Mayor Warnke called the meeting to order at 7:30 P.M. He
announced the Invocation tonight will be given by Rev.
Voris Brookshire, First United Presbyterian Church of
Boynton Beach, followed by the Pledge of Allegiance to the
Flag, led by Vice Mayor Carl Zimmerman. Everyone was requested
to rise.
AGENDA APPROVAL
Councilman deLong stated that he would like to add an item
under Legal, Other.
Mr. Cheney stated he has three things he would like to add.
Two are bills for the ConSent Agenda and one is under
Administrative for discussion regarding a rummage sale.
Mr. deLong moved the adoption of the Agenda with the additions,
seconded by Mr. Wright. Motion carried 4-0.
ANNOUNCEMENTS
Mayor Warnke announced the presence in the audience of our
immediate past Mayor, Walter "Marty" Trauger.
Mayor Warnke read a Proclamation whereby Palm Beach Junior
College, during the week of October 17 through 23, would be
proclaimed Palm Beach Junior College Golden Anniversary Week.
Boynton Beach City Hall will be closed Monday, September 5,
1983, in observance of Labor Day.
There will be a Public Hearing on Tentative Budget Proposed
Millage Rate and the Proposed Use of Federal Revenue Sharing
Funds on September 1, 1983, at 7:30 P.M. to be held in Council
Chambers. Mayor Warnke emphasized the need for the public to
use specifics to enable immediate identification within a
Budget Report containing 282 pages which is available for
viewing at City Hall.

CITY MANAGER'S REPORT
N. E. 10th Avenue Project
Mr. Cheney reported, that' it is expeced that the 10th Avenue
pro3ect will be in full operation again by the end of this week
after having been held up by the telephone strike.
Boat Ramp Park Improvements
Mr. Cheney detailed the progress taking place at the County
and State levels regarding the improvements to-the Boat Ramp
Park. The Board of County Commissioners approved funding
last week and the County will now send an application for
$42,000 to the State. When the Governor and Cabinet act on
this, we will have that money approved to use for anothar
application to the State to get some additional money to
bring the Boat Ramp Project along.
New Wells
Mr. Cheney stated that we are in the process of constructing
six new wells. The two additional wells on the east side have
been "developed" The permanent pumps are due this week for
installation. The bacteriological testing for the water lines,
which have been installed, will be implemented and then the
two east wells will be operational within three or four weeks.
The other four wells are still in the process of being
"developed" to get to the desired yield and are expected
to be operational in a couple of months.
Golf Course
Mr. Cheney announced-that all 800 annual permits for the golf
course have been signed up. We have received three-fourths
payment which is $375 each, for all 800 permits. We have a
long waiting list.
PUBLIC AUDIENCE
Mayor Warnke requested that any person wishing to speak on
any item not on the agenda, come forward, give their name
and address to the City Clerk and they will be called upon
at the time that item is discussed.

Proposed Amendment to Build. inq Co'de for Handicapped
Mr. Samuel Scheiner'of 528 S.E. 27th Terrace came forward. He
wished to recommend that our Building Code be amended to read
that all housing units, whether public or private, on ground
level, have at least one toilet accessible to the handicapped
in accordance with the specifications of the American National
Society I~nstitute. Mr. Scheiner explained that this would mean
that the door to the toilet room'would be at least 2'8" wide
and would open out. Having observed local construction, Mr.
Scheiner noted that the majority of new units have bathroom
doors that are about 2' wide and cannot be used by handicapped
persons, especially in wheelchairs. It is time that we ought
to begin to recognize the problems of the handicapped and
amend our Building Code.
Councilman deLong moved that Mr. Scheiner be directed to
take this matter to the Building.Department for their
consideration. Vice Mayor Zimmerman seconded the motion.
After discussion on the motion, the motion carried 4-0.

