Minutes 02-18-86MINUTES OF THE REGULAR CITY COUNCIL MEETING HELD AT CITY HALL, BOYNTON BEACH, FLORIDA ON TUESDAY, FEBRUARY 18, 1986 AT 7:30 P.M. PRESENT Nick Cassandra, Mayor Robert Ferrellf vice Mayor Ezell Hester, Jr., Councilman James R. Warnke, Councilman Carl zim~erman, Councilman Peter L. Cheney, City Manager Betty Boroni, City Clerk James W. Vance, city Attorney Mayor Cassandra called the meeting to order at 7:30 p.m. The Invocation was given by Reverend George Dettman of First United Methodist Church, and Mayor Cassandra led the Pledge of Allegiance to the Flag. AGENDA APPROVAL Under Administrative, vice Mayor Ferrell wanted to add item B. Palm Beach County Day in Tallahassee. Under Proclamations, City Manager Cheney added C. American Legion Poppy Days - February 21 and 22, 1986. He added a Resolution supporting the Palm Beach County Solid Waste Authority's proposed Special Act Amendments to permit the cost of solid waste disposal fees to be assessed against improved properties and collected on the ad valorem tax bills. Mr. Cheney added two bills for approval; one is for Hi Line Contractors in the amount of $13,883.71 for work at the water plant--painting and cleaning the water clarifica- tion units-~and the other for All-Rite Paving in the amount of $49,930.06, which is partial payment for five street pro- jects, under Legal-Other, Attorney Vance added 2. Settle- ment ofiShell Oil Company parcel; he said this has already been before the S.C.R.W.T. Board. Councilman zimmerman moved, seconded by Vice Mayor Ferrell, to adopt the Agenda with the corrections. The motion carried 5-0. ANNOUNCEMENTS Mayor Cassandra read the following Proclamations: 1. American Association of University Women's History Week - March 2 - 8, 1986 2. Boynton's G.A.L.A. (Great American Love Affair) - February 28 - March 2, 1986 3. American Legion Poppy Days - February 21 and 22, 1986 A representative of the American Legion Auxiliary presented a poppy to Mayor Cassandra, and he and other Council Members made a cash donation to the Legion. - 1 - MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA FEBRUARY 18, 1986 Mr. Cheney said Dr. Michael Robbins telephoned and advised he would be unable to be here tonight; the presentation con- cerning united Way recognition will be postponed until March 4. CITY MANAGER'S REPORT Cost Savin s~f recent IBM-PC Training Sessions Mr. Cheney said the six-week in-house employee training program on the use of IBM PC's, conducted by a city employee, resulted in savings of over $20,000. IBM would have charged $23,000 for the same program which cost about $2,000 in Jean Shortley's time. The city probably would not have gone to IBM for training, but employees would have learned gradually on the job; with the training, the units can be used immediately and effectively. Galax~ School Discussion of traffic problems at this site at the last Council meeting has prompted a closer look at what might be done to improve the situation. Police Chief Hillery heard of an idea for portable traffic signals at a conference he attended; this might be tested and considered on Boynton Beach Boulevard. Cheese Proqram Mr. Cheney said the distribution arrangement in the first week of February was successful. Cheese was distributed at South Tech and at the civic Center for the approximately 40 people who walked in. DOT - Five-year Road Pro rq~ The project in this program of interest to the City is the Intracoastal bridge. Mr. Bill Fowler, Regional Engineer for the DOT, said the expected delay is because of the new Growth Management Act passed in the Legislature last year, which requires that additional studies be done for projects that relate to the barrier islands, rather than because of the court case and the uncertainty of when the court will give its decision. Although this bridge probably will not generate more traffic to the barrier islands, it is a bridge and must go through analysis and value engineering to measure its impact and must be approved again by State agen- cies and the Department of Community Affairs. - 2 - MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA FEBRUARY 18, 1986 Day Care Center Day care in Palm Beach County is undergoing a major change; it previously was operated by the Community Action Council but is now operated by the County government as a division of the Department of Community Services. The employees now work for the County and are undergoing required training. The City has been funding the After-Care Program. Mr. Cheney said he, the Assistant city Manager and Mr. Ed Rich, Director of the Department of Community Services, met with the Advisory Committee of the After-Care Program and discussed ways to best utilize funds. At this time they are uncertain as to whether the building should be expanded. The County has a planning firm