Tor Warnke welcomed everyone and called the meeting to order at 7:3
P. M. He announced the Invocation tonight will be given by Irving I.

addition of Item C - Day Care Center and Item D - Library.
Councilman deLong moved for the adoption of the agenda with the addi-

Mayor Warnke referred to Page 33, first paragraph, last sentence, and
clarified this was not from the County, but from visitors.

CITY MANAGER'S REPORT
Mr. Sullivan requested Mr. Cessna to give a status report on the well
situation. Mr. Cessna informed the Council that one of the wells has
been gravel packed with a new screen and they are running pumping tes
today and tomorrow. It is anticipated that a new pump will be instal
Thursday or Friday. As soon as that is done, they will start work on
another well.
Mr. Sullivan distributed a report to each Council member prepared by
Kelton and Associates regarding double taxation in Palm Beach County
advised that he believes they will find it very interesting.
Mayor Warnke asked if Mr. Cheney had any report back on the 4% user t
on gasoline and Mr. Sullivan replied that he had not yet, but he will
submitting a report.
Councilman deLong requested that the City Manager supply the City
Council with an update on what is going to be done about a new water
treatment--plant. He knows the water plant has been running at capaci
and believes we should have some report as to what is going to be don
in the future. We continue to sign agreements with people to the wes
not within the corporate limits of the City. He is very much concern
What is going to happen to our water supply. He believes we should
ha~e an update on the status and where we are going from here regardi
a new water treatment plant. Mayor Warnke asked if Mr. Cessna cared
re3pond and Mr. deLong clarified that he wants a report from the City
Manager in writing. Mayor Warnke requested comments from Mr. Cessna
this time and Mr. Cessna advised that a master plan review has been
aushorized and a test well study. The test well study has been
co]npleted and he should haVe it this week some time and the master pl
ne~t week. At that time, he will be able to give a comprehensive rep
an~ he recalls that Mr. Cheney was going to distribute this to the
Co· ncil by the next Council meeting. Mr. deLong stated that he would
also like the locations and Mr. Cessna replied that will be included.
Ma~°r Warnke asked if he felt within the next decade that our present
water plant will serve the ~residents of the City and Mr. Cessna repli
that it will serve the City of Boynton Beach alone, but not the servi
ar~a. It would be close to capacity. He added that he did give a
complete report about four years ago and Councilman deLong replied th
it should be updated.

PUBLIC AUDIENCE
Mayor Warnke announced if anybody wishes to speak on any item on the
agenda to please give their name to the City Clerk and when that item is

brought before the City Council, they will be invited to speak. He
added that for any item not on the agenda, the public is welcome to c)me
forward at this time and speak.
Mrs. Henrietta Solomon, 230 N. E. 26th Avenue, first thanked the Council
for being so cooperative regarding problems which face the community.
In conjunction with the North Boynton Cleanup Task Force, she has bee
circulating petitions for widening Seacrest Boulevard. In the event
that the bike path is not constructed on 22nd Avenue, they request th t
the County contribute that money towards the widening of Seacrest
Boulevard, which would enable the County to include this project in tie
83-84 budget. She feels any monies allocated to North Boynton should
stay in North Boynton. She urges the Council to contact Commissioner
Koehler and Wilken and request them to apply this money to hasten the
Seacrest project. Village Royale on the Green is united in improving
their neighborhood and will do anything required to move this project
forward. She would like to feel the City officials will join them in
wanting a beautiful Boynton Beach.
Councilman deLong replied that he certainly appreciated this and advi ed
the Council has already sent a resolution to the County for the widen.ng
nd draining of Seacrest Boulevard and that road program is the numbe~
ne priority. Mrs. Solomon replied that they would appreciate it being
in the 83-84 budget. If there is any need for the people to appear a~
the Commission, please let them know. Councilman deLong clarified that
he is talking about the 83-84 budget and believes we stand a good chance
of them recognizing the need. He referred to being concerned and tol~
about the history of Seacrest Boulevard with the southern portion beihg
paved and the northern portion going under County ownership.
Mayor Warnke referred to being a member of the Metropolitan Planning
Organization and advised they have a five year plan and they are tryil
to push Seacrest Boulevard to a higher priority.
Councilman Wright stated that he has been working with the Task Force
for the past few months and this is definitely a priority. He has mat
requests through Commissioner Koehler's office several times to get ti
in the budget. It is encumbent upon everyone in the North Boynton are
to place a telephone call to Commissioners Koehler and Wilken. Many
resolutions are sent, but they want to hear from their constituents.
addition, the City Manager attended a meeting with the County regardi]
$1,400,000 Community Development funds and he has requested money for
cleanup campaign. We should also express interest to Commissioners
Koehler and Wilken to make sure the City receives that $200,000 to
cleanup the North Boynton area.

