Mayor Zimmerman called the meeting to order at 7:30 P. M.
The invocation was given by Father John Block, St. Mark's
Catholic Church, followed by the Pledge of Allegiance to
the Flag led by Councilman Nick Cassandra.

Owen Anderson, Executive Director of the Chamber of Commerce;
Walter Kies, Member of the Community Appearance Board; Dee
Zibelli, Chairman of the Community Relations Board; Ben
Uleck, Member of the Board of Adjustment; Ralph Marchese,
Member of the Civil Service Board; Mary Reeves of The Post;
and Kipp Friedman and Paul Millette, Boynton Beach News
Journal were present in the audience.
AGENDA APPROVAL
Councilman Warnke wanted to add the Minutes of the previous
meetings to the Consent Agenda as "0" inasmuch as there are
very few corrections and it may speed things up in the future.
There were no objections to this suggestion.
On the assumption that the Council would approve the renewal
of the lease for the access of City landfill, City Manager
Cheney added $1,200, (the City's annual payment for the
access place) to "N. Approval of Bills."
Councilman Wright moved to approve the agenda as corrected,
seconded by Councilman Cassandra. Motion carried 5-0.

opposition and return for two additional years to serve the
City. He felt it said a lot for what the Council tried to
do in the City during the last five or six years. Council-
man Wright expressed that it is great that the Council has
people of experience to do things that need to get
accomplished in the City.
CITY MANAGER' S REPORT
G.A.L.A.
City Manager Cheney asked Charles Frederick, Director of
Recreation and Parks, to give a summary of what is happening
at G.A.L.A. this year. Mr. Frederick said this year
G.A.L.A. will be one of our biggest and best. To date, 144
artists and craftsmen have already paid and are confirmed
for the program. These people represent 36 states, Japan,
and Canada. 39 businesses have signed and paid to exhibit
in the business portion of the show, and close to 50 are
anticipated by show time. 12 to 15 concessions will serve
food and drinks.
Mr. Frederick said 30 entertainment programs are scheduled
for the three day period, and he named some of them. There
will be a Craft Center, Youth Art Exhibit, magic show, break
dancing, etc. for the kids.
Mr. Frederick added 144 artists are booked, which is all
they can handle because of space, but there is a waiting
list of many people who would like to get into the show.
Florida League of Cities
City Manager Cheney thought this meeting was worthwhile and
said Vice Mayor Ferrell, Councilman Wright, and he had a
chance to serve on three of the committees which help develop
legislative policies for the State.
Building Officials Association of Florida
City Manager Cheney reported that they had a question about
th policy issue of the Florida League of Cities developing
a policy and other City related organizations developing a
different policy. A Resolution was passed at Tallahassee
urging that this not happen. City Manager Cheney spoke to
the Building Officials Conference in Tampa last week and
pointed out to them that this had happened in the past; they
hage the Resolution and are hoping that all of these organi-
zations will work more closely together in developing poli-
cies in the future.

City Manager Cheney announced that Bud Howell, Building
Official, was elected President for the coming year of the
Building Officials Association of Florida. There was
applause.
Palm Beach County Chapter of Building Officials
City Manager Cheney further announced that Bert Keehr,
Deputy Building Official, is now President of this Chapter
of Building Officials.
"Boat Ramp Park
City Manager Cheney reported that the concrete blocks which
are'there and will be tied together to become the new boat
ramp are all in place. Dan O'Connell is addressing the
whole place at once. It is well organized, and City Manager
Cheney thought the City would see the project done well on
time and that it will be a very good job.
Special Council Meeting - Interview of Architects
On the evening of Monday, March 4, there will be a Special
Council Meeting at 7:00 P. M. for the purpose of interview-
ing three architectural firms who have been recommended
for the various capital improvement projects the City has
been talking about. This is a public meeting, so anyone can
attend. Regardless of how many bond issues pass, City
Manager Cheney told the Council the City will need an
Architect.
PUBLIC AUDIENCE
Outstanding Utility Bill
Chris Wescott, 350 Pilgrim Road, West Palm Beach, General
Manager of Paggey Investors, Inc. Mr. Wescott is also
employed by John Pagliarulo, Building Contractor, on a part-
time basis as Business Manager.
Since Mr. Wescott is involved with both companies, recently
a bill has come to their attention regarding a hydrant water
meter owed by Pagey Investors, Inc. When Yachtman's Plaza
was originally developed, John Pagliarulo was the developer.
In order to have temporary water, a hydrant was needed, so
they asked that a hydrant water meter be signed out for
them. Mr. Wescott said they started receiving bills for the
meter and the first bill they had paid. Each additional
month, they received another bill.