engaged in analyzing facility space, which they have asked to study our day care center and make a~judgment. The County has no funds for expanding the facility; the city may go back to a program of expanding the center, possibly during the summer. If the city contri- butes the $125,000 set aside in our Capital Improvements program to the expansion, we want as much of a commitment as possible from the County that they would continue to use the facility as long as there is a Head Start Program funded by the Federal Government. Mr. Cheney said everyone involved in our program understands what is going on and is suppor- tive of the improvements and the reorganization the County made in Head Start. The city Manager's report was accepted as presented. PUBLIC AUDIENCE Littering_of Vacant Lots Mrs. Wilda Searcy and Mrs. Butler, who owns a lot on N.E. 13th Avenue near Seacrest Boulevard, came before the Council to tell about the problems they are encountering in trying to keep the lot clean and avoid Codes Enforcement viola- tions. Although signs have been erected, dumping on the property is a continuous problem, as well as cars being repaired on the lot. Mrs. Butler has paid $50 per car to have six vehicles towed away; even refrigerators and tires have been dumped on the property. She asked what could be done, and Mr. Cheney did not know what the city could do with vacant lots. Throughout the City, lot owners are held responsible for keeping the lots clean. He suggested that anyone who sees dumping being done should note the license plate number. The owner of land has the right to swear out a warrant against trespassers; the Police Department will be glad to help with that. Mrs. Butler said she tried to give her lot to the city. Mr. Cheney said the problem will be resolved as people living in the community care about the neighborhood. - 3 - MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA FEBRUARY 18, 1986 Golf Course Plaqu9 Mr. Benjamin Katz, 2520 N.E. 1st Court, said he is a former Director of the dissolved Greater Boynton Beach Municipal Golf Club and a former Vice Chairman of the Advisory Committee to the Boynton Beach Municipal Golf Course. He said several former directors of the dissolved club have heard that the City Council will be asked to install an honorary plaque at the Golf Course. He said a dedication plaque was installed in 1984 honoring city officials, and he and the other former directors are opposed to the request for an additional plaque for several reasons. He charged that the two individuals who helped organize the golf club and whom the plaque would be honoring are not entitled to this recognition. He stated the club was dissolved, and $831 remaining in the club's treasury was never properly disbursed. Councilman Warnke had not heard of the request for the pla- que, and Mayor Cassandra said the other Council Members had received a letter asking that it be placed on the Council Agenda. Councilman Hester saw no need for an additional plaque at the Golf Course. vice Mayor Ferrell moved to place this item on the Agenda for consideration, and Councilman zimmerman seconded it. Councilman Warnke con- firmed that the golf club had been private, and he did not think the city should get involved. The motion on the floor was voted upon and carried 5-0. Vice Mayor Ferrell moved, seconded by Councilman Warnke, that neither this or any other plaque be installed. The motion carried 5-0. Noise of Banana Boat Restaurant Mr. John Peace, 720 East Ocean Avenue, told the Council he lives in Coastal Towers and is continually disturbed and distracted by noise from the Banana Boat. He said the noise goes on until 2:00 a.m., and then conversations among employees and rattling of trash cans in the parking lot con- tinues until 3:00 a.m. Mr. Peace said he has not had a night's sleep in six months, and he proposed that the parking lot be patrolled, rubber wheels be placed on carts used in the lot, the restaurant accept responsibility for litter on both sides of Ocean Avenue and that management control noise created by their employees after 11:00 p.m. His complaints to the management have been met with indif- ference. Councilman Warnke told Mr. Peace that a noise ordinance is on the Agenda for first reading at this meeting. If the ordinance is adopted, the City will have the tools in hand in a few weeks for controlling noise. - 4 - MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA FEBRUARY 18, 1986 Golfview Harbour - Beautification of North Entrance Ms. Pat Shapins, 1340 S.W. 26th Avenue, represented the Golfview Harbour Homeowners' Association in their request for the city's assistance with the beautification project for their entrance at S.W. 23rd Avenue and S.W. llth Street. Ms. Shapins passed around a photograph of the entrance as it currently exists and distributed lists of activities the Association would like to accomplish. The entrance has never had the advantage of being dealt with by a builder. They would like the City to install 1,050 linear feet of sidewalks, remove two poorly maintained f~cus trees, install a water meter for the irrigation system, install an electric meter for the lights and irrigation system (for which the Homeowners' Association would be responsible) and construct a barrier other than the present chain-link fence over the bridge spanning the Lazy Lake Waterway on S.W. llth Street. The Association would like permission to extend lighting up through the post that is in the right of way and install dome-shaped lights on the top of the post, sod 90 feet of the right of way along S.W. 23rd Avenue on both sides of S.W. llth Street, install an irrigation system in the right of way and lanscape the right of way. Ms. Shapins said she made the same proposal to the Community Appearance Board February 17, and they endorsed it. Councilman Warnke made a motion, seconded by Vice Mayor Ferrell, to refer this request to the City staff for review. Councilman Hester thought other areas might have a greater need for sidewalks. Councilman Warnke thought improvements are needed much more in Mrs. Searcy's neighborhood. Councilman zimmerman had heard the presentation an more depth at the Community Appearance Board meeting, and com- ments were made that the Golfview Harbour Homeowners' Association might pay for some of the costs. Vice Mayor Ferrell thought the staff's report would come to the Council with priorities; he commented that the majority of items on the list to be accomplished were to be done by the Association itself. The motion on the floor was voted upon and carried 4-0. Mayor Cassandra abstained from voting, as he lives in Golfview Harbour and wanted to avoid a possible conflict of interest. Woolbright Road - Continuinq West Mr. Ben Uleck, 1507 S.W. 17th Avenue, wanted to know if Woolbright Road is to be continued west through Quail Ridge. - 5 - MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA FEBRUARY 18, 1986 Mr. Cheney said this extension is in the County's five-year plan. The City has consistently taken the position that the road should be extended. The right of way going_though Quail Ridge was bought by the County in 1974--two years before the first plat for Quail Ridge was recorded. The Commission held a hearing and adopted the five-year plan; some people from the west Boynton area were present to oppose the Woolbright Road extention. Councilman zimmerman said we have an ally in the Village of Golf, who sent a resolution recommending the extension of the road; they maintain there is too much traffic on Golf Road. Consider request for site plan approval to construct a 14,483 square foot mixed-use industrial building to be known as 9 Bay Industrial Building on 1.26 acres on the east side of Congress Avenue, south of S.W. 30th Avenue. This request was submitted by Donald T. Smith for L. W. McNamara and Sons, Inc. The Planning and zoning Board unanimously recommended appro- val of this request, subject to staff comments. 4. Consider request for approval of construction plans and preliminary plat which provides for the construction of infrastructure improvements to serve forty-two (42) multi-family attached units in connection with a previously approved Planned Unit Development (pUD) known as Boynton Lakes. This PUD is located on the east side of Congress Avenue, south of Hypoluxo Road, submitted by Rick Rossi, P.E. for Lennar Homes,. Inc. The Planning and zoning Board unanimously recommended appro- val of this request, subject to staff comments. E. Consider renewal of Agreement between City and Boynton Beach Little Leaque, Inc. Agreement has been signed by Mr. Raymond Weeks, President of Boynton Beach Little League, Inc., and Mr. Charles Frederick, Director of Recreation and Parks. F. Consider approval for the placement of one office trailer and one storage trailer in conjunction with the construction of the Knuth Road Office Building, located at Knuth Road and Boynton Beach Boulevard, submitted by Mr. Robert Knuth of the Corporate office of the Undersiqned Boca Raton. The Building Department recommends approval in accordance with Chapter 25, Section 25.7 of the City of Boynton Beach Code of ordinances. PUBLIC HEARING A. Consider request to annex a 9.3814 acre tract of land, show the land as Moderate Density Residential and rezone it from AR (Agricultural Residential) to a Planned Unit Development with Land Use Intensity = 7 to permit the development of 46 townhouse units, located on the east side of Lawrence Road, south of Hypoluxo Road. This request was submitted by Thomas F. Kelsey, for Middle States Coal Company, Inc. (Honeybell HOllow) (Deleted from January 21, 1986 