Minutes 07-16-85MINUTES OF THE REGULAR CITY COUNCIL MEETING HELD AT CITY HALL BOYNTON BEACH, FLORIDA, TUESDAY, JULY 16, 1985 AT 7:30 P. M. PRESENT Nick Cassandra, Mayor Robert Ferrell, Vice Mayor Ezell Hester, Jr., Councilman James R. Warnke, Councilman Carl Zimmerman, Councilman Peter L. Cheney, City Manager Betty S. Boroni, City Clerk James W. Vance, City Attorney Mayor Cassandra called the meeting to order at 7:30 P. M. He announced the Invocation will be given by Pastor Nathaniel Robinson, Church of God, followed by the Pledge of Allegiance to the Flag. AGENDA APPROVAL Councilman Warnke stated he would like to add an item under Administrative, D - Discussion - Hurricane Code. Mr. Cheney stated he would like to add under Administrative, Item E - Consideration of Utility Service Agreement on Hypoluxo Road at High Ridge Road; under the Consent Agenda where we already have four beer and liquor license approvals, an additional one for 67 Liquor Store at Yachtman's Plaza; another bill under Approval of Bills - All Right Paving Company in the amount of $20,317.05 for work done in the new Cherry Hill Road Improvement Project which just started a couple months ago; and a resolution under VIII-D-2 relative to a reduction of bond for Homes of Lawrence on Lawrence Road. Mayor Cassandra stated he would like to delete out of the Consent Agenda, Items G-3 and K for discussion purposes. Councilman Zimmerman moved to accept the agenda as corrected, seconded by Councilman Hester. Motion carried 5-0. ANNOUNCEMENTS Mayor Cassandra welcomed former Mayor Marty Trauger and his lovely wife and also former-Councilwoman Lyn Huckle. Recognition of Recreation & Park Department's Volunteer of the Year - Bill Knoll Mrs. Eleanor Wollenweber told about the volunteer program started in the Recreation & Park Department last October and then introduced Ms. Carol Knight, Volunteer Coordinator. Ms. Knight told about one volunteer standing out with twelve years of service plus being cooperative and dependable. She told about Mr. Bill Knoll's assistance in various projects. - 1 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 16, 1985 Mayor Cassandra then presented a plaque to Mr. Bill Knoll and expressed appreciation for his service to the Recreation & Park Department. Mayor Cassandra showed another plaque and explained this was just started and would .be engraved with people's names in recognition and placed at the entrance to city hall to thank these people. Mr. Bill Knoll expressed thanks and stated in his 78 years, he never anticipated receiving anything like this during his retired years, especially when doing something he enjoyed. Hilliard died this morning and Mark Lewis lost one of his legs and is still in serious condition. He announced there has been a trust fund set up in the Finance Department for anyone wishing to contribute to the financial plight these families will now find themselves in. Workmen's compensation and insurance will not cover all the expenses. So far, in excess of $200 has been collected. Each member of the City Council is contributing $25 to the trust fund and he urges the citizens of Boynton Beach to also contribute what they can for the financial problems of the families involved. Mr. Cheney added that the fund has increased to somewhere around $900. CITY MANAGER'S REPORT Employees' Service Awards Mr. Cheney stated he is pleased with the awards given tonight because this is the best attendance we have had by city employees when giving out awards. He referred to the employees being valuable and expressed appreciation for their contributions to the city. Shelters at the Beach Mr. Cheney reported that we have begun to put roofs on the shelters at the beach. Post Office Construction Mr. Cheney reported that he met a total of three hours today relative to the post office regarding the access and utility questions. The question of better access requiring the post office to buy more land has not been completed, but we are still working on that. Special City Council Meetings Mr. Cheney announced that the five following Special City Council meetings are scheduled: July 23 at 11:00 A. M. to receive and open bids for the general obligation bond issue of $6,350,000 for improve- ments to the police department, fire department, public works building, library and city hall. Monday, July 22, Tuesday, July 23, and Wednesday, July 24 at 7:30 P. M. budget workshop sessions will be held in the council chambers. - 3 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 16, 1985 Thursday, July 25, the City Council is having a special workshop on the subject of drinking water treatment com- paring reverse osmosis to the lime stabilization. We are looking forward to many people coming to that meeting and asking questions. The recommendation from the staff is to use reverse osmosis. We hope people will comment about this and express their concerns, so they can be addressed. City Budget Mr. Cheney announced that he anticipates copies of the city budget for the general fund will be available for the City Council either tomorrow or Thursday in preparation for budget workshops. He explained how the budget will be pre- pared in three sections. Mayor Cassandra ascertained there were no questions and stated the report would be accepted as presented. PUBLIC AUDIENCE Fund Raiser for