Policy INTRODUCTION: The City of Boynton Beach is committed to providing a safe and healthy workplace and to promoting the health and well being of its employees. As required by the
Florida Clean Indoor Act, Chapter 386.201 FS, the City of Boynton Beach Resolution 90-BBB and motivated by our desire to provide a healthy work environment for our employees, the following
policy has been adopted and shall apply to all City employees. POLICY: It is the policy of the City of Boynton Beach to prohibit smoking in all City buildings, facilities and vehicles
in order to provide and maintain a safe and healthy work environment for all employees. The law defines smoking as the “act of lighting, smoking or carrying a lighted or smoldering cigar,
cigarette or pipe of any kind.” SCOPE: The Smoke-Free Workplace policy applies to: All All areas of buildings occupied by City employees. All City sponsored off-site conferences
and meetings. All vehicles owned or leased by the City. All visitors (customers and vendors) to City premises. All contractors and consultants and/or their employees working
on City premises. All temporary employees. All Volunteers. All student interns. 1
Smoking is permitted in: Outdoor areas designated as Smoking Areas. Department Directors are responsible for determining smoking areas within the facilities they operate. Designated
Smoking Areas Facility Location Animal Control Kennel Facility Open area on the east side of the building Art Center South side of the building adjacent to the storage room door Carolyn
Sims Recreation Center No smoking in or around this facility since there is no area that is out of the public eye City Hall, East & West Wing, Police and Fire Courtyard between east
wing and Police Department Civic Center No smoking in or around this facility since there is no area that is out of the public eye Code Compliance Northwest side of the building East
Water Treatment Plant Clearwell deck Ezell Hester Center No smoking in or around this facility since there is no area that is out of the public eye Fire Stations Station Captain will
designate area out of the public view Golf Course Anywhere outdoors as it is customary to permit smoking on a golf course. Smoking is not permitted in any of the buildings. Intracoastal
Park Clubhouse East side of the lower patio Library Northeast corner near the parking lot where the trash bin & ash urn are located Police Dept 2 (old fire station 2) Parking lot on
the east side of the building Police Training Building (range & armory at Miner & Congress Parking lot on the southeast side of the building Public Works Compound 1. Behind Facilities/Solid
Waste Building by the picnic table. 2. Behind the Fleet Maintenance Garage near the trailer 3. In front of the Forestry & Grounds trailer Schoolhouse Children Museum Pavilions south
of the museum that are at least 20 feet away from the front door of the Museum Senior Center No smoking in or around this facility since there is no area that is out of the public eye
Tennis Center No smoking in or around this facility since there is no area that is out of the public eye Utilities Administration Bldg East end of Administration Building picnic area

3 PROCEDURES: We believe that the spirit of thoughtfulness and cooperation, which is characteristic at the City, is adequate to resolve any disputes which might arise under this policy.
Where disputes cannot be so resolved, the rights of the non-smoker shall be given precedence, as required by Boynton Beach Resolution 90-BBB. Employees who violate this smoking policy
will be subject to disciplinary action up to and including immediate discharge. Resolving complaints about smoking: Any complaints about the application of the policy to the workplace
should be brought to the attention of the Division Manager, Department Director or the Human Resources Director for resolution. The complaint should be submitted in writing and identify
specific objections. The City of Boynton Beach will investigate the complaint and resolve it in accordance with the policy. No employee shall suffer any form of retaliation for raising
a complaint or asking a question about this policy. This smoking policy is intended to comply with requirements of the Florida Clean Indoor Air Act. EFFECTIVE: July 5, 1990 REVISED:
