Mayor Zimmerman called the meeting to order at 7:30 P. M.
He announced the invocation will be given by Rev. Ben
Tidwell, Westside Baptist Church, followed by the Pledge of
Allegiance to the Flag led by Councilman Wright.
AGENDA APPROVAL
Councilman Warnke stated he would like to take Item E from
the Consent Agenda for separate consideration.
Mr. Sullivan stated under Announcements, it should be
announced that next Monday, September 24, we will have the
final public hearing for adoption of the new 84/85 budget.
Under Consent Agenda, Item H, he has an additional bill from the
South Central Regional Wastewater Treatment & Disposal Board
in the amount of $164,022, which was approved on June 19 by
the Board. He would like to delete Item VIII-B because the
applicant has requested this be deleted until the October 16
meeting because it is being referred back to the Community
Appearance Board.
Vice Mayor Ferrell stated he would like to move from the
Consent Agenda, Item G, in reference to the South Central
Regional Wastewater Treatment & Disposal Board budget for
separate discussion.
Councilman Warnke moved that the agenda be approved as
corrected, seconded by Councilman Wright. Motion carried
5-0.
ANNOUNCEMENTS
Mayor Zimmerman announced the next City Council meeting will
be held on Wednesday, October 3, 1984, due to the run-off
election on Tuesday, October 2, 1984.
The Mayor announced the first City Council meeting in
November will be held on Wednesday, ~November 7, 1984, due to
the General Election on Tuesday, November 6, 1984.

Mayor Zimmerman announced a budget hearing will be held next
Monday, which is the final public hearing on the fiscal year
budget coming up.
MINUTES
Regular City Council Meeting Minutes of September 5, 1984
Councilman Warnke referred to the second paragraph on Page 3
and stated he thinks the traffic signal should be at N. E.
22nd Avenue. Also, under Appointment of Police Chief, it
should read "Councilman" Warnke and not Mayor. Under Public
Audience, the light should also be at N. E. 22nd Avenue.
Vice Mayor Ferrell made a motion to approve the minutes as
corrected, seconded by Councilman Warnke. Motion carried
4-0 with Councilman Cassandra abstaining since he was not
present.
CITY MANAGER'S REPORT
Beach Project
Mr. Sullivan referred to the beach project coming along and
advised part of the contract calls for official closing of
the beach for two days for transition from Phase I to Phase
II. We are at that point right now and the beach will be
closed for the next two days to the public as a safety pre-
caution. It is anticipated it will be open this coming
weekend.
Proposed Capital Improvement Program
Mr. Sullivan referred to copies of the proposed capital
improvement program being distributed and stated he hopes
the Council will have an opportunity to review it and
discuss it next Monday.
PUBLIC AUDIENCE
Dogs Running at Large
Mrs. Wilda Searcy told about certain dogs running loose in
her neighborhood. She told about the animal officers not
being able to catch them and suggested calling out the Army

Reserves. These dogs are diseased, a nuisance and
dangerous. Councilman Warnke added that these dogs were
living in a house which was demolished and are now running
around the neighborhood. He believes the Council should
direct the proper authorities to get rid of these dogs.
Mayor Zimmerman questioned the number of dogs and Mrs.
Searcy replied there are two.
Mayor Zimmerman referred to the usual procedure on this and
Mr. Sullivan advised he will turn this over to the Animal
Warden. He believes it has been studied by the Animal
Warden and George Hunt. He thought it was resolved, but he
will check into it tomorrow.
Proposed Capital Improvement Program
Mrs. Wilda Searcy referred to an article in the paper in
reference to $13,000,000 being spent in Boynton Beach and
asked if they were going to get some sidewalks, etc. in her
area. Mayor Zimmerman informed her this is a capital impro-
vements program to improve various buildings, etc., but does
not include streets or sidewalks. Mrs. Searcy asked if she
has to go to the courts to get some improvements in her
neighborhood as they need better living conditions in the
black neighborhood. Councilman Wright referred to her
raising these concerns with Community Development and Mrs.
Searcy replied that Community Development started working
with some people living in dilapidated houses, but she
thinks more people need to get involved in this.
Mayor zimmerman stated we do have a new budget with a road
repair program, but he doesn't know if sidewalks were
included. Mr. Sullivan advised as far as including
sidewalks, they were analyzed throughout the city and the
worse ones are taken care of. Also, 10th Avenue has been
completed and three streets in Cherry Hill are going out to
bid. These are two large projects which have been done in
that area. Mrs. Searcy again stressed the need for
sidewalks and Mr. Sullivan replied there are a lot of
sidewalks and streets in Boynton Beach in need of repairs.
A list of these is prepared for the Council's approval.
There was further discussion about the need for sidewalks
and Councilman Wright told about other groups wanting other
improvements and about things being done in this area.

