Minutes 05-15-84MINUTES OF THE REGULAR CITY COUNCIL MEETING HELD AT CITY HALL, BOYNTON BEACH, FLORIDA, MAY 15, 1984 PRESENT Carl zimmerman, Mayor Robert Ferrell, Vice Mayor Nick Cassandra, Councilman James R. Warnke, Councilman Peter L. Cheney, City Manager Betty S. Boroni, City Clerk James W~ Vance, City Attorney Mayor Zimmerman called the meeting to order at 7:30 P. M. He welcomed Cub Scout Leader Bill Lawson and Pack 280 and announced they are present this evening to observe how the City Council works. He also announced that Councilman Wright will not be present this evening because he has to attend a meeting of the Community Action Board. Mayor zimmerman announced we are glad to have with us Reverend Nathaniel Sniffin of St. Joseph's Episcopal Church to give the invocation. He requested everyone to remain standing after the invocation for the Pledge of Allegiance to the Flag led by Councilman Warnke. AGENDA APPROVAL Councilman Cassandra stated he would like to add under Administrative, Item F - Memos from Councilman Wright in reference to the 10th Avenue dedication budget and Youth Advisory Council. Councilman Warnke asked if the date under Item VII-E was for a City Council meeting or Planning & Zoning Board meeting on June 19 and Mr. Cheney informed him it was the date of the Planning & Zoning Board meeting. Mr. Cheney stated under Administrative, Item D, he would like to add something regarding Jog Road. Also, under the payment of bills, he has an additional bill from United Steel Erectors in the amount of $44,884.83 for a new lift station at the Sand Castle project. Mayor Zimmerman stated he has an additional proclamation under Announcements regarding National Safe Boating Week. Councilman Warnke moved to accept the agenda, seconded by Councilman Cassandra. No discussion. Motion carried 4-0. ANNOUNCEMENTS Mayor Zim~erman read a proclamation proclaiming the week of May 27 thru~ne-~.~-t~3~4, to be Soil Stewardship Week. The Mayor read a proclamation proclaiming June 3 through June 9, 1984, as "Life. Be In It." Week. - 1 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA MAY 15, 1984 Mayor Zimmerman read a proclamation proclaiming the week of June 3, 1984, as National Safe Boating Week. Mayor Zimmerman announced that City Hall will be closed on Monday, May 28, 1984, in observance of Memorial Day. Councilman Warnke added along with this on May 28, at 10:30 A.M., there will be a solemn parade by the veterans' organi- zations from the civic center to the cemetery with a cere- mony to be held at 11:00 in observance of fallen comrades. He urged all citizens to attend. Mayor zimmerman announced that Representative Dan Mica has arranged to have a meeting at Florida Atlantic University concerning HMO's for senior citizens. This meeting will be held on May 25 at 9:00 A.M. and the speaker will be from the House on Aging Committee. Presentation of Supervisory Certificates Mr. Cheney announced this is another presentation relative to the program the city has been participating in with four to five other cities in Palm Beach County through Palm Beach Junior College. With recognizing we don't spend enough time giving training opportunities to employees, we have deve- loped this program of "Effective Supervisory Practices" to give employees who have not had the chance to study the principle of supervision in group session. We have seen positive results. We think these programs are beneficial to the city. Mayor Zimmerman then presented certificates to the following employees: Keith Gorles, Utilities Michael Yura, Utilities Clyde Milor, Utilities Anthony Albury, Building Maintenance Mark Ladd, Public Works, and Daniel Perales, Parks Department, also completed this course, but were unable to attend. MINUTES Regular City Council Meetinq Minutes of May 1, 1984 Councilman Cassandra moved to accept the minutes of May 1 as presented, seconded by Councilman Warnke. Motion carried 4-0. - 2 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA MAY 15, 1984 Special City Council Meeting Minutes of May 9, 1984 Councilman Warnke moved to accept the minutes of May 9 as presented, seconded by Councilman Cassandra. No discussion. Motion carried 4-0. CITY MANAGER'S REPORT Water Plant Open House Mro Cheney reported that a successful open house was held at the water plant with many more people coming this year than in previous years. He explained how the tour was very complete and thanked those who came, the employees involved from the Utilities Department, and the volunteers from the water conservation project. It is anticipated to have it more than two days next year. He told about many impressive comments being received. Refinancing of Outstanding Utility Bonds Mr. Cheney announced that we did complete the formal part of the refinancing of our outstanding utility bonds last week. This will be finalized at the end of the month. It took place successfully. The average interest rate which we sold the bonds for is 9.832, which relates to the general.market for the day. The bond~_issue had an A rating assigned to it. Golf Course Mr. Cheney referred to receiving continuing phone calls asking when the course will be opened and advised that the Golf Course Advisory Committee met this week and about 35 people attended and asked questions. There was a general feeling by these people not to open the course too soon with taking the premise of hurting the grass before it can grow. In line with that, we are tentatively picking the day of June 6 as the opening day contingent on all the last things being finished and functioning, all deliveries being made on time, the weather not creating problems, etc. We are 95% confident that June 6 is the real date and will have a celebration that day. PUBLIC AUDIENCE Mayor zimmerman explained how the procedure for public audience was to follow a rotation basis. Also, anyone may register their name with the City Clerk if they wish to speak on any item on the agenda and their name will be called when that item comes up on the agenda. - 3 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA MAY 15, 1984 Golfview Harbour Mr. Leonard Kanonik, 1330 S.W. 28th Avenue, referred to coming before the City Council about one year ago in reference to problems in Golfview Harbour and thanked Chief Hamilton and Captain Hilliary for taking care of this. Mr. Kanonik then told about city equipment replacing sidewalks in the area of Lucille & Otley's Restaurant and stated he has been waiting in Golfview Harbour for a couple years to get the stop signs