Mayor Zimmerman called the meeting to order at 7:30 P. M.
He announced the Invocation will be given by Rev. Joseph
Dye, Boynton Beach Congregational United Church of Christ,
followed by the Pledge of Allegiance to the Flag led by
the Assistant City Attorney, Mr. William Doney.
AGENDA APPROVAL
Councilman Cassandra stated he would like to add an item
under Announcements and also under Administrative, Item
C - Council's Last Month's Pay. Mr. Sullivan stated he
would like to add two items, Item J under Consent Agenda -
Ratification of South Central Regional Wastewater Treat-
ment & Disposal Board Action of June 14, 1984, and a
memorandum to the file for Item G, Development Plans.
Vice Mayor Ferrell made a motion to adopt the agenda,
seconded by Councilman Cassandra. Motion carried 3-0.
ANNOUNCEMENTS
Mayor Zimmerman announced that City Hall will be closed on
Wednesday, July 4, 1984, in observance of Independence Day.
Councilman Cassandra announced that he would like to make
the citizens aware that P.A.C.T. will be holding their
monthly meeting on June 28 at 7:30 P. M. at the Royal Palm
Clubhouse and the press and Councilmembers are also invited
to that meeting.
Mayor Zimmerman read a Proclamation proclaiming Wednesday,
July 4th, anniversary of America's independence, as a day
to Honor America and Americans.
Mayor Zimmerman read a Proclamation proclaiming Saturday,
November 17, 1984, to be Boynton High School Alumni Day.

Mayor Zimmerman requested anyone wishing to speak on any

C~erk and then ascertained nobody desired to address the
~Council under Public Audience.

A. Bids
Vehicle Towing Service Contract - Police
Tabled until July 3, 1984 Meeting
Mayor Zimmerman referred to this being tabled and Mr.
Sullivan suggested putting this under regular Bids for
discussion at the next meeting. Vice Mayor Ferrell made
a motion to withdraw Item A from the Consent Agend~a,
seconded by Councilman Cassandra. Motion carried 3-0.
Councilman Cassandra referred to someone just arriving
wanting to speak under Public Audience and suggested
deviating from the Consent Agenda and Mayor Zimmerman
replied that the Consent Agenda will be finished and
Public Audience continued later. Mr. Cassandra moved to
complete the Consent Agenda and go back to Public Audi-
ence, seconded by Mr. Ferrell. Motion carried 3-0.

Approve Proposed Change Order No. 3 for Concrete Driveway
Work, NE 10th Avenue .Project, Shurly Construction Co.
The City Engineer recommends approval of this change order
per his memo dated May 7, 1984. Mayor Zimmerman asked where
this additional money would come from and Mr. Sullivan in-
formed him there is still money left under this contract.

F. Accept Donation from Castoff Square Dance Club
Mayor Zimmerman asked if Mrs. Roz Kuperman, President, or
any members of the Castoff Square Dance Club were present
and received no response. He stated he wanted to thank
them for their generous contribution. He referred to a
letter being sent and Mr. Sullivan replied that he Will
confirm that.
G. Approve Budget Transfer - Exercise Course at Caloosa Park
This is requested for funding participation for the wheel-
chair exercise course at Caloosa Park.
Approve Community Relations Board Recommendation for
Association for Retarded Citizens
The Community Relations Board requests the City Council to
concur in providing $1,000 to the Association for Retarded
Citizens.

Vice Mayor Ferrell made a motion to approve the Consent
Agenda as altered with the exception of Item A and includ-
ing Item J. Councilman Cassandra seconded the motion.

PUBLIC AUDIENCE (Continued)

informed him that Mr. Cheney will have a report for him at
the next meeting. Mr. Dgshev referred to the Council
members being r~.equ~stedto look at their signs to see if
they are appropriate.

Councilman Cassandra responded that the point he had'made
of there being different signs on the board was well taken
and now an ordinance is being prepared to cover these
entrance signs, which he believes will be ready for the
next meeting'. The Council's decision has been postponed
until the next meeting.
BIDS

Mayor Zimmerman announced this would remain on the table
until the next meeting.
Vice Mayor Ferrell made a motion to move to Item VIII,
since it was not yet 8:00. Mr. Cassandra seconded the
motion and it carried 3-0.
DEVELOPMENT PLANS
Consider Variance Request - Master Plan for Rollingwood
Subdivision - Set Public H~.aring
Mayor Zimmerman asked if the Planning Director had a recom-
mendation for this public hearing date and Mr. Annunziato
suggested the Council meeting following the next one on
July 17 to give the City Clerk ample time to advertise.
Vice Mayor Ferrell made a motion to set this item for public
hearing on July 17, seconded by Councilman Cassandra. No
discussion. Motion carried 3-0.
Consider Conversion of Condominium Development to Rental
Development - Stonehaven Development
Mr. Robert A. Satter referred to submitting information
regarding this project and stated he would be glad to
answer any questions. He added that the rezoning to PUD
was approved late last year and their intention is in
exact conformance with those approvals. The multi-family
parcel will be developed in accordance with the approvals
and ordinances. They just intend to develop it as rental
as opposed to condominium.
Councilman Cassandra explained that the concern was expressed
whether this is a significant change and there was also
the question of who takes care of maintenance with the
absence of condominium documents. Mr. Satter replied that
he believes the approval allows either rental, condominium,
or fee simple under the ordinances.