Mayor Zimmerman requested Mrs. Searcy to be present at the
public hearing on Monday night to fight for an increased
budget in order to accomplish these things.
Allegation of Zoning Violation
Mrs. Sherry Schiller, 1057 S. W. 27th Avenue, read a peti-
tion signed by residents of Golfview Harbour in reference to
the zoning code being violated at 1096 S. W. 27th Avenue.
Councilman Cassandra told about checking out this house per-
sonally and reported there is an excessive number of cars
parked there and an extra kitchen was constructed in the
garage. Also, there is the question they might be holding
house prayers in the home. He requested an investigation to
be made by the Building Department. Mr. Bud Howell,
Building Official, reported that they did go through the
house and it was clean. They were told that prayer meetings
are held there, but there is nothing preventing that. Also,
there is nothing against having two kitchens.
Councilman Cassandra stated that he feels personally there
is more than one family living in this house. He thinks we
have requirements which should be tightened up to define a
one family r~esidence. Mr. Vance advised he will review the
code. Councilman Cassandra questioned the enforcement of
one family living in a house and Mr. Howell told about court
cases and how there could not be control over who was living
in a house.
Councilman Wright questioned how many black residents are
living in this area and Councilman Cassandra enumerated the
various groups living in this area, but clarified that the
petition was signed by all ethnic groups.
Councilman Cassandra requested that a legal opinion be
obtained for these people and Mr. Vance told about some
federal decisions which have been made in this area and
suggested that a field investigation was the only way to
determine what is going on in a house. Councilman Cassandra
agreed a field investigation would be helpful, but it must
be after 5:00 P. M.
Mayor Zimmerman suggested having the City Manager's office
check this out with the help of the City Attorney and submit

a report. Mr. Sullivan replied this could be done by the
next Council meeting on October 3.
Request for Safety Rope at Beach
Mrs. Genevieve Savage, Sterling Village, referred to the
senior citizens enjoying the beach and stated there used to
be a rope in the ocean which they could hold onto. Since
the beach is being improved, she wonders if such a rope
could be included. Mayor Zi~merman requested Mr. Frederick
to comment. Mr. Frederick advised they are taking a look at
it again and are checking with iother beaches in Palm Beach
County. He will have a report for the Council's con-
sideration at the next Council meeting.
Allegation of Zoning Violation
Mr. Bob Tegart, 1099 S. W. 27th Avenue, stated he signed the
petition submitted and wants to make it clear that race,
color, creed or religion is not an issue here. The issue is
a single family residence being used for multiple family.
He would recommend the appropriate time to investigate would
be between 5:00 and 8:00 A. M. with the people exiting to
ten to twelve cars. If there is no legal way to enforce the
zoning, then it should be zoned multiple and he will make
multiple use of his home.
Boynton Plaza Development Plans
Mr. Ron Reeves, 117 North Congress Avenue, stated in
reference to Item B which was deleted, there are people here
in opposition to this building and he would like a count
taken in case they are not able to attend the next meeting.
He also submitted a petition. Mayor Zimmerman counted about
19 to 20 people present in opposition. Councilman Cassandra
requested that copies of the petition be made for the
Council.
Beach Project
Mr. Ben Uleck, 1507 S. W. 17th Avenue, referred to September
10 being the deadline for the completion of the beach pro-
ject and questioned what the penalty is and Mr. Sullivan
informed him it is $500 per day and the contractor has been
put on notice. Mr. Uleck urged the Council not to issue any

