Mayor Cassandra welcomed everyone and called the meeting to
order at 7:33 P. M. He announced the Invocation will be
given by Councilman James R. Warnke, followed by the Pledge
of Allegiance to the Flag led by Councilman Ezell Hester, Jr.
AGENDA APPROVAL
Mr. Cheney stated he would like to add under Administrative
a budget transfer from Contingencies to the Fire Department for
the amount of $6,150 to put air conditioning in Substation
2. He would like to change Item VII-B to add to the title
the additional height limit being requested is 7 feet. Under
Public Audience, he would like to add Youth Advisory Council.
He would like to delete Item X-B for tonight. He would like
to request that Item IX-C, Palm Beach County Community Devel-
opment Report be allowed to be under Public Audience. Under
the Consent Agenda, the two resolutions should be numbered
85-EE and 85-FF.
Vice Mayor Ferrell stated under XII, Other, he would like to
add Palm Beach County Municipal-League.
Mayor Cassandra stated he would like to add an announcement.
Councilman Warnke moved to approve the agenda as corrected,
seconded by Vice Mayor Ferrell. Motion carried 5-0.
ANNOUNCEMENTS
Mayor Cassandra read a proclamation proclaiming July, 1985,
as National Recreation and Park Month and a proclamation
proclaiming June 14, 1985, as National Flag Day.
Mayor Cassandra referred to Mrs. Lillian Artis, a citizen
of Boynton Beach and member of the Board of Adjustment, and
announced that she has a granddaughter who is having a ear
transplant and last week, they found out the insurance com-
pany is not covering the $12,000 cost. The child is four
years old and the mother is Loretta Clemmons. They have
asked if anyone knows of an organization which can help them.

CITY MANAGER' S REPORT
TIF P. ayment from Bethe~a Hospital
Mr. Cheney referred to there having been some questions about
the TIF payment from Bethesda Hospital, but announced the
hospital's Board of Directors has voted to make payment to us
and Boca Raton this year.
Opening of Boat Ramp Park
Mr. Cheney announced that Boat Ramp Park opened last Wednes-
day and told about the crowded parking conditions there on
Sunday. It will be dedicated July 4 and he went on to tell
about the activities planned there over the July 4th weekend.
Construction of New Boynton Beach Post Office
Councilman Warnke referred to a lot of di~ being moved at the
new post office site and asked if they are demucking and Mr.
Cheney replied affirmatively, but just the site they planned
to do. They are continuing on their planned way, but he still
hopes to talk to them further.
Noise Ordinance
Councilman Warnke questioned the progress of the noise ordi-
nance and Mr. Cheney replied that the major problem is to
organize a training class to certify noise inspectors. We
are hoping to have one through the junior college or work one
out otherwise. It is clear we cannot go to court and testify
until having people who passed the course.
Suggestions for City Manager's Report
Mayor Cassandra referred to questions normally being raised
during the Public Audience period and stated he would like
responses to these during the City Manager's report such as
any action taken on Mrs. Tolpo's car problem, Burdine's
landscaping, corrections to code book, etc.
PUBLIC AUDIENCE
Benches at the Beach
Mr. Morton Goldstein, 130 N. E. 26th Avenue, told about citi-
zens being concerned because the new benches at the beach do
not shade them from the sun. They respectfully request the
City Council to take some action to have the benches shaded.

Councilman Warnke told about Mrs. Goldfarb calling him on
this same subject and he suggested that she outline her con-
cerns in detail. He suggests that Mr. Goldstein do the same.
Mr. Goldstein clarified that the specific thing they are
asking for is the covering of the benches on the boardwalk.
Councilman Hester asked if he had advised-the Parks Director
of this concern and Mr. Goldstein replied that people have,
but were told he could not do anything, but it must go before
the Council. Mr. Chsney agreed that any change in design
would be up to the Council.
Councilman Zimmerman asked if the covering should be changed
just for protection from the sun or the rain also and .Mr.
Goldstein replied it should basically'be for protection from
the sun and suggested installing boards the other way.
Mr. Cheney advised there have been two basic complaints: the
height of the rail and the roof o~er the sitting areas~ Mr.
Goldstein responded that most important is the covering of the
benches and possibly at some future time, the height of the
rail could be addressed.
Mayor Cassandra suggested getting cost figures of a possible
way of doing this with not marring the beauty of the-beach.
He requested the City Manager to submit a report and the
Council agreed.
Mowinq at Jaycee Park
Mr. Frank Oltarzewski, 624 Snug Harbor Drive, referred to a
golf area at Jaycee Park and explained'with showing pictures
how this could not be enjoyed unleSs the grass is cut more
frequently. They would tike to have this cut once a week,
but numerous requests to Mr. Frederick have fallen on deaf
ears. He pleads with the Council for action.
Mr. Cheney explained how the entire city is mowed according
to schedule and if one is mowed more .frequently, others are
delayed, He will give a report at the next meeting and
advise what will happen' if this is done once a week.
Installation of Seawall on Canal
Mr. Edgar Lewis, 1391 S. W. 27th A~enue, told about engaging
a licensed contractor to construct a seawall, like others in
the neighborhood, but advised after completing part of the
seawall, he was told to cease and desist. He would like to
see what action can be taken to allow the completion of this
construction of the seawall.

