Mayor Warnke welcomed everyone and called the meeting to
order at 7:30 P. M. He announced in the absence of a
minister, he has been asked to give the Invocation which
will be followed by the Pledge of Allegiance to the Flag led
by Mr. Peter L. Cheney, City Manager. He requested everyone
to please rise.
AGENDA APPROVAL
Mayor Warnke requested the deletion of Item A under New
Business in reference to Gulf Stream Dredging, as he passed
this out as an information sheet at the last meeting and did
not intend it to be an agenda item.
Councilman deLong stated he has a couple questions he would
like to ask the City Manager under City Manager's Report.
Councilman Wright requested the addition of Item C under Old
Business for the City Manager to give an update on the Small
Business Administration,s Parks and Recreation Development
Program.
Mr. Cheney stated under the Consent Agenda, he has an addi-
tional bill for approval from Myre Fairway Construction for
the golf course.
Mr. deLong moved the adoption with the additions, seconded
by Mr. Cassandra. No discussion. Motion carried 5-0.
ANNOUNCEMENTS
Mayor Warnke announced that we have a dedication at the
cemetery this coming Saturday at 11:00 A. M. of a statue
sculptured by Conrad Pickel which has been purchased by the
cemetery to be placed in the children's section to be dedi-
cated to the children buried there. The public is welcome.
The City Council will hold Budget Workshop Meetings tomorrow
night in the conference room of the Building Department and
on Thursday night in the Council Chambers at 7:30 P. M.

Regular City Council Meeting Minutes of July 5, 1983
Councilman deLong moved the adoption as submitted, seconded
by Councilman Wright. No discussion. Motion carried 5-0.
CITY MANAGER'S REPORT
N.E. 10th Avenue Project
Mr. Cheney stated he keeps mentioning this because it has
been around as a potential project for so long and this area
should be watched for the next several months as there will
be a major change evident.
Casa Loma Boulevard Project
Mr. Cheney reported that most of the new deck on the
Intracoastal at the end of Casa Loma Boulevard has been
completed and this will be a sitting and fishing area for
the public. The landscaping has not been finished and we
will build some benches there. No boat docking will be
allowed.
Street Resurfacing Program
Councilman deLong questioned how far the street resurfacing
program had progressed and Mr. Cheney informed him this
should be completed prbbably within two to three weeks. He
explained we are awaiting the lifts for the manholes and a
purchase order has been given to Ranger Construction and
then resurfacing can proceed.

F.I.N.D. Property
Mr. deLong referred to not having heard about this and moved
that the City Manager be instructed to find out what the
status of the City is for acquiring the property at Jaycee
Park and the property south of Walgreen's. Mr. Cheney
replied that in reference to the F.I.N.D. property, we
received a letter several months ago regarding Jaycee Park
and he will recirculate that to the Council. Also in
pending general revenue sharing, there is a suggestion we do
what we did on Boat Ramp Park and have a designer do some
initial concepts for Jaycee Park.. He will put this on the
next agenda. Mr. deLong advised that the people are con-
cerned because no seawall has been constructed and they are
afraid of water coming into their apartments with high seas.
Mr. Cheney suggested they review the letter and discuss at
the next meeting.
Mr. deLong moved to have the City Manager send a letter
inquiring of the status. We should acquire this property
for recreation and park area and the piece by Walgreen's
would make a beautiful bird sanctuary. We have the oppor-
tunity to get this property for the City and should pursue
it. Councilman Cassandra seconded the motion. Mayor Warnke
clarified it had been moved and seconded to have the City
Manager pursue action of the F.I.N.D. property. No
discussion. Motion carried 5-0.
PUBLIC AUDIENCE
Mayor Warnke announced that anybody who wishes to speak on
any item on the agenda to please give their name to the City
Clerk and they will be called upon when that subject comes
up on the agenda. He added if anyone wishing to speak on an
item not on the agenda to feel free to come forward at this
time and express their wishes and desires. There was no
response from the audience.

Lightweight Fire Hose Systems as manufactured by
Snaptite Hose, Inc. or Equal - Fire Dept.
The Tabulation Committee recommends awarding the bid to
Snaptite Hose, Inc., Union City, Pennsylvania, in the amount
of $9,769. The Fire Chief noted this bid meets all specifi-
cations. The two low bidders, Jaffrey Fire Protection Co.~
and Safety Equipment Co. were rejected because they do not
meet the specifications outlined in the bid.
Rescue Tool Model 25-B Combo Tool with B101 Power Unit
as manufactured by Lukas American, Inc. or equal -
Fire Department
The Tabulation Committee recommends awarding the bid to
Firefighters Equipment Company in the amount of $4,400. The
City Manager advised by memo that the purpose in purchasing
this second rescue tool is not only to have two tools, but
to have one that is smaller and lighter weight than the
current Hurst tool. The total lowest bid for the tool and
power unit is also a Hurst product and is $900 more than
what has been budgeted in General Revenue Sharing. Since
purchasing the tool itself without the power unit will not
produce a workable product, it is recommended that the addi-
tional needed funds of $900 be transferred from unallocated
General Revenue Sharing funds to this purchase so that the
Hurst products can be obtained this year and not postponed
to a later time at a possibly higher price.