Councilman deLong moved to approve the proposed Consent Agenda,
Item V, consisting of A 1, 2, and 3, B, C, D, E, F, and G
as presented by the City Manager. Councilman Wright seconded
the motion. The motion carried 4-0.
BIDS
Supply and Installation of Trees in the Median of U.S.
HiGhway ~1 - Parks
Mr. Cheney informed the Council the reason this item is
separate is because there are some alternatives. Option #3
provides for 70 trees to be planted on Federal Highway; 13
Royal Palms plus other trees. It was suggested that the
Royal Palms be divided between the north and south ends.
There are enough remaining trees in the bid to put at least
one in each median section. This would create some impact
on the whole length of Federal Highway. Mr. Cheney added
that the bidder mn Option #3 also proposes that De,ray
Nursery &,~Landscape hire one more unemployed person than
the other bidders and the purpose of this Federal Grant
is to put the unemployed to work. From that point of view,
Delray Nursery is more compliant.
Councilman deLong moved to award the bid in the amount of
$11,890,~o supply and install trees in the Median of U.S.
Highway #1 (Option #3). Councilman Wright seconded the motion.

Under discussion, Mayor Warnke~ stated that although this was
not exactly City property, he would suggest that the Community
Appearance Board be consulted. Mr. Cheney referred to the time
element of this Federal arant and said it is unfortunate that
there is not time to go through the review process. Councilman
deLong suggested that nevertheless, the plans ought to be sent
to the Community Appearance Board for rev±e~. Mr. Cheney agreed.
Councilman deLong hoped that when the Downtown Redevelopment
project gets underway/ the Community Appearance Board will have
a voice. Mr. Cheney referred to the ordinances requiring these
processes with the Downtown Redevelopment project, however, in
this instance with the Federal Grant Conditions, .this was .the
only time they have not gone through the Community Appearance
Board.
Motion carried 4-0.
DEVELOPMENT PLANS
Approve request for site development Plan, 'submitted by Peabody
& Childs Architects, Inc. for Syncom, Inc. to construct the
Boynton Beach Shoppinq Center.
Mr. Annunziato informed the Council this is a request to construct a
79,000 sq. ft. shopping center on 6.45 acres of land located
directly to the east of the Boynton Beach Mall. He explained
the location and added that it is one Of the four outparcets
developed as a result of the Mall planning. This request was-
reviewed by the Technical Review Board and comes to the council
and Planning & Zoning Board with a positive recommendation.
The proposal provides for the construction of a bank facility
in the north east corner,, retail commercial outlets towards
the back of the property, a health'~ club, a retail facility
on the west, and restaurants in a cluster along the southern
building. Access to the site wiit be from the entrance drive-
ways to the Mall with no access ~off of Congress Avenue.
Mr. Annunziato continued that this was reviewed by the tech-
nical staff and went' to the Planning & Zoning Board with the
following comments from the Building Department:
1. Board of Health permit will be required.
2. Hotel and Restaurant ~Commission registration
number will be required.
3. Parking stalls require double line striping.
4. Sidewalks to go through driveways.
Mr. Annunziato outlined the recommendations contained in the
memo submitted by the Utility Department dealing in the tech-
nical aspects of the site 'in designing-utilities.

The Police Department noted that there should be a stop sign at
the exit and the Public Works Department has requested that the
applicant notify the Department 'before they pour the d~mpster
pad. The Community Appearance Board has reviewed and approved
the request.
Vice Mayor Zimmerman moved to approve the request for the Site
development plan subject to staff comments as submitted by
Peabody & Childs Architects, Inc. for Syncom, Inc. to construct
the Boynton Beach Shopping Center. Councilman deLong seconded
the motion. No discussion. Motion carried 4-0.
Approve request for modification' of the approved site develop-
ment plan for The Storaqe Place submitted by James L. O'Conner
Mr. Annunziato informed the Council of the location. This
request was recommended to the Planning & Zoning Board from
the technical staff subject to staff-comments including a
q~ement for an extension of a water line along Congress Avenue.
There was a contention of 1 ft. at the Planning & Zoning Board
and now there has been an agreement reached between the Utility
Department and the applicant concerning the installation of
that facility, The use is for private storage. This was
reviewed by the Community Appearance Board and approved by the~
and this comes to the City.Council with a positive and unanimous
recommendation from the Planning & Zoning Boar.d, subject to
staff comments. Regarding the settlement on the water line,
it was clarified that the costs for the installation would
be shared. The City will install an 8" line and the applicant
will pay for a 6" portion of that line because 6" is what they
need.
Councilman deLong moved to accept the unanimous recommendation
of the Planning & Zoning Board subject to staff comments in the
request for modification of the approved site development plan
for The Storage Place submitted by James L. O'Conner. Council-
man Wright seconded the motion. No discussion. Motion
carried 4-0.
Inasmuch as it was 8:00 P.M., Councilman deLong moved to
suspend the regular order of business and revert to the PUBLIC
HEARING. Councilman Wright seconded the motion. No discussion.

