Minutes 03-16-11 MINUTES OF THE CODE COMPLIANCE BOARD MEETING HELD ON WEDNESDAY, MARCH 16, 2011, AT 6:30 P.M. IN CITY COMMISSION CHAMBERS, BOYNTON BEACH, FLORIDA PRESENT: Michele Costantino, Chair Richard Yerzy, Vice Chair James Brake Robert Foot Kirk LaRock Aimond Alexis, Alternate Barry Ravel, Alternate Scott Blasie, Code Compliance Administrator Shana Bridgeman, Assistant City Attorney ABSENT: Kathleen Carroll I. Call to Order Chair Costantino called the meeting to order at 6:32 p.m. II. Approval of Agenda Mr. Foot requested including a discussion about minutes distribution procedures. Vestiguerne Pierre, Senior Code Compliance Officer, announced the following: Case No. 10-3288 was closed. Case Nos: 11-189 and 11-237 came into compliance. Case Nos: 11-102, 11-103, and 11-161 were removed. Motion Mr. Foot moved to approve the agenda as amended. Vice Chair Yerzy seconded the motion that unanimously passed. IV. Swearing in of witnesses and introduction Attorney Bridgeman explained the hearing procedures. The Recording Secretary administered the oath to all who would be testifying. 1 Meeting Minutes Code Compliance Board Boynton Beach, FL March 16,2011 Officer Pierre called the roll and determined who was present. Case No.1 0-3259 Property Address: Violation( s): 1300 West Industrial LLC 1370 W. Industrial Ave 108 LOR CH2 SEC. 4(N) CO CH13 SEC. 13-16 Repair and keep screen up to contain dust inside your bay. Business Tax Receipt needed to operate a business within the City. Officer Pierre presented the case as contained in the Notice of Violation. The Respondents were present. Jeff Ringold, 600 S. Dixie Highway, agent for the owner and authorized to speak on their behalf, pled not guilty. Officer Pierre circulated photographs to the Respondent and Board. He indicated the tenant cut into a wall to get into another bay without a permit. He was unsure if it was a firewall. The Building Inspector visited the premises and the inspection failed. Officer Pierre explained without a permit, they cannot obtain a Business Tax Receipt . Mr. Ringold testified this is the first time the wall became an issue. Previously, his concerns were the dust and Business Tax Receipt. He advised Mr. Kitchen filed for the Business Tax Receipt on March 9 and he completed a landlord-verification form for them on March 8. The issue with the cut through in the bay was not anticipated to be part of the case. He had documentation about it from five years ago, which he distributed to the members. It was a violation dating back to 2005 and he highlighted it was an open cut in a wall without a permit. Based on a letter from the Building Department, the case complied and the wall openings were permitted the letter was dated May 2006 and he understood it was resolved. Mr. Ringold distributed additional information to the Board members. After discussion, Chair Costantino suggested tabling the case to the next meeting. She wanted to see a permit and wanted to give the City the opportunity to review the information about the permit to see if it can be resolved. Motion Mr. LaRock moved that the aforementioned case be tabled until the Code Compliance Board meeting to be held on April 20, 2011. Mr. Ravel seconded the motion that unanimously passed. Case No. 11-253 Property Address: Violation( s): Michael and Jana Wood 803 NW 11 th Street CO CH14 SEC. 14-3 2 Meeting Minutes Code Compliance Board Boynton Beach, FL March 16, 2011 Vehicles over one ton not allowed to park in a residential zoning district. Officer Pierre presented the case as contained in the Notice of Violation. The vehicle could not be parked in a residential zoning district. The respondents were present: Michael Wood, 803 NW 11 th Street, pled not guilty. Jana Wood, of the same address was present and pled not guilty as well. Officer Pierre testified there is a one-ton truck in Sky Lake that was the subject of many complaints. It is not allowed. He had a photo of the truck, which he distributed to the Board. Mr. Wood explained he purchased the truck in 2008 and has been parking it there since then. He asked the Homeowner's Association of Sky Lake about parking the vehicle there and he inquired of his neighbors if they had objections. The truck was classified as a one and a quarter-ton truck. It fit in the driveway. One person complained constantly about the truck. Multiple letters, signed by the neighbors, indicated they had no problems with it. It met the Association's requirements. The rules also stated the tonnage had to be a towing weight. Chair Costantino inquired if the Code supersedes all Homeowner's Association rules. Attorney