Minutes 03-17-10 MINUTES OF THE CODE COMPLIANCE BOARD MEETING HELD ON WEDNESDAY, MARCH 17, 2010, AT 6:30 P.M. IN CITY COMMISSION CHAMBERS, BOYNTON BEACH, FLORIDA PRESENT: Michelle Costantino, Chair Scott Blasie, Code Compliance Administrator Richard Yerzy, Vice Chair Shana Bridgeman, Assistant City Attorney James Brake Robert Foot Mark Karageorge Kirk LaRock Jamie LaTour ABSENT: Kathleen Carroll, Alternate I. Call to Order Chair Costantino called the meeting to order at 6:31 p.m. II. Approval of January 20, 2010 Minutes Motion Mr. Yerzy moved to accept the minutes with the corrections noted. Mr. Karageorge seconded the motion that passed unanimously. III. Approval of Agenda Mike Melillo, Senior Code Officer, requested case #03-2123 be tabled until January 19, 2011. Motion Mr. Brake moved that the aforementioned case be tabled until the Code Compliance Board meeting to be held on January 31, 2011. Mr. Yerzy seconded the motion. It was noted the correct date of the Code Compliance Board meeting would be January 19, 2011. The motion and second were retracted. 1 Meeting Minutes Code Compliance Board Boynton Beach, Florida March 17, 2010 Motion Mr. Brake moved that the aforementioned case be tabled until the Code Compliance Board meeting to be held on January 19, 2011. Mr. LaRock seconded the motion that unanimously passed. Officer Melillo informed the Board cases #10-~ 226 and #10-190 came into compliance. Additionally, he requested case #09-3799 be tabled for 30 days. Motion Mr. Foot moved that case #09-3799 be tabled until the Code Compliance Board meeting to be held on April 21, 2010. Mr. LaRock seconded the motion that unanimously passed. Officer Melillo reported case #10-92 was removed and case #10-185 was closed. He advised case #09-3194, and not case #09-3799, should have been tabled to April 21, 2010. Motion Vice Chair Yerzy moved to remove case #09-3799 from the table. Mr. LaTour seconded the motion that passed unanimously. Motion Mr. Foot moved that case #09-3194 be tabled until the Code Compliance Board meeting to be held on April 21, 2010. Mr. LaRock seconded the motion that passed unanimously. Scott Blasie, Code Compliance Administrator, requested Jim Vreeland, of FPRC (Federal Property Registration Corporation), address the Board at the beginning of the meeting. FPRC was currently partnering with the City to register foreclosure properties and identify potential buyers for the foreclosure homes. Motion Mr. Karageorge moved to have Mr. Vreeland address the Board after approval of the agenda and before the swearing in of witnesses. Mr. LaTour seconded the motion that passed unanimously. 2 Meeting Minutes Code Compliance Board Boynton Beach, Florida March 17, 2010 Motion Mr. Karageorge moved to approve the agenda. Mr. Foot seconded the motion that passed unanimously. Jim Vreeland, of FPRC (Federal Property Registration Corporation), explained FPRC, a third-party vendor, was partnering with the City to identify and track foreclosure properties. Mr. Vreeland had been working with staff to contact lenders, servicers, trustees and mortgagees. Electronic registration requirements were available to Code Compliance staff. Mr. Blasie added the City had received more than $2 million in Federal grant monies to stem the foreclosure tide, and staff was charged with finding, screening and placing property owners in the foreclosed homes. It was noted the City had entered into an agreement with the Community Development Corporations (the Faith-Based CDC and the R.M. Lee CDC) in the City, and they would be screening the applicants to determine whether they were qualified to move into the foreclosed homes. More than 300 properties had been registered to date. Officer Melillo called the roll and determined the Respondents who were present. IV. Swearing in of Witnesses and Introduction Attorney Bridgeman explained the hearing procedure and administered the oath to all who would be testifying. Chair Costantino requested case #10-520 be heard next, followed by cases #09-3178, #09-3728, #09-3783 and #09-3694 as the attorney was present. There was no objection to the request. Case #10-520 Virginia D. Tacy Location: 3024 E. Palm Drive Violations: CO CH4 SEC. 4-4 CO CH4 SEC. 4-32 Dog must be humanely secured to property or on a leash when not on the property. Dog was tethered between 10:00 a.m. and 5 p.m. which is against tether regulations. 