Agenda) Mr. Cheney read a letter received from this applicant stating that they are withdrawing their application for con- sideration for annexation into the City. Attorney Vance advised that there was no need to vote on the issue. B. Consider request for the abandonment of a five (5) foot utility easement on the south side of Boynton Beach Boulevard, east of N.W. 7th Street, in connection with the proposed construction of Humana Medfirst. This ~equest was submittedl bY Sally Benson for Humdeco, Inc. Mr. Carmen Annunziato, Director of Planning, said this request is recommended positively by the Planning and zoning Board. The applicant has agreed to pay for the relo- cation of Southern Bell's! underground line in the easement; therefore, Southern Bell does not object to the abandonment. Attorney Sally Benson, 1675 Palm Beach Lakes Boulevard, West Palm Beach, was present to represent the petitioner and con- firmed that Southern Bell will be using their new easement. Mayor Cassandra asked if ~anyone wished to speak in favor of or in opposition to the request, and there was no response. Councilman Hester moved, seconded by Vice Mayor Ferrell, to grant the request for the abandonment of the five-foot uti- lity easement on the south side of Boynton Beach Boulevard east of N.W. 7th Street. The motion carried 5-0. C. Consider request for a modification to the previously approved ConditiOnal Use to allow for a 13' 10" expan- sion of the west wing of Praxis Adult Care Residence located on S.W. 3rd Street at Woolbright Road, the southwest corner. This request was submitted by Carl W. Lindner, agent and owner. The modification is not substantial in nature. Mr. Annunziato suggested that, if the Council approves the request, it be subject to the applicant going before the Community Appearance Board, as he was unable to appear at their meeting on February 17. Mr. Carl Lindner explained they want to increase their acti- vities area for the residents of the adult care facility; they anticipate the Health and Rehabilitative Services of the State of Florida will review its requirements for recreational and dining areas in such facilities. He is of the opinion they are inadequate and very restrictive, requiring only 35 square feet per resident. Mr. Lindner said they would like to expand their building now to avoid inconvenience to occupants of the facility at a later date. Mr. Cheney said the expansion is on the side of the building that faces 1-95. Mayor Cassandra asked if anyone wished to speak in favor of or against the request; there was no response. Councilman Zimmerman moved, seconded by Vice Mayor Ferrell, to grant this request for a 13' 10" expansion subject to CAB require- ments. The motion carried 5-0. DEVELOPMENT PLANS Councilman Warnke moved, seconded by Vice Mayor Ferrell, to change the order of the Agenda and discuss item D. first among development plans. The motion carried 5-0. Consider request for site plan approval to construct a 3,125 square foot medical clinic to be known as Humana Medfirst on .58 acres on the south side of Boynton Beach Boulevard, east of N.W. 7th Street. This request was submitted by Randy Oakes for Humdecoz Inc. Mr. Annunziato said this request accompanies two previous requests; one was approved by the Planning and Zoning Board for a parking lot variance and the other was approval of the abandonment of a utility easement. The proposed facility will be approximately 150 feet east of N.W. 7th Street where it intersects with Boynton Beach Boulevard. A positive recommendation, subject to staff comments, by the P&Z Board was unanimous; the request was approved by the Community Appearance Board. Attorney Sally Benson said the proposed building will be single story, and 29 parking spaces, two of them han- dicapped, will be provided. They anticipate the facility will be open from 8:00 a.m. until 8:00 p.m. There will be four employees, and between 25 and 35 patients per day are - 10 - MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA FEBRUARY 18, 1986 expected. Two means of egress and ingress to the facility are provided, one on Boynton Beach Boulevard and the other at the rear on N.W. 1st Avenue. As it is uncertain when and what the DOT will do, Attorney Benson said they have deve- loped interim traffic plans. Before the Planning and Zoning Board there was discussion of requiring that two center cuts be closed and a U-turn be constructed just west of this pro- perty if a Certificate of Occupancy is issued to this appli- cant before the DOT implements the closure of those median cuts and signalization at N.W. 8th Street. Ms. Benson said they ha~e no objection to that arrangement; there is no question the situation is dangerous as it exists. Mr. Dan Murray, who was previously affiliated with the DOT and who did the traffic study, was