February 3, 2011
Andrew Mack, Interim Building Official, explained the application and the fact that a time extension was
granted to the applicant in the past. The City is in favor of this request for a time extension of one year.
The Recording Secretary administered the oath to all those intending to testify.
William David Poist, Sr., ,President of C 1 Construction and Director of Development for
Compson, said this was the second' request for a time extension. He appreciated the Board's
cooperation since this is a very difficult economy. He is hopeful they will be able to move forward with
Compson Place Apartments within the next 90 days when the firm letter from HUD is received. With
regard to the parcels on the opposite side of the canal, Sembler sold their portion and one parcel will
probably move forWard within the year. There is no market for the other parcel at this time.
In response to Ms. Agee, Mr. Poist explained a "firm letter". HUD goes through site planning, site
analysis and a recommen<;lation based on appraisal and income flow. The numbers are then agreed upon
and the application goes forward'from Jacksonville to Miami and onto Washington, D.C. for the issuance
of a "fir!'n letter" which is a commitment to develop and fund. This will be an affordable housing project
including some retail on the ground flo.or with space for ADA and handicapped. It is a different type of
use.
Mr. Rurey referred to the permit, numbers and inquired if the permits were six years old. Mr. Mack
responded affirmatively.

Ms. Agee moved to approve. The motion was seconded. The Recording Secretary called the roll. The
vote was 4-1. (Mr. Rurey dissented.)

This is a petition to have a building department penalty reduced to a reasonable
amount as deemed by the Building Board of Adjustment and Appeals.
Cross Fit Boynton Beach was fined $9,413.67 for commencing a build out at 975
Gateway Boulevard, Suite 106 after building permit was applied for but before it
was granted. The timeline is as follows:

The reasons for which the appeal is taken and a definite and detailed statement of
relief sought from the Building Board of Adjustment and Appeals is as follows:
Cross Fit Boynton Beach hired Polo Construction to build out a new Cross Fit gym at
Quantum Village, the Publix strip mall at Gateway and 1-95. Unfortunately, Polo
Construction began the build out after applying for the building permit but before
obtaining the permit. As spon as the premises was red tagged, all construction
immediately stopped and the fine was paid promptly and in fulL Construction was
completed without further issues, a CO was obtained, the gym is now open, and it is
a beautiful gym that is an asset to the City of Boynton Beach.
John Kay of Polo Construction submitted a Permit Penalty Fee Waiver to the
Building Department. Upon his recommendation, he met privately with Andrew
Mack, Interim Department Head, to argue our petition. It was denied.
Quantum Viilage strip mall is in receivership. Much of the mall is unoccupied. In the
building where CrossFit Boynton Beach is locat~d, both bays on either side of the
gym are vacant and not built out. CrossFit Boynton Beach is bringing valuable
business to a mall that is in financial distress and to a location that needs tenants. A
fine of nearly $10,000 severely threatens Cross Fit Boynton Beach's ability to survive
by consuming a substantial amount of the business' working capital and marketing
budget. It is potentially bankrupting during the critical early months of the new
"
business, when the fine monies could instead be used to market, grow, and establish
, Cross Fit Boynton Beach in the community.
Please consider some of the intangibles that Cross Fit Boynton Beach brings to
Boynton., The gym is an active member of the Chamber of Commerce. The gym
,offers a 33% discount to all police, fire fighters, and first responders (and have many
members from those communities. In fact, one of our coaches is a Boynton police
officer, soon to be detective). CrossFit Boynton Beach has built a state of the art
fitness facility that strives to help Boynton citizens improve their health and fitness.
Enclosed please find a picture of the exterior and the interior of Cross Fit Boynton
Beach. The City can be proud of this beautiful, new facility.
Cross Fit is a global phenomena. In 2007 there were approximately a dozen Cross Fit
gyms in the US. There are now over 2,000 in the US alone and many others
throughout the world. This explosive growth has occurred because Cross Fit is an
exceptional training regimen thatis fun and that works. It works because it is high-
intensity, short-duration training. It's fun because the work outs change every day
and because it is practiced in coach led classes, and it's simply more fun to work out
in a group than alone. Cross Fit is transformational for many of it's practitioners.
Crossfitters tend to become truly fit and very devoted. In fact, most crossfitters seek
out local' Cross Fit gyms when they travel, and having a Cross Fit in Boynton will
support tourism from the growing ranks of crossfitters.
Additionally, Cross Fit gyms traditionally perform charity events. Cross Fit Delray
Beach, for example, holds charity events to benefit the Milagro Center. We plan to
hold similar charity events as well.
In summary, we respectfully request that the Board considers reducing the fine so
that CrossFit Boynton Beach can continue to operate in Boynton and provide tax
revenues for the City and a valuable service for the community.