The Deputy Building Official noted the zoning permits the
sale of beer and wine for consumption on premises in con-
junction with a duly licensed restaurant. It also permits
the sale of packaged beer and wine.

Approve Proposed Change Orders No. 2 and 3 for Golf
Course Parking Lot
The City Engineer noted this proposed change order No. 2
is to provide pipe under roadways at the golf course parking
lot. ThiS eliminates the requirement for cross-road swales
to convey storm water to the ponding area. The unit price

for the 12" RCP is $19.00 per lin. ft. and is considered
reasonable. Approval of the change order is recommended.
The City Engineer noted that change order No. 3 is for the
installation of 60 linear feet of pipe to drain an area of
the parking lot at the northwest corner. This proposal was
requested so that if the landscaped area ever flooded, the
overflow would go under the roadway instead of over the
roadway. Approval is recommended for proposed change order
No. 3 in the lump sum amount of $360.

Councilman deLong moved approval of the Consent Agenda as
recommended by the City Manager consisting of Item V - A, B,
C, D, E, and F, including the additional bill from Myre
Fairway Golf Course Construction Co. Vice Mayor Zimmerman
seconded the motion. Mr. deLong added that the transfer of
funds for the rescue tool takes place with this approval.

Vice Mayor Zimmerman moved to revert to Site Development

DEVELOPMENT PLANS
Approve request for site development plan approval submitted
by Moyle, Jones & Flanigan, P.A. for Manor Care of Boynton
Beach, Inc. This proposal provides for the construction of
the Manor Care Nursing Center which consists of a 120 bed
nursing home to be located at the intersection of South
Congress Avenue and LWDD Canal 928, southwest corner in a
C-3 Community Commercial District
Mr. Cannon informed the Council that the Planning & Zoning
Board has reviewed this site plan and it comes to the City
Council with a unanimous recommendation subject to staff

comments. He explained the plans for the building, access
to the site, parking area and service area. It was reviewed
by the Community Appearance Board and approved. He then
read the staff comments submitted per a memo dated 7/1/83
from the Building Department, a memo dated 7/5/83 from the
Fire Department, a memo dated 7/5/83 from the Engineering
Department, a memo from the Utilities Department, and a memo
from the Planning Department. He added this is the same
facility which had previously requested rezoning at Congress
Avenue and Golf Road; however, this is a C-3 district and a
nursing home is a permitted use.
Vice Mayor Zimmerman referred to this being located on the
northeast quadrant of a larger parcel and asked about the
wall between the entire large parcel and the adjoining resi-
dential district to the west and Mr. Cannon replied that the
zoning ordinance does not require a wall because this pro-
perty does not abut residential property. When commercial
property to the west is developed, it will be required. Mr.
Cheney added that the applicant is aware of this.
Mr. David Pressly, representative of the applicant, advised
they have agreed with all changes submitted by the staff and
Community Appearance Board and will comply. As far as a
wall, the restrictions apply to a de~eloper within 200 feet
of the west boundary. When construction is within 200 feet
of the boundary, a wall will be built.
Councilman Cassandra referred to the possibility of the land
being sold and asked if there would still be the restriction
for the wall and Mr. Pressly replied that a sale would be
subject to all restrictions. Mr. Cheney added that a
restriction goes with the land. Mr. Cassandra added that
the Palmland residents are concerned with another buyer,
they may lose the wall and Mr. deLong replied that develo-
pers must comply with the code and the code requires a wall.
Mr. Jay Bruce, 1568 Palmland Drive, stated he understood the
developer who bought the ground must put up the wall and Mr.
Vance replied negatively, not this particular developer. He
added that it is a geographical requirement. When the outer
portions of the property are developed, there is a recorded
requirement that the developer must build a wall. Mr. Bruce
asked how many feet would be left from the nursing home to
Palmland Drive and Mr. Pressly replied about 234 feet.
Councilman deLong moved that the unanimous recommendation of
the Planning & Zoning Board be approved subject to staff
comments. Councilman Wright seconded the motion. No
discussion. Motion carried 5-0.