At that time, Mr. Wescott said they called the Billing
Department and were told to disregard the bills, as they
were estimated bills, and upon return of the meter, they
would be adjusted to how much water they used. Each month,
Mr. Wescott said they called, and each month they were told
the same thing.
When the meter was returned, they were billed approximately
$8.00 for water, which was paid. To this date, they still
receive a bill for $207.30 for the meter, and they are now
told this is a service charge per month for not bringing the
meter back for reading.
Mr. Wes¢ott checked all of the records on file at his office
and Mr. Pagliarulo's office and cannot find anything pertain-
ing to leasing the meter per month, any kind of charges per
month, or any kind of written Ordinance or anything stating
they would pay a monthly fee if they did not bring back the
meter each month for a reading.
At this time, Mr. Pagliarulo's water meters for his building
have been tied up because of Pagey Investors' outstanding
bill. Mr. Wescott stated that these are two separate
companies, and Mr. Pagliarulo does not at this time have
controlling interest of Pagey Investors. Mr. Wescott veri-
fied this and freed Mr. Pagliarulo's water meters, so his
construction can go on, but this remains an outstanding bill
for Pagey Investors.
Mr. Wescott was informed today by George Hunt, Assistant to
the City Manager, that all of Pagey Investors' water meters
and anything further to do with the City would be held up
until this outstanding bill is paid. At this time, Pagey
Investors is developing 18 single family homes in Miner
Ridge Estates, and they cannot purchase any water meters or
anything to do with the City until the bill is paid.
Since there is no written, legal, or verbal things to go on,
Mr. Wescott felt the bill should be dissolved and Pagey
Investors should be free of the debt and the burden the City
has put on them.
Councilman Warnke asked if there was any written response
from the City's Utility Department about the bill. Mr.
Wescott said they have nothing but the bill that comes
monthly in the amount of $207.30. Councilman Warnke deter-
mined that the only response Mr. Wescott had from the
Utility Department was verbal. Councilman Warnke suggested
that Mr. Wescott ask for a written response. If that is

not satisfactory, he should take it to the City Manager's
office for final review and come back to the Council if he
was not satisfied.
When the meter was read, Mr. Wescott said the Water Meter
Department was satisfied the $8.00 was paid, and there was
no problem there. Mike Munro of the Billing Department
seems to be giving Mr. Wescott the most problems. As far
as Mr. Munro is concerned, they owe the outstanding debt,
and he refuses to let anything go by. Mr. Wescott believed
this was almost 2-1/2 years ago. If things are changed
where now people have to sign out hydrants, it would be
different, but Mr. Wescott wondered who could remember that
far back to know what was done at that time.
Councilman Warnke told Mr. Wescott to refer this to the City
Manager for review and, if not satisfied at that time, he
should come back to the City Council with documentation.
Mayor Zimmerman was sure City Manager Cheney would give the
Council a report after Mr. Wescott contacts him.
Work Performed at S.W. 18th Street and Roma Way
Ralph A. Marchese, 1901 Roma Way, Boynton Beach, told of a
vehicle driving over and toppling a fire hydrant at the
intersection of S. W. 18th Street and Roma Way. The Water
Department responded in 20 minutes to turn the water off.
Mr. Marchese told of being pleased and amazed to see how the
Public Works Department compacted the soil and left the
place nice and clean. The name of the foreman was Arthur
Black. Mr. Marchese commented that it is nice that the
City has people concerned with the job they are doing and
who do it well. City Manager Cheney said it was very
meaningful for Mr. Marchese to say that because he knows a
lot about hydrography.
N. W. 10th, llth, 12th and 13th Avenues
Mrs. Wilda Searcy, 402 N. E. 13th Avenue, wanted to know
when these streets would be finished because you cannot even
drive in there. City Manager Cheney said she was talking
about Cherry Hills, and it was a case of the lowest bidder,
who also has a County job near the Mall and a major job in
Delray Beach. He said the City would keep on him and get the
job done as fast as they can.
Litter in Cherry Hills
Mrs. Searcy also drove around in the same area of Cherry
Hills and told of litter, debris, and piles of paper thrown

every place. City Manager Cheney said they are thrOwn by
the people living there. The City has refuse collections
twice a week in that area and public dumpsters on the
streets. They get the same service as everyone else. The
City has a problem getting those people to put their litter
in trash cans and bags that will not break.
CONSENT AGENDA
A. Bids
1. Pipe Fittings and Other Accessories - Utilities
The Tabulation Committee recommended awarding the bid to
various vendors. In catagories where there were more than
one vendor with low prices, it was awarded to the overall
low bidder of that particular catagory. Sun State Meter &
Supply was not considered due to the delay in deliveries of
supplies in some cases exceeding forty days.
2. Group Dental Insurance for City Employees
It was recommended by City Manager Cheney in his memorandum
of February 19 that the award go to Travelers Insurance
Company for a one year period with a guarantee that the
premium will not increase in the second year and that the
program include orthOdontic and a $1,000 maximum benefit per
person with a $50 deductible per person for the first two
members of the family.

