.Mayor Cassandra called the meeting to order at 7:32 P. M.
The Invocation was given by Rabbi Arthur Rosenwasser,
Congregation Beth Kodesh of Boynton Beach, followed by the
Pledge of Allegiance to the Flag led by Mayor Cassandra.
AGENDA APPROVAL
City Manager Cheney added under "V. BIDS" an emergency pur-
chase of a high pressure breathing air system. Under "VIII,
LEGAL", he added "B, 2", an Ordinance relative to building
construction requirements. A Resolution relative to Library
Funding was also added as "3" under "C. Resolutions."
Under "VIII. LEGAL, D. Other", City Manager Cheney deleted
"2. Approval of transfer - Group W Franchise".
Councilman Hester moved to approve the agenda with the addi-
tions and deletion, seconded by Councilwoman Zibelli.
Motion carried 5-0.

With reference to "c)", Mayor Cassandra believed the City
Manager would be starting very soon to force all City
employees to utilize seat belts. Dr. Greenberg, who proposed
the Proclamation, was in the audience and was recognized by
the Council.
2. Introduction of Two New Council Members
Mayor Cassandra introduced Councilman Hester and Council-
woman Zibelli and presented a cup cake and gift to Council-
woman Zibelli in honor of her birthday.
CITY MANAGER'S REPORT
Yachtman's Plaza
City Manager Cheney said the City has had some concerns
about Yachtman's Plaza and has held up issuing certificates
of occupancy until they could see some results. In response
to the citizens in the area, the City has installed "No

Parking" signs on the streets behind Yachtman's Plaza, as
they requested. The Plaza has hired young people from the
area to police the Plaza every morning and pick up litter
and trash on a regular basis. The dumpster on the north
side has been shielded by the Plaza, and the Plaza has
agreed to grant an easement along 15th Place so they can
place a fence along the back line of the Plaza property.
The fence will be paid for by the residents.
City Manager Cheney further reported that the Plaza has
replaced its sprinkler pumps and is in the process of repair-
ing the entire sprinkler system. The City built the little
piece of sidewalk, so the two pieces of public sidewalk tie
together. The Plaza has agreed to new landscaping, and it
meets the original site plan.
They are still working on agreements relative to J. W.'s
Lounge and the 67 Liquor Store and their problems but, in
general, George Hunt, Assistant City Manager, has been
getting some results. Based on this, City Manager Cheney
recommended that the City lift the moratorium on that part
of the Plaza which is on the south side, recognizing that
there is a good, potential tenant who has been waiting for
some time to go in there and has been paying rent along the
way.
T~ere are still some vacant stores on the north side, so
City Manager Cheney said there is still some value in keep-
ing the moratorium on the north side until the things they
were talking about are finished. A little piece of public/
City owned land is adjacent to the property on the south
side where the City put in the sidewalk. City Manager
Cheney gave the Members a memorandum and said they may want
to think about this. He suggested that maybe the City
should improve the piece of City land that is there just to
the east of the Plaza by sodding and irrigating it.
City Manager Cheney informed Mr. Hester that the Plaza has
a~ready started doing something and have been meeting with
the neighbors.
Vice Mayor zimmerman moved to lift the moratorium, seconded
by Mr. Hester. It was the concensus Of the Members that the
moratorium should be lifted.
Mayor Cassandra did not think a motion was needed because
a_motion had never been made. He asked if the people around
there were aware of the City's intentions. A man in the

audience answered affirmatively. City Manager Cheney
advised that the people keep Mr Hunt on the phone, and they

George Evans, Beach Supervisor, posted a chart on the side

probably do that on an annual basis.
Attendance at Beach
During February, City Manager Cheney said they probably had
t~e highest attendance they have ever had. There were five
d~ys when there were over 1,000 cars. The highest day was
1~353 cars in the middle of February. The following Sunday,
there were 1,335 cars on a 260 car parking lot. 200 cars
that wanted to pay $10 were turned away because they came
wlaen the lot was full.
Testimony on Health Maintenance Organizations (HMO)
)day Congressman Dan Mica and a Congressman from Virginia,
~o jointly were a sub-committee of the House of Representa-
ives, were taking testimony on HMOs. 75 to 100 people

