At 7:30 p.m. the meeting was called to order by Mayor Cassandra,
and the Invocation was given by Councilman Warnke, followed by
the Pledge of Allegiance to the Flag led by City Attorney Vance.
Former Mayor and Councilman Joe DeLong was recognized as being
present in the audience and welcomed.
AGENDA APPROVAL
City Manager Cheney wanted to add under IV. CONSENT AGENDA H.
Approval of Bills the first payment in the amount of $8,729.60
for our agreement with two other cities for the cooperative
library computer system. Councilman Warnke moved, seconded by
Councilman Hester, to approve the Agenda with the correction.
The motion carried 4-0.
ANNOUNCEMENTS
Mayor Cassandra announced that City Hall will be closed Thursday,
July 4, in observance of Independence Day and that the dedication
of Boat Ramp Park will take place at 5:30 p.m. Activities are
scheduled throughout the day at the Park, and everyone is welcome
to attend. Mr. Cheney added that there will be fireworks that
evening, a barbeque Friday afternoon, entertainment on Friday,
Saturday and Sunday, and the Kiwanis fishing tournament on
Saturday and Sunday.
CITY MANAGER'S REPORT
1-95 and 22nd Avenue Interchange
Riteco's Feasibility Study, required for the Boynton Beach Park
of Commerce approval, is in draft form and will be finalized in a
few weeks, at which time a presentation will be made to the City
Council. Mr. Cheney understands the report is favorable for the
interchange, but the cost will be around $15,000,000 and where
the money will come from has not been determined.
Assessed Values - Palm Beach County Communitie~
Summaries were handed out to the Council, and Mr. Cheney pointed
out that Boynton Beach's assessed value for the coming year will

be $987,000,000; Delray Beach, having a similar size and
population, has $1.6 billion; and Boca Raton, with a population a
little over 10,000 larger than Boynton, has an assessed value of
$4 billion.
Full-time City Attorney
The first report on this issue was passed out for the Council's
review prior to its appearance on the Agenda for discussion at
the next meeting.
Budget Workshops
These are open to the public but are not public hearings and are
scheduled for July 22, 23 and 24 at 7:30 p.m. in the Council
Chambers. The Council will review the proposed budgets and set a
tentative tax rate, which will be advertised an early August and
sent to every property owner in the City. The formal public
hearings will be held in September. On July 25 a special Council
meeting will be held to discuss the water treatment
systems--Reverse Osmosis versus Lime Coagulation--which will make
four meetings that week.
Water Meter Fees
Mr. Cheney met with Mr. John Pagliarulo and his Accountant
regarding his difficulty in obtaining water meters for his deve-
lopment due to money owed from a previous project. A letter
clarifying Mr. Pagliarulo's position regarding the issue was
received today and was discussed with the Utilities Director; Mr.
Cheney is hopeful the matter can be resolved this week.
Joint Co-op Bid - Bulk Quicklim~
Mr. Cheney referred to this item, which is on the Consent Agenda,
saying the City spent $30,000 recently to rebuild in two stages
the lime system in the water plant in order to change the kind of
lime used. The cost of lime in the first stage was reduced from
$78 per ton to $71; tonight the request is to approve lime at $61
per ton, which is a total saving of $17 per ton over the original
process. Combining the bidding with Boca Raton and Delray Beach
results in a bulk bid, benefitting each city. Boynton Beach uses
approximately 2,000 tons a year.

Station
Per memo of June 26, 1985, from Bill Sullivan, Purchasing Agent,

only other bidder, Edwards Electric, bid only on installation of
the time clocks rather than renovation of sprinkler system.

Councilman Hester moved, seconded by Councilman Zimmerman, to
approve the Consent Agenda with the addition of the bill for
payment; included are Items A; B 1.,2.,3.; C 1.,2.,3.; E; F; G; H
with the addition of the charge of the Co-op Library of
$8,729.60.
Mayor Cassandra referred to Item B.2 and wanted competitive bids
attached for comparison, and he questioned why the bid was
awarded before Council approval. Mr. Joe Sciortino, Golf Course
Manager, answered that the other bid was for time clocks only;
therefore, there was no other bid for the complete renovation
job.
The motion on the floor was voted upon and carried 4-0, except
for Item A. Minutes; Councilman Warnke was absent from the JUne
18 meeting and abstained from voting on that item, which carried
3-0.