year. He stated in the past month of May, the firefighters in the Ci
aside from putting out fires and saving lives, have been participatin~
in the Firefighters' Olympics. He told about the various athletic
events with firemen participating from many cities. He showed a trop
received and told about two members placing fourth in other events.
This helps maintain the physical conditioning of the firefighters, wh
is needed to protect the City of Boynton Beach. He thanked the City
behalf of the firefighters and the Fire Department for the support.
Mayor Warnke referred to not having many fires in Boynton Beach, but
stated that hardly a day goes by that we don't see the rescue squad
going out to save somebody's life and he thinks they are doing a terr
fic job.
CONSENT AGENDA
A. Bids
Uniform T-Shirts
The Tabulation Committee recommends awarding the bid to the
low bidder, Barker Uniforms, West Palm Beach, Florida, in
the amount of $3.39 each.
One (1) Fedders Split System Room Air Conditioner or Equal
The Tabulation Committee recommends awarding the bid to
Inter-County Engineering, Boynton Beach, in the amount of
$825, since this unit has been inspected and meets all
specifications as well as the required noise level.
One (1) 15 Ton Condenser Rheem Model RAVD 150-Cl or Equal
The Tabulation Committee recommends awarding the bid to
Inter-County Engineering, Boynton Beach, in the amount of
$4,860, since it is the low bid and meets all specifica-
tions.

The Finance Department~has requested approval for the disposal
of records covered by their memorandum dated June 2, 1983 No. 38.
Transfer of Funds - City Council
This is requested to provide funds for Mayor & Council business
meeting expenses to the end of the fiscal year.
Approve R & A Change Order No. 7 for L.S. 316 Landscaping Project
No. 626-681-45 - Boyle Construction Company
This change order is in the amount of $5,050 and is for the
addition of landscape plantings and sprinkler system to L.S.
316 to meet the requirements of the Village of Golf building
permit. Mr. Cessna concurs with R & A's recommendation to
approve this change order.
Approve R & A Change Order No. 2 for Raw Water Main
Project No. 626-681-60, Part B - E.N. Murray, Inc. Contract
This change order is in the amount of $17,260.40 and represents
the establishment of unit prices for additional costs incurred
in laying "to grade" certain portions of the raw water main.
The deeper cuts (greater than 3 feet of cover) are required
to provide for adequate cover over the water main upon comple-
tion of the Boynton Beach Commerce Center and the planned
grading associated therewith. Mr. Cessna has reviewed this
change order and concurs with the recommendation of R & A to
approve this request.

Mr. Robert Hamilton submitted a verbal request for these and
the Building Department recommends approval.
Councilman deLong moved to accept the consent agenda consisting of Items
A-J with the additions, seconded by Councilman Cassandra. Under
discussion, Mr. Sullivan referred to there being enough money in Federal
Revenue Sharing for Item 3 under bids, the 15 ton condenser, and
requested approval to charge this to that account, since it is a non-
budgeted item. Mayor Warnke clarified that the motion would include
the additions and corrections made by Mr. Sullivan. Motion carried 5-0.

Mr. Annunziato informed the Council this request is to delete the bik,
path which will be constructed by Palm Beach County in connection wit]
the construction of Congress Avenue. At the time these were approved
there were no plans for Congress Avenue, but this now becomes a super~
requirement. Mayor Warnke referred to this tying in with the next pl~
also and Mr. Annunziato agreed that both are the same. He clarified
that it is requested that the Council determine there is no substanti~
change.
Councilman Wright moved to approve this request, seconded by Councilm
Cassandra. Under discussion, Councilman deLong asked if this was a
public hearing and Mr. Annunziato replied negatively. Motion carried

Mr. Annunziato informed the Council this is a request for determinati

a single family detached unit with one wall against the property line

Proposed Resolution No. 83-JJ - Re: Accepting performance bond and filal
olat approval for Tract P Hunters Run
Mr. Vance read proposed Resolution No. 83-JJ by title:
A RESOLUTION OF THE CITY OF BOYNTON BEACH, FLORIDA, APPROVING
THE FINAL PLAT FOR THE REPLAT OF TRACT "P" OF THE SUMMIT PLAT
NO. 1 IN SECTION 6, TOWNSHIP 46S, RANGE 43E
Councilman deLong moved the adoption of proposed Resolution No. 83-JJ
seconded by Vice Mayor Zimmerman. Under discussion, Mr. Vance reques'~ed
this approval to be made contingent upon the furnishing of an
appropriate and satisfactory bond to be reviewed by the City staff. Ir.
deLong and Mr. Zimmerman both agreed to include this in the motion.
Councilman Cassandra asked if this correction would be handled by the
City Manager and Hunters Run and Mr. Vance informed him that the plat
will not be recorded until we receive the appropriate amount. Mr.
Cassandra referred to Hunters Run responding to an amount and Mr. Van~e
advised him that this was an incorrect amount.
Mr. Charles Gilbert, 35C Southport Lane, came before the Council and
referred to a letter being submitted from Mr. Paul Hykel, the Project
Manager, in reference to the bond. The developer is requesting that
$280,000 be accepted for that part of Tract P since this tract is
divided into two parts and only the western part is being developed al
this time. For the east part he is requesting, since it will not be
built for a couple years, there be a letter of credit be given to the
City for the remaining amount of $208,000. The letter has been sub-
mitted requesting approval on that basis.
Mr. Vance informed him that the City has an ordinance requiring the
bond. There are certain legal difficulties with letters of credit, he
City has never waived the bond requirement. The plat is for the enti~e
area. It is the recommendation of his office that this plat not be
approved for recording unless the entire bond is posted.

