Minutes 10-15-85MINUTES OF THE REGULAR CITY COUNCIL MEETING HELD AT CITY HALL BOYNTON BEACH, FLORIDA, TUESDAY, OCTOBER 15, 1985 AT 7:30 P.M. PRESENT Nick Cassandra, Mayor Robert Ferrell, Vice Mayor Ezell Hester, Jr., Councilman James R. Warnke, Councilman Carl Zimmerman, Councilman , ] a] Peter L. Cheney, City Manager Betty S. Boroni, City Clerk James W. Vance, City Attorney .y~r Cassandra called the meeting to order at 7:30 p.m. and welcomed audience. The Invocation was given by Reverend Michael Heusel, the Pledge of Allegiance to the Flag was led by Attorney James AGENDA APPROVAL :ilman Warnke requested that under Old Business the discussion of Day Care Center be added. City Manager Cheney wanted to delete the Consent Agenda Item No. 7, which pertained to development for Woolbright Professional Plaza, and add that item for ~sion under VII. Development Plans as part of the regular agenda. a bill for payment for All-Rite Paving Company in the amount 22,531.77 for work done in Cherry Hills. Mr. Cheney requested two bids be added to the agenda to cover Golf Course materials; was for 5,600 pounds of grass seed at prices of $2,296 and $2,128 different vendors) and the other for 20 tons of fertilizer at a of $5,380. Under Administrative he added an item relative to City's delegates to the South County Council of Governments. Cassandra added a second Proclamation regarding Lupus Awareness and an announcement he wanted to make in reference to the City er. Councilman Warnke moved, seconded by Vice Mayor Ferrell, to the Agenda as corrected; the motion carried 5-0. ~N~OUNCEMENTS Cassandra read the following proclamations: A. Energy Awareness Week - October 20 through 27, 1'985 B. Lupus Awareness Week - October 20 through 26, 1985 Next City Council Meeting Date Mayor Cassandra announced that the next City Council meeting will be ednesday, November 6, 1985, due to the Palm Beach County elections to be held on Tuesday, November 5. ~nnouncement in Reference to the City Manager Cassandra read the following statement, "It is the consensus of Council that the issue relative to the City Manager is closed." He made a motion, seconded by Councilman Zimmerman, that the issue be closed. The motion carried 5-0. CITY MANAGER'S REPORT Save Water Program Mr. Cheney said the Consent Agenda contains an annual report on this successful program, with which the City has been involved for some time. The leader of the program was present in the audience. Tia Clemmons' Birthday Party Mr. Cheney wanted to remind people of this party being held Saturday, October 19, beginning at 9:00 a.m., with which a number of prominent Bo~nton Beach citizens have been involved and are promoting. He hopes many people will come out and enjoy themselves and support this very special city-wide program for Tia. Boynton Beach Mall Opening The mall, which has been planned since 1973 or 1974, opened October 2; this was a major and successful event. Mr. ney said the newspaper article pointed out that these pagers are ng engineered and produced at Motorola's Paging Division in Boynton just prior to his Mr. Martin Perry, representing Tradewinds Development Corporation and Kieran J. Kilday Associates, who have petitioned for six separate - 2 - MINUTES-REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA OCTOBER 15, 1985 zoning changes and Comprehensive Plan amendments, said he last appeared before the Council on September 25, when a meeting had been scheduled for the second reading of six separate ordinances pertaining to their applications. At the meeting, there were six separate motions to approve the individual proposed ordinances on second reading; each of the motions died for lack of a second, after which the meeting adjourned. Mr. Perry said he has researched Robert's Rules of Order, to which the City of Boynton Beach adheres for proce- dural purposes, the City's Charter, the City's Zoning Ordinance, American Parliamentary Procedure and has sought the opinion of a cer- tified professional parliamentarian. He has written a letter to Mr. and sent him, a copy of a letter he has received from the red professional parliamentarian. Mr. Perry said he has ~d t~at, Under RObert's Rules of Order and any applicable laws and charters, no action has been taken by the City Council of City of Boynton Beach on the six ordinances. Mr. Cheney said the procedure for matters brought up in the public