Minutes 10-20-10 MINUTES OF THE CODE COMPLIANCE BOARD MEETING HELD ON WEDNESDAY, OCTOBER, 20, 2010, AT 6:30 P.M. IN CITY COMMISSION CHAMBERS, BOYNTON BEACH, FLORIDA PRESENT: Michele Costantino, Chair Scott Blasie, Code Compliance (arrived at 6:33 p.m.) Richard Yerzy, Vice Chair Administrator James Brake Shana Bridgeman, Assistant City Attorney Robert Foot, 2nd Vice Chair Mark Karageorge Kirk LaRock Aimond Alexis, Alternate Kathleen Carroll, Alternate I. Call to Order Vice Chair Yerzy sat as Chair and called the meeting to order at 6:30 p.m. II. Approval of Minutes of August 16, 2010 and September 20, 2010 Lien Reduction meetings. Motion Mr. LaRock moved to approve the minutes as amended. Mr. Foot seconded the motion that unanimously passed. III. Approval of Agenda Willie Webb, Senior Code Compliance Officer announced the following: Case # 07-3227 was requested to be tabled to December 15, 2010. Motion Mr. Brake moved to table the case to December 15, 2010. Mr. LaRock seconded the motion that unanimously passed. Ms. Costantino arrived at 6:33 p.m and sat as Chair. Case #09-3194 was requested to be tabled to November 17, 2010. 1 Meeting Minutes Code Compliance Board Boynton Beach, FL October 20, 2010 Motion Mr. Brake moved to table the aforementioned case to November 17, 2010. Mr. LaRock seconded the motion that unanimously passed. Case #’s 10-1939, 10-1501, 10-1502, 10-1505, 10-2623, 10-2699, and 10-2349 were complied. Case # 10-1281 was requested to be tabled to November 17, 2010. Motion Ms. Carroll moved to table the aforementioned case to November 17, 2010. Mr. LaRock seconded the motion that unanimously passed. Case #s 10-2678, 10-2684, 10-2279, 10-2703, 10-2536, and 10-2711 were removed. Case #10-14 was closed. Mr. Foot inquired about the rationale for cases being removed or closed. Scott Blasie , Code Compliance Administrator, explained staff removes cases because they receive documents at the last minute and/or the Respondent is moving on the violation. Staff considers the size of the agenda, the type of violation, and the documentation they have reflecting the Respondents were working with staff on the matter. When a case is closed, it could mean staff did not obtain good service on the party, the Code sections were vague or the evidence was not strong enough. The Fine Certification that was closed was based on the Building Department’s recommendation. It usually means the Board was not comfortable bringing the case forward. Motion Mr. Foot moved to approve the agenda. Mr. Karageorge seconded the motion that unanimously passed. IV. Swearing in of witnesses and introduction Attorney Bridgeman explained the hearing procedures. The Recording Secretary administered the oath to all who would be testifying. New Business Case #10-564 Salvatore DeCanio Property Address: 211 E. Boynton Beach Boulevard Violation(s): CO CH10 SEC. 10-56 (B) (D) Repair or replace canopy material on front overhang. Replace dead grass. Officer Webb presented the case as contained in the staff report. The case arose from a routine neighborhood inspection on February 19, 2010. Written notice was sent giving 10 days to correct the violation. The case was tabled in May to October. Written notice was sent and the green card was signed on October 4, 2010. Dr. Salvatore DeCanio,Jr. , 9 Fairway Drive, pled no contest and advised he removed the canopy material and only the steel awning structure remained. He removed the dead sod, which now has weeds growing but it is being cut every two weeks. The building has a pending sale and the closing was supposed to occur on September 2, 2010, but it was delayed another 30 to 45 days. He submitted documents to substantiate the closing. The new owner wants to keep the awning structure. In the interim, Dr. DeCanio secured a proposal to remove the structure, repair the stucco and paint it to match the other building. The owner wants to put his own awning cover on the building. Discussion followed whether the awning could be removed and saved for the new owner. It was explained it could not because it would have to be cut. Scott Blasie, Code Compliance Administrator, recommended leaving it up. The violation was the canvas was torn. Dr. DeCanio was certain the property would be improved. Motion Mr. Brake moved that the aforementioned case be tabled until the Code Compliance Board meeting to be held on December 10, 2010. Mr. Foot seconded the motion that unanimously passed. Case #08-2511 America Development Corp. Property Address: 1899 N. Congress Avenue Violation(s): LDR CH7.5 II SEC 5(B) Bring landscape back to what is on file with the City. John Herring , Code Compliance Officer, presented the case as contained in the staff report. The case was a City