3 Meeting Minutes Code Compliance Board Boynton Beach, Florida March 17, 2010 Liz Roehrich, Animal Control Supervisor, presented the case and reviewed the details of the violations. The initial inspection was completed on February 8, 2010. Written notice was provided and compliance with the leash law was expected immediately. The notice was sent via certified mail and posted on the property. Five bites by the dog had been reported since February 2007 and on each occasion, the dog ran unleashed in the streets. The dog bit again on August 2009 and was declared potentially dangerous by Palm Beach County Animal Control on February 8, 2010. Staff requested a Cease and Desist Order be issued for the noted violations. Ryan Spear, 3024 E. Palm Drive, noted he owned the dog and rented the premises. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Karageorge moved that a Cease and Desist Order be issued giving Virginia D. Tracy until March 27, 2010 to bring the violations of City of Boynton Beach Code sections as cited into compliance. The Board has considered the gravity of the violations, the actions taken by the Respondent, and any previous violations by the Respondent, and hereby orders that a fine in the amount of $100 per recurrence of the violation thereafter shall be imposed upon the Respondent. Mr. LaTour seconded the motion. Ms. Roehrich noted Mr. Spear was keeping the dog inside the home and as long as he continued to do so, neither of the incidents would recur. The motion passed unanimously. Case #09-3178 Bank of America 8035 Stirrup Cay Ct. Skip Lewis, Senior Code Officer, presented the case, noting the foreclosure property was required to be registered by the lender. The case had been presented to the Board on January 20, 2010, and no one had appeared. The Board had established a compliance date of February 4, 2010, or a fine of $150 per day. The violation still existed, with 40 days of non-compliance. An attorney representing the mortgage holder was present. th James Karat, of the law firm of Marshall C. Watson, 1800 NW 49 St., Fort Lauderdale, noted he represented Bank of America. In this case, as well as incCases #09-3178, #09-3728, #09-3783 and #09-3694, he was requesting more time to allow the Banks to come into compliance. The Banks in all four cases were still in active foreclosure. In this case a summary judgment hearing had not yet been conducted and the Certificate of Title was still in the name of the property owner, Michelle Galan. 4 Meeting Minutes Code Compliance Board Boynton Beach, Florida March 17, 2010 Officer Lewis noted the properties had not been maintained and the pool, while secure, was not sanitary. Photographs were provided for the Board's review. Attorney Karat requested 60 days be given to clean up and register the property. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Foot moved that this Board find that the Respondent has not complied with this Board's Order dated January 20, 2010, and having considered the gravity of the violations, the actions taken by the Respondent, that this Board impose and certify a fine in the amount of $150 per day plus administrative costs which shall continue to accrue until the Respondent comes into compliance or until a judgment is entered based upon this certification of fine. Mr. LaRock seconded the motion that unanimously passed. th Case #09-3728 US Bank National Assoc. 145 SW 13 Ave. Pete Roy, Chief Code Officer, presented the case. The property had not been registered by the lender, and it was necessary for trash and debris to be removed and for the bushes on the west side to be trimmed. The case had been presented to the Board on January 20, 2010, and Attorney Joanne Galipaulk had appeared. A compliance date and fine had been established of February 19, 2010, or $150 per day. The violations still existed, having 25 days of non-compliance. James Karat, representing US Bank National Assoc., requested an extension of time to comply. The Bank had not yet taken title to the property, and a closing date had not yet been scheduled. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Karageorge moved that this Board find that the Respondent has not complied with this Board's Order dated January 20, 2010, and having considered the gravity of the violation, the actions taken by the Respondent, that this Board impose and certify a fine in the amount of $150 per day plus administrative costs which shall continue to accrue until the Respondent comes into compliance or until a judgment is entered based upon this certification of fine. Mr. LaTour seconded the motion that unanimously passed. th Case #09-3783 US Bank National Assoc. 