Mr. Annunziato clarified that the question raised by Mr.
Vance concerned whether there was a change to any docu-
ments submitted. The documents submitted were for the
single family area and not the multi-family area. Mr.
Satter is developing the property in a rental mode and he
is responsible for maintenance of the lakes, recreational
facilities, roads, etc. Councilman Cassandra clarified
that Phase II was not approved and Mr. Annunziato clari-
fied that homeowners documents for Phase II were not ap-
proved.
Mr. Doney clarified that nothing is changing. The develop-
ment as it was submitted is being built. No homeowners'
documents were submitted. There is no real change to be
considered.
Mr. Cassandra stated he was under the impression the con-
cept was changed because of market conditions. If he had
known what was planned now, his consideration would have
been altered. He thinks this should be reconsidered by
the Council to approve this new concept of renters.
Mr. Satter advised that it was probably their intent when
submitting the original plans to build housing for sale,
but at a later date, the market changed this. The same
units will be used as rental units. With respect to main-
tenance, they will probably be maintained better under
rentals. Their company is going to own, operate and main-
tain the community as a rental. They request the Council's
concurrence in this and have complied with all ordinances.
They have made large commitments for special financing with
the county.
Councilman Cassandra questioned the location of this rental
area and ~. Annunziato replied that it would be located in
the area south of the middle school, west of Congress Avenue,
bordered on the south and north by canals.
Mayor Zimmerman asked if it had been stated in writing
that the maintenance will be provided by the Satter Co.
and Mr. Doney replied affirmatively and read part of a
letter submitted by their attorney stating the owner will
have the responsibility for maintenance, etc. He added
that in this instance, Satter will own the units as well
as the common areas and have the maintenance responsibility
for everything.
Mayor Zimmerman referred to this encompassing a ten year
period and Mr. Satter clarified they will start building
right away and are hoping for occupancy within 18 months.
Under the terms of the loans, they must remain rentals for
ten years. He told about owning other properties in Palm
Beach County.

Councilman Cassandra questioned the number of units and Mr.
Satter informed him that 288 are planned.
Vice Mayor Ferrell clarified that the attorney's letter
covers the maintenance aspect and Mr. Doney agreed. Mayor
Zimmerman announced that no further action was needed.
Mr. Cassandra moved to revert back to the original agenda,
seconded by Mr. Ferrell. 'Motion carried 3-0.
PUBLIC HEARING
Approve request to eliminate the sidewalk on the east side
of NW 9th Street, Sky Lake Plat No. III as per Article XVI
Variances & Exceptions of the Subdivision Ordinance
Mr. Manny Hoppman, Oriole Homes, explained how on one side
of the street where they are building homes, sidewalks
will be constructed as homes are built; but on the opposite
side of the street are the rear of homes where they have
requested to eliminate the sidewalk requirement. They have
spoken to the homeowners who live in the homes with back
yards on this street and they prefer to have shrubbery in
their rear yards rather than a sidewalk.
(Councilman Wright arrived at this time, 8:05 P. M.)
Councilman Cassandra referred to a letter being received
from Mr. Wade Riley stating the people do not want a side-
walk because of security reasons and questioned if this is
what they meant. Mr. Hoppman replied this is correct and
explained the present residents are concerned about their
privacy.
Mayor Zimmerman requested those wishing to speak in favor
of this.particular request to come forward.
Mr. Arnold Thompson, 1307 N.W. 8th Court, stated he is in
favor of this request. He has spoken to all the other
people who own homes backing up to 9th Street. They have
met with the developer and reached an agreement for the
developer to sod the area with installing a sprinkler sys-
tem. There is only about a 20 ft. wide strip in question.
The owners have given approval to have their sprinkler
systems increased to cover this additional area. The deve-
loper also agreed to put in a hedge row. In lieu of a
sidewalk, they think the aesthetics and privacy aspects
are more important. A sidewalk on one side of the street
is sufficient.