PUBLIC HEARING
Approve request for an amendment to the Future Land Use Land
Element of the Comprehensive Plan and rezoning submitted by
Carmen S. Annunziato for the City of Boynton Beach to amend the
t~nd use element from local retail to moderate density resi-
dential and to rezone from C-3 to R-1AA the west one half +
of Lot 18, Yachtman's Cove subdivision

Mr. Annunziato referred to the initial presentation by a resi-
dent of Yachtman's Cove calling attention to the two zoning
classifications of this lot. It was felt that if this lot were
ever developed for any purposes, it would be an unacceptable
intrusion of commercial activity into the residenti&l zone. At
the instruction of the City Council, the Planning Department
prepared notices for public hearing and recommendations for
Planning & Zoning. Doing so, this item was prepared for public
hearing.with the Planning & Zoning Board sharing proper applica-
tion for public review. Mr. Annunziato enumerated~the reasons
for the recommendation to the Planning & Zoning Board to then
recommend to the City Council that the Land Use Element of the
Comprehensive Plan be modified to reflect the single family
residential category of the western one half of Lot 18 and that
the zoning be changed to R-i~A. The Planning & Zoning Board did
conduct a public hearing on these issues and recommends to the
City Council that the land use element of the Comprehensive Plan
be modified as such.
As this was a Public Hearing, Mayor Warnke asked if anyone in
the audience wished to speak IN FAVOR~ There was. no response.
When asked if anyone wished to speak IN OPPOSITION to the requ-
est, no one responded. THE PUBLIC HEARING WAS CLOSED.
Councilman Wright moved to adopt the request to amend the
Future Land Use Element of the Comprehensive Plan submitted
by Carmen S. Annunziato. Councilman deLong seconded the motion.
No discussion. Motion carried 4-0. City Manager Cheney referred

PUBLIC HEARING
Approve request for conditional use by Digby C. Bridges to allow
retail, new boat sales on the north 150 feet of Lot A, Harbor
Estates subdivision at 1406 North Federal Hiqhwa¥ in a C-4 zone
Mr. Annunziato informed the Council this request is to use a
currently derelict building on the site for the sale of new
boats on Lot A, Harbor Estates subdivision. He explained the
location of the property, and said at one time the derelict
building was a car wash. The proposal is to provide for new
boat' sales of Bayflite Marine, Inc. The site is being
approved consistent with our current requirements for
landscaping, drainage and parking, tt was reviewed and
approved by the Community Appearance Board for landscape
and design purposes. Mr. Annunziato explained the access
to the site. He referred to the landscaping being provided
and noted that this application has, in fact, exceeded our
Code requirements in numbers of trees to be provided. In
addition to the trees will be a hedge which will be 36'
at time of planting at the periphery.