repaired. Mr. Cheney informed him that there is only one sign man and he is continually replacing signs. We will check llth Street again. In regards to sidewalks, new sidewalks are put in by develo- pers, but we keep them repaired. In connection with the Lucille & Otley's Restaurant area, there were a couple sidewalks broken because of utility repairs and he explained how the entire area is checked for replacements to be done at the same time. We do have a continuous replacement sidewalk program. Councilman Cassandra asked if he was aware there was a city provision that we would repair existing sidewalks and Mr. Kanonik replied that he did not know that existed, but the city makes different rules and regulations by the week or day. Mr. Cheney disagreed and advised we have been repairing sidewalks for five years. If a sidewalk is broken and there is heavy pedestrian traffic, the city will repair it. Mr. Kanonik then asked if there are special interest groups here which can buy property and be grandfathered in and Mr. Cheney replied that if he is making an allegation to please identify the property. Mr. Kanonik stated that Gulfstream Lumber Co. is buying property from Beane, which was grand- fathered in twice. Mr. Cheney advised that Councilman Cassandra answered him in reference to this. Councilman Cassandra informed him that recently an eagle scout marked down the needs of our signs as a special scout program. Due to his efforts, there is a program to pick up those areas which have immediate needs versus other areas. As far as the other statement, he does know Mr. Kanonik voiced a complaint and it was registered to the City Manager and he will give him a copy of that response. Mr. Kanonik stated that some of the streets in Golfview Harbour do not even have name signs and Mayor Zimmerman informed him this will be taken care of. - 4 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH' FLORIDA MAY 15, 1984 Jewish War Veterans Mr. Jack Dashev~ Jewish War Veterans, told about meeting with Mayor zimmerman and Councilman Warnke and special efforts of their organization. He told about sponsoring an essay contest at local schools and how they awarded the children. It was also suggested to them that they erect a sign at Veterans' Park and they have purchased this, but have a problem needing transPoration to bring this to the city and need help to get it erected. He requested a letter of approval for this sign from Mr. Charles Frederick, but still has not gotten this letter of appr°val after waiting over three months. Mr. Dasher*continued that about 2~ months ago, they received three signs from the National Headquarters of Jewish War Veterans saying: "Protect our Children" and he took these to Mr. Frederick's office about ten weeks ago requesting these be put at the entries to the city. Mr. DasheV*then told about the Jewish War Veterans meeting at the Royal Palm Clubhouse and spending $1,200 to buy cere- monial flags. They cannot carry these flags around and would like to store them in cabinets in the kitchen of the clubhouse. He told about being given various reasons for not being able to use these cabinets and requested that they be allowed to store the flags there. Councilman Warnke expressed his apology for the delay on the sign approval and explained that the Parks & Recreation Department indicated they wanted to find out if other veterans' posts wanted to participate. Councilman Warnke moved to have the City Manager have the Parks & Recreation Department cooperate with the Jewish War Veterans and have that sign erected by city departments. Councilman Cassandra seconded the motion. Under discussion, Mr. Cassandra stated he is concerned downtown development may have this parcel under consideration where the park is located and he would hate to see the money spent if there are other ideas for the park. Mr. Dasher*requested that a vote be taken on this motion with including an addendum if there are other plans for development to let them know, so they don't wait for six months. Mr. Warnke commented that it will probably be two to three years before the park would be changed by downtown development and he is sure there could be other places in the city which could be dedicated to veterans. Mayor Zimmerman stated that he recently saw the design of that sign and discussed it with several city - 5 - *Spelling of name corrected - see minutes of 6/5/84 REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA MAY 15, 1984 officials and the recommendation is the sign read "presented by the Jewish War Veterans". Mr. Cassandra asked if there was any problem with this motion as far as ordinances and Mr. Cheney replied negatively and he doesn't think the other veterans' associations have been involved in this. Mr. Warnke referred to a permit being needed to erect the sign and Mr. Dasher*responded that they just wanted a letter. Mayor Zimmerman clarified that the motion was to authorize the erection of this sign with the changes and conditions discussed. Motion carried 4-0. Mro Dasher*asked about the installation of their little signs and Mr. Cheney replied that he did discuss these with him and explained if they are similar to the other service signs located at the two entrance ways to the city without other messages, they could be installed. However, the sign in his office is not that kind of sign. Mr. Dashev* disagreed and the message to protect our children with their name indicates their presence and he believes that message is more important than where they meet. After further discussion, Councilman Cassandra suggested that the coun- cilmen meet with the City Manager and loOk at the sign and it should be put on the next agenda for discussion. Councilman Cassandra referred to his third item regarding the storing of the flags and stated he believes the City Manager and Mayor responded t6 this and he doesn't know if the Council should get involved. He suggests that they com- municate one more time with the City Manager. Councilman Warnke referred to this being discussed at a previous meeting and advised that a motion was voted on unanimously to deny this request and it cannot be reconsidered. Mr. Cassandra stated he would like to see if there is a way to bring this up again. Mr. Cheney advised that it is a simple issue and explained that some of the lockers are used for our purposes and others are for the original owners of the old clubhouse. Mr. Cassandra asked if it would be possible to put a trunk in some area for storage of these flags and