present to answer questions. Councilman Warnke asked what control the city would have in the event the property sold and a company generating a higher volume of traffic located there. Mr. Annunziato said the only control would be to determine that the parking was sufficient relative to the square footage of the bUilding. The property is zoned C-2, and any use of the C-2 or C-1 zoning classification can locate on the site. Mayor Cassandra pointed out the Texaco station and Wendy's restaurant across the street, the egress of 1-95 and a changing light, which drivers making the U-turn would not be able to see; he thought the DOT's recommendation is a higher risk than the present arrangement. Mr. Cheney said the city has asked the DOT to consider a traffic signal at Industrial Avenue, which would alleviate many of the concerns about the U-turns. Mr. Annunziato said this is one of the worst traf- fic locations in the city; he showed drawings indicating what the DOT is proposing and how the plan can be modified for an interim solution. vice Mayor Ferrell moved, seconded by Councilman Hester, to approve the request to construct a 3,125 square foot medical clinic to be known as Humana Medirst on .58 acres on the south side of Boynton Beach Boulevard east of N.W.- 7th Street. Councilman Warnke said he is still concerned that a future usage might create a worse problem and that, until the DOT makes a final decision and establishes a building date, we do not know where we are~going, vice Mayor Ferrell commented that every project the Council approves has the same possibility of being sold. The motion was voted upon and carried 3-2, with Councilman zimmerman and Councilman Warnke voting against the motion. A short break was taken, and the meeting resumed at 9:15 p.m. - 11 - MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA FEBRUARY 18, 1986 Consider request submitted by Beril Kruger, agent for Roland Reinhardt, for site plan approval of an amended site plan to allow for the expansion of the existing restaurant (Bavarian Haus) from 160 licensed seats to 222 licensed seats and a request for a shared parking allocation. The Bavarian Haus is located on the east side of Congress Avenue south of West Boynton Beach Boulevard ....................................... TABLED Councilman zimmerman moved, seconded by Councilman Hester, to remove this 'request from the table. The motion carried Mr. Cheney said at the last meeting there was a question as to whether the city was properly interpreting the traffic studies for the entire Forum center. Since then he talked with the Vice President of Kimberl¥-Horn, as well as one of the individuals who compiled the report. The author of the report does not think we are interpreting the report incorrectly and he agrees that we have the 56 Parking space situation. His study was based on projections 'of what is likely to happen at the center. The reason a charge of $3,000 to $4,000 was quoted to conduct another traffic study requested by this applicant was that the study would not be based on projections but on the reality of the situation, which will not !be known for a year. The charge would be for a new study at that time. He stands by his prOjections, admitting that they may prove to be inaccurate after the theaters and all shops are open. Friday at 6:00 p.m. is confirmed to be the peak demand of all usage; that is not the peak demand for the theater. The conclusion is that of over 800 parking spaces there is a possible 56 space surplus--less than 10 percent; the staff's position has been that this is not too great of a margin. In response to questions, Mr. Cheney said everything on the site plan for the Forum center is in the permit or construc- tion stages except the office building. At the time the site plan was approved, the assumption was that all busi- nesses in the area would remain at their present size. Vice Mayor Ferrell asked how many parking places the addi- tional 62 seats would translate to, and Mr. Annunziato said the city's code requirements have changed since the restaurant was built. Previously it called for one parking space for 4 seats; now it is one space for 2½ seats. There is a deficit to make up under their current licensing. Mr. Chene¥ said, although the Bavarian ~aus is licensed for 160 seats, they actually have 181 seats. Eighty nine spaces would be needed for the 222 seats. - 12 - MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA FEBRUARY 18, 1986 Mr. Beril Kruger said his client was asked by the city to withdraw his petition at the time Florida National Bank voiced a complaint and said they were not a part of the shared parking. There was a problem with the site plan and the parking study for the Forum Shoppes; they were told they could bring their petition back after that was straightened out. When