Owner Builder Disclosure Statement (489.103 FS.)
To Qualify for the ownerlbuilder exemption in Florida Statute 489.103 (7) (b), an owner must personally appear and shm the
buildinl! permit application. State law requires construction to be done by licensed contractors. You have applied for a permit under an
exemption to that law. The exemption allows you, as the owner of your propeny, to act as your own contractor with certain restrictions even though
you do not have a license. You must provide direct, onsite supervision of the construction yourself. You may build or improve a one- family or two-
family residence or a farm outbuilding. You may also build or improve a commercial building, provided your costs do not exceed $75,000. The
building or residence must be for your own useor occupancy, It may not be built or substantially improved for sale or lease. If you sell or lease a
building you have built or substantially improved yourself within] year after the construction is complete, the law will presume that you built or

Section 108;5 of the Boynton Beach Amendments to the 2007 Florida Building Code
I. WAIVER APPLlCA TION REQUIREMENTS
A. The following submissions are required prior to review of a request for administrative
waiver of a permit penalty fee: .
1. A completed waiver application
2. Payment of $35 review fee
3. A notarized statement verifying that one or more of the following conditions
justify granting a waiver:
a. Codes are unclear regarding permit requirements
b. Applicant has riot previously applied for an admInistrative waiver
c. Construction work stopped prior to initial inspection
d. Construction work was necessary for the immediate protection of life or
property
e. Proof is established that a Building' Division representative advised
applicant that a permit was not required
f. Proof is estab,lished that the applicant is an individual who has recently
relocated to Boynton Beach from a jurisdiction without strict building code
enforcement and possessed no knowledge of building code requirements
g. Construction work was completed prior to current occupancy or
ownership. '

II. CONDITIONS OF REVIEW AND NOTIF/CA TION
A. Based on a complete and documented request for administrative waiver of permit
penalty fees, the BUilding Official may waive part or the entire fee so as to
equitably and uniformly enforce the spirit of the construction codes of the City of
Boynton Beach. Submittal of this waiver form does not guarantee that the penalty
fee will be waived.
B. The Building Official will promptly notify the applicant in writing at the address
provided on the application of any decision reached regarding waiver
deliberations.

A. An applicant may appeal the decision of the Building Official to the Building
Board of Adjustment and Appeals.

4:21 pm and apologized, He assured me that he has stopped the
construction and stated that he made a bad business decision by starting
without a permit. He admitted to me that the tenant was anxious
for the work to begin prior to a permit and agreed that if caught, the
business owner would be responsible for any additional fees.

with me and Andrew Mack, Interim Building Official in Mr. Mack's
office, Mr. Kay reiterated to us that he made a bad business decision
but the tenant wanted him to proceed with the waiver process. Please note
that on page I of Exhibit E that line item "H" is not part of this document and was
hand written by the applicant.
Andrew Mack politely advised that he does not qualify for
penalty relief based on the information provided and it was denied,
One thing should be acknowledged is that the penalty fee is a result of the contractor's negligence by
commencing work without first obtaining the required permits, clearly a violation of the law. The
contractor, not the tenant is responsible for such penalty fees. This a violation of City Ordinance No. 09-
016 and subject to the penalties imposed as prescribed in the Boynton Beach Administrative Amendments
to the 2007 Florida Building Code Section 108,5,
This department felt that this issue was resolved when the contractor made his apologies, fees were paid
and pennit was issued, The contractor Mr. Kay is aware that I had the option but withheld reporting this to
the Department of Business and Professional Regulation who would impose additional fines, discipline the
contractor and leaving record on his professional license,
In closing, based on the information provided and in my opinion on behalf ofthe Building Division, the
only reason that the business owner paid for the penalty fees is because this was
a result of their business arrangement which is clearly in violation ofthe law, In the contractor's
own words, he made a bad business decision and this should be resolved between the contractor and his
customer.