Mr. Cheney replied the only storage area is in the kitchen. Mr. Dashe referred to Mr. Cheney's letter saying the city possibly may need these empty cabinets in the future and advised they will gladly let them be used then. He will discuss this further with Mr. Cheney. CONSENT AGENDA A. Approve Placement of One Construction Trailer at Boynton Lakes, Phase II The Building Department recommends approval of this request for this construction trailer which would remain on site for the duration of this project, approximately three years. H. Approve Community Relations Board Recommendation for Hospice Grant The Community Relations Board requests that the City Council concur in their action to provide $3,000 to Hospice by the Sea, Inc. from General Revenue Sharing Funds. BIDS NONE PUBLIC HEARING Approve request for annexation of a .677 acre parcel of land described as Lot 39, Amended Plat of Tradewinds Estates sub- mitted by Carl and Martha Grummons. This parcel of land is located on Old Dixie Highway, 289 feet south of Miller Road Mr. Annunziato informed the Council this request was reviewed by the Planning & Zoning Board at a public hearing and this and the following application come to the Council with a positive recommendation subject to staff comments as noted in the report submitted with the memo. Approval is recommended. Mayor Zimmerman asked if anyone representing the owner was present and Mrs. Martha Grummons came forward and stated she would be happy to have this property annexed. Councilman Warnke asked if the purpose of ~annexation was because the - 8 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA MAY 15, 1984 county would not rezone it and Mrs. Grummons replied that it is a pocket of county land in a rundown community where people do not care to live. Councilman Cassandra asked if she has read the staff comments and is in agreement and Mrs. Grummons replied affirmatively. Mayor Zimmerman asked if anyone wished to speak in favor or opposition to this annexation and received no response. He then declared the public hearing closed. Vice Mayor Ferrell made a motion to approve this request, seconded by Councilman Cassandra. Motion carried 4-0. Approve request to show annexed land as local retail and to rezone from Palm Beach County RM - Medium Density Residential Multi-Family to Boynton Beach C-3 - Community Commercial, a .677 acre tract of land, submitted by Carl and Martha Grummons. This parcel of land is located on Old Dixie Highway, 289 feet south of Miller Road. Mayor Zimmerman referred to the Council previously discussing this and asked if anyone wished to speak in favor or opposition to this land use change and received no response. He then closed the public hearing. Mr. Ferrell made a motion to approve this request, seconded by Mr. Cassandra. No discussion. Motion carried 4-0. Approve request to amend the future land use element from moderate density residential to high density residential and to rezone from R1A - Single Family Residential to R-3 Multi-Family Residential a parcel of land_in Beverly Hills, Third Addition, on the west side of NW 4th Street between Ocean Avenue and NW 1st Avenue submitted by Ariel Arenado for Numero Uno Capitol Corporation/Primera Del Sur Corp. Mayor Zimmerman read a letter from Attorney Andy Morodis requesting a continuation until June 5, 1984, in considering this request. Councilman Cassandra questioned if this is a normal request and Mr. Annunziato informed him that the applicant is the city attorney for the City of Deerfield Beach and he is unable to be present tonight. Mr. Cassandra asked if it was necessary for the applicant to be present and Mr. Vance replied negatively. Mr. Cassandra questioned if it would be subject to challenge and Mr. Vance replied negatively as it has been scheduled, but the applicant has requested a continuation and it is a judgment call on the Council's part. After further discussion, Mr. Vance informed the Council it would be appropriate to make a deci- - 9 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA MAY 15, 1984 sion to continue this matter, hold a public hearing and reach a decision, or continue the public hearing until the requested date. Mr. Warnke made a motion to deny this request for a continuance, seconded by Mr. Ferrell. Motion carried 4-0. Mr. Annunziato informed the Council the purpose for this rezoning would be to allow the applicant to consolidate his ownership and gain density to allow multi-family units to be built. A negative recommendation has been forwarded from the planning staff based on the three reasons noted in the memo of April 27, 1984. The Planning & Zoning Board recom- mended this application be denied. He then showed a map and explained the location. Mayor Zimmerman asked if anyone was present representing the developer and received no response. He asked if anyone was in favor of this rezoning and received no response. He then asked if anyone was opposed to this rezoning and the following came before the Council. Mr. Earle Waters stated he represents fifty property owners who signed a petition which he presented to the Planning & Zoning Board and they unanimously turned down this request for rezoning. He explained how the property owners feel this would be the beginning of spot zoning and the result would be the rezoning of empty lots around the city. The residents in this area feel this rezoning will lower the value of their property. They are opposed to the rezoning of this property. Mayor Zimmerman referred to having a long agenda and requested the people opposed to this application to stand up and noted at least 24 people responded. Mr. Ray Bush, 458 N.W. 1st Avenue, referred to there being two houses on this property and stated the rezoning would allow about eight families. The value of the land would increase if rezoned and this man could make a fortune. This would cause traffic congestion. Mayor Zimmerman referred to the Technical Review Board and Planning & Zoning Board recommending denial of this request and then declared the public hearing closed. Vice Mayor Ferrell made a motion to deny this request, seconded by Councilman Warnke. No discussion. Motion carried 4-0. - 10 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA MAY 15, 1984 At this time, in view of the number of people exiting, Mayor Zimmerman declared a recess. He then reconvened the meeting at 8:50 P. M. Approve conditional use application submitted by Ronald and Karen Ehster to redevelop an existing house for use as a day care center. The