The Tablulation Committee recommended awarding the bid to
Aluminum Products Company, West Palm Beach, Florida, in the
amount of $1,530
Joint Cooperative Bid - Fuel and Oil for City Vehicles
(Boynton Beach, Delray Beach, Boca Raton)
The Tablulation Committee recommended awarding the bid to
the low bidders of each category: Transport - Chevron,
U.S.A. Tankwagon - Behnke. Oil - Flamingo Oil Co.
5. Variable Frequency Drive Motor - Utilities
In his memorandum of February 14, 1985, Perry A. Cessna,
Director of Utilities, recommended that J. J. Walsh be

allowed to withdraw their bid and have their bond returned
without penalty and that the second low bidder, Florida
Service Engineers, be awarded the bid in the amount of
$44,972.
B. Resolutions
None.
C. Development Plans
Previous review of these Development Plans has met the
six criteria for Consent Agenda consideration
Councilman Cassandra explained that there has been concern
that the Council has been staying until Midnight and 1:00
A. M. discussing development plans. Tonight, if certain
plans were approved by the Planning and Zoning Board by a
vote of 7-0 and there was no disagreement with the Planning
Director, they were put on the Consent Agenda. Anything
without a 7-0 vote is pulled out and put on the Agenda.
Most of the Council Members attend the Planning and Zoning
Board meetings and are familiar with the development plans.
Councilman Cassandra told the public they too could pull the
plans or anything else out of the Consent Agenda for discus-
sion purposes by filling out one of the yellow forms which
were on the table in the back of the room.
a) Consider request for a variance to Ordinance No. 83-40
as extended and site plan approval to construct a
commercial/industrial building to house roofing and
paint supplies. This proposal, Gustafson Commercial
Building, was submitted by George Davis for Thomas
Gustafson and is to be located at 800 NE 3rd Street
The Planning and Zoning Board unanimously recommended
approval of both the site plan and variance requests, subject
to staff comments.
b) Approve request by Cliff Leisinger for Boynton Develop-
ment Corporation for site plan approval to construct
152 dwelling units and recreation facilities on 18.2
acres on Cedar Ridge Road east of High Ridge Road,
between Hypoluxo Road and Miner Road, to be known as
Cedar Ridge Condominium
The Planning and Zoning Board unanimously recommended approval
of this request, subject to staff comments.

c) Approve request by Leonard/Samuel Kaufman for site
plan approval to construct The York Warehouse, a
23,000+ square foot industrial building on 1.15 acres
on SW 30th Avenue at SW 13th Place, northeast corner
The Planning and Zoning Board unanimously recommended approv-
al of this request, subject to staff comments.
Consider approval of special events sign for Boynton
Beach Library Quilters and the Boynton Woman's Club
City Manager Cheney, in his memo of February 19, reminded
the Council that a sign of this nature was permitted by the
City Council for the Quilt Show in 1984 and recommended that
it be permitted again this year.

Consider approval of request to place one (1) construc-
tion trailer at Yachtman's Plaza, 1550 N. Federal High-
way, in conjunction with interior renovation work at
67 Liquors, Inc.
The Building Department recommended approval of this request.

Consider approval of request to place one (1) construc-
tion trailer in conjunction with the construction of the
Woolbright Plaza Phase II located at 1901 S. Congress
Avenue
Vice Mayor Ferrell noted in the "Explanation of Recommenda-
tions'' from the Building Department, it said, "Said trailer
will remain on site upon completion of project, and will be
utilized for storage purposes only." Mr. Edgar "Bud"
Howell, Building Official, confirmed City Manager Cheney's
statement that they cannot do that. City Manager Cheney
said it would be a violation of the Ordinance, and he will
write to them.
G. Approve Authorization for Disposal of Records - City
Clerk's Office
In her memorandum dated February 13, 1985, (No. 46), Betty
S. Boroni, City Clerk, asked for authorization to destroy
records.
H. Approve sealing with Gilsonite and striping of City Hall
East Parking Lot
Tom Clark, City Engineer, in his memorandum dated January
17, wrote that a Pavex representative proposed to do the

sealing with Gilsonite for less than $1,000 in order to
introduce their product. The City would prepare the surface
by sweeping and cleaning.
I. LEGAL - OTHER
Consider renewal of Lease Agreement between the City
of Boynton Beach and Thomas E. Coffey - Access to
Landfill
City Manager Cheney, in his memo of February 19, recommended
that this lease for a one year period of time be renewed.
Consider renewal of Contract with Durbin Paper Stock
Company - Recycling Center
In his memo of February 19, City Manager Cheney recommended
that the contract be renewed with the amendments contained
in the memorandum from Craig Grabeel, Energy Coordinator.
Consider selection of Canvassing Board for Municipal
Election
Betty S. Boroni, City Clerk, in her memo of February 15, was
in agreement with the request of Jackie Winchester, Super-
visor of Elections, to act as an additional person to our
Canvassing Board on election night, March 12.
K. Approve list of pollworkers
With her memo of February 15, the City Clerk submitted a
list of registered voters for the Council's consideration.