Councilman Cassandra referred to the staff recommending not
to grant this variance and stated he would like to hear their
reasoning. Mr. Annunziato replied that the Technical Review
Board discussed the purpose for sidewalks and felt there
would be the opportunity for people to cut driveways into
9th Street and if there are driveways, there should be side-
walks to separate the pedestrian and vehicular traffic.
Councilman Cassandra questioned the number of sidewalks in
the Laurel Hills area and Mr. Thompson told about less than
50% of the homes having sidewalks.
Mr. Thompson continued that he realizes what the Technical
Review Board is trying to do and appreciates their input.
However, having a sidewalk along this stretch would not be
beneficial. He explained how the grassed area would be
better with giving the children more room to play, etc.
He agrees that some homes will put in driveways, but he
does not see where a sidewalk would be beneficial. The
people have always walked through the Laurel Hills area
with no problems.
Mayor Zimmerman referred to there being problems with
storage of things in the rear of these homes and stated
it would help this problem by having a sidewalk as the
owners would probably keep it in better shape with having
people walking along there. Mr. Thompson replied that he
didn't think a sidewalk would have any bearing on that.
A hedge might make it more aesthetic for people across
the street looking into back yards. Most of the people
have cleaned up their yards and keep them looking nice and
he doesn't see where a sidewalk would have any impact.
Mayor Zimmerman stated that he wants the area to be im-
proved and thinks maybe a sidewalk would be an encourage-
ment.
Mr. Thompson told how the road was about two feet lower
than his yard and a wall would be required in addition
to a sidewalk. He would rather have a hedge for privacy.
Mr. Hoppman explained how it was felt it would be prefer-
able to have an area sodded With sprinklers and a good
sized hedge. He added that it is not normal to have side-
walks at the rear, of homes. Also, the residents living on
the other side of the street would rather look at greenery
than a sidewalk.
Mayor Zimmerman questioned who would plant and maintain a
hedge and Mr. Annunziato replied that if it is planted on
private property, the property owners would have to main-
tain it. ~. Hoppman clarified that the intent is to put
it on private property. They will plant and water it until
growing and then the residents will maintain it.

Councilman Cassandra moved to approve the applicant's
request for a variance of the sidewalk for the rear of their
development. He is not prone to concrete walls, as we have
enough in this city. It is at the rear of homes. He feels
the developer has met the commitments as far as the front
of homes. Since the surrounding community is also in favor
of granting the variance, this is having the community at
heart. Vice Mayor Ferrell seconded the motion. Under
discussion, Mayor Zimmerman stated in this case, the wall
would not be any higher than the level of the sidewalk and
would only be a retaining wall. Mr. Cassandra stated that
he realizes this. Mr. Wright stated he is not in favor of
a sidewalk in a back yard. Motion carried 4-0.
Approve request for a seventy-four (74) seat restaurant with
drive-through facilities to be located on West Boynton Beach
Boulevard and NW 7th Street submitted by MTL Associates for
Wendy's Old Fashion Hamburger Fast Food Restaurant/Robert
and Carolyn Beane
Mr. John Lynch, 1290 N.E. 4th Court, Boca Raton, told about
a Wendy's Restaurant with drive-thru facility being planned
for this location. In accordance with the Community Appear-
ance Board meeting last night, they have agreed to put a
6' high wall on the north side of the property as well as
on the west side of the property where the commercial pro-
perty abuts residential zoning. In addition, they are pro-
viding a great deal of landscaped areas around the entire
site to buffer the restaurant from adjacent areas. He also
explained how the lighting would be a low powered type
prohibiting shining into adjacent areas. He thinks the
question is this particular site being used as a drive-thru
restaurant site rather than just a restaurant. He told
about the Wendy's in this area and their employment of
local people. He respectfully requests this be approved
and will be pleased to answer any questions.
Mr. Annunziato referred to submitting a lengthy recommenda-
tion and pointed out the location with advising that it is
zoned C-2 and telling about the surrounding zoning. Coun-
cilman Cassandra questioned the R-2 zone shown and Mr. -~
Annunziato explained this is 1-95 right-of-way. He con-
tinued with explaining the access to the site and parking
provided. The building and landscaping meet and exceed
the codes. The plan meets the technical codes except
those included in the staff comments. He added that the
memo clearly lists the reasons for the basis of their
recommendation for denial. He noted reasons expressed
for traffic congestion resulting. The staff recommenda-
tions were forwarded to the Planning & Zoning Board and

after conducting a public hearing, the board recommended
denial. This was reviewed by the Community Appearance
Board and comes with their positive recommendation. If
the Council approves, he suggests approving subject to
staff comments.
Councilman Wright referred to employment being created and
questioned the number to be hired and Mr. Lynch replied it
would be 30 to 50 employees. Mr. Wright referred to there
also being a scholarship program and Mr. Lynch agreed.
Councilman Wright stated he has looked at this. Unfortu-
nately, he was not able to attend the Planning & Zoning
Board meeting and is interested to know what rationale Mr.
Linkous and Mr. Pagliarulo used in voting for the project.
Mr. Annunziato replied that he didn't recall any specific
comments on their part. Mr. Cassandra added that he be-
lieves Mr. Linkous said they were against progress.
Councilman Wright commented that it seems we are having a
problem along Federal Highway and he hopes nothing further
is considered for that area. He thinks a business such as
this could be an asset for this area. Since there are
several service stations in this area, he doesn't see
where this would create problems.
Councilman Cassandra asked how far the drive-thru window
is from the property line and Mr. Annunziato replied it
would be approximately 35 feet and there will be a hedge
and wall.
Mayor Zimmerman asked those in favor of this request to
please come forward.
Mr. Walter Dutch, 100 S. Federal Highway, Boynton Beach,
stated he is in favor of a Wendy's on the Beane parcel.
He referred to owning adjacent properties and stated
with the proposed new Intracoastal bridge and an inter-
change from the turnpike onto Boynton Beach Boulevard,
this will ultimately be a highly over-used commercial
road and nothing else. He sees no objection to putting
more commercial in this area, especially where it not only
serves the community, but other areas. He told about
going to restaurants with drive-thru windows and how
there arenever cars stacked up waiting and this traffic
is contained within the property itself. He is in favor
of this project.
Mr. Bob Yost, 2006 South Federal Highway, Boynton Beach,
referred to Boynton Beach being a blooming and booming
town and stated the major thoroughfares must also increase.