department referral. The initial inspection occurred August 28, 2008. Written notice was sent giving 30 days to correct the violation. Notice was sent regular mail on August 29, 2008 and certified mail on September 13, 2010. Clint Oster , 845 NE 71st Street, Boca Raton, the landscape architect, was present and authorized to speak on the owner’s behalf. He pled no contest. Mr. Oster had questions about bringing the landscape up to the approved plan. He met with Kevin Hallahan onsite several times. They have an approved plan for two of the three outparcels. Mr. Hallihan was insisting on a triple layer hedge along Gateway and the approved plan does not show it. The approved landscape plan shows a tree every 40 feet, and Mr. Hallahan wants them to be closer. He also wants to bring the landscape up to current standards. Mr. Blasie recommended administrative disagreements should be discussed with someone above Mr. Hallahan as to the interpretation or application of the Code. They also have some trees on site and they were approved at the time. The trees are 18-inch caliper Mahogany trees. Mr. Hallahan had indicated the trees are not Grade-A trees. Mr. Oster asserted the trees are beautiful and most people would be thrilled to them. It was recommended the Respondents follow the administrative process. Motion Mr. Karageorge moved that the aforementioned case be tabled until the Code Compliance Board meeting to be held on November 17, 2010. Mr. LaRock seconded the motion that unanimously passed. Mr. Foot suggested taking action; however, other members of the Board disagreed based on the fact that there are administrative issues and Mr. Hallihan was not present. The motion passed 6-1 (Mr. Foot dissenting.) Case #09-1227 Boynton Plaza Property Address: 111 N. Congress Avenue Violation(s): BBA FBC ’04 105.1.1 Obtain permit for store front repair due to car accident for units/suites 125 and 123 A as stated on the red tag. OfficerHerring presented the case as contained in the staff report. The case was a City department referral. The initial inspection occurred May 27, 2009. Written notice was sent giving 10 days to correct the violation. Notice was sent regular mail on April 27, 2009 and certified mail on September 3, 2010. The green card was returned on September 8, 2010. The management company has been in contact with Officer Herring and was trying to obtain a contractor to address the red tag issues. 4 Meeting Minutes Code Compliance Board Boynton Beach, FL October 20, 2010 Lissette Rivera , 5719 Azela Circle, West Palm Beach, pled no contest and was authorized to speak on behalf of the company. Ms. Rivera explained an auto crashed into the building which the tenant repaired without obtaining a permit. Their architect and engineer’s reports were just received and their general contractor was applying for the permit. They would need at least 30 days. The work was completed but they had to pull the permit. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Brake moved that this Board find that Boynton Plaza is in violation of the City of Boynton Beach Code section cited and moved to Order that the Respondent correct the violation on or before November 19, 2010. The Board has considered the gravity of the violation, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $150 per day for each day the violation continues past November 19, 2010 plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re-inspection of the property to verify compliance with this Order. Mr. LaRock seconded the motion that unanimously passed. Case #10-1358 Douglas Goodwion Property Address: 513 NW 8th Court Violation(s): BBA FBC ’07 ED 105.1 Comply with red tag for the garage to room conversion without permit. Skip Lewis , Senior Code Compliance Officer, presented the case as contained in the staff report. The initial inspection occurred May 4, 2010 which was from a City referral from the Building Department regarding a garage-to-room conversion. Written notice was issued giving 30 days to comply. Douglas Goodwion , 513 NW 8th Court, pled no contest and advised he has a contractor ready to pull permits. He commented the Building Department wanted to charge four times the fee. He moved into the dwelling March 12, 2010 and did not know about the violations until a month afterward. He has the waiver request for the fees and the contractor was ready to do the work. Officer Lewis suggested 60 days be given to comply. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Foot moved that this Board find that Douglas Goodwion is in violation of the City of Boynton Beach Code section cited and moved to Order that the Respondent correct the violation on or before December 19, 2010. