Minutes 08-21-84MINUTES OF THE REGULAR CITY COUNCIL MEETING HELD AT CITY HALL, BOYNTON BEACH, FLORIDA, AUGUST 21, 1984 PRESENT Carl Zimmerman, Mayor Nick Cassandra, Councilman James R. Warnke, Councilman Samuel L. Wright, Councilman Peter L. Cheney, City Manager Betty S. Boroni, City Clerk William Doney, Asst. City Attorney Mayor Zimmerman called the meeting to order at 7:35 P. M. He announced ~the invocation will be given by Rev. Nathaniel Sandy, Church of God Universal, and for everyone to please remain standing for the Pledge of Allegiance to the Flag led by Councilman Nick Cassandra. AGENDA APPROVAL Councilman Warnke stated he has an addition under Old Business - Political Signs. Councilman Cassandra stated he would like to add an item just in front of Development Plans, so we do not interact with the applicants' requests. It is three part, but should not take more than five minutes. Mr. Cheney referred to distributing information in reference to bids for emergency sewer repairs and stated he would like this added under Bids. He would also like to add under Legal - Other - Approval of Amended Agreement with the County for the Community Development Plan in regards to Cherry Hill. Under the Consent Agenda, he has the addition of three bills: one for our share for the design and expan- sion of the sewer plant in the amount of $29,020.16; two bills relative to the Community Redevelopment Agency, which he would like to discuss at another meeting regarding how to handle, one from Haygood & Williams in the amount of $2,462.75 and one from Urban Design in the amount of $5,068.55. Councilman Cassandra moved to adopt the agenda with the additions and changes, seconded by Councilman Wright. No discussion. Motion carried 4-0. ANNOUNCEMENTS Presentation of Certificate of Appreciation to Willie Garvin for saving the life of a 20 month old child Mayor Zimmerman presented a certificate to Mr. Willie Garvin in appreciation for serving the City of Boynton Beach. He added that he is sure many people have a good understanding - 1 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA AUGUST 21, 1984 of what Mr. Garvin did in saving this child's life and of his work with the boy scouts. He expressed pride in having him as a citizen of our city. A Boy Scout Leader stated he was also proud to be associated with Mr. Garvin and proud to have him as part of their Boy Scout Council. Mr. Garvin stated that he wants to accept this appreciation in full faith, but he doesn't deserve this. He explained that people and his parents are the ones who deserve this and have made him what he is. He told about working with all the kids in the community toward improvement for everyone's benefit. He requested the support of adults to work with him and the kids to make the job a lot easier for the local law enforcement officers. Councilman Cassandra read the opening paragraph from the newspaper article commending Mr. Garvin. City Hall Holiday Mayor Zimmerman announced that Boynton Beach City Hall will be closed on Monday, September 3, 1984, in observance of Labor Day. Budget Public Hearings Mayor Zimmerman announced the Budget Public Hearings will be held on Thursday, September 6, and Monday, September 24, at 7:30 P. M. in the City Council Chambers. These two meetings will be open to the public for their opportunity to speak concerning their thoughts about our proposed budget for next year. City Council Meeting Dates Councilman Warnke referred to the next Council meeting being scheduled on Election Day and Mr. Cheney announced the next City Council meeting will be on Wedensday, September 5, in accordance with the charter. This same thing will also apply in November and in October, if there is a runoff. - 2 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA AUGUST 21, 1984 MINUTES Regular City Council Meeting Minutes of August 7, 1984 Councilman Cassandra referred to Page 1 under Agenda Approval and stated he believes Councilman Warnke's state- ment was his request was "premature" instead of immature. Councilman Warnke moved to accept the minutes with this correction, seconded by Councilman Wright. Motion carried 4-0. Special City Council Meeting Minutes of August 13, 1984 Councilman Cassandra moved to accept the minutes as pre- sented, seconded by Councilman Warnke. Motion carried 3-0 with Councilman Wright abstaining. CITY MANAGER'S REPORT Population Estimate Mr. Cheney announced we have received this week the state's initial estimate of population for the city as of April 1, 1984. That figure as indicated by the University of Florida is 39,187. He explained that we always have a different figure because we work on a different base than the system developed statewide by the University of Florida. The 1980 census figure was 35,624. Beach Decals Mr. Cheney announced in the month of September, we will begin to sell beach decals for the coming year and depending on the Council's action tonight, the price will be $3 or $5. This year the decal will go on the driver's side and not on the passenger's side because the beach attendant will now be on the driver's side. Golf Course Permits Mr. Cheney reported that those people adding onto their golf permit for the last months in the fiscal year 1984/85 must do it before the end of September. Otherwise, he will pro- pose the annual fee be increased to $550. Consultants' Studies Mr. Cheney informed the Council he had hoped to have the consultant's contract for the landfill closure study and the water osmosis study, but he will have them at the next meeting to proceed with those projects. - 3 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA AUGUST 21, 1984 Budget Mr. Cheney reported the golf course budget is being fina- lized for the Council's review. The utility budget is also being finalized, which will not have a rate increase pro- posed. He explained that major savings were realized with the debt refunding. The recommendations are being finalized on the operating budget. Mr. Cheney continued that one of the things Councilman Cassandra suggested was taking a look at increasing the building permit fees. We looked at the whole way of charging for building permit fees and plan to submit a revised system at a flat dollar per thousand. There will also be one fee proposed for new construction instead of the individual permit fees. He thinks this will be easier for developers, builders, homeowners and administration. Bike Paths on S.E. 23rd Avenue Mayor zimmerman referred to asking about bike paths on S.E. 23rd Avenue and Mr. Cheney informed him we are in the pro- cess of working out with the county some drainage improve- ments on 23rd Avenue and it will be reviewed to see how sidewalks will fit into it. CONSENT AGENDA A. Bids 16" Wafer Type Butterfly Valve or Equal - Utilities The Tabulation Committee recommends awarding the bid to the low bidder, Water Resources Corp., in the amount of $2,310 each or total amount