proposed Rainbow School and Day Care Center is located at 208 NE 1st Street Mr. Annunziato pointed out the location and explained that the applicant is proposing to redevelop an existing house for day care purposes. There will also be a parking lot in the rear of the house and a fenced-in area. This request went to the Planning & Zoning Board with a positive recom- mendation subject to staff comments. The Planning & Zoning Board unanimously recommended this conditional use be approved. The Community Appearance Board also reviewed and approved. Mayor Zimmerman asked if the owner would like to speak and Mr. Ron Ehster, 3020 Greenwood Lane, Boynton Beach, came before the Council. He clarified that he is not the owner yet, but is in the process of buying the property. He referred to the various zoning uses in this area and explained that their plans were to have 25 to 26 children at a day care center where they will teach the children and not only have day care facilities. He explained the routing for traffic. Also, a stockade wooden fence will be constructed along the south and east sides to shield the noise, plus the property is covered with trees. He told about taking a traffic count and enumerated the possible increase such a school would create. He also submitted a petition to the Planning & Zoning Board with 41 people signing in favor of this application. Ms. Katherine Schmitz, 209 Udell Lane, Delray Beach, read a letter from Karen Ehster outlining her experience and noting her intentions to improve the neighborhood with the recon- ditioning of this single family residence. She feels this downtown area needs a good private day care school. She read the program planned for the school. Ms. Lori Knight, 311 S. W. 5th Lane, Boynton Beach, stated that Mrs. Ehster has taught three of her children and she could not ask for a more caring group of individuals to take care of her children and give a pre-school education. There is not a place in Boynton Beach where children can get an education and be watched. - 11 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA MAY 15, 1984 Mayor zimmerman requested those opposed to this application to come forward. Ms. Bertha Welch, 306 N.E. 1st Avenue, stated there is a letter on file with the Planning & Zoning Board from Boynton Center representing 27 families. The key word is this is a condominium neighborhood. They are sure this family has outstanding qualifications, but there are day care centers at two churches right in this area and they have vacancies. They are opposed to the extra traffic this will bring into their area. Mr. Eric Graupner, 115 N.E. 2nd Street, stated at the Planning & Zoning Board meeting, five individuals spoke in favor to establishing this day care center, but they were not property owners in the immediate area nor residents. He objects to this being in his neighborhood. He expresses opposition against the establishment of this day care center from the residents of the Greenacres Condominium Association. They feel this application was deliberately withheld until most of their residents returned north. He explained how the establishment of this business would interfere with the tranquil lifestyle of this group of senior citizens. He then told about the traffic congestion with the emergency vehicles presently in this area. He respectfully requests this application for the establishment of this day care center be denied. Ms. Mary Jensen, 306 N.E. 1st Avenue, Apartment 210, stated the fact that the Fire Department is across the street from the roadway into this building will create a hazard and she explained. She also explained how the cars going into this property would create a traffic hazard. Also, the house is a fire trap and the safety of the children should be con- sidered. Mayor Zimmerman informed her the roadway entrance is on the west and there would be an exit to the north, so no U turns would be required. Councilman Cassandra added that the building on this property would not be issued a c/o until it meets present codes. Mr. Annunziato agreed with stating the structure would have to meet municipal codes as well as Health Department restrictions. Councilman Cassandra referred to the applicant's presen- tation to the Planning & Zoning Board and stated reference was made to noise and concern for the children, but asked if he evaluated the sudden blast of a siren from the Police or Fire Department as far as the psychological effect. Mr. Ehster explained how the reaction is wide and varied from children, but this is part of the training of children. He - 12 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA MAY 15, 1984 further explained that the Health Department, Fire Marshall and Police Department had come to the house and the inside is satisfactory with a number of exits, but the outside of the house does need a lot of work. Mr. Cassandra asked if the Fire Department comes out onto N.E. 1st Street and Mr. Cheney replied that in most cases, they come out that way and turn north to Boynton Beach Boulevard. Both Ms. Jensen and Mr. Graupner expressed further concern about the traffic congestion and vice Mayor Ferrell replied that he felt this concern is a little over-exaggerated and there will not be a great number of cars all coming at the same time. There would be a hour span for 25 cars. Ms. Jensen disagreed and expressed concern. Councilman Cassandra told about visiting the area personally and finding it noisy with the police and fire stations being located there. He cannot see the concern about having children outside for possibly three hours during the whole day. Mrs. Welch stated she thinks the noise with children playing would be disruptive for some of the older people. She mainly objects to the additional traffic as it is already a busy area. This is an adult residential area. Mr. Cassandra replied that he was hoping that Boynton Beach wasn't zoned with certain adult areas. Mrs. Welch responded that there are two child care centers in the area which are established and are not in such a congested area. Vice Mayor Ferrell made a motion to approve this request, seconded by Councilman Warnke. Under discussion, Councilman Cassandra referred to this being a conditional use request and Mr. Annunziato agreed and added there were several staff comments which Mr. Ehster has agreed to comply with. Mr. Cassandra questioned what happens if these people decide to leave and Mr. Annunziato stated that conditional use is only permitted by specific use of the City Council. This