436 SW 7 Ct. Officer Roy presented the case. In order to bring the property into compliance, it was necessary for the property to be registered by the lender, for the yard to be mowed and the trash and debris removed. The case was presented to the Board on January 20, 5 Meeting Minutes Code Compliance Board Boynton Beach, Florida March 17, 2010 2010, and Attorney Joanne Galipaulk had appeared. A compliance date and fine had been established of February 19, 2010, or $100 per day. The violation still existed, having 25 cays of non-compliance. James Karat, representing US Bank National Assoc., noted the property had been previously rented but was currently vacant. He requested additional time to comply. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Karageorge moved that this Board find that the Respondent has not complied with this Board's Order dated January 20, 2010, and having considered the gravity of the violation, the actions taken by the Respondent, that this Board impose and certify a fine in the amount of $-159 $100 per day plus administrative costs which shall continue to accrue until the Respondent comes into compliance or until a judgment is entered based upon this certification of fine. Mr. LaRock seconded the motion that unanimously passed. Case #09-3694 BAC Home Loans Servicing LP 2602 SW 8th St. Vestiguerne Pierre, Senior Code Officer, presented the case. It was necessary for the foreclosure property to be registered by the lender. Additionally, it was necessary for the yard tp be mowed and for the overgrown vegetation to be trimmed. The case was presented to the Board on January 20, 2010, and no one had appeared. A compliance date and fine had been established of February 4, 2010 or $150 per day. The violation still existed, having 40 days of non-compliance. James Karat, representing BAC Home Loans Servicing LP, noted the Bank had not yet taken title to the property. He requested 45 days be given to comply with both the registration and lawn violations. Chair Costanti,no recommended the matter be tabled for 10 or 15 days. Motion Mr. Brake moved that the aforementioned case be tabled until the Code Compliance Board meeting to be held on April 21, 2010. Mr. LaRock seconded the motion that unanimously passed. It was noted the fine would be running on all four of the cases. Case # 10-394 James E. and Eddy W. McGrady 6 Meeting Minutes Code Compliance Board Boynton Beach, Florida March 17, 2010 Location: Violation: 309 NW 10th Ave. CO CH15 SEe. 15-120(D) INe. Remove or register all motor vehicles. Officer Melillo presented the case and reviewed the details of the violations. The property had, been initially cited on February 3, 2010. Written notice had been provided. The Respondents were given 10 days to comply. Notification of the hearing was sent via certified mail and posted on the property. Eddy W. McGrady, 309 SW 10th Ave., pled not guilty, adding one of the vehicles had been removed and the others were registered. There was a question as to whether the tags shown in the photographs were actually the tags for the vehicles. As such, Officer Melillo requested the case be tabled until the next meeting in order to verify the information. Motion Mr. LaTour moved that the aforementioned case be tabled until the Code Compliance Board meeting to be held on April 21, 2010. Mr. LaRock seconded the motion that unanimously passed. Case #10-197 Location: Violation: Andrew and Sabina Smejkal 189 SE 2ih St. CO CHIS SEe. 15-120(D) INe. Remove all unregistered or inoperable vehicles from property. Auto repair is not permitted in residential lone. Officer Pierre presented the case and reviewed the details of the violation. Andrew Smejkal, 9561 Carrousel Circle E, Boca Raton, pled no contest. After receiving notice of the violation in February 2010, Mr. Smejkal visited the property and observed a green automobile that was not registered. He advised the tenants to remove the unregistered vehicle or he would have it towed. He also advised the tenants' auto repairs were not permitted on the property. As the unregistered car had not been removed, Mr. Smejkal had the vehicle towed. He again visited the premises on March 16, 2010 and observed an unregistered white Nissan Maxima. He informed the tenants if the vehicle had not been removed from the property by 8:00 a.m. on March 17, 2010, he would have the vehicle towed. He visited the property on March 17th and observed the car had been removed. Mr. Smejkal visited the property just prior to this meeting and observed six cars on the property, all with registrations. 7 Meeting Minutes Code Compliance Board Boynton Beach, Florida March 17, 2010 However, the tire was flat on one of the vehicles. While Mr. Smejkal had no objection to towing the cars, he could not be certain which vehicle was inoperable. Officer Pierre requested a Cease and Desist order be issued. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Karageorge moved that a Cease and Desist Order be issued giving Andrew and Sabina Smejkal until March 27, 2010 to bring the violations of City of Boynton Beach Code sections as cited into compliance. The Board has considered the gravity of the violations, the actions taken by the Respondents, and any previous violations by the Respondents, and hereby orders that a fine in the amount of $250 per recurrence of the violation trereaftef shall be imposed upon the Respondents. Mr. Foot seconded the motion. Mr. Blasie explained one fine would be imposed for each recurrence, whether for six vehicles or one. An inoperable vehicle was defined as an automobile that could legally operate on a roadway. The motion passed unanimously. Mr. Blasie provided an overview of the lien reduction procedure. Case #09-1634 Merrideth Ann & Phillip Walker 1102 W. Fairfax Circle Officer Roy presented the case, noting a building permit was required. The case was presented to the Board on September 16, 2009, and no one had appeared. A compliance date and fine had been established of October 16, 2009, or $100 per day. Staff documented compliance on January 5, 2010, having 80 days of non-compliance. David Phillip Walker, 1103 Fairfax Circle West, informed the Board he was the property owner. He had the roof repaired in 2006 for damages caused by Hurricane Wilma. In May 2009, staff informed Mr. Walker that the property was in violation as a final inspection on the roof had not been made. Mr. Walker contacted the roofing contractor. However, he had relocated to Oklahoma and would not provide any assistance. Thereafter, Mr. Walker hired an engineer who reexamined the roof and notified the City of his approval. The Respondents currently reside in the home, which is fully maintained and under contract to be sold. A lien existed on the home at $100 per day. If the lien were removed, Mr. Walker would be able to sell the house and buy 8 Meeting Minutes Code Compliance Board Boynton Beach, Florida March 17, 2010 another home. in the City that was affordable. He anticipated the closing would occur within two months. Motion Based on testimony and evidence presented in the aforementioned case, and having been advised that the Respondents have complied with all lien reduction procedures set forth in Section 2-84 through 2-89 of the City of Boynton Beach Code of Ordinances, Mr. Foot moved that this Board reduce the fines instituted in the aforementioned case by virtue of this Board's Order of September 16, 2009, to an amount of $538.09, including administrative costs. Mr. LaRock seconded the motion that unanimously passed. Case #08-928 Wilchild and Marie W. Guerrier 6 Elton Place Officer Roy presented the case. The Respondents were cited on March 20, 2008, as a Business Tax Receipt was required to rent the residence. The case was presented to the Board on July 16, 2008, and no one had appeared. A compliance date and fine had been established of July 26, 2008, or $100 per day. Staff documented compliance on November 3, 2008, having 99 days of non-compliance. Melanie Huegel, advised she was with Moyna Properties, listing agent for Federal Home Loan Mortgage Corp., 621 NW 53rd St., Suite 390, Boca Raton. The property came into compliance before the Bank became involved with the property. Ms. Huegel requested the lien be reduced to administrative costs for the owner's failure to comply. The Bank took title on December 1, 2009, and the owner was legally evicted in January. It would be necessary for the Bank to determine the identity of the current occupant based upon the Protecting Tenants in Foreclosure Act wherein a tenant was granted a 90-day stay after the issuance of the Certificate of Title. In this case, the owner was automatically evicted once the Certificate of Title was issued and recorded. Motion Based on testimony and evidence presented in the aforementioned case, and having been advised that the Respondents have complied with all lien reduction procedures set forth in Section 2-84 through 2-89 of the City of Boynton Beach Code of Ordinances, Mr. Karageorge moved that this Board reduce the fines instituted in the aforementioned case by virtue of this Board's Order of July 16, 2008, to an amount of $634.12, including administrative costs. Mr. LaRock seconded the motion. 