for four of $9,240. Accept proposal to remove trees adjacent to beach The Recreation & Parks Director recommends Schmidt Tree Company to perform this service based on their record of past experience with the Town of Ocean Ridge. Mayor zimmerman asked if we have funds available and Mr. Cheney replied affirmatively and explained how we agreed to cooperate in this matter with Ocean Ridge. Councilman Warnke added that he checked with two other tree services and was told they really don't want to enter a contract at all for Australian Pines and we were lucky to get this figure. K. Councilman Wright moved adoption of the Consent Agenda with the additional bills presented, seconded by Councilman Warnke. No discussion. Motion carried 4-0. - 6 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA AUGUST 21, 1984 BIDS Emergency Sewer Repairs Mr. Cheney stated on several occasions during the past few years, we continue to have sudden sanitary sewer problems develop in the northeast section of the city because of age, lack of original care, etc. This is another one which has begun to sink because the pipe is falling apart. It will become a health problem. We have received three bids and he recommends solving the problem quickly. He recommends the agreement with Johnson & Davis be authorized in the amount of $19,400 to solve this sewer problem. Councilman Warnke moved approval of that proposal, seconded by Councilman Cassandra. No discussion. Motion carried 4-0. PUBLIC AUDIENCE Mayor Zimmerman announced if anyone wants to speak on any development plans or any other items not scheduled for public hearings to give their name to the City Clerk and they will be allowed to speak at that time. Widening of Seacrest Boulevard Mrs. Henrietta Solomon, 230 N.E. 26th Avenue, referred to there being a design to have a median and explained that she did not think a median would be desirable because Seacrest Boulevard should be the same as in South Boynton plus trash accumulates in medians. Mayor zimmerman informed her these plans have been changed several times and he thinks they are working on a revised set now. Mr. Cheney advised that in discussions of Seacrest Boulevard, this Council with former Councilman Joe deLong's leadership asked for a median in Seacrest Boulevard because of the aesthetic value. The county engineering staff attempted to do that at the request of the city. He was convinced it was not possible to have a median because of limited right-of-way. As far as he knows, the plans do not include a median. He told about plans to have a wide grassed area along the sides of the street which will be landscaped and planted. Mrs. Solomon referred to being concerned about the construc- tion money and Mayor Zimmerman informed her this is included in the M.P.O. long range plan. Mrs. Solomon questioned if - 7 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA AUGUST 21, 1984 this construction money could come out of a different county budget other than M.P.O. and Mayor Zimmerman replied that county road money comes from county funds and the M.P.O. makes recommendations. The funds are thin now, but maybe gas tax money will come in so something can be done. He suggested that possibly she could attend the M.P.O. meeting which will be held on September 6 at 9:30 A.M. on the seventh floor of the county complex. Mrs. Solomon stated on September 5, there will be a county budget hearing at Twin Lakes High School and she requests the Council to send another resolution asking them to include construction money in the upcoming budget. She will gladly hand deliver this resolution. Councilman Wright moved to have the City Manager send another reminder with copies of the resolution that we would like monies in this next budget for Seacrest Boulevard. Councilman Cassandra seconded the motion. Under discussion, Mr. Cassandra commented that it could be a letter to advise the county we would like to have this done. Motion carried 4-0. Mr. Cassandra added that it might be advantageous for Mr. Cheney to attach past resolutions showing we do have interest. Appointment of Police Chief Mrs. Wilda Searcy, 402 N.E. 13th Avenue, asked if a Chief of pOlice had been appointed yet and Mr. Cheney replied negati- vely and explained that he was directed by the City Council at the last meeting to move forward in the direction of appointing within the department and until he makes a recom- mendation, it is a dead issue. Mrs. Searcy asked if she could be advised about this and Mayor Zimmerman explained the appointment would be recom- mended by the City Manager and the Council would be asked to approve. Mrs. Searcy stated she thinks the community people should have something to say about who is appointed Chief of Police as there have been problems with minority groups. Mayor zimmerman stated this would be up to the City Manager and she may contact him. Personnel Policy Mrs. Searcy stated she would like to know why affirmative action has not been done with department heads in Boynton - 8 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA AUGUST 21, 1984 Beach. Councilman Wright agreed that no blacks are shown in these positions and he has asked consideration be given in chief department heads. He would say the problem lies the black community. He doesn't feel the black community has pushed enough and stressed the point about hiring black professionals in the City of Boynton Beach. Councilman Cassandra referred to the city following an affirmative action program and Councilman Wright stated that it is not an active one. Mrs. Searcy remarked there are quite a few negative things going on in Boynton Beach. Mr. Sullivan advised that we do have an affirmative program and reports are submitted. Councilman Wright suggested asking the City Manager to give a report. Councilman Warnke referred to applications not specifying the race and Mr. Sullivan agreed this was correct. Mr. Sullivan explained that with in-house promotions, everything is posted and anyone employed in the city can apply. Mr. Cheney added that we are open in our employment practices and have tried to find black policemen. Mr. Sullivan added that notices are sent to black colleges, schools, employment offices, minority newspapers, black ministers, etc. An open exam is given the first Thursday of every month. Mr. Cheney added there has been concern with having both women and blacks in upper level positions, but the turnover is not that great. Also, a problem with trained black pro- fessionals is they tend to go to the larger cities for higher salaries. The opportunity is there when openings occur. Request for Gymnasium and Multiple Center Mr. Louis Skinner, 437 N. E. 16th Avenue, submitted a letter dated August 13, 1984, on behalf of the Boynton Beach Concerned Citizens Voters League requesting that the pro- perty located on North Seacrest Blvd. between 17th and 19th Avenues be considered for a proposed gymnasium