Chair Hatch called the meeting to order at 6:01 p.m.

3. AGENDA APPROVAL

Mr. Balfe reported the following:

Ms. Glinski said the March PprksDivi~iRnR-eport had not been approved by the Board.
She requested that it be brought to the next meeting in September.
Motion
Ms. Glinski moved to accept the report as made. Vice Chair Hohner seconded the motion
that carried unanimously.
B. Reconsideration of prices for crypts at Boynton Beach Mausoleum
Mr. Balfe reported that in preparing the agenda request for the Commission, it was noted
that the only prices discussed by the Board were the niche prices. Chair Hatch disagreed
and recalled there had been discussion about crypts. The members were referred to the
back-up meeting minutes from December wherein the prices discussed were
representative of niche prices. Mr. Balfe pointed out that there was some confusion
during the discussions regarding levels and no decision or motion was made with
reference to crypts. He explained that if the Board could agree on pricing, a new motion
would be required.
In response to Chair Hatch's question, Vice Chair Hohner remarked that the cost of an
outdoor mausoleum is less than that of an indoor mausoleum, and in her opinion, the
prices listed appeared to be average. Mr. Balfe remarked that the prices were "right on"
considering they include the opening and closing fees, engraving fees and trays.
All of the members agreed that the niche prices were correct. Because there was
confusion, Vice Chair Hohner suggested that a chart be prepared for the next meeting so
that every member could visualize each space in order to agree on prices. Mr. Balfe
agreed to produce that chart for the next meeting. Vice Chair Hohner also suggested
that the prices from Page 3 of the December minutes and the average recommended

prices for crypts on the list provided by Mr. Balfe be provided so that each member
would see the location and cost of each space.
Chair Hatch agreed that once this chart is prepared and reviewed by the members, a
recommendation would be made.

Ms. Glinski moved to table. Vice Chair Hohner seconded the motion that carried
unanimously.
C. Proposed Ordinance 10- Re: Providing for review of
extenuating circumstances by the Cemetery Board (TABLED ON 3-11-
10)
Mr. Balfe explained this Ordinance was a recommendation by the City Attorney's Office.
In his opinion, the trigger for its creation related to a family that wanted to entomb half
of their relative's cremated remains with the grandmother, and the wife wanted to keep
the other half of the cremated remains. The City Attorney felt the Board should make a
determination on when this should be permitted and what documentation would be
required. Mr. Balfe recalled the Board's discussion was to deal with these decisions on a
case-by-case basis.
Ms. Glinski referred to a reference on Page 3 of the March minutes wherein a number of
cases had been referred to the City Attorney's Office, and it was felt that the City
Attorney thought the Board, rather than the Attorney's Office, should deal with these
issues. The Cemetery Board and Cemetery staff felt these issues were too legal in
nature for them to make the decisions.
Chair Hatch felt this item should be tabled until the Secretary returned at the next
meeting in order for the Board to be provided with some guidance.

. motion that carried unanimously.
D. Opening and closing fees for the Boynton Beach Mausoleum
Vice Chair Hohner reminded the members that the Board established a fee of $500 for
disentombments and when that discussion took place, the opening and closing fees were
discussed for when the City begins to sell crypts. At that time, the members agreed that
the fee should be the same ($500) because the same work is being done in both
instances (in-ground burial or entombment). She recalled that there was discussion by
the Secretary that because of the legal issues pending, a decision should be delayed.
Mr. Balfe remarked the opening and closing and set up at the Mausoleum is not nearly as

much work as digging the grave, laying down the plywood, setting up the chairs, carpets
and lowering device and then refilling the grave.
Since the opening and closing fee was going to be included in the price of a crypt or
niche, Vice Chair Hohner suggested there was no need to set an opening and closing fee.
She believed that many of the mausoleum prices included on the list that was given to
the members included the opening and closing fees. She thought it might be necessary
to verify from those cemeteries being compared if the opening and closing fee was
included in the price provided.
In reviewing the list provided, Ms. Glinski confirmed the opening and closing fees were
not included for the private cemeteries. The municipal cemeteries did not indicate
whether the fee was included.
Chair Hatch inquired if there would be another occasion where an opening and closing
fee would be needed other than the purchase of a crypt or niche. Mr. Balfe felt this may
have come about because of one instance where it was necessary to reopen the crypt or
niche either to put full-body remains or cremated remains into the crypt/niche. Mr. Balfe
felt the fee should be half of what it costs for similar ground services. There was a
suggestion that the fee be established at $250 for weekdays and weekends.
A recommendation was made to table this item until the next meeting.