audience is that back with some kind of response at the next Council meeting. Mr. Perry said his intent and his client's right is to see what they spent their money for; they feel that a vote was never taken--but should be- -to either deny or approve these ordinances. He said he cannot proceed from this point without a decision of the Council; he said if the five CoUncil Members think a decision has been reached by this Council on those six ordinances and that the decision is a denial, they should so state for the record so he is free to proceed. Mayor answer would have to come from our recognized and this will be addressed one way or another by the next Council meeting. This request was submitted by Russell P. Kiviniemi for Boynton West Corporation and is to be known as Meadows 300, Tract M. The Planning and Zoning Board unanimously recommended approval of this request, subject to staff comments. Consider request for site plan approval to construct a 32,000 square foot office building on 1.66 acres on the east side of Knuth Road, south of West Boynton Beach Boulevard. This request was submitted by Robert Steiner for V. J. Gallo and is to be known as Knuth Road Office Building. The Planning and Zoning Board unanimously recommended approval of this request, subject to staff comments. Consider request for approval of an amended site plan to allow for the addition of an access driveway to Congress Avenue. Approve Chanqe Order No. 1, Cherry Hills Improvements Phase IIB Mr. William V. Flushing, Deputy City Engineer, submitted change order under cover of his memo of October 10, 1985, to the City Manager. P. Approval of Bills See attached list, plus bill for All-Rite Paving in the amount of $22,531.77 for Cherry Hill improvements, Phase IIB (General Fund 001-000-115-87-00). Vice Mayor Ferrell moved, seconded by Councilman Hester, to approve the Consent Agenda as presented with the deletion of Items D-7, E and G and with the addition of the added bill for payment to All-Rite Paving, Inc., in the amount of $22,531.77. The motion carried 5-0. Ee Consider approval of request submitted by Mr. Timothy Wood for renewal of his permit for the use of a construction trailer on the property site of Arden Park Lots 40-43, located on N.E. 3rd Street. Councilman Warnke had the City Clerk run copies of the Codes Enforcement Board Meetings regarding the Wood property. There is no building permit on this property at the present time, although the Codes Enforcement Board stated that one should be obtained before Mr. Wogd could receive permission for the trailer. Mr. Kopczynski, Deputy Building Official, confirmed that the trailer is in violation. Councilman Warnke said in his opinion the property is a mess and a blight to the neighborhood; there is a huge pen full of building materials. The owner has been cited by the Codes Enforcement Board. Until a proper permit is presented, he moves to deny the request for a trailer on that site. Before accepting the motion, Mayor Cassandra asked if the applicant wished to respond to Councilman Warnke's state- me~ts. Mr. Cheney said, if he had b~en aware of and up to date on this situation, it would not have been on the agenda, and approval of the trailer would not have been recommended. He said there is no reason for the trailer to be on the lots without a permit; they recom- mend that this not be approved. The violation should be cleaned up, a building permit obtained, then a request can be submitted for the trailer. Mr. Timothy Wood said he is totally shocked; this was not the way he understood things would go. He said he is presently working on having ne~~ permits drawn up for the building. Mr. Wood said he apologizes an~ will do what he can to straighten up the situation. Vice Mayor Ferrell seconded Councilman Warnke's motion to deny the request for the construction trailer on Arden Park Lots 40-43. Accept donation from Boynton Beach West Lions Club Councilman Warnke moved, seconded by Councilman Zimmerman, that the City Council send a letter to the Boynton Beach West Lions Club acknowledging and thanking them for their donation of the picnic table with benches to be placed in Boat Club Park. The motion carried 5-0. BIDS A. 5,600 Pounds of Grass Seed for the Municipal Golf Cours~ The Tabulation Committee recommends awarding the bid in part: 2,800 lbs. "FIESTA" to AG Resources, Inc., Brandon, FL - $2,296.00 