is based upon evidence presented to the City Council. Use is put on the property and conditions run with the use. Mr. Cassandra clarified that if they leave, another day care center could come in, but they must follow the conditions of the original approval. Motion carried 4-0. Approve request to defer Pineland Plaza issues submitted by Digby Bridges for a variance to the redevelopment area mora- torium and site plan approval, parking lot variance, and abandonment. DEVELOPMENT PLANS Approve Time Extension Request for Filing Final Plat - Quai1 Lake West Mr. Cheney referred to the letter from the applicant being self-explanatory and stated the request is clear. However, we have had some conversations in the past how long to extend things. The applicant hopes to get started in a couple months. We don't have any objection to giving this one extension. It can be included in the letter that we do not automatically grant extensions as in the past and it should not be expected if not completed this time. Councilman Cassandra referred to having given one extension of twelve months and stated he has no qualms of granting this extension, but this applicant must follow present codes. Mr. Cheney agreed the present building code must be followed and he doesn't believe there are any significant changes in this site plan. Mr. Annunziato clarified that no site plan has been approved on this property. When a site plan is submitted, it would be subject to current con- ditions. Mr. Cassandra asked if this clause could be added and Mr. Cheney replied affirmatively. Mr. Cassandra clarified that anything going on that land should be according to ordinance. Councilman Cassandra moved to grant this extension with the stipulation that all present codes and ordinances must be followed at the appropriate time, until November 16, 1984. Approve request for a variance to the redevelopment area moratorium and site plan approval to construct a 6,000 square foot industrial storage building plus parking and landscaping. This request was reviewed by the Community Redevelopment Agency and has been found to be consistent with the Community Redevelopment Plan. This request was submitted by John Nichols for Florentine Marble Co., Inc. and is located at 630 N.E. 3rd Street. Mr. Annunziato informed the Council that the Planning & Zoning Board submitted a resolution recommending approval of this request. This resolution also comes with review of the site plan, which was unanimously recommended subject to - 14 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA MAY 15, 1984 staff comments. It was also reviewed by the Community Appearance Board and approved. Mayor Zimmerman asked if the developer cared to speak and received a negative response. Councilman Warnke made a motion to approve this request for a variance to the redevelopment area moratorium as requested by John Nichols for Florentine Marble Company. Vice Mayor Ferrell seconded the motion. Motion carried 4-0. Approve request for a modification to a previously approved site plan to permit the construction of screened enclosures in the patio area of the various units. This request was submitted by Robert Hamilton for SPH Associates and the pro- posed modification is located at N.E. 4th Street at N.E. 22nd Avenue Mr. Annunziato informed the Council this is a request to enclose private areas at The Crossings Condominiums. This will provide a standard for future construction of screen rooms. A positive recommendation was given by the Technical Review Board and the same from the Planning & Zoning Board. Vice Mayor Ferrell made a motion to approve this request, seconded by Councilman Cassandra. Under discussion, Mr. Cheney commented this is positive because many of these developments come in and all kinds of screen enclosures are added afterwards. Motion carried 4-0. Approve request submitted by Norman Michael for the Milnor Corporation, for a modification to a previously approved site plan to permit the construction of a pool and ancillary facilities located at Congress Avenue at S.W. 25th Place and is known as Golfview Harbour Estates. Mr. Annunziato stated this is submitted subsequent to the master plan modification. The applicant requested to change the recreation package. This request was reviewed by the Technical Review Board and went to the Planning & Zoning Board with a positive recommendation subject to comments. The Planning & Zoning Board and Community Appearance Board positively approved. Vice Mayor Ferrell made a motion to approve this request, seconded by Councilman Cassandra. Under discussion, Councilman Warnke clarified this is subject to staff com- ments, since they are significant. Motion carried 4-0. - 15 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA MAY 15, 1984 Approve request submitted by John and Elain Arnold to Construct a 9,000 square foot industrial building to be known as Arnold Warehouse II plus parking and landscaping improvements. This proposed warehouse would be located at 3272 S.W. 14th Place. Mr. Annunziato informed the Council this is a companion building to the one currently built. It went to the Planning & Zoning Board with a positive recommendation from the Technical Review Board subject to staff comments. The Community Appearance Board also approved. Councilman Cassandra asked if the dumpster questions have been resolved and Mr. Annunziato replied affirmatively. Mr. Warnke moved that the request submitted by John and Elain Arnold for Arnold Warehouse II be approved subject to staff comments, seconded by Mr. Cassandra. No discussion. Motion carried 4-0. Councilman Cassandra announced that it may be appropriate to let the people know the majority of the Council attended the Planning & Zoning Board and Community Appearance Board meetings and heard complete presentations. Approve request submitted by Mr. Alan Strassler for 1st American Bank and Trust, to construct two four-story office buildings totaling 80,000 square feet plus parking lots and landscaping to be located on Congress Avenue at the north entrance of Boynton Beach Mall. Mr. Annunziato stated this is the second request for out- parcel development at the Boynton Beach Mall. It went to the Planning & Zoning Board with a positive recommendation from the Technical Review Board subject to staff comments. Additionally, the Planning & Zoning Board recommended approving the 10 ft. height exception as addressed in Section 4(f) of the Zoning Code. It was unanimously recom- mended for approval subject to staff comments by the