Ms. Glinski moved to table. Vice Chair Hohner seconded the motion that carried
unanimously.
D. Transfer fees for the Boynton Beach Mausoleum
Vice Chair Hohner recalled that the Board was waiting to establish a transfer fee until all
of the legal issues are settled. Ms. Rivers had advised this fee might be established at a
percentage of the sale price as opposed to a set fee. Mr. Balfe agreed with that
recollection and reminded the members that the percentage suggested would be the
difference between the purchase price and the present market value of the crypt.

8. NEW BUSINESS
A. Ratify the request by Kevin Hubers for a transfer of Lots 177 A&B, 181-A,
183 A&B and 184 A&B, Block W, Boynton Beach Memorial Park.
B. Ratify the request by Eve Pereira for a refund of Lots 170 A&B, Block Y,
Boynton Beach Memorial Park, Addition # 1 in the amount of $600.
(Original purchase price was $750 less $150 which is 20% for a total of
$600.)
C. Ratify the request by Victoria Forsyth for a refund of Crypt F-6, Sunset
Building, Section D, Boynton Beach Mausoleum in the amount of $1,330.
(Original purchase price was $2,660 less 50% for a total of $1,330.)
D. Approve the request of Frances Savage for a transfer of Lots 193 A&B,
165-B and 166-B, Block S, Boynton Beach Memorial Park.
E. Ratify the request of Eugene B. Bunce for the disinurnment of cremated
remains of Eugene Hammond Bunce from Niche H-4, Section N, Devotion
Building at Boynton Beach Mausoleum.

Vice Chair Hohner moved to ratify Items A, B, C and E. Ms. Glinski seconded the motion
that carried unanimously
Ms. Glinski moved to approve Item D. Vice Chair Hohner seconded the motion that
carried unanimously.
9. OTHER
Ms. Glinski noted that the "K" on the sign at the cemetery was repaired. She inquired
about the fountain.
Mr. Balfe explained that another section of piping must be installed. Once the piping is
installed, the low level lighting will be purchased. The fountain was cleaned out for
Memorial Day and it looks better than it has in the past. Hopefully, within the next
couple of weeks, all of the wiring and breakers will be installed and FPL will turn it on.
Vice Chair Hohner expressed her concern about the upkeep of the markers and the fact
that grass that is growing over the granite into the bronze so that you cannot see the
marker. She suggested edging be done. Mr. Balfe agreed to resolve this issue.

Motion
Vice Chair Hohner moved to adjourn. Ms. Glinski seconded the motion.
Ms. Glinski reported that the next meeting is scheduled during Rosh Hashanah and
questioned whether or not the meeting would be rescheduled. None of the members
had an issue with meeting on September 9, 2010.
The motion carried unanimously. The meeting properly adjourned at 6:50 p.m.

Motion
Ms. Norem-Hohner moved to recommend to the City Commission that the City charge
$200 per person for engraving of any crypt or niche fronts, to include the person's first
name, last name, year of birth, year of death and a hyphen. Ms. Glinski seconded the
motion that passed unanimously.
Mr. Balfe suggested a flat rate of $15 be established for the emblems, whether on a
crypt or niche. The fee would include only those emblems reflected on the list
circulated to the Board. Any request for emblems that were not included on the list
would require the Board's approval, and the cost could be determined at that time. A
$75 fee was suggested in lieu of $15 to cover increases in engraving fees to the City.
Motion
Ms. Norem-Hohner moved to establish a fee of $75 for the emblems shown on the list.
Emblems not included on the list would need to be approved by the Board, and a price
would be determined at that time. Ms. Glinski seconded the motion that passed
unanimously.
B. Discuss prices for crypts and niches at Boynton Beach Mausoleum
(Tabled)
Jody Rivers, Parks Superintendent, noted staff had researched the costs of crypts and
niches charged by mausoleums in Delray Beach, Boca Raton, Lake Worth and Palm
Beach in comparison to fees currently charged by Boynton Memorial Park. She
provided a list of recommended crypt costs which were based on an average of the
costs researched and the location of the crypts. Ms. Rivers did not have information
pertaining to non-resident crypt costs or resident and non-resident niche costs and
would provide the additional information next month. As such, the Board agreed to
have this item remain on the table until the next meeting.
C. Discuss and make recommendation to the City Commission regarding a
transfer fee for crypts and niches at Boynton Beach Mausoleum (Tabled)
Ms. Prainito would discuss this issue with the City Attorney, as it was believed the
current litigation could affect the sale and transfer of crypts and niches. It was agreed
the item should remain tabled.