C~Lty Manager Cheney thought Congressman Mica was happy with
tile way it was handled and that he could have that kind of
m~eting in his own city.
Evaluation and Appraisal Report of Comprehensive Plan
C~ty Manager Cheney anticipated that the Council would get
a copy of the E&A report by the end of the week, as will the
Planning and Zoning Board. It will go through the Planning
a~d Zoning Board for review in the months of April and May
and come back to the Council. It is a 200 page document

which was prepared mostly by Tim Cannon, Planning Department.
It will put forth a lot of work for the City and Council
between now and June. City Manager Cheney said it is the
foundation for beginning to develop the new Comprehensive
Plan which will have to be adopted by February, 1988.
Bridge Problem at End of Lake Drive
The State indicated that they have a potential safety
situation. City Manager Cheney said it will require some
cement pumping under one of the culverts. Barricades were
tentatively there, but they were taken down because the
bridge is safe. In the next few days, the City will be
repairing it.
Report Concerning Police Department Activities Relating
to Drug Enforcement
City Manager Cheney referred to newspaper articles and
citizens discussing problems of crime and drugs. Edward
Hillery, Police Chief, said 1½ years ago, when he first
became Chief, they spent endless hours waiting for boats to
come in on the Intracoastal so they could grab drugs at that
level. For two or three years they worked with the Sheriff's
Department and Federal Agencies in that kind of enforcement.
Chief Hillery wanted to change the focus to the street
related drug problems and local problems because they are
becoming very apparent now. We have robberies, assaults,
burglaries, and stoplight mugging. The image being built
by people who apparently were being very successful by break-
i~g and flaunting the law had a direct effect on the young-
sters of our City. Chief Hillery was talking about the dope
dealers and pimps.
Chief Hillery said the vast majority of offenders are using
drugs when they commit their crimes or are motivated to do
the acts to obtain funds with which to buy drugs. The
typical burglar spends a lot of his money for cocaine. He
usually does not have a job due to his drug use and must
resort to crime as a means of maintaining a living. Cocaine
is now sold in rock form. It is not uncommon for a teenager
or young adult to use five rocks a day. Rocks sell for
about $20 each, so the typical habit will cost its owner
$~00 a day. When you convert that into stolen property
f~nced at 10% of its value, you are talking about a theft of
$~,000 .a day to support just drugs, not taking into consider-
ation living expenses.

Chief Hillery said the user has two ways to meet the
staggering price of drugs, and they are to steal or deal.
The media has been covering the cocaine epidemic Palm Beach
County is experiencing, which has come north from Miami and
is costing the citizens of Boynton Beach "lots of bucks".
Chief Hillery informed the Council that the non-user, small
habit dealer, or dealer who has three or four sellers work-
ing for him is earning a great deal of money. The profit
is what motivates these people. The product looks like
small rocks from the top of a gravel roof and can be thrown
into the sand or gravel of the street with very little
chance of being recovered by the Police. This makes it
difficult to effect an arrest on the typical street dealer.
The average street dealer usually stays at home. He is
wary and alert to his surroundings and is always ready to
get rid of his wares upon the approach of a Police car. He
will deal with drugs and rip off gold chains from the very
people who come into his area to buy drugs. When he cannot
make a sale, he will turn to purse snatching from the elderly
or will occasionally stick up a convenience store.
Chief Hillery estimated that about 66-2/3 of the 3,400
Part I crimes reported last year were attributed in some
degree to the use or sale of cocaine. Part I crimes are
what the crime rate in the City is based upon. The Police
Department has and will continue to respond to this with
vigor.
In-the past six months, the Police Department has arrested
106 people on 163 drug charges. At present, 13 arrest
warrants have been issued that they are trying to serve. 19
search warrants have been executed, and a business was shut
down. Vehicles have been confiscated as a result of an in-
depth drug investigation. In only the last 90 days, 14 indi-
viduals were arrested, clearing over 100 burglaries by those
arrests. 17 people were arrested for over 30 robbery
offenses in the City. In all instances except a few, the
individuals admitted to using cocaine rock. They are all
strong suspects in similar crimes in other cities as well.
Of the 106 arrested for drug charges, 83 (70%) were made
in areas frequently complained about by our citizens. The
rest were scattered about the city. Only four arrests were
made west of 1-95. Chief Hillery said the Vice Enforcement
Unit has also been involved in investigations relating to
prostitution and gambling.