Tia Clemmons Mrs. Dee Zibelli, 440 Ocean Parkway, distributed a newspaper article about Tia Clemmons and told about her hearing problem. She referred to a bank account being opened for Tia and small fund raisers with different organizations taking place and announced that a large fund raiser is being planned for October 19 entitled: Boynton Beach, the City Which Cares - Tia's Birthday Party. She told about all-day activities being planned and requested the Council's support and use of the civic center for this event. Mrs. Lillian Artis introduced her granddaughter, Tia Clemmons. Mrs. Zibelli continued they are in a situation where the insurance company has not yet covered her type of operation. She explained the operation procedure and stated they are happy to know Tia is a candidate and the possibili- ties are good for her. The problem is needing $15,000. They are requesting the City Council to allow them to use the center with a minimum number of workers and equipment. Vice Mayor Ferrell commented that he did not see any reason why the city cannot go ahead and cooperate and have that facility used. Councilman Hester added that he thinks we should help as much as we can and sees no reason why they cannot use the civic center unless there is a legal problem. - 4 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 16, 1985 Councilman Warnke commented that he would like to see the center used. Councilman Zimmerman agreed and asked if anything is scheduled and Mrs. Zibelli replied that it is open. Mayor Cassandra requested the City Manager to comment and Mr. Cheney advised that he asked them to come before the Council. He would like to clarify the policy question of using the civic center and the city providing support. It means we will need to devote some labor with assembling the stage, keeping the grounds clean, etc. He wants to be sure we do extra things to ensure the volunteers can do their jobs and possibly even have some of our program specialists provide some assistance. It could be the first county-wide type activity and possibly can be done yearly to help other children. Mayor Cassandra referred to the city donating the time for this and stated we should help one of our citizens. He sum- marized that the consensus of opinion is to go ahead with it and we hope it is successful. Mrs. Zibelli added that tomorrow night, a meeting is being held at Royal Palm Clubhouse in reference to this. She then introduced some of the volunteers present. Disabled Parking Space Violation Penalty Ms. Eleanor Shuman, 2520 N.E. 1st Court, urged the City Council to please vote for proposed Ordinance No. 85-44 having to do with handicapped parking. Also, if this is approved, she requests that it be implemented so the offi- cers have the tickets to write physically and the money stays in Boynton Beach. She added that hopefully the Building Department will look into what has happened over the past years where there is not enough parking for the han- dicapped pursuant to Florida Law. After further comments, she again requested passage of this ordinance. Mayor Cassandra referred to the money going to the county and Mr. Cheney agreed, but explained that it may be better to continue that rather than establishing a separate ticket. Accident Report In response to Mr. Ralph Marchese's question, Mr. Cheney stated that people wanting to make donations to the employees in the accident can make a check out to the City - 5 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 16, 1985 of Boynton Beach noting the Hilliard and Lewis Fund. Mr. Marchese referred to the newspapers giving attention and Mr. Cheney replied that the Miami Herald has been particularly helpful in this. Bond for Mahogany Bay Project Mr. Kevin Henderson, Metro Development Corp., 21301 Powerline Road, Boca Raton, stated they have requested an extension for finalizing their plat for the Mahogany Bay rental project. They are cognizant of the requirement to post a bond for the improvements; but in pursuing that bond, they have come across some difficulty in finding a way to post that bond and getting it released as they build out. The project build-out is virtually short being 17 months. He explained how there are some substantial differences between rental projects. He would like to bring this item to the City Manager and City Attorney for a view from all sides and bring back to the Council for consideration as to whether their particular circumstances would warrant a look at the bond they would have to post for their project is truly serving the purpose in their case. Mayor Cassandra clarified that he wanted this request tabled because of a problem of surety and Mr. Henderson clarified that he wants an extension to record the final plat. In the absence of having a better solution, it would be most help- ful. Mr. Cheney clarified that Mr. Henderson is addressing the Council prior to approval of the Consent Agenda to advise he is requesting an extension because of the bonding issue and not because they have not been pursuing the matter. He recommends extending it while we continue to see if there is a solution to the bonding question. A report will be provided. CONSENT AGENDA A. Minutes 1. Regular City Council Meeting Minutes of July 2, 1985 Bids Sale and removal of lime sludge at the Boynton Beach Water Treatment Plant - Utilities The Tabulation Committee recommends extending the bid to Hardrives, Inc., Delray Beach, in the amount of $1.76 per cubic yard. - 6 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 16, 1985 C. Resolutions NONE D. Development Plans Consider request for approval for a replat of Quail Lake plat, including construction plans for infrastructure improvements to serve 135 condominium units in connection with a previously approved Planned Unit Development on Congress Avenue at Golf Road, northwest corner. Request was submitted by Richard E. Teagle for Phillip Conner. The Planning & Zoning Board unanimously recommended approval of this request subject to staff comments. Consider request from Peter L. Cheney for approval of a 3,000 square foot addition to an existing children's day care center, including landscaping and paved parking located at 909 N.E. 3rd Street. This center is known as Boynton Beach Child Care and is owned by the City. The Planning & Zoning Board unanimously recommended approval of this request subject to staff comments. Consider request for approval of an amended site plan to allow construction of a 280 square foot maintenance building near softball diamonds at Caloosa Park, 1300 S.W. 39th Avenue. Request was submitted by William F. Wilsher for Palm Beach County Parks and Recreation Department. The Planning & Zoning Board unanimously recommended approval of this request subject to staff comments. Consider request for approval of an amended site plan to allow for enlarged floor plans at North Woods Phase 3 of Hunters Run Golf and Racquet Club Planned Unit Development. Request was submitted by Gary Maresca and Dean Fleming for George Culverhouse. The Planning & Zoning Board unanimously recommended approval of this request subject to staff comments. - 7 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 16, 1985 Consider request for approval of a site plan which provides for the construction of 384 apartment units plus landscaping and recreation facilities at The Landings lOcated on Congress Avenue at S.W. Congress Blvd., north side. Request was submitted by M. T. Register for The Landings Apartments, Ltd. The Planning & Zoning Board unanimously recommended approval of this request subject to staff comments. Consider request for site plan approval to construct 36 multi-family dwelling units plus landscaping at Phase II of the Quail Lake West project north of Golf Road, west of Congress Avenue. Request was submitted by Robert C. Wade for the Catania Development Corporation. The Planning & Zoning Board unanimously recommended approval of this request subject to staff comments. Consider request for site plan approval to construct a 20,298 square foot new branch banking facility/office building on 1.26 acres located on Congress Avenue at Old Boynton Road, northwest corner. This request was submitted by Howarth L. Lewis for Sunpoint Savings Bank. The Planning & Zoning Board unanimously recommended approval of this request subject to staff comments. Consider request for time extension for filing the final plat for Mahogany Bay. The City Engineer recommends the 90 day extension beyond July 15, 1985, be granted subject to approval of a revised cost estimate to be submitted when the final plat is filed. E. Transmittal of Road Impact Fees to Palm Beach County The Finance Director has reviewed the collections as noted in his memo of July 10, 1985, and finds them in order and recommends they be transmitted to Palm Beach County. Vice Mayor Ferrell made a motion to approve the Consent Agenda with the noted exceptions, seconded by Councilman Hester. Mayor Cassandra clarified this would be approval of Items A, B-l, D-l-8, E, F, G-l, G-2, G-4, G-5, H, I, J, L and M with the additional bill. Motion carried 5-0. - 9 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 16, 1985 G. Approve request for zoning approval for alcohOlic beverage license: Lou's Subs & Soups, Inc. 502 North Federal Highway BOynton Beach, FL 33435 Mayor CaSsandra referred to this being very close to St. Mark's ChUrch and requested legal advice whether this is allowed under our ordinances. Mr. Vance read Sections 3-6 and 3-7 of the code. Mayor Cassandra suggested tabling this approval so confir- mation of distance from this particular area to the house of worship can be verified. Councilman Warnke pointed out that we do have a recommendation from city staff saying this is allowed and he presumes they took this distance into con- sideration. Mayor Cassandra replied that he thinks it would be advantageous to have it confirmed. Vice Mayor Ferrell made a motion to approve, subject to it being~checked rather than having them wait three more weeks. Mayor Cassandra stated that Lou's has been there for five yearsland he doesn't think three more weeks will hurt and Vice Mayor Ferrell replied that there is no reason to hold them Up three more weeks. Councilman Warnke seconded the motion. Mayor Cassandra clarified that the motion is to grant Lou's a conditional approval based on verification that it is allowed and meets the requirements of Section 3-7. Under discussion, Mayor Cassandra commented that with due respect of not hOlding up the bUsiness needs, he still thinks it behooves the city to do this right. Vice Mayor Ferrell responded that it also behooves the city to do things in