Minutes 09-15-10 MINUTES OF THE CODE COMPLIANCE BOARD MEETING HELD ON SEPTEMBER, 15,2010, AT 6:30 P.M. Call to Order Chair Costantino called the meeting to order at 6:30 p.m. II. Approval of Minutes Motion Mr. Karageorge moved to table the minutes to the next meeting. Mr. LaRock seconded the motion that unanimously passed. III. Approval of Agenda Skip Lewis, Senior Code Compliance Officer, announced the following: Case #10-1908 and Case #10-2047 were closed. Case #09-3194 was requested to be tabled to October 20,2010. Motion Mr. Foot moved that the aforementioned case be tabled until the Code Compliance Board meeting to be held on October 20, 2010. Mr. Karageorge seconded the motion that unanimously passed. Swearing in of witnesses and Introduction Attorney Bridgeman explained the hearing procedures and administered the oath to all who would be testifying. IV. New Business Rodger Kemmer, Deputy Fire Chief and Fire Marshall, was present. He explained Fire and Life Safety inspections involve many re-inspections before Code Compliance receives the violation. The Department lost a Fire Inspector and another inspector solely handles the re-inspections. He is 300 to 600 inspections behind and often has to re-inspect 8 or 9 times to gain compliance on some of the simplest issues. Mr. Kemmer proposed a new policy that after three or four re-inspections, they will be cited to appear before the Code Compliance Board. Anytime Fire and Life Safety has a case on the agenda, an inspector will be present to testify on behalf of the Department. 3 Meeting Minutes Code Compliance Board Boynton Beach, FL September 15, 2010 Chair Costantino expressed the Board looked forward to working with them. Officer Lewis called the roll and determined who was present. Case #10-1505 Property Address: Violation(s): Nationwide Assets INC 215 SW 3rd Street CO CH10 SEC10-2 Clean, mow and maintain lot per City Ordinance including swale. Officer Lewis requested this case be tabled to October 20, 2010. Motion Mr. LaRock moved that the aforementioned case be tabled until the Code Compliance Board meeting to be held on October 20, 2010. Mr. Karageorge seconded the motion that unanimously passed. Case #10-2080 Deutsche Bank National Tr. Co (2209 NE 2nd Street) 2209 NE 2nd Street CO CH10 SEC 10-51.5 INC Property vacant or subject to default must be registered with the City. Property must be maintained in accordance with City Code. Property Address: Violation(s): Officer Pierre, explained this case was closed. A motion was needed to remove it from the agenda. Motion Vice Chair Yerzy moved to remove the item from the agenda. Mr. LaRock seconded the motion that unanimously passed. Case #09-3437 Property Address: Violation(s): Scott and Christina Eaton 626 NW 7th Street 104.6.1 FBC '01 ED BBA Red tagged for bedroom and bath addition. Officer Lewis presented the case as contained in the notice of violation. The initial inspection date was November 2, 2009 pertaining to a permit issued in 2003 and 30 days was given to comply. The Respondents constructed an addition and did not obtain a final inspection or certificate of occupancy. To his understanding, the Respondents could not pass the electrical inspection on the permit. Proof of service was effectuated 4 Meeting Minutes Code Compliance Board Boynton Beach, FL September 15, 2010 by posting. The permit had expired. An extension had been previously granted, but they were no longer able to extend the permit. Scott and Christina Eaton, 626 NW 7th Street, were present and pled no contest. Mr. Eaton testified he had the electrical inspection done on Tuesday and they passed with stipulations. Officer Lewis recommended 30 days to finalize the permit. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Karageorge moved that this Board find that Scott and Christina Eaton are in violation of the City of Boynton Beach Code section cited and moved to Order that the Respondents correct the violation on or before October 15, 2010. The Board has considered the gravity of the violation, the actions taken by the Respondents and any previous violations by the Respondents and hereby orders that if the Respondents do not comply with this Order, a fine in the amount of $100 per day for each day the violation continues past October 15, 2010 plus administrative costs shall be imposed. The Respondents are further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re-inspection of the property to verify compliance with this Order. Mr. Foot seconded the motion that unanimously passed. Case #10-2106 Property Address: Violation( s): Raul Vargas Jr. 405 SE 1 st Street CO CH15 SEC 15-120(D) INC CO CH10 SEC 10-56 (B)(D)(G) Repair or replace damaged exterior doors, garage door, soffit and fascia. Clean and paint building, remove outside storage and unregistered and inoperable vehicles. John Herring, Code Compliance Officer, presented the case as contained in the notice of violation. The initial inspection was held on July 9,2010. Notice was sent on July 14, 2010, and certified mail on August 16, 2010. The return receipt was signed on September 1, 2010. Staff recommended 30 days be given to comply. Raul Vargas, Jr, 405 SE 1 st Street, pled not guilty. Officer Herring circulated photographs to the Respondent and the Board. Mr. Vargas testified finances were an issue for him. He lost his job in January and was not collecting unemployment. He had medical issues with his back and he cannot stand for long without resting. He explained he had a hardship. Not all of the items in the photographs were a problem. He agreed with the garage door. Officer Herring explained the fascia and soffit were rotted out and the roof over the garage was very worn, but he did not cite it. Mr. Vargas explained he 5 Meeting Minutes Code Compliance Board Boynton Beach, FL September 15, 2010 had the home pressure cleaned a few years ago to paint it when he was able. The garage door was not damaged and had a shutter. It was a pressure treated % inch 4' x 8' plywood, which he left half on. He did not remove the shutter because of his back. The black SUV appeared to have a broken drive shaft. Mr. Vargas explained the vehicle belonged to his nephew and he gave him permission to could park it there. Ramon Torres, 299 Windswept Drive, Lantana, testified the vehicle was operational. It was a front and rear wheel drive vehicle but it had an expired registration. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Karageorge moved that this Board find that Raul Vargas, Jr. is in violation of the City of Boynton Beach Code sections cited and moved to Order that the Respondent correct the violations on or before December 14, 2010. The Board has considered the gravity of the violations, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $250 per day for each day the violations continue past December 14, 2010 plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re-inspection of the property to verify compliance with this Order. Mr. LaRock seconded the motion that unanimously passed. Case #10-2313 Property Address: Violation(s): Michael J. and Jane A. Morris 921 SW 34th Avenue CO CH 10 SEC 10-56 (B)(C) Secure pool with approved pool barrier. Remove outside hurricane hazardous lumber and building material not used in permitted construction. Officer Lewis presented the case as contained in the notice of violation. The initial inspection date was August 10, 2010. Written notice was provided giving 10 days to correct the violations. Notice was effectuated via posting on September 2, 2010. Staff recommended giving 10 days to comply. It was noted the pool was not secure. The Respondent, Michael Morris was present. Michael Morris, 921 SW 34th Avenue, pled not guilty. He explained he had a building permit and did not know what the case was about. Officer Lewis had photographs he distributed to the Respondent and the Board. The permit was valid until October 27, 2010. Officer Lewis explained the permit was pulled in October of 2009 and the Respondent was before the Board before. While he pulled the permit, he did not do any work towards the permit. There was concrete block on the property, the fencing was falling over, an orange fence was around the pool, but it was not secured. It was 6 Meeting Minutes Code Compliance Board Boynton Beach, FL September 15, 2010 referred to the Building Department, and then came to Code. The neighbors were concerned as the fence had gaps. Mr. Morris explained the Building Department inspected the property and he followed the instructions given to him by Mr. Blasie. He obtained the building permit which could be renewed for six months. He testified there were three violations involved in the original citation, which were the window, the door and the pool. The pool has a barrier fence and the building inspector did not say anything about it on July 28, 2010. He explained the inspector approved the additional permit request lasting until October 27, 2010, and it mentioned none of the items Officer Lewis was discussing. The lumber on the deck could be moved to the garage. Chair Costantino explained the orange fence around the pool is only acceptable following a hurricane until proper fencing can be installed. Mr. Morris explained he has the fence, but it costs a lot of money to install the fence. He explained he is on a fixed income and doing the best he could. He had addressed the window. He would be addressing the door frame and he would address the pool and install the fence. He commented until this point, no one mentioned anything about the temporary barrier around the pool when he obtained his permit. Officer Lewis explained the information was contained In the violation and hearing letters. Mr. Morris was unaware of the letters. He expressed he was told he needed a fence enclosure and he had the permit to do so up until October 27,2010. The members discussed the permit pertained to the construction which mayor may not use some of the materials that were at issue. Mr. Morris explained he did not have a permit for the balcony, and the pool was specifically in violation. Mr. Foot read the permit to the Board. It was unknown what the permit would cover. The permit number was 092872, issued in October 2009. It was valid for six months plus a six month extension. Officer Lewis explained the City was looking at the safety factor. Mr. Morris needed to use an approved barrier that the Building Department could inspect. This was the first time he heard from Mr. Morris. He pointed out Mr. Morris could have easily contacted him. He had no response from Mr. Morris and he had to post the property. Chair Costantino expressed her fear of a child falling into the pool and being found dead. She explained he had the building permit long enough to do something to the pool other than taking the quick way out. Mr. Morris explained in the beginning, the wrought iron fence sections were in place and he thought there was a miscommunication. Mr. Morris explained he did not contact Officer Lewis because he thought Officer Lewis was aware he had a building permit. He took exception to the Board's handling of individuals with hardships. He indicated if 7 Meeting Minutes Code Compliance Board Boynton Beach, FL September 15,2010 the individual does not have the money to comply, the City takes the property and he inquired if that was the way the process worked. Chair Costantino explained if the property is not brought into compliance by the date set, they will certify the fine and lien the property. Mr. Foot suggested partitioning the violations, imposing a 10 day and/or $1,000 per day fine for the pool enclosure and 30 days for the remaining violations with a lesser fine. Mr. Karageorge seconded the thought but thought all could be addressed in 10 days. The hurricane hazardous materials and the pool were the priorities. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Foot moved to find that Michael J and Jane A Morris are in violation of City of Boynton Beach Code section as cited, and moved to order that the Respondents correct the violations on or before September 25, 2010. Based on the evidence presented in this case, the Board finds a repeat violation of the Code section as cited. Having also considered the gravity of the violations, the actions take by the Respondents, the Board hereby orders that should the Respondents fail to comply with this Order, a fine in the amount of $1,000 per day, shall be imposed for each day the violation continues past September 25, 2010 plus administrative costs. The Respondents are further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re- inspection of the property to verify compliance with this order. Mr. Karageorge seconded the motion that passed unanimously. Case #10-1336 Countrywide Home Loans 143 NW 14th Avenue Officer Pierre presented the case as contained in the notice of violation. The hearing date was July 21, 2010 and no one appeared. The date and fine established by the Board was to comply by July 31,2010 or incur a fine of $50 per day. The Respondent was present. Joanne Galipault, Attorney from Marshall Watson, 1800 NW 49th Street, Suite 120, Ft. Lauderdale, Florida, representing the lender was present. She spoke with the Code Officer and thought they would have another 30 days to correct the violations. It was noted the violation had progressed to the lien certification process. Diane Springer, Code Compliance Coordinator, explained the case complied today but it was not verified. She recommended tabling the case. 8 Meeting Minutes Code Compliance Board Boynton Beach, FL September 15, 2010 Motion Mr. Karageorge moved that the aforementioned case be tabled until the Code Compliance Board meeting to be held on October 20, 2010. Mr. Foot seconded the motion that unanimously passed. Case #10-1162 Washington Mutual Bank 205 Gulfstream Boulevard Vestiguerne Pierre, Senior Code Compliance Officer, presented the case as contained in the notice of violation. The hearing date was July 21,2010 and no one appeared. The compliance date and fine established by the Board was to comply by July 31, 2010 or incur a fine of $100 per day. The Respondent was present. Joanne Galipault, Attorney from Marshall Watson, 1800 NW 49th Street, Suite 120, Ft. Lauderdale, Florida, representing the lender, was present. Ms. Galipault explained it was her understanding they were missing the registration on the property and in order to do so they needed the Certificate of Title, which they did not have. The bees were still on the property, they only secured the property. All other violations were outstanding. Ms. Galipault explained they have not gone to summary judgment yet. They were cleaning up the bees and having the lawn and grass trimmed. She explained they could address it within a week or two. Attorney Bridgeman explained as soon as the lis pendens is filed, the property would be registered. Mr. Foot did not think it was worthwhile to certify the lien at this point if they could correct the violations. He did not think the City would gain much by certifying the lien. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Karageorge moved that this Board find that the Respondent has not complied with this Board's Order dated July 21, 2010, and having considered the gravity of the violation, the actions taken by the Respondent, that this Board impose and certify a fine in the amount of $100 per day plus administrative costs which shall continue to accrue until the Respondent comes into compliance or until a judgment is entered based upon this certification of fine. Mr. LaRock seconded the motion that unanimously passed. Case #10-2154 Oakwood Square E & A LLC - Bangkok House 334 N. Congress Avenue CO CH9 Sec. 9-22(C) Fire inspection annual fees. Property Address: Violation(s): 9 Meeting Minutes Code Compliance Board Boynton Beach, FL September 15,2010 Officer Webb presented the case for Mr. Blasie as contained in the notice of violation. Staff recommended 10 days be given for compliance. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Karageorge moved that this Board find that Oakwood Square E & A LLC is in violation of the City of Boynton Beach Code section cited and moved to Order that the Respondent correct the violation on or before September 25, 2010. The Board has considered the gravity of the violation, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $100 per day for each day the violation continues past September 25, 2010 plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re-inspection and verification of payment of the fees to comply with this Order. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re-inspection and verification of payment of the fees to comply with this Order. Mr. LaRock seconded the motion that unanimously passed. Case #10-2158 Location: Violation: Boynton Beach JCP Associates - Mingle III 801 N. Congress Avenue 313 CO CH9 Sec. 9-22(C) Fire inspection annual fees. Officer Webb presented the case as contained in the notice of violation. Staff recommended 10 days be given for compliance. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. LaRock moved that this Board find that Boynton JCP Associates is in violation of the City of Boynton Beach Code section cited and moved to Order that the Respondent 10 Meeting Minutes Code Compliance Board Boynton Beach, FL September 15,2010 correct the violation on or before September 25, 2010. The Board has considered the gravity of the violation, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $100 per day for each day the violation continues past September 25, 2010 plus administrative costs shall be imposed. Federal Highway CO CH9 Sec. 9-22(C) Fire inspection annual fees. Officer Webb presented the case as contained in the notice of violation. Staff recommended 10 days be given for compliance. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. LaRock moved that this Board find that Sunpoint Savings Bank is in violation of the City of Boynton Beach Code section cited and moved to Order that the Respondent correct the violation on or before September 25,2010. The Board has considered the gravity of the violation, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $100 per day for each day the violation continues past September 25, 2010 plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re-inspection and verification of payment of the fees to comply with this Order. Mr. Karageorge seconded the motion that unanimously passed. 11 Meeting Minutes Code Compliance Board Boynton Beach, FL September 15,2010 Motion Based on the testimony and evidence presented in the aforementioned case, Mr. LaRock moved that this Board find that Chase Bank is in violation of the City of Boynton Beach Code section cited and moved to Order that the Respondent correct the violation on or before September 25, 2010. The Board has considered the gravity of the violation, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $50 per day for each day the violation continues past September 25, 2010 plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re- inspection and verification of payment of the fees to comply with this Order. Mr. Karageorge seconded the motion that unanimously passed. Case #10-2198 Location: Violation(s): Guerson & Beatrice Lorissaint 128 NE 11th Avenue CO CH15 SEC 15-120(D) INC Property must be mowed, trimmed and free of trash and debris. Officer Webb presented the case as contained in the notice of violation. The notice was sent certified mail on August 16, 2010 and was returned signed on August 23, 2010. Ten days was given to comply. Regular mail was also sent. The Respondent was present. Guerson Lorissaint, 128 NE 11th Avenue, pled no contest. He explained he should have called Mr. Webb. When he received the letter, he did not have much grass and he did not understand what he meant about the mowing and trimming. His thought was Officer Webb viewed the area before he mowed. When he received another letter, he thought he should appear. Officer Webb distributed photographs to the Respondent and the Board. The Respondent was clear on what needed to be done. He installed grass but advised he did not have a sprinkler system. He also parked the car on the grass so some of it died. He requested 30 days to correct the violation. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Karageorge moved that this Board find that Guerson & Beatrice Lorissaint are in violation of the City of Boynton Beach Code section cited and moved to Order that the Respondents correct the violation on or before October 15, 2010. The Board has considered the gravity of the violation, the actions taken by the Respondents and any previous violations by the Respondents and hereby orders that if the Respondents do not comply with this Order, a fine in the amount of $200 per day for each day the 12 Meeting Minutes Code Compliance Board Boynton Beach, FL September 15, 2010 violation continues past October 15, 2010 plus administrative costs shall be imposed. The Respondents are further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re-inspection of the property to verify compliance with this Order. Mr. LaRock seconded the motion that unanimously passed. It was noted the Respondent was a repeat violator hence the $200 fine. Case #10-1929 Location: Violation(s): Luterson Celony 475 Miner Road LDR CH2 SEC 5(E)(1) CO CH15 Sec. 15-120(D) INC Auto repair not allowed in R-1 Zoning District. Remove vehicles from front and back yards. Remove auto parts and trash and debris from property. Officer Cain presented the case as contained in the notice of violation. Staff recommended 15 days be given for compliance. Mr. Karageorge noted the narrative directs the Respondent to cease work. He inquired if a Cease and Desist Order would be appropriate. Officer Cain respondent it would. Accordingly, a Cease and Desist Order and a Motion Finding Violation would be issued. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Karageorge moved that a Cease and Desist Order be issued giving Luterson Celony until September 25, 2010 to bring the violations of City of Boynton Beach Code sections as cited which pertained to the auto repair work into compliance and that it cease. The Board has considered the gravity of the violations, the actions taken by the Respondent, and any previous violations by the Respondent, and hereby orders that a fine in the amount of $100 per recurrence of the violation thereafter shall be imposed upon the Respondent. Mr. LaRock seconded the motion that passed unanimously. The following motion pertained to the appearance and trash, debris and auto parts violations. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Karageorge moved that this Board find that Luterson Celony is in violation of the City of Boynton Beach Code sections cited and moved to Order that the Respondent correct the violations on or before September 25, 2010. The Board has considered the gravity of the violations, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $50 per day for each day the violations continue past 13 Meeting Minutes Code Compliance Board Boynton Beach, FL September 15, 2010 September 25, 2010 plus administrative costs shall be imposed.