Councilman Cassandra referred to just receiving this proposed resolut
and stated he has not had the chance to read it to know what it is
about. If it meets with Councilman Wright's approval, he would like
defer this until the next meeting so he could read it. Councilman

Councilman Cassandra referred to approaching budget time with work lo~
and schedules increasing and stated he would like a consensus of opin~
of this Council to have an executive meeting to discuss the firemen's
and policemen's negotiations. With the City Manager's approval, he
would like to leave open June 14 at 7:30 P. M.
Councilman deLong questioned if it would be more appropriate to let t!
meet and find out what their requests are before getting entangled in
negotiations? What will be accomplished in an executive session? He
thinks we should at least find out what the proposals are from the Fi]
Department and then guide the City Manager and City Attorney accordin¢
as to the wishes of the City Council.
Mr. Cassandra stated that he has a few things in mind. He does not h~
the benefit of having been on this Council while negotiations were in
session and would like some education prior to being exposed to the

Councilman deLong referred to discovering there was no set policy per-
taining to alternates and stated he requested a policy to be drafted

member of the Board of Adjustment, he sat at the press table and the
chairman allowed the alternates to comment after the members spoke.
Mr. Zimmerman read the last sentence: "If there is more than one alt~
nate present at a meeting, the chairman will select the alternate to
participate by seniority of appointment as an alternate." He comment~
that this may work on some boards, but he thinks it would be better t¢
leave this at the discretion of the chairman as to who he selects an~
possibly alternate if there are two alternates. There is the possibi-
lity the man on the low end of the totem pole would never get to makir
a decision and may drop out. Mr. deLong agreed and added that he has
seen that happen. Mr. Zimmerman suggested changing this to letting t~

appropriate and Mr. deLong suggested changing "may" to "shall". Mr.
Vance suggested that the City Manager insert the appropriate language
based on this discussion upon his review of these minutes.
Mr. Zimmerman referred to some boards designating a first alternate a
second alternate and asked if it would apply and Mr. Vance clarified
that where the designated first alternate is present, he would have t
be called.
Mayor Warnke clarified that the motion is to adopt the policy as pre-
sented by the City Manager for alternates on city boards and it would
up to the chairman to rotate alternates if they are called to serve o
that board unless those boards have first and second alternates alrea

Mayor Warnke stated that Mr. Cheney had submitted an outline and read
the following: "It appears that the concensus of the City Council, a

take steps to prepare a detailed written report, which
would be the basis for a stipulated agreement that will

committee of neighbors who are affected by the proposed
hospital project, which was presented to the City Council

Councilman deLong stated that it appears last Thursday night's meetin(

Mr. deLong stated that he brought these up as they do trouble him and he
is concerned whether we are going in the right direction.
Mayor Warnke asked if the City Attorney had any comments and Mr. Vanc~
stated to the best of his knowledge, if you are involved in a law suit,
both parties are entitled to reach a settlement of that law suit if t~ey
feel it is advantageous for them to do so. Mr. deLong stated that he
believes this is such a serious matter that he personally would like
have a legal opinion from the State Attorney General. This has been
done on many occasions in the past. All he is concerned about is pro
tection for this City Council.
Mayor Warnke clarified that the question before the Council is not one
of rezoning. This law suit is between one government taxing agency
against another taxing agency and as to whether or not they can contr~
one another. Mr. Vance added there are two questions involved. It i
rezoning matter though at the present time, the hospital's position i
that our zoning power does not apply to them, but it is also a zoning
matter in the sense that we are taking the position that we do have t!
right to control their use of the property. Our position is thai
it is a zoning matter and we do have the power to control their use
through our zoning authority, but their position is that we don't hav~
that power. There are two conflicting legal issues. Mr. deLong agree
this is correct, but he thinks the court should decide whether this
governmental agency supersedes the authority of the local governing b(
with all power in zoning the municipality. This is a question which
never been decided in court. Everyone is watching to see what the out
come is going to be. Mr. Vance added there have been a couple decisi~
where two governmental entities have bumped heads and to date, the
courts have decided that this is an impossible situation and they haw
adopted a balancing of interest test and he explained.
Mayor Warnke clarified that he requested this on the agenda to decide
where we go from here. He would like the Council's thoughts on this.
Shall we continue with the present law suit or give the City Manager
City Attorney authority to negotiate? Mr. deLong stated that we have
taken the previous action to have the City Attorney pursue the law suJ
and Mayor Warnke agreed, but added at the workshop meeting, new nego-
tiations were presented.
Councilman Cassandra referred to Mr. deLong's concern and also having
legal opinion and stated he would like to suggest, since the time was
sh~rt when the State Attorney responded to one of our other requests,
that we go ahead and have our City Attorney find out if Mr. deLong's
concerns are valid and at the same time proceed with the meeting with
the hospital contingent upon the State Attorney's opinion. Mr. deLon¢
stated that we do not have doubt in the ability of our local attorney,
but he wants clarification from the State Attorney General.