Councilman Hester asked if it is difficult to get the people
selling rocks because they can see the Police coming and
throw them down. That was the point Chief Hillery was
trying to make. Obviously, since the Police are arresting
them, they know the Police are watching them, so they do not
carry a great deal of the drug on them at a time. Since it
is so small, they can carry a nice supply for sale in the
palm of their hand. Upon being approached, they will throw
it away,
City Manager Cheney said the City and Police Department can
not respond just because two people are gathered together,
and much work is done undercover.
The papers attempt to do a good job in reporting these
things, but City Manager Cheney said they cannot report
everything, and the citizens cannot get a real impression as
to what is going on.
In some areas where it seems there is a lot of selling of
drugs, such as a hangout under a tree somewhere where there
is a large congregation, Councilman Hester asked if it would
help if the Police were more visible. He was talking about
the area that was brought to the attention of the Police
Department some time ago and wondered if the Police could
make regular rounds in that area.
Chief Hillery said the areas they were talking about were
major intersections in the City. Cars going from one place
to another naturally pass those intersections. At times,
the Police do not want to patrol because they have other
means of observing what is going on. Chief Hillery made it
very clear that they are getting a lot of help from people
in the community giving them names and information. He
could think of six situations where search warrants
resulted.
Chief Hillery wanted the people to know the Police are
responding, and the results of their work are in the areas
they were talking about. He was talking about the central
city core. If the Police watch a person who is involved do
it, they can take action, but they cannot just swoop down on
someone. They have to go about things in a legal manner.
City Manager Cheney urged people not to hesitate to call the
Police. There was discussion about the Courts.

Andrews Situation
Councilman Hester said this was brought up at the last
Council Meeting. City Manager Cheney said a letter had been
written to that gentleman, and it was identified before the
meeting; a red tag was put on the property the morning of
the Council meeting (March 18, 1986), and they were given ten
days to comply. City Manager Cheney received a call from
Reverend Davis today indicating that work was still going
on. In another day or two, the City will go back up there
and follow up on the inspections. If they continue to
construct, the City will have to enforce against the red
tag.
Mayor Cassandra wished the record to show that the report of
Chief Hillery was accepted as presented.
PUBLIC AUDIENCE
Mayor Cassandra acknowldged the presence in the audience of
Former Mayor Walter "Marty" Trauger and then explained the
procedure for addressing the Council.
New Civic Facility - North Boynton
Miss Veoletta Wright, 32 Crossings Circle, #D, spoke on
behalf of the residents in the north area and herself about
the gymnasium they hoped would be built in the north
Boynton area near 17th Avenue. She recalled about two years
ago, former Councilman Samuel Wright addressed the need for
this type of facility. A lot of athletes went to him and
complained about getting injured due to playing on the court
at Wilson Center. Boynton Beach has had a few professional
basketball and football players, and the community is in need
of a facility of this nature.
Miss Wright recalled that the City did not have the money to
support such a facility, and it was taken to referendum.
She hoped the Council would continue to try to plan and
provide them with this facility.
Miss Wright remembered that the Black Awareness Committee
had trouble with the Civic Center because it was overcrowded.
She hoped the Council would approve of something of that
nature in the North Boynton area, as Boynton needs to try and
get its youth off of the streets.
Mayor Cassandra offered an invitation to Miss Wright to
attend the Special Council Meeting on April 7, 1987 at 7:00
P. M. in the Council Chambers to address that question.

Councilman Hester added that there will be a complete package,
and this is one of the items on it. Mayor Cassandra told
Miss Wright to bring all the people she can that feel the
same way so they can voice their opinions.
Community Development Projects
Wilda Searcy, 402 N. E. 13th Avenue, referred to "XI.
ADMINISTRATIVE, A. Application for Community Development
Projects for the coming year," which appeared on the agenda,
and asked why it was tabled. City Manager Cheney replied
that it was tabled because it was discussed at the last
meeting. The Mayor wished to have more information with
reference to housing as a part of the community redevelopment
program. At that time, City Manager Cheney suggested a
discussion with Allan Schnier, Director of Palm Beach County
Housing and Community Development, and they hoped Mr.
Schneir would be present tonight. Mr. Schnier will be here
at the next Council meeting on April 15th.
Mayor Cassandra informed Mrs. Searcy that four items were on
there that the City would want done. He thought it would
cover recreation in different areas of the city. Nothing
was on sidewalks and housing, so Mayor Cassandra asked about
those areas.
Fundinq
City Manager Cheney read big headlines in the Sun Sentinel
this morning that said the City expects funding to be
dramatically cut and said, "So What?" Every year the City
puts an application in, and it is dramatically cut. The
purpose in that is to try to get applications together that
make sense. They submit them to the County for review just
in case there are not enough applications in other communi-
ties. It was just that process of submitting additional
applications that made it possible for the City to be in
line for funds to rebuild the Wilson pool.
Youth Program for 1986
Mrs. Searcy asked if they were working to get a youth pro-
gram for 1986. At the last Council Meeting, they passed a
Resolution saying this City is concerned that there should
be programs of funding starting from the State level. Mayor
Cassandra said Mrs. Searcy's question should be addressed
during budget time, at which time the City will know what
monies they have. If the General Revenue Sharing is not
given to the City, that will be a concern.