an expeditious manner and he assumes the staff has done their job. Motion carried 4-1 with Mayor Cassandra dissenting. K. Approve City Council attendance at Florida League of Cities Convention in Hollywood, Florida - OctOber 10-12 Mayor Cassandra referred to this convention being held in Hollywood, Florida, and questioned the need for hotel reser- vations and Councilman Warnke stated that many meetings at the Municipal League Conventions last well into the night and he does not care to drive 1-95 at 11:00 P. M. and return at 6:00 or 7:00 A. M. the next morning. He thinks it would be advantageous for those attending the convention to stay overnight. Mayor Cassandra questioned just who was planning to attend and Councilman Warnke stated this is general authorization fOr anyone on the CoUncil to attend this convention. - 10- REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 16' 1985 Vice Mayor Ferrell made a motion to approve this for the Mayor and City Council to go covering the expenses of anyone who wants to go. Councilman Warnke seconded the motion. Motion carried 5-0. Mr. Cheney requested that his office be advised as soon as possible just who is going, so rooms can be reserved. He asked if anyone definitely was not going and Mayor Cassandra replied that he cannot say at this time. BIDS NONE PUBLIC HEARING Consider a request for an amendment to the Future Land Use Element of the Comprehensive Plan from Local Retail Commercial to Industrial and Rezoning from C-3 Community Commercial to M-1 Light Industrial for the purpose of establishing a sales office and storage yard for Spada Concrete Specialists, Inc. Request was submitted by Frank Spada for Spada Land Company and would be located at 3466 Old Dixie Highway. Mr. Annunziato explained the location and told about the zoning of surrounding properties. He explained how property in this area had been annexed into the C-3 category and stated he submitted a memo dated June 5, 1985, stating the Planning Department's analysis and recommendation. He fur- ther explained how it may not be appropriate to have C-3 zoning along Old Dixie Highway, but M-1 seemed inappropriate in this location. An ample amount of M-1 land is available and vacant for this use, but not in this location. The future land use in this area should be determined with the comprehensive plan modification procedure. They recommend denial of this request. Mr. Frank Spada told about outgrowing their previous C-3 location and purchased this larger C-3 property because that is what they had for years. When applying for a fence per- mit, that is when they found out they could not park trucks on the property. There is commercial property in this area, but he does not see it used for retail stores being located along the train tracks. There are commercial vehicles parked in residential areas of the city and nobody sees this property along the railroad tracks. - 11 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 16, 1985 Mayor Cassandra ascertained nobody else desired to speak and declared the public hearing closed. Councilman Warnke referred to the Planning & Zoning Board turning this down based on creating an isolated M-1 parcel which would be spot zoning. He agrees with this recommen- dation and it is his opinion this would be spot zoning to the detriment of the surrounding property owners. Mayor Cassandra referred to conditional uses in C-3 zoning and Mr. Annunziato informed him that contractor's yards are not allowed. Councilman Zimmerman moved to deny this request in con- currence with the recommendation, seconded by Councilman Warnke. As requested, Mrs. Boroni took a roll call vote and the motion carried 5-0. Ke Approve City Council attendance at Florida League of Cities Convention in Hollywood, Florida - October 10-12 (Continued) Councilman Warnke referred to not appointing a voting dele- gate at this convention under previous discussion and Councilman Zimmerman moved to address that now, seconded by Councilman Warnke. Motion carried 5-0. Councilman Zimmerman moved to let our regular delegate to the Municipal League represent us, which would be Councilman Jim Warnke, seconded by Vice Mayor Ferrell. Under discussion, Mayor Cassandra referred to being kept informed of what is being voted on and Mr. Warnke replied that he would not vote unless the entire Council approved. Motion carried 5-0. Mayor Cassandra declared a five minute break and then recon- vened the meeting at 8:50 P. M. DEVELOPMENT PLANS Consider agreement relative to Forum Shoppes Site Plan Mr. Bob Kassell referred to having an approved site plan and told about the shopping center including theaters, retail stores and office building under construction. He advised there have been some problems with the site plan submitted with a mistake discovered on some of the shared parking arrangements with their neighbors. They have been working - 12 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 16, 1985 with the city departments on being able to solve this, so they can continue construction. Construction has been stopped by the Building Department until this is satisfied. He believes they have come to a resolution. An agreement was prepared by the City Attorney, which is acceptable to them and the City of Boynton Beach. He requests that the City Council approve this agreement, so