Minutes 01-20-10 MINUTES OF THE CODE COMPLIANCE BOARD MEETING HELD ON WEDNESDAY, JANUARY 20, 2010, AT 6:30 P.M. Call to Order Chair Costantino called the meeting to order at 6:30 p.m. II. Approval of November 18, 2009 and December 16, 2009 Minutes November. 18, 2009 Minutes Mr. Foot requested a correction to the second line of the "Correction to Code Board Hearing Minutes" sheet included with the meeting materials relating to page 16 of the minutes. He believed the case was numbered 09-3282 rather than 09-3287. Motion Mr. Foot moved approval of the minutes as amended. Vice Chair Yerzy seconded the motion that passed unanimously. December 16, 2009 Minutes Mr. Foot moved approval of the minutes as amended. Vice Chair Yerzy seconded the motion that passed unanimously. III. Approval of Agenda Vestiguerne Pierre, Senior Code Officer, reported the following: The following cases complied: #09-3500, #09-3571, #09-3606, #09-3786, #09-3848 and #09-9~640 and # 09-3786. The following cases were removed: #09-2327, #09-3675, #09-3681 and #09-3712. 1 Meeting Minutes Code Compliance Board Boynton Beach, Florida January 20, 2010 Officer Pierre recommended Case #09-3170 be tabled until February 17, 2010. Motion Mr. Foot moved that Case #09-3170 be tabled until the Code Compliance Board meeting to be held on February 17, 2010. Mr. Brake seconded the motion that unanimously passed. Motion Mr. Foot moved approval of the agenda. Vice Chair Yerzy seconded the motion that passed unanimously. II. Swearing in of Witnesses and Introduction Attorney Tolces set forth an explanation of the hearing procedure and administered the oath to all who would be testifying. Chair Costantino reminded the Board to refer to the symbols set forth on the last page of the agenda for additional information on the cases. Officer Pierre called the roll and determined who was present. Case #09-3333 Deutsche Bank National Trust Co. Location: 440 Ocean Parkway Violations: CO CH10 Ord. 09-040 Inc. CO CH15 SEC. 15-120(D) Inc. Register vacant foreclosure property and remit $150 fee. Mow overgrown areas and trim overgrown vegetation. Courtney Cain, Code Officer, presented the case and reviewed the details of the violations. The property was initially inspected on October 14, 2009. The overgrown areas have been mowed and trimmed and all that remained was the registration of the property. Written notice of the violation was provided. The Respondent was given 10 days to comply. Service was effectuated by certified mail. Joe Bilotta, 1920 Wekiva Way, West Palm Beach, noted he was present on behalf of the Albertelli Law firm, representatives for Deutsche Bank. He pled no contest. Mr. Bilotta received a check for $150 payable to the Police Department and would require "a few days" to secure the fee and file the application. 2 Meeting Minutes Code Compliance Board Boynton Beach, Florida January 20, 2010 Motion Based on the testimony and evidence presented in Case #09-3333, Vice Chair Yerzy moved that this Board find that Deutsche Bank National Trust Co. is in violation of the City of Boynton Beach Code sections cited and moved to Order that the Respondent correct the violations on or before February 19, 2010. The Board has considered the gravity of the violations, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $50 per day for each day the violations continue past February 19, 2010 plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re-inspection of the property to verify compliance with this Order. Mr. Foot seconded the motion that unanimously passed. Chair Costantino requested the cases for which attorneys were present be addressed next. There was no objection by the Board. Case #09-3895 Bank of America, N.A. Location: 930 Chapel Hill Blvd. Violation: CO CH10 Ord. 09-940 Inc. Restore pool to sanitary condition, secure barrier around pool and perform yard maintenance. Skip Lewis, Senior Code Officer, presented the case and reviewed the details of the violation. The attorney for the Respondent was present. th Laurence Barsky, with the law office of Marshall Watson, 1800 NW 49 Street, Suite 120, Fort Lauderdale, pled no contest. The property was still in foreclosure proceedings. Mr. Barsky requested 30 days be given to bring the property into compliance. Mr. Foot suggested 10 days be given for compliance. Motion Based on the testimony and evidence presented in Case #09-3895, Mr. Foot moved that this Board find that Bank of America, N.A. is in violation of the City of Boynton Beach Code section cited and moved to Order that the Respondent correct the violation on or before January 30, 2010. The Board has considered the gravity of the violation, the actions taken by the Respondent and any previous violations by the Respondent 3 Meeting