To Qualifv for the ownerlbuilder exemption ill Florida Statute 489.103 (7) (b), an owner mllst personally appear and shm the
buildinj! permit application, State law requires construction to be done by licensed contractors. You have applied for a permit under an
exemption to that law, The exemption allows you, as the owner of your property, to act as your own contractor with certain restrictions even though
you do not have a license, You must provide direct, onsite supervision of the construction yourself. You may build or improve a one-family or two-
family residence or a farm outbuilding, You may also build or improve a commercial building, provided your costs do not exceed $75,000. The
building or residence must be for your own use or occupancy. It may not be built or substantially improved for sale or lease. If you sell or lease a
building you have built or substantially improved yourself within 1 year after the construction is complete, the law will presume that you built or
substantially improved it for sale or lease, which is a violation of this exemption, You may not hire an unlicensed person to act as your contractor or
to supervise people working on your building. It is your responsibility to make sure that people employed by you have licenses required by state
law and by county or municipal licensing ordinances. You may not delegate the responsibility for supervising work to a licensed contractor who is
not licensed to perform the work being done. Any person working on your building who is not licensed must work under your direct supervision
and must be employed by you, which means that you must deduct F.I.C.A. and withholding tax and provide worker's compensation for that
employee, all as prescri by law. Your construction must comply with all applicable laws, ordinances, building codes, and zoning regulations.

The Building Official decision being appealed is the denial of the "Permit Penalty Fee
Waiver" application ofJanuary, 19th, 2011.
This is a petition to have a building department penalty reduced to a reasonable
amount as deemed by the Building Board of Adjustment and Appeals.
CrossFit Boynton Beach was fined $9,413.67 for commencing a build out at 975
Gateway Boulevard, Suite 106 after building permit was applied for but before it
was granted. The timeline is as follows:

The reasons for which the appeal is taken and a definite and detailed statement of
relief sought from the Building Board of Adjustment and Appeals is as follows:
CrossFit Boynton Beach hired Polo Construction to build out a new Cross Fit gym at
Quantum Village, the Publix strip mall at Gateway and 1-95. Unfortunately, Polo
Construction began the build out after applying for the building permit but before
obtaining the permit. As soon as the premises was red tagged, all construction
immediately stopped and the fine was paid promptly and in full. Construction was
completed without further issues, a CO was obtained, the gym is now open, and it is
a beautiful gym that is an asset to the City of Boynton Beach.
John Kay of Polo Construction submitted a Permit Penalty Fee Waiver to the
Building Department. Upon his recommendation, he met privately with Andrew
Mack, Interim Department Head, to argue our petition. It was denied.
Quantum Village strip mall is in receivership. Much of the mall is unoccupied. In the
building where Cross Fit Boynton Beach is located, both bays on either side of the
gym are vacant and not built out. Cross Fit Boynton Beach is bringing valuable
business to a mall that is in financial distress and to a location that needs tenants. A
fine of nearly $10,000 severely threatens Cross Fit Boynton Beach's ability to survive
by consuming a substantial amount of the business' working capital and marketing
budget. It is potentially bankrupting during the critical early months of the new
business, when the fine monies could instead be used to market, grow, and establish
CrossFit Boynton Beach in the community.
Please consider some of the intangibles that Cross Fit Boynton Beach brings to
Boynton. The gym is an active member ofthe Chamber of Commerce. The gym
offers a 33% discount to all police, fire fighters, and first responders (and have many
members from those communities. In fact, one of our coaches is a Boynton police
officer, soon to be detective). CrossFit Boynton Beach has built a state of the art
fitness facility that strives to help Boynton citizens improve their health and fitness.
Enclosed please find a picture of the exterior and the interior of Cross Fit Boynton
Beach. The City can be proud of this beautiful, new facility.
CrossFit is a global phenomena. In 2007 there were approximately a dozen Cross Fit
gyms in the US. There are now over 2,000 in the US alone and many others
throughout the world. This explosive growth has occurred because CrossFit is an
exceptional training regimen that is fun and that works. It works because it is high-
intensity, short-duration training. It's fun because the work outs change every day
and because it is practiced in coach led classes, and it's simply more fun to work out
in a group than alone. Cross Fit is transformational for many of it's practitioners.
Crossfitters tend to become truly fit and very devoted. In fact, most crossfitters seek
out local Cross Fit gyms when they travel, and having a Cross Fit in Boynton will
support tourism from the growing ranks of crossfitters.
Additionally, Cross Fit gyms traditionally perform charity events. Cross Fit Delray
Beach, for example, holds charity events to benefit the Milagro Center. We plan to
hold similar charity events as well.
In summary, we respectfully request that the Board considers reducing the fine so
that CrossFit Boynton Beach can continue to operate in Boynton and provide tax
revenues for the City and a valuable service for the community.