Mr. Yost continued with stating that he was present at the
Planning & Zoning Board meeting and the only objections he
heard were in reference to lights in the parking area,
traffic in and out, and the speaker system. The property
is zoned C-2 and a restaurant would be allowed without a
drive-thru window. They have agreed to put a wall on the
north and west sides, which would buffer the speaker system.
There are several drive-thru restaurants on Federal Highway
within a few blocks and traffic has not created any problems.
He is in the process of buying property across the street
from this location and knows Wendy's would be a good neigh-
bor. He is in favor of this project.
Mayor Zimmerman then requested those opposed to this request
to come forward.
Mr. Harold Werger, 1306 N. W. 7th Street, President of the
Laurel Hills Homeowners Association, came forward. He
stated there are 230 homes in Laurel Hills, which is directly
behind this location. This is the main street into their
area. Sky Lake is building 300 homes in this area and one
of their main outlets will be N.~W. 7th Street. He told
about having problems now exiting and entering Boynton
Beach Boulevard because of traffic from 1-95. He ex-
plained how there was no room for stacking by the island
when coming from the west and making a left turn from
Boynton Beach Boulevard. Also, with Wendy's having take-
outs, it will create the opportunity for a lot more young
people to congregate at Pioneer Park or on West Industrial
Avenue. He is in favor of a sit-down restaurant with the
drive-thru and carry-out eliminated.
Mr. Arnold Thompson, 1307 N.W. 8th Court, added that he
would like to point out there is no way to go out halfway
into Boynton Beach Boulevard and wait for traffic to clear
with the design of that island. It is also a turning lane
into the industrial park. The 30 ft. right-of-way is dan-
gerous. There will definitely be a traffic problem with
this restaurant. Directly to the west, Some changes could
be made on Old Boynton Road and that would be a good loca-
tion for a fast food restaurant. There is an existing
problem at this intersection. The C-2 zone is fine for an
office complex with a small amount of traffic.
Mayor Zimmerman stated that he agrees with the last two
speakers and the recommendations made by the Planning &
Zoning Board and Technical Review Board. He lives fairly
close to this location and passes it often and the traffic
on Boynton Beach Boulevard is intolerable., especially for
people coming out from 7th Street and a drive-thru restaurant
will make it worse.

Vice Mayor Ferrell referred to going through the recommenda-
tions and listening to the comments and stated this is a
sit-down restaurant and is not drive-thru, but only has a
drive-thru window. There will be 74 seats. If we deny the
window, it will not be a way of keeping them from building.
We cannot disallow because of a high volume restaurant,
because that is allowed. A lot of points do not have a
bearing on whether the window is there or not. This will
be a main thoroughfare with the bridge and turnpike inter-
change. He doesn't think we want it to be a main thorough-
fare without development. The road~with traffic makes more
noise than any restaurant or speaker would ever make. The
traffic flow from a restaurant will make a difference, but
all the traffic generated onto that spot will not be the
result of a drive-thru window. He has not heard any com-
plaints about traffic backing up at other drive-thru res-
taurants. Off-street parking, lights, dumpster, etc. will
exist with any restaurant. A drive-thru window eliminates
kids hanging at the site, excess banging of doors, etc.
There is other commercial property in this area and a lot
of C-2 property backs up to residential areas. The condi-
tional use allows individual review. Restaurants are
located at every exit of 1-95. He thinkS we have to be
reasonable in what we are doing.
Councilman Cassandra told about clarification being given
for drive-thru and drive-in restaurants. He considered
the traffic concern and told abou~ other exits of 1,95
having traffic signals close to the exits and believes
we can maks a reqUest for one at this location. He thinks
the medians are a hazard. If restaurants are not wanted
in the C~2 zone, then the ordinance should be changed.
This request is only for the conditional use of the window.
He read ths traffic analysis and their main business is
conducted 9nly during a one hour period and only 30% is
generated by the drive-thru window. He has known of no
accidents ~n U. S. 1 because of the fast food restaurants.
In regard to a curb cut, possibly this should be studied
by the en Lneers. A shopping center would generate more
cars. In reference to lights, he explained how the next
building ~uld be 75 feet away from the road and he does
not see h ~ headlights could hit that building. He re-
ferred to another .sensitive area where a wall was the
solution. He thinks the Planning Department submitted an
excellent ~eport, but we must consider the main objective
which is the conditional use of the Window.
Vice Mayor Ferrell questioned what the staff comments are
if approved and Mr. Annunziato replied these are covered
in the-last four sheets of the memo submitted.