Mr. Annunziato continUed.that because this is a conditional use, the
Planning & Zoning Board conducted a Public Hearing. They recommen-
ded conditional use be approved subject to staff comments and
that the driveway width be increased from 25 ft. to 30 ft. The
applicant has agreed to this.
Digby C. Bridges, Architect, 124 N. E. 5th Avenue, Delray Beach,
Florida, came forward. He was representing his client and has
prepared the plans which 'a~e~ improving the site that is now not
very acceptable to the eye. He referred to everything being
done in a first class manner including landscaping and building,
~yhave even kept the old seagrape~ ~ice Mayor Zimmerman
questioned the possible widening'of North Road which is 20 ft.
City Planner Annunziato advised that this was not discussed at
the T.R.B. meeting but he believed it was felt that because of
the nature of the use which is not high occupancy, traffictwas not
an issue for this use at this location~ Mr. Zimmerman referred
to the trailers backing up, etc. in order to get into this
location. Mr. Bridges thought they would get in pretty easily
now that the gate was being widened. Mr. deLong questioned the
possibility of widenfng within the 69 ft. of the property line.
Mr. Annunziato advised that the possibility is there and the
site can be rearranged but this was the proposal presented by
the applicant. It would require that he modify his site.
Mr. deLong referred to the right-of-way. Mr. Annunziato did
not believe that the applicant would have the ability to
dedicate the right-of-way as this is a lease arrangement.
Mayor Warnke referred to the landscape plan. Although a copy
was not available, Mr. Annunziato believed that it called for
one tree every. 25 feet and the ~installation of a hedge between
the trees on all four sides with the hedge adjacent to the public
rights-of-way being 36" at time of planting. Additionally, Mr.
Annunziato believed there was a hedge adjacent to the south
property line. Mr. Bridges added details of the additional
landscaping being provided. Mayor Warnke complimented the
plans presented by the applicant last night at the Community
Appearance Board which protected the people to the east.
At the meeting of the planning & Zoning Board attended by
Councilman deLong, people expressed their satisfaction.
Mayor Warnke asked if there was anyone in the audience
wishing to speak AGAINST the request. There was no response.
Mayor Warnke read a letter received from Mr.' Jack Quatman,
Quatman Investments, 7416 S.W. 5th, Portland, Oregon 97219,
(property owner within 400 ft. of the property) speaking
IN FAVOR of the request~ Mayor Warnke asked if there was
anyone Un the audience wishing to speak IN FAVOR of the request.
Mr'. Robert Constant, 1407 Dale Lane, Delray Beach, said he
was representing Antonio Velardo property owner within 400 ft.
and Harry Kirsner who owns Section 2, Coquina Cove.

Mr. Constant referred to the two sites north of the subject
property which he sold notwithstanding this derelict building.
It has been a detriment to the entire area of U.S. Highway #1
for the past 4 years. He spoke in favor of this proposed
development.
Councilman de~ong moved to approve the reques~ for conditional
use by Digby C. Bridges to allow retail, new boat sales on
the north 150 feet of Lot A, Harbor Estates subdivision at
1406 N. Federal Highway in a C-4 zone. Vice Mayor Zimmerman
seconded the motion. No discussion. Motion carried 4-0.
At this time, Councilman deLong moved to revert to the regular
order of business. Vice Mayor Zimmerman seconded the
motion and the motion carried 4-0.
DEVELOPMENT PLANS (Continued)
To approve request for modification of the approved site
development plans for Gould Plastics submitted by Richard
C. Ahrens
Mr. Annunziato informed the Council that this is a request
to construct a 9,600 sq.ft, addition'to an existing warehouse
located at 1580 High Ridge Road. Mr. Annunziato further
clarified the location and the access to the site. The
new facility will be constructed on the eastern one half
of the site. One additional truck parking bay will .be con-
structed consistent with the Zoning Code. Mr. Annunziato
further referred to the improvement of the parking lot and
the enhanced landscaping consistent with our Codes. This
plan went to the Planning & Zoning Board with a positive
recommendation from the Technical Review Board subject to
staff comments.
Mr. Annunziato continued that there were several technical
comments. There is one from the Fire Department concerning
fire protection at this location. The problem in this area
ms that there are no municipal water lines constructed at
this time. The applicant met with Fire Inspector Cavanaugh
and Chief Rhoden and it was determined that the applicant
would either install a fire alarm system or a well to
accommodate fire means in this location. As no approximate
date of installation has been determined, Mr. Annunziato
suggested that if Council determines that this should be
approved, that a stipulation be included that no Certificate
of Occupancy be granted until such time as the fire system
is approved by the Fire Inspector.
Mr. Annunziato advised that this comes to the City Council
with a positive and unanimous recommendation from the

Planning & Zoning Board subject to staff comments. This was
reviewed by the Community Appearance Board and was approved.
Councilman deLong moved to approve the request for modification
of the approved site development plans for Gould Plastics sub-
mitted by Richard C. Ahrens, subject to staff recommendations.
Vice Mayor Zimmerman seconded the motion. No discussion.