they resubmitted their petition, Mr. Kruger said they found the Forum Shoppes were taking most of their parking spaces. He said the parking studies are based on theory, and retail stores are not busy at 6:00 p.m. He said the bank~closes at 6:00 p.m., the office building will close at 5:00 p.m., admittedly the theaters' traffic will not peak at 6:00 p.m., so the only other businesses are the Winn-Dixie store, the retail shops and the restaurants. Mr. Cheney explained that the traffic studies are based on cur- ves developed'from studies at many shopping centers--not on theory. Mr. Kruger said his client is willing to reduce his seating capacity from the requested 222. Mr. Reinhardt said he wants to build an addition and improve the handicapped bathroom facilities. Mr. Kruger was confident that within a year they can show there will be sufficient parking spaces. Mr. Cheney said they could build the larger space, be licensed for a certain number of seats now, and add addi- tional seats if there proves to be ample parking next year. Mr. Kruger said his client plans to remodel the kitchen facilities and other parts of the restaurant. Mr. Annunziato said the applicant could be licensed for 190 seats--an increase of 30 over the present. Councilman Warnke made a motion to deny the request as sub- mitted a~nd said the applicant could make another request with the amended number of seats; Councilman zimmerman seconded the motion for discussion and wanted the City Attorney to advise if this is the proper legal procedure. Attorney Vance said the Council could suggest that the applicant ask for an extension of time with respect to this petition in order to permit him to amend his request. Councilman Warnke withdrew his motion, and Councilman zimmerman withdrew the second. Mr. Kruger requested that the petition be postponed until March 4, 1986, when the request will be amended to ask for 191 seats. Vice Mayor Ferrell asked if a margin of error is built into the Code; he suggested that a certain percentage might be applied as a safety margin for future developments. Mr. Annunziato said we can create language that suggests that, in the instance of shared parking, limits could be set as to how close to the allowed number an applicant could come. - 13 - MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA FEBRUARY 18, 1986 Be Consider request for approval of an amended site plan to allow for the replacement of an office building with a 150 room hotel (85,000 sq. ft.)and a change in parking lot layout and design. This site is located south of Woolbright Road, between SCL Railroad and LWDD E-4 Canal. The request was submitted by Fred J. popper for Boynton Commerce Center. (Postponed from January 21, ~986 Agenda) Mr. Cheney said this applicant took down the illegal sign, they areistitl under citation by the Codes Enforcement Board, and he has heard nothing relative to the landscaping violations. Attorney Vance said the applicant was on notice that this application would be considered tonight by the city council; therefore, the Council could remove the item from thei Agenda for an indefinite period of time or they may consider it and either grant the request or deny it. vice Mayor Ferrell moved, seconded by Councilman Warnke, to deny the request. Attorney Vance suggested that the site plan modification to allow a 150' room hotel be considered on its merits based on the recommendations to the Council at a prior meeting for improving the general situation and the fact that there was no presentation at this meeting by the applicant. Councilman Warnke asked, if the motion is based on the applicant's noncompliance with the Code, are we not taking over the job of the Codes Enforcement Board. Attorney Vance replied that this is a PID, and the entire force and effect of a planned industrial development is that certain performance standards are built in and the applicant who is granted a PID should comply with those standards, especially in connection with the application for a modifi- cation of that PID. The motion on the floor was voted upon and carried 5-0. Mr. Richard Morsch and Mrs. Ruth Morsch, 1204 S.W. 22nd Avenue, had requested the opportunity to speak on this issue. Attorney Vance advised that this item no longer exists, as the Council has disposed of it. Vice Mayor Ferrell said the Council is showing this applicant in the strongest possible way that they must make improvements. Mrs. Morsch said all of the plants have now been removed, and the area is more barren than before construction was started, She also advised that the constuction workers are littering excessively. Mayor Cassandra suggested that Mrs. Morsch speak with the City Manager regarding this situation, which she agreed to do. C. ConSider Height variance for WXEL Antenna at proposed new site (Proposed