Councilman Cassandra commented that it is normal procedure
for fast food restaurants to have a speaker coming from a
menu board speaking down to the car. The amount of sound
lost is astronomical. He recommends the speaker being at
the same height as the car window. Increased volume would
not be needed then. ~&r. Lynch replied that they will check
into that, but their speakers are in the box itself and at
window level.
Mayor Zimmerman commented that he sees there is no use
considering eliminating the drive-thru window from what he
has heard. He still feels the main item which has been
discussed against this project is the exit that people have
from Laurel Hills onto Boynton Beach Boulevard. It is a
bad situation and this will make it worse and he doesn't
see any solution. He will have to vote against this.
Councilman Cassandra asked if the applicant has to donate
anything and Mr. Annunziato replied 5 feet for a sidewalk.
Mr. Cassandra questioned if there would be enough room to
have a separate lane for them to come out and Mr. Lynch
replied there could be a right turn lane only. He added
that their original site plan had ingress/egress cut onto
Boynton Beach Boulevard which did not interfere with
N.W. 7th Street, but that was eliminated. Mrl Cassandra
clarified that he was suggestin9 making another lane for
traffic coming out and Mr. Annunziato advised the possible
result would be to lose a lane of parking.
After further discussion relative to traffic, Mr. Cassandra
moved to grant the conditional use variance for the drive-
thru window of this applicant. Councilman Wright seconded
the motion. No discussion. Motion carried 3-1 with Mayor
Zimmerman dissenting.
Councilman Cassandra continued that since the biggest con-
cern of the Planning Department was there would be others
in this area, he asked if it would be appropriate to request
through the Acting City Manager the possibility of review-
ing the C-2 permitted uses to get rid of driVe-in or drive-
thru restaurant altogether. Mayor Zimmerman replied this
could be taken care of separately.
Approve request for abandonment of a special purpose easement
and a prescriptive easement submitted by Digby Bridges for

Mr. Annunziato pointed out the location and explained there
is a platted utility easement and a sanitary sewer was in-
stalled many years ago. The applicant is requesting that
this special purpose easement and the city's rights to this

sewer line be abandoned. The sewer line has never been
put in service. The staff recommends approval.

DEVELOPmeNT PLANS (Continued)
Approve request for a variance to the redevelopment area
moratorium and site plan approval to construct a 26,240
square foot retail building plus parking and landscaping,
to be located on U.S. 1 between S.E. 1st and S.E. 2nd
Avenues, west side. This request was submitted by Digby
Bridges for Pineland Plaza/Pronto Builders, Inc.
Mr. Annunziato clarified this is a two part request to
grant a variance to the downtown moratorium and approval
of the site plan. He explained the variance process.
The Planning & Zoning Board with respect to the moratorium
variance made a recommendation that the variance be granted.
Mr. Annunziato then explained the site plan including the
parking, access, etc. He advised this application went to
the Planning & Zoning Board with several technical staff
comments and the board incorporated those comments in their
recommendation. It was approved by the Community Appearance
Board.
Mayor Zimmerman asked if the developer cared to add any-
thing. Mr. Bridges explained how they have designed a
prestigious building, plus keeping with the downtown
development scheme.
Councilman Cassandra referred to the Community Redevelopment
Agen~Ybeing concerned the landscaping in front might not
coincide with the final downtown plan and stated that Mr.
Bridges has gone on record to work with the C.R.A. If at
that time, there is the necessity to change the landscaping,
he is willing to make that change and Mr. Bridges agreed
this is correct.

Councilman Wright moved to grant this variance to the re-
development area moratorium and site plan approval for
construction of a retail building plus parking and land-
scaping located on U. S. 1 between S.E. 1st and S.E. 2nd
Avenues, submitted by Digby Bridges, subject to staff
comments. Councilman Cassandra seconded the motion. No
discussion. Motion carried 4-0.
Approve request for the construction of a model unit at the
sales center at Hunters Run Golf and Racquet Club, Tract J,
submitted by Charles Gilbert for Summit Associates, Ltd. to
be located on the southern portion of Tract J, fronting on
Clubhouse Lane
Mr. Annunziato informed the Council this is a request to add
one unit to the model area of Hunters Run. It was the unani-
mous recommendation from the Planning & Zoning Board to
approve. This request was also reviewed by the Community
Appearance Board and approved.
Vice Mayor Ferrell made a motion to approve this request,
seconded by Councilman Wright. Motion carried 4-0.
Approve request to construct a 220,660 square foot, two
story department store at the Boynton Beach Mall plus
parking lot, landscaping and utility modifications submitted
by Mike Greer and Charles O'Brien for Boynton - JCP
Associates, Ltd./Boynton Beach Mall - Burdines to be
located at 801 North Congress Avenue
~. Annunziato explained the location. He advised there
are two parts to this approval request, one for the site
plan and the second for an exception to the height limita-
tion to construct mechanical equipment and a dome type
feature on top of the building. There is a recommendation
from the staff to approve subject to staff comments. The
Planning & Zoning Board unanimously recommended the site plan
and height exceptions be approved in compliance with the
staff comments. It was also approved by the Community
Appearance Board. The applicant is present.
Vice Mayor Ferrell stated the height exception for the
mechanical equipment is fine, but questioned the sky
light and Mr. Annunziato replied that all the reviews have
recommended approval as it is a clear structure, similar
to a dome.
Mr. Harold Robinson, Director of Store Planning for Burdine's,
came forward with Mr. Scott Bratey, Architect & Engineer.
He referred to having two models and informed the Council
that the concept is to create a store which is uniquely