and multiple center. Mayor zimmerman questioned how this could be financed and Mr. Skinner replied that they are requesting funds from Community Development and the city does have some revenue funds coming in. Councilman Wright stated the City Manager is aware of this concern and suggested that Mr. Cheney address this and sub- - 9 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA AUGUST 21, 1984 mit a report. Mr. Cheney advised this will be part of the capital improvement program. Mayor Zimmerman asked if any school gymnasium could be used in the interim and Councilman Wright replied negatively as people are rough on facilities like that. Mr. Cheney added that Congress Middle School is available. Community Concert Program Mr. Rod Elkins, Manager of the Greater Palm Beach Symphony, told about expanding their regional orchestra in Palm Beach County. He would like to know how they can serve this city. Mr. Elkins then introduced their Conductor, Mr. David Gray. Mr. Gray questioned what kind of concerts the people in the city would like to hear. Councilman Warnke stated he would like this group to come as a Boston Pops type concert at the fireworks program. Councilman Wright added they would be welcome at any time in our community. Mr. Cheney referred to having a community concert program and stated it has shown from the response that the community is interested in good music. He told about the G.A.L.A. having a v~riety of musical groups. He will ask the Recreation~Department to contact these gentlemen to see what can be worked out. PUBLIC HEARING NONE DEVELOPMENT PLANS Development Plan Procedure Councilman Cassandra stated he reviewed the site plan appro- val procedure and some doubt was created in his mind and he talked to the City Attorney. He read from Section 19-17 of the code and stated if the applicant is not in compliance with any paragraph, they should be told and the procedure stopped. If a variance is required, then that procedure should be followed. Mr. Cassandra stated that a height variance request goes to the City Council. He read the procedure according to the - 10 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA AUGUST 21, 1984 referendum approved by the people. The procedure now is for it to go to the Planning & Zoning Board and then come to the City Council. The city code clearly spells out the proce- dure when there is a height variance required. Nowhere does it ask the Planning & Zoning Board to evaluate height variance requests. He recommends that the procedure in the code be followed with the requests coming first to the City Council. Mr. Doney agreed with this interpretation, but added that he thinks the Planning & Zoning Board could take a proposed site plan that may have a building exceeding the height limitation and approve subject to Council approval with no recommendation. However, according to the code, the first consideration of any height exception should be by the City Council. Probably the Planning & Zoning Board should not make a recommendation whether a variance should be given for height. Mr. Cheney clarified that Councilman Cassandra is saying the City Council would prefer to address the height first without interference or recommendation from another body. The assumption had been the City Council would want advice on these issues from staff and the Planning & Zoning Board. He explained if air conditioning equipment was not going to be allowed on a roof, it would have to be accommodated elsewhere and the loss of office space would have an impact on parking and general site use. Councilman Wright stated he thinks it should stay the way it is. Councilman Warnke agreed and stated if somebody comes in with a site plan and there is some question about going above 45 feet, it should be up to the City Council to decide whether it is necessary for the use of the building and if it is going to be used as habitable then should not even be considered by the Council. Mr. Cheney stated the code is clear that it has to be non-habitable. Councilman Cassandra continued that it would not slow the process. The City Planner gets the first preview and knows if something is in compliance. The code should be followed which says the City Council is the only body which can decide a height variance and on the direction of the City Council, the Planning & Zoning Board reviews it. He referred to applicants getting the wrong impression with approval from boards and having to attend meetings unne- cessarily. - 11 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA AUGUST 21, 1984 Councilman Wright stated that we have the boards to receive input from them and the Planning & Zoning Board studies these things. Councilman Cassandra clarified that he is not disagreeing, but there are two alternatives. If we are going to go by the code, let's follow it. If we want to change the proce- dure, then change the code. After further discussion, Mr. Cheney stated the code will be followed. Councilman Cassandra then referred to Section 19-27 which states that if an applicant has not submitted a plan and obtained a permit within a year, all previous approvals are null and void. Mr. Doney agreed that a permit must be pulled and construction begun within one year. Councilman Cassandra stated the Community Appearance Board had twelve items last night, of which three did not have to go through the board. He thinks there should be a policy decision saying that which has not been changed does not have to go through the boards and with certain modifica- tions, certain boards would not have to be involved. Mr. Cheney informed him that according to the ordinance, modified plans must go to the Community Appearance Board and they not only cover landscaping. He agreed maybe some admi- nistrative leeway could be.given, but we have been reacting to a time when all things did not go through the boards and that was brought to our attention. At this time, Mayor Zimmerman recognized the presence in the audience of ex-Mayor Betty Riscoe. Approve request to construct a covered porch as an addition to a previously approved rectory in the Community Redevelopment Area, wherein there is a moratorium on construction or building renovation. This request for a variance and site plan approval was submitted by Richard SanGiovanni for Edward A. McCarthy and the proposed construction is to St. Mark's Catholic Church located on 615 N.E. 4th Avenue Mr. Annunziato informed the Council this is an addition of a covered porch to a previously approved building. After con- ducting a public hearing, the Planning & Zoning Board for- warded Resolution No. 84-6 recommending approval of this variance. The Community Appearance Board also approved. Councilman Warnke moved to approve this request for the addition of a covered porch, seconded by Councilman Wright. No discussion. Motion carried 4-0. - 12- REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA AUGUST 