Minutes Code Compliance Board Boynton Beach, Florida January 20, 2010 and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $500 per day for each day the violation continues past January 30, 2010 plus administrative costs shall be imposed. Mr. LaRock seconded the motion that unanimously passed. Case #09-3728 US Bank National Association th Location: 145 SW 13 Ave. Violations: CO CH10 Ord. 09-040 Inc. CO CH15 SEC. 15-120(D) Inc. Register vacant foreclosure property. Remit $150 fee. Remove all trash, horticultural and other debris. Trim hedges on west side. Pete Roy, Chief Code and Rehabilitation Officer, presented the case and reviewed the details of the violations. Service was effectuated by certified mail. Officer Roy provided photographs for the Board's review. The Respondent was given 10 days to comply. th Joanne Galipault, of the law firm of Marshall Watson, 1800 NW 49 St., Suite 120, Fort Lauderdale, pled no contest. A good deal of work was required on the property, and she requested 30 days to bring the property into compliance. Motion Based on the testimony and evidence presented in Case #09-3728, Vice Chair Yerzy moved that this Board find that US Bank National Association is in violation of the City of Boynton Beach Code sections cited and moved to Order that the Respondent correct the violations on or before February 19, 2010. The Board has considered the gravity of the violations, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $150 per day for each day the violations continue past February 19, 2010 plus administrative costs shall be imposed. CO CH15 SEC. 15-120(D) Inc. 4 Meeting Minutes Code Compliance Board Boynton Beach, Florida January 20, 2010 Register vacant foreclosure property and remit $150 fee. Mow overgrown yard and remove all trash and debris. Officer Roy presented the case and reviewed the details of the violations. The property was initially inspected on November 25, 2009 and the Respondent was given 10 days to comply. Service was effectuated via certified mail. The City recommended 10 days for compliance. th Joanne Galipault, of the law firm of Marshall Watson, 1800 NW 49 St., Suite 120, Fort Lauderdale, pled no contest and requested 30 days to comply in order to engage a contractor to regularly maintain the property. Motion Based on the testimony and evidence presented in Case #09-3783, Ms. Carroll moved that this Board find that US Bank National Association is in violation of the City of Boynton Beach Code sections cited and moved to Order that the Respondent correct the violations on or before February 19, 2010. The Board has considered the gravity of the violations, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $100 per day for each day the violations continue past February 19, 2010 plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re-inspection of the property to verify compliance with this Order. Mr. Brake seconded the motion that unanimously passed. Case #09-3917 Wells Fargo Bank th Location: 117 SW 13 Ave. Violations: CO CH10 ORD. 09-040 INC. CO CH15 SEC. 15-120(D) INC. CO CH10 SEC. 10-56(A) CO CH10 SEC. 10-56(B) CO CH10 SEC. 10-56(C) Mow and trim overgrowth. Register property. Clean pool and maintain in sanitary condition. Officer Roy presented the case and reviewed the details of the violations. Staff cited Wells Fargo Bank for the vacant property, which was in foreclosure. A lis pendens had been filed. The property was initially inspected on December 15, 2009. Written notice was provided on December 16, 2009. The Respondent was given 10 days to comply. 5 Meeting Minutes Code Compliance Board Boynton Beach, Florida January 20, 2010 Service was effectuated by certified mail on December 28, 2009. The green card was signed but no date was provided. The property had been registered. Officer Roy spoke with the real estate agent and she advised there was no electricity to circulate the water in the pool. Staff still recommended 10 days for compliance. Photographs were provided for the Board's review. th Joanne Galipault, of the law firm of Marshall Watson, 1800 NW 49 St., Suite 120, Fort Lauderdale, pled no contest and requested seven days to cure the pool violation and 30 days to find someone to maintain the yard and bring all other violations into compliance. Motion As to the pool cleanliness only, based on the testimony and evidence presented in Case #09-3917, Mr. Foot moved that this Board find that Wells Fargo Bank is in violation of the City of Boynton Beach Code sections cited and moved to Order that the Respondent correct the violations on or before January 30, 2010. The Board has considered the gravity of the violations, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $250 per day for each day the violation continues past