extra work orders to this contractor and requested that it
be completed as it stands.
Request for Additional Agenda Information
Mr. Ben Uleck requested that the agenda contains the exact
request in reference to a height variance and the reason
requested under Development Plans. Mayor Zimmerman replied
these items have to be kept rather brief because of the
number of pages involved, but possibly an additional fact or
two in the way of numbers could be included. Mr. Uleck
requested that the number of feet and purpose be included.
Mayor Zimmerman agreed this information would be helpful and
requested the City Manager's department to include anything
like that which could be put in a reasonable amount of
space.
Waiver of Fee for Permit to Solicit
Mrs. Fern Wilson, 512 N. W. 8th Court, told about the wOrk
done by the Atlantic High School Band. She told about fund
raising efforts of this group and stated in order to solicit
in Boynton Beach, they were told the fee is $10 for the per-
mit plus 25~ for each youngster collecting money. This is
not a great amount, but when kids are trying to raise money
and keep out of trouble, it is a lot. She respectfully
requests that the Council waive this $10 solicitation fee
and 25~ for each youngster. Their drive is scheduled ten-
tatively for October 13. Each youngster would be under the
supervision of an adult and the police will be notified.
Councilman Cassandra stated he would like to pay the $10 fee
for the permit.
Councilman Wright questioned how many children were involved
and Mrs. Wilson replied there are 125 kids. Vice Mayor
Ferrell asked if there was any problem with waiving the fee
and Mr. Vance replied that it has been done before and Mr.
Sullivan added that it was done for the Girl Scouts.
Vice Mayor ~errell made a motion to waive all fees for this
solicitation, since we have done it before. Councilman
Wright seconded the motion. Mayor Zimmerman added that
badges will ihave to be issued. Motion carried 5-0.

Mrs. Boroni advised that 765 badges were just issued to
Congress Middle School with a permit and they paid $201.
Vice Mayor Ferrell suggested the City Attorney look at this
and structure exceptions into it for educational institu-
tions. Mr. Vance informed him this would raise the issue of
discrimination. Mayor Zimmerman stated that it is at the
discretion of the Council.
CONSENT AGENDA
A. Bids
1. 18 Tons Bulk Fertilizer for The Golf Course
The Tabulation Committee recommends awarding the bid to the
low bidder, Woodbury Chemical, in the amount of $4,882.25.
2. 5,600 Pounds of Grass Seed for the Golf Cours~
The Tabulation Committee recommends awarding the bid to the
low bidder, Woodbury Chemical, in the amount of $4,816.
Swale Construction for Drainage Improvements and/or
Swale Sodding for 1984 - Engineering
The Tabulation Committee recommends awarding the bid to the
low bidder, S. E. Cattle Company, in the amount of
$36,057.10.
4. Re-roof Wilson Center - Building Department
The Tabulation Committee recommends awarding the bid to the
lone bidder, A.C.I. Century, Inc., in the amount of $15,665.
The City Manager recommends expanding the project to do the
entire roof by using contingency funds and use the reroofing
process of the same nature that was used for City Hall and
the Library.
5. Golf Ball Retrieval - Golf Cours~
The Tabulation Committee recommends awarding the bid to the
high concessionaire, International Golf, in the amount of
$3~024.

Councilman Cassandra moved to accept Consent Agenda, Item A,
1 thru 6; Item B, Resolutions 84-VVV and 84-WWW; Item C, 1
thru 7; Item D; Item F; Item H with additional bill from
South Central Regional Wastewater Treatment & Disposal Board
in the amount of $164,022. Councilman wright seconded the
motion. Under discussion, Councilman Warnke referred to
Approval of Bills having a bill from Russell & Axon in the
amount of $11,214.86 and stated two years ago, he asked for
itemized bills. He read the statement submitted and stated
he believes for us to evaluate bills of this size, we should

have attachments and staff comments including statements why
they could not be done in-house. He wants it broken down by
man hours with details on bills from Russell & Axon.
Councilman Cassandra stated that he believes Mr. Cessna gets
that breakdown and a copy could be attached to the bill for
our review. Mr. Sullivan agreed it could be included with
the agenda material and Mr. Cessna added that he will see
that it is done. Motion carried 5-0.

Approve Authorization for Professional Services
Seacrest/Boynton Canal Water Main Crossing Report
Councilman Warnke stated he was disturbed with the
suggestion to refer this to Russell & Axon to perform their
services at a fee up to $3,500 to determine whether or not
the water pipe is hung properly from the bridge. He showed
pictures and told personally about what equipment he had
observed at this crossing. He explained how he did not
think this professional service was necessary and this could
be done by our own engineering department and the utility
company. He would like to turn this down and have it sent
back to our engineering department and ask for an explana-
tion why we should go through this expense.
There was further discussion about the condition of the
bolts and Mr. Cessna offered to go with Councilman Warnke
and show him the items referred to in the report. Mr.
Cessna added that the bolts are just hanging there, the
cable and straps are badly deteriorated and he brought this
up because this is a main line. Councilman Warnke replied
that he does not see where we have to spend $3,500 for a
study.
Councilman Cassandra moved to table this, so Councilman
Warnke is satisfied the staff is not misleading the Council
and also can meet with Mr. Cessna to resolve this.
Councilman Warnke seconded the motion and it carried 5-0.