Planning & Zoning Board. Councilman Cassandra requested clarification as an addi- tional 10 feet is close to another floor in concept, which would imply five stories. Mr. Strassler stated the building is four stories, 45 feet in height. He explained how all modern buildings have the mechanical appurtenances placed on the roof because they are normally undesirable things to see. He showed a sketch of the building as it would be seen from ground level. He then explained further the architec- ture and construction materials of this building. - 16 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA MAY 15, 1984 Councilman Cassandra questioned why ten feet was needed when other applicants have only needed six feet and Mr. Strassler replied that ten feet is an estimate and the mechanical system has not been designed as yet. Mr. Cassandra asked if it would be greater than ten feet and Mr. Strassler replied negatively, but it could be less. Councilman Warnke referred to it being reflective glass on the exterior and asked how this would be protected during a hurricane and Mr. Strassler replied that the glass and fra- mes are designed to withstand 120 mile per hour winds. Further discussion followed about this construction and Mr. Strassler assured him it would be built according to code. Mayor Zimmerman questioned how far back the penthouse will be from the edge of the roof and Mr. Strassler replied about 25 to 30 feet. Mayor Zimmerman clarified that it will be in the central part of the roof and Mr. Strassler agreed. Mr. Ferrell asked how large the penthouse will be and Mr. Strassler replied that the roof is about 100 square feet and the penthouse would be 50 to 60 square feet. Mayor zimmerman asked if both buildings would be built at once and Mr. Strassler replied negatively as it will be done in two phases. Mr. Cheney informed the Council when the ordinance was writ- ten, it excluded mechanical equipment within or on top of the roof and the building could be 45 feet or four stories. Most codes include the screening of the equipment, but this was not included in our code. Another building had a simi- lar request and it went to the Board of Adjustment for interpretation and they stated screening is part of the mechanical equipment and is exempt from the 45 ft. height limit. Councilman Cassandra moved to accept the unanimous recommen- dation of the Planning & Zoning Board for First American Bank and Trust construction with all staff comments. Vice Mayor Ferrell seconded the motion. Under discussion, Mr. Vance asked if the 10 ft. height exception was includedLand Mr. Cassandra replied affirmatively. Mr. Warnke stated he has nothing against this, but we should take a look at tightening our code for 120 mph winds. The wind limit should be raised in the future. Motion carried 4-0. - 17 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA MAY 15, 1984 Approve request submitted by Mr. Sam Scheiner, President of the Condominium Association for Los Mangos, to construct screen enclosures for each of the three different kinds of units at the Los Mangos Development located on S. Federal Highway at S.E. 28th Court. Mr. Annunziato referred to this development having two dif- ferent kinds of duplexes and four unit townhouses and advised these screen enclosures will provide to meet the needs of different units. The Technical Review Board recom- mended approval and the'Planning & Zoning Board reviewed this request and recommended approval as submitted. Mr. Sam Scheiner, 528 S.E. 27th Terrace, complimented the Planning Department, Community Appearance Board and Planning & Zoning Board for their action in getting this through in a short time. He introduced the architect who worked on the drawings. Councilman Cassandra referred to there being a question about Florida Power & Light Co. being able to get between the two buildings and Mr. Scheiner replied this has been resolved with a two feet wide opening being sufficient. Discussion of Expanding Recreation & Parks Board by One Mr. Vance informed the Council this will require an ordi- nance amendment. Councilman Cassandra explained that he was concerned about getting youth onto some of our boards, but possibly it should be limited to youths 17 to 21 years of age if it won't create problems. Maybe it should be clarified by saying "youth oriented". He would like to have~ someone actively involved in recreation possibly par- ticipating as an alternate member. Mr. Vance suggested adding an alternate and someone would be chosen from that age group to be this alternate. Discussion ensued about the age and whether it should be stated this member should be a high school student residing in Boynton Beach. Mr. Vance suggested this could be accomplished by adding an advisory member. After discussion, Mr. Cassandra moved to direct the City Attorney to draft the proper amendment to the Parks & Recreation Board. Councilman Warnke seconded the motion. Under discussion, Mr. Vance asked if a high school was located within the city limits and Mr. Cheney replied nega- tively, but it could be a student living in the city. Discussion to Consider Two Members for Community Relations Board Councilman Cassandra stated this is one board which he feels probably could use an increase and not in alternate concept because of the activities they are involved with. Mrs. Dee Zibelli, Chairman of the Community Relations Board, came forward. She advised that the board decided seven mem- bers are not enough to do what they plan. They would like to have the membership increased to nine and if two alter- nates are wanted, that is okay. Vice Mayor Ferrell agreed that it should be increased in membership and also include a couple alternates. Mayor Zimmerman clarified that he was talking about eleven members and Mr. Ferrell agreed. Mrs. Zibelli told about this board having eleven members in 1981 and how they accomplished much and worked well together. Councilman Cassandra suggested just adding two members at this time and seeing how it works out. Vice Mayor Ferrell made a motion to go with two new members and two alternates for a total of eleven members for the Community Relations Board, seconded by Councilman Warnke. No discussion. Consider request of CRA to set date for City Council Public Hearing on Community Redevelopment Area Plan and consider request of CRA in letter of April 27, 1984, from Hank Thompson to Mayor and City Council - 22- REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA MAY 15, 1984 Mr. Hank Thompson came forward and