Mr. Cheney clarified that Mr. Lewis was given a permit to
build a seawall along the canal. It is his understanding
when inspecting the seawall, it was discovered it was not
being built as shown on the plans on the property line, but
was being built within the canal right-of-ways This is one
of the canals dedicated to the public and is included in the
spraying program. The issue is whether the CounCil wants to
abandon a portion of the canal in this area and give Mr.
Lewis the right to build a seawall in the right-of-way, as
well as other peoi~le.

Mayor Cassandra asked if the public has access to this area
and Mr. Cheney replied the public has access to the canal
system by boat and has.visual access from 14th Street, but
this is the end of the canal.
Mr. Lewis informe the Council there are 25 other seawalls
in this immediate area and one was recently installed right
across the canal, which must be on city property with having
an 80 ft. right-of-way. Mayor Cassandra replied it~would be
up to the Council whether they would be willing to allow this
wall to proceed along the shore line with the stipulation to
investigate the other seawalls.
Mayor Warnke questioned~if a Board of Adjustment variance
would be required and Mr. Vance replied negatively as it
would be a license situation.
Mayor Cassandra asked if the Council allows this wall to be
built on city property, would M~. Lewis go along with the
stipulation concept and Mr. Lewis replied affirmatively.

Councilman Warnke moved that~the City Manager be instructed
to proceed in this situation and draw up the appropriate
license for our approval, seconded by Mayor Cassandra after
passing the gavel to the Vice Mayor. Under discussion,
Councilman Zimmerman referred to not being acquainted with
this area and stated he would like to check into this before
voting as there is the possibility of getting too many sea-
wall~ along our canals. Councilman Hester stated when we
start giving it to one person, we will have other people
along the canal wanting to do the same thing and"-must come to
the City Council for approval. He does not believe building
on public property should continue.
Councilman Warnke clarified the intent of the motion was to
have this pursued and brought back to the Council and at that
time, we could review the situation further. Vice Mayor
~errell stated he would be in favor of letting them come back
with more support infOrmation and also would tike to know the
status of others in the ar~a. Councilman Warnks clarified
that the motion was to have the proper permit prepared.
Mayor Cassandra referred to this being dead water in this area
and Mr. Cheney clarified that it ends at this location, but
there is a pipe coming in from Silver Lake.
Councilman ~Zimmerman questioned who would get assessed for
this seawall and Mr. Vance replied that it is probably not
assessed at all.
Vice Mayor Ferrell requested the maker of the motion to make
it clear to come back with information on this and Mayor
Cassandra stated if the city was negligent with stating on
the permit to construct at ~the shore line, then the applicant
was not trying to do anything.
Councilman Warnke clarified'his motion is to refer this back
to the City Manager for the proper permitting process to be
referred back to the City Council with all other factors
taken into consideration. Vice Mayor Ferrell added that a
report should be included. Councilman Warnke added to look
into the situation and have everything brought back to th~
Council. Motion carried 4-1 with Mayor Cassandra dissenting.
Mr. Lewis explained how it was a dangerous situation with the
seawall partially constructed and Mayor Cassandra informed him
the motion has been made and there will be no more discussion.
Mr. Lewis' request will be considered and will be expedited.