Mayor Warnke stated it was expressed by several Councilmen at the
workshop meeting that we want something in writing to spell out wher~
we are going from here. The question is now are we going to get the
attorneys involved to spell it out to the Council or go ahead with t
law suit? 5~. deLong replied that before telling him to go ahead, h
thinks he brought out valid points and he wants some guidance whethe
we are doing the right thing. He does not think we should take any
action until we find out we are entitled to do it. He thinks the
Attorney General must give these answers. The City Attorney can dra
a communication to the Attorney General outlining exactly what we ar
concerned and interested in.
Councilman deLong moved that the points he listed be taken by the Ci

Councilman Cassandra clarified that the motion did not preclude nego
tiations or giving direction to the City Attorney to talk to the hos
tal. He then made a motion to direct the City Attorney to meet with
the hospital attorney to discuss their concept and proclaim a warnin

City ~nager's memo of June 7, 1983, is to be incorporated. Vice ~

Mayor Warnke then requested those wanting to speak on this issue to
come forward.
Mr. Caesar Mauti, 150 S. W. 24th Avenue, stated he has lived here fo
approximately nine years. It is surprising to him how this bypassed
the City Planners and there have not been statements from planning
minutes. He would like to bring out some facts. At the Planning
Meeting of January 12, this hospital applied for a change in zoning
for the purpose of additional parking spaces. He then read from a
letter from Dr. Weems, Chairman of the Planning Committee, stating
if they are permitted to utilize the land which they are requesting
to be rezoned, they expect to qenerate~approximately 100 'spaces. He
then read from the minutes of the Planning Board on January 12 where
he was asked about closing 2nd Street to traffic and his response wa
if that was done, then the neighborhood might go along with the zonil
being approved. At that time, only seven lots were in consideration
butnow they are up to ten acres. He was concerned about the traffic
from 100 spaces. It was an established issue then by Mr. Humphreys
that the hospital would take the rest of the Benson property. That
was denied by the Planning & Zoning Board and City Council. Now, th,
have re-applied with ten acres. They would not consider that even iJ
2nd Street was closed. This Council represents the taxpayers and thi

Councilman Cassandra questioned what the rough amount of taxes which
would be lost if this was developed as R-1AA and Mr. Annunziato repli
it would probably be about $300 per lot. Mr. Cassandra added that th,
impact fee would be lost also and Mr. Annunziato agreed and that is $
per unit. Mr. Cassandra asked him to prepare written comments regard
this and also include the impact on 23rd Avenue and Mr. Annunziato
replied that he will do that and added that the traffic pattern in th
entire area would change. Mr. Vance commented that it would be his
intent to rely upon Mr. Annunziato and the Technical Review Board whel
carrying on any negotiations.
Mr. Cassandra then requested Mr. Hill to honor Mr. Mauti's request an,
Mr. Hill informed him that he made a request for the plans and he
expects to have them by the end of this week.
Mrs. Carol Wimer, 140 S. W. 24th Avenue, referred to living here sinc
1957 and stated all these years they have tried to work with the hosp
tal. She feels they have now come to the point where the hospital is
trying to invade and take over the whole neighborhood. Every time th
have met with the hospital, different plans have been presented. The~
came Thursday night and were not able to get in and could not even gii

presented their plan at that meeting. They have attended meetings
with the hospital representatives and have taken what they have said
at face value and it has been changed continually to something dif-
ferent. Can they depend on reaching a solution and if a solution is
reached, can it be definite? Can the City hold the hospital to
restrictions or is it a ploy to get the zoning changed? She requests
the Council to think carefully before making a zoning change. Mayor
Warnke informed her the Council tonight voted on .exactly what she is
talking about. This will be sent back to the attorneys to have it
etched in concrete. This is not a rezoning situation tonight. Mrs.
Wimer asked how they would go about being sure it is not changed and
Mayor Warnke informed her that Mr. Vance and the hospital attorney ar
going to work out an agreement. Also, there will be a public hearing
before any rezoning is done.
Mr. Vance announced that he would be appreciative if the neighborhood
could present to him in written form their concerns and he would be
glad to meet with the group to get a general consensus. This is not
going to be a short fast procedure, but will take awhile. Mr. Mauti
responded that they would like to look at whatever plans they have an~
have a meeting with the neighborhood and present in writing exactly
what they think should be done. Mr. Vance agreed this would be the
proper thing to do.
Mayor Warnke emphasized that this action of the Council is to have
something in writing from the attorneys and have it presented to the
neighbors. Nothing will be done in a hurry. The attorneys will pre-
sent the Council with written proposals and a public hearing will be
held.
Mrs. Mary Samyn, 151 S. W. 25th Avenue, referred to living directly
across the street from the additional property the hospital has bought
and stated she agrees with Mrs. Wimer and Mr. Mauti. Also, the next
time there is a meeting, she would appreciate it if she did not have
to wait to hear it on the five o'clock news. Mayor Warnke informed
her that the City Council meets on the first and third Tuesdays. Mrs
Samyn asked if it was published in the paper when there is a meeting
and Mayor Warnke informed her that the agenda is posted on the door o~
City Hall and Councilman Cassandra added that it is published in the
Sunday Sun Sentinel. Vice Mayor Zimmerman clarified that the Council
has just done what the people are asking by their vote tonight.
Mr. Owen Anderson, 2181 S.W. 15th Avenue, submitted a resolution from
the Chamber of Commerce supporting in essence the motion adopted.
Mayor Warnke then read the resolution of the Greater Boynton Beach
Chamber of Commerce in support of the proposed plan by Bethesda
Memorial Hospital for use of the Benson Heights property for parking
and building purposes.