they can proceed. It specifically has to do with the number of parking spaces for the entire project. They propose to submit a new plan to the City Council. They do have adequate parking on their site, can do it through shared parking and also have an office building at one end on which they can change the con- figuration and provide parking underneath, or have a cross parking agreement with their neighbors to the east. They are going back t.o the drawing board and will come up with something making sense to all concerned. Mr. Cheney informed the Council the project was approved and the cross parking situation was developed with City Federal Bank. The retail stores are finished. They have a commit- ment to have the theaters in operation by Christmas. There is no way they can get the site plan redone and approved through the regular city process to meet their commitment. We are suggesting and they are commiting through this agreement to bring in a site plan which will work. A permit can be issued in the meantime and they can proceed with the theater with a reduced number of seats. It still would not be over-built relative to parking. The agreement has been approved by Mr. Vance and it protects the city and holds us harmless. He thinks it is a workable solution to this problem. He recommends proceeding under this arrangement. Mr. Vance added that he believes the agreement as drafted legally protects the city. Mayor Cassandra questioned from what and Mr. Vance replied from construction of facilities which would exceed the number of parking spaces required by ordinance. Mayor Cassandra questioned if the other people did not agree to shared parking and Mr. Cheney informed him there is only one shared parking agreement that is not workable. Mr. Kassell added that they would be reducing the number of theater seats and if they cannot work out the parking requirements, they would have the reduced number of seats. After further discussion about shared parking arrangements, Mr. Cheney clarified that it is suggested, in the absence of a new site plan which will take awhile, that possibly an - 13 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 16, 1985 agreement could be developed to indemnify the city. Mr. Kassell added that the agreement includes for the city's protection that they are not allowed to get any c/o, not allowed to build the number of original seats, not allowed to start the office building, but can just continue construction. Councilman Zimmerman moved to sign this agreement with Forum Shoppes, seconded by Vice Mayor Ferrell. Motion carried 5-0. Consider request for site plan approval to construct a 6,300 square foot strip retail and office building on .57 acres located on Boynton Beach Boulevard and N.E. 1st Street, northwest corner. Request was submitted by Everado R. Garcia for Anthony Mannino and will be known as the Mannino Shopping Center. Mr. Annunziato informed the Council that this was not approved unanimously by the Planning & Zoning Board because there was concern about the kind of use as opposed to the site plan presented. There was discussion by the Board whether the city should be thinking in terms of higher land uses along Boynton Beach Boulevard to compliment uses in the redevelopment area. The question was whether a strip commer- cial center like this would be appropriate for that site and what impact it would have on the other parcels along Boynton Beach Boulevard. This request was recommended for approval 5-1 by the Planning & Zoning Board subject to staff com- ments. The Community Appearance Board reviewed and approved it last night. Mayor Cassandra referred to the zoning allowing strip com- mercial and Mr. Annunziato informed him the application as proposed is consistent with zoning. Councilman Warnke referred to there being an excessive number of staff comments to be met and Mr. Annunziato agreed and commented that it appears the building might end up shrinking to accommodate the staff comments. In response to comments about strip commercial and the down- town development, Mr. Vance clarified that technically this meets the C-3 requirements for the site plan. Mr. Everado R. Garcia stated they will comply with all the requirements of the staff. Hopefully it will be better than the rest of the block and will upgrade the rest of the pro- - 14 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 16, 1985 perties in the area. Councilman Warnke asked if they agreed to make the tremendous number of changes noted and Mr. Garcia replied affirmatively and added they did not get all the information in the first place and were not familiar with the procedures of the city. Mr. Vance clarified that he agrees to comply with all staff comments and Mr. Garcia replied affirmatively. Councilman Zimmerman moved to approve this request with all staff comments, seconded by Councilman Hester. Motion carried 5-0. Mrs. Boroni took a roll call vote as follows: Councilman Warnke - Aye Councilman Zimmerman - Aye Mayor Cassandra - Aye Vice Mayor Ferrell - Aye Councilman Hester - Aye Motion carried 5-0. - 15 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA Ordinances - 1st Reading NONE Resolutions Proposed Resolution No. 85-TT - Re: Amending Civil Service Rules and Regulations JULY 16, 1985 Mr. Vance read proposed Resolution No. 85-TT by