DEVELOPMENT PLANS
A. Consider Amendment to Palm Beach County Comprehensive Plan -
Future Land Use Element
Mr. Carmen Annunziato, Planning Director, said three notices have
been received from the Palm Beach County Planning Director
advising of requests for zoning changes to allow commercial use
of land currently planned for residential development; each of
these has been addressed and recommendations made to Council. In
reviewing these requests, the Planning staff determined that the
requests for change in land use on North Seacrest and the one on
Lawrence Road are not of substance or size to cause future
problems for the City. For the one located on Knuth Road,
however, they recommend to the Council that they respond, as this
would be improper land use. Mr. Annunziato said a past study
shows there should not be commercial development west of Knuth
Road. Councilman Warnke moved, seconded by Councilman Hester,
that the recommendations of the Planning Director on the three
Land Use proposals be backed by the Council; this means no com-
ments on the two and opposing -~ the change on the Knuth Road
project. The motion carried 4-0.
B. Consider Interlocal Agreement for Local Government
Development Review
Mr. Cheney said from the South County Council of Governments
Meeting and a meeting called by the County Commission some time
ago and held in Delray Beach regarding South County activities
have arisen some concerns and suggestions as to how the South
County cities and the county government can better interrelate
with each other in regard to development proposals that are
taking place in the area. The Planning Directors of the three
cities and the County have been meeting.
Mr. Annunziato said several meetings of the staffs have taken
place and they arrived at a list of positions they felt they
could recommend to their individual local governments. They
decided it would be improper to hold workshop sessions until the
COuncils were apprised of these positions. They covered pri-
marily the areas of coordinated review, types of documents which
would receive coordinated review, the procedure to effect that
review and that there would be no predetermined set of review
standards, as the standards could vary depending upon the appli-
cation or the interest of the local government.
The area of coordinated review between Palm Beach County and
Boynton Beach is suggested to be the area between 1-95 and the
E-3 Canal, and north to south from Hypoluxo Road to Canal 30.
The area of coordinated review with Delray Beach is all lands

between Lake Ida and Golf Road, and east and west through
city limits. The projects to be developed would be any develop-
ment requiring legislative approval which exceeds 25 percent of a
DRI threshold. The procedure will be Planning Director to
Planning Director, with the receiving Planning Director having 30
days to seek review of the application through the local govern-
ment. Though this review will be advisory in nature, Mr.
Annunziato thinks it will carry some weight. Mr. Cheney added
that in the pockets there will be review of anything that hap-
pens. He added that this will probably come before the Council
governments within the next couple of months for formal ratifica-
tion.
Councilman Zimmerman moved, seconded by Councilman Warnke, to
accept the report on Interlocal Agreement for Local Government

Mr. Cheney said this ordinance is in response to the public
audience during which Dee Zibelli spoke regarding increasing the
fine for disabled parking space violations to $50. As it has not
yet been advertised for second reading, he said it would not be
until August. Attorney Vance said the details are being worked
out for the simplest ticketing approach, and he read proposed

1. Canal Retaining Wall - Golf View Harbour

a. Consider License Agreement
A proposed license agreement has been prepared and was passed out
to the Council for review regarding docks and seawalls that have
been built along canals in the City without permits. Mr. Cheney
said the staff is endeavoring to resolve this situation without
accepting liability on the part of the City. He said the issue
is whether or not the Council wants to allow these property
owners to use the public canal right-of-way on a yearly basis by
issuance of annual revocable one-year permits. Mr. Lewis, who
applied for a permit to build a seawall, cannot be denied the
privilege of constructing it on the right-of-way unless owners of
similar structures are required to remove theirs. If Mr. Lewis
is given permission to complete his bulkhead, which is properly
built, Mr. Cheney raised the question of whether the City would
be giving licenses to the other owners, whose structures are not
properly built and acknowledge that they were not properly built.
If each owner submits a hold-harmless insurance policy and names
the City as the insured, he would ask the City Attorney if that
protects the City against liability. He believes that would be
an improvement over our present situation, with the City knoWing