Mayor Warnke announced this matter has been referred back to the
attorneys and we will get a detailed report on what the solution may
or may not be and certainly there will be a public hearing before any
decision is made regarding zoning. It must go before the Planning &
Zoning Board, Community Appearance Board and Technical Review Board.
It will possibly be a few months before a final solution is arrived
at.
OLD BUSINESS
Bicycle Path and Sidewalk - N.E. 22nd Avenue (Tabled)
Councilman Cassandra moved to take this off the table, seconded by
Vice Mayor Zimmerman. Motion carried 5-0.
Mayor Warnke requested those people wanting to speak on this to come
forward.
Mr. George Goldman, 2520 N. E. 1st Court, requested the building of a
bike path on 22nd Avenue be voided on behalf of the residents of
Village Royale on the Green. They do not think it is proper to take
away their lawns, parking spaces, trees and shrubbery to build a bike
path. He told about the history of when Village Royale on the Green
was built and how parking and landscaping was allowed on City pro-
perty. It is up to this Council to right this wrong. He requests th~
City not to take away from the senior citizens their right to the use
of their parking lot and lawn to build a possibly dangerous bike path
where elderly people will be walking. Mayor Warnke informed him that
several Council members and the City Manager walked along 22nd Avenue
and were aware a bike path would take away from the parking lot.
Councilman deLong agreed the building inspections weren't handled pro.
perly and advised the inspectors were fired from the City, but this
took place before he came on the City Council. Mr. Goldman asked if
they should be punished for what was done and Mr. deLong agreed it
should have been corrected when it came up at the beginning; but now,
nothing should be done there about a bike path but wait until the roa~
is widened.
Mrs. Mary Erhardt, 230 N. E. 22nd Avenue, referred to representing th
single family residents on 22nd Avenue and asked the Council to recon
sider the necessity and relocation of such a bike path. There is mor
than adequate space outside their property. There would be great
expense to construct it at the current location. They request it to
be moved closer to the street. They also would like to suggest that
the funds from this project be turned over towards the widening of
Seacrest Boulevard since that is needed more. If the project pro-

Councilman deLong moved to take this from the table, seconded by
Councilman Cassandra. Motion carried 5-0.
Councilman Cassandra stated at the last election, it was brought to
our attention the need to tighten up our election laws and procedures
He wants to start a discussion to give the electoral procedure the
proper time and consideration it deserves. He recommends that one
month from tonight on July 5th that we finalize our recommendations t
the City Attorney so he can prepare the necessary referendums and
corrections to our City Code. In the last election, the issues which
arose were in the areas of primary, residential requirements, city-
wide versus districting, unopposed candidate and some side effects
inasmuch as our City Codes do not reflect proper procedures in some o
our governmental procedures.
Mr. Cassandra referred to primary and stated this City had the added
expense of primaries where recently we seem to have a high apathy
toward voting. In the last few elections, we have had less than a
majority of registered voters coming out to vote. This means the
minority of the registered voters are putting the Council members int
office. Therefore, he suggests we remove the need for primaries and
let the person getting the most votes win on election day. 2)
Increase the number of candidates before you have any primary. 3) I
you wish to have a runoff, let it occur after election day if no can
didate running receives a majority.
Mr. Cassandra referred to residential requirements and stated there
were comments at the last election brought against an incumbent of
moral and ethical procedure because of moving from one district to
another for the purpose of running again for City Council. Therefore
he recommends a residential requirement that must be met before the
first day allowed for registering of a candidate. He recommends if a
citizen wishes to change his residence, he must live there 100% of th
time and not just a mailing address. Also, there should be a penalty
if an address is changed just for running purposes. If an incumbent