Ratification of South Central Regional Wastewater
Treatment & Disposal Board Action of September 13, 1984
of Fiscal Year 84/85 Plant Operating Budget
Vice Mayor Ferrell stated he thinks we have to ratify this,
but he would like to go on record to have a letter sent by
the City Manager requesting the budget be resubmitted

showing costs for the same items during the last two
years, showing new items, etc. He thinks we should have
this because we do not review the budget line by line. Mr.
Ferrell so moved, seconded by Councilman Warnke. Mayor
Zimmerman clarified that the City Manager will make our
desires known with a request for a comparison budget with
line items. Vice Mayor Ferrell added that transfers are
made without approval and he has some questions about that.
Mr. Cessna added that the budget was only received about
seven days before and he would hope they would be asked to
submit it at least one month prior next year so it can be
reviewed.
Councilman Wright asked if there is a deadline to approve
this and Councilman Warnke replied that it is approved by
the Board and just requires our ratification. Vice Mayor
Ferrell clarified that it was passed by the Board on the
basis a more extensive presentation would be made by the
next quarterly meeting and he wants to make sure it will be
done. Mr. Vance stated that he understands the Council's
concern and is in agreement, but thinks there is a time fac-
tor problem here. Vice Mayor Ferrell clarified that he was
not suggesting to delay ratification, but be sure to get a
more extensive review before the next quarterly meeting. He
has d~scussed this with the City Manager and will work with
him on drafting the letter.
Motion carried 5-0.
BIDS
NONE
PUBLIC HEARING
Approve request by Robert G. Beane to rezone a .52 acre par-
cel from R-3 multiple-family residential to C-2 neighborhood
commercial and to amend the future land use element of the
Comprehensive Plan from high-density residential to local
retail commercial. This parcel of land is located in the
700 block of North Seacrest Blvd.
Mr. Annunziato showed the location of the property and
advised the Planning Department recommended that this
application be denied and submitted a report listing the

reasons. This recommendation was forwarded to the Planning
& Zoning Board and after conducting a public hearing, the
Planning & Zoning Board made a recommendation to approve
this request.
Mr. Gene Moore, attorney representing the applicant, stated
Mr. Beane applied for rezoning of this property two years
ago, but it was denied and suggested at that time it could
be C-2. Since then, 120 residential units have been
constructed. This property is left, which is abutted by C-2
to the south. This property is not susceptible for reaso-
nable development of multi-family dwellings, mainly because
of the size of the parcel with a lack of depth and with
fronting on Seacrest Boulevard which is heavily travelled.
This can only be used for reasonable neighborhood commercial
to service the people there. It is not spot zoning since
C-2 zoning is adjacent. Mr. Beane did discuss with the
developers of the apartments whether they would be
interested in this property, but they declined saying a
buffer was needed by the arterial street. They do not feel
there is adequately zoned commercial in this area. There
has not been any new commercial development in the C-2 area
even with the advent of Martin Luther King, Jr. Boulevard.
They feel this should be added. They feel it is an ideal
site for limited commercial uses to adequately service the
people living there. There was no opposition at the
Planning & Zoning Board and he sees none here tonight and
feels that is support for this change. A favorable ruling
was obtained from the Planning & Zoning Board.
Mayor zimmerman ascertained nobody else wanted to speak in
favor or opposition.
Councilman Warnke moved that the request by Robert G. Beane
to rezone this parcel from R-3 to C-2 be approved, seconded
by Councilman Cassandra. No discussion. Motion carried
5-0.
Approve rezoning request to change the zoning classification
of the land surrounding the High Ridge Country Club from
R-1AAA single family residential to R-1AA single family
residential submitted by Fred Roth for Ralph Biernbaumo
This property is located on N. W. 7th Court extended at
Miner Road extended.
Mr. Annunziato referred to a recommendation being submitted
from the Planning Department and he noted the requirements
of R-1AA zoning. After conducting a public hearing, the