2,800 lbs. "P-2" Woodburg Chemical Co., Princeton, FL - $2,128.00 Councilman Hester moved, seconded by Vice Mayor Ferrell, to approve this bid as recommended by the Tabulation Committee. The motion carried 5-0. B. 20 Tons of Bulk Fertilizer for the Municipal Golf Course The Tabulation Committee recommends awarding the bid to Consolidated Chemicals, Pahokee, Florida in the amount of $5,380.00. Vioe Mayor Ferrell moved, seconded by Councilman Hester, to approve th~s bid as recommended by the Tabulation Committee The motion carried 5-0. PUBLIC HEARING ae Annexation, Land Use Amendment and Rezoning requests submitted by Kieran Kilday for Greentree Plaza II. (Hearing continued until Planning & Zoning Board Meeting of November 12) Mr. Cheney said the developer requested that the hearing be continued, and asked Attorney Vance if this could be continued until the second hearing in November without having to advertise again. Attorney Vance replied that it could be. Councilman Zimmerman moved, seconded by Councilman Warnke, to continue the hearing for the annexation, land us~ amendment and rezoning request submitted by Kieran Kilday for Greentree Plaza II until November 19, 1985, at 8:00 p.m. The motion carried 5-0. DEVELOPMENT PLANS Am Consider request for approval of an amended site plan to allow for the addition of an access driveway to Congress Avenue. This site is located on the south side of Woolbright Road east of Congress Avenue, and the request was submitted by John F. Wheeler for J. Ronald Simmons. (Woolbriqht Professional Plaza) - 9 - MINUTES-REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA OCTOBER 15, 1985 Mr. Cheney said Mr. Carmen Annunziato, Director of Planning, was invited to go to Tallahassee and participate with a group of Planners from throughout the State as a special committee to help prepare' the standards and guidelines for the new Comprehensive Planning Act. He is there for three days. Mr. Tim Cannon, Senior Planner, is present to answer questions regarding this request, and Mr. Cheney read his memorandum stating that Mr. John F. Wheeler has informed the Planning Department that he has been in contact with Lindsley Lumber Company, Inc., concerning the Planning Department's staff comments requiring the dedication of 10 feet of right of way for the future widening of Con Avenue. The right of way to be dedicated represents the of a 35 foot access easement, which runs parallel Villas and connects the Woolbright Professional Plaza to Avenue. Mr. Wheeler said Lindsley Lumber Company has agreed to in question and will submit a letter to the Planning stating their intent. Due to their Chapter ll reorganiza- ti however, it is not likely the right of way will be dedicated 45 days stipulated by the Planning Departmen%and approved he Planning and Zoning Board. Mr. John Wheeler, Caulfield & Wheeler, Inc., 2290 N.W. 2nd Avenue, Suite 3, Boca Raton, Florida 33431, said the access road being con ucted was an easement that was granted for ingress and egress by Li] ~y Lumber to his client through the sale of the property. This is from Congress Avenue going east about 300 feet. His client advised him that they have title to the property and would have no problem in gra~ting the easement within 45 days. As Lindsley Lumber is under reorganization, they cannot determine how long it will take to obtain the additional dedication; they agreed they will give it. Mr. Wheeler sai.], if they come in for site plan approval, the dedication require- men will be on at that time--if it was not granted now. He asked how lon, his client can take for this matter. Mr. Cannon said this access was not shown on the original site plan; it only showed one access off of Woolbright Road. The City did not ask for the access off Congress; the applicant came in and asked the City to approve an amended site plan showing the access. Mr. Cheney asked if this could be left in limbo until the problem is solved, and our requirement can be met. Mr. Cannon did not see a problem with that as long as we have a letter from the applicant stating the right of Way will be dedicated. Attorney Vance suggested that, even though Lindsley Lumber Company is going through Chapter 11, there is a high probability that within 30 to 90 days an order can be obtained approving such a dedication. He said he has no problem with Mr. Cheney's suggestion if the Plannin Department