Loitering
Mrs. Searcy wondered if a report could be done about loiter-
ing on streets in front of buildings. Police Chief Hillery
said there is a second part to the Statute. It is loitering
and prowling. When you loiter (hang around), the prowling
aspect has to enter into it. It is all right to be hanging
around some place if you live in the neighborhood. They
have a right to be anywhere they want to be unless they are
doing something that is obviously wrong. Behind a warehouse
at 2:00 A. M. is a good example of loitering because chances
are they will do something bad. Police cannot just walk up
to someone on the corner and pick him up, as there are
certain guidelines they must follow.
Mrs. Searcy asked why the owners of property could not
complain about the loitering. Chief Hillery replied that
there are instances where shop owners post their property,
and if a person is hanging around and the shop owners want
them off their property, the Police can remove them. If they
do not leave, they are arrested for trespassing after a warn-
ing, but that is not loitering.
Mrs. Searcy stated that she has a business, and that is what
happened. City Manager Cheney informed her that people have
the right to be on a public sidewalk in front of a store.
If they are blocking a sidewalk and keeping people from going
into that store, the Police can do something about it.
Private property can be posted, but City Manager Cheney said
most of the people Mrs. Searcy was complaining about are on
public sidewalks or on private property where the private
property owner does not care.

Councilman Ferrell moved to approve the Consent Agenda,
seconded by Councilman Hester. Mayor Cassandra clarified
that this motion covered approval of IV, items A-1 and 2;
B-1 through 6; C-l, Resolution 86-EE; 2, Resolution 86-FF 3,
Resolution 86-GG; E, F, G, and H.
Motion carried 5-0.
BIDS
Emergency Purchase of High Pressure Breathing Air System -
Fire DeDartment
The Purchasing Department concurred with Fire Chief Rhoden's
recommendation that this be purchased from SDS Industries
Inc., Miami, for $11,730. City Manager Cheney said this is
the system that fills the tanks the Fire Fighters use. The
compressor died, and it is an essential item.
Mayor Cassandra asked where the money would come from. City
Manager Cheney thought some capital purchases in the Fire
Department came in lower than they budgeted. If they do not
have that money, he will come back to the Council for a
contingency transfer.
Councilman Ferrell moved to approve the bid, seconded by
Councilwoman Zibelli. Motion carried 5-0.

DEVELOPMENT PLANS
Consider request for time extension for filing final plat -
Rollingwood
City Manager Cheney felt this was a reasonable request.
Mayor Cassandra was concerned because the Council had already
given two six month extensions, and he thought they should
be given 45 days, as Rollingwood was implying 30 days was

Rollingwood wanted six months but said 45 days would be
reasonable.
Councilman Ferrell asked what would happen if they did not
get it done in 45 days. City Manager Cheney answered that
the Council could deny an extension and Rollingwood would
start all over, or the Council could extend the extension.
He asked if anyone in the audience was from Rollingwood.
There was no response.
City Attorney Vance thought Rollingwood was saying they
would complete the financing in thirty days, not the plat
work. Mayor Cassandra read from Gentry Engineering and Land
Surveying, Inc.'s letter, dated March 13, 1986, "that all
requirements covered under the final plat shall be completed
within this time period."
City Engineer Clark pointed out that the City had approved
the plat and they had paid the new fees. It was just a
question of whether the City decided they did not like his
plat. City Manager Cheney suggested that the Council give
Rollingwood three months and expect them to be here the next
time they have this request. Councilman Ferrell reminded
the Members that they did it for others in the past. City
Manager Cheney agreed but said as it gets to be the second
or third six months, the City begins to raise questions
about whether they want to let it just set around. In the
past, the Council became more skeptical and concerned about
continued extensions.
Vice Mayor Zimmerman moved to grant an extension to Rolling-
wood of three (3) months only. Councilman Ferrell seconded
the motion, and the motion carried 5-0.
In the future, Councilman Ferrell wanted some indication of
whether the Council would be dissatisfied with the plat upon
renewal. Otherwise, he thought the Council wastes a lot of
time if there is nothing of concern. If there is no reason
to question it, it seemed to him the Council could approve
an extension indefinitely. City Manager Cheney said the
Staff would make the comment more clear as to whether there
is a problem or not.
Mayor Cassandra pointed out that the City projects traffic
based on that development being developed. His concern was
that a new developer coming in cannot develop because they
have projected what this developer is going to develop, etc.