Planning & Zoning Board unanimously recommended that this
request be approved subject to the dedication and construc-
tion of Miner Road from High Ridge Road to Congress Avenue
including a bridge across the canal.
Councilman Cassandra questioned why a two grade change was
recommended and stated he is concerned about downgrading the
quality of homes. Mr. Annunziato replied the project as
proposed, density-wise, still falls under the land use
recommended in the Comprehensive Plan. Mr. Fred Roth added
that an 8,000 sq. ft. lot and 1,500 sq. ft. house is of
subStantial size. They made this request based on the
surrounding area and changes which have occurred. Even
R-1AAB is a fairly large unit on a large lot. This is basi-
callY surrounded with industrial or PUD with heavier den-
sity. They felt an exclusive type house would not be a
viable product in this area. He showed a proposed layout of
the lots and pointed out how they would wrap around the
existing golf course. He referred to preserving trees and
having park areas and advised there will be the same density
as in R-1AAA.
Mr. Roth then stated in reference to the recommendations
concerning the construction of Miner Road, he would like to
request there be consideration given to the impact which
will be on this road other than from this development. He
would like other contributions considered for the cost of
constructing Miner Road. Mr. Annunziato replied that at
this point, we are not in the position to assess any other
property owner in the area. This property almost entirely
borders Miner Road. Mr. Roth clarified that their major
concern is jumping the canal with bridges and going off
site. Mr. Vance asked if the applicant concurs and agrees
with the condition of rezoning as outlined by Mr. Annunziato
and Mr. Roth replied affirmatively, but he is asking con-
sideration for construction which will go off-site. Mr.
Vance again asked if he agreed to this condition and Mr.
Roth replied affirmatively. Mr. Vance added that he is sure
the Planning Department will take this request under advise-
ment. Mr. Roth clarified that he is not disputing it, but
because of the cost associated with it and because it
impacts other developments, he would like that considered.

Mr. Vance clarified that he is agreeing to build Miner Road
as requested and Mr. Roth agreed.
Councilman Wright questioned the price of these homes and
Mr. Roth replied there is a contract to purchase on the pro-
perty contingent on rezoning. It will probably be similar
to Sky Lake.
Councilman Warnke questioned how many homes could be allowed
under R-1AAA opposed to R-1AA and Mr. Roth showed a concep-
tual plan containing 234 lots and advised the original PUD
under R-1AAA contained 160 lots. They further discussed the
number and size of the homes.
Mayor Zimmerman asked if anyone wanted to speak in favor of
this rezoning and received no response. He asked if anyone
was opposed and received no response.
Vice Mayor Ferrell made a motion to approve this request
subject to the Planning Department's recommendation
regarding Miner Road as requested by the City Attorney.
Councilman Wright seconded the motion. Under discussion,
Councilman Warnke commented that he has trouble with
reducing the highest rating in our city from R-1AAA to R-1AA
to get an extra 150 people in this area. We are having
problems with population now. He cannot go along with
reducing that fine piece of property any lower just to get
more people in. Motion carried 4-1 with Councilman Warnke
dissenting.
At this time, Mayor Zimmerman declared a break and then
reconvened the meeting at 9:10 P. M.
DEVELOPMENT PLANS
Approve request for a variance to Ordinance No. 83-40 which
places a moratorium on new construction or building renova-
tion in the Community Redevelopment Area, as well as site
plan approval to install a satellite receiving dish on the
roof of First Financial Plaza, located at 639 E. Ocean Ave.
Mr. Annunziato stated this item came to the Council first
and a height exception was granted. After conducting a
public hearing, the Planning & Zoning Board unanimously
recommended approval. It was also approved by the Community
Appearance Board.

Mr. Bill Rawson informed the Council this particular dish is
8 ft. in a fully erected position. When in a working posi-
tion, it is less than 8 ft. off the roof. After further
explaining the installation, he advised it is 48 feet to the
top of the elevator shaft on the building and this is below
it.
Councilman Cassandra stated he was concerned about satellite
dishes two years ago and an ordinance was written covering
the installation from the ground, but he doesn't believe it
covers satellites on roofs. He believes that should be con-
sidered.
Councilman Wright moved adoption of this request, seconded
by Vice Mayor Ferrell. Motion carried 4-1 with Mr. Warnke
dissenting.
Approve request to construct a two story office building of
approximately 12,000 sq. ft. plus parking lot renovations at
the Boynton Plaza located at 111 N. Congress Avenue. This
request was submitted by Herbert C. Gibson for Nicholas
Athans.

