AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, AMENDING ORDINANCE NO. 80-19 OF
SAID CITY BY REZONING A CERTAIN PARCEL OF
LAND OF APPROXIMATELY 13.94 ACRES LOCATED
IN SECTION 33, TOWNSHIP 45 SOUTH, RAi~GE 43
EAST~ MORE PARTICULARLY DESCRIBED HEREAFTER
FROM R-2 TO PUD WITH LAND USE INTENSITY
OF 5.2 ('LUI), PROVIDING FOR A SAVINGS
CLAUSE, REPEALING PROVISION, AN EFFECTIVE
DATE AND FOR OTHER PURPOSES.
WHEREAS, the City Council of the City of Boynton Beach,
Florida, has heretofore adopted Ordinance No. 80-19 in which a
Revised Zoning Map was adopted for said City; and
WHEREAS, EDWARD ODDO, JR., Trustee, RIDGEWOOD VILLAS has
heretofore filed a Petition with the City of Boynton Beach,
Florida pursuant to Section 31-1 of the Codified Ordinances of
said City, for the purpose of rezoning certain property consisting
of approximately 13.94 acres located within the municipal limits
of said City, said property being more particularly described
hereinafter, from R-2 to Planned Unit Development (PUD) District
as more particularly set forth in said application and plans and
specifications relative thereto, all of which items are now on
file in the office of the City Planner; and
WHEREAS, the Planning and Zoning Board of the City of
Boynton Beach, Florida, has heretofore approved said development
plans and specifications and has recommended approval thereof by
the City Council subject to certain conditions; and
WHEREAS, the City Council deems it to be in the best
interests of the inhabitants of the said City to amend the afore-
said Revised Zoning Map as hereinafter set forth.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF BOYNTON BEACH, FLORIDA:
Section 1. That the aforesaid land described in Exhibit "A"
attached hereto and made a part hereof, be and the same is hereby
rezoned from R-2 to Planned Unit Development (PUD) with a Land
Use Intensity (LUI) of 5.2 which intensity is determined to be
appropriate under the circumstances represented to the City in
said application and is in conformity with the Comprehensive
Plan of the City of Boynton Beach, Florida.
Section 2. The aforesaid Revised Zoning Map of the City
shall be amended accordingly.
Section 3. That the application of EDWARD ODD0, JR.,
Trustee for RIDGEW00D VILLAS, for rezoning of subject tract is
hereby granted for the purpose of permitting the development of
said land as a Planned Unit Development (PUD) is soecific, in
accordance with development plans and specifications therefore now
on file in the office of the City Planner in the City of Boynton
Beach, Florida, and all requirements, terms and conditions estab-
lished and set forth in the minutes of the Municipal Planning and
Zoning Board and the City Council of the City of Boynton Beach
pertaining to the review and approval of said application which
minutes are hereby made a part hereof for reference and staff
comments as attached hereto as Exhibit "B".
Except as provided herein, the applicant shall proceed in
strict accordance with all ordinances of the City of Boynton Beach
including, but not limited to, its building, electrical, plumbing,
subdivision, planning and zoning codes, and all rules and regu-
lations of the State of Florida Department of Environmental
Regulation. In satisfaction of the recreation dedication require-
ments of the City Ordinances, this approval incorporates a payment
by the Developer consistent with City Planning and Zoning Board
approval.
Section 4. That should any section or provision of this
Ordinance or any portion thereof be declared by a Court of com-
petent jurisdiction t.o be invalid, such decision shall not affect
the remainder of this Ordinance.

Section 5. Ail ordinances or parts of ordinances in con-
flict herewith are hereby repealed.
Section 6. This Ordinance shall become effective
immediately upon its passage.

Mr. Chas. Walker, Palm Beach County Traffic Engineer has recommended
that the applicant
construct a seventy-five (75) foot left turn lane at the
west approach on Golf Road with a thirty to one foot taper
and a seventy (70) foot shadow,
dedicate fifteen (15) feet of right-of-way for Golf Road,
and
secure a permit from the County for any work in the right-of-
way.