Approve request for preliminary plat approval for the plat of
Lawson Park Plat II, submitted-by Rossi & Malavasi, Engineers
for Paul Plunkett
Mr. Annunziato informed the Council that the next four items
are technical issues involving the approval of preliminary
plats consistent with our subdivision regulation. This is
the second and last phase of Lawson Park involving the platting
of four lots. Mr. Annunziato described the location and said
that this came to the Planning & Zoning Boardlwith a positive
recommendation from staff subject to some technical comments.
Councilman deLong moved to approve the request for preliminary
plat approval for the plat of Lawson Park Plat II, submitted
by Rossi & Malavasi, Engineers for Paul Plunkett, subject to
staff comments. Vice Mayor Zimmerman seconded the motion.
No discussion. Motion~carried 4-0.
Approve request for preliminary plat approval for the plat of
Sky Lake Plat III submitted by Rossi & MalaVasi, Engineers for
Hylib, Inc.
Mr. Annunziato informed the Council that this is the third and
last preliminary plat for the Sky Lake subdivision. Mr.
Annunziato described the location and advised that this plat
provides for the construction of 45 single family lots consis-
tent with the current zoning at the site.
Mr. Annunziato continued that this preliminary plat was reviewed
by the Technical Staff and went to the Planning & Zoning Board
with a positive recommendation subject to a technical memo
from the City Engineer. The 'T.R.B. also recommended that the
Planning & Zoning Board accept a recent appraisal for Plat II,
adjacent to this property, in the amount of $25,000 per acre.
The Planning & Zoning Board unanimously recommended to the
City Council that the preliminary plat be approved subject to
staff comments and that the land value be accepted. Councilman
deLong determined that the applicant concurred with the per
acreage land value. Councilman deLong moved to approve the
unanimous recommendation of the Planning & Zoning Board to
approve.~ the request for preliminary plat approval for the plat
of Sky Lake Plat III submitted by Rossi & Malai~asi, Engineers
for Hylib, Inc., subject to staff comments. Vice Mayor

Mayor Warnke commented to the audience that most of the Council
Members have been at the meetings of the Planning & Zoning Board,
Community Appearance Board, etc., and have thoroughly gone into
the background of the requests.
Approve request for preliminary plat approval for the plat of
Boynton Lakes Plat II submitted by Rossi & Malavassi, Engineers
for Lennar Homes, Inc.
Mr. Annunziato provided background information for this submission
consisting of 102 zero lot line, s'lngle family lots and construct-
ion documents providing for the construction of infrastructure
improvements to support a previously approved phase of a Planned
Unit Development. Mr. Annunziato advised the Council that this
preliminary plat was reviewed by the Technical Review Board and
went to the Planning & Zoning Board with a positive recommendation
subject to a technical memorandum from.the City Engineer. The
Planning & Zoning Board unanimously recommended to the City Council
that the preliminary plat be approved subject to the comments
noted in the City Engineer's memo.
Councilman deLong moved to approve the unanimous recommendations
of the Planning & Zoning Board, subject to staff comments.
Councilman Wright seconded the motion. No discussion. The
motion carried 4-0.
Approve request for preliminary plat approval for the plat
of Lakes of Tara, Plat I submitted by Ambrose & Associates,
Enqineers for Tara Development Group, Inc.
Mr. Annunziato informed the Council that presumably the Council
will act on the next item on the Agenda, Proposed Ordinance No. 83-
24, which provides for the rezoning of the Lakes of Tara Development.
This is the preliminary plat submitted in connection with the
master plan. This preliminary plat was reviewed by the Technical
Review Board and came to the Planning & Zoning Board with a
positive recommendation subject to a technical memorandum
by the City Engineer. It was also submitted at the time of
the preliminary plat with the contract for sale which provided
for fair market land.~value of the property of $40,000 per acre-..
The Planning & Zoning Board accepted that as being consistent
with recent land value for Recreation & Parks indication purposes.
Mr. Annunziato continued that the plan provides for 59 zero
lot lines, single family homes plus recreation. The plat
comes to the City Council with a positive and unanimous
recommendation from the Planning & Zoning Board. Councilman
deLong determined that the price of the acreage was agreed
upon by the applicant. Councilman deLong moved to accept
the unanimous approval of the Planning & Zoning Board for
the approval of the request for preliminary plat approval