Consider request for conditional use approval by James
Torbit, for Romireo Andino to secure an after-the-fact
approval of a maintenance storage facility at Leisure-
ville Recreation and Maintenance Facility, 1007 Ocean
Drive
Carmen Annunziato, Planning Director, showed on the overlay
that the E-4 Canal is on the west. The maintenance facility
is a concrete slab adjacent to the E-4 Canal right-of-way.
The slab is surrounded on four sides by a fence, and
landscaping exists on almost all of the sides. Access to
the facility is through a gate through the parking lot.
This kind of use would be permitted as a Conditional Use in
the Recreation Zone, subject to City Council approval.
The Planning Department reviewed the request and prepared a
recommendation to the Planning and Zoning Board. They
analyzed the request against the conditions imposed in the
Conditional Use Approval Section of the Zoning Code and also
in the Comprehensive Plan Policies.
Mr. Annunziato said it was their recommendation that the
City Council approve this conditional use, subject to the
conditions stipulated in the Memo from the Planning Director
to the Chairman and Members of the Planning and Zoning Board
dated February 1, 1985 and also consistent with the letter
of December 7, 1984 by Mark B. Schorr, Attorney for Palm
Beach Leisureville Community Association, Inc., of the firm
of Becker, Poliakoff & Streitfeld, P. A., Corporate Park at
Cypress Creek, 6520 N. Andrews Avenue, Fort Lauderdale,
Florida 33310-9057, which stipulates the kinds of vehicles
that can be stored in the maintenance facility.

Mark B. Schorr, Esq. could not say anything that would not
be repetitious of Mr. Annunziato's comprehensive report and
preferred just to respond to any questions or concerns the
Council had. If the audience had any objections, Attorney
Schorr wanted to be able to respond to them.
Councilman Cassandra recalled that at the Planning and Zoning
Board meeting, Caesar Mauti, Board Member, raised the ques-
tion of whether they would be repairing lawn mowers and,
therefore, have "junky" lawn mowers. That was Mr. Mauti's
only concern, and Councilman Cassandra thought there were
relatively no problems with this. Mr. Schorr assured
Councilman CaSsandra that there is nothing in the facility
for the repairing of lawn mowers.
Mayor Zimmerman read a letter which the City Clerk received
from Alice C. Anderson, 1005 Reposo Avenue, Boynton Beach
33435, objecting to the conditional use and complaining about
noise and confusion. When she purchased in Leisureville, it
was with the understanding that no business was to be
conducted within its area.
Mayor Zimmerman noted that Ms. Anderson had a statement in
her letter that Seacrest Maintenance equipment would be
stored there, which is not true. Attorney Schorr confirmed
this statement was not true. His letter of December 7, 1984
states that no outside contractor's lawn mowers will be
stored there.
If Ms. Anderson's comments are to be properly considered
under the conditional use approval application, Attorney
Schorr said Palm Beach Leisureville Community Association
has the obligation to maintain the entire community. One
of the reasons the facility was conceived was to cut down on
the amount of traffic back and forth through the community
each day. Also, vehicles which liked to park there would be
parked off site instead.
Attorney Schorr could not call it noise but said there will
be some sound from vehicles moving around the community to
maintain it, and you cannot escape that. No matter what
facility existed under what zoning code, there would be
vehicles moving around the community every day maintaining
the property. Attorney Schorr said there is nothing they
can do.
Attorney Schorr did not feel the fact that vehicles may go
around each day making some noise constituted adverse
economic effects on Ms. Anderson's property and said what

MS. Anderson is unhappy with is a fact of life which exists
today.
Mayor Zimmerman asked if anyone wanted to speak in favor of
granting the Conditional Use. There was no response. Mayor
Zimmerman asked if anyone was opposed to granting the condi-
tional use. There was no response. THE PUBLIC HEARING WAS
CLOSED.
Vice Mayor Ferrell moved to approve the request for condi-
tional use, subject to the conditions enumerated in the memo
from the Planning Director to the Chairman and Members of
the Planning and Zoning Board, dated February 1, 1985, and
.consistent with the letter of December 7, 1984 from Mark B.
Schorr, Esq. Councilman Wright seconded the motion, and
the motion carried 5-0.
Consider request for conditional use approval to con-
struct a permanent home for the Leroy Parker Post No.
288, American Legion Lodge, at NW 17th Avenue at 1-95,
north side. This request was submitted by Leroy Harris
for Karl Washington, Post Commander
Carmen Annunziato, Planning Director, directed the Council's
attention to the overlay and said N. W. 17th Avenue was the
point of entrance. It is a rectangular building with park-
ing at the periphery. This was reviewed by the Technical
Review Board, and a recommendation was made to the Planning
and Zoning Board, based on a list of staff comments.
The Planning Department also prepared an analysis of the
application with respect to the conditions listed in the
Conditional Use approval application and recommended that
the Council approve the Conditional Use, subject to the con-
ditions recommended by the Technical Review Board. This was
also reviewed by the Community Appearance Board and subse-
quently approved.
Leroy Harris, 212 N. W. 12th Avenue, Boynton Beach, repre-
senting the American Legion, thanked the Boards and Council
for what they have done for the American Legion. However,
Mr. Harris said one of the Boards raised a question about
the fire hydrant not being close enough to the Post. He
reminded the Council that they are a non-profit organization
and wondered what the Council could do to help them on this
issue. Mr. Harris was sure the cost of a fire hydrant would
be expensive and hoped the Council would consider this.
Mayor Zimmerman asked what the cost would be to get the extra
hydrant in. Perry Cessna, Director Of Utilities, advised