A. Ordinances - 2nd Reading - PUBLIC HEARING
Proposed Ordinance No. 86-5 Re: Prohibiting Consumption
of Alcoholic Beverages in parking lots (Public Hearing
continued to April 1, 1986)
City Attorney Vance advised that they should go back into
first reading on this Ordinance. The County just passed an
Ordinance relating to the consumption of alcoholic beverages
in parking lots and in cars while driving, which City
Manager Cheney thought would stand. He suggested the Council
consider doing nothing on this Ordinance, get a copy of the
County Ordinance and take a position out of that Ordinance as
it affects the City.
City Manager Cheney was told that all law enforcement agencies
in the County are required to enforce that Ordinance, and
all fines from the enforcement of that Ordinance will go to
the County. He suggested that they might want to adopt that
Ordinance as a City Ordinance, go ahead and enforce it, but
have the fines come to the City instead of the County. The
City has to use its Policemen, and they have to go to Court
to testify, so City Manager Cheney thought this was an oppor-
tunity for the City to do it in a way that they could get
the proceeds and still be cooperative with the whole County-
wide process.
Councilman Ferrell was in favor of what the City Manager
just said. City Attorney Vance advised Mayor Cassandra that
they could readvertise and put the Ordinance on first
reading as another numbered Ordinance. This Ordinance will
drop dead at this point.
Councilwoman Zibelli wondered why nothing was said about
what the fines would be. City Attorney Vance said it is
identified as a misdemeanor, and the City has a general
Ordinance that makes a misdemeanor in the City $500 or sixty

days in jail. This applies to all misdemeanors. He said
he will get a copy of the County Ordinance as rapidly as he

Zimmerman. Motion carried 5-0.

City Attorney Vance thought this type of thing might be
better as a Resolution, as it will possibly be changed every
so often, and there is really no reason to have something
like this in our Code Book. The only concern Mayor Cassandra
had was that there was such a hullabaloo on raising the fee.
Normally, you do not have a public hearing with a
Resolution.

2. Proposed Ordinance No. 86-7 Re: Building Construction
City Manager Cheney had not passed out copies of the Ordinance
to the Council and explained that if they do not like his
memorandum of March 31, they will not like the Ordinance.
He explained that the City is in a situation where they have
potentially affected two active building projects (Mahogany
Bay and The Landings). He read his memorandum, which
recommended that the requirement of automatic sprinkler
systems in wood frame buildings exceeding two stories or 20
feet be eliminated from the City Code.
City Manager Cheney said the City told Mahogany Bay and The
Landings that the Code requires that they put sprinkler
systems in their buildings. Mahogany Bay is well under
construction, but they have not closed in any walls. There
is a cost they would not have had if they had known this in
the first place. Mahogany Bay has three stories in many of
their buildings, two stories in some, and all of them have
one hour fire protection walls.
The Landings has two stories, is basically wood frame, some
masonry protection is between some of the units, and it has
an hour's protection. It falls under this requirement
because the area over the ceiling is above 20 feet.
Both of these projects are affected by this provision of the
Ordinance which was not noted at the time the building per-
mits were approved. The issue before the Council was
whether to tell the projects to install sprinkler systems or
wait two or four weeks while the Council gives it more
consideration. City Manager Cheney brought it to the atten-
tion of the Council because it was a money situation for the
developers.
These things have happened, and City Manager Cheney commented
that the Courts have upheld that when a provision in the
Zoning or Building Codes have been missed, the City can bring
about compliance, and he told of some cases. He guessed that
both the developer and the City had an obligation to know
what the Codes are. There was discussion.
City Manager Cheney told Councilman Hester this was because
of the wood construction, and he said a lot of arguments have
been made nationwide about where sprinkler systems belong
and do not belong. It is not in the Fire Code that was
adopted by the Standard Building Code organization.

