PRESENT Harry "Dale" Hatch, Chair Janet Prainito, Secretary Bonnie Glinski Karilyn Norem Hohner Tom Balfe, Parks Manager Jody Rivers, Parks Superintendent 1. CALL TO ORDER Chair Hatch called the meeting to order at 6:00 p.m. 2. ATTENDANCE Secretary Prainito called the roll. The attendance is noted above. 3. AGENDA APPROVAL Secretary Prainito requested the addition of New Business, Item H. - Ratify Disinurnment of Cremated Remains of Betty Tenety from Lot 217, Replat, Boynton Beach Memorial Park. It was noted that the Board had been polled on Items C through H; therefore, they would be ratifications rather than approvals. Secretary Prainito requested that Unfinished Business, Item E, be stricken from the agenda as it was already included in the Cemetery Rules & Regulations. Ms. Glinski also referred to Future Agenda Item B, noting that it should also be stricken from the agenda. Mr. Hatch requested the addition of an item under Other - Item A, Status Report on Fountain. Motion Ms. Glinski moved to approve the agenda as amended. Ms. Hohner seconded the motion that carried unanimously. 4. APPROVAL OF MINUTES - June 10, 2010 Motion Ms. Glinski moved to approve. Ms. Hohner seconded the motion that carried unanimously. 1 MEETING MINUTES CEMETERY BOARD BOYNTON BEACH, FL SEPTEMBER 9, 2010 5. RECEIPT OF REVENUE/EXPENSE SHEETS - May, June, July & August 2010 Motion Secretary Prainito moved to place these reports on file. Ms. Glinski seconded the motion that carried unanimously. 6. RECEIPT OF SALES REPORTS - June, July & August 2010 Motion Secretary Prainito moved to place the reports on file. Ms. Glinski seconded the motion that carried unanimously. 7. UNFINISHED BUSINESS A. Parks Division Reports - March, June, July & August 2010 Mr. Balfe reviewed the Parks Division reports for the months noted. B. Reconsideration of prices for crypts at Boynton Beach Mausoleum (Tabled) Motion Secretary Prainito moved to remove this item from the table. Ms. Glinski seconded the motion that carried unanimously. Secretary Prainito recalled at the Board meeting in December, the motion did not include crypt prices. The prices set were for niches only. Ms. Rivers disseminated a handout and reviewed it with the Board. It included comparative information from six facilities. An average of each category was run. The price for Level D was derived by averaging the lowest and highest prices. Regarding the niches, Secretary Prainito referred to the December 10th meeting minutes wherein the recommended prices were established as follows: .-, MEETING MINUTES CEMETERY BOARD BOYNTON BEACH, FL SEPTEMBER 9, 2010 Levels A through D - $1,000 Levels E through F - $1,500 Levels I through L - $700 The members were reminded that the niche prices would include opening and closing, and etching. The prices for the crypts would include opening & closing, sandblast engraving and the tray (or two trays if it is a Companion or True Companion.) Motion Secretary Prainito moved to recommend to the City Commission to accept these recommended prices for crypts and niches at Boynton Memorial Park. Ms. Glinski seconded the motion that carried unanimously. C. Proposed Ordinance 10- _ Re: Providing for review of extenuating circumstances by the Cemetery Board (Tabled) Motion Secretary Prainito moved to remove this item from the table. Ms. Glinski seconded the motion which carried unanimously. Secretary Prainito recalled that at a previous Board meeting, this issue was discussed and not all of the members were comfortable with this Proposed Ordinance. There have been inquiries and questions received that staff felt could have legal repercussions and they were not comfortable making some of these decisions. The numerous questions that we were sending to the Legal Department have subsided; however, there are still circumstances that arise that we feel need Legal review and determinations. Chair Hatch recalled that the Board was not comfortable making these decisions either. Ms. Glinski was not any more comfortable now than she was in the past. Mr. Balfe was also of the opinion that staff should be able to pose these odd circumstances to the attorney and then report back to the Board. Ms. Rivers advised that this ordinance would empower the Board to make decisions that the member may not be comfortable making. Staff felt comfortable going directly to the City Attorney with special exceptions and then reporting back to the Board. Motion Secretary Prainito moved to not move forward with the Ordinance. Ms. Glinski seconded the motion which carried unanimously. D. Opening & Closing Fees for Boynton Beach Mausoleum (Tabled) Ms. Rivers referred to Page 3 of the June meeting minutes wherein there were pending legal issues with the Mausoleum and a suggestion that the fee be the same as an in-ground burial. However, there was discussion that since there was not as much work involved in opening and closing the 3 MEETING MINUTES CEMETERY BOARD BOYNTON BEACH, FL SEPTEMBER 9, 2010 Mausoleum, the fee should be reduced to $250. The members were further reminded that when crypts and niches were purchased from the previous agent, the opening and closing fee was included; however, that fee covered only one opening and closing. Therefore, it is necessary to establish this fee for situations involving additional openings and closings. A fee of $250 was recommended for weekdays, Saturdays and Sundays. Motion Ms. Glinski moved that the fee for Sunday through Saturday would be $250. Ms. Hohner seconded the motion that carried unanimously. E. Transfer Fees (Tabled) This item was stricken from the agenda during agenda approval. 