21, 1984 Approve request to alter the facade and provide landscaping in the parking lot of the Town Tavern Restaurant located at 512 N. Federal Highway in the Community Redevelopment Area wherein there is a moratorium on construction or building renovation. This request for a moratorium variance and site plan approval was submitted by George Davis for Town Tavern Mr. Annunziato informed the Council the applicant is requesting to modify the facade and install landscaping. He showed the plan. Also, the use will be changed from a lounge to a restaurant. This comes with a positive recom- mendation from the Planning & Zoning Board subject to staff comments. The parking is inadequate, but it is a grand- fathered situation. The Planning & Zoning Board forwarded Resolution No. 84-7 recommending approval and approval was also given by the Community Appearance Board. Councilman Cassandra referred to a variance for the parking and Mr. Annunziato informed him this is a grandfather situation. Mr. Cassandra referred to signage and landscaping and asked if this would meet the C.B.D. require- ments and Mr. Annunziato replied that the applicant is not present, but has expressed willingness to comply. Mr. Cassandra referred to there being a Pete's Attic sign on the top of the building which was non-conforming and asked if this would be replaced. Mr. Annunziato informed him when a non-conforming structure is removed, it cannot be replaced. Councilman Warnke asked if a building permit was issued on this and Mr. Annunziato replied for interior renovation. Mr. Warnke referred to the exterior being worked on now and Mr. Cheney explained that they have probably gone ahead on a risk. Councilman Wright moved to approve this request from Town Tavern subject to staff comments, seconded by Councilman Warnke. No discussion. Motion carried 4-0. Approve request to construct a skylight, 25 feet high, with a maximum height of 60 feet above grade on Burdines at Boynton Beach Mall, 801 N. Congress Avenue. This site plan modification was submitted by Mike Greer and Charles O'Brien for Burdines Mr. Annunziato informed the Council this is a request to construct a skylight 25 feet high on top of the proposed building requesting a height exception of 15 feet. The - 13 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA AUGUST 21, 1984 Planning & Zoning Board reviewed the site plan with the recommendation to approve as submitted. It was also approved by the Community Appearance Board. If the Council approves this height exception and modified site plan, they must make findings in compliance with Section 4F of the code. Mr. Harold Robinson, Vice President of Store Planning with Burdines, and Mr. Scott Braley, Architect, came before the Council. Mr. Braley explained the skylight has a maximum height of 25 feet and the building is 34 feet for a total height of 59 feet. This is more in line with mechanical appurtenances. He then showed a sketch of this revised lower height. He explained a diagram pointing out the sky- light would only be visible from a distance approximately 500 feet away. Mr. Braley advised the reason for this dome is this is the prime retail area of the store and explained. There will also be plants in this area and it is necessary to have natural light for plants to grow. He explained how cosme- tics and merchandise in this area would be featured by the natural light. Mr. Robinson added that lighting would also not be needed in this area during the day resulting in energy savings. Mr. Braley further explained how a low skylight would trap the heat and this height would require less air conditioning. Also, heat buildup would affect the landscaping in this area. The dome will be ventilated to enhance air movement. Mr. Braley then explained the structural elements. stressed this area contained no habitable space. Mr. Braley read paragraphs a) thru i) from Section 4-F and gave considerations applying to each. Mr. Braley concluded that they believe they have presented sufficient evidence for this variance to be granted and both the Planning & Zoning Board and Community Appearance Board recommended approval. Mr. Ralph Marchese, 1901 Roma Way, referred to the height limitation going before the people and being set at 45 feet and stated with the proper engineering, this height excep- tion is not necessary. He stressed the limit of 45 feet being the wishes of the people with no exceptions. With regard to air conditioning units or elevator over-runs, a specific height should be addressed to be ample. - 14 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA AUGUST 21, 1984 After discussion, Councilman Warnke questioned if this could be constructed in a different way with proper engineering to a height of 6 feet and Mr. Braley replied that a dome 6 feet high could be constructed structurally, but there would be heat buildup and he explained the consequences. Councilman Cassandra clarified that according to the calcu- lated heat dissipation, this would be about an 8 to 5 degree difference on the upper limit. He questioned the height of the first step. Mr. Braley replied it is approximately half of the overall dome, which would be 15 feet. Councilman Wright asked if other plans to exceed 59 feet have been approved for the mall and Mr. Cheney replied one building at the mall is 65 feet. Councilman Cassandra questioned whether this 1982 approval would apply since they have not obtained a permit. Mr. Cheney replied affir- matively since it was part of the annexation agreement with the rezoning assigned by the city as a permanent condition. Councilman Cassandra stated that he has a questionable doubt this is still a legal document. He requests the City Attorney to review this agreement and minutes. He will honor the previous Council's decision as long as the lega- lity is verified. Councilman Cassandra then read from the referendum voted on by the people adopting the 45 feet height limit and questioned whether there was any conflict with the referen- dum and ordinance. He would like to know what the defini- tion for similar structures means. Councilman Wright replied that this gives flexibility. Mr. Doney informed him the ballot line must be limited to a certain number of words and the whole ordinance could not be written. It is clear the ordinance which was approved by the City Council with that language contained all the provisions. Mr. Cassandra stated his concern is mechanical structure and what that is and he thinks that should be clarified. Mr. Robinson clarified that Burdines is not a four story building, but will be a two story building, and 10 feet under the height limit for the whole building. The dome is allowed under the current code in the middle of the building and cannot be seen from the parking lot. It is a mechanical structure. They feel they have met all the requirements under the current code and that is why they are asking for