It seemed to Mayor Cassandra that it was a question of
safety, and he referred to the City Manager's memorandum.
City Manager Chene¥ said with the one hour pro~ection and
smoke alarms in the building, there is a highly reasonable
expectation that people will get out safely and that there
will be a minimum of fire damage because the City has good
response, fire hydrants, and a fire system that will func-
tion well. There is an hour of protection between units.
After more discussion, City Manager Cheney said other people
who have reviewed it, including the County, have not felt it
necessary to include this kind of requirement, which is in
our Code.
There was more discussion. Councilman Ferrell was also
concerned about safety but wondered if the City had an un-
reasonable requirement by today's standards and asked if
everything the City had accomplished was worth it or if they
wasted a lot of time and money making their system better.
Mr. Howell advised that the intent of Fire Codes and Build-
ing Codes is for the safety of the people in the buildings.
There is no way that they can guarantee that a concrete
building will not crumble and fall in a fire, but they try
to see that people occupying buildings have time to get out
of a building. The Code now gives those people an hour.
The City's response time is five minutes, so Mr. Howell
thought they would find that the County felt, when they
addressed this, that the Building Code was adequate. The
Building Code covers how the building is bUilt, and the Fire
Codes for the building.
At the time this Code was written, Mr. Howell thought it was
probably needed in Boynton Beach because they took into con-
sideration that they had nine Firefighters, one fire station,
and no water pressure to amount to anything in a lot of
areas. Now the City has the Technical Review Board, loop
water systems, the pressure needed, fire hydrants close by,
and good firefighting equipment.
In Mayor Cassandra's mind, there was no justification for
taking away more safety from the people. Mr°Howell brought
out the fact that sometimes they become unfair to industry
by what they require, and the people buying the buildings
pick up the tab for the sprinkler systems.
Mayor Cassandra asked if you had to put sprinkler systems
above 20 feet for CBS or just wood buildings. Mr. Howell
answered that it varies. When CBS gets over three stories,
they have to put in sprinkler systems.

Councilman Ferrell pointed out that this adds considerable
costs, and affordable housing is hard to come by. This was
adopted in 1973 in place of the things that did not exist.
Councilman Ferrell thought the City had progressed over the
last 13 years to get those things. There was more discussion.
Mayor Cassandra felt the crisis was to relieve these two
builders.
City Manager Cheney said he raised the question now because
it was the time to raise it, and it was unfortunate that
two builders were involved. It did not seem to him that the
City should tell them to install the sprinklers without
thinking about it and raising the issue with the Council.
If he had not raised the issue, City Manager Cheney thought
the bUilders would have raised the issue anyway.
Councilman Hester thought it was unfortunate that the
builders did not know about the Code, but he thought they
should have the added safety feature.
City Manager Cheney informed Councilman Ferrell that the
Council had copies of letters from Fire Chief RhOden and Mr.
Howell saying they concurred with his recommendation. There
was further discussion.
Mayor Cassandra has seen where the Board of Adjustment and
Appeals has granted variances on fire walls in other areas.
If that was the case, he wondered if these builders could
also go to that Board and override the decision the Council
might make tonight. City Attorney Vance's opinion was that
a variance from this Ordinance would be invalid. City
anager Cheney added, "because that Building Board of
Adjustment an~ Appeals comes straight out of the Building
Co~e, and they relate to the Building Code. This provision
is not in the Building Code. It is in the general City
Ordinance."
For some good reason, Vice Mayor zimmerman noticed we have
not had too many multi-family, multi-story wooden construc-
tions in the city and said these are probably the first two
for some time. He thought maybe it was good that they had
t~e Ordinance and developers were aware of it. Vice Mayor
Zlmmerman commented that maybe they should just keep the
O~dinance. He did not think Fire Chief Rhoden's letter was
too specific as to what they should do with the Ordinance
b~cause, in Chief Rhoden's opinion, relief might be given to
these two people. Vice Mayor Zimmerman thought maybe the
only way to give them relief would be to nullify the
Ordinance.

City Manager Cheney commented that it may well be that they
have an opportunity for better design and more innovative
design with the wood buildings than they have had with CBS.
He explained and said the question was whether they wanted
to keep wood frame buildings from being built. There was
more discussion.
Mr. Howell told the Council they will be seeing more and
more wood frame buildings because of the Energy Code. It is
much easier to meet the Energy Code with them. Mayor
Cassandra thought maybe they should have an opinion from the
fire prevention people. City Manager Cheney informed him
that those people work with the Fire Chief, and they are a
part of the Fi:re Department.
It seemed to Councilman Ferrell that they were getting to
where they were considering anything built of wood was a
fire hazard. If they looked around town, he said they would
see a lot of old wood buildings that have not burned down.
Most of the northern community is wood, and it is still
there. There was more discussion.
Councilman Ferrell moved to go to first reading on the
Ordinance because the first reading does not obligate any-
thing, and it will enable the Members to do some research
before the second reading. Vice Mayor zimmerman pointed
out that there would be a public hearing too. The motion
died for lack of a second.
C. Resolutions
Proposed Resolution No. 86-HH Re: Establishing Advisory
Committee to review the City's Sign Code and rescinding
Resolution 86-R TABLED
Before taking this off the table, Mayor Cassandra wanted the
Council to know that a question came up. Maybe five or
seven people will be on this Committee from various areas of
concern (Chamber of Commerce, a Sign person, a Member of the
Downtown Review Board, a planning and zoning type person,
and a citizen at large). In going down the rotational list,
Mayor Cassandra was concerned that they may possibly miss
someone from a particular area. City Manager Cheney had
recommended that maybe the Council and citizens should give
a list of names to the Mayor so he could break them down and
pick from the appropriate areas. For example, he may have
three names from Planning and Zoning, but there may be a
person from the Chamber of Commerce with the same qualifica-
tions, and there is no sense in having one of each.