Mr. Balfe had communicated with the vendor who currently inscribes the crypt and
niche fronts at the mausoleum, and the vendor advised he could probably engrave a
smooth finish, but would not be eager to engrave the limestone.
As previously discussed, the cost of the limestone bench would be $950, the "India
Gray" granite, $630 and the "Diamond Pink" granite, $1,602. It was noted the granite
benches would have to be ordered in quantities of 10 while the limestone benches
could be ordered from Mr. Ferazzoli individually. Mr. Balfe noted the original limestone
color for the mausoleum pillars had been 10 to 15 shades lighter than the limestone
currently on the fascia and pillars.
The question arose as to whether Mr. Ferazzoli could attend the next meeting to
address the Board's concerns, particularly those relating to engraving and leeching. Mr.
Balfe would contact Mr. Ferazzoli and request his attendance at the next meeting.
Motion
Ms. Glinski moved to table. Ms. Norem-Hohner seconded the motion that passed
unanimously.
C. Status of the fountain
Mr. Balfe had provided Finance with references and when the purchase order has been
processed, the work will commence. It was hoped the fountain would be installed by
the next meeting.
8. New Business

Secretary Prainito moved to establish the fee of $75 for the emblems that was
approved at the July 9, 2009 meeting and to disregard the motion passed at the
October 8, 2009 meeting.
It was noted the motion passed at the July 9, 2009 meeting required the Board's
approval of the emblems.
Ms. Glinski seconded the motion that passed unanimously.
C. Approve the request from Lucy Velez for a refund on Lot 167-A, Block Y,
Boynton Beach Memorial Park Addition #1 in the amount of $600. (The
original price was $750 less $250 (20%) for a total refund of $600.
Secretary Prainito noted the paperwork for all the refunds was in order. The Board
agreed to approve all of the refunds in one motion. It was noted a change in Item D
was required. The original price was $50 less $10 for a total refund of $40.

F. Ms. Glinski seconded the motion that passed unanimously,

Secretary Prainito noted families had been calling the City Clerk's Office complaining
that their crypts or niches had not been engraved. Brady Osborne sold the
crypts/niches and supposedly was collecting the fees for the engraving. This item was
placed on the agenda to discuss the manner in which this issue should be handled,
especially since it was believed there was no money in the budget for the engraving.
Ms. Rivers confirmed the fact that there was no money in the budget for engraving.
Additionally, as a result of contractual arrangements between Mr. Osborne and his
customers, Mr. Osborne bore the responsibility for the engraving. Staff had been in
discussions with City Attorney Cherof regarding a similar situation, and had been
attempting to make it clear to the individual that the City was not the responsible party.
Calls of this nature were being referred to Mr. Osborne. While staff had previously
arranged for some of the engraving, they did so as they empathized with the families.
However, this could no longer be accomplished in the current economic climate. In
fact, budget transfers were necessary to cover operational expenses. With regard to
the pending litigation, [\1s. Rivers noted the attorneys were going forward with the
litigation as opposed to settling the matter.
It was questioned whether a fee could be established for those families wishing to have
the engraving done. Ms. Rivers suggested staff work with Lake Worth Monument to
have the engraving done at cost. Those families that chose not to do that would still
have to pursue their contractual rights through Mr. Osborne.
Mr. Balfe noted the emblems, which cost the City $15 each, were of major concern, in
addition to the inscription of the names and dates. Ms. Hohner felt that the names and
dates should be added to the crypts/niches. If the families wanted to pay for the
inscriptions while a resolution of the litigation was pending, they should be able to do
so. However, she believed the emblems were a separate issue.
Ms. Rivers noted staff could arrange to send the families directly to Lake Worth
Monument in order to pay for the engraving. IVlr. Balfe did not believe Lake Worth
Monument would object to charging the families the cost normally extended to the City,
as long as staff notified Lake Worth Monument in advance of the families' arrivals.
After payments were made to Lake Worth Monument, staff would follow the usual
process which included removing the cryptfront, sending it to Lake Worth Monument
and replacing the cryptfront after it was returned. Ms. Rivers would communicate with
Lake Worth Monument to ensure the City was not placing them in an awkward position.
The Board was in agreement with the recommendations.

the motion that passed unanimously.
The question was raised as to the status of the fountain. Mr. Balfe noted a full-time
electrician would be joining the Facilities Maintenance Department on the 21st and the
fountain would top his list of priorities. The bushes circling the bottom of the fountain
had already been installed, and it was anticipated the fountain would be fully
operational by early January.