Mr. Cannon informed the Council this application for
rezoning from the present R-3 designation to PUD was
reviewed by the Planning & Zoning Board and after a public
hearing, the Board recommends this rezoning request be
approved subject to staff comments. He explained the loca-
tion and access to the site. He also pointed out how it
would be developed in two phases. The Planning & Zoning
Board's approval, in addition to staff comments, included
elimination of a tennis court and addition of another lot.
In reference to staff comments, memos have been submitted by
the Utilities Department, City Planner, and Recreation &
Parks Department. He summarized that this is a straight
forward subdivision with single family lots with zero lot
lines.
Councilman deLong suggested resolving the fee on recreation
and Mayor Warnke replied that the Recreation Department
agreed to elimination of the tennis court. Mr. Cannon
clarified that if a developer provides a package of five
major recreation facilities, he can get one-half credit. In
this case, the Recreation Department did not feel the faci-
lities were adequate for this.
Mr. D. M. Ambrose came before the Council and advised it was
their understanding in the staff meeting prior to the
Planning & Zoning Board meeting that they would not get one-
half credit for the recreation and parks fee. During the

staff meeting, they asked if the staff would be in favor of
the deletion of a tennis court to recapture one lot in that
they agreed to pay the entire recreation fee. The staff had
no problem with that request and the Planning & Zoning Board
did not either and it was unanimously approved. Mayor
Warnke questioned what kind of money we were talking about
and Mr. Ambrose replied that his recollection was the parks
and recreation fee was somewhere around $36,000.
Mr. Ambrose then explained the plan and pointed out that
they have tried to develop a great deal of open space. This
is a request to downzone to less than four units per acre.
It is the developer's'belief that one of the most needed
housing units in the marketplace are attractive homes in
attractive surroundings in the affordable single family
range. They have been working with the staff for several
months. Their time frame is immediate. They are already
into final designs. As soon as the requirements of the City
are met, the developer intends to start models. They hope
this is a lovely development that will be available to resi-
dents and future residents of Boynton Beach in the next
season. Councilman Cassandra questioned what the affordable
single home price range would be approximately and Mr.
Ambrose replied in the $60,000 to $70,000 range.
Vice Mayor Zimmerman asked if these would be sold as a fee
simple arrangement on lots and the buildings with a
homeowners' organization and Mr. Ambrose replied affir-
matively as it is a fee simple plat with fee simple lots and
a homeowners' organization will take care of the common
lands, lake and activity areas. He added they will also
improve the intersection on Congress Avenue.
Mayor Warnke asked if anyone in the audience wished to speak
in favor or opposition to this subdivision and received no
response. He then declared the public hearing closed.
Councilman deLong moved to approve the unanimous recommen-
dation of the Planning & Zoning Board with all staff com-
ments. Councilman Cassandra seconded the motion. Mr.
deLong also included the payment on recreation. No
discussion. As requested, Mrs. Boroni th~n took a roll call
vote on the motion as follows:

Mr. Cannon informed the Council that after conducting a
public hearing, the Planning & Zoning Board unanimously
recommended this request for land use amendment and rezoning
submitted by Harry Kirsner be denied. He pointed out the
location of the property on a map and enumerated the
surrounding uses and zoning. The applicant wishes to have
C-4 zoning for the purpose of C-4 uses. The applicant has a
particular type of development anticipated with plans for a
wholesale center, but any C-4 permitted use could be located
on the property if rezoned. The staff commented about the
comprehensive plan policies. The Planning Department
reports detailed issues surrounding this rezoning. The
Planning & Zoning Board did concur with the Planning
Department's report and recommended against rezoning and
land use amendment.
Mr. Harry Kirsner, owner of the property, came before the
Council and advised that he would like to develop it. A
feasibility study was made and it is difficult to rent offi-
ces to attorneys, doctors, etc. this close to the railroad
track. The railroad is in their front yard. He would like
to develop this as The Boynton Wholesale Mart with a com-
bination of wholesale and retail uses. With C-2 zoning, he
cannot get mortgage money because the lender says the main
use is offices and nobody will want to be in offices when
trains go by about 22 times during the day. The farthest he
can get from the track is 122 feet. The only zoning in
which he can put a wholesale mart is C-4. Unfortunately,
C-4 zoning allows other undesirable uses. He would like to
ask Mr. Cannon if there were a way to have this developed as
The Boynton Wholesale Mart according to the rendering sub-
mitted, would he be against it preventing it from being used
for any other C-4 use? Mr. Cannon responded that he doesn't
think the Planning Department would have any objections, but
there is no way to do that under the present ordinances.
Mr. Kirsner added that he also spoke to Mr. Annunziato and
he would have no problem with this.
Mr. Kirsner then requested a motion for withdrawal without
prejudice, so he can work on other planS. The Community
Redevelopment Agency is working in this area and they are in
favor of this type of business.
Mr. deLong moved to strike this from the agenda at the
applicant's request without prejudice. Mr. Cassandra
seconded the motion. No discussion. As requested, Mrs.
Boroni took a roll call vote on the motion as follows:

DEVELOPMENT PLANS (Continued)
A~Drove request for modification to the approved Palm Beach
Leisureville site development plans submitted by James G.
Torbit. This proposed modification provides for an after-
the-fact approval of a screened, open storage area which is
located in the northeast corner of the intersection of Ocean
Drive and the LWDD E-4 canal.
Mr. Cheney referred to there being some confusion about this
at the Planning & Zoning Board meeting and stated he would
like to comment about this. This started out with the con-
cern of the Leisureville Association Board relative to
storage of maintenance equipment and no place being provided
for it in the original development plans for the area.
There were some discussions with the City staff about space.
They submitted an application for permission to pour a
patio. There was no reason not to grant this permit. Shortly
after that, it was noted a fence was erected and a violation
was issued ~and then they secured a fence permit for the
patio. The! problem developed when there were complaints and
we noted the area was being used for outdoor storage. It
was conclUdied it was a violation of the zolning ordinance
because oUtidQor storage is allowed only in M-1 and C-4
zones; ther!iefore, it is not allowed in other zones. A
violation iniotice was issued for outdoor storage. In an
occasion like this, the Board process~takes time and ulti-
mately the !violation was not resolved. He believes the
Codes Enforicement Board has determined this is a violation.
The issue, lin looking at the plan, is a request for amending
the site plan to allow for outdoor storage properly screened
and landscaped. The issue is whether oUtdoor storage is
allowed. The staff recommendation was pOssibly another
place couldl be found, but we have been told ithere is no
other place. The only way to solve this ~problem would be
with indoor storage. He assumes from the plan submitted
that it will include removal of the existing patio, since he
believes the existing patio is at the property line and this
proposed storage area is shown to be 25 feet from the prop-
erty line. This should be Clarified by the applicant. The
issue is approval of an outdoor storage area not permitted
in the zoning ordinance and there is a legal question
whether the Council can permit this outdoor storage.
Mayor Warnke asked~the City Attorney whether the Council
could rule on this since it is an unresolved violation

before the Codes Enforcement Board and Mr. Vance replied the
Council can rule on the kind of application before them in a
concurrent manner.
Mr. Vance explained how the City had reverted to a pyramid
zoning code.
Mr. deLong asked if there are any conditional or exceptional
uses in this zoning classification that the City Council is
privileged to invoke and Mr. Vance replied that he is not
aware of any. Mr. deLong asked if this could be checked
before taking action and Mr. Vance replied that he thought a
variance to the zoning code could be approved.
Councilman Cassandra clarified that if the Council made a
decision, it would have to be concurrent with the decision
from the Codes Enforcement Board. He asked if it was legal
for the Planning & Zoning Board to make a decision based on
the Codes Enforcement Board's decision and Mr. Vance replied
that from the record he has, the Planning & Zoning Board was
no= making a decision based on what is happening in the
Codes Enforcement Board.
Mayor Warnke asked if an original site plan is available
showing this and Mr. Cannon replied negatively. Mayor
Warnke asked how a site plan can be modified which does not
exist and Mr. Cheney replied there is a long history to
this. He can pull out relatively recent correspondence from
a gentleman who has written several times in the last year
about the history of the site plan and changes in the PUD.
The original plan was amended along the way. Mayor Warnke
stated he would like the legality researched. Mr. deLong
added that he thinks the City Attorney should give a
complete survey through the City Manager's office insofar as
the legality.
Councilman deLong moved to postpone this item to the next
meeting and for the City Attorney through the City Manager
to submit to the Council a thorough report on the legality.
Mr. Mark Shore, attorney for the applicant, requested to be
heard to clarify the facts. Mr. deLong replied that the
Council wanted the facts clarified by the City Attorney and
Mr. Cassandra then seconded the motion. Mayor Warnke
informed Mr. Shore that Mr. Vance will work with him and we
are not considering this request tonight, but are just post-
poning it. Mr. Shore stated that the City Manager has been
discussing legalities of outdoor storage and not what this
facility is being used for. Mr. deLong informed him that
there is no discussion by the audience when a motion is on
the floor. Motion carried 5-0.