Councilman Ferrell asked if they could not delineate which
area each Councilman would pick from by each of their names.
Mayor Cassandra had recommended that to City Manager Cheney,
but City Manager Cheney wanted the Council's approval because
if he would pick, then he would have decided the areas the
people came from and not the Council.
City Manager Cheney explained that the Ordinance proposed
more categories to be represented than there are people on
the proposed body. Vice Mayor Zimmerman clarified that
there are ten categories but only seven Members, so they will
be leaving some empty or be doubling up. After more dis-
cussion, City Manager Cheney said if the Council would go
down the list and make appointments, they may end up with a
good balance.
Vice Mayor Zimmerman moved to remove Proposed Resolution No.
86-HH from the table, seconded by Councilman Ferrell. Motion

3. Proposed Resolution No. 86-JJ Re: Library Fundinq
By policy, City Manager Cheney said the State Librarian and
his department (Secretary of State's Department) provide
funding to what they like to consider the State Library
system, which means County libraries and any library in any
ity over 200,000. Municipal libraries have been fighting
hat policy because they think they should get monies
directly from the State. They do not get it through the
County, and they are not going to if the County library does
not represent them. City Manager Cheney said they think the
tate should provide construction funds and any money they
re going to provide to the County library system to munici-
pally supported libraries like the City's.
~ity Manager Cheney said the current Bill being presented
by Representative Bell before the House provides, as a
~atter of State law, that the State will o for the Count

~lbrary system. In addition, there is a proposed funding
~or library sources for the State money to pass out to the
~ounty libraries, and City Manager Cheney elaborated. He
~aid that would mean the City would pay 2% tax on any book
~hey buy for the City Library, and the City would not get
any money back under the proposal. The City does not think
it should pay the 2%, but if it does, they should get some
money back. This Resolution addresses the issue of the 2%
tax and the issue that the City is not considered a part of
the fundable library system.
This Resolution was passed by North Miami, and municipal
libraries in the State are attempting to have similar
Resolutions passed. The City hopes to communicate with
Representative Bell and has communicated with Representative
Messersmith requesting funding from the State budget for its
library expansion. If the City cannot get the funding from
the Director of Libraries, it hopes to get it from the State
budget.

City Manager Cheney said if the Members had any. questions,
they should talk to Carmen Annunziato, Director of Planning,

This item was deleted from the agenda.
3. Approval of corrected deed for American Legion
City Manager Cheney explained that it is officially not the
Leroy Parker American Legion but American Legion Post No.
288, Inc., so the name on the deed was incorrect.
Vice Mayor Zimmerman moved, seconded by Councilman Ferrell,
to approve the execution of the corrective deed.
Myra Gendel, Attorney at Law, Moyle, Flanigan, Katz, et al,

that the deed be signed tonight as the closing was scheduled

The Council had recommendations from City Manager Cheney
through Perry Cessna, Director of Utilities. Councilwoman
Zibelli had problems with the fact that there were no
presentations by the two remaining firms. Mayor Cassandra
had the same question, and he read what the Request for
Proposals spell out. He assumed there were three high rank-
ing firms and read from the Request that they would be
invited for interviews by the Screening Committee and
referred to the City Council for final selection in the order
of preference, as determined by the Screening Committee.
Mayor Cassandra asked if that meant the applicants had the
legal right to present their case to the Council. City'
ttorney Vance thought theY could insist upon that right,
ased upon the RFP.
ity Manager Cheney told the Council that the Screening
Committee reviewed the applications and concluded that only
wo applicants met the requirements put forth. Therefore,
here were only two responsive bids. City Attorney Vance's
response was as to those two. City Manager Cheney continued
~hat there is a ranking, and his report said he did not feel
it was necessary for the Council to interview a lot of firms
and suggested if they interviewed any firms at all, they
interview Post, Buckley, Schuh & Jernigan, Inc. and CH2M
Hill. The staff's recommendation was clear, but there was
no suggestion that the Council could not interview the two
firms if they wanted to.
Mayor Cassandra's concern was that the Council would decide
who they wanted to interview, and he wondered if they would
put the City in jeopardy if they did not interview. Council-
man Hester personally thought it was too technical for him
to interview the firms, and he commented that the Screening
Committee has more expertise than he does. City Attorney
Vance agreed with Councilman Ferrell that the Council would
not have any legal problems. In response to Councilman
Hester, City Manager Cheney said the advantage of interview-
ing one or two firms is that the Council would get a better
understanding of what is going on.