ceeds, will they be apprised beforehand of the type of material,
construction and location? Councilman Cassandra replied
affirmatively, if it does occur.
Mr. Doug Crawford, 2222 N. E. 1st Way, Village Royale, stated it was
nice to know the Mayor, Vice Mayor, Councilmen and City Manager walke
up and down the street. On the assumption that this program will be
implemented, they agree with the City Manager's recommendation B-5 fo
the bike path to be on the north side and remove from the right-of-wa
at Village Royale on the Green and meander construction to minimize
effect and east of Village Royale on the Green to stay at the right-
of-way line except where minor movement away from the right-of-way
will minimize effect on quality landscaping. He stressed that the
question of safety is high on the list of priorities. A mixture of
pedestrians, two wheel bikes, three wheel bikes and wheelchairs may
create a hazard. Are 'bikes to be banned from sidewalks?
Consideration should bie given to the property which has been in
existence there for some time.
Councilman Cassandra stated that Mayor Warnke, Vice Mayor Zimmerman
and he walked fr~m thei clubhouse down to Seacrest with Mr. Cheney.
They looked at every house and considered the effect this bike path
would have on the commUnity. He saw a beautiful rock garden which
would be lost along with l~ndscaping, shrubbery, etc. All they heard
was that nobody wants Ut. They met two bikers at the end of the walk
and they don't want a path on their street.
Councilman Cassandra moved to postpone the construction of the
sidewalk/bike path until when and if 22nd Avenue is widened.
Councilman deLong seconded this motion with great pleasure because
this is the suggestion!he made at the original meeting. Under
discussion, Mr. deLong added that if they decide to widen the street
they will come back to the Council before any walk is constructed.
Mr. Wright commented that it is unfortunate that the citizens could
not get together and make any determination. He was called quite a
bit about funds from the County to do something there. Former Mayor
Trauger received a lot of calls from people in Village Royale on the
Green about the bike path. He hopes there won't be problems with
pedestrians or bikers riding along that area. If the residents choos,
not to have a bike path at this time, he will support that request.
Vice Mayor Zimmerman referred to 22nd Avenue being the City's respon-
sibility and stated if it is to be widened, we will have to pay for
it. Probably if we don't build the bike path, the City will be egged
on to get the whole job done quicker. Councilman deLong added that
when Motorola gets into operation, signs should be installed noting i~
is not a truck route. Mayor Warnke clarified that it has been moved
and seconded to postpone any action on the bike path on 22nd Avenue
until such time as the road is widened. Motion carried 5-0.

changes his or her residence, he must resign his Council seat becaUse
he won't be representing his district any more and a replacement must
be appointed.
Mr. Cassandra referred to City-wide election versus district voting
and stated if it is the decision of this Council to stay with
districting, then let it truly represent the people who live in that
district. For example, at the last election, we had voters coming ou
that did not even vote for a candidate in District I or III and nearl
all voted for District V candidates. They did this to control the
vote and the people did not even live in District V. That is not a
true representation of the district constituents. If we had district
voting on the last election based on the results of that election,
there would be no change in District I, no change in District III,
District V would be 519 votes for Morton Goldstein and 418 votes for
Sam Wright.
Mr. Cassandra referred to having an unopposed candidate and stated
this creates a problem with the election of our Vice Mayor/Mayor.
An unopposed candidate defeats the manner in which we elect our Vice
Mayor. It is unfair to the candidates who have opponents and also
unfair to the unopposed candidate. Therefore, he recommends changing
the procedure from electing our Vice Mayor to Mayor as long as we sta
with districting concepts. He recommends that the newly elected
Council members and the incumbent Council members elect the Vice
Mayor/Mayor position.
Mr. Cassandra stated when districting was initiated, certain codes
were not changed such as Paragraph 51 - filling vacancies on the City
Council. It does not state the position must be filled with a repre-
sentative from the same district and it could be anybody. This
defeats the concept of districting.
Councilman Cassandra referred to presenting a few of his ideas and
suggested that the Council consider our electoral procedure and sub-
mit further recommendations, so we can have an election system which
Boynton Beach can be proud of.
Councilman deLong suggested taking these recommendations and turning
them over to the City Attorney. He added that we must realize that w
are also governed by the election laws which supersede our local laws
This is a good time to do it because the new election will be set up
for a certain date. Councilman Cassandra suggested that the members
think about his recommendations for a month and come back with
suggestions.
Mr. Vance advised that he believes the statute will over-ride the
existing code provision. As a practical matter, he would like a con-
sensus from the Council of what items they would like to have looked

