In reviewing the five (5) year history of cruelty cases tiled by Officer Rochrich it's clearly evident animal
cruelty i q way of life in .Boynton Beach and a large, 111-1111ber of animals were spared a life time of neglect
and /or abuse, What's not revealed in review of these cases is the fact many of the prosecutions were the direct
j'C,SUl[ of Offlicer Roehrichs knowledge of the community and her ability to obtain key information from
II I Jo 1-111a tits, Diane Suave the Director of Animal Care and Control for Palm Beach County willingly concedes
tl)c fact this street level knowledge is something her program can't provide and therefore could not be nearly as
crfCctive as our program.
Enclosed as Exhibit "B" is a SUrninary including back tip of a.11 calls rcecived by CommunicationsfDisputch
seeking a . ss 'starlco with animal issues. The most important item of note i thi d is the fact most or
these calls go directly to Officer Rool for disposition that would o therwise be responded to by our Police
0111ccrs. Witlioul. an Animal Contr()l 011jecr to respond to these calls our Police Officers would be the ones

As mentioned previously, I had a conversation wi th the two primary administrators of the Pa.1111 Beach County

Re: Delray Beach Experience with Elimination of Animal Control Division
I spoke with Lula Butler, Director of Department of Community Improvement with the City of Delray
Beach regarding the impact of the elimination of their Animal Control Program, Overall, Ms. Butler
indicated the transition has not been problematic. They utilized a complaint tracking system that
allowed them to keep track of calls they received with animal related complaints or issues. Initially they
received about twelve complaints per month then after several months the complaints dropped to two -
three per month.
One thing that Ms. Butler said helped them handle the initial calls was to work closely with County staff
to understand their response system which seemed to help the callers understand why certain things
were not being responded to as quickly as they had seen in the past. Not everyone was happy, but it
did address the complaint matters.
i inquired as to how often their Police Officers become involved in animal related calls, Ms. Butler
indicated if it is a dog bite situation or an alleged violation of law the Police Department will respond and
immediately engage the County. They have not experienced any problems with the County's response
to their situations.
Delray does not have an Animal Cruelty Investigator on staff. All complaints are forwarded to the
County. Ms. Butler was not aware that the County Animal Control does not have a cruelty investigator
on staff and that they rely on the by PBSO for those needs,
I had asked Ms. Butler if they experienced serious issues with dog fighting and/or animal cruelty cases
in Delray and she did not indicate that was a big problem in their area.
Bottom line: She said the transition was not nearly as difficult as she had anticipated it might be. The
City of Delray realized a savings of approximately $80,000 with the elimination of their program.

As a follow up to my previous research attempts of various communities that provide Animal Cruelty
investigation and prosecution using certified Animal Control Officers i offer the following.
Summary:
Several local governing municipalities provide their own Animal Control Officers (non- sworn) to pursue
and prosecute violations of Florida Statute with regard to animal cruelty and neglect, but none in Palm
Beach County as noted in my transmittal to you last week. I've also spoken with Delray Beach P.D., Boca
Raton P.D. and West Palm Beach P.D. with all parties stating their Police Officers respond to, investigate
and prosecute cases of animal abuse /neglect and animal cruelty. As you can imagine, this can involve
many hours of work on the part of the Police Officer both in the field and in the office to include
appearances in Court, preparing probable cause (P.C.'s) and the securing of search warrants. For
example when we executed a 'arrant on Marta Pejouhy (a dog hoarder) it took the better part of the day
to process all 30 or so animals, transport them and document the conditions of the scene
(house /property). For anyone that hasn't been involved with an operation similar to this, many of the dogs
needed to be caught and restrained and then each animal that's confiscated is processed much in the
manner a human criminal is processed. This means photographs and descriptions much be entered for
each animal including names, medical information and any other evidence that may be available to
properly prosecute the case. Without a civilian "cruelty investigator" we would have tied up a couple of
officers plus a crime scene tech for the duration of that day.
Comments:
The smaller towns I spoke with (only a few) basically appear to have concentrated problems and may or
may not be subject to a taxation structure that differs from Palm Beach County thus requiring them to act
in this fashion. What appears to occur in the "real world" is that most Counties have an Animal Control
Department similar to what we have in Palm Beach County that may or may not conduct their own
cruelty investigations and prosecutions. Currently as you know, if a cruelty case is going to be
prosecuted within a municipality in Palm Beach County it's incumbent upon that particular
jurisdiction to provide their own investigation and prosecution effort. Even in unincorporated areas
the Sheriff's Office handles the prosecutions. I'm sure most municipalities in Palm Beach County spend
relatively limited amounts of their resources in this regard due to several factors including, but not limited
to; education level of the population with respect to this issue, the demographic of the population within a
particular jurisdiction and the willingness of law enforcement in a particular jurisdiction to take on this
somewhat non - traditional enforcement task.
I think it's important to note this is what sets Boynton Beach apart from other jurisdictions in
Palm Beach County. All municipalities in Palm Beach County have to address cases of
cruelty /neglect/abuse within their own corporate boundaries (City's with P.B.S.O. contracts
excluded). Many assume that if we abandon our civilian "cruelty investigator" proposal the
County will step in and take care of it for us and that assumption of course in incorrect.
Based on the above, a couple of points seem obvious to me based on my experience here in Boynton
Beach and with our existing cruelty enforcement program:
. Our population is very educated in the area of neglect and abuse due primarily to our heavy
involvement over the years in this area thereby resulting in between 300 and 400 calls for service
annually to P.D. not withstanding our pro - active work in the community and the calls to our Animal
Control Office,

Our demographic is such that we're not likely to see a decline in the number of abuse, neglect or cruelty
cases in the future. We have a large elderly population that tend to create situations beyond their control
subsequently requiring very radical and creative treatment by the City to include property abandonment
(animals and /or structures), involvement of elder care agencies, confiscation of numerous animals, Code
Compliance citations, etc. Our case history also tells us we have a continued interest of our residents in
the area of dog fighting and /or the training of animals for fighting. Lastly, even though a number of our
Police Officers have worked on these types of situations our resources are such that Police Officer's time
most likely would be better spent on the streets performing more traditional law enforcement. From a cost
perspective I believe it's fair to state what we spend annually on maintaining a civilian "cruelty investigator"
would probably be eclipsed by the costs the Police Department would incur processing cases of
neglect /abuse /cruelty as there's a tremendous amount of time involved working these cases to completion
that most certainly in many instances involve overtime as well for Court appearances, etc.
It should also be mentioned Officer Roehrich maintains her Level 1 Code Enforcement Officer Certification
and therefore provides a dual purpose in the field while on duty.
I stand by my earlier assertion that our taxpayers will receive a better bang for their buck by having a professional
civilian staff member on board in a "cruelty investigator" capacity thereby creating more time for our Police
Officers to respond to calls of a more traditional nature. Officer Roehrich and I will be available tomorrow evening
to answer any questions if necessary.