Application for Adult Care Center
Mr. Gordon Dunsmore, 220 Main Boulevard, President of Section
I of High Point, expressed concern for an adult care cen~er
planned in their area and Mr. Cheney informed him this is
scheduled for another public hearing at the next Planning &
Zoning Board meeting and next City Council meeting. He thinks
it would be improper to talk about it now and not at the pub-
lic hearing.
Mr. Dunsmore asked if 3rd Street .is going to be opened, which
would lead into their private roads and Mr. Cheney informed
him there has been no final decision on that because the whole
issue was tabled by the Planning & Zoning Board. He thinks
it would be unfair to make comments tonight because the appli-
cant is not present.
Installation of Satellite Antenna
Ms. Sharon Pettzey, representing Charlene & Lee Gillian, 316
N. E. 24th Avenue, explained how they had tried to apply for
a permit to install a satellite antenna, but were turned down
because of needing a hedge or wall six feet in height. She
would like clarification whether this is required around the
satellite itself or their property. Mayor Cassandra suggested
that this question be addressed to the Building Department.
Mr. Cheney clarified that our ordinance~requires six feet of
screening around satellites and· Ms. Pettzey is questioning
whether that condition in the ordinance is necessary. He
suggests this requirement be reviewed as it has.been brought
to our attention that screening interferes with reception.
Further discussion ensued about location, height, etc. of
the hedge or wall and Mr. 'Cheney suggested reviewing the
conditions of this ordinance and leaving the enforcement of
this issue in abeyance. After additional comments, Mayor
Cassandra requested a report to be submitted.
Youth Advisory Council Request
Mr. Harvey Oyer, III, Chairman of the Youth Advisory Council,
told about being invited to the National Youth Conference in
Nashville,Tennessee, and requested approval of approximately
$1,750 for him, Tracey Gilbert, and a chaperone to attend for
a three day, two night period. Mr. Cheney also distributed a
memo in reference to this.
Mayor Cassandra referred to monies being tight, but stated
he submitted this invitation to the Youth Advisory Council

and thinks it is a good idea, but it may be advantageous to
wait for the second ~invitation. Mr. Oyer stated he thinks
it would be advantageous for them to get a good start and
represent the City of Boynton Beach at the nationwide level.
Councilman Warnke stated in reading through the minutes of
the Youth Advisory Council meetings, he was extremely im-
pressed with the progress they have made since being formu-
lated a short time ago. Since the Youth Advisory Council
has taken a tremendous interest in the city, he is in favor
of finding the money to appropriate up to $2,000 for this
youth summer program. Mayor~ Cassandra Stated he is not ac-
cepting a motion as he wants more discussion first.
Councilman Zimmerman questioned the possibility of enough
money in the contingency fund and Mr. Cheney informed him
there is $50,000 and it could be trans£er.~ed.
Councilman Hester commented in favor of sending the youth
to this convention as he thinks it would be a good experi-
ence for them and the city, Vice Mayor Ferrell agreed and
added a limited amount is spent on the youth and we are al-
ways finding money for other things.
Mayor Cassandra stated he would like the chaperone to be
George Hunt, who has been very active with the Youth Advisory
Council, subject to the City Manager's approval. Mr. Oyer
advised they asked Mr. Hunt,'bu~he has another engagement
and cannot attend, They did speak to Vice Mayor Ferrell
about going. Mayor Cassandra requested the chaperone to be
decided.
Councilman Warnke again made his motion to approve up to
$2,000 for thiS trip to go to this national conference,
seconded by Councilman Zimmerman. Motion carried 5-0.
Appointment to Downtown~Review Board
Mr. Bob Fauser, 125 S. E. 6th ~venue, stated he is interested
in the recent appointment of Charles Parker to the Downtown
Review Board. He referred to there being questions whether
Mr. Parker was a Boynton Beach resident and told about his
own investigation revealing Mr. Parker to be a resident of
Delray Beach from voting and license records.
Mayor Cassandra informed him the city will look into verify-
ing Mr. Parker's residence. Mr. Cheney added that he was aware
of this and has had the Police Department verify Mr. Parker's
address. Mayor Cassandra clarified that if the Police Depart-
ment has verified the address in Boynton Beach, that has sat-
isfied our ordinance.