BOYNTON BEACH, FLORIDA, ENDORSING LOCAL, COUNTY-
WIDE AND STATEWIDE EFFORTS TO REGULATE OR PRO-
HIBIT THE BLOWING OF TRAIN WHISTLES DURING
EVENING AND NIGHT HOURS AT SIGNALIZED RAILROAD
CROSSINGS; PROVIDING AN EFFECTIVE DATE~ AND FOR
OTHER PURPOSES.
Councilman deLong moved the adoption of proposed Resolution No.
83-BBB, seconded by Vice Mayor Zimmerman. Under discussion,
Mayor Warnke advised that he has no input, pro or con on this
mssue. Mayor Warnke took exception to the wording, "WHEREAS,
the City of Boynton Beach has determined that the blowing of
train whistles at signalized railroad crossings is of negligible
safety value...' and stated that this resolution was requested
by Mayor Konrad of Boca Raton to try to unite the cities along
the east coast of Florida. At the present time it is under
litigation in the City of Miami which is now under appeal.
Mayor Warnke continued at that time the original litigation
against the F.E.C. was turned down and they have appealed it.
Our City attorneys have already told us that this proposal
could not stand up in court. Mayor Warnke stated that this
Resolution does not prohibit tramn whistles; it merely says
we are supporting our nemghboring cities in concept.
If this ms passed and approved by the courts, Mayor Warnke
expressed concern over the liability angle of somebody being
killed or injured at a crossing because a train did not blow
its whistle. Mayor Warnke also felt that we are pulling
chestnuts out of the fire for other cities where he thought
the proposition in the end will probably fail because it will
be determined by the courts that it is illegal. At the
present time, Mayor Warnke was on the fence about this
whole proposition and said it was up to the Council whether
they want to support the other cities to regulate amd
prohibit the blowing of train whistles.
Councilman deLong referred to the many occasions in his
experiences when our City attempted the same thing as that
of the City of Boca Raton. He has since changed his mind
and feels the same as the public living near the tracks
who are affected by the train whistles. Noting that it
is sponsored by Boca Raton, Councilman deLong would be
inclined to support them because we don't know at what
time we may ask to seek support from Boca Raton. Councilman
deLong added that it would be bad policy not to go along
with something like this because it is not costmng us a

dime and as far~ as we are concerned, let the courts make the
final decision; at least there will be unity in the attempt to
eliminate the train whistlesl
Councilman Wright 'told of the incident in which his secretary
was almost killed a few years ago'in West Palm Beach because of
a train whistle not blowing loud enough. He has said repeatedly
for the past couple of years that he just could not support
something like that. He referred to' ~hose with hearing impairment
who just may need to hear a train whistle; or those who are
driving or are handicapped. Hearing can be one of those handicaps.
Mayor Warnke added that he lives about 200 yards from a~ crossing
and train whistles never wake him up at night. After a while
it doesn't bother you. He has had no calls or letters about
this subject pro or con. Mayor Warnke referred to the wording
of the resolution. Councilman deLong noted that the City Attorney
drafted it. Mr. Doney stated that 'whether there is a determina-
tion or not, it is questionable. If the Council chooses, it can
be deleted. He noted that it only talked about signalized
railroad crossings. Many times Mayor Warnke has driven up
to a crossing that is going up and~down because of~a.short £rom
the rain, etc~ Personally he would like to have the whistle blow.

City Manager Cheney stated that the Council adopted a resolution
similar to this some time ago, in a much larger area. This

material was sent to the state. We were informed that we could
not meet their criteria for establishing the larger area but
they did suggest that the N.S.A. would certainly meet the
criteria for an Enterprise Zone. Mr. Cheney added that it may
make sense sometime in the future to try again for an inter-
mediate sized area and will continue to review it. Mayor
Warnke asked if this took in 10th Avenue and was told that
it did. Reference was made to the new name of the Department
of Veteran and Community Affairs.
Mayor Warnke repeated the motion which had been moved and

Mayor Warnke stated that Councilman Cassandra, who proposed this,
is not here tonight. Council has copies of a letter from City
Manager Cheney placing it on the Agenda as "Legal Other" instead
of "Ordinance 1st Reading".
Councilman deLong believed, with all due respect to Councilman
Cassandra, who sponsored this, that he would move to lay this
on the table. Vice Mayor Zimmerman seconded the motion. The
motion carried 4-0.
Memorandum of 8/15/83 from Mayor Warnke to Chairpersons of all

Councilman deLong moved to adopt the recommendations contained

Consider North Boynton Clean Up Task Force request to empower
certain sanitation' emp~loyees to cite code violators
In a memo of August 11, 1983, Attorney Doney replied to the
issue. Councilman deLong's thinking was expressed in his
memorandum of July 11, 1983, to'City Manager Cheney. While
City Manager Cheney was not opposed to the task force, he
foresaw possible problems in consistency and uniformity in
the process of issuing citations. With the second Code
Enforcement Inspector, Mr. Cheney referred to now being in
a position to double the Code Enforcement activity, however,
there will always be the problem of identifying violators
as these things usually don't happen in front of somebody.