January 30, 2010 plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re-inspection of the property to verify compliance with this Order. Mr. Brake seconded the motion that unanimously passed. Motion As to the maintenance of the yard, based on the testimony and evidence presented in Case #09-3917, Ms. Carroll moved that this Board find that Wells Fargo Bank is in violation of the City of Boynton Beach Code sections cited and moved to Order that the Respondent correct the violations on or before February 19, 2010. The Board has considered the gravity of the violations, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $100 per day for each day the violations continue past February 19, 2010 plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re-inspection of the property to verify compliance with this Order. Mr. LaRock seconded the motion that unanimously passed. Case #09-3601 Keith L. Johnson rd Location: 310 NE 23 Ave. Violation: CO CH15 SEC. 15-120(D) INC. 6 Meeting Minutes Code Compliance Board Boynton Beach, Florida January 20, 2010 Remove all construction materials and equipment from property. Officer Cain noted the Respondent was no longer present. No action was taken at this time as the case was new. Case #09-3844 Jesse and Janice L. Webb Location: 2130 NW1st Street Violation: CO CH15 SEC.15-120(D) INC. Remove all outside storage from carport. Storage of unlicensed and inoperable vehicle is not allowed in residential areas. Luney Guillaume, Code Officer, noted the Respondents had complied. Motion Mr. Foot moved to dismiss Case #09-3844, with compliance having been fulfilled. Mr. LaRock seconded the motion that passed unanimously. Case #07-350 Martins Barbeque Inc. Location: 399 Winchester Park Blvd. Violations: CH15 ART. IX-15-120(D) 1 INC. 15-18 B.B.C OF ORD. PT3-LDR CHAPTER 4 SEC. 11 PT3-LDR CH7.5-II. SEC. 5.B. Bring property back to original site plan. Mow, trim and weed yard. Remove all junk, trash, debris and graffiti from property. John Herring, Code Officer, presented the case and reviewed the details of the violations. The property was initially inspected on February 2, 2007, and the Respondent was given 15 days to comply. Notice was sent via regular and certified mail and the green card was signed. Officer Herring has had continued contact with the representatives of the company, who have also worked with staff. While a number of parties had been interested in taking over the property, none of the contracts had ever been completed. The case was brought back as it had gone on for too long a period of time and a number of citizen complaints had been received. A representative from the company was present. Officer Herring provided photographs for the Board's review. 7 Meeting Minutes Code Compliance Board Boynton Beach, Florida January 20, 2010 Jim Klinker, 2731 Vista Parkway, D-10, West Palm Beach, pled no contest. He had been working with Officer Herring on this case for some time. Pursuant to Officer Herring's suggestion, it was Mr. Klinker's intent to meet with Kevin Hallahan next week in order to establish a plan of action. The vacant building was recently vandalized, and repairs to the copper pipes would amount to $14,000. The graffiti had been recently painted over. Mr. Klinker believed he would require a minimum of 90 days to come into compliance. Officer Herring would be amenable to tabling the case for 30 days as long as Mr. Klinker established a game plan and provided a schedule advising how long it would take to comply with the irrigation and landscaping requirements. Motion Mr. LaRock moved that Case #07-350 be tabled until the Code Compliance Board meeting to be held on February 17, 2010. Ms. Carroll seconded the motion that unanimously passed. Mr. Blasie provided an overview of the lien reduction procedure, as well as the appeal process. If requested, letters advising of the Board's actions could be provided to a lender, real estate agent or title company requiring immediate information. Case #08-2509 Christin Demesmin 10 Crossings, Circle G Scott Blasie, Code Compliance Administrator, advised the Respondent was originally cited on August 29, 2008 for violations to the City's Code of Ordinances. A plumbing leak in the unit had damaged the unit below. The case appeared before the Board on October 15, 2008, and no one had appeared. A date and fine had been established of October 25, 2008, or $250 per day. Staff had documented compliance on November 24, 2009, with 394 days of non-compliance. Mr. Blasie did have photographs evidencing the damage, but did not have "after" photographs. As a result of Ms. Carroll's efforts as a member of the Homeowner's Association for the property, Mr. Blasie was able to conduct a full lien reduction inspection of