does not. g Mr. Wheeler said his client needs to get this road constructed as part of the financing package for the project, to which Mr. Cheney replied that they have ~ strong need to obtain that dedication from Lindsley. - 10 - MINUTES-REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA OCTOBER 15, 1985 Mr. Vance said we could take an optimistic approach, continue it for 30 more days, and see how they do. Mr. Wheeler said his client has already started construction of the wall along the west and south sides of the property, and they want to continue with it. Mr. Cheney said the City is actively involved in getting the right of way for Congress Avenue now--not some time in the future--as Congress is funded and under design by the County for four lanes; this is needed for the mall. He suggested that Mr Wheeler see what he can do and d~scuss it with ham before November 6 to see if the problem can be resolved. Councilman Warnke moved, seconded by Vice Mayor Ferrell, to postpone this request until the November 6 Council meeting. Mr. Wheeler asked if the 45 day requirement is being cut to 30 days. Mr. Cheney said the applicant cannot promise to meet the 45 day requirement; there- fore, before the Council extends the time further, he and the appli- cant will try to come to a better understanding of Lindsley's position. The motion was voted upon and carried 5-0. LEG&L Ordinances - 2nd Reading - Public Hearin9 Proposed Ordinance No. 85-55 Re: Amended Sanitation Charges Attorney Vance read proposed Ordinance No. 85-55 by title only: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING BOYNTON BEACH CODE OF ORDINANCES CHAPTER 10, "GARBAGE, TRASH AND OFFENSIVE CONDITIONS", ARTICLE II, "REFUSE, GARBAGE AND TRASH", SECTION 10-29, "RATES AND CHARGES FOR CITY SERVICE", PROVIDING FOR A NEW FEE SCHEDULE; PROVIDING FOR A SAVINGS CLAUSE; REPEALING ALL ORDINANCES IN CONFLICT; PROVIDING FOR AN EFFECTIVE DATE AND FOR OTHER PURPOSES. Mayor Cassandra asked if anyone wished to speak in favor of or in opposition to the ordinance, and no one responded. Vice Mayor Ferrell moved, seconded by Councilman Hester, to adopt proposed Ordinance No. 85-55 on second and final reading. Ordinances - 1st Reading Proposed Ordinance No. 85-56 Re: Amending Ordinance No. 85-48 Adopting a Final Budget for Fiscal Year 1985/86 - 11 - MINUTES-REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA OCTOBER 15, 1985 Attorney Vance read proposed Ordinance No. 85-56 by title only: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING SECTION 2 OF ORDINANCE NO. 85-48 TO CORRECT A CLERICAL ERROR CONTAINED THEREIN RELATING TO THE APPROPRIATION OF MONEYS TO THE GENERAL FUND FOR THE PAYMENT OF OPERATING EXPENSES AND NECESSARY CAPITAL OUTLAYS OF THE CITY; PROVIDING THAT EACH AND EVERY OTHER TERM AND PROVISION OF ORDINANCE NO. 85-48 SHALL REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY ENACTED; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. Councilman Warnke moved, seconded by Vice Mayor Ferrell, to approve proposed Ordinance No. 85-56 on first reading. Mrs. Boroni took a roll call as follows: Councilman Hester - Aye Councilman Warnke - Aye Councilman Zimmerman - Aye Mayor Cassandra - Aye Vice Mayor Ferrell - Aye The motion carried 5-0. Resolutions None. Other Water Service Agreements Mr. Cheney said the City already has utility service agreements with both of these properties. The agreement with Phase 3 of Sunny South dates back to %979 when water lines were put in to Congress Avenue. The developer is now refining that agreement; no development had taken place along Congress Avenue at that time and there were only rough figures. The current proposal calls for 6.5 units per acre, which is the same .density as the Melear property and the standard development for that area. These two properties are next to each other. Some time ago the City approved an agreement for six acres of the Gustafson property; a density of 6.5 units per acre is recommended for this also. Mr. Cheney said both of these plans seem to be consistent with the City's standards--if they had been in the City, which they are not. Both properties are east of Lawrence Road; if they should ever annex, what they propose to build is consistent with the City's stan- dards regarding recreation space, etc. The recommendation is to amend the existing contracts and approve these requests for utility