introduced the members of the Community Redevelopment Agency present. He referred to submitting the community redevelopment plan and advised that a public hearing is required before passage. He is hopeful the plan will be adopted with a minimum amount of change. He then explained that a CBD ordinance must be prepared to control this plan. Councilman Cassandra asked if a workshop could be held before the public hearing and Mr. Vance replied this could be done, but the advertising requirement of 14 and 5 days before the public hearing must be met. After discussion of possible dates, it was agreed to hold a special meeting and public hearing on July 5. Mayor Zimmerman commented that he didn't see how the ordi- nance could be approved until the plan is approved and Mr. Thompson replied the majority of the ordinance could be done. Councilman Cassandra referred to there being questions raiSed and stated he would like to set up workshops to get things cleared up before the public hearing. Mr. Haygood advised that he will come back to the City Council with the legislation to clarify at the June 5 and June 19 meetings. Vice Mayor Ferrell stated he would also like to discuss the financial request at the workshop meeting. Mr. Thompson thanked Mayor Zimmerman and Councilman Warnke for their com- munications. He added that Mayor Zimmerman made suggestions to secure financing through five different sources and explained how these were not available to the Community Redevelopment Agency. He referred to submitting a proposed budget and stressed that they will repay any funds forwarded from the tax increment financing. Mr~ Thompson Stated that someone is needed immediately to start on the downtown development work. A part-time execu- tive director is needed right away. Any funds given to the agency will not be used for anything but administration of the agency and none for downtown development. Councilman Cassandra stated that he doesn't have the same confidence in Urban Design Studios as expressed by the agency and he explained. Mr. Thompson agreed certain cri- teria wasn't followed, but stated that Urban Design Studies was paid to give a professional opinion. Mr. Thompson referred to the request of $15,000 to develop the CBD ordinance and Councilman Warnke asked what this - 23 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA MAY 15, 1984 ordinance involves and Mr. Thompson replied that we have a central business district, but no ordinance controlling it. Councilman Cassandra referred to the request being for $150,000 for the next two years and stated he would need more time to study that. He asked if they would also pay back the original money and Mr. Thompson replied affir- matively. Further discussion ensued in reference to this request and Mr. Thompson advised that they had hoped for approval tonight with having many things to do. Mr. Ferrell asked if certain portions could wait and Mr. Thompson replied affirmatively, but they wo~ld like first to extend the contract with Urban Design Studios. He would appreciate any expression tonight so they know whether to consider the entire budget for the year. Mr. Cassandra stated he thought it would be advantageous for the Community Redevelopment Agency to allow the City Council to review it a little bit. Councilman Warnke agreed as the revised plan was just received tonight. Councilman Warnke questioned where the money would come-from if approved tonight and Mr. Cheney explained that it would be the same as the golf course with loaning money and being repaid when the tax increment financing income starts to come in at the rate of 50%. After further discussion, Mr. Cheney announced this would be put back on the agenda for the next Council meeting. OLD BUSINESS Wastewater Plant Overflow by Delray Beach - Postponed from City Council Meeting of April 16, 1984 Mr. Cheney told about discussing this issue with Delray Beach and how they are spending money now to reduce the amount of flow coming in. We will keep track of what they are using. In preparation for next year, Mr. Federspiel has been requested to write an agreement consistent with the Interlocal Agreement for the two city attorneys to consider which the Board could adopt and if they use more next year, we will benefit. The Council will be advised on this periodically. NEW BUSINESS Consider Drainage Projects Fiscal Year 1983/84 (Tabled) Mr. Warnke moved to take this off the table, seconded by Mr. Cassandra. Motion carried 4-0. - 24- REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA MAY 15, 1984 Councilman Cassandra referred to the staff being qualified to know what areas need drainage taken care of and moved to accept the recommendations of the City Manager as far as the priority of drainage projects for the fiscal year. Councilman Warnke seconded the motion. Under discussion, Mro Cassandra asked if these would be done in any particular order and Mr. Cheney replied negatively, but he thinks all can be accomplished. Motion carried 4-0. Consider Projects to be Funded by City Two Cent Gas Tax Receipts (Tabled) Councilman Warnke moved to take this from the table, seconded by Councilman Cassandra. Motion carried 4-0.' Mr. Cheney referred to a memo submitted by Councilman Warnke this week regarding a long-standing problem across the street at N.W. 1st Street and N.W. 1st Avenue and explained how he would like to put in a concrete walk, curb, gutter and positive drainage in this area because of the amount of pedestrian traffic. This would cost in the range of $12,000 to $13,000. Councilman Cassandra questioned what percentage this would be of the total and Mr. Cheney replied about 10%. Mr. Cheney continued that some of the things on the list he submitted have been taken care of and reviewed the projects listed. He suggested consideration being given to a shared sidewalk assessment program. Mayor Zimmerman referred to Item H and Mr. Cheney enumerated this list to be constructed to be consistent with the comprehensive plan. He clarified that he was concerned there may be some additional areas. Mr. Cassandra Suggested that the City Manager compile a preferred priority list. After discussing various locations, Mr. Cheney advised that he will put together some lists reduced from this and addi- tions can be submitted from the Council. Industrial Revenue Bond Screening Committee Report - Accurate Leather & Novelty Company Mr. Cheney distributed an updated Dun & Bradstreet report. Councilman Warnke stated that he went over this company's report and they