the unit. The plumbing issue had been remedied and the unit was vacant. Photographs had also been taken of the unit on August 28, 2008 evidencing the source of the leak and mold on the ceiling. These issues had been remedied as well. John Baughman, of The Real Estate Office Company, 1800 Forest Hill Boulevard, Suite A7, West Palm Beach, was the listing agent for the bank that had taken over the property, which was under contract for just under $30,000. The Certificate of Title was received on September 4, 2009. Mr. Baughman was made aware of the violations by 8 Meeting Minutes Code Compliance Board Boynton Beach, Florida January 20, 2010 Ms. Carroll on September 14, 2009, and the damages were repaired by November 9, 2009. As such, Mr. Baughman was requesting a reduction of the lien. He was not aware of any outstanding expenses relating to the property. However, costs of $3,000 were incurred to repair the entire unit, including all valves and both bathrooms. Ms. Carroll explained the photographs were provided by the homeowner residing in the bottom unit. The owner at the time, Christin Demesmin, had previously appeared before the Board, advising he did not believe the leak had emanated from his unit. His tenant refused to allow anyone into the unit. Shortly after the Board had levied the $250 fine and the unit had been vacated, the Association shut the water off and repaired the damage. The upstairs unit had been vacant until being taken over by the bank. To the bank's credit, the entire unit had been refurbished within 30 days. Ms. Carroll pointed out the aforementioned $250 fine had been levied as Mr. Demesmin had appeared before the Board on numerous occasions for the property in question as well as other rental properties he owned. Motion Based on the testimony and evidence presented in Case #08-2509, and having been advised that the Respondent has complied with all lien reduction procedures set forth in Section 2-84 through 2-89 of the City of Boynton Beach Code of Ordinances, Vice Chair Yerzy move that this Board rescind the fine instituted in Case #08-2509, by virtue of this Board's Order of October 15, 2008, and that the lien imposed by that Order be released. Ms. Carroll seconded the motion. Mr. Foot did not believe the fine should be waived in this case as the Association had suffered in many respects. It was his belief the Board should consider a nominal fine of $5,000. Ms. Carroll disagreed. Mr. Baughman took measures to ensure that the damages were repaired. As such, rather than remaining vacant, the property could now be sold, with the new owner remitting the required maintenance to the Association. The vote passed 5-2 (Messrs. Foot and LaTour dissenting). th Case #09-1692 Laurel F. Martin 709 SW 25 Ave. Mr. Blasie noted the Respondent had originally been cited on June 3, 2009 for a "green pool." The case was presented to the Board on August 19, 2009 and no one had appeared. A compliance date of August 29, 2009 was established with a $250 per-day fine. Staff had documented compliance on December 29, 2009, for 121 days of non- compliance. Mr. Blasie provided a photograph taken August 16, 2009 depicting the green pool, and another photograph taken January 10, 2009 showing the front of the 9 Meeting Minutes Code Compliance Board Boynton Beach, Florida January 20, 2010 house. Officer Roy had visited the premises and verified that the pool was "crystal clear." Raquel James, 1830 Embassy Drive, West Palm Beach, noted she was employed by the property owner. Aside from the $1,000 incurred to bring the pool into compliance, $7,000 was owed in delinquent taxes by the previous owner, and an additional $15,000 was expended on the property. The property was purchased on November 24, 2009 and was brought into compliance shortly thereafter. The owner was not aware that another inspection was necessary. Motion Based on testimony and evidence presented in Case #09-1692, and having been advised that the Respondent has complied with all lien reduction procedures set forth in Section 2-84 through 2-89 of the City of Boynton Beach Code of Ordinances, Mr. LaTour moved that this Board reduce the fines instituted in Case #09-1692, by virtue of this Board's Order of August 19, 2009, to an amount of $634.12, including administrative costs. Mr. LaRock seconded the motion that passed 6-1 (Mr. Foot dissenting). rd Case #09-1304 HSBC Bank USA 225 NW 3 Ave. National Assn. TR Mr. Blasie reported the HSBC Bank was originally cited on May 1, 2009 for an unpermitted carport enclosure. The case was presented to the Board on July 15, 2009, and no one had appeared. A compliance date and fine had been established of July 23, 2009, or $500 per day. Staff documented compliance on September 9, 2009, for 45 