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re- inspection of the property to verify compliance with this Order. Mr. Brake seconded the motion that unanimously passed. Case #10-2321 Tommy Jonas Property Address: 101 NW 13th Avenue Violation(s): CO CH15 SEC 15-120(D) INC Remove unregistered/inoperable vehicles. Remove trash and outside storage. Officer Herring presented the case on behalf of Officer Melillo. The case was a City referral. The initial inspection date was August 12, 2010 for unregistered vehicles. Written notice was sent on August 13, 2010 giving ten days to correct the violation. Certified mail was sent September 3, 2010 and returned signed on September 9, 2010. He met with the individual on the property earlier in the day along with Officer Roy and he had photographs to distribute to the Board. The Respondent was present. Tommy Jonas , 101 NW 13th Avenue, pled no contest. He requested direction of what needed to be done as he did not feel there was any violation and he had been requesting assistance for two weeks. He explained the vehicles were antiques and he understood residents have a right to have an antique vehicle in the yard under cover. He was told he could not. Mr. Jonas was advised the vehicle still needed to be licensed, registered and operable, and the respondent explained it was. He had a six- foot fence and the vehicle was in his backyard. The photograph showed the vehicle in question did not have a tag on it. It was explained to Mr. Jonas the vehicle must be street legal. There was also trash and debris in the backyard. The vehicle belonged to his cousin. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Brake moved that this Board find that Tommy Jonas is in violation of the City of Boynton Beach Code section cited and moved to Order that the Respondent correct the violation on or before December 4, 2010. The Board has considered the gravity of the violation, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $250 per day for each day the violation continues past December 4, 2010 plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re- inspection of the property to verify compliance with this Order. Mr. LaRock seconded the motion. 6 Meeting Minutes Code Compliance Board Boynton Beach, FL October 20, 2010 There was discussion that even with the fence, Mr. Jonas could not keep supplies and materials in the yard as it constituted outside storage. It was thought more expedient action would be appropriate. Mr. Brake amended his motion to comply within 30 days by November 19, 2010. Mr. LaRock agreed to the amendment and the motion unanimously passed. Case #10-2549 Edner & Aliette Dorsanvil Property Address: 3504 SE 2nd Street Violation(s): CO CH15 SEC 15-120(D) INC LDR CH2 SEC 4(E) Repair wooden fence. Mow grass and weed. Move truck from corner, blocking view of the intersection. Officer Herring presented the case as contained in the staff report. The initial inspection date was August 20, 2010. Notice was sent giving 10 days to correct the violation. The Notice of violation was sent regular mail on August 30, 2010. Certified mail was sent September 22, 2010 and the return receipt was signed on October 9, 2010. The grass and vehicles were addressed. Only the fence needed repair. Officer Herring had photographs to distribute to the Board. A man whose name and address were inaudible, but was known to be a relative of the Respondent was present and authorized to speak on the Respondent’s behalf. He pled no contest and requested 30 days to repair the fence. Motion Based on the testimony and evidence presented in the aforementioned case, Vice Chair Yerzy moved that this Board find that Edner & Aliette Dorsanvil are in violation of the City of Boynton Beach Code sections cited and moved to Order that the Respondents correct the violations on or before November 19, 2010. The Board has considered the gravity of the violations, the actions taken by the Respondents and any previous violations by the Respondents and hereby orders that if the Respondents do not comply with this Order, a fine in the amount of $100 per day for each day the violations continue past November 19, 2010 plus administrative costs shall be imposed. The Respondents are further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re-inspection of the property to verify compliance with this Order. Mr. LaRock seconded the motion. It was noted the Respondents were repeat violators. Vice Chair Yerzy amended his motion to reflect a fine of $250. Mr. LaRock agreed to the amendment which passed unanimously. 