Crossfit Craze Hits Boynton
Crossfit, the global fitness phenomena, has arrived in Boynton Beach. It started in a
California garage and in 4 years has gone from about a dozen to over 2,000 Crossfit
gyms in the US, plus many world wide. The US Military, police departments, and
firefighters have embraced it. And now regular people are getting in the best shape
of their lives with it. What's driving this underground fitness craze that's developed
a cult like following? "It's fun, it works, it's addictive," says Crossfit Boynton Beach
founder and head coach Rob Labar.
A Crossfit gym has little in common with a convention gym. Members work out in
coach led classes. The hour long classes include a warm up, skills and technique
training, and the WOD (Work Out of the Day). WODs usually last 15-20 minutes and
are high intensity. The WOD changes every day and a particular WOD is usually not
repeated for months, if at all. WODs incorporate a few different exercises each day
in different combinations. Examples of exercises are olympic lifts, box jumps, pull
ups, sit ups, kettle ball swings, push ups, sprints, tire flips, medicine ball tosses, dips,
air squats, rope climbs ... and many others. All the exercises are scalable to an
individual's fitness level and limitations; anyone can participate. Technique and
safety are emphasized.
"The variety of exercises and the group dynamic of the class make it fun, the high
intensity makes it effective," states member Andres Sasson, MD, an ER Doctor.
"Crossfitters get amazing results because the principles of Crossfit - variety, high
intensity, functional movements - are based on state-of-the-art exercise science,"
says Dr. Sasson. "And because it's fun," adds Rob Labar.
Crossfit Boynton Beach recently opened on the corner of 1-95 and Gateway, in the
Publix shopping center next to Firehouse Subs. Classes start at 6am and run
through 7:30pm. There is onsite daycare. Crossfit Boynton Beach offers a one week
free trial to all prospective members.
A Grand Opening is being held on Saturday, March 19th, from 1-3pm, and is open to

The Cross Fit Games is an International, annual event that is currently underway. In
2007 CrossFit launched its' first 'CrossFit Games' in California, and had
approximately 100 athletes participate in the event The event took pace at a ranch
in a field.
In 2011, the CrossFit Games currently has over 20,000 athletes, from various
countries, competing to find the worlds fittest athlete. The final event will take
place in CA in July, and will be narrowed down to 60 male and 60 female athletes.
Rebok has stepped in and become the major sponsor, and will be contributing
$1,000,000 in prize money. The event will take place at the Home Depot Center in
LA.
Cross Fit brings community together. CrossFit is weightlifting, meets gymnastics,
meets endurance training.
Rob LaBar's involvement with the Cross Fit Games helps lends credibility to Cross Fit
Boynton Beach and helps to bring Boynton Beach to the map.
Rob recently had an article published about Jose Lajara, one of its members at the
gym. Jose weighed 350 pounds a little over 1 year ago, Jose is 150 pounds lighter
and is now competing in the Cross Fit Games. This article was published in the
Cross Fit Games web site, and is seen worldwide by hundreds of thousands of people.
Rob LaBars goal with CrossFit Boynton beach is to build a sense of community and
fitness to the area.
The trainers at Cross Fit Boynton Beach consist primarily of Police and Firemen. This
includes Detective Dan Dugger from the BBPD and Brent Tracy from BBFD.