heiqht 100 feet) Mr. Annunziato said there is a need 'to construct a 100 foot high tower, three legged with 30 feet between legs, which is - 14 - MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA FEBRUARY 18, 1986 not proposed to diminish as it goes higher but will be at that triangle at 100 feet, as it will not be guyed. The intent is to mount on this antenna at least a four-foot microwave broadcasting dish, which will broadcast to a receiving antenna west of U.S. 441, where WXEL does their radio and television transmission. He said they related the impact of the tower to the standards in Section 4F of the Code. Standard 94 concerns the height exception and whether it will be a deterrent to the improvement or development of ,surrounding properties. Property to the south is zoned C-3, and the developers of Hunter's Run to the west are con- templating a four-story office complex on their commercial property. To the east is the M-1 zoning district, and to the south is the City's property, where it is contemplated the Civ~ic Center will be built. The nearest housing tract is 1,0:00 feet away and is separated from the subject site by a lake and a golf fairway. The tower itself has no bulk and is not anticipated to be a deterrent to future development of any of the properties. In response to Councilman Warnke's question, Mr. Cheney said the offer of this parcel of land will be made to WXEL if the Council agrees that an exception will be granted to the City's height limit. Standard ~7 concerns whether the height exception would const'itute a grant of special privilege to an individual owner as contrasted with the public welfare. Mr. Annunziato thought the act of the Council to offer land is recognition that WXEL has public benefit; this is a regional public benefit which apparently will inflict no damage on the surrounding properties and does not constitute a grant of special privilege to an individual. Mr. Cheney said the Architect and Engineer for WXEL were present in the audience. Mayor Cassandra said the donating of the land is not a problem, but he was concerned that WXEL has not yet given a commitment to accept this land. He would like to determine if the surrounding community objects to the project and would like to see a conceptual drawing as to what type of building will be constructed. He heard rumors that the Palm Beach Junior College area is also trying to attract the sta- tion. He also would have liked to see the diamond shaped tower rather than the triangular. Vice Mayor Ferrell said this subject has been in the newspa- pers, and he is hesitant to create a problem. Councilman zimmerman thought the Engineer's presence at this meeting - 15 - MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA FEBRUARY 18, 1986 indicates that WXEL is interested, and if they receive what they need to operate, they will probably accept it. Mr. Ferrell added that the variance would only apply to WXEL. Councilman Warnke said it was clear when the Council approved the concept of this offer that an antenna would be required on the property. He made a motion, seconded by Councilman zimmerman, to grant the height variance con- tingent on WXEL accepting the 6.2 acres of land donated by the city. The motion carried 4-1, with Mayor Cassandra Voting against the motion. Mr. Ben Uleck, 1507 S.W. 17th Avenue, said this variance is 55 feet over our height limitation for which the people voted. Councilman Hester said the ordinance provides that the Council has the right to approve exceptions to the 45 foot height. He said there cannot be a radio station without an antenna; an antenna is not a building. Mr. Uleck asked what financial advantage the radio station offers to the taxpayers of Boynton Beach. Vice Mayor Ferrell said this is a regional facility--an educational system, and he felt that for too long Boynton Beach had refused to par- ticipate in anylthing else that happened in Palm Beach County, and that should stop. He said this is an oppor- tunity to benefit the entire community. Mr. Uleck said he did not want to drive WXEL out of the city, and Mayor Cassandra added that they need the tower. Vice Mayor Fe~rell said the ordinance says that, not only can the Council grant a variance, but if something is a necessity and certain criteria are met, it will be granted. He added that a height exception will be needed for the Police and Fire Departments' antenna. Councilman zimmerman said the ordinance was written as it was to allow for the necessi- ties. The motion carried 5-0. - 18 - MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA FEBRUARY 18, 1986 Proposed Resolution No. 86-S Re: Supporting Special Act amendments requested by Solid Waste Authority to permit special assessments a~a_~i~st real pro_~erty Mr. Cheney said the Solid Waste Authority is asking for sup- port