Palm Beach County Community Development Funding for Boynton
Beach for FY 85/86 - First year of Three Year Community
Development Plan
Mr. Allan Schnier, Director, Palm Beach County Housing and
Community Development, referred to the federal funds allo-
cated and requests submitted from Palm Beach County and
stated they have narrowed it down to ~roughly four projects
recommended for'the city's approval. The four projects they
are recommending are to complete the various street improve-
ments in Cherry Hills, Phases III and IV; revitalize Sara
Sims Park; provide curb ramps throughout the city for the
handicapped; and pickup vacant lots that are available for
purchase and provide affordable housing for the residents.
They have also recommended funding a consultant's study to
determine where community centers should be located through-
out Palm Beach County. Last is their residential rehabilita-
tion program and county-~ide code enforcement demolition
program, If the Council is in agreement with their recom-
mendations, he would appreciate a resolution being passed to
take before the County Commissione.rs.
Councilman Zimmerman referred to the county building a senior
citizens' center in Caloo'sa Park and stated we have been talk-
ing about a recreational type center and questioned which he
was referring to. Mr. Schnier explained they were consider-
ing a recreation center similar to the one in Pompey Park.
They feel the best~way to spend limited funds is to take a
look at the existing centers and decide where to put future
centers since requests have been received throughout the
county to enlarge present centers and build new. ones.
Mayor Cassandra referred to requests from Mr.s. Wilda Searcy
and Mr. Schnier advised that some of Mrs. Searcy~s requests
were quite legitimate and he discussed some with the city
staff and it was .felt problems would be created in the city
and they are not recommending them. They are trying to work
with Mrs. Searcy and organize the area with a cleanup cam-
paign and do something with summer programs.
Councilman Zimmerman referred to sidewalks being requested
in Mrs. Searcy's area and Mr. Schnier informed him that in
some of the areas, it is not practical, but the s~reet im-
provements in Cherry Hills will include sidewalks.
Councilman Warnke asked if a resolution was necessary or a
vote and letter would suffice and Mr. Schnier replied that
would be satisfactory.
Vice Mayor Ferrell made a motion to approve the recommenda-
tions of Community Development and send a letter, seconded
by Councilman Zimmerman. Motion carried 5-0.

The Tabulation Committee recommends the bid be awarded to
Counts Rescue Equipment in the amount of $3,399.
2. Annual Requirements for Polyphosphates - Utilities
The Tabulation Committee recommends awarding the bid to the
low bidder, Shannon Chemical Corp., in the amount of .6174¢
per pound.

The Tabulation Committee re, commends that the 'bid be awarded
to Semes Enterprises in the amount of $1,120.
4. Vehicle Towing Service Contract
Mayor Cassandra questioned ithe enumeration of these bids and
Mr. Cheney explained how the bids were analyzed the same as
last year to be consistent since one company had the city con-
tract.
The Tabulation Committee recommends awarding the bid to the
overall low bidder, Zuccala's Towing, in accordance with a
two page memo dated May 31, 1985, submitted by the Purchasing
Agent.
5. Annual Bid for Tires -~Public Works
The asterisks indicate the iow 'bids on the form. The recap
portion was divided between Elpex, Inc. and Pierce Tire Co.
The Tabulation Committee recommends awarding the remaining
portion of the bi~ to Pierce Tire Co. becaUse theY provide
daily pickup service and delivery, whereas Elpex is weekly.

Consider Approval of Reservation Fees for Picnic Shelters
at Boat Club Park
Mayor Cassandra referred to going this route for the beach
because people are staffed there and asked if we intend to
put a fulltime person at Boat Ramp Park and Mr. Cheney in-
formed him it is recommended for a few weeks here to see what
happens. We will want to review it at budget time in detail.
If this is approved and we find people who want to reserve
for a period of time, we will find some way to put up re-
serve signs and have people there to see it takes place.
Mos~ of the time, we do have someone working who can be
sent there. He recommends approving the reservation fee
policy outlined in the memorandum dated May 30, 1985, from
Charles Frederick, Recreation & Parks Director.

Approve Water Service Agreement Amendment for Extension
of Utility Service to Gustafson Property for Residential
Use
Mayor Cassandra stated he was under the impression we were
going to look at site plans when approving such an agreement
and Mr. Cheney informed him this is a typical residential
PUD with an extension of what tke Council previously reviewed.
It is an extension of an already approved development.
Approval of Agreement with Prudential~Bache for Financial

Mr. Cheney advised in accordance with the action of the City
Council selecting Prudential-Bache as the city's financial
consultant, meetings to formalize arrangements and prepare
an agreement have been held. He has reviewed this agreement
as has the City Attorney and both recommend approval by the
City Council.

Request for a determination of consistency with the adopted
Comprehensive Plan for the proposed Planned Commercial
District Regulations ~
Mr. Cheney pointed out that on Page 5, it was corrected to
three acres and on Pages 10 and 1t, it covers the changes the
Council requested. If the Council is satisfied with these
corrections, direction is needed for the City Attorney to
prepare an ordinance.
Vice Mayor Ferrell made a motion to have the City Attorney
draft the appropriate ordinance, seconded by Councilman Warnke.