7 Meeting Minutes Code Compliance Board Boynton Beach, FL October 20, 2010 Case #10-2641 Metlife Home Loans (3310 Canal Drive) Property Address: 3504 SE 2nd Street Violation(s): CO CH10 SEC 10-51.5 INC Property that is vacant or subject to default must be registered with the City. Officer Herring presented the case as contained in the staff report. The initial inspection date was September 10, 2010. Notice was sent giving 10 days to correct the violation. The notice of violation was sent September 10, 2010. Certified mail was sent September 27, 2010 and the green card was signed on September 30, 2010. The front yard was mowed but the backyard and the pool had not complied. James Karrat, Esq. 1800 NW 49th Street, Suite 120, Ft. Lauderdale, pled no contest and requested 30 days. The fence was operational but the pool remained in an unsanitary condition. Officer Herring distributed photographs to the Board. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Karageorge moved that this Board find that Metlife Home Loans is in violation of the City of Boynton Beach Code section cited and moved to Order that the Respondent correct the violation on or before November 19, 2010. The Board has considered the gravity of the violation, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $250 per day for each day the violation continues past November 19, 2010 plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re-inspection of the property to verify compliance with this Order. Mr. LaRock seconded the motion. The property needed to be registered. The motion passed unanimously. Case #10-2581 Countrywide Home Loans 906 NW 13th Avenue (906 NW 13th Avenue) Vestiguerne Pierre , Senior Code Compliance Officer, presented the case as contained in the notice of violation and advised the property has a pool. James Karrat, Esq ., 1800 NW 49th Street, Suite 120, Fort Lauderdale pled no contest and requested 30 days to register the property. Since the case was at the certification level, Mr. Karrat requested separate motions be made. The below motion pertained to the unsecured pool. 8 Meeting Minutes Code Compliance Board Boynton Beach, FL October 20, 2010 Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Karageorge moved that this Board find that Countrywide Home Loans is in violation of the City of Boynton Beach Code section cited and moved to Order that the Respondent correct the violation on or before October 30, 2010. The Board has considered the gravity of the violation, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $500 per day for each day the violation continues past October 30, 2010 plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re-inspection of the property to verify compliance with this Order. Mr. Brake seconded the motion for discussion. Mr. Brake thought $1,000 per day was more appropriate. Mr. Karageorge amended his motion to reflect a fine of $1,000 per day. Mr. Brake agreed to the amendment that passed unanimously. The next motion pertained to the property registration, mowing and trimming. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Karageorge moved that this Board find that Countrywide Home Loans is in violation of the City of Boynton Beach Code sections cited and moved to Order that the Respondent correct the violation on or before November 19, 2010. The Board has considered the gravity of the violation, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $250 per day for each day the violation continues past November 19, 2010 plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re-inspection of the property to verify compliance with this Order. Mr. Foot seconded the motion that unanimously passed. Case #10-1336 Countrywide Home Loans 143 NW 14th Avenue Luney Guilliume , Code Compliance Officer, presented the case as contained in the notice of violation. The hearing was July 21, 2010 and no one appeared. The date and fine established by the Board was to comply by July 31, 2010 or incur a fine of $50 per day. The violation still exists. James Karrat, Esq ., 1800 NW 49th Street, Suite 120, Ft. Lauderdale asked they not certify the fine and he would have it addressed as soon as possible. He indicated he did not know why it was not addressed. 