title: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING RULES AND REGULATIONS OF CIVIL SERVICE BY ADOPTING A NEW SET OF RULES AND REGULATIONS. Mr. Cheney informed the Council that he distributed a pro- posed new set of rules and regulations with a memo from the Personnel Director and his memo. He referred to these variety of changes having been in the works for a long time and advised a number of changes are relatively routine, but are improvements. Mr. Cheney stated basically the issue in the Fire Department is to make it possible for greater mobility and promotion and achievement and get rewarded for it. We are trying to relate by providing for firefighters to be I, II or III and hopefully, they will all progress to III. We will then have a limited number, which are well paid and well trained and can do any number of jobs. He explained how this would allow flexibility and use of personnel. Mr. Cheney referred to the Police Department and stated he thinks it is fair to say just about everybody in the Police Department is in agreement. He explained how the current system allows a detective to become a lieutenant without first becoming a sergeant and how a lieutenant for most of the week is the chief on duty and a very important person in the day-to-day function of the Police Department. This allows a lieutenant in charge without having supervisory experience. This proposal takes away from a detective the right to go directly to a lieutenant, but substitutes for that the idea of special sergeant. The detective will be paid as a special sergeant and be given exposure to super- visory work. Then, a sergeant's test will be given for eva- luation and they will be eligible to become a lieutenant. He summarized that what we have taken away from a detective, - 16 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 16, 1985 we have given something in return and Will pay them for it. Also, there will be the advantage built in with having a special sergeant on the road and bringing in other sergeants to get experience in the station. He believes the vast majority is in agreement with this. He thinks we have done all we can to develop good proposals and respond to the rights of employees and the city. He then requested the Chiefs to comment. Fire Chief Rhoden explained how actually an apprenticeship program was being developed with a progressive program resulting in having capable men. This is a program enabling the men with initiative to go to the top. He thinks it is exactly what the Fire Department needs. Police Chief Hillery stated the Police Department is lacking supervisory experience prior to the men becoming watch com- manders. It is important for the watch commander to be able to supervise the men. This plan offers an excellent oppor- tunity to move people who are sergeants to gain experience, so when they become lieutenants, they can serve in any department of the Police Department. This is the essence of good management. Officer Chris Yannuzzi requested to speak. He referred to the promotional exam given for sergeant in March 1984 and told about the promotions filled from this list and the balance remaining. As a member of the Police Department, he accepts this concept as a viable method; however, his con- cern is this could promote ten current detectives, only four who have passed the sergeant exam. How is the promotion of these six being justified to the position of sergeant over those who passed the test and remain on the active list? Mr. Cheney replied this is being justified because it is taking away the right of going from detective to lieutenant and all will have to take the sergeant test. Also, with the turnover, it is anticipated that those who have passed the sergeant exam will most likely have the opportunity to become sergeant before the list expires. Councilman Warnke referred to objections coming under grievances before the Civil Service Board and Mr. Cheney informed him the grievance procedure is more complicated, but there is always the opportunity to file a grievance. Mayor Cassandra clarified that Officer Yannuzzi's concern was some people, who have not taken the sergeant's test, may jump ahead of him and Officer Yannuzzi agreed this would - 17 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 16, 1985 happen. Mr. Cheney disagreed, as there is still the same opportunity for promotions into the sergeant's position. Mayor Cassandra referred to a test being passed for the sergeant's slot and Officer Yannuzzi replied that when a detective becomes eligible, he will be promoted and collect the special sergeant's pay and will also become eligible for lieutenant before he will. Vice Mayor Ferrell interjected that they are eligible right now to take the lieutenant's test. Mayor Cassandra clarified that it is possible at the end of the proper period of time, a special sergeant can take the lieutenant's test, but Officer Yannuzzi could not and could slip two years behind in time. Vice Mayor Ferrell commented that if it isn't changed, he will still be behind the detectives. Officer Yannuzzi stated that the proposal is fine, but he wanted to make his objection part of the record. Mayor Cassandra referred to the Training Officer in the Fire Department and Mr. Cheney stated that his memo submitted covers this with reference to Resolution No. 80-L