8. NEW BUSINESS A. Establishment of an overtime fee at the Boynton Beach Mausoleum The overtime fee currently applies to any service that arrives after 3:00 p.m. The fee is $225 for in- ground services. However, there is no overtime fee for the Mausoleum. Ms. Rivers reminded the members that City staff covers the cemetery from Tuesday through Saturday. Existing staff can cover the cemetery on Monday without having the cemetery crew present. There is no reason for overtime costs until 3:00 p.m. The normal working hours are from 6:30 a.m. to 3:00 p.m. Overtime is incurred any time after 3:00 p.m. Monday through Saturday. Sundays and holidays are overtime days all day. It was suggested that there should be a cut-off time for the last scheduled service at the cemetery. After discussion, a decision was made to set the cut-off time for 3:30 p.m. and keep the overtime fee at $225. In this way, everyone would be out of the cemetery at 4:00 p.m. Motion Ms. Hohner moved to keep the $225 overtime fee and set the cut-off time of 3:30 p.m. for the cemetery/mausoleum operations so that everyone is out of the cemetery by 4:00 p.m. The overtime fee would kick in at 3:00 p.m., Monday through Saturday and all day on Sunday and holidays. Ms. Glinski seconded the motion which carried unanimously. B. Report of Replatting - Tom Balfe Mr. Balfe displayed Tract B of Boynton Beach Memorial Park. In looking at the Mausoleum, Tract B is the grassy strip area that runs by the main road going north and the road going to the Mausoleum along Woolbright Road. A surveyor platted the area and it would be possible to add 200 plots to the cemetery. With the Board's approval, there are plots running along the northwest corner that would be pre-vaulted and turned into double-down plots. Mr. Balfe would get additional information about double-down plots and bring it back to the next meeting. Palm Beach Memorial Park has some of 4 MEETING MINUTES CEMETERY BOARD BOYNTON BEACH, FL SEPTEMBER 9, 2010 these double-down plots in the center of the cemetery. They charge an additional $200 for those plots. That price would cover the double-down vault and allow for two burials in the one plot. Once this plat is approved, the only remaining free space would be the roads. This raised the issue of past discussions of extending the cemetery into Little League Park and the members were reminded that a previous City Commission made the decision that such an expansion would not occur. There was a consensus of the Board to move forward with the replat of Tract B. Secretary Prainito inquired if the Board wanted to consider discounted pricing for a crypt or niche that was previously used. While the members agreed that purchasers would have to be told the crypt or niche was previously used, there should not be a discounted price. C. Approve the request by Joseph Tramontana for a refund on Lot 470-A, Block W, Boynton Beach Memorial Park Addition #1. (Original price was $1,000 less 20% ($200) for a total refund of $800. D. Approve the request by Emily E. Bauta and Nelson Bauta for a refund on Lot 93 A&B, Block S, Boynton Beach Memorial Park Addition #1. (Original price was $750 less 20% ($150) for a total refund of $600. E. Approve the request by Raymond W. Sweet for a transfer of deed on Lots 313 Band 314 A&B, Block N, Boynton Beach Memorial Park to Boynton Memorial Chapel. ($25 transfer fee was paid.) F. Approve the request by Stormet Norem of Boynton Memorial Chapel for a transfer of deed on Lots 314 A&B, Block N, Boynton Beach Memorial Park to Jerry W. Ashworth. ($25 transfer fee was paid.) G. Approve the request by Robert Brooks Kelly POA for Robert Kelly (father) for a transfer of deed on Lot 75, Block F, Boynton Beach Memorial Park to Robert Brooks Kelly (son). ($25 transfer fee was paid.) H. Ratify disinurnment of cremated remains of Betty Tenety from Lot 217, Replat, Boynton Beach Memorial Park Motion Secretary Prainito moved to ratify Items C through H. Ms. Hohner seconded the motion which carried unanimously. The Board members agreed that it would not be necessary to include the entire backup on ratification items. 9. OTHER A. Status Report on Fountain Mr. Balfe reported that the fountain is now working and chlorine has been added. Ms. Glinski visited 5 MEETING MINUTES CEMETERY BOARD BOYNTON BEACH, FL SEPTEMBER 9, 2010 the cemetery and advised that the water and the fountain were green. Mr. Balfe agreed that staff would check on this situation. Additionally, the float valve was removed. The fountain runs from 7:00 a.m. until 7:00 p.m. and then shuts off. The two lights on the pillars are timed commensurately with the fountain. Chair Hatch was pleased to see the lights working. For information, Mr. Balfe said the water in the fountain is reclaimed water. 10. FUTURE AGENDA ITEMS A. City Attorney to review Code section on the Cemetery for the purpose of updating archaic language, and add definitions. The Board agreed that this item should be removed from the agenda. B. Discuss and make recommendation to the City Commission regarding a transfer fee for crypts and niches at Boynton Beach Mausoleum.