approval. Mayor Zimmerman asked if all the code requirements have been met and Mr. Doney replied that is the Council's decision and - 15 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA AUGUST 21, 1984 they must look at the criteria in subsection 3 and whether they have met those. Councilman Wright moved to approve this request with the stipulations included and the 25 feet skylight and maximum height of 60 feet above grade for Burdines. Mayor Zimmerman ascertained there was no second for this motion. Councilman Warnke moved that the request to construct a 25 feet high skylight for Burdines be denied, seconded by Councilman Cassandra. Under discussion, Mayor Zimmerman stated the building was previously approved with the excep- tion of the dome or skylight. Councilman Wright stated we asked them to lower it and they did. Mayor Zimmerman clarified the only thing being considered is this 25 feet height exception; the building itself is below 45 feet. Councilman Cassandra added that he understood the argument from the first presentation to the secolnd presentation was to show the skylight was functional with energy savings, necessary for the cosmetic area, etc. and they feel it should be 15 feet. Councilman Warnke clarified that his motion was to deny the request as presented. It is not our position to say what they should do. 49 feet may be acceptable. Councilman Wright suggested possibly tabling, so they could bring back another recommendation. Councilman Cassandra stated he would lean towards 49 feet because there is need for the first step. We do approve elevator shafts up to 10 feet. Councilman Wright moved to table. Mayor Zimmerman ascer- tained there was no second to this motion. This request was submitted by Alan Strassler for First American Bank and Trust Mr. Annunziato informed the Council this request was reviewed by the Technical Review Board and went to the Planning & Zoning Board with a positive recommendation sub- ject to staff comments. The Planning & Zoning Board recom- mended approval with staff comments and the Community Appearance Board approved. Councilman Warnke moved that this modification to the parking lot be approved subject to staff comments, seconded by Councilman Cassandra. Motion carried 3-0. Approve request to construct an addition of truck loading bays to Building A of the Boynton Beach Distribution Center located on the east side of High Ridge Road right-of-way. This request was submitted by Boynton Beach Distribution Associates, a Florida General Partnership. Mr. Annunziato informed the Council this is a request to change the configuration of the truck loading bays. The Planning & Zoning Board recommended approval of this request as submitted. It was also approved by the Community Appearance Board. Councilman Cassandra moved to approve this request for addi- tional truck loading bays to Building A of the Boynton Beach Distribution Center with no staff comments. Approve request to construct optional screened rooms and screened porches to single family units known as Cedarwood Villas, Phase II. The modification to this site plan was submitted by A. Mr. Annunziato informed the Council this request went to the Planning & Zoning Board with a positive recommendation. - 17 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA AUGUST 21, 1984 Both the Planning & Zoning Board and Community Appearance Board recommend approval. Councilman Warnke moved to approve this request for Cedarwood Villas, Phase II. Councilman Wright seconded the motion. Under discussion, Councilman Cassandra asked if all setbacks were satisfied and Mr. Annunziato replied affir- matively. Motion carried 4-0. Approve request for a height exception of 15 feet to accom- modate mechanical equipment for Boynton Commercenter at 1600 Corporate Drive, submitted by Fred J. Popper for Boynton Commercenter, Inco Mr. Annunziato corrected that this height exception should be 9 feet and not 15 feet for the mechanical equipment. It was reviewed by the Technical Review Board and the Planning & Zoning Board and approval recommended. The Community Appearance Board also approved. If the Council decides to approve, they must make findings in accordance with Section 4-F of the zoning code. Councilman Cassandra asked if this was requested for air conditioning equipment and Mr. Fred J. Popper replied affir- matively with it being a cooling tower for the air con- ditioning system. Councilman Cassandra clarified the original building is 45 feet and this is an additional 9 feet in the center of the building and Mr. Popper agreed. Councilman Warnke remarked that it could hardly be seen from the ground. Mr. Cassandra asked if water cooling makes it more efficient and Mr. Popper replied affirmatively and explained that it is a heat pump system and they investi- gated others, but additional height would be required. Councilman Warnke moved to approve this request for the height exception for the Boynton Commercenter, seconded by Councilman Cassandra. Under discussion, Mr. Cheney referred to the Council's finding to justify this variance and Mr. Annunziato suggested finding there would be no adverse impacts. Mr. Warnke included this in the motion and Mr. Cassandra agreed. Motion carried 4-0. Approve request to construct Pylon Interstate which consists of two office buildings, each two stories high totaling 58,000 square feet plus landscaping and ancillary parking on a 2.86 acre site located on the southwest corner of 1-95 and Woolbright Road. This site plan was submitted by Leon Noble for Pylon-Boynton Joint Venture. - 18 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA AUGUST 21, 1984 Mr. Annunziato explained the location. He advised these buildings are two stories high with under-building parking. The Planning & Zoning Board unanimously recommended approval of this request subject to staff comments. It was also reviewed by the Community Appearance Board and subsequently approved. Councilman Cassandra referred to there being concern about the physical affect to Leisureville from these buildings and asked if planting of certain type trees had been resolved. Mr. Cheney replied the Community Appearance Board included these conditions, which must be met. Councilman Cassandra moved to approve this request to construct two office buildings based on the unanimous appro- val of the Planning & Zoning Board and subject to staff com- ments. Councilman Warnke seconded the motion. No discussion. Motion carried 4-0. Mr. Knowles showed a picture of the proposed building. Councilman Warnke asked if these were designed to withstand 120 to 160 mph winds and Mr. Knowles replied they have been designed to meet the code. Approve request to construct a two story, 16,000 sq. ft. industrial warehouse on .86 acres to be known as Quickrentals. This request was submitted by Herbert Pecht, Jr. for Quickrentals, a Florida Partnership, and would be located on Industrial