After further discussion about the height of the building and
actual appearance, Mr. Reynolds further explained how a lower
ceiling on the first floor was undesirable because of not
having room for a bank vault. Other requirements state four
stories, not to exceed 60 feet. This takes into considera-
tion the size of various materials such as door' frames, wall-
board, etc.
Councilman Warnke clarified that the request is for a 50 ft.
building in a 45 ft. height limitation. Vice Mayor Ferretl
added that most of'the four story buildings are in the area
of 44 to 45 feet high with a 6-7 ft. exception for elevator
shafts, but this is a request for 5 ft. additional for the
entire building. Mr. Reynolds stated the majority of four
story buildings are higher than 44 to 45 feet and that is why
he submitted in detail in the letter to show where the actual
footage was going with typical floor to floor requirements.
Vice Mayor Ferrell remarked this is not typical in compari-
son to others.
Vice Mayor Ferrell asked if this was denied, would they
build it at 45 feet with 6 to 7 feet of mech&nical appurte-
nances on top of it and Mr. Reynolds replied the duct worx
for each floor has to go above the ceiling area; it would
not be a benefit to have the mechanical equipment~ on the
roof. The only thing required on the roof is space for the
elevator shaft.
Mr. Cheney explained that this is evidently a different con-
cept and level of design with having 9 and 11 feet floors
instead of 8 and 10 feet floors.
After comments about other exceptions ~and ~reque~sts, Council-
man Warnke asked if he was aware the voters of Boynton Beach
mandated 45 feet and we cannot change it without another
referendum. Mr. Cheney pointed out that the ordinance allows
approval with exceptions for mechanical space within or on
top of a building.
Mr. Robert Carnivale, developer, informed the Council they
want to build a superior office building. They cannot do
it within the 45 ft. limit. To use 8 ft. ceilings would be
like ceilings in homes. If they cannot get this variance
to build a superior office building, they would not build
an inferior building. Councilman Zimmerman suggested hav-
ing three stories and Mr. Carnivale replied that would not
be economical.
After additional comments regarding the height limitation
and exceptions, Vice Mayor Ferrell made a motion to deny
this request, seconded by Councilman Warnke. Motion car-
ried 5-0.

Councilman Zimmerman moued to adopt this ordinance on first
reading only, seconded by Vice Mayor Ferrell. Under discus-
sion, Mayor Cassandra questioned whether the conditions
should be stipulated and Mr. Cannon informed him that condi-
tions are imposed at the 'time of the approval of a specific
application and the zoning ordinance sets forth conditions
that all conditional use applications must meet. Mr. Cheney

questioned if specific Conditions could be included in this
ordinance relating to rental automobiles and Mr. Vance re-
plied it would not be the typical way conditional 'uses are
drafted~ but explained that it could be done. Mayor
Cassandra referred to the Planning Director noting specific
conditions such as current model, relationship to the busi-
ness, number allowed, etc. and Mr. Cheney suggested that it
could be postponed for fur%her study With making the condi-
tions more specific as related to the specific use.
After further comments, Councilman Warnke moved to postpone
this to June 18, seconded by Councilman Z~mmerman. Motion
carried 5-0.

Mr. Cheney informed the COuncil this particular resolu%ion
relates to our activities 'involved with Briny Breezes and
Village of Golf. As we expand our wastewater c
and treatment system, we are required through t

Golf. At the Village of Golf, there is a lift
which we own, and they pump into it and we pump
treatment station. Briny Breezes just recently

and Village of Golf pay us for operation, maintenance,

explained how these two cities also pay the capital facili-
ties charge for their share over a 20 year period plus can
be charged for capacity into the system.
Mr. Cheney advised we have been having discussions with
Village of Golf for a long time. Briny Breezes passed the
same resolution and he hopes Village of Golf will be in agree-
ment with these charges being fair and correct. Village of
Golf cannot use that lift station in that capacity unless
they agree to something. This is finalizing our agreements
with Village of Golf and Briny Breezes and collecting the
capital share over a 20 year period.
Mr. Vance requested the City Clerk to send a certified copy
of this resolution to EPA after approval.
Councilman Warnke questioned whether this would have any
significant impact on our wastewater being sent to the
plant and Mr. Cheney informed him that it has already been
calculated in-and they have a master meter and will pay for
the actual sewerage flow into the system. He added if they
produce more than 8,000 gallons of sewerage, we will collect
for it. Mayor Cassandra referred to these cities paying
the same rate as citizens of Boynton Beach and Mr. Cheney
agreed, but clarified it is equal to the unincorporated
areas' 25% surcharge with paying the capital charge.
Councilman Warnke moved to app~rove proposed Resolution No.
85-GG, seconded by Councilman Zimmerman. Motion carried
5-0.
Other
Discussion with FEC Attorney Concerning Speed Regula-
tions for Railroad
Mr. Edwin F. Radson, Railroad Coordinator for Florida Dept.
of Transportation, informed the City Council in February,
1984, the F.E.C. Railroad submitted an application to in-
crease their speed from 35 to 50 mph. In January, 1985,
a pre-hearing was conducted by the Dept. of Transportation.
After that pre-hearing, D.O.T. submitted to the Director
of Public Transportation the r~ecommendation that the appli-
cation for 50 mph be denied and we accept a speed increase
for 45 mph. He then explained how public hearings are
conducted.
MaYor Cassandra clarified that the D.O.T. is maRing a recom-
mendation for 45 mph and if no request for public hearing
is made, then it is submitted to the Secretary of Transpor-
tation.