days of non-compliance. HSBC took title to the property on March 20, 2009. Mr. Blasie provided to the Board a photograph reflecting the carport enclosure. Photographs were also taken this date. Steven Petrucci, 2700 W. Cypress Creek Road, Suite C-103, Fort Lauderdale, noted he and the gentleman with him were the new owners of the property purchased from HSBC on July 24, 2009. They had incurred expenses of $19,869 to bring the property into its current condition. It was the intention of the purchasers to sell the home. Mr. Blasie agreed the property was immaculate and a "knockout" after the improvements were made. Mr. Petrucci and the other gentlemen had purchased property across the street as well, in an effort to revitalize the neighborhood. Motion Based on testimony and evidence presented in Case #09-1304, and having been advised that the Respondent has complied with all lien reduction procedures set forth in 10 Meeting Minutes Code Compliance Board Boynton Beach, Florida January 20, 2010 Section 2-84 through 2-89 of the City of Boynton Beach Code of Ordinances, Mr. Foot moved that this Board reduce the fines instituted in Case #09-1304, by virtue of this Board's Order of July 15, 2009, to an amount of $3,134.12, including administrative costs. The motion died for lack of a second. Motion Based on testimony and evidence presented in Case #09-1304, and having been advised that the Respondent has complied with all lien reduction procedures set forth in Section 2-84 through 2-89 of the City of Boynton Beach Code of Ordinances, Ms. Carroll moved that this Board rescind the fine instituted in Case #09-1304, by virtue of this Board's Order of July 15, 2009, and that the lien imposed by the Order be released. The motion died for lack of a second. Motion Based on testimony and evidence presented in Case #09-1304, and having been advised that the Respondent has complied with all lien reduction procedures set forth in Section 2-84 through 2-89 of the City of Boynton Beach Code of Ordinances, Vice Chair Yerzy moved that this Board reduce the fines instituted in Case #09-1304, by virtue of this Board's Order of July 15, 2009, to an amount of $634.12, that being administrative costs. Mr. Brake seconded the motion. Mr. LaTour suggested the fine be reduced to a total of $1,500 including administrative costs. Messrs. Yerzy and Brake agreed and the motion passed unanimously. Mr. Petrucci noted he and the other gentleman had purchased the property with the preexisting condition. Mr. Petrucci reiterated the lien search performed through the City indicated there had been no liens on the property, and Mr. Petrucci had no idea the fine had been accruing. At the time he learned of the violation, he had secured a permit and immediately cured the violation. Attorney Tolces advised Mr. Petrucci could appeal the decision of the Board, or the Board could make a motion to reconsider. Motion Ms. Carroll moved to reconsider. Vice Chair Yerzy seconded the motion that passed 6-1 (Mr. Foot dissenting). Diane Springer, Code Compliance Coordinator, noted Mr. Petrucci had visited the office seeking a lien reduction. Upon checking the file, Ms. Springer observed that the 11 Meeting Minutes Code Compliance Board Boynton Beach, Florida January 20, 2010 City's lien was filed at the time of Mr. Petrucci's purchase of the property. A lien search was performed through the City at the same time the case commenced, and the lien had not appeared on the search. The lien only became evident at the time Mr. Petrucci attempted to sell the property, and Mr. Petrucci took measures to bring the property into compliance within 10 days. He did not realize, however, that the fine was accruing and never telephoned staff to advise the property had come into compliance. Board comments included the following: ?The liens on the property existed through no fault of the purchasers. Upon learning of the existence of the lien, they took immediate measures to cure the violation. ?Once again, the Board would be punishing people who had incurred considerable costs to bring the property into compliance and who had taken the time to find a buyer who would maintain the property and pay for water usage and taxes. ?The Commissioners had recently rescinded action taken by the Board in some of the cases where it was believed the wrong people had been punished. ?The purchasers were not being treated fairly, and the fine should be rescinded. ?The purchasers understood the risks involved and that problems could occur. A minimal amount of $1,500 should be levied. Motion Based on testimony and evidence presented in Case #09-1304, and having been advised that the Respondent has complied with all lien reduction procedures set forth in Section 2-84 through 2-89 