Avenue. Mr. Annunziato informed the Council this request was reviewed by the Technical Review Board and went to the Planning & Zoning Board with a positive recommendation sub- ject to staff comments. The Planning & Zoning Board unani- mously recommended this request be approved subject to staff comments. The request was reviewed by the Community Appearance Board and subsequently approved. Mr. Herbert Pecht, Architect, came forward and stated there were two items under staff recommendations they would like to correct or modify. The first one is the dumpster loca- tion and he told about moving it based on recommendations, but the Public Works Department recommended it be in the noted location. He then pointed out the final location of the fire hydrant based on recommendations of the Fire Chief. Mr. Annunziato stated if these solutions are acceptable to the various department heads, it would be acceptable and Mr. Pecht replied that he talked to these departments. - 19 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA AUGUST 21, 1984 Councilman Cassandra moved to recommend the approval to construct a two story, 16,000 sq. ft. industrial warehouse to be known as Quickrentals, subject to staff comments including the comments the Planning Director has stated if those two differences are approved by the staff in regard to the locations of the dumpster and fire hydrant. Councilman Warnke seconded the motion. No discusion. Motion carried 4-0. Approve request to construct a shopping center to be known as Forum Shoppes and would include 68,000 sq. ft. of office space, 19,000 sq. ft. for retail space and 24,000 sq. ft. for cinema on 6.5 acres. This request was submitted by Siteworks, Inc. for KG Venture Group and would be located on Congress Avenue at Ocean Drive. Mr. Annunziato pointed out the location and adjacent uses. He explained access to the site. He added the most interesting aspect of this plan is the request for shared parking and he distributed and explained an analysis to sup- port this request. He summarized with the combined parking, there would be an extra 37 parking spaces. The Council would have to take specific action in regard to shared parking spaces. Councilman Cassandra referred to the corner office building proposed to be four stories high being out of conformity to this area and Mr. Annunziato informed him this approval was given three years ago for a four story building. Mayor Zimmerman commented that he was glad to see two accesses to Congress Avenue and Mr. Cheney added there was also access to Boynton Beach Boulevard. Councilman Warnke asked if the parking study considered afternoon matinees and Mr. Annunziato replied affirmatively and explained. He further explained how shared parking was a benefit to the developer as well as to the public with more efficient use of the property and not having vast areas of unused parking. Councilman Cassandra referred to this causing parking congestion for the present owners and Mr. Annunziato replied the parking study limited the scope of the existing parking to 500 feet. Mayor Zimmerman questioned what demarcation would be on the property to the south and Mr. Annunziato replied there would be landscaping. Mayor Zimmerman asked if there would be - 20- REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA AUGUST 21, 1984 shared parking with the development to the east and Mr. Annunziato replied this was not anticipated. Mr. Wayne Isley, 142 Ocean Court, advised that he talked to a lot of residents in Leisureville and they object to the exits onto Ocean Drive. He referred to the traffic pattern at the Leisureville Golf Course and stated it doesn't appear any provision is made in this drawing for handling the traf- fic situation. He stressed in detail how no provision had been made for traffic control. Also, there will be noise from this area. He thinks there should be time to further evaluate this and the people of Leisureville should have the opportunity to analyze the effect of traffic in Leisureville. Mayor Zimmerman stated the applicant could clarify the situation about traffic on Ocean Drive and Mr. Annunziato informed them the applicant will be required to construct a left turn lane from the approach to serve the property. Ocean Drive is an 85 ft. right-of-way and serves as a collector for that area. The signalization on Congress Avenue will be enhanced. Mr. Craig Livingston, Architect, stated the applicant retained a traffic engineer who did analyze the impact and submit studies. They have provided for a 25 ft. wide people-street in front of the area instead of having a strip center. Mr. Rick Ricanis, Traffic Engineer, added that they found relative to the situation on Ocean Drive that access from there would be a convenience for the people coming from the residential area to the east with not having to make a turn onto Congress Avenue. Based on their observation of the existing traffic flows, even with this particular deve- lopment, Ocean Drive will have less than 30% of its available traffic capacity being used. Mayor Zimmerman clarified that they felt most of the outside traffic will be coming from Congress Avenue or Boynton Beach Boulevard and the impact on Ocean Drive will be very minimal and Mr. Ricanis agreed. Councilman Cassandra referred to the driveways being close together and Mr. Cannon informed him the only requirement in the code is a 30 ft. distance from the intersection right- of-way line. Mr. Cheney further explained that individual lots must have access to the main road. Mr. Lowell Bennett, 400 S.W. Golfview Terrace, referred to Leisureville being a retirement community and stated they - 21 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA AUGUST 21, 1984 see the potential in this plan for a traffic problem. There is the problem of traffic increasing on Congress Avenue and people now are driving through Leisureville to avoid that traffic. He stressed their concern about the traffic problem. He referred to the capacity of the proposed theaters and explained how there could be hundreds of cars exiting at the same time. Also, he was told by the mayor there is the potential to make Ocean Drive four lanes wide incorporating right and left turn lanes, which would create a problem in the area of the Leisureville Golf Course. He then questioned the need for nine theaters. Councilman Cassandra asked if he was against the driveway or against the whole construction and Mr. Bennett clarified that he was not against any of it, but thinks this is too many theaters and because of that, the traffic will be horrendous. He again reiterated their concerns about traf- fic increasing in Leisureville and on Congress Avenue. He would like to see some kind of arrangement, such as dividing the line between parking lots with people parking in the Winn-Dixie lot having to exit onto Congress Avenue or Boynton Beach Boulevard. Also, there may be room to have an exit onto