9 Meeting Minutes Code Compliance Board Boynton Beach, FL October 20, 2010 Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Karageorge moved that this Board find that the Respondent has not complied with this Board's Order dated July 21, 2010, and having considered the gravity of the violation, the actions taken by the Respondent, that this Board impose and certify a fine in the amount of $50 per day plus administrative costs which shall continue to accrue until the Respondent comes into compliance or until a judgment is entered based upon this certification of fine. Mr. LaRock seconded the motion that unanimously passed. Case #10-1297 Bank of America 848 NW 1st Avenue Pete Roy , Chief Code and Rehabilitation Officer, presented the case. The notice of violation date was April 30, 2010 for violations of the Property Registration Ordinance. The hearing date was July 21, 2010 and no one appeared. The compliance date and fine was to comply by July 31, 2010 or incur a fine of $100 per day. The violation still exists and the property was overgrown. James Karrat, Esq. 1800 NW 49th Street, Suite 120, Ft. Lauderdale had no explanation why the property was not registered. He sent an email to the supervising attorney about the registration for Boynton Beach, urging the matter be addressed for vacant and foreclosed property. He was sure everyone was aware of the issue. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Karageorge moved that this Board find that the Respondent has not complied with this Board's Order dated July 21, 2010 and having considered the gravity of the violation, the actions taken by the Respondent, that this Board impose and certify a fine in the amount of $100 per day plus administrative costs which shall continue to accrue until the Respondent comes into compliance or until a judgment is entered based upon this certification of fine. Mr. LaRock seconded the motion that unanimously passed. Case #10-1642 Countrywide Home Loans 623 SW 3rd Avenue Officer Roy presented the case as contained in the notice of violation. The case was heard on August 18, 2010 and no one appeared. The date and fine established by the Board was to comply by August 28, 2010 or incur a fine of $250 per day. The violation still exists. James Karrat, Esq . 1800 NW 49th Street, Suite 120, Ft. Lauderdale was present. Chair Costantino explained the liens are accruing. Mr. Karrat explained the length of time for the foreclosures and other properties has been set and they do not have the 10 Meeting Minutes Code Compliance Board Boynton Beach, FL October 20, 2010 Certificate of Title. Mr. Brake requested the properties be secured. Unsecured buildings are an invitation for trouble. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Karageorge moved that this Board find that the Respondent has not complied with this Board's Order dated August 18, 2010 and having considered the gravity of the violation, the actions taken by the Respondent, that this Board impose and certify a fine in the amount of $250 per day plus administrative costs which shall continue to accrue until the Respondent comes into compliance or until a judgment is entered based upon this certification of fine. Mr. LaRock seconded the motion that unanimously passed. Case #10-2698 101 SE 27th Ave. LTD – A Pain Clinic of WPB Property Address: 101 SE 27th Avenue Violation(s): CO CH2.5 SEC 2.5-12+13 Excess false alarms and service fee. Mr. Blasie reviewed the case which was a commercial property occupied by a pain clinic medical facility. The violations pertained to the alarm ordinance and were against the property owner and the tenant. The property owner was 1010 SE 27th Ave Ltd. whose address was 971 NW 10th Court. The Pain Clinic 101 27th Avenue was the tenant. The case was a City department referral. The parties were noticed on September 20, 2010 and given 10 days to comply. Certified mail was sent on September 29, 2010 and the return receipts were signed on October 1, 2010. Notice to the property owner was effectuated by personal service earlier in the day. There had been false alarm issues in the past and they previously paid $2,000. They currently owed $1,450. Mr. Blasie spoke with the property owner before the meeting who was unaware of the alarm issue and had no communication from the tenant. Staff recommended 15 days be given for compliance. He reminded the Board members they did not have jurisdiction over the amount of the fines. It was whether they had false alarms. Laurie Schreiber , 971 NW 10th Court, owned the building. She testified no one notifies her if the alarm goes off. The alarm system was programmed to notify whoever was designated and usually the user is notified. The invoices are sent to both parties and there was a previous amount paid on other alarms. The penalty for excessive alarms was based on a sliding scale contingent on the number of times the Police had to respond. When the invoices are sent, it should prompt a call from the recipient to resolve the matter with the City. This incident could have been avoided. 