Mr. Shore requested that the City Attorney and City Manager
consult with him first, so they are sure they agree on what
the facts are. Mayor Warnke replied he is sure this will be
taken into consideration. Mr. Cheney replied there was no
question on this, but he wishes Mr. Shore had come to see
him earlier.
At this time, Mayor Warnke declared a five minute recess and
then reconvened the meeting at 8:48 p. M.
Approve request for site development plan approval submitted
by Rossi & Malavasi, Engineers, Inc. for the Riteco
Development Corporation. This proposal provides for the
construction of Phase I of the Congress Lakes Planned Unit
Development. Phase I consists of 135 units on approximately
16 acres. The location of Phase I is directly west of the
Motorola Paging Products facility and north of and adjacent
to the Boynton Canal
Mr. Cannon informed the Council that this comes with a una-
nimous positive recommendation from the Planning & Zoning
Board subject to staff comments. He explained the site plan
for the first phase. He read the staff comments from the
Building Department and Public Works Department.
Councilman deLong referred to the streets being public in
the development and Mr. Cannon advised this was incorrect as
they will be private streets. Mr. deLong stated that he
heard at the Planning & Zoning Board meeting that these were
going to be public streets and he wants it a matter of
record that these are going to be private streets as in
other developments. Mr. Roy Barden came forward repre-
senting the applicant and advised they agree with all the
conditions recommended by staff. The streets inside the
project are part of the PUD and will be maintained by the
builder and property owners' association.
Mayor Warnke asked if a tree survey had been submitted iden-
tifying every tree before development and Mr Barden replied
affirmatively. ·
Councilman Wright asked if this development was being
planned for Motorola and the mall and Mr. Barden informed
him this is a residential project which is part of a 120
acre development on the west side of Congress Avenue. This
is the first phase of possibly eleven to twelve phases. It
is across the street from Motorola. Mr. Wright asked if
young families will be permitted and Mr. Barden replied
affirmatively. Mr. Barden continued that when the PUD was
approved, there were suggestions for four story buildings,
but they re-evaluated the market and it indicated they

should go after the young married market rather than the
older market and they designed units with two and three
stories rather than four stories. They have arranged the
buildings on the site in such a way to maximize the view
towards the lake and capture the breezes from the southeast.
The recreation facilities include biking and jogging paths,
tennis courts, handball courts, etc. which are activities
for young people, but they will not deny selling them to
older people.
Mr. deLong referred to the price range and Mr. Barden
informed him it would be $50,000 to $75,000 and generally
two bedroom units with some having two bedrooms and a den.
Also, there will be some townhouse units sitting on top of
first floor apartments. The project looks toward the future
employment activity growing in that area.
Councilman Wright asked when this would be completed and Mr.
Barden replied they will be opening in November.
Mayor Warnke asked who would maintain the streets after the
developer is gone and Mr. Barden replied this would be done
by the homeowners, association. Councilman deLong referred
to the City Attorney being aware of this requirement and
stated when this is consummated this matter should be
locked up. '
Mr. Zimmerman referred to there being reference to both a
condominium and homeowners, association and Mr. Barden
clarified there will be one common association for 125 units
and then an overall master association for the entire deve-
lopment for the common areas and roads.
Mr. Rick Rossi stated that the plat is very specific about
streets and read the statement regarding private streets and
maintenance of same. He added this is a matter of record.
Mr. Zimmerman clarified there will be two levels of
homeowners, associations with the streets and recreation
facilities being maintained. Mr. Barden agreed and added
that all the recreation facilities will be maintained by the
condominium association for this project. Mr. Zimmerman
stated they will be owned in the same ratio as the square
footage in their condominiums and Mr. Barden agreed. Mr.
Cheney clarified there will be several developments with
several associations and also an overall condominium asso-
ciation for the amenities common to the whole thing. Mr.
Zimmerman stated there will be an umbrella association and
Mr. Barden agreed there will be a master association.
Mr. Wright questioned how many units have been planned for
the entire PUD and Mr. Barden replied apProximately 1,200