Boynton Beach Boulevard from the east side of the building. AlSo, he would like to recommend angled parking areas rather than straight-in parking areas. Councilman Cassandra stated this is commercial zoned land and they are entitled to put on there what they intend to put on there without any request for variances. We cannot deny them legally what they want to do. He thinks it would be advantageous to discuss this with the community involved to see if there is something which can be worked out. As far as dividing east and west, if they don't use the sharing concept, they cannot build and meet the parking require- ments. He thinks if it is agreeable to the applicant and the Council, they should spend some time meeting with the people in Leisureville and work something out mutually. Councilman Cassandra moved to table this decision to the next Council meeting. Mr. Livingston explained that the theaters would not be large and would have staggered hours with different type movies. He stressed there will not be a mass of people coming out at one time. They have spent a great deal of time studying traffic. The people in Leisureville could walk to the site and that is why the people-street area was included. The developer is tying up a great deal of money in this and to hold off two weeks - 22- REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA AUGUST 21, 1984 would be a hardship. He will be glad to meet with anyone and explain the plans fully. After further comments, Mr. Cheney advised the property does have a right to have access onto Ocean Drive since there is frontage on Ocean Drive and it is a public street. Ocean Drive does have sidewalks. He explained that he could not understand someone cutting through Leisureville more than one time. There will be a new updated traffic signal at Ocean Drive and Congress Avenue. With breaking off the parking lot, it would prevent people from going out onto Boynton Beach Boulevard. He thinks people will come out onto Ocean Drive and make a right turn to go south on Congress Avenue. They are not asking for any variance and are complying with the new concept of shared parking in order not to have a vast large area of asphalt. He then explained how access into the Leisureville Golf Course was dangerous with having 200 feet of curb cut. Mr. Bennett clarified that he did not come here in opposi- tion to this development. He came because of concern for the people living in Leisureville and surrounding areas. He just wanted to point out the potential traffic problem. He disagrees with Mr. Cheney saying people will not go thru Leisureville more than once and he told about the traffic they were experiencing there now. Mayor Zimmerman informed him that Congress Avenue will be widened to four lanes during the next year and it may be more tempting for people to stay on Congress Avenue then. Councilman Wright moved to table this and request a com- munity meeting with a report brought back at the next meeting. Councilman Warnke seconded the motion. Mr. Bennett advised that he didn't think there was anything to be gained by tabling this. It seems it is the Council's civic duty to approve it and he just wanted to make a point about the traffic conditions, but doesn't think it should hold up the project. They would appreciate if these gentle- men would be willing to sit down with them and explain the plan. Councilman Wright withdrew his motion and moved to approve this request subject to staff comments, but he would like to see a community meeting at Leisureville within the next two weeks. Councilman Warnke withdrew his second to the pre- vious motion and Councilman Cassandra seconded this motion. Approve request to construct a 2,100 square foot modular bank with drive-through windows plus parking lot and landscaping improvements on the northwest corner of 25th Avenue and Seacrest Blvd. to be known as The First Bankers - Boynton Beach Banking Center. This request was submitted by Jeff Falkenger & Associates for The First Bankers of Palm Beach County. Mr. Cannon pointed out the entrances, traffic access and parking on this plan. He discussed the location. Mayor Zimmerman asked where the wall would be located and Mr. Cannon read the recommendation. He added that the applicant originally proposed a hedge as a buffer, but the Planning & Zoning Board recommended a buffer wall be constructed along the west property line up to the limits of construction. This site plan was reviewed and approved by the Community Appearance Board. Mr. Robert Foot asked if the applicant agreed to the wall stipulation and Mr. Cannon replied affirmatively. Mr. Foot commented that he didn't believe 20' light standards were needed and Councilman Cassandra informed him the recommen- dation was to install parking lot lighting directed away from the residential area. Mr. Jeff Falkenger added that they have agreed to 15' high poles with reduced wattage and number of fixtures on each pole per the Energy Coordinator's recommendation. Mr. Foot questioned the location of the dumpster and Mr. Cannon pointed out on the plan where this would be located. - 24- REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA AUGUST 21, 1984 Mr. Chris Banning questioned the height of the wall and Mr. Falkenger informed him it would be 6 ft. high. Resolutions NONE Other Recommendation for proceeding with development of noise control ordinance Mayor Zimmerman referred to a letter being submitted quoting $1,000 to get this started. Councilman Wright moved to approve this request, seconded by Councilman Cassandra. Mayor Zimmerman clarified this was a request to have Florida Atlantic University assist our legal department in regards to the noise control ordinance. Motion carried 4-0. Approve three year extension of Inter-Local Agreement for Palm Beach County Community Development Block Grant Program Councilman Cassandra referred to a self-explanatory letter being submitted and moved to approve this three year exten- sion, seconded by Councilman Warnke. Under discussion, Councilman Wright commented that he is going to do some research to check the advantages of this and Mr. Cheney advised if the agreement is signed, it will not be looked into for three years. Motion carried 4-0. Approve Amended Agreement with Palm Beach County and Community Development to provide additional $110,000. Mr. Cheney informed the Council this adds $110,000 of jobs money which the county has to go with $350,000 we already have for the next Cherry Hills project to get bids approved next week. There is $260,000 here now, plus $200,000 now. This will take care of street improvements. He recommends approval. - 29 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA AUGUST 21, 1984 Councilman Warnke moved this amended agreement as presented this evening by Mr. Cheney for additional funds be approved, seconded by Councilman Cassandra. No discussion. Motion carried 4-0. OLD BUSINESS