Beach, Florida on the date of hearing stated above. The City Commission having considered the
relief sought by the applicant and heard testimony from the applicant, members of city administrative
staff and the public finds as follows:
1. Application for the relief sought was made by the Applicant in a manner consistent with
the requirements of the City's Land Development Regulations.

3. Buildings, structures and parts thereof shall be designed to withstand the X
minimum wind loads of 140 mph. Wind forces on every building or
structure shall be determined by the provisions of ASCE 7, Chapter 6, and
the provisions of 2007 FBC, Section 1609 (Wind Loads). Calculations that
are signed and sealed by a design professional registered in the state of
Florida shall be submitted for review at the time of permit application.
4. At time of permit review, submit signed and sealed working drawings of the X
proposed construction.
5. This project falls under the guidelines of the Florida and Federal Fair X
Housing Acts. The dwelling units shall comply with the following
requirements:
A) An accessible building entrance on an accessible route shall be provided.
B) Public and common use areas shall be readily accessible to and usable by
people with disabilities.
C) An accessible route into and through the covered dwelling unit shall be
provided.

At the time of permit review, submit details of reinforcement of walls for
the future installation of grab bars as required by the FFHA, Title 24 CFR,
Part 100.205, Section 3, Requirement #6. All bathrooms within the covered
dwelling unit shall comply.

7. CBBCPP 3.C.3.4 requires the conservation of potable water. City water may X
not, therefore, be used for landscape irrigation where other sources are
readily available.
8. A water-use permit from SFWMD is required for an irrigation system that X
utilizes water from a well or body of water as its source. A copy of the
permit shall be submitted at the time of permit application, F.S. 373.216.
9. If capital facility fees (water and sewer) are paid in advance to the City of X
Boynton Beach Utilities Department, the following information shall be
provided at the time of building permit application:
A) The full name of the project as it appears on the Development Order and
the Commission-approved site plan.
B) The total amount paid and itemized into how much is for water and how
much is for sewer. (CBBCO, Chapter 26, Article II, Sections 26-34)
10. At time of permit review, submit separate surveys of each lot, parcel, or X
tract.
11. Pursuant to approval by the City Commission and all other outside agencies, X
the plans for this project must be submitted to the Building Division for
reView at the time of permit application submittal. The plans must
incorporate all the conditions of approval as listed in the development order
and approved by the City Commission.
12. This structure meets the definition of a threshold building per F. S. X
553.71(7) and shall comply with the requirements of F.S. 553.79 and the
CBBA to the 2004 FBC, Sections 109.3.6.1 through 109.3.6.6.
The following information must be submitted at the time of permit
application:
A) The structural inspection plan must be submitted to the enforcing agency
prior to the issuance of a building permit for the construction of a
threshold building.
B) All shoring and re-shoring procedures, plans and details shall be
submitted.
C) All plans for the building that are required to be signed and sealed by the
architect or engineers of record shall contain a statement that, to the best
of the architect's or engineer's knowledge, the plans and specifications
comply with the applicable fire safety standards as determined by the
local authority in accordance with this section and F.S. Section 633.
13. If this project is located within the Downtown Stormwater Improvement X
Watershed, appropriate fees must be paid to the City of Boynton Beach