units and this first phase is for 135 units, which is
slightly less than they are permitted to build on this pro-
ject. They have requested and received approval to transfer
the deficit units from this first phase to another stage.
Mr. Zimmerman referred to four story units and Mr. Barden
informed him that only two story units were being planned
now. Mr. Cassandra referred to four stories being allowed
in this PUD and Mr. Barden agreed, but advised that the site
plan would have to be approved. Mr. Vance added that they
can go to the maximum under the City ordinance which is 45
feet or four stories. Mr. Cheney added that once this site
plan is approved, it does not include four stories.
Councilman deLong moved to approve the unanimous recommen-
dation of the Planning & Zoning Board subject to staff com-
ments. Vice Mayor Zimmerman seconded the motion. No
discussion. Motion carried 5-0.
Approve request for preliminary plat approval for the plat
of Congress Lakes, Planned Unit Development Plat I submitted
by Rossi & Malavassi, Engineers, Inc. for the Riteco
Development Corporation. This submission consists of a pre-
liminary plat and construction documents which provide for
the construction of infrastructure improvements to support
previously approved Planned Unit Development. The Congress
Lakes Planned Unit Development is located on Congress Avenue
west of the Motorola Paging products facility.
Mr. Cannon showed the preliminary plat for the site plan
just approved. He advised this was reviewed by the Planning
& Zoning Board and they unanimously recommended approval.
There were no staff comments in conjunction with this plat.
He explained the location of Tracts A, B, C and D with the
utility and roadway easements.
Mr. deLong moved to approve this recommendation of the
Planning & Zoning Board, seconded by Mr. Cassandra. No
discussion. Motion carried 5-0.
Approve request for preliminary plat approval for the plat
of Stanford Park Planned Unit Development submitted by
Michael B. Schorah & Associates, Inc. for Lawrence E. White
and Ralph Biernbaum. This submission consists of a prelimi-
nary plat and documents which provide for the construction
of infrastructure improvements to support previously
approved Planned Unit Development. The Stanford Park
Planned Unit Development is located on Hypoluxo Road east of
and adjacent to the High Ridge Country Club.
Mr. Cannon informed the Council this is a preliminary plat
for the previously approved Stanford Park PUD. This PUD

calls for the development of a nursing center, adult congre-
gate living facility and medical office. The Planning &
Zoning Board unanimously recommends approval subject to
staff comments. He explained the location and adjoining
uses. He read the staff comments from the Engineering
Department, Utilities Department, Planning Department and
Recreation & Parks Department.
Mayor Warnke referred to this being submitted for approval
of the infrastructures and asked if the plat has been
approved and Mr. Cannon replied that the master plan was
approved.
Mr. Mike Schorah, representing the developer, stated if
there are any questions, he will try to answer them.
Mr. deLong stated that every member of the Council attended
the Planning & Zoning Board meeting and is familiar with
this plat.
Mr. deLong moved to accept the unanimous recommendation of
the Planning & Zoning Board and approve this subject to
staff comments. Mr. Cassandra seconded the motion. No
discussion. Motion carried 5-0.
Approve request for site development plan approval submitted
by Michael B. Schorah & Associates, Inc. for Lawrence E.
White, Trustee. This proposal provides for the construction
of the High Ridge Nursing Home at the Stanford Park Planned
Unit Development consisting of a one story, 120 bed nursing
home located on Hypoluxo Road, east of and adjacent to the
High Ridge Country Club
Mr. Cannon informed the Council this is for the development
of a 120 bed convalescent center. He explained the location
and told about the building plans. He read the staff com-
ments from the Building Department, Engineering Department,
and Public Works Department. This site plan was reviewed by
the Community Appearance Board and comes to the City Council
with their approval subject to the modifications requested.
Mr. Wright referred to this being a medical complex and
asked if there would be another building and Mr. Schorah
informed him this will be an average nursing home and there
is a 6,000 sq. ft. commercial parcel not being site planned
at this time. Mr. Cassandra asked if there would be a phar-
macy and Mr. Schorah agreed this had been discussed.
Mr. Vance asked if the applicant agrees to comply with all
staff comments and Mr. Schorah replied affirmatively.

nursing homes, then a highly controversial application, and
now applications for one in the north and south Motion

Approve request for modification to the approved site deve-
lopment plans for the Florida National Bank submitted by the
Hendrick-Brown Construction Company. The Florida National
Bank, Boynton Beach Branch, is located at 200 North Congress
Avenue. This proposed modification provides for the
construction of a 2,000 s~. ft. addition
Mr. Cannon informed the Council this is a site plan modifi-
cation. It was reviewed by the Planning & Zoning Board and
comes to the City Council with a unanimous recommendation
subject to staff comments. This is a 2,000 sq. ft. addition
to the south end of the existing building. He read the
staff comments from the Building Department per their memo
dated 7/1/83. The applicant did receive a variance from the
Planning & Zoning Board to retain the existing positive
drainage on the site. This application was reviewed and
approved by the Community Appearance Board las~ night.
Ms. Victoria Peat, Gibson & Gibson Law Firm, representing
the applicant, advised that the bank agrees and accepts the
recommendations made. The general contractor and bank
representatives are present for any questions.
Councilman deLong moved to accept the unanimous recommen-
dation that the proposed modification be approved subject to
staff comments. Councilman Wright seconded the motion No
discussion. Motion carried 5-0. '
Approve request for modification to the approved site deve-
lopment plans for the Coral Industries warehouse submitted
by Robert B. Kipp, Jr. The Coral Industries warehouse is
located at 1365 Neptune Drive. The proposed modification
provides for the construction of a loading ramp to serve the
facility.
Mr. Cannon informed the Council this is a site plan modifi-
cation. The site plan was approved several months ago for
the construction of a warehouse on Neptune Drive. The
applicant wishes to construct an approximate 4 ft. high
loading ramp along the east side of the property. This
comes with a positive recommendation from the Planning &
Zoning Board with no staff comments.
Mr. deLong moved to approve the unanimous recommendation of
the Planning & Zoning Board for this modification, seconded
by Mr. Cassandra. No discussion. Motion carried 5-0.