service. Phase 3 of Sunny South Estates (DDK Investments) Mr. John Mo¥1e was present to represent DDK Investments and urged the adoption of the City Manager's recommendation. Councilman Zimmerman - 12 - MINUTES-REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA OCTOBER 15, 1985 asked if the 1,541 units is the new figure, and Mr. Moyle replied affirmatively, although he thinks there may be a small arithmetic problem. Mayor Cassandra said, although the 6.5 units per acre is the average, some areas will have a density of 8 units per acre. Mr. Cheney said that is often true in a PUD. In response to Councilman Zimmerman's question as to whether these will be mobile homes, Mr. Moyle said Phase 3 will be two-story multiple family. Councilman Warnke pointed out that Mr. Annunziato's memorandum said the peti- tioner requested a density of 8 units per acre, but the Planning DePartment recommends 6 to 6.5. Attorney Vance confirmed that Mr. Moyle, on behalf of his client, concurs with the City Manager's recom- mendation. Mr. Vance clarified that a site plan is not being approved--that comes from the County; we are approving a utility service agreement to pro- vide water to 1,541 units. Mr. Moyle said there is a question of .43 or .53 acres; therefore, the total number of units will be either 1.,541 or 1,548. Vice Mayor Ferrell moved, seconded by Councilman Hester, to approve the water service agreement for Phase 3 of Sunny South Estates (DDk Investments). Councilman Warnke said, based on a COnsumption of 3,000 gallons per month per unit, the Council is now approving 4.5 million gallons of water per month outside the City l!imits. Mr. Cheney said we have already approved 1,463 units through previous agreement. The motion was voted upon and carried 4-1, Councilman Warnke dissenting. Gustafson Property Mr. Tom Gustafson, Jr., represented his father, who owns the property. Mr. Alan Ciklin, the attorney representing the owner, was present also. Mr. Gustafson said their 20-acre parcel of property is bounded on the north and east by Sunny South Estates. He said they would like to build two-story townhouses, using the existing recreational faci- lity. They will have access onto Lawrence Road. Mr. Gustafson said he thinks the prior water service agreement provided service over 20.48 acres, which includes a 1.2 acre strip of commercial in the froDt of the property. If their density is 6.5 units per acre, as was allowed for Sunny South Estates, the total number of units will be 133. They would like to put 132 units in the residential section and reserve the one unit for the commercial section, though that maynot be developed immediately. This would result in a 6.85 density on the residential only, but a 6.5 density on the property overall. Councilman Zimmerman asked if any part of this plan has been a roved b Lh - ' PP y ~ e coun=y. Mr. Gustafson said they started processing it through the County, but when the Sunny South project started movina forward they pulled back and waited for this meeting to occur and see which way the City suggested they go. Mayor Cassandra voiced the same con- cerh he had with Sunny South Estates--extreme density in the clusters where the housing is located. He asked if the child-care center will be open to the public. Mr. Gustafson replied it will not but will be - 13 - MINUTES-REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA OCTOBER 15, 1985 part of the townhouse homeowners' common facilities, accommodating 40 children. The facility will be 1,250 square feet plus a free play area; they will comply with the State and County regulations. Attorney Vance reminded the Council that we are talking about the number of units for which the City will provide water and sewer service; the zoning itself is a County concern. Councilman Hester moved, seconded by Councilman Zimmerman, to approve the water service agreement for the Gustafson property. The motion carried 4-1, with Councilman Warnke casting the dissenting vote. Mr. Cheney informed the Council that Tom Gustafson is a Representative in the State Legislature from Ft. Lauderdale. Proposal from Metric Engineering, Inc. for Supplemental Agreement 5, Phase IV and V Mr. Cheney said this is a continuation of our Community Development project in Cherry Hills, which has been approved by the County and will be funded 100 percent through Community Development funds, which have