then call the
question.
Councilman Ferrell responded that he thinks that point needs
to be cleared up, that technicality. The Mayor is referring

to a policy and he doesn't know if any of us were here when
the policy was passed to begin with. Mayor Cassandra
replied that he was here and Councilman Ferrell disagreed,
not the original policy to have to answer to him or someone
else as to where he goes, that was four or five years ago.
In reference to the committee thing, the Mayor interpreted
it his way when it was brought up and the discussion was
committee meetings may come at times when it is inconvenient
to get Council approval. Councilman Ferrell stated that it
has been a procedure and there was no problem with it until
he chose not to obey the Mayor's orders and show up for a
meeting. Mayor Cassandra remarked that he had never missed
a Council meeting! Councilman Ferrell continued that he has
attended those meetings and some have been without bringing
up before Council for approval because they were committee
meetings. Mayor Cassandra commented that five wrongs do not
make a right. Councilman Ferrell replied that is not the
issue, he has known it and approved the expenditures. Mayor
Cassandra clarified that he knew it and also when exceeding
$1,000, it is part of policy to obtain Council approval.
Councilman Ferrell suggested addressing this policy.
Mayor Cassandra clarified that the question in front of this
Council is a motion made to rescind the Council decision of
May 6. The motion made by Councilman Ferrell is to rescind
the action of May 6. Motion failed 2-3 with Councilwoman
Zibelli, Vice Mayor zimmerman and Mayor Cassandra
dissenting.
Councilman Ferrell stated the question now is the fact that
the expenses are already paid - what is it the Council would
like now? Mayor Cassandra replied that is not his decision.
Councilman Ferrell clarified that he is posing this question
to the Council. The City Council authorized him to be a
member of that committee. Vice Mayor Zimmerman questioned
how long this authorization goes on - five years from now or
when? Councilman Ferrell replied that the question Which
exists is how long the original policy, that was insti-
tuted back some years ago, will be going on with expenditures
being approved by the Council, which we have always done,
but made an exception with the committee appointments.
There was never any reason to change it. Vice Mayor
zimmerman questioned how long this committee would be in
operation. Councilman Ferrell replied that there was never
any reason to change it because there was no problem,
because it had been done in the past and was an accepted
procedure by the Council.

Councilwoman Zibelli suggested so we don't get into this
problem again in any way, shape or form, that we do set a
policy.
Mayor Cassandra clarified that the original question from
Councilman Ferrell was how to pay back or does he pay back.
Councilman Ferrell asked if the Council was asking him to
pay back for attending a committee meeting on city business?
Vice Mayor Zimmerman replied that it has been done before.
Councilman Ferrell asked if someone wanted to make a motion
to that effect and Mayor Cassandra replied that would imply
unauthorized. Councilman Ferrell continued that he did not
consider it unauthorized, but he does not intend to pay it
back. Mayor Cassandra clarified that he does not intend to
pay it back and Councilman Ferrell agreed because they all
approved for him to attend and the Mayor just got upset
because he did not respond to his memo and attend the
meeting. He is not going to pay to attend a meeting for
city business. Mayor Cassandra replied that he is making it
personal and Councilman Ferrell disagreed. Mayor Cassandra
stated this is a question which will have to be discussed at
another time. If Councilman Ferrell is not going to pay it
back, that seems to be a problem of Council's decision in as
far as they feel anything towards that type of statement.
NEW BUSINESS
Renaming Golf Course Access Road to "Joe deLong Memorial
Boulevard" - Discussion requested by Councilman Robert
Ferrell
Councilman Ferrell stated he had a request from a couple
residents who spoke about the possibility of renaming the
access road to the golf course to Joe deLong Memorial
Boulevard.
Councilwoman Zibelli referred to this being a county road
and Mr. Cheney clarified that this will be a city owned road
in the county; it will be deeded to the city and we will
maintain it.
Mayor Cassandra asked Mr. George deLong to come forward and
asked if he knew if Mrs. Grace deLong would have any pre-
ference and Mr. deLong replied that he thinks she would be
very happy. He expressed thanks for this consideration.
The deLong family feels very honored on behalf of his
father. He talked to Mrs. deLong about this and she feels

very touched about it. He suggested that probably
"Memorial" could be dropped and the road named just "Joe
~deLOng Boulevard". He wishes his father could be here to
see it, but the family is quite pleased.

iAccess Road to JOe deLong Boulevard, seconded by Councilman
iHester. Under discussion, Mr. Cheney commented that he
~assumes there would be no problem if a directional arrow to
ithe golf course was placed on the same pole. Motion carried

Consider appointing alternate member for Building Board
of AdjUstment and Appeals - Appointment to be made by
Councilwoman Dee Zibelli
Councilwoman Zibelli requested this to be tabled, seconded
by Councilman Hester. Motion carried 5-0.
Announcement of appointment of Chairman of Sign Advisory
Committee
Mayor Cassandra appointed Mr. Joseph Molina as the Chairman
of the Sign Advisory Committee. Mr. Cheney added that the
members will be called to find a convenient time for the
first meeting.
Consider annual street resurfacing program
Mr. Cheney referred to preparing a list of streets for
review by the Council each year and advised it was an over-
sight that the list was not included with the agenda
material. He showed a chart identifying the streets. He
requests the Council to review the list and note any addi-

tions or included streets which are not important. After
receiving the comments, there will be further discussion and
a priority list selected.
Request for donation to Santaluces Community High School
- Project Graduation
Mr. Cheney informed the Council this request was submitted
by one of the participants in Youth in Government Day. This
is what is going on now in the various schools. Project
Graduation is an all evening affair. In this case, they are
going to go on a Viking cruise for the evening. The total
cost is about $10,000. They have raised $3,500 through
Santaluces and are raising it in other places. They asked
if the City would help on this particular evening. They are
also going to the Town of Lantana and he urged them to go to
Commissioner Jerry Owens. The question is whether the
Council feels comfortable in supporting this kind of program
and how much. The students just asked for some help.
Vice Mayor Zimmerman referred to the other high schools and
Mr. Cheney replied that he suspects after this year, we will
probably hear from Lake Worth and Atlantic High Schools.
Mayor Cassandra referred to this event being non-alcoholic
and stated we have been pushing youth consideration. He
suggested possibly contributing $500.
Councilman Hester made a motion to go along with the Mayor's
suggestion to donate $500 to Santaluces for Project
Graduation, seconded by Councilman Ferrell. Motion carried
5-0.

Mayor's officer and anyone who wants to can go