Approve request for variance from subdivision and platting
regulations for the Town Club of Boynton Beach site plan
Mr. Cheney informed the Council that what is involved here
is the setting of a public hearing to consider whether or
not thi~ variance should be granted. Prior to a public
hearing, there should be some title searches to give an
understanding of the current and future situation relative
to N. E. 4th Street and the trailer park. He thinks prior
to a public hearing, they should know who is the legal pro-
perty owner and be aware of any encumbrances relative to 4th
Street. Also, 17th Avenue is an issue where a variance is
being requested. The staff and Technical Review Board
feel since 17th Avenue is part of the circulation system, it
should be constructed through this property. The Council
should take a look at this with 17th Avenue closed on the
west end. They must be sure to have title ownership infor-
mation at the public hearing. We have had some street title
problems in Four Sea Suns.
Mr. deLong referred to this problem having existed and
stated that he thinks it was created by the City. It is a
poor setup going into 17th Avenue between the two con-
dominiums. He thinks it would create a traffic hazard with
cutting 17th Avenue through. He thinks the proper thing,
which should have been done at the time this was permitted,
was to have abandoned the portion of that road. Mr. Cheney
stated that it hasn't been abandoned and Mr. deLong replied
that we must resolve this. Mr. Cheney agreed and stated
this should be addressed at the public hearing. Mr. deLong
remarked that he didn't see where this developer will suffer
any inconvenience and Mr. Cheney advised that he doesn't
want 17th Avenue cut through, but must go through the public
hearing process to address that.
Mr. Cassandra stated that he would like to know about the
existing fences. We must be sure not to create problems.
Mayor Warnke advised that he has received calls about the
problems and they don't want the fences open because of
security problems.
Mr. Cheney asked the City Attorney how much time would be
needed to research this and Mr. Vance replied there is no
precise requirement, either two or four weeks. He suggests
the second meeting in August. Mr. Cassandra stated that he
would not be present August 16 and the first or second
meetings in September were suggested. Mr. Vance pointed out
that the applicant has indicated he is in a time bind on
development.
Vice Mayor Zimmerman made a motion to consider this at a
public hearing at the first meeting in September, September

Mr. Cheney announced at this point, he would like to ask for
the privilege of adding one item to the agenda now that the
Council has adopted this resolution creating the golf course
manager position to add a new department in the City. When
making an appointment of a department head position, the
City Council must concur with his making that appointment.
Mr. deLong moved that this request of the City Manager be
granted, seconded by Mr. Zimmerman. Motion carried 5-0.
Mr. Cheney stated with the concurrence of the Council, he is
appointing Mr. Joseph Sciortino, Jr. as the manager of the
golf course. If the Council concurs, Mr. Sciortino will be
starting work in early August. Mayor Warnke asked if a
contract is needed and Mr. Cheney replied negatively as once
appointed, it is under civil service.
Councilman deLong moved to approve the appointment by the
City Manager of the manager of the golf course of Joseph
Sciortino, Jr. Councilman Cassandra seconded the motion.
Under discussion, Mr. deLong commented that he thinks it was
a splendid appointment on the City Manager's part. We do
have plenty of residents in the City who have credentials as
good or better than any in the nation and he thinks the
locals should be given first consideration. He appreciates
what the City Manager has done. He then introduced Mr.
Sciortino. Mr. Sciortino thanked the City Manager and members
of the Council for their show of confidence. The golf
course will be self-supporting as well as the City being
very proud of it. Motion carried 5-0.