Mayor Warnke agreed with City Manager Cheney and thought that
the City Council a't the present time should be in a position to
authorize the City Manager to use bis discretion on this
suggestion and that the Council approve it in concept. The crux of
Councilman deLong's memorandum stated that greater
cooperation was needed, from the residents. He referred to other
additional help being needed by the City. Councilman deLong
moved to turn this over to the City Manager for his discretion
.in local government Code Enforcement additions, including
inspectors,etc.~ Councilman Wright seconded the motion. Under
discussion, Councilman Wright suggested that the Council be
made aware of those municipal employees who would be allowed
to do this. Council~man deLong stated that he would like to
see the same group follow up on this and report their results.
Motion carried 4-0.
ADMINISTRATIVE
Approve funding for Mayor James Warnke and Councilman Samuel
Wright to attend Florida League of Cities 57th Convention in
Orlando, October 13th throuqh October 15th
Councilman Wright moved to approve funding. Vice Mayor
Zimmerman seconded the motion. The motion carried 4-0.
Approve request from Beautification Committee - Chamber of
Commerce to sell beer at Boat Club Park on September 5th,

Councilman deLong moved to approve this request. Councilman

candidate for appointment to the Community Appearance Board.

Vice Mayor Zimmerman nominated Mr. David Roberts, 5-F Ridge
Point Drive, Boynton Beach. The Council had all received
copies of his resume which was hig.hly complimented.
Councilman deLong moved that nominations be closed with
the unanimous ballot in favor of Mr. Robert's appointment
as Alternate Member. Vice Mayor Zimmerman seconded the
motion. The motion carried 4-0.

As there were no nominees' to be presented for the Boynton Beach
Housing Authority, no action would be taken tonight. It was
noted that Basil 'Hawkins submitted his resignation due to moving
out of town. Vice Mayor Zimmerman moved to accept Basil Hawkins'
resignation. Councilman deLong seconded the motion. Appreciation
for Mr. Hawkins' services would be properly extended. Motion
carried 4-0.
Regarding the expiring terms of Joseph Delaney (9/4/83) on the
Boynton Beach Housing Authority, George Dawis (9/83) and Enrico
Rossi (9/83) on the Codes Enforcement Board, Councilman deLong
remarked that they have done an excellent job and he moves that
they be reappointed. Vice Mayor Zimmerman seconded the motion.
Under discussion, Vice Mayor Zimmerman contacted each member
and was told that they' would be willing to serve another term,

Councilman deLong moved to terminate the services of Daniel White

It was noted that this would leave an opening on the Community
Relations Board.
Rummaqe Sale - Fraternal Order of Eaqles
Mr. Cheney referred to' this application for Permit to Solicit,
also, in part, relating to a zoning ordinance in which we have
a prohibition for a sidewalk sale in general but the Council
can, at its discretion, authorize a sidewalk sale. That is more
restrictive than the solicitation permit so Mr. Cheney thought
the Council ought to take a look at it. Before the Council
was a request from the Fraternal Order of Eagles to have a
rummage sale at Yachtman's Plaza South which is basically un-
occupied. It is a one time event for two days. Mr. Cheney
recommended that the Council grant it with the understanding
that it would not present a precedent problem with other char-
ity groups, due to the fact that the shopping center is unoccu-
pied and therefore the outdoor sale would not interfere with
business.
Councilman deLong moved to accept City Manager Cheney's
recommendation to acceplt.the ~pplication from the Fraternal
Order of Eagles to have an outdoor rummage sale at Yachtman's
Plaza. Vice Mayor Zimmerman seconded the motion. The
motion carried 4-0.