that the assembly would cost about $900. City Manager
Cheney informed the Council that a number of costs are
involved with the project. The sewer line will have to be
extended, and that will be about $800. There will have to
be a water meter deposit. The fire hydrant is about $800.
Water and sewer to carry the sewage out will probably run
$1,000. Road impact fees will be about $1,147. Building,
Electric, and Plumbing Permit fees will be approximately
$1,300. City Manager Cheney said the Council discussed them
before but did not have the building plans then.
It seemed to Councilman Cassandra as if they were speaking
of a little more than $5,000. He thought the Council had
consistently bent backwards to most veterans' organizations
in the city. Councilman Cassandra felt these people deserved
this for the service they gave to their country. As they
have done it for other veterans' organizations, he thought
it would be a wonderful gesture by the City to absorb these
costs for this veterans' organization. Councilman Cassandra
commented that the Council probably will be confronted by
other veterans' organizations.
Councilman Cassandra moved to waive all of the off-site
expenditures that were discussed, and the City will pay the
road impact fees of Leroy Parker Post No. 288, American
Legion. Vice Mayor Ferrell seconded the motion, and the
motion carried 5-0.
Councilman Warnke announced that the ground breaking for
the American Legion Post will be Saturday, March 16, 1985 at
2:00 P. M.
Mayor Zimmerman explained that the motion passed was just
for waiving of the fees. He asked if anyone wished to speak
in favor of having the Conditional Use granted. There was
no response. Mayor Zimmerman asked if anyone wished to
speak in opposition to the Conditional Use. There was no
response. THE PUBLIC HEARING WAS CLOSED.
Vice Mayor Ferrell moved to approve the request for Condi-
tional Use, seconded by Councilman Wright. Motion carried
5-0.
DEVELOPMENT PLANS

Approve request for site plan approval to construct a
27,200 square foot shopping center to include a bank with

Streets, south side. This request was submitted by
Richard Wensing for Alfred Marulli. (This item was not
on the Consent Agenda because the Planning Board was not
unanimous (6-1).
Carmen Annunziato, Planning Director, said this is the
entire block except for the 7-11, which remains an out
parcel. Currently, there is a Power gas station and several
houses on the site.
Mr. Annunziato said the request went to the Planning and
Zoning Board from the Technical Review Board with a positive
recommendation, subject to a list of staff comments. At
the Planning and Zoning Board meeting, some question was
raised with respect to access to the site from 7th Street.
A proposal was offered for the Board's consideration and
agreed to by the applicant that, recognizing that 7th Street
is a very narrow pavement width, it would be proper to re-
configure 7th Street into a three lane roadway within the
existing right-of-way in order to provide a right turn lane
and a left turn lane northbound, and a southbound lane to
alleviate congestion in the area. Following that, the plan
went to the Community Appearance Board and was recommended
for approval.
Mr. Annunziato informed Mayor Zimmerman that there is
enough existing right-of-way (50 feet) for three lanes, and
it will include sidewalks. Mr. Annunziato checked it with
Tom Clark, City Engineer, and, at this point, it is an engi-
neering solution. Mayor Zimmerman asked if there would be
curbing instead of swales. Mr. Annunziato preferred to
refer it to Mr. Clark.
Councilman Wright asked what else will go in the shopping
center. Mr. Annunziato replied that they will have a
bank and drive-through facilities, and the rest will be
retail. Mayor Zimmerman asked about a restaurant, and Mr.
Annunziato said there likely will be one.
Jeffrey Sherman, of Richard Wensing, Architects & Planners,
P. A., 1280 North Congress Avenue, Suite 100, West Palm
Beach, Florida 33409, Agents for Alfred Marulli, Jr., Owner,
said what they have is basically a very high quality neighbor-
hood shopping center, which will upgrade the site.
Mr. Sherman told the Council they agreed to widen 7th Street
at the Planning and Zoning Board meeting and worked with Mr.
Annunziato and the Planning staff to take care of the City's
requirements. They will have to remove the Power gas station.