Mayor Warnke stated he is not very comfortable with the districting wE
have at the present time and is open to consideration to different
procedures in the future. It does raise certain problems. What if
nobody runs from a district? It gives representation of the whole
City if you have people for all sections of the City. There could
also be problems with one person running who is not qualified. There
are certain difficulties with districting that he is not comfortable
with. Councilman deLong agreed that we must be given the opportunity
to work things out and added that previously three or four members of
the City Council all came from one district which was unfair.
Councilman Wright commented that he thinks districting is great and
will do a lot for the City. He does agree there are some problems
with the way it is and some improvements could be made. He would lik
to see the attorney respond to the concerns raised by Councilman
Cassandra. Possibly we should have a workshop meeting next month to
discuss this fully before making any final decision. Mayor Warnke
agreed this could be done. Councilman Cassandra stated the first ste
is to take these recommendations under consideration. He mentioned
the July 5th meeting to give direction to the city Attorney, but he i
open to a workshop concept for discussion before presenting to the
City Attorney. Mr. Wright stated he would like inpu~t from the City
Attorney and Mr. Cassandra asked if Mr. Vance could give input on Jul
5th? Mr. Vance replied that he could handle it, but it may be more
appropriate to consider the recommendations made by Mr. Cassandra by
the Council and address certain areas.
Mayor Warnke stated he talked to Mr. Wolf about whether a study had
been made in different areas and he was told there hadn't been. Mr.
Vance advised that the elections in Boynton Beach have been amended
four or five times in the past 15 to 20 years. There are different
methods of elections in all municipalities. Councilman deLong
referred to the City Attorney being acquainted with the time limita-
tions and stated we must decide exactly what should be advertised an(
he thinks Mr. Vance can handle it to get it on the ballot for the ne:
election. Mr. Vance agreed that we have adequate time with having
almost a year. Mayor Warnke added that he will call on the League o:
cities and the Department of Community Affairs to see if we can come
up with something more. Mr. Vance added there are many variations ii
t~e County alone, but he will poll the largest six or eight cities ai
run copies of their election forms for background material.
Day Care Center
COuncilman deLong referred to work being done at the Day Care Center
and stated they were unable to hold their graduation ceremonies at t

center because of this and made arrangements to hold it at the com-
munity center on Sunday. However, they must pay a fee for cleanup,
but were able to use their own people before.
Mr. deLong moved that the fee be waived for the renting of the civic
center by the Day Care Center for that particular day. Mr. Cassandr~
asked if he was also recommending that they do the cleanup work and
Mr. deLong replied affirmatively and included it in the motion.
Councilman Wright seconded the motion. Under discussion, Vice Mayor
Zimmerman questioned what the fee is and Mr. deLong replied .that it is
around $25. Motion carried 5-0.
Library
Councilman deLong referred to the librarian doing a wonderful job, but
added if you take a tour of the library and see how overcrowded it i
and what the conditions are, he thinks we are remiss in not
instructing the City Manager to start moving with a second story addi-
tion for that building.
Councilman deLong moved to instruct the City Manager to proceed in
making arrangements to get a second story constructed on the library.
Vice Mayor Zimmerman seconded the motion. Under discussion, Mr.
deLong added that there are a lot of preliminary things to be done.
Mayor Warnke asked if it should be included in this year's budget and
Mr. deLong replied that he wants it pursued as quickly as possible an
the City Manager knows the procedure. Mr. Cassandra clarified that a
cost feasibility study is wanted. Mayor Warnke clarified that it has
been moved and seconded that the City Manager be asked to get a study
going for a second floor addition to the library and come back to the
City Council with recommendations. Motion carried 5-0.
ADMINISTRATIVE
Consider Appointing two Alternate Members to Boynton Beach Housing
Authority (Tabled)
Councilman Cassandra suggested leaving this on the table because he
believes they are contemplating disbandment. Mayor Warnke agreed tha
he also got this impression from reading the minutes. Mr. Cassandra
moved to leave this on the table, seconded by Mr. deLong. Motion
carried 5-0.
Report on Parking in area of N.E. 26th Avenue and 3rd Street (Tabled)
Councilman deLong moved to take this from the table, seconded by

Councilman deLong referred to reading the reports from the City
Manager and people in the association there and moved to adopt the
recommendations as presented by the City Manager. Mr. Cassandra
seconded the motion. Under discussion, Mayor Warnke read that the
Board of Directors, Village Royale Greenwood Association, Inc.,
(Building 12) has again recommended that no parking be permitted on
the west side of N. E. 3rd Court and that the present signs prohi-
biting parking remain. They further agree that additional signs be
placed between their north driveway entrance and 26th Avenue. He rea
from the City Manager's memo that the recommendations of the represen
tatives from Village Royale on the Green are:
That "No Parking" signs be installed on the south side
of N.E. 26th Avenue, between N.E. 3rd Court and Victoria
Boulevard.
That the existing "No Parking" area on the west side of
N.E. 3rd Court be extended in a northerly direction to the
corner of N.E. 26th Avenue.
3. That parking be allowed on the north side of N.E. 26th Ave.
Motion carried 5-0.
Appoint one City Alternate to Municipal Golf Course Advisory Committe
(Tabled)
CoUncilman Cassandra moved to remove this from the table, seconded by
Vice Mayor Zimmerman. Motion carried 5-0.
Councilman Cassandra moved to open nominations, seconded by Councilma
deLong. Councilman Cassandra nominated Mr. Phil Massa, 1315 S. W.
18th Street, Phone: 737-8652, as he submitted a terrific resume.
Councilman deLong moved to appoint Mr. Phil Massa as the City alter-
nate to the Municipal Golf Course Committee and this appointment
received a unanimous vote from the Council.
Consider Adjustments to 1982/83 Budget
Mr. Sullivan read the memo submitted by the City Manager stating:
"A review of the Monthly Expenditure Statement for the end of
May 1983 (eight months of the fiscal year) shows that the projections
for overall revenue reductions for 1982/83 are at about the same leve
as previously reported to the City Council and, therefore, in general
the expenditure reductions that were presented to the City Council on
May 17, 1983, are still appropriate.