which accepted the fact the Training Officer did not have to obtain all his experience in Boynton Beach, but because we will require the Training Officer to be a Firefighter III, in essence six of the eight years will be in the city. Mr. Cheney informed the Council that the Chairman of the Civil Service Board indicated he was not here tonight because he was not on the Civil Service Board when all these issues were presented. Vice Mayor Ferrell made a motion to adopt this resolution adopting the Civil Service Rules and Regulations. He added that amending the rules was a problem the Police Department has been trying to iron out and it is good to see the problem in the Fire Department is getting straightened out too. Councilman Hester seconded the motion. Under discussion, Mr. Cheney added that the detectives do support this. Mayor Cassandra referred to submitting comments and expressed concern in lowering the standards in the form of a passing grade. He doesn't think the City Council should be waiving examinations; we should be examining people to see what they are capable of doing. He is also concerned about height and weight as it is a point you cannot join the force unless a certain weight, but it is not held for years to come. In the area of qualification, he is a firm believer of academic requirements. Field experience is definitely needed. There is a tendency to slip between hours and cre- dit hours on Page 35. He showed a flow chart he prepared - 18 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 16, 1985 and how it meant going back to go forward for Fire Prevention II. Mr. Cheney explained this was done on pur- pose. Mayor Cassandra suggested looking at it further. The Mayor then explained that when teaching, such as the Training Officer position, it is important to have a higher level of requirements. As far as the police, he received no negative comments on the new proposal, but we should increase our standards. Motion carried 5-0. Proposed Resolution No. 85-UU - Re: Reduction of Bond, Homes of Lawrence Mr. Vance read proposed Resolution No. 85-UU by title: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, REDUCING PERFORMANCE BOND FOR HOMES OF LAWRENCE P.U.D., PLATS I AND II. Councilman Warnke moved to approve proposed Resolution No. 85-UU, seconded by Councilman Zimmerman. Motion carried 4-0. (Vice Mayor Ferrell had left the room.) Other Canal Retaining Wall - Golf View Harbour (Tabled) Consider License Agreement Mr. Vance informed the Council the license agreement has been revised to provide if there is a sale of the home, the license can be cancelled. Councilman Warnke moved to remove this from the table, seconded by Councilman Zimmerman. Motion carried 4-0. Councilman Warnke asked if this is going to be proposed to the residents and Councilman Zimmerman replied that in order to get a permit, they will have to sign it. Mr. Cheney added that he met with Mr. Lewis this week and doesn't think he has any problems. Councilman Warnke moved to approve this agreement with Mr. Lewis covering a revocable one year permit to use public property, seconded by Councilman Zimmerman. Motion carried 4-0. - 19 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 16, 1985 Consider request submitted by Roy Barden for Max Schorr, P.A. to annex a 10.84 acre tract of land located on the southwest corner of the intersection of Miner Road and High Ridge Road Councilman Warnke moved that the request submitted by Roy Barden be forwarded to the Planning & Zoning Board for further consideration, seconded by Councilman Hester. Motion carried 5-0. OLD BUSINESS NONE NEW BUSINESS Consider employing a full time City Attorney as an alternative to an Attorney on retainer Mayor Cassandra referred to there being no question about Mr. Vance's qualifications and stated his concern is more in reference to the availability of an attorney for the full time needs of Boynton Beach. The report from the City Manager's office pretty well explained the pros and cons. He has some disagreement in numbers, but not large enough to make a difference. He reviewed the assumptions submitted, but the last budget sheet did show $124,000 for the City Attorney making the numbers close for discussion. The question is whether it is time to consider someone who is available to give a relatively acceptable turn-around time to our needs. Councilman Hester asked if he was saying the city's budget for 1985 is $94,000 plus for the City Attorney and Mr. Cheney clarified that he used the 1984-85 budget figures beginning the year for Boynton Beach, Delray Beach and Boca Raton. He quoted $94,000 because it was the approved budget at the beginning of the year and is comparable to other cities' budgets. During the year, there were some special costs which increased that. Vice Mayor Ferrell stated he has no complaint about the ser- vice we have been receiving. There is no doubt there will be a time when we will do this, but he would like to do it like the capital improvements going first class and not cutting costs. He does not consider Assumption 92 to be a feasible comparison. We must consider Assumption ~1, which is considerable cost and with $100,000 difference. Councilman Warnke referred to this coming up 2~ to 3 years ago and stated in the interim, our position for the need of - 20- REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 16, 1985 a full time attorney has not changed that much. think it is necessary at the present time. He does not Councilman Zimmerman commented that he does not see any ser- vice that we are not getting under our present system. If there are any, he would like to be made aware of them. Secondly, we do not have the room to house an office for an attorney with law books, etc. He is well satisfied with status quo. Councilman Hester stated it seems Mr. Vance has given good service. If we do change to a full time lawyer, we might get someone who has not had enough experience with city policies. He doesn't think it is the time yet that we need one. Vice Mayor Ferrell agreed that quality is more impor- tant than availability. Mayor Cassandra referred to not being happy with the turn- around time from the City Attorney and stated we had a spe- cial workshop with the code book over a month ago. He referred to Mr. Vance being a very busy individual and he respects his opinions, but he doesn't agree we will get a poor attorney if we go out to contract. He explained that the numerical hours must be considered with the service we are getting. He summarized that the consensus is not to pursue this any further and the issue is dead. ADMINISTRATIVE Consider appointment to fill alternate vacancy on Community Appearance Board - Councilman James Warnke Councilman Warnke nominated Joel Baskin and told about his interest in the Community Appearance Board. Councilman Zimmerman seconded and the nomination carried 5-0. Consider appointment to fill alternate vacancy on Municipal Golf Course Advisory Committee - Vice Mayor Robert Ferrell Vice Mayor Ferrell moved to appoint Joseph Christiano, 1103 Florentine Way, seconded by Councilman Hester. Motion carried 5-0. Consider weighted voting in the Palm Beach County Municipal League Vice Mayor Ferrell moved to approve the resolution suggested by Boca Raton and pass on to the Municipal League. He does - 21- REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 16, 1985 understand there is a discussion taking place and there may be a compromise. Mr. Vance clarified that it would mean changing Boca Raton to Boynton Beach in this proposed resolution and Vice Mayor Ferrell agreed. Councilman Hester seconded the motion. Under discussion, Councilman Warnke stated this resolution in effect says Boynton Beach will withdraw from the Municipal League unless they get weighted voting and he read Section 2 on the last page. Secondly, a committee has been set up and they are now in agreement with some proposed changes to the bylaws which are not as drastic as proposed by Boca Raton. Until we receive the report from that committee, he thinks we would be premature to approve a resolution of this type being pushed by the City of Boca Raton before having all the facts in place. The committee report will be in our hands within the next week or two. He recommends we vote not to go along with this resolution at the present time. we should get the facts together and a recommendation of alternatives, which will be forthcoming and at that time compose a resolution of our own lo at all the facts and figures. Vice Mayor Ferrell commented that nothing has been done about this for years. Mayor Cassandra referred to just having a resolution pre- pared and Mr. Vance advised it could be passed with just changing the city name. Councilman Warnke referred to going on record previously stating we are in favor of weighted voting and Vice Mayor Ferrell replied that we should give them something to work with or nothing will be done. Councilman Warnke referred to the Municipal League being in business for 62 years and stated he thinks it would be pre- mature to make a bylaw chan~e in the local league without all the facts. Vice Mayor ~errell replied that we are not doing that, but are sending a resolution in reference to this being a good idea. After further comments pro and con, Mr. Vance read proposed Resolution No. 85-VV by title: A RESOLUTION OF THE CITY OF BOYNTON BEACH SUPPORTING THE PROPOSED AMENDMENTS TO THE CHARTER AND BY-LAWS OF THE PALM BEACH COUNTY MUNICIPAL LEAGUE; REQUESTING THE MEMBERS OF THE PALM BEAC~ COUNTY MUNICIPAL LEAGUE TO ADOPT AND RATIFY THE PRO~SED AMENDMENTS TO THE CHARTER AND BY-LAWS OF THE LEAGUE; PROVIDING AN EFFECTIVE DATE. Mr. Vance then enumerated the changes throughout the resolu- tion from Boca Raton to Boynton Beach. Vice Mayor Ferrell replied he would go along with looking into it and would be interested to know the costs as far as construction. Councilman Warnke responded that insurance premiums may be decreased, but the cost may increase, so the cost would be equal. He thinks we should take a long look at it and see what the expert advice is. Mr. Cheney agreed to talk to the different experts and submit a report. Consideration of Utility Service Agreement (Dudley) Mr. Cheney referred to this being a small piece of land at the corner of High Ridge Road and Hypoluxo Road with utilities in the area and informed the Council that Mr. Annunziato checked into the proposed use of the property and it is consistent with the County Comprehensive Plan. It is owned by the Dudley family and they are willing to sign a utility agreement. He recommends authorizing this agreement for utilities for the Dudley property.