the docks are there illegally, but doing nothing about it. If
those owners refuse to sign license agreements, at least the City
will have notified them that they have a dock that is not
approved and they should get insurance on it for both their own
and the City's protection. Removal of the docks would probably
be required only if they appeared to be unsafe for people using
the canal. Mr. Cheney said, if the Council is willing to allow
this usage of the canal right-of,way, this is probably the best
solution to the problem.
Councilman Zimmerman asked for an estimate of how many other
properties are involved, and Mr. Lewis said he counted 25 from
his house to the main canal--the canal from 14th Street to 10th
Street. Mr. Zimmerman said they would be treading on dangerous
ground if they ignored this situation which has come to their
attention. Councilman Warnke suggested the insurance coverage
could probably be in the form of a rider to homeowner's policies.
He clarified that under 3.f. of the proposed Permit to Use Public
Property, successive property owners would be required to remove
these structures or obtain a new license in their own name.
Attorney Vance said the City should retain the right to require
removal of these docks if the need should arise. Councilman
Warnke said it should be emphasized in the letter that goes out
to these property owners that the City is trying to be fair to
all people. This item will be placed on the agenda for the next
Council meeting and will remain on the table.

Am
At the request of the Community Redevelopment Agency,
purchase of land on Intracoastal
Mr. Hank Thompson, Chairman of the CRA, placed a three-page sta-
tement in Council Members' mail boxes today outlining the reasons
the Agency feels this proposed Cove area property should be owned
by the City. Mr. Cheney said he placed this item on the agenda
at the request of the CRA. Councilman Warnke moved to table this
request regarding purchasing of land on the Intracoastal, but he
withdrew the motion to table when Councilman Zimmerman wanted
discussion before tabling the issue. He said the question
brought up to him is what the cost will be and how will improve-
ment to the Cove area be financed.
Mr. Cheney said those questions have been asked of him, and he
has not attempted to give answers nor commented on Mr. Thompson's
letter, as he is waiting for direction from the Council regarding

his involvement. He said if the Council agrees with the CRA's
request, they might give instructions for him to work with the
CRA and participate in their discussions. He pointed out that
the Council adopted the Downtown Redevelopment Plan, and the Plan
calls for the Cove. If the Plan is to be implemented, that would
include the Cove project; until the engineering firm produces a
detailed environmental analysis as to whether the Plan can be
implemented, it is difficult to say what implementing the Cove
project is and what costs will be. If the Plan is to be imple-
mented, Mr. Cheney said it would probably be easier to have some
public control over this land as we go through the environmental
permitting process; with private ownership there would be no way
to implement the Plan with the Cove and also the regulatory agen-
cies ~ill be less receptive to any implementation activity. He
mentioned the two schools of thought among biologists regarding
whether the circulation of water would help the Mangroves or
whether they would be better off left alone.
Councilman Warnke said the Audobon Society has entered into the
suit by Ocean Ridge regarding the bridge across the Intracoastal,
and he thinks the State may advise to what extent and under what
circumstances public usage of the area is allowable. Mr. Cheney
told the Council he will send them a copy of the brief prepared
by the City Attorney's office as our response to the bridge suit.
Councilman Hester thought it is too early to spend money before
we know what will happen in this area. Mayor Cassandra said he
has the same opinion and wonders if what the owner is willing to
sell is useful land at the present time; he pointed out that Mr.
Thompson suggested that any contract to purchase stipulate that
it is subject to permit approval. Councilman Warnke said an
appraisal would have to be obtained in any case, but he thinks it

table the request to purchase land as proposed by the CRA. The

Accept Benjamin Katz's resignation from Golf Course Advisory
Committee
Councilman Warnke moved, seconded by Councilman Hester, to accept
Mr. Katz's resignation as requested in his letter of June 17,
1985, and that an appropriate letter of thanks be sent to him.
Mayor Cassandra suggested that, as the Council appoints board
members, the letters thanking them for service rendered should be
signed by the Mayor. The motion on the floor was voted upon and
carried 4-0.

Ezell Hester
Councilman Hester nominated ~Mr. Alfred Peiffer, presently an
Alternate, to be moved up to a Regular Member. Councilman Warnke
moved, seconded by Councilman Zimmerman, that this appointment be
approved. The motion carried 4-0. At the next Council meeting
an Alternate should be appointed to fill the vacancy left by Mr.
Peiffer.
B. Consider appointment to fill alternate vacancy on Community
Appearance Board - Councilman James Warnke
Councilman Warnke did not have a name to submit for nomination,
so this appointment will be on the agenda for the next Council
meeting.
As there was no further business to conduct, the meeting was
adjourned at 8:35 p.m.