Florida and uniquely Boynton Beach. He explained how the
store would be covered with foliage and landscaping with a
translucent sky light dome.
Mayor Zimmerman declared a recess, so the audience could
come forward to look at the models and then reconvened the
meeting at 9:40 P. M.
Mayor Zimmerman stated this matter is before us for consid-
eration of the site plan and also for a variance for height
exceptions. Councilman Wright questioned if the request is
in. compliance with the ordinance and Mayor Zimmerman replied
affirmatively. Councilman Wright clarified that we do have
the right to approve this request and Mr. Annunziato agreed
and read Section 4-F of the zoning code.
Councilman Cassandra referred to height exceptions being
granted for elevators, air conditioner equipment, etc., but
stated there has never been the intent of a 55 foot non-
functional use in this particular area. He thinks this is
a beautiful design, but they were aware of our ordinances.
He does not think the intent of including domes or cupolas
in this ordinance was included for a concept such as this.
It was commented that it could not be seen from Congress
Avenue with a 45 ft. building in front of it and he ques-
tions the reasons for it if it is not going to be seen from
Congress Avenue.
Councilman Cassandra then read the considerations to be studied
from the code and questioned satisfying various ones. They
were aware of our code and with asking for 55 feet, it is
definitely exceeding the 45 ft. height limit.
Vice Mayor Ferrell stated when he read the application ori-
ginally, he thought it was for 2 feet over the height limit.
However, for something non-essential, he could not go along
with it. It is a beautiful plan, but it is not essential.
He does not think the building would be hurt without it.
It would not be allowed in the downtown area, so should not
be allowed west of town.
Councilman Wright asked if it could be built without this
dome and Mr. Robinson replied that the spire dome is very
important in terms of design of the building. Without the
spire, it is just a sky light. It is a Functional sky
light in the center of the building over the central core
where the cosmetics area will be. Without the contrast of
this architectural item, it'will lose an important design
element. Without it, they will be going from an award win-
ning design to something which is less than that. If it
is reduced in size, it would lose a great deal in terms of

architectural value. They think the concept is very similar
to a church spire in nature as far as the zoning code reads.
He is not sure how the two can be separated. If a church
spire is allowed, why isn't this allowed? Vice Mayor
Perrell replied that he would not go along with a church
spire either. Mr. Robinson continued that the code does
allow exceptions. He thinks they should consider the func-
tion as a sky light and the important architectural element
to the design of the building.
Mayor Zimmerman referred to reducing the height probably throw-

asked if it could be r.educed and Mr. Robinson replied there
has been a lot of study in the proportions of the dome spire;
if it is reduced any great amount, it becomes almost meaning-
less.
Councilman Cassandra questioned the diameter at the base of
the cone and Mr. Braley replied that it is 40 ft. ~ diameter
at roof level. Mr. Cassandra commented that since the de-
sign of the store is to utilize light through the dome spire
concept, actually what is needed is a 40 ft. area for light
to come through and it could be done with something not as
high. Mr. Braley replied that it could be built flat, but
that would be like having the ceiling at door height. With
a small dome, the illusion would be incorrect. This design
is very functional. Light is only one function. He sug-
gested that the Council members look through a model scope
to see the impression of what it would look like. Council-
man Wright referred to this not being a design for this area
and Mr. Robinson replied that they hoped many people in
Boynton Beach would like this design and every store is
designed differently with the store being unique to the
particular area.
Councilman Cassandra referred to two additional department
stores coming into the mall and stated he could see approval
of this store leading to the next store wanting an archway
or something else above the 45 ft. limit. Mr. Robinson
replied that he understood this, but didn't think they were
asking for approval just for architecture or something non-
functional. This is a functional architectural element for
this building. They feel it could be handled in other ways
as far as bringing in light, but there is architectural
value and importance to this building.
Councilman Cassandra stated that he was also concerned
about the hurricane factor and Mr. Braley informed him
this will comply with all technical requirements of the
code. Mr. Cassandra stated he would have to have the