Mr. Paul Risner, attorney for F..E.C., referred to making a
presentation at the pre-hearing and told about the original
speed limit being applicable because of unsignalized and un-
protected crossings. He told about going to the expense of
signalizing the crossings in Florida and constantly updating
with new equipment. They now feel it is appropriate to
begin modifications for the speed limits. They feel 50
mph is justified and will present evidence stressing safety,
savings and economy to-~the company. However, it is a great
expense to have personnel attend public hearings when a
compromise is available. They will accept the D~O.T.'s
request if the city will agree to ~accept that. There will
be no decrease in the safety factors in the city and they
will move trains through the city faster. They are basic-
ally here in the spirit of compromise to request the city
to cancel the request for a public hearing and agree to
45 mph.
Mr. Vance stated the Council members may wish to ask some
questions, but he suggests if the city takes any action,
it would be to withdraw the request for public hearing with-
out agreeing to any number.
Councilman Warnke questioned the main reason for increasing
the speed and Mr. Risner replied that the main reason is
because they have made the main line as safe as any in the
nation. He also explained how it would result in substan-
tial savings in fuel, equipment and ease of operations.
Councilman Warnke responded that the trains are already
travelling at 45 mph and there woUld only be a saving of
1½ minutes in the four mile stretch of Boynton Beach going
from 35 to 45 mph. He then told about the present F.E.C.
maps being incorrect. Mr. Risner clarified that they are
operating with ~orrect maps showing railway mile posts.
Also, they do not condone any engineer speeding and have
speed regulators on the trains. They will investigate any
reports of speeding'. Mr. Radson added that since the D.O.T.
does regulate the speed for the F.E.C., they welcome any
type of compl-aints or comments; their inspectors will do
radar checks against the trains.
Mayor Cassandra then expressed his concern for controlling
the speed of trains. He referred to train whistles not
being blown at night and how visibility is decreased for
some people in the dark, the distance required to stop a
train with 100 cars at an increased speed, etc. Mr. Risner
stated they feel comfortable in requesting 50 mph and the
reasons for the reduction to 45 mph will be given at the
public hearing. He then explained how the speed is calcu-
lated from Jacksonville to Miami.

Mr. Cheney referred to the trains carrying chemical and
toxic materials and Mr. Risner stated they do not carry
hazardous wastes. If carrying hazardous wastes, the train
would not be moving at 45 mph. Councilman Warnke stated
he just saw three propane tank cars go through Boynton
Beach at 45 mph.
Vice Mayor Ferrell stated he is not interested in having a
public hearing on this matter and questions what the differ-
ence is if they are already going 45 mph. We must have pro-
gress.
Councilman Zimmerman moved to withdraw our request of having
a public hearing on this matter, seconded by Vice Mayor
Ferrell. No discussion. As requested, Mrs. Boroni took a
roll call vote on the motion as follows:

OLD BUSINESS
Report on Housing AuthOrity Members
Mr. Cheney informed the Council there is a quorum presently
on the Housing Authority with having three regular members
with terms expiring an July 1985, May 1988, and August 1986;
and an alternate with a term expiring in July 1985. Mayor
Cassandra clarified that there is no need to add anyone at
the present moment.
Consider Projects for 1985 Street Resurfacing Program
Mr. Norman Gregory', 644 S. W. 3rd Avenue, stated he hoped the
Council would give consideration to resurfacing the streets
in the Lake Boynton Estates Subdivision. During the thirteen
years he has lived there, only one or two minor improvements
have been made to the area. There are only about 2 to 24
running miles of street improvements needed in that area.
There has been little or no attention given to that particu-
lar subdivision and it is growlng~
Mayor Cassandra asked if any of these streets are included
on the list and Mr. Cheney replied negatively and explained
how the list is prepared. He added that actually the inter-
section at Ocean Drive and Ocean Avenue requires removing the