of the City of Boynton Beach Code of Ordinances, Vice Chair Yerzy moved that this Board reduce the fines instituted in Case #09-1304, by virtue of this Board's Order of July 15, 2009, to an amount of $634.12, that being administrative costs. Mr. Brake seconded the motion that passed 5-2 (Messrs. Foot and LaTour dissenting.) Case #05-872 Sandalwood at Boynton Beach 100 Buttonwood Ln. Mr. Blasie reported the Respondent had originally been cited on April 28, 2005 for violations to the City's Land Development Regulations and Community Appearance Code. The violations had been issued for site maintenance, including all landscaping, painting and staining roofs and fences. The case had been presented to the Board on September 19, 2007, and no one had appeared. A compliance date and fine had been 12 Meeting Minutes Code Compliance Board Boynton Beach, Florida January 20, 2010 established of October 16, 2007, or $500 per day. Staff had documented compliance on November 3, 2009 for 748 days of non-compliance plus the administrative costs. Four photographs taken this date were provided to the Board for review. Alan Borrelli, 100 Buttonwood Lane, President of Sandalwood Homeowner's Association, requested a reduction of the violations. The Association had remedied the violations and expended more than $200,000 in improvements which were described in a binder he distributed to the Board. He contended the violations consisted of missing trees and trees that were destroyed by hurricanes over five years, and dirt around the trees, flower beds and townhouses. The fines had been levied as Scott Straleau of Gulfstream Management, (the previous management company), had disregarded letters sent by the City requiring him to appear before the Board. The Board had terminated Mr. Straleu's services a month after taking over the management of the complex. Under the guidance of Kevin Hallahan, the Association had installed more than 80 new trees and plants, and added mulch, new flowering plants and shrubs around the dumpster and utility boxes. The existing and newly-planted trees had been surveyed and mapped. The swimming pool was re-decked, the tennis and basketball courts refinished and the irrigation system renovated. The Association could not afford to satisfy the $500-per-day fine. Mr. Blasie noted that Mr. Straleau managed a number of properties in Boynton Beach and had remained in contact with staff since 2005. Mr. Straleau met with Mr. Hallahan and developed a management plan which would bring the property into compliance. The City's Code required a tremendous amount of acreage and foliage for a condominium community of this size. With regard to past hurricanes, the Association had submitted a plan on October 12, 2005 that was approved by Mr. Hallahan. A letter had been received from Mr. Straleau on February 13, 2007 with regard to an amended plan approved by Mr. Hallahan to replace 10 trees per year. During this time, the Association also addressed building and fence maintenance issues. The scope of work undertaken was tremendous and had taken some time to complete. Portions of the work required a special assessment. Chair Costantino expressed concern as the violation dated back to 2005. While there had been hurricanes and other issues, there was no economic crisis at that time. The Association still collected fees and should have maintained the property rather than minimize its responsibilities. Mr. Borrelli noted Mr. Straleau never approached Sandalwood's Board of Directors to advise that he had been working with Code Compliance or that the violations had to be corrected. Additionally, Mr. Straleau had not pulled the necessary permits for the fence construction. Mr. Borrelli did not believe the new Board should be responsible for Mr. Straleau's actions. 13 Meeting Minutes Code Compliance Board Boynton Beach, Florida January 20, 2010 Christopher Risk, the new property manager hired by Sandalwood, noted the complex was comprised of 300 acres and 332 units, with approximately 15 foreclosures and arrearages of $193,000 to date. The Association spent approximately $256,000 in improvements from 2008 to 2009. Special assessments would be required for major fines. In the last year, unit owners were assessed $5,000 each for the mansard roof repair for damages caused by Hurricane Wilma. While the binder provided indicated a total of $178,706.26 had been expended for improvements, Mr. Risk advised approximately $150,000 was spent to bring the property into compliance. Comments by the Board included the following: Mr. Foot suggested a fine of $25,000, as the Association should have maintained the property. Vice Chair Yerzy felt the community was well maintained, and this should be taken into consideration.