Mr. Sherman said they have one tenant (a beauty parlor).
He said they would answer any questions from the Council or
the audience. Mr. Sherman advised Mayor Zimmerman that they
would like to have a restaurant move into the center, as he
believed there was no other restaurant in that area, but did
not have one signed up yet.
Mr. Sherman presented a rendering to the City CounciI of
what the project will look like. He confirmed Vice Mayor
Ferrell's statement that they will have a concrete wall on
1st Avenue. Vice Mayor Ferrell spoke to residents there
and said they are pleased.
Councilman Warnke asked what bank will be there. As they
are negotiating with a couple of banks, Mr. Sherman did not
know.
Councilman Cassandra recalled they had a proposed day care
behind the 7-11 store area, and there was concern that
traffic on N. W. 1st Avenue, because of youngsters going down
N. W. 7th Street to meet their bus, would be a problem. Now
they have this development where they will have traffic on
N. W. 7th Street. There will be a future light on N. W.
8th Street, and Councilman Cassandra thought there would be
a good chance that traffic will "U" turn on N. W. 1st Avenue
to get out. He thought that would create a traffic problem.
Councilman Cassandra pointed out that they ~ave a narrow
street in N. W. 1st Avenue. Only one side has sidewalks.
Mr. Sherman interjected that they will be constructing
sidewalks the full length of N. W. 1st Avenue. They are
constructing new sidewalks all the way down N. W. 7th
Street, across N. W. 1st Avenue, and along the north of the
property on N. W. 8th Street.
City Manager Cheney commented that sidewalks will b~ on all
of N. W. 8th Street from Boynton Beach Boulevard all the
way to Ocean Drive. Some of the new developments had side-
walks built when houses were built. He thought N. W. 8th
Street would be a major street because it will eventually go
through to Woolbright. There will be a signal there and the
reconfiguration to Woolbright Road. City Manager Cheney
thought they may eventually recommend a sidewalk project to
fill in the gaps on 8th Street. It is publicly funded in
this case, because City Manager Cheney thought it was a city-
wide public safety hazard, and the City may not want to wait
until all of the activity happens.
Vice Mayor Ferrell moved to approve the site plan, subject
to staff comments. Councilman Wright seconded the motion,
and the motion carried 5-0.

Approve proposed adoption of new zoning map and correc-
tions thereto, to' replace the existing zoning map which
is in need of maintenance and consider instructing the
City Attorney to prepare appropriate Ordinance for First
Reading
In preparing a new map, Mr. Annunziato said four areas were
uncovered where the zoning is not consistent with the land
use or where there was an error in the way the zoning was
placed on the map initially. The Council has the authority
to make corrections. A list of the four items and a
synopsis of why corrections should be made was furnished to
the Council, and the Planning Department recommended that
the Council authorize the preparation of an Ordinance to
adopt the new zoning map.
Councilman Warnke moved to adopt the new zoning map and
corrections thereto and to instruct the City Attorney to
prepare an appropriate Ordinance for first reading.
Councilman Wright seconded the motion.
Councilman Cassandra said they are involved in a Comprehens-
ive Plan and wondered if the Comprehensive Plan would have a
variety of changes again in the City's zoning. He wondered
if they would be duplicating an Ordinance. Councilman
Cassandra asked if Mr. Annunziato's workload was saying the
Comprehensive Plan would not be completed for six months and
in lieu of that, the City should go with this.
Mr. Annunziato thought they should go ahead at this time.
He explained that they are working towards completing their
report but it is not going as fast as they thought it might,
and there is not much they can do about it. Mr. Annunziato
thought they should adopt an Ordinance which will adopt the
map because the Building Department is receiving complaints
from the public. City Manager Cheney added that he thought
this would make the amendment revision of the master plan
easier to do.
A vote was taken on the motion, and the motion carried 5-0.

Mayor Zimmerman asked if anyone wished to speak in favor
of the proposed Ordinance. There was no response. Mayor
Zimmerman asked if anyone wished to speak in opposition.
Mrs. Wilda Searcy, 402 N. E. 13th Avenue, Boynton Beach,
was opposed to raising taxes on utility bills of Senior
Citizens. Councilman Warnke explained that this is a tax on
heating oils like kerosene and stove oils. Mayor Zimmerman
informed Mrs. Searcy there is a tax on the other utilities
and, to be fair, they should not exclude this one.
Councilman Cassandra told Mrs. Searcy the tax on the utility
usage (not sewage and water) had been passed. Mrs. Searcy
said the citizens would not vote for it, and Mayor Zimmerman
advised that just the Council voted on it and not the citi-
zens. It was a public hearing and went through the proce-
dures any other Ordinance would. Mrs. Searcy referred to
taxes being paid to Bethesda Hospital and thought it should
be looked into.
Mrs. Searcy told Mayor Zimmerman when it comes to Senior
Citizens, she would still be against this Ordinance. Mayor
Zimmerman said mostly businesses would be paying this.
There was more discussion. Mayor Zimmerman thought it was
an oversight that this was not included before, and that was
why they had it tonight.
Mayor Zimmerman asked if anyone else wished to speak in
opposition to the Ordinance. There was no response.
Councilman Warnke moved to approve Ordinance 85-14 on second
and final reading. Mrs. Boroni took a roll call vote on the