asphalt and'retreating, as the streets are way above the
curb and have drainage problems. We don't have the money
for such a resurfacing project this year.
After further discussion about the streets in this area,
Mr. Cheney suggested tabling this and he will take a look
at the streets and make a judgment how they fit in with all
the others.
Vice Mayor Ferrell made a motion-to postpone consideration
of this list, seconded by. Councilman Zimmerman. Under dis-
cussion, Councilman Warnke suggested a look be taken at
N. E. 6th Street from Ocean Avenue into the marina area and
from Casa Loma Boulevar~to the Intracoastal. Mr. Cheney
replied that he would prefer not to do anything in this area
for another year and wait .... to see what develops with the
Community Redevelopment Agency. Councilman Warnke agreed.
Motion carried 5-0.
NEW BUSINESS
Consider Administrative Reorganization of Utility Dept.
Mr. Cheney told about discussing this with Mr. Cessna and how
it was felt reorganization for efficiency and operation was
recommended at this time. He as concerned about getting it
reorganized to have Assistant Directors.· He believes Mr.
Cessna should have relief of his day-to-day activity with
moving into the water plant expansion and supplying top
level help. We also must move into preventive maintenance
as the system gets older and he explained. He told how the
recommendation is to bring in an Assistant Utility Director
and diVide this into three divisions. We still have not
found an engineer with the abil±~ty wanted, which was approved
at the last budget, and it is suggested hiring a draftsman
and field inspector to work with the engineer. There are
also two other things to develop with an overall coordinated
program with training and moving the inventory division out
of the user div±sion. Mr~ Cessna then expressed agreement
and added it woUld be much better use of manpower, tools and
supplies to concentrate into one division with maintenance
and repairs to the equipment.
Mayor Cassandra clarified that the request was for a two
manpower increase and Mr. Cheney agreed with an Assistant
Director and Draftsman/Field Inspector.

Councilman Zimmerman moved to grant this request, seconded
by Vice Mayor Ferrell. Under discussion, Councilman Warnke
asked if the increase in inspection fees was included and
Mr. Vance clarified that the Council is approving this re-
organization. Mayor Cassandra clarified that the motion is
to approve the reorganization chart as presented by Mr.
Cheney's memo of June 4, 1985~ Motion carried 5-0.
Consider Administrative Reorganization of Police Dept.
DELETED.
Consider Proposal for Restr.ucturing of Police K-9 Proqrsm
Councilman Warnke complimented the Chief and City Manager on
the comprehensive material submitted on this subject.
Chief Ed Hillery explained how the entire training is geared
to the bonding procedure of a dog and his handler. However,
sometimes this bond can be too much and things get out of
kilter with regard to priorities. A police patrol dog is a
tool to be used in law enforcement. When it becomes more,
emotions enter into the game. He referred to a recent inci-
dent causing investigation into this relationship with the
result being ~to have discussions with vets, handlers, in-
structors, teachers, military, etc. He told about the mili-
tary program not being as intense, They checked into the
possibility of building a kennel in Boynton Beach, but found
the cost was high plus the problem of finding an ideal loca-
tion. He told about checking into co.mmercial facilities and
talking to people about 'housing our dogs. He explained how
less vehicles would be needed and how the' handlers could take
care of the dogs at. the kennel. He would like to try such a
program as recommended in his memorandum of May 7, 1985, to
see if it would work.
Councilman Warnke asked if this program could be phased in
with giving consideration-to the present handlers and Chief
Hillery informed him that this is the best time to do it as
none of the handlers are married and we are in the process
of buying three dogs. He added that if and when we imple-
ment the program, we will do it by steps with one dog at a
time.
Mayor Cassandra referred to the dogs in the military not
being housed in a commercial concept, but being kept with
separate identities and Chief Hillery agreed this was cor-
rect and advised we do not intend to mix our dogs and they
will have a segregated area of the kennel with space between
our dogs and others.

Mayor Cassandra referred to the recommendation-that the
officer's home was the better way to go and Chief Hillery
replied that he doesn'~t necessarily agree and has laid out
considerations for three ways to go. Mayor Cassandra
pointed out with the expert opinions given, none has recom-
mended housing the dog in a commercial concept. Mr. Cheney
agreed this is a new first time effort and we cannot find
any place which has done this or supports this. We have
attempted to give it full consideration based on the recent
incident.
Mayor Cassandra stated he feels he would need more informa-
tion on paper of an approximate estimate from other kennels
of what it would cost. This quote of $5 per day may be in
eagerness to get our business. Consideration must be given
to liability insurance, food, medical needs, etc. Mr.
Cheney clarified that the issue is just being, presented
tonight and there could be conHinued research.
Mayor Cassandra questioned when the handler would feed the
dog and Chief Hillery informed him the normal procedure is
they feed the dogs after work and the same procedure could
be followed at the kennel. Training time could be increased
to be sure of the effect. Handlers have put their dogs in
commerCial kennels when going on vacation.
Mayor Cassandra referred to decreasing the number of canine
patrol cars and Mr. Cheney agreed and explained the number
could be reduced to two cars.
After further comments, Mr. Cheney clarified that Council
support was being requested at 'this time to experiment with
such a program. The Council will be kept informed of every
step along the way.
Vice Mayor Ferrell expressed agreement to trying this pro-
gram. Mayor Cassandra replied that he was not against the
idea of trying something, but is concerned about not having
some necessary answers in this report. He will submit his
questions in writing. Councilman Zimmerman told about check-
ing with people claiming to be experts with dogs and advised
they all favor making the change.
Mr. Chris Yannuzzi, 213 S. W. 7th Avenue, stated he is a
former canine handler on the Boynton Beach Police Depart-
ment. The inference in this is a result of an incident he
was involved in and he wants to go on record stating he
fired that shot to protect Officer Kuss. The dog did not
do what he was supposed to do and possibly it was because
of the bond between them. He thinks this program is some-
thing which should be tried to see if it is going to work.