There was discussion, and City Manager Cheney told Council-
man Ferrell they should have a Workshop instead of a Special
Meeting. Councilman Ferrell pointed out that some people

where they would vote, it would make a lot of difference.
City Manager Cheney said he would set up a Workshop, have
the two firms, and give approximately an hour to each. Then
the Council can vote on them.

Councilwoman Zibelli reappointed Lou Samyn to a three (3)
year term as a Regular Member. Councilman Hester reappointed
Leonard Mann to a two (2) year term as an Alternate Member.
Councilman Hester moved to approve the appointments to the
Building Board of Adjustment and Appeals, seconded by Vice
Mayor Zimmerman. Motion carried 5-0.
Cemetery Board
Vice Mayor Zimmerman reappointed Mike Bowden, Regular
Member, to a three (3) year term. Mayor Cassandra reappoint-
ed David A. Nyquist, Regular Member, to a three (3) year
term, and Councilman Ferrell reappointed Joseph Delaney as
an Alternate Member for one (1) year.
Councilman Ferrell moved to approve the appointments,
seconded by Councilwoman Zibelli. Motion carried 5-0.
Civil Service Board
Councilwoman Zibelli reappointed Henry Stanley, Regular
Member, to a two (2) year term. Councilman Hester reappoint-
ed Don L. Balmer, Alternate Member, to a two (2) year term.
Councilman Ferrell moved, seconded by Councilwoman Zibelli,
to approve the appointments. Motion carried 5-0.
Community Appearance Board
Vice Mayor Zimmerman reappointed Barney Pitkin, Alternate
Member, to a three (3) year term and moved that the
nomination be accepted, seconded by Councilman Ferrell.
Motion carried 5-0.

Mayor Cassandra nominated Michele Constantino to a two (2)
year term as a Regular Member. Councilman Ferrell reappointed
Philip Berkowitz, Regular Member, to a three (3) year term.
Councilwoman Zibelli reappointed Dr. Perry Brown, Regular
Member, to a three (3) year term, and Councilman Hester
renominated Veoletta Wright, Regular Member, to a three (3)
year term. Vice Mayor zimmerman nominated Denys Delong as
an Alternate Member to a two year term.
Councilman Hester moved, seconded by Councilman Ferrell to
approve the nominations. Motion carried 5-0.
Library Board
Mayor Cassandra renominated Naomi Creason, Regular Member,
to a three (3) year term. Councilman Ferrell renominated
Sandra Lautenschlager, Regular Member, to a three (3) year
term.
Vice Mayor Zimmerman moved that the nominations be accepted,
seconded by Councilwoman Zibelli. Motion carried 5-0.
Planning and Zoning Board
Councilwoman Zibelli renominated Marilyn Huckle, Regular
Member, to a three (3) year term. Councilman Hester
renominated Robert Wandelt, Regular Member, to a three (3)
year term, and Vice Mayor Zimmerman renominated Norman
Gregory, Alternate Member, to a two (2) year term.
Councilman Hester moved approval of the nominations,
seconded by Councilwoman Zibelli. Motion carried 5-0.
Recreation and Parks Board
Mayor Cassandra renominated G. Don Fenton, Regular Member,
to a three (3) year term but did not have a chance to confirm
with Mr. Fenton that he still wants to be on the Board.
Councilman Ferrell renominated Dorian Trauger, Regular
Member, to a three (3) year term.
Councilman Hester moved approval of the nominations,

Employees' Pension Board
Councilwoman Zibelli renominated Leon B. Himelfarb to a

Councilman Ferrell nominated Vice Mayor Zimmerman, seconded
by Councilman Hester.
Upon accepting this nomination, Vice Mayor zimmerman said
he would tender his resignation as a Member of the Metropoli-
tan Planning Organization (MPO). As he had been the Alternate
Member of the MPO, Councilman Ferrell volunteered to be the
Regular Member.
A vote was taken on Councilman Ferrell's motion and carried
5-0.
Councilman Ferrell moved, seconded by Vice Mayor zimmerman
to amend the Agenda to add "Appointment of Representative to
the MPO". Motion carried 5-0.
Appointment of Regular Member to the Metropolitan
Planning Organization (Replace Vice Mayor Zimmerman)
Mayor Cassandra announced that the appointment of Councilman
Ferrell had been accepted by acclamation. Motion carried
5-0.