Other
Approve Property Management Agreement between the City
and Mr. Willison - Boat Ramp Park (It is expected that
the agreement will be available at the City Council Meet-
ing
When the City purchased the property in front of Boat Ramp
Park, City Manager Cheney said they anticipated entering
into a management agreement and a rental agreement for the
cottages that are there. He had one agreement similar to
what the previous owner had. City Manager Cheney said they
also anticipated having an agreement with Mr. Willison on
the bait and tackle shop. The City has had a problem with
negotiating an acceptable agreement on the cottages and
feels the agreement should be very similar to the agreements
and dollars the previous owner was receiving when he owned
the property. City Manager Cheney said they would know
about the negotiations this week.
Mr. Willison, who rents the bait and tackle shop is willing
to take over the management agreement for a year. City
Manager Cheney said the City will receive the same
$24,000 they anticipated receiving, but Mr. Willison will
take on the resPonsibilities of leasing and running the
cottages for a year, as well as his own building. The
City's agreement with Mr. Willison is that he will do that on
the same basis, and the City will not charge him rent during
this two or three month period when Boat Ramp Park is shut
down because, basically, his business has gone almost to
zero.
City Manager Cheney said the Council already approved the
City going ahead on the regular agreement, and he wanted
them to concur that the City can change this, substitute an
agreement with Mr. Willison, and, hopefully, arrive at
approximately the same number of dollars they were going to

arrive at. City Manager Cheney said the agreement was not
worked out yet but he will bring it to the Council for final
approval when it is worked out. In the meantime, he wanted
to be able to talk to Mr. Willison and know that was the
direction they were going to go, and they could be assured
of that income.
Councilman Cassandra did not think they needed a motion.
Councilman Warnke asked if Mr. Willison would need guide-
lines and if he was going to execute the leases for the
rental units there. City Manager replied, "The same as they
have been. They are basically week to week leases." Mr.
Willison will be doing the same thing that had been done by
the previous manager. Councilman Warnke did not think a
real estate license would be required.
Mayor Zimmerman asked if Mr. Willison will be receiving a
reduced rent for his services. Eventually, he will pay his
regular rent when Boat Ramp Park opens up again, but City
Manager Cheney said they feel he should have some reduced
rate because the City is taking his business away from him.
Councilman Warnke commented that the City ruined his busi-
ness. City Manager Cheney added that Mr. Willison under-
stands that but asked that the Council consider this interim
period.
City Manager Cheney wanted the record to show that the
Council talked about this, and the City is moving in this
direction. Councilman Cassandra asked that the final agree-
ment come back to the Council.

Approve Lease Agreement with Boynton Beach Child Care
Center, Inc. TABLED
City Manager Cheney asked that this be left on the table, as
the City is still working with it. They met with the archi-
tect and contractor. The next step is for Bud Howell,
Building Official; George Davis, Architect; and Bob Norene,
Contractor, to go through the existing building. Council-
man Cassandra wished to expedite this.

Councilman Cassandra moved to approve the recommendation,

the talent and enthusiasm brought forward at the meeting
with the Screening'Committee.

PUBLIC AUDIENCE (Continued)
Mayor Zimmerman announced that some people who came in late
wanted to speak in Public Audience.
Noise - Sunshine Car Wash
Mro James Richardson, 639 South Road, Boynton Beach, said
Sunshine Car Wash is a nuisance to the area. It is
uncontrolled, has no supervision, and is open 24 hours a day.
There are six or eight large bays where people like to go
and "rev" their motors up. The reverberation is very

disturbing in the day time and especially at night. Mr.
Richardson said eight or nine other people were present who
were also very interested in this situation.
Mr. Richardson told of music being so loud in the afternoons,
morning or evening that you can hear it 500 to 1,000 feet
away. He feels something must be done and was discouraged
that the noise ordinance was not taken up tonight.
Mr. Richardson spoke of engines being raced, gun shotS,
rowdiness, and bottles being thrown over the wall. It is
a disgrace to the City, and Mr. Richardson was anxious for
something to be done about it very soon.
The Police have been called numerous times and have been
there, but they cannot be there all of the time. Mr.
Richardson again referred to the business being open 24
hours a day and said he did not know of any other business
in town with no supervision.
Councilman Warnke recalled this was referred to him sometime
ago, and City Manager Cheney was going to look into it.
Councilman Warnke also inspected the site. People get
through washing their cars, go to the vacuum pumps, open up
the doors and play their stereos as loud as they can go.
Hopefully, the Noise Ordinance the City will get will have
"some teeth" to correct the problem.
If a person is disturbing the peace, Councilman Warnke asked
if it can be covered under the Mutual Police Codes and the
person taken into custody. Attorney Doney advised that
disturbing the peace would be a misdemeanor, and the Police
could write a Notice to Appear before somebody.
Mr. Richardson asked how they would go about that. For the
Police to write it up, Attorney Doney said they would have
to observe it. An individual can sign an affidavit to get
the machinery working, but that would be difficult because
they would not know who the person was. It is a difficult
enforcement situation.
Councilman Warnke asked if there is any way the City, with-
in its Codes, can force the business to either regulate it
or shut down as a public nuisance during certain hours. Mr.
Richardson would like to see it closed at night. With the
existing Codes, Attorney Doney did not think they could
close it dOwn.
Mr. Richardson said it is a continuous situation. He has
lived there for ten or eleven years, and this business moved