already been appropriated by the Federal Government. Councilman Zimmerman moved, seconded by Councilman Warnke, to approve the Supplemental Agreement 5, Phase IV and V. The motion carried 5-0. Mr. Cheney encouraged people to drive through Cherry Hills and see the improvements that have been accomplished to date. OLD BUSINESS Discussion of Day Care Center Councilman Warnke referred to the letter of October 9, 1985, from Mrs. Dee Zibelli, Chairperson for the Community Relations Board, to the Board of the Day Care Center, in which she asks for a complete finan- cial statement as opposed to the Balance Sheet they have received in thepast. Councilman Warnke felt the Council should support the Community Relations Board and go on record as approving of their letter asking for a complete financial statement. They ask around November 1 that financial reports be pro- ~d. They give to South County Drug Abuse, Hospice-by-the-Sea, the ~ence Fuller Foundation, which brings money back to the Day Care ~er in our area. The CRB sends out two members to each area to ~ back with a recommendation--positive or negative. Along with the Lncial statement and a positive recommendation, the CRB submits its rec~)mmendation to the City Council and asks for their approval. Mrs. Zib~lli said they have not been receiving financial statements from the Day Care Center, which receives over half of the allotted monies for social services. What they have been receiving about six months later, which holds up some of the other allocations, is what they call a balance sheet. As the checks are made out to Boynton Beach Child Care Center, Inc., we should have a financial statement showing w~h~ue- the taxpayers' monies are allo- cated. Mrs. Zibelli said they request the Council's support in requiring the financial statement if money is given to the Child Care Center. Couacilman Hester asked why these reports were not made mandatory from t~he beginning. Mrs. Zibelli said they were asked for before, but when it came down to the wire in March when the funds have to be allocated, several of the CRB Members did not feel the Center should receive the funds but she and some Members felt they are dealing with children and they need the money for their care. She said this is the last year these funds are being allocated; in the future, if the Chairman of the CRB wants to come before the City Council and ask for funds to deal with social services, the financial statement would be required. Mayor Cassandra's concern was that we might be directing the pressure to the wrong person. Mr. Cheney said maybe the wrong person is accepting the issue, but we will get to the right person. Mrs. Zibelli said other recipients of funds fill out a form providing information the CRB needs to make their decisions; this has not been done by the Day Care Center. Mr. Cheney said the County School Board has not yet finished their study to determine if they will take control of the day care centers. He explained the breakdown of the three funds involved with the Day Care Center; the City funds are used for the After Care Program. Mr. Cheney said the City will obtain the report--possibly the same report that is provided to United Way--and he will report to the Council at the next meeting. Councilman Warnke asked if any action is needed from the Council, and Mrs. Zibelli felt that what has been said at this meeting indicates support of the CRB's position. Councilman Warnke said, if a proper report is not received, Mrs. Zibelli should come back to the Council. Everyone agreed they do not want anything to happen to the Day Care Center, as it is very important. ADMINISTRATIVE City's Delegates to the South County Council of Governments Mayor Cassandra passed the gavel to Vice Mayor Ferrell so he could make a motion. He explained that he was the City's Regular Member of the South County Council of Governments, and Vice Mayor Ferrell was the Alternate. Due to the change in meeting times, Mayor Cassandra cannot attend regularly; he suggested that a new Regular Member be nominated, as well as a new Alternate. He made a motion to move Vice Mayor Ferrell up to a Regular Member and stated that he, himself, would not want to be an ~lternate. Councilman Warnke seconded the motion. The motion carried 5-0. Councilman Warnke moved, seconded by Vice Mayor Ferrell, to nominate Councilman Zimmerman to serve as Alternate.