9 Meeting Minutes Code CompUance Board Boynton Beach, Florida March 17,2010 Mr. Foot felt the owner was defiant as the lien was still outstanding prior to the Bank's involvement. This was not an unfortunate situation as in the earlier case where the contractor had not done what was required. He believed the lien should be reduced to at least $1,000 plus administrative costs. The motion passed 5-1 (Mr. Foot dissenting). Case #08-2253 Navon Wallace 45 S. Palm Drive Officer Roy presented the case and reviewed the details of the violations. The Respondent was originally cited on August 1, 2008 and was directed to secure the property and mow the lawn. The case was presented to the Board on November 17, 2008, and no one had appeared. A compliance date and fine had been established of September 27, 2008, or $50 per day. Staff documented compliance on November 17, 2009, and there were 415 days of non-compliance. Kathryn Weber, Nautica Realty, 1200 S. Federal Highway, Suite #307, advised she represented the Bank that currently owns the property. While the property had been under contract since December 2009, the parties were unable to close because of the liens against the property. The property had been assigned by the Bank to Nautica Realty on November 6, 2009. Ms. Weber drove by the property this date and discovered issues with the fence and electrical outlet illegally installed on the front porch. The violations were corrected and the exterior and interior of the property have been maintained. The top rail of the fence was missing because it was stolen after the fence had been repaired. Ms. Weber provided "before" and "after" photographs for the Board's review. Officer Roy indicated the house had been secured, and he provided "before" and "after photographs for the Board's review. Ms. Weber added the property had been secured November 6, 2009, the day Nautica Realty received the assignment from the Bank. The property was currently listed at $41,900 and the fines exceeded $20,000. Motion Based on testimony and evidence presented in the aforementioned case, and having been advised; that the Respondent has complied with all lien reduction procedures set forth in Section 2-84 through 2-89 of the City of Boynton Beach Code of Ordinances, Mr. Karageorge moved that this Board reduce the fines instituted in the aforementioned case by virtue of this Board's Order of September 17, 2008, to an amount of $2,000, including admInistrative costs. Vice Chair Yerzy seconded the motion that unanimously passed. 10 Meeting Minutes Code Compliance Board Boynton Beach, Florida March 17,2010 Case #10-391 Location: Violation: Andrew 8r. Lenoria B. Clark 700 SW 4th Ave. CO CHI0 SEe. 10-2 Remove or trim holly back to adjacent lot property line. Holly is located on the ih Street abandoned right-of-way. Officer Roy presented the case and reviewed the details of the violations. The initial inspection was completed on February 4, 2010. The Respondents were given 10 days to comply. Service was effectuated by certified mail. Staff recommended 10 days be given for compliance. Andrew and Lenoria Clark, 700 SW 4th Avenue, pled no contest. The Respondents felt it was not their responsibility to trim the holly as it was not on their property but rather at the dead end of the street. Officer Roy explained a portion of SW ih Street had been abandoned from 4th Avenue going south and as such, the Clarks owned half the property and their neighbors owned the other half. Mr. Clark requested an extension of time to cure the violation and would appreciate whatever the Board would allow. Suggestions included 30, 45 and 60 days to comply. Officer Roy noted the violation did not create a health halard, and he had no objection to a 60-day extension. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Foot moved that this Board find that Andrew & Lenoria B. Clark are in violation of the City of Boynton Beach Code section cited and moved to Order that the Respondents correct the violation on or before May 16, 2010. The Board has considered the gravity of the violation, the actions taken by the Respondents and any previous violations by the Respondents and hereby orders that if the Respondents do not comply with this Order, a fine in the amount of $50 per day for each day the violation continues past May 16, 2010, plus administrative costs shall be imposed. The Respondents are further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re-inspection of the property to verify compliance with this Order. Mr. LaRock seconded the motion. Discussion ensued and it was suggested by Vice Chair Yerzy and Mr. LaTour that a fine of $25 per day be imposed. Mr. Foot noted he would not reconsider his motion. 