Vice Mayor Ferrell responded that the inference is part of
this, but there were a lot of other things he related to.
There have been a lot of things which have happened and he
thinks it should be tried and evaluated. If not working
out, the s~aff will tell 'us and recommend a change.
Mr. Cheney summarized that they will continue to research
this and take steps forward. He will come back with a
report and respond to questions wh±ch require answers.

Approve the Addition of One (~1~).Clerical Position to
Planning Department
Mr. Cheney referred.to submitting a'memo and stated he recom-
mends adding a Clerk II for the three.months prior to the new
budget at a cost of $3,000 with about $1,000 for furniture.
Vice Mayor Ferrell made a motion to approve the addition of
a clerical position in the Planning'Department, seconded by
Councilman Warnke. Motion carried 5-0.
ADMINISTRATIVE
Consider feasibility of two alternates instead of three
for Community Appearance Board
Mayor Cassandra suggested this be tabled because a memo was
written to the Community Appearance Board requesting their
opinion. Vice Mayor Ferrell made a motion to table, seconded
by Councilman Hester. Motion carried 5-0.
Budget Transfer Request
Mr. Cheney requested the transfer of $6,150 from Contingen-
cies to the Fire Department for an air conditioner for Sub-
station 2, since their air conditioner died'and has been a
problem since the building was built. Vice Mayor Ferrell
made a motion to transfer the amount for this air conditioner
for fire station 2. The motion was seconded and carried 5-0.
OTHER
Palm Beach County Municipal League
Vice Mayor Ferrell referred to the Council being aware of
the discussions at the League meeting and moved to direct
the City Manager to write a letter containing the results
of our vote in reference to weighted voting to the Municipal
League, seconded by Councilman Hester. Under discussion,

Councilman Zimmerman advised that Mrs. Vallan, Manager of
Manalapan, had talked to him expressing the idea there may
be some other way to give recognition to.larger cities
excluding going to weighted voting - possibly by having
additional delegates for the larger cities. She just did
not think all the avenues were looked into yet and thinks
she feels very strongly the League will consider something
to keep all cities together. We must find some solution to
this problem.
Vice Mayor Ferrell staked a committee was appointed to look
into weighted voting. -Mrs. Vallan comes from a smaller
city. If it doesn't go to weighted~voting, some of the
cities will go out. He thinks there w~tl be eight to nine
cities making a formal request. He doesn't think it is nego-
tiable. He thinks it is time to consider this. Councilman
Zimmerman clarified that he is not against weighted voting,
but if something better comes up with giving the larger
cities recognition theyneed with the same results, he
might go with that.
Councilman Warnke added there are many ramifications with
this issue. The nine member committee will be set up within
the next month. They will come back wi. th all the issues
pro and con of weighted voting. ~e has attended every
Municipal League meeting for the past three years and has
not seen the larger cities get short changed. He would like
to see the issues from the committee before making a deci-
sion. '
Councilman Hester commented that he thinks with weighted
voting, there would be the chance of doing a better job.
After further discussion, a vote was taken and the motion
carried 3~2 wi'th Councilmen Warnke and Zimmerman dissenting.
Summer Youth Programs_
Mr. Cheney stated included in his memo regarding funding
for Youth Advisory Board members to attend the convention
was a request for a summer youth work program. There were
three projects listed with the cost of the program being
approximately $2,700. Mayor Cassandra requested this to be
included on the next agenda.
ADJOURNMENT
Vice Mayor Ferrell moved to adjourn, seconded by Councilman
Zimmerman. Motion carried 5-0 and the meeting was properly
adjourned at 11:30 P. M.