Technical Review Board confirm this and Mr. Annunziato in-
formed him that whatever is constructed in Boynton Beach
will have to meet the Southern Standard Building Code and
addendums. Councilman Wright asked if the Technical Review
Board approved this and Mr. Annunziato replied that height
exceptions are policy decisions evaluated by the Council
on an individual basis. Policy support has been given with
approval recommended by the Planning & Zoning Board and
Community Appearance Board.
Mr. Robinson referred to the code allowing mechanical spaces
in buildings and explained how a three story building could
be 50 to 55 ft. high with permitting mechanical equipment
spaces between floors and stated this is just a 35 ft. bu±ld-
· ng with a spire in the center.
Mr. Ralph Marchese, 1901 Roma Way, stated he thinks the
people in Boynton Beach spoke loud and clear and they don't
want another Fort Lauderdale. The way the ordinance is
written, the Council has no room to approve what appears to
be a dunce cap on a nice structure. He thinks Burdine's
would want to stand out by having quality and good prices.
If they are looking for light, it can be done with a trans-
parent roof. He does not think this height exception should
be approved.
Vice Mayor Ferrell commented that he personally thinks it is
a beautiful building, but the voters of the city have said
how they feel.
Mr. Robinson asked if there is an area which would be accept-
able as opposed to unacceptable an~d Mayor zimmerman replied
this could be tabled. Mr. Robinson referred to the Council
not being in favor of this proposal and stated another pro-
posal could be submitted if an indication was given of what
is acceptable. Mr. Annunziato suggested that it be within
the height limit and conservative in the approach.
Councilman Cassandra told about voting against other proposals
exceeding the height limit. Vice Mayor Ferrelt stated if the
height is not a necessity, he is against it. Councilman
Wright requested that they comply with the requirements.
Mr. Annunziato clarified that if this concept is not approved,
the applicant still has the opportunity to modify the plan
and be within 45 feet. There could be a clear translucent
cap and Mr. Robinson replied they do not want to have a flat
roof and it is important to have natural light in the center
of the store.
Mr. Robinson requested the Council to table this, so they
can decide what they want to do. They will come back and
discuss a different situation. If the Council votes in the
negative, does it mean they have to live with 45 feet or can

they submit another proposal? Mr. Braley stated he is con-
cerned about the dense foliage complimenting the spire and
if there is going to be no spire, they may want to rethink
the whole design. He requested the Council to table this
request. Vice Mayor Ferrell replied that he doesn't agree
with tabling as this is a policy statement. Mr. Doney ad-
vised if they want to come back with a revised site plan and
no requirements for a variance, this would not hurt the Coun-
cil. Mayor Zimmerman commented that it might be better to
see the entire plan and he is in favor of tabling it.
Councilman Cassandra added that the intent is not to exceed
the 45 ft. height limit. If they need time to relandscape
and are aware of the 45 ft. height limit, he sees no reason
for not tabling this. Councilman Wright moved to table.
Mayor Zimmerman ascertained there was no second for the
motion.
Vice Mayor Ferrell made a motion to approve the site plan
with the 2½ additional feet for the mechanical appurtenances,
but deny the request for a height exception for the spire.
Councilman Cassandra seconded the motion. Motion lost 2-2.
Mr. Doney informed the Council that if not approved, we don't
have anything. Councilman Wright suggested that they come
back with something else. Mr. Doney advised even if this
site plan is approved with the variance for the mechanical
equipment and they have other plans, they can continue coming
back with an amended site plan. Mr. Ferretl clarified that
the motion as made would allow them to go to the site plan
and reconsider only one portion. Mr. Doney added that they
could file an amended site plan. Mayor Zimmerman stated
based on this explanation, he will change his vote.
Vice Mayor Ferrell made a motion to approve this site plan,
approve the extension for the mechanical equipment, but dis-
approve the request for the non-essential spire. Councilman
Cassandra seconded the motion. No discussion. Motion car-
ried 3-1 with Councilman Wright dissenting.
Approve request to construct 249,600 square feet of offices
an four buildings plus landscaping and parking for Boynton
Commerce Center Office Complex to be located at 1600
Corporate Drive submitted by Fred Jay Popper for Boynton
Commerce Center, Inc.
Mr. Annunziato showed the plan and pointed out the location
of the four office buildings. He advised this plan went to
the Planning & Zoning Board with a positive recommendation
subject to several staff comments. The Planning & Zoning
Board unanimously recommended approval subject to the com-
ments. It was reviewed by the Community Appearance Board
and subsequently approved at their meeting.

Mayor Zimmerman asked if the developer was present and Mr.
Fred Popper, Architect, came forward and stated they feel
these four office buildings will compliment the rest of
this planned industrial development.
Mayor Zimmerman referred to the staff comments and Mr.
Annunziato replied there were several and the key comment
regarded traffic. He explained the requirements in regard
to a turn lane and traffic signal. Mr. Popper stated they
will comply with the staff comments.
Vice Mayor Ferrell made a motion to approve this request
subject to staff comments, seconded by Councilman Cassandra.

