3 A RESOLUTION OF THE CITY OF BOYNTON BEACH,
4 FLORIDA, AMENDING THE FINAL BUDGET FOR THE
5 FISCAL YEAR BEGINNING OCTOBER 1, 2009, AND
6 ENDING SEPTEMBER 30, 2010 BY INCREASING THE
7 CIP FUND APPROPRIA TION TO $10,619,600.00 BY
8 TRANSFERRING $870,000.00 FROM THE PARK
9 IMPACT FEE FUNDS TO THE CIP FUND FOR THE
10 PARTIAL FUNDING FOR THE CONSTRUCTION OF
II PHASE I OF THE CONGRESS A VENUE BARRIER-
12 FREE PARK PROJECT; PROVIDING FOR
13 SEVERABILITY, CONFLICTS, AND AN EFFECTIVE
14 DATE.

16 WHEREAS, a final budget was approved by the City Commission on September 22,
17 2009, for the 2009/1 0 fiscal year; and
18 WHEREAS, staff is recommending the City Commission appropriate the current
19 balance of $870,000.00 in Park Impact Fee funds to the Congress Avenue Barrier-Free Park
20 Project-Phase I; and
21 WHEREAS, the City Commission of the City of Boynton Beach deems it to be in the
22 best interests of the residents and citizens of the City of Boynton Beach to approve the
23 transfer of $870,000.00 in 2009/1 0 from the Park Impact Fee Fund to the Capital
24 Improvement Fund for partial funding for the construction of Phase I of the Congress
25 Avenue Barrier-Free Park Project.
26 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
27 THE CITY OF BOYNTON BEACH, FLORIDA:
28 Section 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as being
29 true and correct and are hereby made a specific part of this Resolution upon adoption hereof
30 Section 2. That the final budget of the City of Boynton Beach, Florida, for the
31 fiscal year beginning October 1,2009, and ending September 30,2010, is hereby amended
32 by providing for a transfer of $870,000.00 in 2009/1 0 from the Park Impact Fee Fund to the
33 Capital Improvement Fund for partial funding for the construction of Phase I of the
34 Congress A venue Barrier-Free Park Project.
35 Section 3. All delinquent taxes collected during the ensuing fiscal year as

1 proceeds from levies of operation millages of prior years are hereby specifically appropriated
2 for the use of the General Fund.
3 Section 4. If any clause, section or other part of this Resolution shall be held by
4 any court of competent jurisdiction to be unconstitutional or invalid, such unconstitutional
5 or invalid part shall be considered as eliminated and shall in no way affect the validity of the
6 remaining portions of this Resolution.
7 Section 5. If any clause, section or other part of this Resolution shall be held by

11 Section 6. All Resolution or parts of Resolution in conflict herewith are hereby