Bridgeman advised if the roads were City roads Attorney Bridgeman explained as long as the subdivision is not a private community and it is in a public city street area, then City Code applies. If it were a private or gated community, it would be different. Mr. Woods distributed information from the Homeowners rules and letters of support from the neighbors. Jason Weinrich 1205 NW 13th Avenue, was the acting Vice President of the Association. He commented the subdivision was a private community, but he did not know about the roads. At one point, the Board wanted to gate the community, but he indicated the City maintains the roads. Chair Costantino commented then it was a clear Code violation. Mr. Brake inquired if the Code, as it was written, referenced the hauling weight or the weight of the truck. Pete Roy, Chief Code Compliance Officer, commented the configuration on the truck reflects it weighs a ton and a quarter, which is what the Officers use in determining if the vehicle was permitted or not. The Code states the weight cannot exceed one ton. It is over that weight. It was explained the Respondents would have to appear before the Commission if they want to increase the weight restriction. 3 Meeting Minutes Code Compliance Board Boynton Beach, FL March 16, 2011 Mr. Woods inquired if they could obtain a variance and was referred to the City Commission. He then inquired if he did park at his driveway for a few minutes and a Code Compliance Officer drives by, if he was going to be fined each time. His business is in the City and he cannot just buy another truck if his present one is not allowed in the neighborhood. Officer Pierre responded the Code only allowed for parking the vehicle at the premises for 15 minutes. Mr. Woods understood there was nothing he could do. The vehicle cannot fit in the garage. Chair Costantino suggested he park the vehicle off site. Ms. Wood commented when they received the violation letter they went to their neighbors. Vice Chair Yerzy commented they have to abide by the Code only. She indicated when they purchased the truck, they checked with the Homeowners Association. Ms. Woods thought it was selective enforcement as there are many trucks in the community. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Foot moved that this Board find that Michael and Jana Wood are in violation of the City of Boynton Beach Code section cited and moved to Order that the Respondents correct the violation on or before April 15, 2011. The Board has considered the gravity of the violation, the actions taken by the Respondents and any previous violations by the Respondents and hereby orders that if the Respondents do not comply with this Order, a fine in the amount of $50 per day for each day the violation continues past April 15, 2011 plus administrative costs shall be imposed. The Respondents are further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re-inspection of the property to verify compliance with this Order. Vice Chair Yerzy seconded the motion that unanimously passed. Mr. Weinrich commented they investigated becoming a gated community. He inquired if they changed the community to a gated community and took possession of the roads, if the truck would be allowed and if it superseded the Code. Chair Costantino referred them to the City Commission. Case No. 11-338 Property Address: Violation( s): Elisha Harris 422 NE 12th Avenue CO CH13 SEC. 13-16 CO CH15 SEC. 15-120(0) Inc. Remove outside storage of items not actively used from public view. Obtain Business Tax Receipt for rental property. 4 Meeting Minutes Code Compliance Board Boynton Beach, FL March 16, 2011 John Herring, Code Compliance Officer, presented the case on behalf of Willie Webb, Senior Code Compliance Officer. Officer Herring presented the case as contained in the Notice of Violation. The case was a routine inspection. Written notice was sent February 8, 2011 giving 10 days. Notice was posted on March 3, 2011. Certified mail was sent and the green card was signed on March 7, 2011. The storage items complied; only the Business Tax Receipt remained outstanding. The Respondent was present. Elisha Harris, 2944 Bolton Court, pled not guilty. Officer Herring inquired if Mr. Harris was renting the property. Mr. Harris testified his handyman was in the premises fixing the dwelling. He was unemployed for a while and Mr. Harris planned to enter into a contract with him. He cleans up, mows and does repairs to other properties he has. The handyman makes the repairs in lieu of paying rent. He was unaware he needed a Business Tax Receipt to permit someone to live in his home. Mr. LaRock