Approve request to approve the modification of Forum
Shoppes, office building, consistent with the height excep-
tion approved by the City Council. This request was sub-
mitted by Siteworks, Inc. for Claude B. Gagne and is to be

Mr. Annunziato referred to the height exception being
granted by the City Council and advised this comes now with
a positive recommendation from the Planning & Zoning Board,
the planning staff and Community Appearance Board with no
comments. Councilman Cassandra questioned the height excep-
tion and Mayor Zimmerman informed him it was 4 ft. for an
elevator.

Boynton Beach Promenade as well as to change site lighting,
to be located at Old Boynton Road and N. Congress Avenue.
This request was submitted by Peabody and Childs for Edward
J. DeBartolo Corporation.
Mr. Annunziato informed the Council the applicant has deter-
mined the need to adjust the loading dock and lighting on
this site. It was reviewed by the Planning & Zoning Board
and recommended unanimously with no comments.
Councilman Warnke moved to approve this request to modify
the loading dock on Building D at Boynton Beach Promenade as
well as to change the site lighting. Vice Mayor Ferrell
seconded the motion and it carried 5-0.
Approve request to construct optional screened porches on
apartments at Golfview Harbour Estates, which has previous
site plan approval. Golfview Harbour Estates is located on
Congress Avenue at S.W. 25th Place, and this request was
submitted by Norman Michaels for the Milnor Corporation.
Mr. Annunziato explained this concerns only the construction
of screened porches and advised the staff reviewed and
recommended approval as submitted. The Planning & Zoning
Board and Community Appearance Board both unanimously
approved.
Councilman Cassandra moved t'o approve the recommendation of
the Planning & Zoning Board for approval of the Golfview
Harbour Estates screened porches. Councilman Wright
seconded the motion. No discussion. Motion carried 5-0.
Approve request to reconstruct boat launching facilities,
rest rooms, picnic shelters and parking at the Boynton Beach
Boat Club Park on North U.S. 1 and N.E. 21st Avenue. This
request was submitted by Edward D. Stone, Jr. & Associates
for the City of Boynton Beach.
Mr. Annunziato showed the site plan and enumerated the
improvements planned. This request was reviewed by the

Councilman Cassandra referred to being concerned with having
that motel and bar in front of this beautiful park and asked
if anything had progressed in that area and Mr. Frederick
replied that the capital improvements plan includes a figure
for the purchase of the property in front.
Councilman Warnke moved that the request to reconstruct the
boat launching facilities, rest rooms, picnic shelters and
parking at Boat Club Park be approved subject to staff com-
ments. Vice Mayor Ferrell seconded the motion. No
discussion. Motion carried 5-0.
Approve request to construct a one story industrial building
to be known as the Rouse Building for testing laboratories
and administrative offices on a 72,056 square foot site on
Neptune Drive at Thor Drive. This request was submitted by
Frank Snedaker for Jack Rouse.
Mr. Annunziato explained the function of the business and
showed the location of the site. He advised the Technical
Review Board forwarded recommendations to the Planning &
Zoning Board and the Planning & Zoning Board recommended
approval subject to comments. It was also reviewed and
approved by the Community Appearance Board.
Mr. Richard Otto told about their present business in
Pompano Beach of primarily testing soil for new construction
and stated they are looking forward to relocating to Boynton
Beach. Mayor zimmerman asked if he was aware of the staff
comments and Mr. Otto replied affirmatively. Councilman
Wright asked how many jobs would be created and Mr. Otto
explained that they would be relocating from Pompano Beach,
but are looking at expanding.
Councilman Cassandra referred to the stipulation by the City
Engineer regarding drain fields and asked if this implied
certain toxic type material would be going into the sewer
and Mr. Annunziato replied those issues were addressed and
he thinks tgat recommendation had to do with on-site reten-
tion facilities. He added that the Technical Review Board
was concerned with fleet maintenance on site and this was
rectified in the environmental review procedure with the
applicant constructing the proper drains to empty into a
tank. There were also comments regarding the storage of
fuel and bulk storage of waste materials. Councilman