seemed to be on the edge of making a profit. Mr. Cheney advised that representatives are present. Councilman Cassandra referred to the Council making a deci- sion whether we want this type of industry here and moved to direct the City Manager or City Attorney to proceed in the - 25 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA MAY 15, 1984 next step with the bond counsel and prepare a letter of inducement. Approve Boat Club Park Consultant Selection Mr. Cheney referred to the plan being submitted and advised we have been working on the funding pending from the state and the money is in place for this project. He explained that we now have to select a consultant and a report has been submitted, plus Mr. Frederick is present to give any further information. He concurs with the recommendation, but if the Council is not comfortable with that, they may set up interviews with the consultants. Councilman Cassandra referred to there being nothing to challenge from the screening committee and moved to accept the screening committee's recommendations on the first, second and third selections and go to the next step required. Mr. Ferrell seconded the motion. Under discussion, Mr. Cheney advised the next step is to negotiate with No. 1 and if an acceptable contract can be worked out, he can be hired. If not reaching a negotiable contract, then we proceed to No. 2. It is brought back to the Council when reaching an agreement. The initial design was done by Edward Stone. We went through a process of interviewing and the committee concluded that Edward Stone was No. 1, but Neal, Smith & Associates came out very close. The recommen- dation is Edward D. Stone, Jr. & Associates. Motion carried 4-0. ADMINISTRATIVE Approve Development of Data Processing Capability for Building Department Mr. Cheney referred to a memo being submitted and explained how we were getting into some production problems in data processing because of growth and the number of permits. We would like to move ahead now. It will take a few months to implement. If we don't proceed, we will have to add some people in a few months. Having this system on line will benefit the departments and save clerical time. He explained how the Building Department is busy with inspec- tions, etc. There was discussion about funding and Mr. Cassandra stated he would have liked to see how much money would be saved and Mr. Cheney replied that he could not say how many people we will not hire, but it is a more efficient process and the hiring will slow down. - 26 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA MAY 15, 1984 Mr. Cassandra moved to approve the development of data pro- cessing for the Building Department. Board Appointments Two Alternate Members for Housing Authority Councilman Warnke announced that he has not been able to find a person willing to serve. Councilman Cassandra referred to having problems with this board and suggested possibly they should take a leave of absence for awhile. Mr. Cheney advised that he talked to Mr. Delaney today and there are some things the Housing Authority is working on. After discussion, Mr. Cassandra moved to table and have everyone try to find someone interested to appoint. Vice Mayor Ferrell seconded the motion. Motion carried 4-0. Report on Golf Course Operations & Jog Road Mr. Cheney explained the memo he submitted and stated he thinks this proposed operation is a way of developing a good stable operation for the municipal course. Councilman Cassandra expressed concern for item 3 since we have not opened the course and questioned implementing programs. Mr. Cheney explained that employees are needed and this will be implemented to follow the established apprentic program, which he feels will eliminate our problems. Mr. Cassandra clarified that he is not against the concept, but is concerned about doing it right away. Mr. Cheney explained that these kinds of people are needed to carry out this function. This is the Golf Course Manager's suggestion to tie into the PGA program. It is recommended that this is the way to proceed. Councilman Warnke asked if there were any problems with water and sewer and Mr. Cheney replied that it is still being hooked up. REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA MAY 15, 1984 After discussion, Vice Mayor Ferrell made a motion to accept this program for the golf course operations. Jo9 Road Mr. Cheney referred to Jog Road being relocated further west and explained that Parkwalk is obligated for a certain amount of off-site improvements and he has convinced them to put a 1" overlay on Jog Road to get that section paved from from LeChalet to the entrance. Mayor Zimmerman asked how long will it be before it is relocated and Mr. Cheney replied in about one year, but he has convinced the county that paving Jog Road is a legitimate extension of the requirements for Parkwalk to supply access to the golf course. He then explained that we will front $9,000 tem- porary funding for this, but will get it back when Parkwalk makes payment in August. Councilman Cassandra asked if Jog Road will be paved from the north and Mr. Cheney explained this was the county's responsibility. There was further discussion about the actual construction of the road and landscaping. Mr. Sciortino added that the county cleaned up the garbage and they-are aware of the dumping problem. He is hoping when it is paved, the dumping problem will cease. Exercise Course for Handicapped - Caloosa Park Mr. Cheney referred to memos being submitted and advised that Mr. Mike Staley, President of the Boynton Beach Sunrise Kiwanis Club, is present and they have taken special. interest in this project. Mr. Frederick further explained this is a wheelchair course on asphalt surface and seven stations are planned similar to the heart trail. Councilman Cassandra asked if the height of the equipment would restrict people without any disability from using it and Mr. Frederick replied that the equipment is heavy wood structure and placed in concrete. Mr. Cheney added that we did have some reservations about the park, but the problems have been resolved. He would like to see us approve this, as it is a great program for the Boynton Beach Kiwanis Club. Vice Mayor Ferrell made a motion to go ahead and split the cost and congratulate the Kiwanis Club on these efforts. Councilman Warnke seconded the motion. Under discussion, Mayor Zimmerman commented that he was asked if any money was involved and even if it cost ten times more, he would like to see it happen.