Approve request to construct an 81,213 square foot office
building plus landscaping and parking on Woolbright Road
eas~ of Congress Avenue. This request was submitted by
Richard Reill¥ for FMED Realty/Woolbriqht Professional Plaza
Mr. Annunziato explained the location of this four story
building with under-building parking. He advised this was
reviewed by the Technical Review Board and went to the
Planning & Zoning Board with a positive recommendation
subject to staff comments. The Planning & Zoning Board
unanimously recommended approval subject to comments from
the Technical Review Board plus the additional recommenda-
tion to meet with the County Traffic Engineer to discuss
the impacts on Woolbright Road of this proposed building.
He explained the suggestions submitted by the County
Traffic Engineer. Also, they requested to exceed the
height regulation by 3% feet for mechanical equipment and
this was recommended for approval. The Community Appear-
ance Board also approved.
Councilman Cassandra referred to the plan showing a 5 ft.
wall, but a 6 ft. wall being required and Mr. Annunziato
agreed it would be a 6 ft. walt as required by code.
Mr. Ed Seymour, Architect, showed a rendering of the build-
ing. Mayor Zimmerman asked if they will comply with the
recommendations and Mr. Seymour replied affirmatively.
Vice Mayor Ferrell made a motion to approve this request
subject to the staff comments, including the height excep-
tion for the mechanical equipment. Councilman Cassandra
seconded the motion. No discussion. Motion carried 3-0.

Mayor Zimmerman referred to missing out on the discussions
of these various powers at the last meeting and stated he
does have a question about the thinking of one or two items.
He referred to Page 4 and questioned why we are delegating
the power to mortgage, pledge, hypothecate, or otherwise
encumber or dispose of any real property when we are hold-
ing onto the right for approval to purchase or lease?
Councilman Cassandra stated that he questions the same thing.
Also, Section 163.375 was never discussed. Therefore, there
should be nothing denoted to 163.375. Eminent domain is not
a function of the Community Redevelopment Agency.
M~. Cassandra continued with referringto Paragraph c on
Page 2 and stated the intention is for everything still to
meet city codes. This would also apply to Paragraph e on
Page 2 being subject to city codes. He also questions
Paragraph d on Page 4 as the disposition of property still
should be the function of city control.
Mr. Doney clarified that one is acquiring and one is dis-
posing and one is with Council approval and one is not.
Mayor Zimmerman suggested that they be consistent. Mr.
Ferrell suggested adding "subject to Council approval" on
paragraph d, Page 4.
Mayor Zimmerman questioned this error and ~. Haygood
stated in discussions, the concern was with acquisition
and the restriction can be added about City Council appro-
val. Mayor Zimmerman agreed with the suggestion to add
subject to City Council approval.
Mr. Doney explained that amendments must be clarified
before advertising. Mr. Cassandra clarified that Mayor
Zimmerman wants consistency with Paragraph d on Page 4
requiring City Council approval. Also, he wants to make
sure about Section 163.375. Mr. Doney advised that the
requirement for City Council approval is non-substantial
and can be added without re-advertising. Reference to
Section 163.375 can be deleted at this time.
Vice Mayor Ferrell made a motion to adopt Ordinance No.
84-28 with deleting in Section 1 reference to Section
163.375 and adding on Page 4, Paragraph d - "Subject to
City Council approval". Councilman Cassandra seconded the
motion and added that it is understood that city codes must

Mr. Sullivan researched this, but there has never been a
policy about this and there had been no problem previously
with taking office April 5. He thinks a policy should be
made and direction given, which he is recommending, since
the last Thursday of the month is when the outgoing leaves,
they should get paid for the month including those two days
and the incoming not get paid, but will collect when they
go out.
Councilman Wright asked how much more money was needed to
pay Mr. deLong and Councilman Cassandra replied that he was
deducted two days, but policy direction is needed.
Vice Mayor Ferrelt made a motion to go along with this recom-
mendation. Councilman Wright seconded and added to pay Mr.
deLong $16.00. Under discussion, Mayor Zimmerman questioned
if a term ends on the first or second day of the month.
Mr. Cassandra replied that it ends on the last Thursday of
the month. Mr. Wright suggested that they be paid if serving
over half a month. Mr. Sullivan referred to the possibility
of someone resigning around the tenth of a month and Mr.
Cassandra replied they would not get paid. Mr. Wright clari-
fied if one works half the month, they should get paid the
full amount. Motion carried 4-0.
OTHER
C-2 Zoning Permitted Uses
Mr. Cassandra stated the City Attorney recommends that the
Planning & Zoning Board be requested to consider the per-
mitted uses in C-2 zoning to possibly remove drive-in and
drive-thru restaurants. Councilman Wright asked if this
could be included when redoing the comprehensive plan and
Councilman Cassandra replied that we must be prepared for
another application. Mayor Zimmerman clairifed this is just
to instruct the Planning & Zoning Board to review this.
Vice Mayor Ferrell stated he is not in favor and Councilman
Wright added that he is not either at this particular time.
ADJOURNMENT
- Councilman Cassandra moved to adjourn, seconded by Vice
Mayor Ferrell. Motion carried 4-0 and the meeting was
properly adjourned at 10:50 P. M.