in during the last three or four years. Until then, it was
a nice neighborhood, but property rights and valuations are
dropping.
The wash water from the automobiles contains grease, and
Councilman Warnke wondered if this water was going into the
canal or under an Ordinance where it has to be controlled.
He thought they could possibly look into that.
Councilman Wright asked if Mr. Richardson spoke to the
owner. Mr. Richardson did not know the owner and said it is
difficult to find out who he is. City Manager Cheney said
the City can find the property owner and find out from him
who manages the property. He stated that the City will do
that and check on the idea Councilman Warnke had about the
water, although he suspected the water was recycled and did
not go into the canal. City Manager Cheney hoped the
periodic presence of Police cars would cause the regular
attendees of the car wash to get the message.
City Manager Cheney did not want the people to think the
Noise Ordinance was the total solution because when the City
gets it, they must measure it and identify who is doing it.
Mr. Richardson commented that there must be Ordinances regard-
ing nuisances. City Manager Cheney said the problem is
proving it is a nuisance and who it is a nuisance to. The
burden is on the people to indicate who is causing the
nuisance. Mr. Richardson said they have eight people who
will testify.
Mr. Richardson told Councilman Wright the time when they
make the noise varies but is very frequent around 9:00 or
10:00 P. M. He told of the people in the house next to it
not being able to entertain on their porch or in their
house because of the car wash and added that it is a serious
situation. A woman in the audience informed the Council
that there are gun shots at 2:00 A. M.
Albert R. Hermanson, 622 South Road, is directly behind the
car wash and has two bedrooms facing it. Noise can come
any time (2:00, 3:00 and 4:00 A. M.) as loud as can be.
Every morning he has to pick up all of the "stuff" that is
thrown over the fence. Mr. Hermanson finds bottles,
wallets, pocket books, hypodermic needles, and all kinds of
junk. He has called the Police many times. The Police come
and just tell the person to turn down the radio. Mr.
Hermanson emphasized that it is a public nuisance. All of
the things are thrown over the fence mostly at night and not
during the day time. He suggested that the place be closed

from 7:00 P. M. until 8:00 A. M. because nobody is there
watching the place.
If the City closes that car wash, Mayor Zimmerman said they
will have to close all of the car washes in the City. City
Manager Cheney did not think the City had any Ordinance
basis on which they could close a car wash. Councilman
Warnke asked about a public nuisance. It would take some
research, but Attorney Doney said possibly an unsupervised
business could be required to be closed during certain hours.
The City would need an Ordinance, and it would be a Citywide
regulation. Councilman Warnke said that would close things
like coin wash places for washing clothes too. Attorney
Doney advised City Manager Cheney they would just be
inspected and fined.
Vice Mayor Ferrell thought it would be best if the City
Manager would try to get with the owner first to make him
personally aware of the problem. Mr. Hermanson was sure the
owner was aware of the problem because he talked with him and
the owner said, "Whenever there is a problem, just call the
Police," and then he just walks away. Maybe this would be
the first time he will be contacted by the City, so Vice
Mayor Ferrell thought it might help.
City Manager Cheney suggested that Mr. Hermanson keep a
plastic bag for the City of things he picks up. When he gets
a bag full, he is to call Mr. Cheney.
Councilman Wright understands the place is quite busy. He
told of someone trying to get his truck washed, and it was
so crowded, he could not get in. Mr. Hermanson remarked
that it is just "a hang out." Councilman Warnke said the
Council wants to do something within the City Ordinances
and Codes. Personally, he would like to see it shut down,
and the Council will do all they can.
Mayor Zimmerman commented that the owner does not want to
get too rough with his customers, or he will lose them.
Mr. Hermanson said a different crowd comes at night. People
who steal things come and dispose of what they do not want
and are off.
Councilman Cassandra told Mr. Hermanson it was his responsi-
bility to find out a little more on it and call City Manager
Cheney.
Howard Barnes lives in back of the Hermansons and also in
back of the car wash. He just wanted to reiterate what had

been said and asked for the Council's help so they could
have the quiet enjoyment of their homes. Mr. Barnes wanted
an effective tool in the Noise Ordinance as a beginning in
dealing with this problem because calling the Police is
ineffective. He did not suggest calling the Police because
nothing is happening.
City Manager Cheney pointed out that the Noise Ordinance
still takes enforcing, and that is what the Police are try-
ing to enforce. Mayor Zimmerman said the City is trying to
get the Noise Ordinance as stiff as they can. That is why
it is being worked at so long. Mayor Zimmerman suggested
that this neighborhood follow along with the Council on the
Noise Ordinance. If they have any suggestions when it comes
up, they should let the Council know.
ADJOURNMENT
Vice Mayor Ferrell moved to adjourn, seconded by Councilman
Wright. Motion carried 5-0, and the meeting was properly
adjourned at 9:20 P. M.