for an amendment to their Special Act to allow the tip- ping fee for the new plant to be added to property tax bills, with the fee not to be based on valuation of property but rather on the use of it. Owners of single-family homes, commercial buildings, office buildings and retail buildings would each pay different kinds of fees for having their gar- bage dumped in the resource recovery plant and burned, based on the amount of refuse believed to be generated by their type of activity. Establishing a fee schedule would be complex, but this system would guarantee payment of the tipping fees because it would be included on the tax bills. It assures bond buyers that there is a guaranteed way to collect the money. If this guarantee is built in, a percen- tage point of savings in the interest rate is estimated, which over the of this bond issue would be $100,000,000 to in reduced cost for the financing and operation of the resource recovery plant. Mr. Cheney said he thinks that without this provision, contrary to some ~ns, the bond issue can still be sold, but it will at a higher interest rate. The Solid Waste Authority will determine countywide what the charge will be for a single-family home, as well as each of the other types of charges. The City's sanitation rates presently include collection and tipping fee charges; if this system goes into effect, the tipping fee will be dropped from the City's rate. Councilman Warnke asked if the homeowners paying no taxes because of the homestead exemption would be exempt from this charge, and Mr. Cheney advised they would not. Councilman zimmerman compared this assessment to the fee the Water Management District assesses. Mr. Cheney said this item was placed on the Agenda because the Solid Waste Authority has said, if cities want to pass a resolution such as this, it might be helpful to influence the delegation to approve the adoption of the amendment to the Special Act. The motion carried 5-0. 2. Settlement - Shell Oil Parcel Attorney Vance said he is acting as special counsel to the S.C.R.W.T. Board in connection with the condemnation of approximately four acres, which have been referred to as the Shell Oil Parcel. The suit was filed, there was an order of taking, and now we have a settlement. Our good faith esti- mate was $450,000; the settlement was $485,000, plus a uti- lity drainage easement. Mr. Vance said he normally recommends settlement of eminent domain suits at 10 percent or better, because it costs that much to try the case. This one is 7 percent; Boynton Beach's cost will be half of that. This has previoUsly been approved unanimously by the S.C.R.W.T. Board, and he recommended that the Council authorize him to execute this settlement on behalf of the city of Boynton Beach. Vice Mayor Ferrell moved, seconded by Councilman Warnke, to authorize the City Attorney to exe- cute the settlement. The motion carried 5-0. OLD BUSINESS A. Consider proposal to employ lobbying services as a joint agreement with other Palm Beach County cities ..... TABLED Vice Mayor Ferrell said he did not bring a copy of the pro- posed rules. Four or five other cities are now indicating an interest; therefore, the rules may have to be revised, as most of them pertain to a three-city type of agreement. He hopes to know which cities are interested by the next - 20 - MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA FEBRUARY 18, 1986 Council meeting and will have some type of a draft. Mr. Ferrell said it is uncertain whether this will be in effect in time for this legislative session. The item remained on the table. B. Approval of design contract with Edward D. Stone for preparation of plans at west portion of Boat Ramp Park Mr. Cheney recommended that the Council authorize a formal agreement with Edward D. Stone to proceed with the develop- ment of the construction plans for the frontage of Boat Ramp Park. He said the Council reviewed the conceptual design some time ago and approved it. The final design, if approved, is expected to be finished in six to eight weeks. At that time, we will commence the bidding, advertising, contract selection and construction. The money is in the Capital Improvements program. Councilman Warnke moved, seconded by Vice Mayor Ferrell, to authorize the execution of this agreement with Edward D. Stone. Mayor Cassandra mentioned an article in the Sun Sentinel newspaper regarding Betty's Apartments. Mr. Cheney said, when the City entered into the agreement with Betty, the schedule of dates was very clearly understood; the City was to give her 90 days notice and vacating was to take place at about this time. A letter has been sent to her attorney stating that, if she does certain things, the situation will be discussed with the City Council. The motion was voted upon and carried 5-0. NEW BUSINESS None.