Cassandra clarified that they will have a tank with spill-
over into sewage and Mr. Annunziato agreed as that is common

ject to staff comments, seconded by Vice Mayor Ferrell. No
discussion. Motion carried 5-0.
Approve request to construct CATV facilities consistent with
the approved master plan modification for Boynton Lakes PUD
at LWDD E-4 Canal at LWDD Canal 20. This request was sub-
mitted by James Holland for Lennar Homes, Inc.
Mr. Annunziato informed the Council the 60 ft. free standing
antenna was approved by the City Council. This went to the
Planning & Zoning Board after review by the Technical Review
Board. The Technical Review Board included several staff
comments and the Planning & Zoning Board recommended appro-
val subject to staff comments. The Community Appearance
Board reviewed and approved. He understands the Community
Appearance Board noted landscaping recommendations on the
plan and these will be noted by the Building Department.
Councilman Cassandra questioned why 60 ft. was required for
the antenna and Mr. James Holland explained the extra height
was needed to pickup the Miami Channel 6. Councilman
Cassandra asked if a field measurement test was done and Mr.
Holland replied affirmatively. Councilman Warnke stated
when Channel 6 separated from Channel 33, they indicated
they were going to increase their signal strength. Mr.
Holland agreed they were still supposed to do that and also
increase their tower height. Mayor Zimmerman clarified that
the height is not an issue tonight. Councilman Cassandra
stated that he didn't feel 60 ft. is warranted.
Vice Mayor Ferrell moved to approve this request with the
staff comments, seconded by Councilman Wright. Under
discussion, Mayor Zimmerman asked if they understood the
staff comments and are willing to comply and Mr. Holland
replied affirmatively. Motion carried 3-2 with Councilman

Approve request for preliminary plat approval of Boynton
Lakes PUD Plat 4 located north of LWDD 19, east of Congress
Avenue. This request provides for infrastructure improve-
ments related to the construction of 167 single family
detached, zero lot line homes on 54.7 acres plus the dedica-
tion of a 7 acre park for public purposes, consistent with
a previously aDproved master plan modification.
Mr. Annunziato explained the highlights of the plat and
pointed out access to the site. Councilman Wright
questioned the price of the homes and Mr. Holland informed
him they would be in the $60,000 to $70,000 range. Mayor
Zimmerman asked if he was acquainted with the staff comments
and is willing to comply and Mr. Holland replied affir-
matively.
Vice Mayor Ferrell made a motion to approve this request
subject to comments, seconded by Councilman Warnke. No
discussion. Motion carried 5-0.
Consider Annexation Request and forward to Planning & Zoning
Board - United States Postal Facility
Mr. Annunziato explained the location. Vice Mayor Ferrell
moved to forward this to the Planning & Zoning Board,
seconded by Councilman Cassandra. Under discussion,
Councilman Warnke commented that he could not see the advan-
tage as it is non-taxable. Mayor Zimmerman asked if a
pocket would still remain and Mr. Annunziato replied affir-
matively. Mayor Zimmerman questioned what happens to the
sewer and water rates when property is annexed and Mr.
Sullivan replied they would not be affected and the standard
city rate would be utilized. He added that with this being
the Boynton Beach Regional Post Office, it would make more
sense to be located in the city. Councilman Warnke referred
to the old post office remaining and Mayor Zimmerman agreed
that it would remain as a sub-station. Mr. Annunziato added
that 19 routes east of 1-95 would be operated out of the
present facility. Motion carried 5-0.
Consider Annexation Request and forward to Planning & Zoning
Board - Lakes of Hypoluxo
Mayor Zimmerman stated this is an 18 acre parcel in the
northwest corner of town. Mr. Annunziato added that city
property is adjacent to.the east and south. This is a true
county pocket and annexation would begin to close that