"On two previous occasions it had been suggested that the stre~
resurfacing expenditures for 1982/83 be reduced to $100,000 from the
original proposal of $150,000 so that added personnel can be employed
as follows:
1o Building Department - an additional rehabilitation
and code inspector
2. Police Department - an additional police clerk
3. Parks Division - a landscaping crew for the purpose
of keeping up with added park areas and taking on new
landscaping and beautification projects throughout
the City in order to respond to desires for improve-
ments in this area
"All of these positions were approved by the City Council with
the adoption of the 1982/83 budget with adequate funds appropriated t¢
fill these positions during the last four to six months of the fiscal
year. These positions have not yet been filled pending these current
budget reviews and the making of a determination that funds are
available."
Mr. Sullivan advised that the Council's pleasure is needed as to the
filling of these various positions.
Councilman Wright referred to reading this and other reports in the
past and stated he still feels strongly that we should not cut the
budget back for street resurfacing. He wants to keep $50,000 in the
budget for that. Councilman Cassandra added that he agrees with Mr.
Wright .on the road resurfacing program; he would rather see that stay
intact. He would like to see the new Codes Enforcement Officer hired,
but thinks the other two can wait until the next budget.
Mr. Sullivan informed the Council that the Police Department had
requested additional patrolmen and police aides, but the Chief feels
he can do without them until next year, but an additional clerk is
essential because of the increased work load. The Parks Department
goes without exception as a lot of parks have been added and this is
the growing season. Councilman Wright remarked that we should get
some CETA workers.
Councilman Cassandra commented if the City Manager could tighten
things a little more, there would be money and also he should check to
see if there are other places which don't need spending, but the roads
are needed.

Mr. Sullivan asked if the Rehabilitation and Code Inspector could be
taken out of the $150,000 and Mr. Cassandra replied that he thinks
there are other monies.
Councilman Wright referred to $60,000 being mentioned at the last
meeting and vice Mayor zimmerman clarified that $60,000 recommended k
the City Manager was in the budget for the police pistol range and he
intended to use that to make up a deficiency and fund part of the
pistol range which is currently in a state fund for local government
crime control.
Councilman Wright moved to leave $50,000 in the street resurfacing
budget and hire the Rehabilitation and Code Inspector for the next fE
months. Councilman Cassandra seconded the motion. No discussion.

Parking in Area of N.E. 26th Avenue & 3rd Street (Continued)
Mrs. Edith Grant, 313 N.E. 26th Avenue, referred to being proud of h
residence and her home, but stated what has developed in the last te
months is undesirable. She has written to the city Manager and talk
to his secretary. Since the ball park was opened, this area is
terrible. They change their clothes and use the parking lots for
toilet facilities. Cans and bottles are all over. This has been
tabled since last year and "No Parking" signs should be put up. The
school has ample parking on Miner Road, which belongs to the school.
This is the lowest area in which a person could ever live. Council~

26th Avenue. They met with the city Manager and Miss Pulte. He wr¢
a letter asking that no parking be permitted on 3rd Court. On the
north side of their drive to 26th Avenue, there are no signs, but a
lot of parking. The grass is being destroyed. They are not in
agreement to having a parking lot built north of 26th Avenue. Mayo~
Warnke informed him that this has already been voted on tonight.
Councilman deLong added that the Village Royale on the Green reside
approved it and Mr. Wiener replied that they did not vote for
screening of the parking lot and the vote was not covering plans fo
the parking lot.
After further comments, Mayor Warnke advised that this will be
referred back to the City Manager.

proposed plan by Bethesda Memorial Hos-
pital for use of the Benson Heights
Property~for parking and building purposes.
WHEREAS, the present parking area for Bethesda Memorial Hospital
is totally inadequate to accommodate the parking requirements of the
staff and general public, and
WHEREAS, the projected population growth of the area served by
this regional hospital is expected in the next five years to exceed
the explosive growth of the past five years, and
WHEREAS, this growth will increase the vehicular.traffic to and
from this public institution and increase the need for additional
parking spaces and a more sophisticated traffic system, and
~HEREAS, the hospital has now arranged to secure a tract~of ten
acres for which access is available from S.W~ 23rd Avenue~ and on
which it can develop an adequate and reasonable solution to its
parking needs, and
NOW, THEREFORE, BE IT RESOLVED, that the Greater Boynton Beach
Chamber of Co~m~erce urge the City Council of the City of Boynton Beach