Ms. Hohner felt the middle level, or eye level, should be the most expensive as she
believed it was the most desirable location. She felt the two top tiers were difficult to
reach and should be the least expensive.
Following discussion, the Board agreed on the following prices: $1,000 for A and B,
$1,500 for C and D and $700 for E and F.
Motion
Ms. Glinski moved to approve the costs agreed to by the Board: $1,000 for A and B,
$1,500 for C and D and $700 for E and F, and to recommend the figures to the City
Commission for approval. Ms. Hohner seconded the motion.
Mr. Balfe pointed out that the niches reached higher than level F. Standard crypts were
at levels A through F and the niches were half of a standard-sized crypt. Niches A, B, C
and D should have the same prices as they were equivalent to the height of two crypts.
As such, Ms. Rivers suggested the following:

Motion
Ms. Glinski amended her motion to charge $1,000 for niche levels A through D, $1,500
for niche levels E through Hand $700 for niche levels I through L, which would include

for approval. Ms. Hohner seconded the motion that passed unanimously.
B. Discuss the discrepancy regarding emblem engraving prices.
At the July 9, 2009 meeting, action had been taken by the Board to establish a fee of
$75 for emblems reflected on the list provided by Mr. Balfe. Emblems not included on
the list would need to be approved by the Board and a price would be determined at
that time. Thereafter, at the October 8, 2009, action was taken to allow up to two
emblems at $50 each. All requests for emblems would require Board approval.
Discussions at the July meeting revealed the Board felt $75 was a reasonable price for
the emblems. The Board again concurred and agreed a motion should be made to
reestablish a fee of $75 for the emblems.

Jody Rivers, Parks Superintendent, noted the Board had asked staff at the last
meeting to determine what other municipal cemeteries charged and, in particular,
Delray Beach. This information has been added to the comparison chart included with
the meeting materials. Options could include averaging the cost, having the prices
remain as they are, or lowering the costs so that they were closer to Delray's prices.
It was believed the prices set forth on the chart were a bit high. Ms. Rivers noted there
had not been that many prices available for comparison purposes. As such, she
averaged the costs and came up with the prices reflected on the chart. She did,
however, agree that the prices reflected were high. In considering the price range
reflected for Delray Beach, $600-$700, she recommended a range of $700-$900 for
Boynton Beach.
Suggestions by Board members included the following:
. $1,500 to $1,750 for C and D
. $1,000 to $1,200 for A and B
. $800 to $1,000 for E and F

for emblems would require Board approval. Secretary Prainito seconded the motion.
Discussion ensued, and it was noted the vendor could produce many more emblems
than as reflected on the sheets. It was also noted that all charges previously or
currently agreed upon by the Board required the approval of the City Commission prior
to collection of the charges. As such, it would be necessary for Ms. Rivers to prepare
an agenda item in order for all prices to be approved simultaneously by the
Commission.
The motion passed unanimously.

Mr. Balfe provided a chart of both comparison and recommended prices for crypts and
niches. Purchases of crypts or niches would include the opening and closing, the trays
and the inscription. A Tandem crypt would include two openings and closings. Mr.
Balfe noted the City currently owned Crypt E-6, Section F in the Sunrise Building. It
was noted that many of the crypt/niche prices shown on the chart were for privately-
owned cemeteries.
Mr. Balfe advised of the following prices for a True Companion crypt (noted as
"Tandem" on the chart) for the City of Delray Beach:
. First level:
$4,800 for at-need and $3,840 for pre-need
. Second level:
$5,175 for at-need and $4,140 for pre-need
. Third level:
Same as the second level
. Fourth level:
$4,800 for at-need and $3,840 for pre-need

It was believed the prices suggested would appear to be high if presented to the
Commission. As such, it was suggested pricing be obtained from at least two other
municipal cemeteries. It was therefore suggested the item be tabled.