pocket. The recommendation is this be forwarded to the
Planning & Zoning Board for public hearings and
recommendation.
Vice Mayor Ferrell made a motion to forward this to the
Planning & Zoning Board, seconded by Councilman Wright.
Under discussion, Councilman Warnke referred to there being
no indication at this time of what kind of homes will be
built and stated there will be an impact on our water
system. Mr. Annunziato informed him the request is for zero
lot line, single family development and he believes the den-
sity proposed is four units per acre. The density is nego-
tiable subject to our review. As far as utilities, we would
be obligated to serve them water whether they are in the
city or not.
Councilman Warnke stated this is a case where the developer
wants to buy land and doesn't want to go through with the
sale unless annexed. The people voted not to have more
annexation. Vice Mayor Ferrell disagreed as the exception
was to square off the boundaries, which this will do.
Councilman Warnke referred to this creating a pocket and
Vice Mayor Ferrell disagreed and stated the present pocket
will become smaller.
There was further discussion about whether this was
favorable for annexation and Mr. Annunziato stated it is
difficult to not consider annexation which closes the
pockets. We are serving these areas now on Hypoluxo and
Lawrence Roads. If this property is not annexed, they will
go to the County Commission and we will be obligated to
serve them utilities. There could possibly be a higher den-
sity allowed by the county.
Mr. Annunziato stated he thinks the Council has to take the
step of considering annexation as ruled according to the
former Asst. City Attorney. Mayor Zimmerman questioned if the
Council had the right to turn this down and Mr. Annunziato
replied they could after going through the review process.
Mr. Vance clarified there are some requirements in the
Florida Statutes relating to annexation when there is a
voluntary application. In his opinion, the Council has to
consider the application.
Vice Mayor Ferrell referred to squaring off the boundaries
and explained how it would be simpler for the city depart-
ments.

Mr. Annunziato advised that he has done a map analysis of
the city's boundaries with it going to the west side of

Closing of Landfill
Mr. Sullivan referred to this being a comprehensive
agreement and explained how each section was separate with a
maximum price. He added that this meets all regulations
pertaining to closure of the landfill.
Mayor Zimmerman stated that we do have the option to turn
this down and select another on the list. Mr. Sullivan
referred to the Council approving this particular firm and
advised that it has taken quite a lot of time to resolve
this particular contract. If they are not happy with this
contract, they can start over. However, this must be
resolved because the landfill is a problem.

Councilman Warnke referred to Page B-ii under Task 7 and
pointed out that it states to confirm completion of
construction in substantial compliance and questioned if
that should be complete compliance. Mr. Vance replied nega-
tively and added this is reasonably standard and in the
field conditions may have some modifications.
Councilman Warnke referred to Page C-1 and asked if
Professional Associates referred to in paragraph B is a
separate company and Mr. Vance replied that he believes that
is a standard term. Councilman Warnke referred to this same
paragraph noting a charge of 15% and questioned if that was
subject to negotiation if some could be done in-house. Mr.
Vance replied that he didn't believe we had this capability
in-house.
Councilman Warnke referred to Page C-2 and stated the
invoicing procedure locks us in pretty tight on payment of
bills. In case an invoice has a valid dispute, we would
have to pay it and argue about it later. If there is a
valid dispute, couldn't we suspend the 14% penalty? Mr.
Vance agreed this could be discussed.
Councilman Wright asked who reviewed this contract and Mr.
Vance replied that it was basically negotiated by the City
Manager and his office reviewed the contract. Councilman
Wright commented that these terms and conditions are accep-
table and he thinks we should move on.
A representative from Post, Buckley, Schuh & Jernigan, Inc.
came forward and stated they will renegotiate that last
phase of the contract and include a clause about payment of
the bill if that is acceptable to the City Council.
Councilman Cassandra so moved, seconded by Councilman
Warnke. No discussion. Motion carried 5-0.
Proposed Ordinance Re: Firemen's Relief & Pension Trust Fund
Vice Mayor Ferrell stated he understands in pension plans
that 2~% per year is accrued, but they will lose 5% each
year if retiring early. Mr. Vance advised this ordinance
was recommended by the Firemen's Pension Board. Mr. Edward
Allen came forward and explained this is a penalty for
early retirement.

Councilman Warnke moved to take this from the table,
seconded by COuncilman Wright. Motion carried 5-0.
Councilman Warnke stated he proposed this originally to
increase the compensation for the Mayor and Council by $100
per month. It would take a charter amendment through the
referendum process. He would like Council's feeling about
this suggestion.
Councilman Cassandra replied that he is not in favor of a
referendum and the salaries have been increased without a
referendum. Mr. Vance read Section 55 of the Charter
applying to this. Councilman Cassandra referred to the cost
to have a referendum election.
Councilman Wright suggested that the staff do a comparable
study with other municipalities abOut the same size.
Councilman Warnke moved to direct the City Manager to have
the proper city department give us a study of other cities
in Palm Beach County in relation to compensation, popula-
tion, and ratio. Vice Mayor Ferrell seconded and the motion
carried 5-0.