11 Meeting Minutes Code Compliance Board Boynton Beach, Florida March 17, 2010 The motion failed 1-6 (Chair Costantino, Vice Chair Yel2Jl, Messrs. Brake, Karageorge, LaRock and LaTour dissenting). Motion Based on the testimony and evidence presented in the aforementioned case, Vice Chair Yerzy moved that this Board find that Andrew & Lenoria B. Clark are in violation of the City of Boynton Beach Code section cited and moved to Order that the Respondents correct the viQlation on or before May 16, 2010. The Board has considered the gravity of the violation, the actions taken by the Respondents and any previous violations by the Respond~nts and hereby orders that if the Respondents do not comply with this Order, a fine in the amount of $25 per day for each day the violation continues past May 16, 2010, plus administrative costs shall be imposed. The Respondents are further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re-inspection of the property to verify compliance with this Order. Mr. LaTour seconded the motion that passed 6-1 (Mr. Foot dissenting). (The Board recessed at 7:59 p.m. and reconvened at 8:10 p.m.) Case #10-240 Location: Violation: 1420 Holdings 1420 SW 30th Ave. CO CH9 SEe. 9-22(C) Annual fire inspection fees. John Herring, Code Officer, presented the case and reviewed the details of the violation. It was noted the Respondent was a repeat violator. Staff recommended 10 days be given -for compliance. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Karageorge moved that this Board find that 1420 Holdings is in violation of City of Boynton Beacn Code Section as cited, and move to order that the Respondent correct the violation on or before March 27, 2010. The Board has considered the gravity of the violation, the actions taken by the Respondent, and any previous violations by Respondent, and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $100 per day for each day the violation continues past March 27, 2010 plus,administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re-inspection and verification of payment of the fees to comply with this Order. Vice Chair Yerzy seconded the motion that passed unanimously. 12 Meeting Minutes Code Compliance Board Boynton Beach, Florida March 17, 2010 Case #10-247 Boynton Commerce Center LLC and Teele & Associates 2103 Corporate Drive CO CH9 SEe. 9-22(C) Annual fire inspection fees. Location: Violation: Officer Herring presented the case and reviewed the details of the violation. It was noted the Respondents were repeat violators. Staff recommended 10 days be given for compliance. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. LaTour moved that this Board find that Boynton Commerce Center LLC is in violation of City of Boynton Beach Code Section as cited, and move to order that the Respondent correct the violation on or before March 27, 2010. The Board has considered the gravity of the violation, the actions taken by the Respondent, and any previous violations by Respondent, and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $100 per day for each day the violation continues past March 27, 2010 plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re-inspection and verification of payment of the fees to comply with this Order. The Board has considered the gravity of the violation, the actions taken by the Respondent, and any previous violations by Respondent, and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $100 per day for each day the violation continues past March 27, 2010 plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re-inspection and verification of payment of the fees to comply with this Order. Vice Chair Yerzy seconded the motion that passed unanimously. Case #10-425 Woolfed Inc. - Wachovia 1600 S. Federal Hwy. CO CH2.5 SEe. 2.5-12+ 13 Location: Violation: 13 Meeting Minutes Code Compliance Board Boynton Beach, Florida March 17, 2010 Excessive false alarms. Officer Herring presented the case and reviewed the details of the violation. Staff recommended 10 days be given for compliance. Motion Based on the testimony and evidence presented in the aforementioned case, Vice Chair Yerzy moved that this Board find that Woolfed Inc. is in violation of City of Boynton Beach Code Section as cited, and move to order that the Respondent correct the violation on or before March 27, 2010. The Board has considered the gravity of the violation, the actions taken by the Respondent, and any previous violations by Respondent, and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $50 per day for each day the violation continues past March 27, 2010 plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re- inspection and verification of payment of the fees to comply with this Order.