Justification-Conditional Use
As indicated in Code Section 11.2.B, the proposed assisted living facility (nursing or convalescent
facility by definition) must be approved as a conditional use. Accordingly, as required by Code
Section 11.2.D, the Planning & Development Board and City Commission shall consider the
following standards to grant the conditional use. This application has satisfactorily provide for
these standards as indicated below.
1. ingress and egress to the subject properly and proposed structures Thereon, with
particular reference to automobile and pedestrian safety and convenience, traffic flow
and control, and access in case of fire or catastrophe.
• For mixed use projects along Federal Highway, access is preferred to be from a side
street. In this case, the property is located mid-block however it spans from Federal
Highway through to SE 4th Street. Accordingly, there is no access on Federal Highway
and only from SE 4th Street. The parking lot flow allows for unobstructed circulation to the
building for vehicular, pedestrian and fire access. Pedestrian circulation is also provided
from the public sidewalks
2. Off-street parking and loading areas where required, with particular attention to the
items in subsection D.1. above, and the economic, glare, noise and odor effects the
conditional use will have on adjacent and nearby properties, and the city as a whole.
• The parking lot and loading area is located on the western half of the site plan which
allows the building to be located nearer to Federal Highway as desired for the mixed use
zoning. Properties to the north and south are eligible and likely to be redeveloped with
similar mixed use. The proposed conditional use, assisted living, is a low impact use
relative to traffic, noise, odors and other City services. Accordingly, this standard has
been met.
3. Refuse and service areas, with particular reference to the items in subsection D.1. and
D.2. above.
• The refuse area for this project has been incorporated into the building design but
located with straight on access from the access drive. The refuse containers will be
concealed behind decorative swing doors and rolled out and back in facility employees
on pick up days. The parking circulation will allow the garbage tracks to circulate
through for easy access. Accordingly, this standard has been met.
4. Utilities, with reference to locations, availability and compatibility.
• Utilities are readily available to serve the site from the east and west sides of the property.
The extension of the utilities to the building is shown on the provided plans. Accordingly,
this standard has been met.

5. Screening, buffering and landscaping with reference to type, dimensions and character.
Screening and landscape buffering has been provided on all sides of the property
including accent landscaping within the plaza area along Federal Highway. The
landscape program, including the preservation or relocation of existing trees is depicted
on the provided landscape plans. Accordingly, this standard has been met.
6. Signs, and proposed exterior lighting, with reference to glare, traffic safety, economic
effect, and compatibility and harmony with adjacent and nearby properties.
• Give the low intensity use, there will be minimal signage proposed for the project.
Lighting will comply with minimum standards within the parking lot and courtyard to
provide safety for the residents, employees and guests of the facility. The provided
photometric plans shows that there will be little to no light spillage outside of the property
boundaries. Accordingly, this standard has been met.
7. Required setbacks and other open spaces.
• Building setbacks are a maximum of 10 feet along Federal Highway and S.E. 4th Street
and a minimum of 10 feet along the north and south property lines. The proposed facility
meets or exceeds the setbacks along Federal Highway and the north and south property
line. A variance has been requested for the setback from S.E. 4th Street to allow for the
parking field to be screened from Federal Highway. Accordingly, with the approval of
the variance, this standard has been met.
8. General compatibility with adjacent properties, and other property in the zoning district.
• Properties surrounding the subject site include an undeveloped commercial site to the
north, Sterling Village across Federal Highway to the east, older office developments to
the south and a park across S.E. 4th Street and the railroad to the west. The proposed
project is one of the first mixed use projects for this area of the City. It follows the goals
and direction set by the City for development along the Federal Highway corridor. It is
expected that with time, the properties to the north and south will also be
developed/redeveloped with similar mixed use projects. There is no adverse impact
expected on Sterling Village considering its location across the median separated
Federal Highway and that all vehicular access will be from S.E. 4th Street. Likewise there
will be no adverse impact on the park. Accordingly, this standard has been met.
9. Height of buildings and structures, with reference to compatibility and harmony to
adjacent and nearby properties and the city as a whole.
• As indicated above, this will be one of the first mixed use projects in this area and will
hopefully spark more similar development. The proposed facility complies with the
building height for this district. The building also complies with the Site Plan Exposure
requirements of the district. Accordingly, this standard has been met.
10. Economic effects on adjacent and nearby properties, and the city as a whole.
• An intent of the City to adopt and implement the Mixed Land Use and Zoning is to allow
for redevelopment of the Federal Highway Corridor which hopefully revitalizes the
economic growth of this area of the City. it is only anticipated for the development of
this project to be an economic benefit to the immediate area and the City as a whole.
Accordingly, this standard has been met.

11. Conformance to the standards and requirements which apply to site plans, as set forth
in Chapter 4 of the City of Boynton Beach Land Development Regulations.