Political Signs Councilman Warnke referred to submitting a report and stated he is concerned. These political signs are against the laws and a hazard to pole climbers and it is getting out of hand. He feels we should notify the candidates, especially after the primary. He thinks this should be controlled now. He then moved that the City Manager be instructed to order the City Clerk to send to all candidates and the Republican and Democrat Headquarters a letter saying that Section 21-26 of the City Code will be enforced and enclose a copy of the code. Councilman Cassandra asked if the county enforces the sign law and Councilman Warnke replied that nobody does. Councilman Wright asked where he got the information from Florida Power & Light Co. and Councilman Warnke replied that he received it two years ago. Councilman Wright commented that he was never told he could not use their poles. Mr. Cheney advised that signs are not allowed in the right-of- way and most of the poles are in the right-of-way. Councilman Wright suggested that a letter be sent and Mr. Cheney replied that it is against the code and difficult to enforce, but he will write some letters. If the Council wants them allowed in public rights-of-way, the code could be amended. Councilman Warnke clarified that he just wants the candidates notified of the law and Mr. Cheney replied that he will notify them. NEW BUSINESS Request from Town of Hypoluxo for Fire Service (Postponed from August 7, 1984, City Council Meeting) Mr. Cheney referred to being in the same situation as last week and stated he wrote a memo. There is some value to the city under the terms listed to proceed with this agreement. He was concerned about Palm Beach County expressing opposi- tion and at the last meeting, a senior officer expressed his - 30- REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA AUGUST 21, 1984 opposition but we have not received anything in writing indicating the county is in opposition. This was discussed with our Fire Department and the water situation was addressed. We understand Hypoluxo is willing to conform to all suggestions. He recommends proceeding under these con- ditions with a five year agreement. The income would be of value and any costs not directly involved in Hypoluxo should be set aside for future capital improvement projects. The question came up about having our equipment in Hypoluxo ver- sus here, but it would be very seldom to have fires at the same time and we do have mutual aid from the county and other departments. He told about having an increased number of paramedics also. Councilman Cassandra referred to the code saying a contract could only be for one year with the option to renew every year and stated the code would have to be amended. Mr. Cheney agreed and added that the code was adopted in 1958 and explained that it is usually amended for a certain reason. Mayor Zimmerman stated this could be approved and Councilman Cassandra replied the approval would have to be subject to going through the process of a public hearing with changing the code. Councilman Cassandra stated he is not in favor of approving this contract. Hypoluxo does have the option to go with the county. He feels more comfortable knowing all the services we have are all here for the service of Boynton Beach. Councilman Wright added that he would like to have a com- munity meeting about this. Mr. Cheney advised that the county needs to know about this contract. Chief Rhoden informed the Council that he feels this added activity could be absorbed in the Fire Department; however, Hypoluxo does not have an adequate supply of water. That has been addressed with their purchase of a tanker. Mr. Manley Caldwell, Hypoluxo Town Attorney, stated they do have a time constraint and the county has budget problems. They must give their decision by the end of this month. They would much rather go with Boynton Beach. Their popula- tion is 870 and they would be paying $131 per resident for fire service over the five years. If the citizens of Boynton Beach each paid $131, there would be a $4,000,000 fire and revenue budget. Testimony has been given on the low number of calls. It seems it would be beneficial to both Hypoluxo and Boynton Beach. - 31- REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA AUGUST 21, 1984 Councilman Warnke stated that he doesn't feel right about this contract. Councilman Wright stated he is not opposed, but doesn't like the deadline and would like to have people from the community give their comments. Mayor A1 Kelly, Hypoluxo, stated they only have this week to sign with the county or will be nowhere. He knows they could work with Boynton Beach. Councilman Cassandra asked if a one year contract with the option to renew would be acceptable and Mr. Caldwell replied affirmatively. Councilman Cassandra stated he could live with a one year trial, but couldn't go with five years. Mr. Caldwell added that one year would be a problem with the tanker as it is a major investment to be amortized over five years. Their time is short and he can see there are reser- vations by the Council. They will sign the one year contract with the county and come back to Boynton Beach earlier next year to give the Council more time for consideration. Consider Rainbow Grocery Lease - City Owned Facility (Tabled) Councilman Warnke moved to take this off the table, seconded by Councilman Cassandra. Motion carried 4-0. Mr. Cheney informed the Council he has confirmed we have a lease with Southland for five more years. He has confirmed that Mr. Art Matthews does not have a lease with Southland for five more years. He has confirmed that Mr. Matthews would be satisfied with a one year lease with somebody. Councilman Warnke asked if Southland will let us out of the lease and Mr. Cheney replied this issue needs to be addressed. Councilman Warnke commented that we could use the land behind the store. He suggested instructing the City Attorney to approach Southland to reduce the lease by four years. Mr. Cheney referred to entering a one year lease with Mr. Art Matthews. Councilman Cassandra moved to direct the City Manager to work out an agreement with the City and Art Matthews for one year. Councilman Warnke seconded the motion and it carried 4-0. - 32- REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA AUGUST 21, 1984 Industrial Revenue Bond Screening Committee Report - Poly Plastic Packaging Company Mr. Cheney stated he submitted this for the Council's review. ADMINISTRATIVE Consider request from Veterans of Foreign Wars Post 5335 (Tabled) Councilman Cassandra referred to a representative not being present and Mr. Cheney replied that he will remind them again for the next meeting. Consider Drainage Projects 1983/1984 Budget Mr. Cheney referred to submitting a list for the Council's suggestions and stated he will put this on for final con- currence or approval at the next Council meeting.