11 Meeting Minutes Code Compliance Board Boynton Beach, FL October 20, 2010 Ms. Schreiber explained the only notification she ever received was when the tenant did not pay the fine. Ms. Schreiber was advised she was responsible for the tenant. Len Jones , 909 SE 3rd Street, Boynton Beach, was the representative of Dr. Jaffe and was authorized to speak on his behalf, pled not guilty. He explained on November 29th they had a break-in. The doors, cameras, internet and telephone lines were all damaged. Due to the medications they keep on site, they sought an alarm system. Te first violation occurred on December 23rd. Mr. Blasie reviewed the history of the alarms. He prefaced his list by advising the tenant is granted three free false alarms per fiscal year which runs October 1 through September 30th. On December 23, 2010 there was a false alarm – no charge  On April 10, 2010 there was a false alarm – no charge  On April 17, 2010 there was a false alarm – no charge  On April 17, 2010 there was another false alarm - $200 charge  On May 1, 2010 there was a false alarm - $500 charge  On May 8, 2010 there was a false alarm - $750 charge  On May 12, 2010 payment for the $200 false alarm charge from April 17, 2010  was received On June 22, 2010 payment of $1,250 was received from May 1, 2010 and May 8,  2010 On July 22, 2010 there was a false alarm - $1,000 charge  On August 14, 2010 there was another false alarm $1,000 totaling the $2,000  Mr. Blasie provided the times the alarms sounded. Mr. Jones testified the first alarms were due to the alarm system installation. There were issues between the alarm system and the telephone lines. They put in a radio based alarm as a backup to the wired system and then had issues with that. The vendor caused some of the issues. The payments should not have been made. The alarm that occurred on July 22, 2010 was due to the office manager who was on site with her son. The manager was being threatened in the office and the son hit the panic button and he should not have done so. The son is four years old. A police report was filed regarding the son and the altercation with the manager and a male. Mr. Jones was not sure what the August 14th alarm was about. He suggested someone could have been trying to break in. The vendor checked the system to see if the system operated properly and could not find anything wrong. There was discussion if the system operated properly, it was not a false alarm. It was also noted alarms usually have a call tree. Each office manager at each location gets the call. If the vendor tripped the alarm, they could have advised not to call the police. 12 Meeting Minutes Code Compliance Board Boynton Beach, FL October 20, 2010 Mr. Foot contended the Respondents say they are not guilty for a variety of reasons, but it is their responsibility. Mr. Jones requested the fines be reduced. Mr. Blasie explained the Respondents are invoiced the 1st of the month after a fine is imposed. The alarm company was working on the problem at the time they incurred some previous alarms that were paid. They have the option to appeal the fines and Mr. Blasie offered to review it provided they supply the alarm company information that occurred concurrent to the alarms. If they have documentation, he may be able to reduce or waive the fines. A motion for both the tenant and the property owner was needed. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Foot moved that this Board find that 101 SE 27th Avenue LTD is in violation of City of Boynton Beach Code Section as cited, and moved to order that the Respondent correct the violations on or before November 19, 2010. He received the letter regarding non-compliance for this hearing, and advised the work was done but he did not notify anyone the work was completed. Officer Roy re- inspected the driveway on September 8, 2010 and the driveway and other violations existed. Later he did observe the driveway was patched, but the property was still overgrown and had trash and debris. When it was time to re-inspect for the hearing, the property was not as overgrown as it was but there was still trash, lying around. Officer Roy showed the photographs to Mr. Hassan. The property was not fully complied. Mr. Hassan requested seven days. The driveway, trash and maintaining the grass were the violations. Currently, two of the violations remained. Case #10-1814 Job Sylvain 620 NE 7th Avenue Motion Based on testimony and evidence presented in the aforementioned case, Vice Chair Yerzy moved that this Board find that the Respondent,Job Sylvain was in violation of the City of Boynton Beach Code sections as cited subsequent to the date of compliance specified in the Board's Order of August 18, 2010, and in consideration of the gravity of the violations and the actions taken by the Respondent to remedy the violation and the previous violations of the Respondent, that this Board impose and certify “No Fine.” Mr. Karageorge seconded the motion that unanimously passed. He had several computer issues resulting in him not attending the meetings.