inquired if he was providing one of his employees with housing. Mr. Harris responded it was a friend he has known all his life and he would soon have a rental contract. Chair Costantino explained the Business Tax Receipt provides for an inspection to ensure all safety issues are addressed. The inspection is for the benefit of the landlord and the tenant. Mr. Harris agreed to comply and commented he just got caught up and let someone store something at the premises, but he addressed it with the handyman and Officer Webb. Mr. Brake inquired if there were other rental properties and advised he would need a Business Tax Receipt for them also. Mr. Harris receives inspections from the Delray Beach Housing Authority. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. LaRock moved that this Board find that Elisha Harris is in violation of the City of Boynton Beach Code sections cited and moved to Order that the Respondent correct the violations on or before April 15, 2011. The Board has considered the gravity of the violations, the actions taken by the Respondent and any previous violations by the Respondent, and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $100 per day for each day the violations continue past April 15, 2011 plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re- inspection of the property to verify compliance with this Order. Vice Chair Yerzy seconded the motion that unanimously passed. Case No. 09-2909 High Ridge Properties 640 E. Ocean Avenue 5 Meeting Minutes Code Compliance Board Boynton Beach, FL March 16, 2011 Officer Herring presented the case as contained in the Notice of Violation. The violation occurred on September 9,2009 having to do with unpermitted signs. No one appeared at the hearing and a compliance date of October 26, 2009 or incur a fine of $250 per occurrence was established. An occurrence was documented on February 4,2011. Cyd Fender, 1370 Parktridge Place North, was an owner of High Ridge Properties. She testified one of the tenants, the Fancy Flamingo, held an event and had parking in the rear. She did not know they needed a permit. The tenant was advised to put the sign in the parking lot, but the tenant's assistant put it by the sidewalk. Fancy Flamingo made a mistake. Ms. Fender advised in the future they will apply for a Special Events permit and was currently working with the Building Department. Officer Herring had photographs he reviewed with the Respondent and the Board. Ms. Fender confirmed that was the sign and the sign did not say anything about parking. Mr. Foot commented a prior issue with Franky's, a tenant at the same center, does not help. There have been too many signs on the property in the past Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Foot moved that this Board find that the Respondent has not complied with this Board's Order dated October 21, 2009, and having considered the gravity of the violation, the actions taken by the Respondent, that this Board impose and certify a fine in the amount of $250 for that occasion plus administrative costs or until a judgment is entered based upon this certification of fine. Mr. LaRock seconded the motion Mr. Brake inquired if the owner of the Fancy Flamingo was aware that the property had a problem with the signs in the past. He was aware the tenant was fairly new. Ms. Fender responded she did not. Ms. Fender tried to help her, but her assistant put the sign in the wrong place. There was too much going on and there was much confusion. Officer Herring clarified Mr. Blasie did call and let the operator know that the way they were cordoning off the parking lot was not allowed. They needed a permit. The signs were not allowed and he advised Mr. Fender that the Board would address a Cease and Desist Order. A vote was taken on the motion and unanimously passed. Case No. 11-267 Property Address: Violation( s): 1950 Congress Ave. LLC - Styles for Less 910 N. Congress Avenue 140 Fire inspection annual fees. Deanna Richardson, Administrative Associate, presented the case as contained in the Notice of Violation. Staff recommended 10 days be given to comply. 6 Meeting Minutes Code Compliance Board Boynton Beach, FL March 16, 2011 Motion Based on the testimony and evidence presented in the aforementioned case, Mr. LaRock moved that this Board find that 1950 Congress Ave. LLC is in violation of the City of Boynton Beach Code Section as cited, and moved to order that the Respondent correct the violation on or before March 26, 2011. The Board has considered the gravity of the violation, the actions taken by the Respondent, and any previous violations by the Respondent, and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $100 per day for each day the violation continues past March 26, 2011 plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re-inspection and verification of payment of the fees to comply with this Order. Property Address: Violation( s): Ms. Richardson presented the case as contained in the Notice of Violation. Staff recommended 10 days be given to comply. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Foot moved that this Board find that Southern Homes of Palm Beach LLC is in violation of the City of Boynton Beach Code Section as cited, and moved to order that the Respondent correct the violation on or before March 26, 2011. Ms. Richardson presented the case as contained in the Notice of Violation. Staff recommended 10 days be given to comply. It was noted the Respondents were repeat violators. Staff recommended 10 days be given to comply. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. LaRock moved that this Board find that FPM Twenty Ten LLC is in violation of the City of Boynton Beach Code sections cited and moved to Order that the Respondent correct the violations on or before March 26, 2011. The Board has considered the gravity of the violations, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $150 per day for each day the violations continue past March 26, 2011 plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re- inspection of the property to verify compliance with this Order. Mr. Alexis seconded the motion that unanimously passed. Case No. 11-199 Deutsche Bank National Trust Co. (440 Ocean Pkwy) 440 Ocean Parkway CO CH15 SEC. 10-51.5 1 Inc. Property that is vacant or subject to default must be registered with the City and maintained per City Code. Mow overgrown yard, trim overgrown bushes and remove tires in the swale. Install a proper pool barrier to secure the pool. Secure doors and windows. Property Address: Violation( s): Officer Guillaume presented the case as contained in the Notice of Violation. Staff recommended 10 days be given to comply. The pool was unsecured. The property was not registered. When originally cited, the Respondent sent an attorney; however, the property was still unregistered and there may be a fine already accruing. (440 Ocean Pkwy) is in violation of the City of Boynton Beach Code section cited and moved to Order that the Respondent correct the violation on or before March 26, 2011. The Board has considered the gravity of the violation, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $1 ,000 per day for each day the violation continues past March 26, 2011 plus administrative costs shall be imposed. Industrial Ave. Motion Vice Chair Yerzy moved that the aforementioned case be tabled until the Code Compliance Board meeting to be held on May 18, 2011. Mr. Alexis seconded the motion that unanimously passed. The following Fine Certification case was reconsidered: Case No. 09-1227 Boynton Plaza 111 N. Congress Avenue Officer Herring explained this case was not supposed to have been certified. The Respondents complied before the date. They obtained the permit but he thought it was supposed to be finalized. It was his mistake as the Respondent did what they were supposed to do in the allotted time. Mr. L3Rock seconded the motion th3t un3nimously p3ssed. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Brake moved that this Board find that the Respondent has not complied with this Board's Order dated October 20, 2010 and havinq considered the qravity of the violations, the actions taken by the Respondent, that this Board impose and certify a fine in the amount of zero dollars per day plus administrative costs which shall continue to accrue until the Respondent comes into compliance or until a iudqment is entered based upon this certification of fine. Mr. LaRock seconded the motion that unanimously passed. Mr. Foot requested when the minutes are distributed electronically, the members be notified that they are available on the internet. Chair Costantino explained normally the minutes are emailed as an attachment. Chair Costantino explained there was information about the Code Enforcement Board Member's workshop. If members were interested in attending, it would be at their own expense and they would be responsible for making their own reservations. Chair Costantino also called attention to the change on the agenda where the page numbers are the first items listed. A Lien Reduction meeting was scheduled for Monday. Mr. Brake advised he would not make the meeting. Chair Costantino requested the members alert her if they were unable to attend.