My experience with Crossfit has been a life changingjoumey, I was introduced to
Crossfit by my friend Henry. Before I use to go to a regular gym and use to spend 2 to 3
hours in the gym working out the different body parts while trying to find out healthy
ways of eating on my own. I use to weigh approximately 350 pounds, and my friend told
me I'm going to show you a way to lose weight, eat a certain way, and you will never be
the same.
Absolutely, I am now weighing 216 pounds, I went from a size 44 - 46 pants to a size 32
skinny, I went from a 5x - 6x shirt, to a large. On the other hand, the Crossfit community
is outstanding, its like their is not a way to go wrong, your surrounded by people who
have your same extreme interest, who want to push themselves 150% just like you do.
Who talk about there KELLY, CINDY, FRAN, KAREN, JACKIE, FIGHT GONE BAD
Workouts, and the ways you can improve them on a daily basis, which are a combination
of movements called benchmark, which measure you progress.
The biggest change that Crossfit has assisted me in is my eating habits, I went from
eating a 20 piece chicken mcnugget, Supersize fries, Supersize Milkshake, Apple pie, and
whatever crazy things I could be feeling for from Mc D's on any given day; to eating
strictly Paleo. I do not know about you, but when you see men and women working out,
doing handstand pushup, burpess, butterfly pull ups, and all these other amazing complex
movement then all you can do is ask and be interested in what they are doing to have the
same results.

Applicant: Victor Andres Sasson, Managing Member
ORDER DENYING APPEAL
The Appeal filed by Victor Andres Sass (hereinafter referred to as "Applicant") was
submitted to the City's Building Board of Adjustment and Appeals on February 16,2011. The
Applicant was appealing the Interim Building Official's Disapproval of the Permit Penalty Fee
Waiver in Section 108.5 ("Permit Penalty Fee Waiver") of the City of Boynton Beach
Administrative Amendments to the 2007 Florida Building Code.
The City's Building Board of Adjustment and Appeals (hereinafter referred to as the
"Board") reviewed the testimony and evidence provided by the Chief Field Inspector, Karl
Swierzko, and the arguments of Applicant, and orders as follows:
FINDINGS OF FACT
1. The Board makes the following preliminary findings:
The Applicant applied for a Building permit on November 1, 2010. The
contractor began the build out after applying for the building permit but
before the permit was issued. A stop work order was issued on November
17, 2010. The Building Permit was issued on December 6, 2010 after
payment of a penalty fee of $9,413.67 was paid. The project received the
Certificate of Occupancy on January 13, 2011. A penalty waiver was
submitted by the Contractor, Mr. Kay on January 19, 2011, but the request
was denied by the Interim Building Official as not qualifying for the relief.
The Applicant is requesting a waiver or reduction of the Permit Penalty
Fee pursuant to Section 108.5 ("Work Commencing Before Permit
Issuance") of the Boynton Beach Administrative Amendments to the 2007
Florida Building Code.
CONCLUSION AND ORDER
1. After review of the record before the City's Interim Chief Building Official, the
recommendations and comments of the City's Interim Chief Building Official and Chief Field
Inspector, the Applicant's testimony and evidence, the Board hereby determines that the City
correctly applied the applicable Code sections.
2. Pursuant to the authority of the Boynton Beach Amendments to the 2007 Florida
Building Code, as adopted by the City of Boynton Beach, the Board hereby DENIES the
Applicant's request for a Permit Penalty Fee Waiver pursuant to Section 108.5 ("Work
Commencing Before Permit Issuance") of the City of Boynton Beach Administrative
Amendments to the 2007 Florida Building Code.
3. The public record, including, but not limited to, the Interim Chief Building
Official's reports, memoranda, comments, and recommendations on the appeal, agenda back-up
before the Building Board of Adjustment and Appeals, along with the record established before
the Building Board of Adjustment and Appeals on June 2, 2011, are hereby incorporated by
reference.