Warnke commented that this looks like tremendous innovative
funding if we can get it through. Mr. Cheney stated that we
are hopeful we can and we will be contacting the Board of
County Commissioners. Mr. Cassandra referred to possibly
buying more land at the Boat Club Park and Mr. Cheney
explained that the land on Federal Highway was included in
the plan in case the possibility ever came along. Recently
we were told the land was for sale and an appraisal is being
reviewed by the City Attorney. Mr. deLong told about pre-
vious plans to secure additional land in this area. As
requested, Mrs. Boroni then took a roll call vote on the

Consider amending zoning ordinance relative to R-1AA and
permitting outside storage - Requested by Vice Mayor Carl
Zimmerman
Vice Mayor Zimmerman stated possibly the Council may want to
defer this for later discussion until after the meeting
tomorrow night. He was asked by some of the people in
Leisureville that if they do not get what they want through
their efforts, they thought maybe the Council would be
willing to do something in the way of amending the code. He
believes the overall zoning of Leisureville is R-1AA. It
seems the designation PUD is only a name which does not
exist in Leisureville and not a zoning for Leisureville. It
is a PUD in concept only and not a legal PUD because there
is not a site plan on record. These conditions exist. Some
of the people feel they want the Council to do something
about it. Possibly some suggestions can be made or it can
be tabled. Mr. deLong replied that based on the fact we
have asked for a legal opinion, he thinks it would be advi-
sable to table this until receiving the report from the City
Attorney.

Approve Water Service Agreement - Dyer Property
Mr. deLong asked if the check was received which was
referred to and Mr. Cheney replied affirmatively.
Mr. deLong moved to accept the recommendation to approve
with the following memo dated July 13, 1983, from Perry A.
Cessna, Director of Utilities, becoming a part of the public
record. Mr. Cassandra seconded the motion.
"Attached is a letter of transmittal, original agreement
to annex and, a marked up tax map for water and sewer ser-
vice to a parcel of property located between Seacrest Blvd.
and 1-95 just south of Hypoluxo Road and just north of the
cemetery.
"The proposed sewer force main from Bristol Springs will
be required to be increased and sized from a 6" to a 8" line
in order to accommodate the flow from proposed 125,000
square foot shopping center.
"The trustee of this property will deliver, on Friday
(7/15), a check in the amount of $22,634.40 to cover the
cost of increasing the line to 8". This amount is the
quotation given to Russell & Axon by the contractor to
change line size from 6" to 8".
"In addition to this, if the City Council approves, the
contractor will be required to extend a 12" water line
northward from Miner Road to the northern line of subject
property and to tie the various lines off of the side
streets in this (northern) area to the new line. This cost
will be totally at the developer,s expense without credit
against the capital facilities charges anticipated for
either water of sewer.
"It is requested that this be placed on the July 19th
agenda for Council approval."

Report on Test Well Program & Revised Water Master Plan
Report
Mr. Cassandra referred to receiving this large report at the
same time the volume of the budget and tonight's agenda

were received and stated he has not had a chance to look at
this. He thinks the report was finished on time, but we
received it not at the proper time to give it the due
justice it deserves.
Mr. Cassandra moved to postpone this until August 2,
seconded by Mr. deLong. No discussion. Motion carried 5-0.
Status Report on Seacrest Boulevard - Requested by
Councilman Samuel Wright
Mayor Warnke asked if Councilman Wright had received enough
material and Mr. Wright replied affirmatively, but he
doesn't know if there was any recent development. He still
does not see any specifics on action on the part of the
County Commissioners. He thinks with the request
Commissioner Koehler has made, the Mayor is following
through with the M.P.O. Mayor Warnke replied that he is and
he also talked to the County Commissioners and they are in
favor of putting this on a higher priority. Mr. deLong com-
mented that we should use our influence and we will get the
job done, the same as on the south end. Mayor Warnke added
that he got a favorable call from a County Commissioner this
evening and it does look much better. Mr. Wright added that
he has been talking to Commissioner Koehler's aide and he
will try to find out more. Mr. deLong clarified that
everyone on the Council is concerned and interested and that
is why we passed a resolution requesting the County to take
care of it. He told about Boca Raton getting revenue from
the County and stated that we want as much consideration.
Mayor Warnke urged all the members of the Council to contact
the County Commissioners.
Update on Small Business Administration Parks & Recreation
pevelopment Program
Mr. Cheney advised the Council voted to approve the grant
and the material was sent to the State for money. Mr.
Wright referred to there being uncertainty as to hiring an
unemployed person and Mr. Cheney replied that he had full
conversations with them and it is resolved how to do that.
A contractor called today who is interested in the project and
he will have no problem meeting the federal guidelines. He
thinks we are in good shape.

Career Development & Training for City Employees - Postponed
from July 5, 1983 Meeting
Mr. Cheney referred to submitting a report and Mr. Cassandra
commented that it was an excellent report and showed that

training is not only done for supervisors, but there is con-
tinuous ongoing training for all employess.
